		<section id="HB82CA3583C204E5482972A0D8141BBA5" section-type="section-one"><enum>1.</enum><header>Exemption from prohibitions for Alaskan Native articles containing migratory bird parts</header><text display-inline="no-display-inline">Section 2 of the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="HCDEB1D92C6234234914DB456E79AD238" style="OLC">
				<subsection id="H7248DB748787432897697F596CB08D22"><enum>(c)</enum><header>Exemption for authentic Alaskan Native articles of handicraft or clothing</header>
					<paragraph id="H00E1CFAE9C2B453FA063367DF160184B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provisions of this Act, nothing in this Act prohibits possession,
			 offering for sale, sale, offering to barter, barter, offering to purchase,
			 purchase, delivery for shipment, shipment, causing to be shipped,
			 delivered for transportation, transport or causing to be transported,
			 carrying or causing to be carried, or receiving for shipment,
			 transportation, or carriage, any authentic Alaskan Native article of
			 handicraft or clothing on the basis that it contains a nonedible migratory
			 bird part.</text>
					</paragraph><paragraph id="H6DF0C43AD36348BC9FB8E0675534F94A"><enum>(2)</enum><header>Limitation</header><text>This subsection shall not apply with respect to any handicraft or clothing containing any part of a
			 migratory bird that was taken in a wasteful manner.</text>
					</paragraph><paragraph id="H9652A980CD4D4BC49DF7D2AEDD9F53FE"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text>
						<subparagraph id="H0B309C2B8B854E23B95753F676C59902"><enum>(A)</enum><header>Alaskan Native</header><text>The term <term>Alaskan Native</term> means any Indian, Aleut, or Eskimo who resides in Alaska.</text>
						</subparagraph><subparagraph id="H9701778A7FD7448DA3F6F0E66D801E66"><enum>(B)</enum><header>Authentic Alaskan Native article of handicraft or clothing</header><text display-inline="yes-display-inline">The term <term>authentic Alaskan Native article of handicraft or clothing</term>—</text>
							<clause id="H0239671B781244F79A405106E1773380"><enum>(i)</enum><text>means any item that is—</text>
								<subclause id="H589A8D1BD51B48BEADBE9F8954AEC0FA"><enum>(I)</enum><text>composed wholly or in some significant respect of natural materials; and</text>
								</subclause><subclause id="H1458A7BBC92F4E41BD1B70DB142695C7"><enum>(II)</enum><text display-inline="yes-display-inline">produced, decorated, or fashioned by an Alaskan Native, in the exercise of traditional Alaskan
			 Native handicrafts, without the use of any pantograph or other mass
			 copying device; and</text>
								</subclause></clause><clause id="H577DE62CDE944DAAB32028315EB2F8DC"><enum>(ii)</enum><text>includes any weaving, carving, stitching, sewing, lacing, beading, drawing, or painting described
			 in clause (i), or any combination thereof.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
