R. 2952</legis-num><associated-doc display="yes" role="report">[Report No. 113–324]</associated-doc><current-chamber display="yes">IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20130801">August 1, 2013</action-date><action-desc><sponsor name-id="M001181">Mr. Meehan</sponsor> introduced the following bill; which was referred to the <committee-name added-display-style="italic" committee-id="HHM00" deleted-display-style="strikethrough">Committee on Homeland Security</committee-name></action-desc></action><action><action-date date="20140109">January 9, 2014</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on August 1, 2013</action-instruction></action><action display="yes"><action-desc display="yes"><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Homeland Security Act of 2002 to make certain improvements in the laws relating to the advancement of security technologies for critical infrastructure protection, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body changed="added" committee-id="HHM00" display-enacting-clause="yes-display-enacting-clause" id="HB1CC6FED25F545BEBF4631418C06A858" reported-display-style="italic" style="OLC"><section id="H379B1E8F2C464812AF82FAA8409AA694" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Critical Infrastructure Research and Development Advancement Act of 2013</short-title></quote> or the <quote><short-title>CIRDA Act of 2013</short-title></quote>.</text></section><section id="H24A110FDDF4F436CBC8D5A325A2EBE24"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 2 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>) is amended by redesignating paragraphs (15) through (18) as paragraphs (16) through (19), respectively, and by inserting after paragraph (14) the following:</text><quoted-block changed="added" committee-id="HHM00" id="HD80C59A8EF62437EA7B0F2D057693CB6" reported-display-style="italic" style="OLC"><paragraph id="H4A17A2A67330491DA5DBD4E068C89A10"><enum>(15)</enum><text display-inline="yes-display-inline">The term <quote>Sector Coordinating Council</quote> means a private sector coordinating council that is—</text><subparagraph id="H52994F0B78744EA1895FCE861B43A574"><enum>(A)</enum><text display-inline="yes-display-inline">recognized by the Secretary as such a Council for purposes of this Act; and</text></subparagraph><subparagraph id="H3512022ED9354948A8C6049FCD245753"><enum>(B)</enum><text>comprised of representatives of owners and operators of critical infrastructure within a particular sector of critical infrastructure.</text></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></section><section id="H616DF5CADCCB48D09439D4FBC64F89C7"><enum>3.</enum><header>Critical infrastructure protection research and development</header><subsection id="H0BBD95441FBE4AC3BC86298CE5E8941C"><enum>(a)</enum><header>Strategic Plan; Public-Private Consortiums</header><paragraph id="HE3076410DC074D028577D91F99495C6F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Title III of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/181">6 U.S.C. 181 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block changed="added" committee-id="HHM00" id="HFB4D06A2961B42BCB2526B04675EE60D" reported-display-style="italic" style="OLC"><section id="H965C20EE5679440295ACFCB386794608"><enum>318.</enum><header>Research and development strategy for critical infrastructure protection</header><subsection id="HFB0B70364F884E188E5164D691499F24"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the Critical Infrastructure Research and Development Advancement Act of 2013, the Secretary, acting through the Under Secretary for Science and Technology, shall transmit to Congress a strategic plan to guide the overall direction of Federal physical security and cybersecurity technology research and development efforts for protecting critical infrastructure, including against all threats. Once every 2 years after the initial strategic plan is transmitted to Congress under this section, the Secretary shall transmit to Congress an update of the plan.</text></subsection><subsection id="H9CA79555399042B2997E4472E3EB5474"><enum>(b)</enum><header>Contents of Plan</header><text>The strategic plan shall include the following:</text><paragraph id="HA5BA5E37ECBC4536B7A913624A7C4081"><enum>(1)</enum><text display-inline="yes-display-inline">An identification of critical infrastructure security risks and any associated security technology gaps, that are developed following—</text><subparagraph id="HD623969AD67A4CFEBE2F56D997B00E87"><enum>(A)</enum><text display-inline="yes-display-inline">consultation with stakeholders, including the Sector Coordinating Councils; and</text></subparagraph><subparagraph id="H89D4DD6034784DDC90CF64A1E76E4B69"><enum>(B)</enum><text>performance by the Department of a risk/gap analysis that considers information received in such consultations.</text></subparagraph></paragraph><paragraph id="H6B241479621E41029FB2128E4CA464A9"><enum>(2)</enum><text display-inline="yes-display-inline">A set of critical infrastructure security technology needs that—</text><subparagraph id="HF25E2287292A4B16A814BAF891F585A9"><enum>(A)</enum><text display-inline="yes-display-inline">is prioritized based on risk and gaps identified under paragraph (1);</text></subparagraph><subparagraph id="H0AEA85F64BCE48AD9E48F2E0B6CD1801"><enum>(B)</enum><text>emphasizes research and development of those technologies that need to be accelerated due to rapidly evolving threats or rapidly advancing infrastructure technology; and</text></subparagraph><subparagraph id="HA29FB1A8FC0D429FB035F35B3E362CC8"><enum>(C)</enum><text>includes research, development, and acquisition roadmaps with clearly defined objectives, goals, and measures.</text></subparagraph></paragraph><paragraph id="H0B4CB3B6E01F4B6E81D88D403804E4E2"><enum>(3)</enum><text>An identification of laboratories, facilities, modeling, and simulation capabilities that will be required to support the research, development, demonstration, testing, evaluation, and acquisition of the security technologies described in paragraph (2).</text></paragraph><paragraph id="H6097487EB7E844B59CFBBC2BC6413EB6"><enum>(4)</enum><text>An identification of current and planned programmatic initiatives for fostering the rapid advancement and deployment of security technologies for critical infrastructure protection. The initiatives shall consider opportunities for public-private partnerships, intragovernment collaboration, university centers of excellence, and national laboratory technology transfer.</text></paragraph><paragraph id="HAC9483416AD04A9EA28CED1C282CC427"><enum>(5)</enum><text display-inline="yes-display-inline">A description of progress made with respect to each critical infrastructure security risk, associated security technology gap, and critical infrastructure technology need identified in the preceding strategic plan transmitted under this section.</text></paragraph></subsection><subsection id="HAD4793557F0F48799BD0D96DEDEAB796"><enum>(c)</enum><header>Coordination</header><text>In carrying out this section, the Under Secretary for Science and Technology shall coordinate with the Under Secretary for the National Protection and Programs Directorate.</text></subsection><subsection id="H3016F775B6FF4A489277670CAED783D0"><enum>(d)</enum><header>Consultation</header><text>In carrying out this section, the Under Secretary for Science and Technology shall consult with—</text><paragraph id="H03B8AA81D94F4E12886A43A125549D39"><enum>(1)</enum><text>the critical infrastructure Sector Coordinating Councils;</text></paragraph><paragraph id="H846FBFEE33784EA784E70C8ED34F0E69"><enum>(2)</enum><text display-inline="yes-display-inline">to the extent practicable, subject matter experts on critical infrastructure protection from universities, colleges, including historically black colleges and universities, Hispanic- serving institutions, and tribal colleges and universities, national laboratories, and private industry;</text></paragraph><paragraph id="HF3FCC064C93F4FF4869DD5499A649FD1"><enum>(3)</enum><text>the heads of other relevant Federal departments and agencies that conduct research and development for critical infrastructure protection; and</text></paragraph><paragraph id="H7DFACF1314194AF993EC5D1704D6D699"><enum>(4)</enum><text>State, local, and tribal governments as appropriate.</text></paragraph></subsection></section><section id="HC2177FA7DAF747AFB12FD72BCCA0F49E"><enum>319.</enum><header>Report on public-private research and development consortiums</header><subsection id="HDDD35241F66245D8B1C73B97A49F89BE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the enactment of the <short-title>Critical Infrastructure Research and Development Advancement Act of 2013</short-title>, the Secretary, acting through the Under Secretary for Science and Technology, shall transmit to Congress a report on the Department’s utilization of public-private research and development consortiums for accelerating technology development for critical infrastructure protection. Once every 2 years after the initial report is transmitted to Congress under this section, the Secretary shall transmit to Congress an update of the report. The report shall focus on those aspects of critical infrastructure protection that are predominately operated by the private sector and that would most benefit from rapid security technology advancement.</text></subsection><subsection id="H0ABF8EB708CC4D2DAE035DCD7E0BB9CF"><enum>(b)</enum><header>Contents of Report</header><text>The report shall include—</text><paragraph id="HA825823E3AA541ABAEFEE630C1FB2F95"><enum>(1)</enum><text>a summary of the progress and accomplishments of on-going consortiums for critical infrastructure security technologies;</text></paragraph><paragraph id="H80D261D6FBAF450E831BE456DC8B9B58"><enum>(2)</enum><text display-inline="yes-display-inline">in consultation with the Sector Coordinating Councils and, to the extent practicable, in consultation with subject-matter experts on critical infrastructure protection from universities, colleges, including historically black colleges and universities, Hispanic-serving institutions, and tribal colleges and universities, national laboratories, and private industry, a prioritized list of technology development focus areas that would most benefit from a public-private research and development consortium; and</text></paragraph><paragraph id="HA12A2642756F47B2B474974657AE94D2"><enum>(3)</enum><text>based on the prioritized list developed under paragraph (2), a proposal for implementing an expanded research and development consortium program, including an assessment of feasibility and an estimate of cost, schedule, and milestones.</text></paragraph></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></paragraph><paragraph id="HDE1D652C5F77448588BF73445699F0E9"><enum>(2)</enum><header>Limitation on progress report requirement</header><text display-inline="yes-display-inline">Subsection (b)(5) of section 318 of the Homeland Security Act of 2002, as amended by paragraph (1) of this subsection, shall not apply with respect to the first strategic plan transmitted under that section.</text></paragraph></subsection><subsection id="H4437E5C970144E169583603E4394E14D"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of such Act is amended by adding at the end of the items relating to such title the following:</text><quoted-block changed="added" committee-id="HHM00" display-inline="no-display-inline" id="HBA977A92C5CE4789967D6C3BB26FB7FC" reported-display-style="italic" style="OLC"><toc changed="added" committee-id="HHM00" container-level="quoted-block-container" idref="HFB4D06A2961B42BCB2526B04675EE60D" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration" reported-display-style="italic"><toc-entry idref="H965C20EE5679440295ACFCB386794608" level="section">Sec. 318. Research and development strategy for critical infrastructure protection.</toc-entry><toc-entry idref="HC2177FA7DAF747AFB12FD72BCCA0F49E" level="section">Sec. 319. Report on public-private research and development consortiums.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9D5A87F0E733487F9E1FABEA423811BA"><enum>(c)</enum><header>Critical infrastructure protection technology clearinghouse</header><text display-inline="yes-display-inline">Section 313 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/193">6 U.S.C. 193</external-xref>) is amended by redesignating subsection (c) as subsection (d), and by inserting after subsection (b) the following:</text><quoted-block changed="added" committee-id="HHM00" display-inline="no-display-inline" id="H013B9C77F67D4D98B8B74D2E8CD1890E" reported-display-style="italic" style="OLC"><subsection id="HAAD385BE899E4412B195F523523FAF1F"><enum>(c)</enum><header>Critical infrastructure protection technology clearinghouse</header><paragraph id="HF120E70310A643CD877AE62D693D48FE"><enum>(1)</enum><header>Designation</header><text display-inline="yes-display-inline">Under the program required by this section, the Secretary, acting through the Under Secretary for Science and Technology, and in coordination with the Under Secretary for the National Protection and Programs Directorate, shall designate a technology clearinghouse for rapidly sharing proven technology solutions for protecting critical infrastructure.</text></paragraph><paragraph id="HCC4DFA124FA44529A29A7502E6DEBA8E"><enum>(2)</enum><header>Sharing of technology solutions</header><text>Technology solutions shared through the clearinghouse shall draw from Government-furnished, commercially furnished, and publically available trusted sources.</text></paragraph><paragraph id="H7564E09620D849879CEE833CAD12BEE5"><enum>(3)</enum><header>Technology metrics</header><text>All technologies shared through the clearinghouse shall include a set of performance and readiness metrics to assist end-users in deploying effective and timely solutions relevant for their critical infrastructures.</text></paragraph><paragraph id="H7F754A000C8E4F118EBE514C97F89006"><enum>(4)</enum><header>Review by privacy officer</header><text display-inline="yes-display-inline">The Privacy Officer of the Department appointed under section 222 shall annually review the clearinghouse process to evaluate its consistency with fair information practice principles issued by the Privacy Officer.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2100C185FECD47E28DC8E7BB95B15004"><enum>(d)</enum><header>Evaluation of Technology Clearinghouse by Government Accountability Office</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Comptroller General of the United States shall conduct an independent evaluation of, and submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on, the effectiveness of the clearinghouses established and designated, respectively, under section 313 of the Homeland Security Act of 2002, as amended by this section.</text></subsection></section><section id="H4E5A08BEB40948A2806D3B9E93391A10"><enum>4.</enum><header>No additional authorization of appropriations</header><text display-inline="no-display-inline">No additional funds are authorized to be appropriated to carry out this Act and the amendments made by this Act, and this Act and such amendments shall be carried out using amounts otherwise available for such purpose.</text></section></legis-body><endorsement display="yes"><action-date date="20140109">January 9, 2014</action-date><action-desc>Reported with an
