<section id="H584E36CFC711474A924879AD0FE4937B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Commonsense Construction Contracting Act of 2013</short-title></quote>.</text> </section>
<section id="HD1831146D9734FE393C3937863BA920B"><enum>2.</enum><header>Reverse auctions prohibited for contracts for design and construction services</header><text display-inline="no-display-inline">The Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>) is amended—</text> 
<paragraph id="H1EC351781E49461AAA5ECC9B783F9654"><enum>(1)</enum><text>by redesignating section 47 as section 48; and</text> </paragraph>
<paragraph id="HD77DC7CF664545A7B94329532149B19F"><enum>(2)</enum><text>by inserting after section 46 the following:</text>

<section id="HB33B939334AC46A4B34AFAB732A0E7E6"><enum>47.</enum><header>Reverse auctions prohibited for contracts for design and construction services</header> 
<subsection id="H978ADEB433BA4CEFA6B1FD685203BF07"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of any contract for design and construction services, reverse auction methods may not be used if the contract—</text> 
<paragraph id="H607DFE724A4641B88F637569C5F92877"><enum>(1)</enum><text>is suitable for award to a small business concern; or</text> </paragraph>
<paragraph id="H288BC56DDB24416EAB7CF50E686C5943"><enum>(2)</enum><text>if the award is to be made under—</text> 
<subparagraph id="H224176E5B7D04B4290F7CB95D1FF6F99"><enum>(A)</enum><text>section 8(a);</text> </subparagraph>
<subparagraph id="HEBE36B8152834A2D942512F2F37919C9"><enum>(B)</enum><text>section 8(m);</text> </subparagraph>
<subparagraph commented="no" id="HC3DEF6EA09F7457A943623D771A79818"><enum>(C)</enum><text>section 15(a);</text> </subparagraph>
<subparagraph id="H3A7E51C0D04F4491A1A5159CA0277248"><enum>(D)</enum><text>section 15(j);</text> </subparagraph>
<subparagraph id="HED1B20EEFB2445D8A7DB3A479A286225"><enum>(E)</enum><text>section 31; or</text> </subparagraph>
<subparagraph id="H921CCEB3FD0A4A26A1E19306B36556D0"><enum>(F)</enum><text>section 36.</text> </subparagraph></paragraph></subsection>
<subsection id="H51E9ED3C3076434194DE912D09614E39"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section—</text> 
<paragraph id="H215473EF2A1F46289CC51AB2BBBE5C49"><enum>(1)</enum><text>The term <quote>reverse auction</quote> means, with respect to procurement by an agency, a real-time auction on the Internet between a group of offerors who compete against each other by submitting bids for a contract or task order with the ability to submit revised bids throughout the course of the auction, and the award being made to the offeror who submits the lowest bid.</text> </paragraph>
<paragraph id="H733DB3A22FEC4712961898BB284A34C7"><enum>(2)</enum><text>The term <quote>design and construction services</quote> means—</text> 
<subparagraph id="H4E945295FD0A40A8A7F519CB97F40F57"><enum>(A)</enum><text>site planning and landscape design;</text> </subparagraph>
<subparagraph id="HF5F37805253144EFAC1CDAE955B6B00E"><enum>(B)</enum><text>architectural and interior design;</text> </subparagraph>
<subparagraph id="H63D9BAC088A6483FACE1E3CE0D4A42F4"><enum>(C)</enum><text>engineering system design;</text> </subparagraph>
<subparagraph id="HF5BB31ACE7334184886A802D2DAF2AF8"><enum>(D)</enum><text>performance of construction work for facility, infrastructure, and environmental restoration projects;</text> </subparagraph>
<subparagraph id="HC6C50A3D1CA04B7F963AE791CD6F8DA5"><enum>(E)</enum><text>delivery and supply of construction materials to construction sites; and</text> </subparagraph>
<subparagraph id="H89207B86F13E49A1848BD3252933D54E"><enum>(F)</enum><text>construction, alteration, or repair, including painting and decorating, of public buildings and public works.</text> </subparagraph></paragraph></subsection></section><after-quoted-block> .</after-quoted-block></quoted-block> </paragraph></section>
