<section id="H3286008590694EE39875838B9454318E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Design-Build Efficiency and Jobs Act of 2013</short-title></quote>.</text> </section> 
<section id="H00DE30007E424BF9A9C59B833D299A0C"><enum>2.</enum><header>Design-build selection procedures</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/41/3309">Section 3309</external-xref> of title 41, United States Code, is amended—</text> 
<paragraph id="H2ECD5FAB857B43939E3287D9F118D23B"><enum>(1)</enum><text>in subsection (d) by striking <quote>agency determines with respect to</quote> and all that follows through the period at the end, and inserting the following: <quote>the head of the agency approves the contracting officer’s justification that an individual solicitation must have greater than 5 finalists to be in the Federal Government’s interest. The contracting officer must provide written documentation of how a maximum number of offerors exceeding 5 is consistent with the purposes and objectives of the two-phase selection process.</quote>; and</text> </paragraph> 
<paragraph id="H93DAECCC1F22410AA764E0A8E92E6EC1"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="HD2A28FAB62DA4984A8CB80B7BDBA1A4F"><enum>(f)</enum><header>Design and construction contracts</header><text display-inline="yes-display-inline">Two-phase selection procedures shall be used for entering into a contract for the design and construction of a public building, facility, or work when a contracting officer determines that the contract has a value of $750,000 or greater, as adjusted for inflation in accordance with <external-xref legal-doc="usc" parsable-cite="usc/41/1908">section 1908</external-xref> of title 41, United States Code.</text> </subsection> 
<subsection id="H673E01228159495CB2181AAD2672E769"><enum>(g)</enum><header>Reports</header> 
<paragraph id="H09CD32814290495DAFAEA0A221903B7A"><enum>(1)</enum><header>Agency reports</header><text>Beginning on the date that is 1 year after the effective date of this subsection, and for each of the 4 years thereafter, each agency shall submit to the Comptroller General of the United States and publish in the Federal Register, an annual report regarding all cases in the preceding year in which—</text> 
<subparagraph id="HC752904E4B664A00814A2C3349D97680"><enum>(A)</enum><text>more than 5 finalists were selected for phase-two requests for competitive proposals; or</text> </subparagraph> 
<subparagraph id="H0CA13E121D7E4C5DAA1CFD74F50E62EE"><enum>(B)</enum><text>for a contract that has a value of $750,000 (as adjusted for inflation in accordance with <external-xref legal-doc="usc" parsable-cite="usc/41/1908">section 1908</external-xref> of title 41, United States Code) or greater for which the two-phase selection procedures was not used.</text> </subparagraph></paragraph>

<section id="HF4DC07A72B0841C6A72EBA25CE33275A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Design-Build Efficiency and Jobs Act of 2014</short-title></quote>. </text></section>

<subsection id="HD6629C6FD81A42CF8AC73F427A9C5390"><enum>(a)</enum><header>Civilian agency contracts</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/41/3309">Section 3309</external-xref> of title 41, United States Code, is amended—</text> 
<paragraph id="HA2006230A5B544D08C955B7D8A7E5500"><enum>(1)</enum><text>in subsection (d), by striking <quote>agency determines with respect to</quote> and all that follows through the period at the end, and inserting the following: <quote>head of the agency approves the contracting officer’s justification that an individual solicitation must have greater than 5 finalists to be in the Federal Government’s interest. The contracting officer must provide written documentation of how a maximum number of offerors exceeding 5 is consistent with the purposes and objectives of the two-phase selection process.</quote>; and</text></paragraph>

<paragraph id="H2825D7D522F54A8C9005E859104E81A5"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d), by striking <quote>agency determines with respect to</quote> and all that follows through the period at the end, and inserting the following: <quote>head of the agency approves the contracting officer’s justification that an individual solicitation must have greater than 5 finalists to be in the Federal Government’s interest. The contracting officer must provide written documentation of how a maximum number of offerors exceeding 5 is consistent with the purposes and objectives of the two-phase selection process.</quote>; and </text></paragraph> 
<paragraph id="H64D813A2C47B41F7BCA65559E570D1F0"><enum>(2)</enum><text>by adding at the end the following:</text>

<subparagraph id="H493C1BF05BE5451188294648E17D7BD1" indent="up1"><enum>(A)</enum><text>in which more than 5 finalists were selected for phase-two requests for competitive proposals; or</text></subparagraph> 
<subparagraph id="H4414895B94BD4263A29EE266251FAED2" indent="up1"><enum>(B)</enum><text>for a contract that has a value of $1,500,000 (as adjusted for inflation in accordance with <external-xref legal-doc="usc" parsable-cite="usc/41/1908">section 1908</external-xref> of title 41) or greater for which the two-phase selection procedures were not used.</text></subparagraph></paragraph>
