<official-title display="yes">To amend the National Energy Conservation Policy Act to encourage the increased use of performance contracting in Federal facilities.<pagebreak/></official-title> 
</form>

<section id="H2283CA050E624E99A314A3E012AF2625" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Energy Savings Through Public-Private Partnerships Act of 2014</short-title></quote>.</text></section> 
<section id="H0373A4AB0F6145F188D1F5CDFE5E6C5F"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H3CCCB195FE65447A9EF2F2EB2C85394C"><enum>(1)</enum><text>Private sector funding and expertise can help address the energy efficiency challenges facing the United States.</text></paragraph> 
<paragraph id="H0BA3E89B36E64CEE8AF4F5D8705D4060"><enum>(2)</enum><text>The Federal Government spends more than $6 billion annually in energy costs.</text></paragraph> 
<paragraph id="H58C2B5F47C2D4E6C832551B7945FC7F6"><enum>(3)</enum><text>Reducing Federal energy costs can help save money, create jobs, and reduce waste.</text></paragraph> 
<paragraph id="HC3F76338A18143EC8A4A0C32F9C82F09"><enum>(4)</enum><text>Energy savings performance contracts and utility energy service contracts are tools for utilizing private sector investment to upgrade Federal facilities without any up-front cost to the taxpayer.</text></paragraph> 
<paragraph id="H8AE95077EEF7477581DCA6CF6D33A5FF"><enum>(5)</enum><text>Performance contracting is a way to retrofit Federal buildings using private sector investment in the absence of appropriated dollars.</text></paragraph> 
<paragraph id="H44688A94FBC54E339BE5EABD71350598"><enum>(6)</enum><text display-inline="yes-display-inline">Retrofits that reduce energy use also improve infrastructure, protect national security, and cut facility operations and maintenance costs.</text></paragraph></section> 
<section id="H7D86D77AB4C2417DA7F753AA340D7D39" section-type="subsequent-section"><enum>3.</enum><header>Use of energy and water efficiency measures in Federal buildings</header> 
<subsection id="HD3D8A44C6CBE46D5A458BBC55310A116"><enum>(a)</enum><header>Energy management requirements</header><text display-inline="yes-display-inline">Section 543(f)(4) of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8253">42 U.S.C. 8253(f)(4)</external-xref>) is amended—</text> 
<paragraph id="H452CD2D40437478D905FEFEACD892CAF"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively and by moving the margins 2 ems to the right;</text></paragraph> 
<paragraph id="HE559501F8DB1463EBB7C09CFBB30A559"><enum>(2)</enum><text>by striking <quote>Not later than</quote> and inserting the following:</text> 
<quoted-block style="OLC" id="H8BD374695C2A442C96A9ECC5755BF9FD" display-inline="no-display-inline"> 
<subparagraph id="H65C1874109ED42F995B4D967D8744B46"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H2A4E9E762D9F43E0B1FEE34E49CFCB9C"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following new subparagraph: </text>

<subparagraph id="H6DA9B9C0E07345F5857336D96E5F7B89" commented="no"><enum>(B)</enum><header>Measures not implemented</header><text>Each energy manager, as part of the certification system under paragraph (7) and using guidelines developed by the Secretary, shall provide an explanation regarding any life-cycle cost-effective measures described in subparagraph (A)(i) that have not been implemented.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HE80265F316CF4693941EA259F312A833"><enum>(b)</enum><header>Reports</header><text display-inline="yes-display-inline">Section 548(b) of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8258">42 U.S.C. 8258(b)</external-xref>) is amended—</text> 
<paragraph id="H8E28319443DC404EBCE983C08FC87238"><enum>(1)</enum><text>in paragraph (3), by striking <quote>and</quote> at the end; </text></paragraph> 
<paragraph id="H0ECA180867DD4512AC8AF1CB3C2E58C8"><enum>(2)</enum><text>in paragraph (4), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H084BB61798754138B980C66737BB03A8"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="HCCEEEBF42A1F40E591485D26AD4310B0" display-inline="no-display-inline"> 
<paragraph id="H7C6B4BBA91FD46808FF12ACD0C0B5751"><enum>(5)</enum><text display-inline="yes-display-inline">the status of each agency’s energy savings performance contracts and utility energy service contracts, the investment value of such contracts, the guaranteed energy savings for the previous year as compared to the actual energy savings for the previous year, the plan for entering into such contracts in the coming year, and information explaining why any previously submitted plans for such contracts were not implemented.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H497AFC31067F40A48D20CBBCFCF56D71"><enum>(c)</enum><header>Federal energy management definitions</header><text display-inline="yes-display-inline">Section 551(4) of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8259">42 U.S.C. 8259(4)</external-xref>) is amended by striking <quote>or retrofit activities</quote> and inserting <quote>retrofit activities, or energy consuming devices and required support structures</quote>.</text></subsection> 
<subsection id="HEAC91B714817437EB35237A04A0823F5"><enum>(d)</enum><header>Authority to enter into contracts</header><text display-inline="yes-display-inline">Section 801(a)(2)(F) of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8287">42 U.S.C. 8287(a)(2)(F)</external-xref>) is amended—</text> 
<paragraph id="HF9F123966DA64030A3C3D974A2CC9C31"><enum>(1)</enum><text>in clause (i), by striking <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="H89307931B4334BC9A400ADE4B9F3A376"><enum>(2)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="HDFB19E70F6C7432784FFCB9EC9166972"><enum>(3)</enum><text>by adding at the end the following new clause: </text> 
<quoted-block style="OLC" id="H1E048B965B4F4594B3ED551C80700FB0" display-inline="no-display-inline"> 
<clause id="H954EBDBCA9FC4EE4997733A0C64EAFD3"><enum>(iii)</enum><text display-inline="yes-display-inline">limit the recognition of operation and maintenance savings associated with systems modernized or replaced with the implementation of energy conservation measures, water conservation measures, or any series of energy conservation measures and water conservation measures.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HAD37066EEE5D4580B60600F12A10F952"><enum>(e)</enum><header>Miscellaneous Authority</header><text display-inline="yes-display-inline">Section 801(a)(2) of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8287">42 U.S.C. 8287(a)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="HC852A31F7C1740A686C02D23AC7CE300" display-inline="no-display-inline"> 
<subparagraph id="HE125654D076A4F97948B457A93DFB536"><enum>(H)</enum><header>Miscellaneous Authority</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a Federal agency may sell or transfer energy savings and apply the proceeds of such sale or transfer to fund a contract under this title.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H38BCA76E31994CF1A5D8E6264A054E06"><enum>(f)</enum><header>Payment of costs</header><text display-inline="yes-display-inline">Section 802 of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8287a">42 U.S.C. 8287a</external-xref>) is amended by striking <quote>(and related operation and maintenance expenses)</quote> and inserting <quote>, including related operations and maintenance expenses</quote>.</text></subsection> 
<subsection id="H97C427A9917446AA83C02565F7318AFC"><enum>(g)</enum><header>Energy savings performance contracts definitions</header><text display-inline="yes-display-inline">Section 804(2) of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8287c">42 U.S.C. 8287c(2)</external-xref>) is amended—</text> 
<paragraph id="H30A9AFEC8B4D4E358DA96C4AB78C394A"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>federally owned building or buildings or other federally owned facilities</quote> and inserting <quote>Federal building (as defined in section 551 (<external-xref legal-doc="usc" parsable-cite="usc/42/8259">42 U.S.C. 8259</external-xref>))</quote> each place it appears;</text></paragraph> 
<paragraph id="H48B52FA4EB7B4B7E80250A19C23FBB6D"><enum>(2)</enum><text>in subparagraph (C) , by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph> 
<paragraph id="H1D2109495837453CBC246A0044F7F17D"><enum>(3)</enum><text>in subparagraph (D), by striking the period at the end and inserting a semicolon; and </text></paragraph> 
<paragraph id="HA3267FDF6CBD445A946979EFCC9C5195"><enum>(4)</enum><text>by adding at the end the following new subparagraphs:</text> 
<quoted-block style="OLC" id="H0D1FB7862F6F444F91369E48EDB7BA10" display-inline="no-display-inline"> 
<subparagraph id="HE1DE6337958449E78F0ABA75BD5C4A91"><enum>(E)</enum><text>the use, sale, or transfer of energy incentives, rebates, or credits (including renewable energy credits) from Federal, State, or local governments or utilities; and</text></subparagraph> 
<subparagraph id="H265BCC15409443D1A4B51EDA5C1ECE17"><enum>(F)</enum><text>any revenue generated from a reduction in energy or water use, more efficient waste recycling, or additional energy generated from more efficient equipment.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
