<section id="H7C87D070115F42F6B7220096EB65EF81" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Buildings Savings and Reform Act of 2013</short-title></quote>.</text> </section>
<section id="H8F01515087274E2B81171EC8F8203B63"><enum>2.</enum><header>Required offsets for new space</header> 
<subsection id="HE8C70D135C3F431A9EEA4E69FB76D7CC"><enum>(a)</enum><header>Offsets and freeze of space inventory</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/33">Chapter 33</external-xref> of title 40, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H7B04C662082C4A239DE424D6E00ED7EB" style="USC"> 
<section id="H8A47F425F2284ED598D667BB4E6D0EBB"><enum>3317.</enum><header>Offsets and freeze of space inventory</header> 
<subsection id="HF67977F510454A07987FB0CA17A1C736"><enum>(a)</enum><header>Information in prospectus</header><text>Any prospectus that proposes new space, whether leased or owned, transmitted pursuant to section 3307(b) for each of fiscal years 2014, 2015, 2016, and 2017 shall contain information outlining the details of the elimination of at least a corresponding amount of space.</text> </subsection>
<subsection id="H9B7ECA1AAA894FC885C4117B02042992"><enum>(b)</enum><header>Freezing the real estate footprint</header><text display-inline="yes-display-inline">On an annual basis, the Administrator shall not increase the size or amount of its real property inventory, leased or owned, as compared to its fiscal year 2012 real property baseline, except in those years in which space offsets have been specifically identified or for emergency or national security purposes as determined by the President.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="H2D88A91BEA7148B28BE32E27810D9BD2"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for such chapter is amended by adding at the end the following:</text>

<subsection id="HC495B73D090646C8A8C6248B703C58DD"><enum>(a)</enum><header>Definitions</header><text><external-xref legal-doc="usc" parsable-cite="usc/40/3301">Section 3301(a)</external-xref> of title 40, United States Code, is amended—</text> 
<paragraph id="HAD9345B121FD46FBBFE133121048867F"><enum>(1)</enum><text>by redesignating paragraphs (5) and (6) as paragraphs (6) and (7), respectively; and</text> </paragraph>
<paragraph id="H4ABDF60542B14080938165993B0C6717"><enum>(2)</enum><text>by inserting after paragraph (4) the following:</text>

<paragraph id="H496471724DAD4549BDADF08604C76366"><enum>(5)</enum><header>Maximum rental rate</header><text>The term <quote>maximum rental rate</quote> means the maximum rate, by rentable square feet estimated by the Administrator of General Services for the leasing of commercial space for purposes of a public building in a given geographical location.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="HF4B185AAF92C4C70948B7D10469A6E3E"><enum>(b)</enum><header>Restrictions on below-Prospectus projects</header><text><external-xref legal-doc="usc" parsable-cite="usc/40/3307">Section 3307(g)</external-xref> of title 40, United States Code, is amended by adding at the end the following:</text>

<paragraph id="HDC41261EAECA42758F9A34ED07E92742"><enum>(3)</enum><header>Restriction on below-prospectus level</header> 
<subparagraph id="H390C24ADDDE84F11A1FC763D991B02AC"><enum>(A)</enum><header>Restriction on rental rate</header><text>The Administrator may not lease space at an amount below the average annual rental rate thresholds established pursuant to subsections (a) and (h) and that exceeds the maximum rental rate established by the Administrator for the respective geographical location, unless the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate are notified by the Administrator in writing at least 10 days before the execution of such lease.</text> </subparagraph>
<subparagraph id="H4D911A96F7CF45FCB4265518902F294F"><enum>(B)</enum><header>Annual reports</header><text>The Administrator shall submit, on an annual basis, to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a report detailing the maximum rental rates established by the Administrator by geographical location.</text> </subparagraph></paragraph>
<paragraph id="H57ABE92B05D142CBA7AF8898342B84CE"><enum>(4)</enum><header>Restriction on other below-prospectus level projects</header><text>Not less than 30 days before entering into any lease-construction agreement, regardless of the threshold amounts established pursuant to subsections (a) and (h), the Administrator shall notify the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate, in writing, of the intention to enter into such agreement and include in the notification details of the project and any associated information.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>

<subsection id="H5D14FD27726A4253AD2338BF3B69BA9D"><enum>(a)</enum><header>Reports on leases</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/33">Chapter 33</external-xref> of title 40, United States Code, as amended by this Act, is further amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HF951AAEC4B444E3F8875F938B625216B" style="USC"> 
<section id="HA19A9D9540CA487D9C5FA3BE452CDCDF"><enum>3318.</enum><header>Reports on leases</header><text display-inline="no-display-inline">Not later than December 31 of each year, the Administrator of General Services shall submit a list to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate of all leases, including lease-construction agreements, entered into by the General Services Administration for the previous fiscal year. For each lease, the list shall detail the size of the space, location, tenant agency or agencies, total annual rental rate, and the authorized annual rental if such rental rate exceeds the annual threshold amounts set forth in section 3307.</text> </section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="H44553BD22D7F4A0B8699557F58ABF7AA"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for such chapter, as amended by this Act, is further amended by adding at the end the following:</text>

<section id="H44CAEE41EEC34256BF9E6E63433BC922"><enum>5.</enum><header>Zero-based space justification</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/40/3307">Section 3307(b)</external-xref> of title 40, United States Code, is amended—</text> 
<paragraph id="H5D1D66E215994CD68E1F6B2A70B7BCC7"><enum>(1)</enum><text>in paragraph (6) by striking <quote>and</quote> at the end;</text> </paragraph>
<paragraph id="HA2FEBA3B9C08492788C3C51F86D56F92"><enum>(2)</enum><text>in paragraph (7) by striking the period and inserting <quote>; and</quote>; and</text> </paragraph>
<paragraph id="H4E809CCDB1384C62A087A795CA18DC92"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block id="HBC3B6849B52C40008E18BB3A140723B1" style="OLC"> 
<paragraph id="H899EFF061B194D0093C3799AD1F5F165"><enum>(8)</enum><text>with respect to any prospectus, including for replacement space, lease renewal, or lease extension, the Administrator shall include a justification for such space, including an explanation of why such space could not be consolidated or co-located into other owned or leased space.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>

<subsection id="H13BC1180E05A450BA2B2D218A2E0829B"><enum>(a)</enum><header>Reducing costs related to courthouses</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/33">Chapter 33</external-xref> of title 40, United States Code, as amended by this Act, is further amended by adding at the end the following:</text>

<section commented="no" id="HEF46EE248A0D400D8E5C221DF2E1F01E"><enum>3319.</enum><header>Reducing costs related to courthouses</header> 
<subsection commented="no" id="H278B228C93344EA5AF1F1A8C6DA23078"><enum>(a)</enum><header>Limitation on new courthouses</header><text>The Administrator of General Services may not commence construction of any new courthouse if—</text> 
<paragraph commented="no" id="H4E253995F6E949C6BEE9FCE1E5BFD114"><enum>(1)</enum><text>construction has not begun on or before the date of enactment of this section; and</text> </paragraph>
<paragraph commented="no" id="H80D94EDEC15C4D81A71867B4F76EC05B"><enum>(2)</enum><text>the design and construction of the new courthouse fails to comply, at a minimum, with the courtroom sharing requirements described in subsection (b).</text> </paragraph></subsection>
<subsection commented="no" id="HC63D9EFB300F496697F4D6D100B88EAA"><enum>(b)</enum><header>Courtroom sharing requirements defined</header><text>The term <quote>courtroom sharing requirements</quote> means—</text> 
<paragraph commented="no" id="HB47EBCE6ACFC41149D57BD18AAEF2965"><enum>(1)</enum><text display-inline="yes-display-inline">in courthouses with 10 or more active district judges, 2 courtrooms per 3 active district judges, except such courthouses may contain not less than 9 courtrooms for active district judges;</text> </paragraph>
<paragraph commented="no" id="H38FD475BF6B244FEBE11F392D72BB90C"><enum>(2)</enum><text>in courthouses with 3 or more bankruptcy judges, 1 courtroom per 2 bankruptcy judges;</text> </paragraph>
<paragraph commented="no" id="HB693549C71044BE5875B4E3CF6242C5E"><enum>(3)</enum><text>in courthouses with 3 or more senior district judges, 1 courtroom per 2 senior district judges; and</text> </paragraph>
<paragraph commented="no" id="H05833BD5BDE64AE68CBED97CC230B2FE"><enum>(4)</enum><text>in courthouses with 3 or more magistrate judges, 1 courtroom per 2 magistrate judges.</text> </paragraph></subsection>
<subsection commented="no" id="H3CFC0D0FF2C345ABBE8664A08A6054F3"><enum>(c)</enum><header>United states courts design guide</header><text>Not later than 180 days after the date of enactment of this section, the Design Guide for courthouses shall be updated to incorporate courtroom sharing requirements to the maximum extent practicable.</text> </subsection>
<subsection commented="no" id="H92D596D384694EC4BD465E19C3BE51DA"><enum>(d)</enum><header>Utilization</header><text>If a new courthouse will add capacity in the inventory of the General Services Administration, existing space in the same courthouse complex must be fully utilized or relinquished from the inventory of the General Services Administration.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="H14D4CAE9C76A42D0B96F55D3C29256F4"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for such chapter, as amended by this Act, is further amended by adding at the end the following:</text>

<section commented="no" id="HFEE07CC45D7F4CCD84056E00F564DB96"><enum>7.</enum><header>Inspector General review</header><text display-inline="no-display-inline">The Inspector General of the General Services Administration shall review the Public Buildings Service’s internship program, recent graduate program, and any similar program and report to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate on the following:</text> 
<paragraph commented="no" id="H30ACBDC93BD849788F0BAC7CE0BDCEF6"><enum>(1)</enum><text>The costs associated with each program.</text> </paragraph>
<paragraph commented="no" id="HEDC47A5A414C49EBB6F22D70AD8C0949"><enum>(2)</enum><text>Value added to the Public Buildings Service by the programs.</text> </paragraph>
<paragraph commented="no" id="H59E474BB5C4844C2ABA06288B4C43CD3"><enum>(3)</enum><text>Recommendations on improving the programs.</text> </paragraph>
<paragraph commented="no" id="H69DE25EEA4E74795B53FE9C296BA3EF0"><enum>(4)</enum><text>Compliance with Federal hiring laws, practices, and standards.</text> </paragraph></section>
<section id="H5F21D483DA20491EB27842616B014D7D"><enum>8.</enum><header>Bonuses and conferences</header> 
<subsection id="H2202E096F44745FAAD6391D5B9DF1D84"><enum>(a)</enum><header>Moratorium on bonuses</header><text><external-xref legal-doc="usc" parsable-cite="usc/40/592">Section 592</external-xref> of title 40, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HC1307F1D47D7402996DA96346524B0BA" style="OLC"> 
<subsection id="H72AB9FF8D1D540A8A9355C37F5114302"><enum>(g)</enum><header>Moratorium on bonuses</header><text>No funds in the Federal Buildings Fund may be available for bonuses, performance awards, or similar expenditures for a member of the Senior Executive Service, until the Administrator of General Services submits a report to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate detailing—</text> 
<paragraph id="H83FFC23443AE41C1AA7663C7F7AF67F1"><enum>(1)</enum><text>the findings and conclusions of a review of the Public Building Service’s system of awarding bonuses and performance awards;</text> </paragraph>
<paragraph id="H49384D2A1DEF43169FAD27663318C524"><enum>(2)</enum><text>actions to be taken by the Administrator to improve the system and ensure efficiency and effectiveness; and</text> </paragraph>
<paragraph id="H494FF0C1A821475F8B7967304E601725"><enum>(3)</enum><text>a description of how the actions identified will resolve any inefficiencies identified.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="H823EF90C8623418D9A4BB544BB075B16"><enum>(b)</enum><header>Restrictions on conferences and travel</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/33">Chapter 33</external-xref> of title 40, United States Code, as amended by this Act, is further amended by adding at the end the following:</text>

<section id="H8555182224704194A98028B4E5647CFC"><enum>3320.</enum><header>Restrictions on conferences and travel</header> 
<subsection id="H95379EE44D734D1E81CDB8123EFCE0EB"><enum>(a)</enum><header>Reports regarding conferences</header><text>Not later than the end of each fiscal year, the Administrator of General Services shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a report on conferences proposed to be hosted by the Public Buildings Service for the subsequent fiscal year. The report shall include the following for each proposed conference:</text> 
<paragraph id="H6499F216CF77449D98F472592E90504A"><enum>(1)</enum><text>The purpose of the conference.</text> </paragraph>
<paragraph id="H2A93C14A1115495BAFB702E1CF40411B"><enum>(2)</enum><text>A detailed budget for the conference, including related travel, lodging, and per diem costs.</text> </paragraph>
<paragraph id="HAAC176DB9F6F44148126199D4BA54B6D"><enum>(3)</enum><text>The expected number of participants, including from the Public Buildings Service.</text> </paragraph>
<paragraph id="H23D0F24F3D4742A88A9DAAC4F2FDC33C"><enum>(4)</enum><text>The location and length of the conference.</text> </paragraph>
<paragraph id="HB73BE266DF5D4AEC9DA86FD3E0E3FF76"><enum>(5)</enum><text>Any expected non-Federal funding or sponsorships.</text> </paragraph></subsection>
<subsection id="H31A5821BF7214E618E2E05887DA7816F"><enum>(b)</enum><header>Conference review</header><text>Not later than 60 days after each fiscal year, the Administrator shall submit a report to the congressional committees identified in subsection (a) including the following:</text> 
<paragraph id="H1A8F1C54D38242C29A340AAF203CC34A"><enum>(1)</enum><text>The actual expenditures and costs of each conference and a comparison to the budget submitted pursuant to subsection (a).</text> </paragraph>
<paragraph id="H6385B90D8ABD45EFB7B49C2BC682A39D"><enum>(2)</enum><text>The actual number of participants of the Public Buildings Service in each conference and associated travel, lodging, and per diem costs.</text> </paragraph>
<paragraph id="HF193F7FF60504021A14ADADB2C036DAC"><enum>(3)</enum><text>An agenda of each conference programming and events.</text> </paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="H27AAB504F17B4F399BBE8F6B4E63B65C"><enum>(c)</enum><header>Clerical amendment</header><text>The analysis for such chapter, as amended by this Act, is further amended by adding at the end the following:</text>

<subsection commented="no" id="H2E7AC41F1B3549348DDB850A3D76FEFF"><enum>(a)</enum><header>Administrative costs specified</header><text><external-xref legal-doc="usc" parsable-cite="usc/40/592">Section 592(c)</external-xref> of title 40, United States Code, is amended by adding at the end the following:</text>

<paragraph commented="no" id="HB328F2632D774ADBBCF960BCD8E4C3C6"><enum>(5)</enum><header>Exception for administrative expenses</header><text>Notwithstanding paragraph (1), deposits in the Fund may not be used for administrative expenses of the Public Buildings Service unless an amount specified for such expenses is specifically authorized for a given fiscal year.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection commented="no" id="H0F8D2725D23B4986B5AB066884D97074"><enum>(b)</enum><header>Reporting of administrative expenses</header><text><external-xref legal-doc="usc" parsable-cite="usc/40/3307">Section 3307</external-xref> of title 40, United States Code, is amended by adding at the end the following:</text>

<subsection commented="no" id="H548AFF9ECD4A4F2887D29B34B0645F75"><enum>(i)</enum><header>Budget proposal of administrative expenses</header> 
<paragraph commented="no" id="HCFC7496EBC944FDD9A6D3AED2616FAE3"><enum>(1)</enum><header>Proposed budget</header><text>Not later than the date that the President submits the budget request to Congress pursuant to <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105</external-xref> of title 31, United States Code, the Administrator of General Services shall submit a proposed budget for the Public Buildings Service to the Committee on Transportation and Infrastructure of the House of Representatives, the Committee on Environment and Public Works of the Senate, and the Committees on Appropriations of the House of Representatives and the Senate detailing all proposed administrative expenses for such Service for the following fiscal year.</text> </paragraph>
<paragraph commented="no" id="HFB1EFB3145E048F1A3B04E213A2C5DD8"><enum>(2)</enum><header>Specifics of budget proposal</header><text>Such proposed budget shall include the following:</text> 
<subparagraph commented="no" id="H136D6DECC6154A868FA266E10D737A9A"><enum>(A)</enum><text>A breakdown of proposed administrative expenses of the Public Buildings Service and the expenses of the previous fiscal year, including a breakdown of object classification and subclassification to include salaries, bonuses, travel and transportation, training, and conferences.</text> </subparagraph>
<subparagraph commented="no" id="HB43B61300D9A496A8E6C3F34A9A2E2AF"><enum>(B)</enum><text>A breakdown as described in subparagraph (A) for the Public Buildings Service headquarters, Commissioner’s office, and each of the regional offices.</text> </subparagraph>
<subparagraph commented="no" id="HBD4BF6E6F9554A098FB2432B14436D06"><enum>(C)</enum><text>A breakdown of proposed staffing levels, including the number of full-time equivalent positions and the number of Federal employees by job classification and title of the Public Buildings Service, the Service headquarters, Commissioner’s office, and the regional offices, and the numbers for the same for the previous fiscal year.</text> </subparagraph>
<subparagraph commented="no" id="HA64870D64ED5455ABAAEE614C47954D7"><enum>(D)</enum><text>A detailed justification for any proposed increase in administrative expenses or staffing.</text> </subparagraph>
<subparagraph commented="no" id="H95B28F901B374C62AC9E8A4B2B4C299F"><enum>(E)</enum><text>A justification for the total amount of administrative expenses.</text> </subparagraph></paragraph>
<paragraph commented="no" id="HAEB51FA5643949E4BBF84C9C41AE0369"><enum>(3)</enum><header>Administrative cost categories</header><text>The budget proposal information described in paragraph (2) shall provide the required information within the following administrative cost categories:</text> 
<subparagraph commented="no" id="HE5C89D171ACF4A3FBB4D3CA246AA998C"><enum>(A)</enum><text>Building Operations and Maintenance, including cleaning, utilities and fuels, and maintenance.</text> </subparagraph>
<subparagraph commented="no" id="H5A96052766944CC6B218C22AC1A6A146"><enum>(B)</enum><text>Salaries and Expenses, including other building services, space acquisition, staff support, and information technology services.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>
<section id="HCE8A4C20EA1448089CCCF81A18F5D5DE"><enum>10.</enum><header>Limitation on authorizations</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/40/3307">Section 3307</external-xref> of title 40, United States Code, as amended by this Act, is further amended by adding at the end the following:</text>

<subsection id="HF9B9BB2DAED04438A0C959433353DAB1"><enum>(j)</enum><header>Expiration of committee resolutions</header><text display-inline="yes-display-inline">Unless a lease is executed or a construction, alteration, repair, design, or acquisition project is initiated within 5 years of the resolution approvals adopted by the Committee on Transportation and Infrastructure of the House of Representatives or the Committee on Environment and Public Works of the Senate pursuant to subsection (a), such resolutions shall be deemed expired. This subsection shall only apply to resolutions approved after the date of enactment of this subsection.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
<section id="H9F46F01DB9644D9CBA8690CFB70D1447"><enum>11.</enum><header>Limitation on certain leasing authorities</header> 
<subsection id="H011D4661167C448897EF8B4E1E0F421F"><enum>(a)</enum><header>Limitation on leasing authority of other agencies</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/33">Chapter 33</external-xref> of title 40, United States Code, as amended by this Act, is further amended by adding at the end the following:</text> 
<quoted-block id="HB2ADBBDB7F9142848880DDAD80CE41E3" style="USC"> 
<section id="HDEABC35AA4B445358143FB7D6FFD6FAF"><enum>3321.</enum><header>Limitation on leasing authority of other agencies</header> 
<subsection id="H98A9AD36BE844661BE00F62AB7AA3497"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, an executive agency may not lease space for the purposes of a public building as defined under section 3301, except as provided under section 585 and the provisions of this chapter.</text> </subsection>
<subsection id="H56D550FE7F9E4AC09BE3340075B14936"><enum>(b)</enum><header>Public building</header><text>For the purposes of this section, the term <quote>public building</quote> includes leased space.</text> </subsection>
<subsection id="H717E0132D66F43E3B333AF0744F3D5A5"><enum>(c)</enum><header>Exclusions</header><text>This section shall not apply to—</text> 
<paragraph id="H3FE75200A5EC4884904A69E68E1B4DF5"><enum>(1)</enum><text>properties that are excluded for reasons of national security by the President; and</text> </paragraph>
<paragraph id="H46D223724E3D4A43BBF41D0D0432FA36"><enum>(2)</enum><text>properties of the Department of Veterans Affairs.</text> </paragraph></subsection>
<subsection id="H28B7658F98A04A2FB0CA73AFF2524CFC"><enum>(d)</enum><header>Construction</header><text>Nothing in this section shall be construed as creating new authority for executive agencies to enter into leases.</text> </subsection>
<subsection id="HB781826D6E9B4043B23BAB864D137EAE"><enum>(e)</enum><header>Delegation pilot</header><text display-inline="yes-display-inline">With respect to executive agencies covered by subsection (a)—</text> 
<paragraph id="H7F21A95EAC1D424D8741984F6F9DE78C"><enum>(1)</enum><text>the Administrator of General Services may delegate authority to manage the procurement of leases to an appropriate executive agency if the Administrator determines that such agency has the appropriate expertise and ability to do so and such delegation promotes efficiency and economy;</text> </paragraph>
<paragraph commented="no" id="H23494E43936C41BF84A7CC55BBA3A62B"><enum>(2)</enum><text>the delegation under this subsection does not exempt the Administrator or the agency to which the delegation is made from any other provision of this chapter, including sections 592 and 3307; and</text> </paragraph>
<paragraph id="HCC904AB9A6944B078435D08E7FF254DA"><enum>(3)</enum><text>the delegation authority under this subsection shall terminate on December 31, 2018.</text> </paragraph></subsection>
<subsection id="HBEC02FEFB4AF4DDF88AB6F84A9D7F1B6"><enum>(f)</enum><header>Report</header><text>Not later than 6 months before the termination date set forth in subsection (e)(3), the Administrator shall submit a report to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate. The report shall include an analysis of the effectiveness of the delegation authority provided in this section, including—</text> 
<paragraph id="H31F139FB5ED14A31ABD7A53A6DF438C5"><enum>(1)</enum><text>a comparison of the costs and terms associated with leases procured under the delegation authority to the leases procured by the Public Buildings Service;</text> </paragraph>
<paragraph id="HB32A342EF44F43FA83098777956919BC"><enum>(2)</enum><text>whether procurements delegated were consistent with authorization limitations and parameters; and</text> </paragraph>
<paragraph id="H8F64FAF75327405FBDAB25B7599A7B0A"><enum>(3)</enum><text>recommendations on improvements to the delegation authority and whether such authority should be extended.</text> </paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="HD8013F9EB3164AE0A5D07563E996AA97"><enum>(b)</enum><header>Small businesses</header><text>When using commercial leasing services, the Administrator of General Services shall adhere to the requirements of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>).</text> </subsection>
<subsection id="HF35EC138A11E4D128CB130D3F3C00A8F"><enum>(c)</enum><header>Clerical amendment</header><text>The analysis for such chapter, as amended by this Act, is further amended by adding at the end the following:</text>

<section id="H36B9A4CA95C8498AB8BB76DD4C25FD4D"><enum>3322.</enum><header>Utilization rates</header> 
<subsection id="H91F8B08C916D40498F7810B09ED30524"><enum>(a)</enum><header>Measurement of space utilization</header><text>Not later than 6 months after the date of enactment of this section, the Administrator of General Services shall develop and implement a method of measuring actual utilization rates of its owned and leased inventory of public buildings space and a plan for incorporating such utilization rates into performance metrics for owned and leased buildings by region.</text> </subsection>
<subsection id="HD601CC77987D458E91E1AB60882F7492"><enum>(b)</enum><header>Space utilization</header><text>Any method developed and implemented pursuant to subsection (a) shall be based on actual utilization by rentable square feet per person.</text> </subsection>
<subsection id="HED8B2AFB7065496E89890C518057F612"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this section and annually thereafter, the Administrator shall report to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate utilization rates measured pursuant to subsection (a) and performance metrics for owned and leased buildings.</text> </subsection>
<subsection id="HA93B437E3DD748038CDAECB330174B68"><enum>(d)</enum><header>Certification</header><text>Not later than one year after the date of enactment of this section and every year thereafter, the Administrator and tenant Federal agencies shall certify, in writing, to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate the actual number of personnel housed in each building, leased or owned, in the inventory of the General Services Administration. Such written certifications shall detail the number of Federal employees, temporary employees, contractors, and any other non-Federal employees.</text> </subsection>
<subsection id="HDFC66C7E608C43B5B297B80DD98EB032"><enum>(e)</enum><header>Database</header> 
<paragraph id="H4523BC85B2C14A09ACA6B8F0F54EF432"><enum>(1)</enum><header>In general</header><text>The Administrator shall maintain a database of utilization rates and metrics developed pursuant to this section.</text> </paragraph>
<paragraph id="H4B58A724E8734C1FBA689AB105E4E9A9"><enum>(2)</enum><header>Accessibility</header><text>The database described in paragraph (1) shall be made available upon request by congressional committees.</text> </paragraph>
<paragraph id="H5E5B82D120BF47ACB4DA0FB85DB6E7F0"><enum>(3)</enum><header>Exclusions</header><text>For reasons of national security, the President may exclude any property from the requirements of this subsection.</text> </paragraph></subsection>
<subsection id="H9A9F610FAA0A463F97913A93AB4F9046"><enum>(f)</enum><header>Agency space plans</header><text>Not later than 60 days after the date of enactment of this section, the Administrator shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate all agency Real Property Cost Savings and Innovation Plans submitted pursuant to the MANAGEMENT PROCEDURES MEMORANDUM NO. 2013–02 of the Office of Management and Budget. The Administrator shall submit subsequent updates of the Real Property Cost Savings and Innovation Plans or any successor plans to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate not later than 60 days after their receipt by the Administrator.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="H1609D55AAFF84FE58D4869EAE16F7BF7"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for such chapter, as amended by this Act, is further amended by adding at the end the following:</text>

<section id="H282EB2419DE1405294C19C4B8F6C9C0C"><enum>13.</enum><header>Eliminating project escalations</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/40/3307">Section 3307(c)</external-xref> of title 40, United States Code, is amended by adding at the end the following: <quote>The Administrator shall notify, in writing, the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate of any increase of more than 5 percent of an estimated maximum cost or of any increase or decrease in the scope or size of a project of 5 or more percent. Such notification shall include an explanation regarding any such increase or decrease. The scope or size of a project shall not increase or decrease by more than 10 percent unless an amended prospectus is submitted and approved pursuant to this section.</quote>.</text> </section>
<section id="H4312AFCE3EF64A0CAF7F6B36539F81F2"><enum>14.</enum><header>Report on public building service activities</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator of the General Services shall submit a report to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate regarding how the Public Buildings Service, through its acquisition activities—</text> 
<paragraph id="HCACF29706A364B98BAB6680DA2CA2101"><enum>(1)</enum><text display-inline="yes-display-inline">conserves existing urban, suburban and rural resources;</text> </paragraph>
<paragraph id="H83ACA52A908243F699B1463787FEBB60"><enum>(2)</enum><text>encourages the development and redevelopment of urban, suburban, and rural areas; and</text> </paragraph>
<paragraph id="H55539F11B0AA40E88B4096AE4955991D"><enum>(3)</enum><text>reduces costs to the Public Building Service and improves the social, economic, environmental, and cultural conditions of the communities in urban, suburban, and rural areas.</text> </paragraph></section>
