<official-title display="yes">To amend the Small Business Act with respect to the procurement program for women-owned small business concerns, and for other purposes.<pagebreak/></official-title>

<section id="H8447AF5619F44137B0579B1BDC8526CF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Women’s Procurement Program Equalization Act of 2013</short-title></quote>.</text> </section> 
<section id="HFCA8C9B44C5842E68D63643E61BB1FAC"><enum>2.</enum><header>Women’s Procurement Program Equalization</header><text display-inline="no-display-inline">Section 8(m) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(m)</external-xref>) is amended—</text> 
<paragraph id="HCFA3AA964DB241679CFF8CF058DF98A8"><enum>(1)</enum><text>in paragraph (2), so that subparagraph (E) reads as follows:</text> 
<quoted-block id="H33449928D1654152BF0205C24B7D855C" style="OLC"> 
<subparagraph id="HCC335DE860B741A1AB35E49984FA07E5"><enum>(E)</enum><text>each of the concerns—</text> 
<clause id="H78351C87103B4261B5114D19F1A9CFCE"><enum>(i)</enum><text>is certified by a Federal agency, a State government, or a national certifying entity approved by the Administrator, as a small business concern owned and controlled by women; or</text> </clause> 
<clause id="H6F74D560B807408191C71E92F77E2782"><enum>(ii)</enum><text>is certified by the Administrator as a small business concern owned and controlled by women.</text> </clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="HCEE8462219CA465CA6F8E1AB1DC494E9"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H301A884F9AE547B4B9B797573F126004" style="OLC"> 
<paragraph id="H9A496A15F58D40D29B46F7D46BD874F8"><enum>(7)</enum><header>Sole source contracts for economically disadvantaged women-owned small businesses</header><text>In accordance with this section, a contracting officer may award a sole source contract to any small business concern meeting the requirements of section 8(m)(2)(A) of this Act if—</text> 
<subparagraph id="H5F486209C750458781406C8BFD92160A"><enum>(A)</enum><text>such concern is determined to be a responsible contract with respect to performance of such contract opportunity and the contracting officer does not have a reasonable expectation that 2 or more businesses meeting the requirements of section 8(m)(2)(A) will submit offers;</text> </subparagraph> 
<subparagraph id="HE0C536618A4F4C87A3986DB455E08D0F"><enum>(B)</enum><text>the anticipated award price of the contract (including options) will not exceed—</text> 
<clause id="H58738F6B20774A57BC133876874B5DDE"><enum>(i)</enum><text>$6,500,000 in the case of a contract opportunity assigned a standard industrial code for manufacturing; or</text> </clause> 
<clause id="H669FE821E5A84FFB8FB21F6FFD71CBB2"><enum>(ii)</enum><text>$4,000,000 in the case of any other contract opportunity; and</text> </clause></subparagraph> 
<subparagraph id="H47DDD17709554AA4AD9C1A4D51001B23"><enum>(C)</enum><text>in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price.</text> </subparagraph></paragraph> 
<paragraph id="HCAC0FE5F66874199B814684A6D18675D"><enum>(8)</enum><header>Sole source contracts for women owned small businesses in substantially underrepresented industries</header><text>In accordance with this section, a contracting officer may award a sole source contract to any small business concerns meeting the requirements of section 8(m)(3) of this Act if—</text> 
<subparagraph id="HAA4DA6F0E7AA4E679BA712B7BEF9B921"><enum>(A)</enum><text>such concern is determined to be a responsible contract with respect to performance of such contract opportunity and the contracting officer does not have a reasonable expectation that 2 or more businesses meeting the requirements of section 8(m)(3) will submit offers;</text> </subparagraph> 
<subparagraph id="H2DB5B260BAC74640A450FF329AA28E99"><enum>(B)</enum><text>the anticipated award price of the contract (including options) will not exceed—</text> 
<clause id="HCF03DABFA0EB41C18CC7AA0A1BD028A4"><enum>(i)</enum><text>$6,500,000 in the case of a contract opportunity assigned a standard industrial code for manufacturing; or</text> </clause> 
<clause id="H716A883B43B54A1B9763DF741C8CE68A"><enum>(ii)</enum><text>$4,000,000 in the case of any other contract opportunity; and</text> </clause></subparagraph> 
<subparagraph id="HBF9F6CC8723A4125A9994A7661081CB7"><enum>(C)</enum><text>in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section> 
<section id="H980245C1B0BE4177B2027B4827DDC0BF"><enum>3.</enum><header>Reporting on goals for procurement contracts awarded to small business concerns</header><text display-inline="no-display-inline">Section 15(h)(2)(E)(viii) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644</external-xref>) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H825F6A56B55C419BB85D2D67EAB02404" style="OLC"> 
<clause id="H302B6B58EE2D47E88B21E348106FBB64"><enum>(viii)</enum><text>small business concerns owned and controlled by women—</text> 
<subclause id="H0C550AD708F24D6DAE6D07D5B2CE6986"><enum>(I)</enum><text>in the aggregate;</text> </subclause> 
<subclause id="H07945F87DEAE49518E412854B10F87A2"><enum>(II)</enum><text>through competitions restricted to small business concerns;</text> </subclause> 
<subclause id="H100165E0499143E1BA7E70DFBB85E7B0"><enum>(III)</enum><text>through competitions restricted using the authority under section 8(m)(2);</text> </subclause> 
<subclause id="H60BF713041F94A5BACF89BD513D97D01"><enum>(IV)</enum><text>through competitions restricted using the authority under section 8(m)(2) and in which the waiver authority under section 8(m)(3) was used;</text> </subclause> 
<subclause id="H66E07178C196445EB9D3A4F77FBD91CA"><enum>(V)</enum><text>through sole source contracts awarded using the authority under section 8(m)(7);</text> </subclause> 
<subclause id="H973C02C0A79B4B0FB6A4E777D1450270"><enum>(VI)</enum><text>through sole source contracts awarded using the authority under section 8(m)(8) and in which the waiver authority under section 8(m)(3) was used;</text> </subclause> 
<subclause id="HDC370CF7FAC44E5D8FF6A186ACB02838"><enum>(VII)</enum><text>by industry in which the contracts described in subclauses (III) through (VI) were awarded; and</text> </subclause> 
<subclause id="H7D5FFEC80A73420C8A8D8F6400A683CA"><enum>(VIII)</enum><text>through unrestricted competition; and</text> </subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block> </section>
