		</section><section id="HCA475713423F44E2B5FC7ED7D2A6462D"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of the Congress that:</text>
			<paragraph id="H1A601F6DEA8547FCB9F51E1E80461C71"><enum>(1)</enum><text>Our Nation’s future economic prosperity in the global economy is strongly linked to the ability of
			 our schools to educate students in the science, technology, engineering,
			 and mathematics (STEM) subjects.</text>
			</paragraph><paragraph id="HC958667F07C24CA594034E8B5C5BCA2E"><enum>(2)</enum><text>A portion of application fees paid by employers seeking to hire foreign workers should be devoted
			 to supporting improvements in STEM education in the United States,
			 including computer science education, at the elementary, secondary, and
			 university levels in order to reduce our dependence on foreign workers
			 over time.</text>
			</paragraph><paragraph id="HBD9307589EBD4C48A1BC21AED43EEB01"><enum>(3)</enum><text>Such funds should be used to support—</text>
				<subparagraph id="HCC145631FFAE4341AF13F61361FDC272"><enum>(A)</enum><text>building the capacity of every State to improve student achievement in STEM subjects, especially in
			 the most high-need school districts;</text>
				</subparagraph><subparagraph id="HF2DFCB6205AE4225A91F4128333FD7B6"><enum>(B)</enum><text>supporting innovation in STEM education through partnerships between elementary and secondary
			 schools, universities, non-profits, businesses, and informal education and
			 community-based partners;</text>
				</subparagraph><subparagraph id="H8D679747272D4B20A5E386F023385380"><enum>(C)</enum><text>broadening the diversity and capacity of the STEM education pipeline in the United States through
			 scholarships and other forms of assistance to American students who study
			 in these subjects; and</text>
				</subparagraph><subparagraph id="H41DCE3B99FA2457FBB6D3FA64F745626"><enum>(D)</enum><text display-inline="yes-display-inline">improving and promoting STEM education for underrepresented populations, including economically
			 disadvantaged individuals in STEM fields.</text>
				</subparagraph></paragraph></section><title id="H4EC3AB1E1216494BBB6FCA15BB7486AF"><enum>I</enum><header>Immigrant Visa Reforms</header>
			<section id="HB1F6A010B52D4C479E5B42CBE157746D"><enum>101.</enum><header>Immigrant visas for certain advanced STEM graduates</header>
				<subsection commented="no" id="H812078722100463FAA571F01C6382303"><enum>(a)</enum><header>Worldwide level of immigration</header><text display-inline="yes-display-inline">Section 201(d)(1)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(d)(1)(A)</external-xref>) is amended by
			 striking <quote>140,000,</quote> and inserting <quote>140,000 in fiscal years through 2013 and 195,000 beginning in fiscal year 2014, reduced for any
			 fiscal year beginning in fiscal year 2014 by the number by which the
			 number of visas under section 201(e) would have been reduced in that year
			 pursuant to section 203(d) of the Nicaraguan Adjustment and Central
			 American Relief Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref> note) if section 201(e) had not been
			 repealed by section 106 of the <short-title>SKILLS Visa Act</short-title>,</quote>.</text>
				</subsection><subsection id="H6D0DC53CC985447F82C7BF19EAECF11A"><enum>(b)</enum><header>Preference allocation for employment-Based immigrants</header><text>Section 203(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) is amended—</text>
					<paragraph id="H22A31ACB401347689D87D006175101B9"><enum>(1)</enum><text>by redesignating paragraph (6) as paragraph (9); and</text>
					</paragraph><paragraph id="HD016D04EE4DA4AB39B2FC08F56617916"><enum>(2)</enum><text>by inserting after paragraph (5) the following:</text>
						<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H5C6C1D632E53471D99F82ACD52F35B46" reported-display-style="italic" style="OLC">
							<paragraph id="H1B43ED0AD9734875A18AAE8BF218BE87"><enum>(6)</enum><header>Aliens holding doctorate degrees from U.S. doctoral institutions of higher education in science,
			 technology, engineering, or mathematics</header>
								<subparagraph id="H3F39F9DDBE6047EB8040F301C7066489"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Visas shall be made available, in a number not to exceed 55,000, reduced for any fiscal year by the
			 number by which the number of visas under section 201(e) would have been
			 reduced in that year pursuant to section 203(d) of the Nicaraguan
			 Adjustment and Central American Relief Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref> note) if section
			 201(e) had not been repealed by section 106 of the <short-title>SKILLS Visa Act</short-title>, plus any visas not required for the classes specified in paragraph (1), to qualified immigrants
			 who—</text>
									<clause id="H3C21C1DDB2DA49659AF1A33B50D1B070"><enum>(i)</enum><text display-inline="yes-display-inline">hold a doctorate degree in a field of science, technology, engineering, or mathematics from a
			 United States doctoral institution of higher education, or have
			 successfully completed a dental, medical, or veterinary residency program
			 (within the summary group of residency programs in the Department of
			 Education’s Classification of Instructional Programs taxonomy), have
			 received a medical degree (MD) in a program that prepares individuals for
			 the independent professional practice of medicine (series 51.12 in the
			 Department of Education’s Classification of Instructional Programs
			 taxonomy), have received a dentistry degree (DDS, DMD) in a program that
			 prepares individuals for the independent professional practice of
			 dentistry/dental medicine (series 51.04 in the Department of Education’s
			 Classification of Instructional Programs taxonomy), have received a
			 veterinary degree (DVM) in a program that prepares individuals for the
			 independent professional practice of veterinary medicine (series 51.24 in
			 the Department of Education’s Classification of Instructional Programs
			 taxonomy), or have received an osteopathic medicine/osteopathy degree (DO)
			 in a program that prepares individuals for the independent professional
			 practice of osteopathic medicine (series 51.19 in the Department of
			 Education’s Classification of Instructional Programs taxonomy) from an
			 institution that is described in subclauses (I), (III), and (IV) of
			 subparagraph (B)(iii); and</text>
									</clause><clause id="HB6D7E4B390B54509858E4DF708C20D78"><enum>(ii)</enum><text display-inline="yes-display-inline">have taken not less than 85 percent of the courses required for such degrees, including all courses
			 taken by correspondence (including courses offered by telecommunications)
			 or by distance education, while physically present in the United States.</text>
									</clause></subparagraph><subparagraph id="HF8D10C08C6F6417DABB7455491E7D349"><enum>(B)</enum><header>Definitions</header><text>For purposes of this paragraph, paragraph (7), and sections 101(a)(15)(F)(i)(I) and
			 212(a)(5)(A)(iii)(III):</text>
									<clause id="HF87CAA5151BD458A8075A1F8197DE957"><enum>(i)</enum><text>The term <quote>distance education</quote> has the meaning given such term in section 103 of the Higher Education Act of 1965 (20 U.S.C.
			 1003).</text>
									</clause><clause id="HB90E6A2CE11D49C69A426AA35C3C7BC5"><enum>(ii)</enum><text display-inline="yes-display-inline">The term <quote>field of science, technology, engineering, or mathematics</quote> means a field included in the Department of Education’s Classification of Instructional Programs
			 taxonomy within the summary groups of computer and information sciences
			 and support services, engineering, biological and biomedical sciences,
			 mathematics and statistics, physical sciences, and the series geography
			 and cartography (series 45.07), advanced/graduate dentistry and oral
			 sciences (series 51.05) and nursing (series 51.38).</text>
									</clause><clause id="HEE136BA868A648C2BF03843F56836542"><enum>(iii)</enum><text display-inline="yes-display-inline">The term <quote>United States doctoral institution of higher education</quote> means an institution that—</text>
										<subclause id="HF0B1D950126A4421BA9BA7C2DF85DF9C"><enum>(I)</enum><text display-inline="yes-display-inline">is described in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>) or is a
			 proprietary institution of higher education (as defined in section 102(b)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(b)</external-xref>));</text>
										</subclause><subclause id="H2041DB2B44864607A792BDED973AB078"><enum>(II)</enum><text display-inline="yes-display-inline">was classified by the Carnegie Foundation for the Advancement of Teaching on January 1, 2013, as a
			 doctorate-granting university with a very high or high level of research
			 activity or classified by the National Science Foundation after the date
			 of enactment of this paragraph, pursuant to an application by the
			 institution, as having equivalent research activity to those institutions
			 that had been classified by the Carnegie Foundation as being
			 doctorate-granting universities with a very high or high level of research
			 activity;</text>
										</subclause><subclause id="H2D1735D050E54555B1EB7D22C049D32C"><enum>(III)</enum><text>has been in existence for at least 10 years; and</text>
										</subclause><subclause id="H0C17038AD81C4C46A62E278F05970EB1"><enum>(IV)</enum><text display-inline="yes-display-inline">is accredited by an accrediting body that is itself accredited either by the Department of
			 Education or by the Council for Higher Education Accreditation.</text>
										</subclause></clause></subparagraph><subparagraph id="H058A9BDEC11447E799921FB5271ACE73"><enum>(C)</enum><header>Labor certification required</header>
									<clause id="HAD5225B2DDCA4DFEAFF9B9B65C3409DB"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to clause (ii), the Secretary of Homeland Security may not approve a petition filed for
			 classification of an alien under subparagraph (A) unless the Secretary of
			 Homeland Security is in receipt of a determination made by the Secretary
			 of Labor pursuant to the provisions of section 212(a)(5)(A), except that
			 the Secretary of Homeland Security may, when the Secretary deems it to be
			 in the national interest, waive this requirement.</text>
									</clause><clause id="H29FAB38FEB4747E2A4D542F4602C94BE"><enum>(ii)</enum><header>Requirement deemed satisfied</header><text>The requirement of clause (i) shall be deemed satisfied with respect to an employer and an alien in
			 a case in which a certification made under section 212(a)(5)(A)(i) has
			 already been obtained with respect to the alien by that employer.</text>
									</clause></subparagraph></paragraph><paragraph id="H3E2A8E34596F4F48951B688559E27705"><enum>(7)</enum><header>Aliens holding master’s degrees from U.S. doctoral institutions of higher education in science,
			 technology, engineering, or mathematics</header>
								<subparagraph id="HB17CD978D987404D9CDCC158DA476594"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Any visas not required for the classes specified in paragraphs (1) and (6) shall be made available
			 to the classes of aliens who—</text>
									<clause id="H9A426F6EF9A84D2B8FFF801ADFCE41E3"><enum>(i)</enum><text display-inline="yes-display-inline">hold a master’s degree in a field of science, technology, engineering, or mathematics from a United
			 States doctoral institution of higher education that was either part of a
			 master’s program that required at least 2 years of enrollment or part of a
			 5-year combined baccalaureate-master’s degree program in such field;</text>
									</clause><clause id="HC05ACA6E843A40CB9B2ABFAC9C0BB433"><enum>(ii)</enum><text display-inline="yes-display-inline">have taken not less than 85 percent of the master’s degree courses in a field of science,
			 technology, engineering, or mathematics, including all courses taken by
			 correspondence (including courses offered by telecommunications) or by
			 distance education, while physically present in the United States; and</text>
									</clause><clause id="H987D0F5B7920462D8E54A8F766A81A46"><enum>(iii)</enum><text display-inline="yes-display-inline">hold a baccalaureate degree in a field of science, technology, engineering, or mathematics.</text>
									</clause></subparagraph><subparagraph id="H31DF2820A06E4098BBDB8BB8F93AAF17"><enum>(B)</enum><header>Labor certification required</header>
									<clause id="H871B3274C3434D2F8F6F85EFA4ACE047"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to clause (ii), the Secretary of Homeland Security may not approve a petition filed for
			 classification of an alien under subparagraph (A) unless the Secretary of
			 Homeland Security is in receipt of a determination made by the Secretary
			 of Labor pursuant to the provisions of section 212(a)(5)(A), except that
			 the Secretary of Homeland Security may, when the Secretary deems it to be
			 in the national interest, waive this requirement.</text>
									</clause><clause id="H41D45E2E7061456D88221FD19B75EAE5"><enum>(ii)</enum><header>Requirement deemed satisfied</header><text>The requirement of clause (i) shall be deemed satisfied with respect to an employer and an alien in
			 a case in which a certification made under section 212(a)(5)(A)(i) has
			 already been obtained with respect to the alien by that employer.</text>
									</clause></subparagraph><subparagraph id="H82239C1DC1A34D24AF9A58C73C0D5F4C"><enum>(C)</enum><header>Definitions</header><text>The definitions in paragraph (6)(B) shall apply for purposes of this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HF5901DDBE38E470DB5C7952549BF7B66"><enum>(c)</enum><header>Aliens who are members of the professions holding advanced degrees or aliens of exceptional ability</header><text>Section 203(b)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)(2)(A)</external-xref>) is amended by striking <quote>paragraph (1),</quote> and inserting <quote>paragraphs (1), (6), (7), and (8),</quote>.</text>
				</subsection><subsection id="H0C43047E5ADC4D2A9CCDA5192A123D54"><enum>(d)</enum><header>Skilled workers, professionals, and other workers</header><text>Section 203(b)(3)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)(3)(A)</external-xref>) is amended by striking <quote>paragraphs (1) and (2),</quote> and inserting <quote>paragraphs (1), (2), (6), and (7),</quote>.</text>
				</subsection><subsection id="H26F54063C693430E8EC654E1864B4B0C"><enum>(e)</enum><header>Procedure for granting immigrant status</header><text>Section 204(a)(1)(F) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(F)</external-xref>) is amended—</text>
					<paragraph id="H5100104722284FADA6C54EB05E331ECB"><enum>(1)</enum><text>by striking <quote>(F)</quote> and inserting <quote>(F)(i)</quote>;</text>

								<subclause id="H90171015644C444C8D537C3F1556D938"><enum>(I)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security shall adjudicate such petitions not later than 60 days after the
			 date on which the petition is filed. In the event that additional
			 information or documentation is requested by the Secretary during such
			 60-day period, the Secretary shall adjudicate the petition not later than
			 30 days after the date on which such information or documentation is
			 received.</text>
								</subclause><subclause id="H21D91B7B2A7F4F369E8E88702A2053A8"><enum>(II)</enum><text display-inline="yes-display-inline">The petitioner shall be notified in writing within 30 days of the date of filing if the petition
			 does not meet the standards for approval. If the petition does not meet
			 such standards, the notice shall include the reasons therefore and the
			 Secretary shall provide an opportunity for the prompt resubmission of a
			 modified petition.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" id="H1668AB67F8E44D8E87994EBB389F5694"><enum>(f)</enum><header>Labor certification and qualification for certain immigrants</header><text>Section 212(a)(5) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(5)</external-xref>) is amended—</text>
					<paragraph id="H0D9B98A52EF547D498E0EC0E32F724C6"><enum>(1)</enum><text>in subparagraph (A)—</text>
						<subparagraph commented="no" id="H84904E885DD94DE29F8CE9FB645D9743"><enum>(A)</enum><text>in clause (ii)—</text>

							</clause></subparagraph><subparagraph id="H0E77BF12E1AD4B53BA5A93AB04A2D37F"><enum>(B)</enum><text>by redesignating clauses (ii) through (iv) as clauses (iii) through (v), respectively;</text>
						</subparagraph><subparagraph id="H2E167C36BE3D40DC945C1481D5D81A08"><enum>(C)</enum><text>by inserting after clause (i) the following:</text>
							<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="HFBCFB2969DCF4E048DFEF51369932F0A" reported-display-style="italic" style="OLC">
								<clause id="HCFAB62F21DD54D9A94582A8FAB5F2296"><enum>(ii)</enum><header>Job order</header>
									<subclause id="H82C533812EB64BA886C4A96876FF3921"><enum>(I)</enum><header>In general</header><text>An employer who files an application under clause (i) shall submit a job order for the labor the
			 alien seeks to perform to the State workforce agency in the State in which
			 the alien seeks to perform the labor. The State workforce agency shall
			 post the job order on its official agency website for a minimum of 30 days
			 and not later than 3 days after receipt using the employment statistics
			 system authorized under section 15 of the Wagner-Peyser Act (29 U.S.C. 49
			 et seq.).</text>
									</subclause><subclause id="H9EBBB7F6A07344C091E66CEBD3739BD1"><enum>(II)</enum><header>Links</header><text display-inline="yes-display-inline">The Secretary of Labor shall include links to the official websites of all State workforce agencies
			 on a single webpage of the official website of the Department of Labor.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
						</subparagraph><subparagraph id="H3D7C19A922DF473AA5BC2FD9707ECA3C"><enum>(D)</enum><text>by adding at the end the following:</text>
							<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H6275377A62B24EDFAA4146B52C4058B6" reported-display-style="italic" style="OLC">
								<clause id="HFA69B8FA5B824C10A9A05B7E29BB98FB"><enum>(vi)</enum><header>Processing standards for alien beneficiaries qualifying under paragraphs (6) and (7) of section
			 203(<enum-in-header>b</enum-in-header>)</header><text display-inline="yes-display-inline">The following processing standards shall apply with respect to applications under clause (i)
			 relating to alien beneficiaries qualifying under paragraph (6) or (7) of

									</subclause><subclause id="HDBFF69B77D5D45CFBB0EBC85DDE4D976"><enum>(II)</enum><text display-inline="yes-display-inline">The applicant shall be notified in writing within 60 days of the date of filing if the application
			 does not meet the standards for approval. If the application does not meet
			 such standards, the notice shall include the reasons therefore and the
			 Secretary shall provide an opportunity for the prompt resubmission of a

						</subparagraph></paragraph><paragraph commented="no" id="H0A31D3DFDD1E496DB66E07CD11BBF5C7"><enum>(2)</enum><text>in subparagraph (D), by striking <quote>(2) or (3)</quote> and inserting <quote>(2), (3), (6), or (7)</quote>.</text>
					</paragraph></subsection><subsection id="H51B086F22F774C618114F2172063F60A"><enum>(g)</enum><header>GAO Study</header><text display-inline="yes-display-inline">Not later than June 30, 2019, the Comptroller General of the United States shall provide to the
			 Congress the results of a study on the use by the National Science
			 Foundation of the classification authority provided under section
			 203(b)(6)(B)(iii)(II) of the Immigration and Nationality Act (8 U.S.C.
			 1153(b)(6)(B)(iii)(II)), as added by this section.</text>
				</subsection><subsection commented="no" id="H3F11D5F5653049FDAA9288A88EB85953"><enum>(h)</enum><header>Public information</header><text>The Secretary of Homeland Security shall make available to the public on the official website of
			 the Department of Homeland Security, and shall update not less than
			 monthly, the following information (which shall be organized according to
			 month and fiscal year) with respect to aliens granted status under
			 paragraph (6) or (7) of section 203(b) of the Immigration and Nationality
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>), as added by this section:</text>
					<paragraph commented="no" id="H1427994F9A8C406897499E2D69A78058"><enum>(1)</enum><text>The name, city, and State of each employer who petitioned pursuant to either of such paragraphs on
			 behalf of one or more aliens who were granted status in the month and
			 fiscal year to date.</text>
					</paragraph><paragraph commented="no" id="HF77827AC4BA24CC99EFDB0884F8A26FD"><enum>(2)</enum><text>The number of aliens granted status under either of such paragraphs in the month and fiscal year to
			 date based upon a petition filed by such employer.</text>
					</paragraph><paragraph commented="no" id="HA3EC570CE5FA4F7289CE3080A1EF07DE"><enum>(3)</enum><text>The occupations for which such alien or aliens were sought by such employer and the job titles
			 listed by such employer on the petition.</text>
					</paragraph></subsection><subsection id="H3E6607915A574311B7F307148A94B181"><enum>(i)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on October 1, 2013, and shall apply with
			 respect to fiscal years beginning on or after such date. Nothing in the
			 preceding sentence shall be construed to prohibit the Secretary of
			 Homeland Security from accepting before such date petitions under section
			 204(a)(1)(F) of the Immigration and Nationality Act (8 U.S.C.
			 1154(a)(1)(F)) relating to alien beneficiaries qualifying under paragraph
			 (6) or (7) of section 203(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) (as added by
			 this section).</text>
				</subsection></section><section id="H9EED363E115B46AE989CD394AD65CCC1"><enum>102.</enum><header>Immigrant visas for entrepreneurs</header>
				<subsection id="HAC3DC4DDF3E245A0AD8062D9A5DF543B"><enum>(a)</enum><header>Preference allocation for employment-Based immigrants</header><text display-inline="yes-display-inline">Section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) is amended by inserting
			 after paragraph (7) (as added by section 101 of this Act) the following:</text>
					<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H54D748AAC072411C9B5FE07377B8352E" reported-display-style="italic" style="OLC">
						<paragraph id="H02BED63F24824B59A7092D2E2412BFFB"><enum>(8)</enum><header>Alien entrepreneurs</header>
							<subparagraph id="HE90CAF60DB024BF09E3765026729207D"><enum>(A)</enum><header>In general</header><text>Visas shall be made available, in a number not to exceed 10,000, plus any visas not required for
			 the classes specified in paragraphs (1), (2), and (3), to the following
			 classes of aliens:</text>
								<clause id="H208D63181D9549F29F8ECE034232AB0B"><enum>(i)</enum><header>Venture capital-backed start-up entrepreneurs</header>
									<subclause id="H611D1FD875994D7A9C41C441DC4A928C"><enum>(I)</enum><header>In general</header><text>An alien is described in this clause if the alien intends to engage in a new commercial enterprise
			 (including a limited partnership) in the United States—</text>
										<item id="HFDC0ED5F42554BE98DE525ACC6FEFD44"><enum>(aa)</enum><text>with respect to which the alien has completed an investment agreement requiring an investment in
			 the enterprise in an amount not less than $500,000, subject to subclause
			 (III), on the part of—</text>
											<subitem id="HB32F69D5D6B14B3EBD6E0303012143E2"><enum>(AA)</enum><text display-inline="yes-display-inline">a venture capital fund whose investment adviser is a qualified venture capital entity; or</text>
											</subitem><subitem id="H1FF25B9B4D054F3CAD3E183CBA07F54D"><enum>(BB)</enum><text>2 or more qualified angel investors; and</text>
											</subitem></item><item id="HD0F810F9328C493CBEDEF2092717BE89"><enum>(bb)</enum><text>which will benefit the United States economy and, during the 3-year period beginning on the date on
			 which the visa is issued under this paragraph, will—</text>
											<subitem id="HE1CA167EE1C34E3BA626A51E1A271497"><enum>(AA)</enum><text>create full-time employment for at least 5 United States workers within the enterprise; and</text>
											</subitem><subitem id="H7A428CF74CD64F368B9A318412445081"><enum>(BB)</enum><text>raise not less than an additional $1,000,000 in capital investment, subject to subclause (III), or
			 generate not less than $1,000,000 in revenue, subject to subclause (III).</text>
											</subitem></item></subclause><subclause id="HAA75A63042F4422781B4F26AAB69B35F"><enum>(II)</enum><header>Definitions</header><text>For purposes of this clause:</text>
										<item id="H3C1CBCF934314C28A8D2B33303004160"><enum>(aa)</enum><header>Investment</header><text>The term <quote>investment</quote> does not include any assets acquired, directly or indirectly, by unlawful means.</text>
										</item><item display-inline="no-display-inline" id="H4451ADDC31C646EFA983D238BBFE4CDF"><enum>(bb)</enum><header>Investment adviser</header><text>The term <quote>investment adviser</quote> has the meaning given such term under section 202(a)(11) of the Investment Advisers Act of 1940
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/80b-2">15 U.S.C. 80b-2(a)(11)</external-xref>).</text>
										</item><item id="HD511BD59B3A34CD2AE8907F1A4E3F50B"><enum>(cc)</enum><header>Qualified Angel Investor</header><text>The term <quote>qualified angel investor</quote> means an individual who—</text>
											<subitem id="H8F25095FB32C41D6810360DAE634F227"><enum>(AA)</enum><text>is an accredited investor (as defined in <external-xref legal-doc="usc" parsable-cite="usc/17/230">section 230.501(a)</external-xref> of title 17, Code of Federal
			 Regulations (as in effect on April 1, 2010));</text>
											</subitem><subitem id="HDAFAED521E9747C68C743DC7BBBD2BB6"><enum>(BB)</enum><text>is a United States citizen or an alien lawfully admitted to the United States for permanent
			 residence; and</text>
											</subitem><subitem id="H6D4AE3204A6D4C0B9AA98CA629B12BC1"><enum>(CC)</enum><text>has made at least 2 investments during the 3 year period before the date of a petition by the
			 qualified immigrant for classification under this paragraph.</text>
											</subitem></item><item display-inline="no-display-inline" id="HB82E3D94D3324230892C3FC6D4194051"><enum>(dd)</enum><header>Qualified venture capital entity</header><text>The term <quote>qualified venture capital entity</quote> means, with respect to a qualified immigrant, an entity that—</text>
											<subitem id="H5322AB41E40F466AA0DBEDFA1BBF57A9"><enum>(AA)</enum><text>serves as an investment adviser to a venture capital fund that is making an investment under this
			 paragraph;</text>
											</subitem><subitem id="HA4557E72631C4D6FBCE2FA91D7B1902F"><enum>(BB)</enum><text>has its primary office location or principal place of business in the United States;</text>
											</subitem><subitem id="HC32289800F634B3C94BD6FAAC40B35FB"><enum>(CC)</enum><text>is owned and controlled, directly or indirectly, by individuals the majority of whom are United
			 States citizens or aliens lawfully admitted to the United States for
			 permanent residence;</text>
											</subitem><subitem id="HEDED93271F6746F9AA0FBBDE576CE033"><enum>(DD)</enum><text>has been advising one or more venture capital funds for a period of at least 2 years before the
			 date of the petition for classification under this paragraph; and</text>
											</subitem><subitem id="H68B8550F7F0647288BDB02F7AAFDB8EA"><enum>(EE)</enum><text>advises one or more venture capital funds that have made at least 2 investments of not less than
			 $500,000 in each of the 2 years before the date of the petition for
			 classification under this paragraph.</text>
											</subitem></item><item id="HF5B18D43BB484CF3A72709F64AFBE17C"><enum>(ee)</enum><header>Venture capital fund</header><text>The term <quote>venture capital fund</quote> means an entity—</text>
											<subitem id="H2D1FA7ED1FAF4A2283B1BCE1E3F3459E"><enum>(AA)</enum><text>that is classified as a <quote>venture capital operating company</quote> under <external-xref legal-doc="regulation" parsable-cite="cfr/29/2510.3">section 2510.3–101(d)</external-xref> of title 29, Code of Federal Regulations (as in effect on January 1,
			 2013) or has management rights in its portfolio companies to the extent
			 required by such section if the venture capital fund were classified as a
			 venture capital operating company;</text>
											</subitem><subitem id="HE6F96752C0F846FBA805C548D111957E"><enum>(BB)</enum><text>has capital commitments of not less than $10,000,000; and</text>
											</subitem><subitem id="H1AAEB7F0F1064F3F966A863DD87B0B56"><enum>(CC)</enum><text>whose general partner or managing member is owned and controlled, directly or indirectly, by
			 individuals the majority of whom are United States citizens or aliens
			 lawfully admitted to the United States for permanent residence.</text>
											</subitem></item></subclause><subclause id="HDF6D3B6E473F4710B6F37C748FF2BCE6"><enum>(III)</enum><header>Inflation Adjustment</header><text>Effective for the first fiscal year that begins more than 6 months after the date of the enactment
			 of this clause, and for each fiscal year thereafter, the amounts described
			 in subclauses (I) and (II) shall be increased by the percentage (if any)
			 by which the Consumer Price Index for the month of June preceding the date
			 on which such increase takes effect exceeds the Consumer Price Index for
			 the same month of the preceding calendar year. An increase described in
			 the preceding sentence shall apply to aliens filing petitions under
			 section 204(a)(1)(H) on or after the date on which the increase takes
			 effect. For purposes of this clause, the term <quote>Consumer Price Index</quote> means the Consumer Price Index for all urban consumers published by the Department of Labor.</text>
									</subclause></clause><clause id="HC2061E63F2FC472BBDC5996748FCF8E6"><enum>(ii)</enum><header>Treaty Investors</header><text>Immigrants who have been issued a visa or otherwise provided nonimmigrant status under section
			 101(a)(15)(E)(ii) (not including alien employees of the treaty investor)
			 who have maintained that status for a minimum of 10 years and have
			 benefitted the United States economy and created full-time employment for
			 not fewer than 5 United States workers for a minimum of 10 years.</text>
								</clause></subparagraph><subparagraph id="H9DEF3C42B421431C8144EB6FFE7D70BF"><enum>(B)</enum><header>Definitions</header><text>For purposes of this paragraph:</text>
								<clause id="H01C8E9BF43234E08923566BA2CD5172A"><enum>(i)</enum><text>The term <quote>full-time employment</quote> has the meaning given such term in paragraph (5).</text>
								</clause><clause id="H0B1983A64CC9456E8720484D8E3C7E1F"><enum>(ii)</enum><text>The term <quote>United States worker</quote> means an employee (other than the immigrant or the immigrant’s spouse, sons, or daughters) who—</text>
									<subclause id="HC8BF69396B24449C878E9150F3F69552"><enum>(I)</enum><text>is a citizen or national of the United States; or</text>
									</subclause><subclause id="H19163AD4020746AEBFF24870DA1CD4B0"><enum>(II)</enum><text>is an alien who is lawfully admitted for permanent residence, is admitted as a refugee under
			 section 207, is granted asylum under section 208, or is an immigrant
			 otherwise authorized to be employed in the United States.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HD4A4F6A524E54722BE0B453364024B4D"><enum>(b)</enum><header>Procedures for granting immigrant status</header><text>Section 204(a)(1)(H) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(H)</external-xref>) is amended—</text>

								<section id="H5A1AC53A748C49109C19E8A43EBD24DA"><enum>216B.</enum><header>Conditional permanent resident status for certain alien entrepreneurs, spouses, and children</header>
									<subsection id="H261B1C531EB44C2BA4BDFF38A3CEEEA2"><enum>(a)</enum><header>In general</header>
										<paragraph id="H4C3F7974848246099E84342956ECB98E"><enum>(1)</enum><header>Conditional basis for status</header><text>Notwithstanding any other provision of this Act, an alien entrepreneur (as defined in subsection
			 (f)(1) of this section), alien spouse, and alien child (as defined in
			 subsection (f)(2) of this section) shall be considered, at the time of
			 obtaining the status of an alien lawfully admitted for permanent
			 residence, to have obtained such status on a conditional basis subject to
			 the provisions of this section.</text>
										</paragraph><paragraph id="H611988AC0E9D467C8BB3AFDC37BA9E5D"><enum>(2)</enum><header>Notice of requirements</header>
											<subparagraph id="H0FCB58FA320641EA910E72C38125013E"><enum>(A)</enum><header>At time of obtaining permanent residence</header><text>At the time an alien entrepreneur, alien spouse, or alien child obtains permanent resident status
			 on a conditional basis under paragraph (1), the Secretary of Homeland
			 Security shall provide for notice to such an entrepreneur, spouse, or
			 child respecting the provisions of this section and the requirements of
			 subsection (c)(1) of this section to have the conditional basis of such
			 status removed.</text>
											</subparagraph><subparagraph id="H86AE5C44240847F5AB9BD308F5499AFE"><enum>(B)</enum><header>At time of required petition</header><text>In addition, the Secretary of Homeland Security shall attempt to provide notice to such an
			 entrepreneur, spouse, or child, at or about the beginning of the 90-day
			 period described in subsection (d)(2)(A) of this section, of the
			 requirements of subsection (c)(1) of this section.</text>
											</subparagraph><subparagraph id="H7269139EC74E4B9998984DED7C107698"><enum>(C)</enum><header>Effect of failure to provide notice</header><text>The failure of the Secretary of Homeland Security to provide a notice under this paragraph shall
			 not affect the enforcement of the provisions of this section with respect
			 to such an entrepreneur, spouse, or child.</text>
											</subparagraph></paragraph></subsection><subsection id="HBBCAF6B9AC3F45A2850000D8BC26A33E"><enum>(b)</enum><header>Termination of status if finding that qualifying entrepreneurship improper</header>
										<paragraph id="HC487A07A7B2F407A86B1CDB736A635A7"><enum>(1)</enum><header>In general</header><text>In the case of an alien entrepreneur with permanent resident status on a conditional basis under
			 subsection (a) of this section, if the Secretary of Homeland Security
			 determines, before the third anniversary of the alien’s obtaining the
			 status of lawful admission for permanent residence, that—</text>
											<subparagraph id="H74A74434379C45A78EC3D47A79E3B144"><enum>(A)</enum><text>the required investment in the commercial enterprise under section 203(b)(8)(A)(i)(I) was intended
			 solely as a means of evading the immigration laws of the United States;</text>
											</subparagraph><subparagraph id="HD547342106F042849A20C192466CD9C5"><enum>(B)</enum>
												<clause commented="no" display-inline="yes-display-inline" id="H10DBC8FE27874691820A9EB220F3A779"><enum>(i)</enum><text>any requisite capital to be invested under section 203(b)(8)(A)(i)(I) had not been invested, or was
			 not actively in the process of being invested; or</text>
												</clause><clause changed="added" committee-id="HJU00" id="H0066863CE2B646ACAA2BD3561DDF8C81" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>the alien was not sustaining the actions described in clause (i) throughout the period of the
			 alien’s residence in the United States; or</text>
												</clause></subparagraph><subparagraph id="H4DBA6B2DE6BB4B09AABA182736B786C2"><enum>(C)</enum><text>the alien was otherwise not conforming to the requirements of section 203(b)(8)(A)(i);</text></subparagraph><continuation-text continuation-text-level="paragraph">then the Secretary of Homeland Security shall so notify the alien involved and, subject to
			 paragraph (2), shall terminate the permanent resident status of the alien
			 (and the alien spouse and alien child) involved as of the date of the
			 determination.</continuation-text></paragraph><paragraph id="H970744A1C3364605A09A9B89981FB609"><enum>(2)</enum><header>Hearing in removal proceeding</header><text>Any alien whose permanent resident status is terminated under paragraph (1) may request a review of
			 such determination in a proceeding to remove the alien. In such
			 proceeding, the burden of proof shall be on the Secretary of Homeland
			 Security to establish, by a preponderance of the evidence, that a
			 condition described in paragraph (1) is met.</text>
										</paragraph></subsection><subsection id="HDCB96E56AE4940A6B7EBE0D145F47012"><enum>(c)</enum><header>Requirements of timely petition and interview for removal of condition</header>
										<paragraph id="H3B3C3510CE60404BA905E2535CDCFB58"><enum>(1)</enum><header>In general</header><text>In order for the conditional basis established under subsection (a) of this section for an alien
			 entrepreneur, alien spouse, or alien child to be removed—</text>
											<subparagraph id="H27F6AF7B3B054BF4ACC1D652C50F4C8B"><enum>(A)</enum><text>the alien entrepreneur must submit to the Secretary of Homeland Security, during the period
			 described in subsection (d)(2), a petition which requests the removal of
			 such conditional basis and which states, under penalty of perjury, the
			 facts and information described in subsection (d)(1); and</text>
											</subparagraph><subparagraph id="H09F597202DE7410DA7DA96D3ADB750BE"><enum>(B)</enum><text>in accordance with subsection (d)(3), the alien entrepreneur must appear for a personal interview
			 before an officer or employee of the Department of Homeland Security
			 respecting the facts and information described in subsection (d)(1).</text>
											</subparagraph></paragraph><paragraph id="HE8D2E6A96A504B1BA4670AD2484BD91C"><enum>(2)</enum><header>Termination of permanent resident status for failure to file petition or have personal interview</header>
											<subparagraph id="H80C80FAED0B6405CA2EC76D5CD24BD4C"><enum>(A)</enum><header>In general</header><text>In the case of an alien with permanent resident status on a conditional basis under subsection (a)
			 of this section, if—</text>
												<clause id="H2691920560C0439DB53C5098C513628F"><enum>(i)</enum><text>no petition is filed with respect to the alien in accordance with the provisions of paragraph
			 (1)(A); or</text>
												</clause><clause id="HF7065F2E297449D1B60221660EC7F8D4"><enum>(ii)</enum><text>unless there is good cause shown, the alien entrepreneur fails to appear at the interview described
			 in paragraph (1)(B) (if required under subsection (d)(3) of this section),
			 the Secretary of Homeland Security shall terminate the permanent resident
			 status of the alien (and the alien’s spouse and children if it was
			 obtained on a conditional basis under this section or section 216A) as of
			 the third anniversary of the alien’s lawful admission for permanent
			 residence.</text>
												</clause></subparagraph><subparagraph id="H4052ECEC201B4BE0B4C792BE32EC5887"><enum>(B)</enum><header>Hearing in removal proceeding</header><text>In any removal proceeding with respect to an alien whose permanent resident status is terminated
			 under subparagraph (A), the burden of proof shall be on the alien to
			 establish compliance with the conditions of subparagraphs (A) and (B) of
			 paragraph (1).</text>
											</subparagraph></paragraph><paragraph id="H8EDEC8E80F694B7C9BF990D0F784DC2C"><enum>(3)</enum><header>Determination after petition and interview</header>
											<subparagraph id="H8C894A063F824545864BEAD169D5D731"><enum>(A)</enum><header>In general</header><text>If—</text>
												<clause id="H11491DD1041F45678F84B4F3477CF0B0"><enum>(i)</enum><text>a petition is filed in accordance with the provisions of paragraph (1)(A); and</text>
												</clause><clause id="H6829FF27D65942159FF1D3BE9955B903"><enum>(ii)</enum><text display-inline="yes-display-inline">the alien entrepreneur appears at any interview described in paragraph (1)(B);</text></clause><continuation-text continuation-text-level="subparagraph">the Secretary of Homeland Security shall make a determination, within 90 days of the date of such
			 filing or interview (whichever is later), as to whether the facts and
			 information described in subsection (d)(1) and alleged in the petition are
			 true with respect to the qualifying commercial enterprise.</continuation-text></subparagraph><subparagraph id="H3D97635CDB9A4D6E850E230C6BCB391C"><enum>(B)</enum><header>Removal or extension of conditional basis</header>
												<clause id="HE7EFAC7B53A04CFBA294673C1F6FA068"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), if the Secretary of Homeland Security determines that such facts
			 and information are true, including demonstrating that the alien complied
			 with subsection (d)(1)(B)(i), the Secretary shall so notify the alien
			 involved and shall remove the conditional basis of the alien’s status
			 effective as of the third anniversary of the alien’s lawful admission for
			 permanent residence.</text>
												</clause><clause id="H20EF9C8A7D8B43F691A3489AF15E9A80"><enum>(ii)</enum><header>Exception</header><text>If the petition demonstrates that the facts and information are true, including demonstrating that
			 the alien is in compliance with section (d)(1)(B)(ii), then the Secretary
			 of Homeland Security may, in the Secretary’s discretion, extend the
			 conditional status for an additional year at the end of which—</text>
													<subclause id="H692D4D8CAF01467B93D04BA3C9E14234"><enum>(I)</enum><text>the alien must file a petition within 30 days after the fourth anniversary of the alien’s lawful
			 admission for permanent residence demonstrating that the alien complied
			 with subsection (d)(1)(B)(i) and the Secretary shall remove the
			 conditional basis of the alien’s status effective as of such fourth
			 anniversary; or</text>
													</subclause><subclause id="HA80697E7902F4D01904CCEB19258697D"><enum>(II)</enum><text>the conditional status shall terminate.</text>
													</subclause></clause></subparagraph><subparagraph id="HA0B649D595C64802B173E90EDC2DAF24"><enum>(C)</enum><header>Determination if adverse determination</header><text>If the Secretary of Homeland Security determines that such facts and information are not true, the
			 Secretary shall so notify the alien involved and, subject to subparagraph
			 (D), shall terminate the permanent resident status of an alien
			 entrepreneur, alien spouse, or alien child as of the date of the
			 determination.</text>
											</subparagraph><subparagraph id="H854C9AFE781D4A14888EC1B3B10A24BF"><enum>(D)</enum><header>Hearing in removal proceeding</header><text>Any alien whose permanent resident status is terminated under subparagraph (C) may request a review
			 of such determination in a proceeding to remove the alien. In such
			 proceeding, the burden of proof shall be on the Secretary of Homeland
			 Security to establish, by a preponderance of the evidence, that the facts
			 and information described in subsection (d)(1) of this section and alleged
			 in the petition are not true with respect to the qualifying commercial
			 enterprise.</text>
											</subparagraph></paragraph></subsection><subsection id="H3F8D15026400414CAC67DE64997A61EE"><enum>(d)</enum><header>Details of petition and interview</header>
										<paragraph id="H537B69BA2B3E451B8A96372615862B8B"><enum>(1)</enum><header>Contents of petition</header><text>Each petition under subsection (c)(1)(A) shall contain facts and information demonstrating that—</text>
											<subparagraph id="H19B0FC717ECD44F28F8CAF8CAC38E412"><enum>(A)</enum>
												<clause commented="no" display-inline="yes-display-inline" id="H5EBFCF7210734C46BFA323E07D4173B5"><enum>(i)</enum><text>any requisite capital to be invested under section 203(b)(8)(A)(i)(I) had been invested, or was
			 actively in the process of being invested; and</text>
												</clause><clause changed="added" committee-id="HJU00" id="H7CC4C914E5114B40B8941CBF5016E8D0" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>the alien sustained the actions described in clause (i) throughout the period of the alien’s
			 residence in the United States;</text>
												</clause></subparagraph><subparagraph id="H0E075B172EA54239AFB7A99B99F89766"><enum>(B)</enum>
												<clause commented="no" display-inline="yes-display-inline" id="H97A7D4112959455F9A1E808CA2B26343"><enum>(i)</enum><text>the alien created the employment required under section 203(b)(8)(A)(i)(I)(bb)(AA); or</text>
												</clause><clause changed="added" committee-id="HJU00" id="HA933874A44E24451ACE4EDAEB91CD6C4" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>the alien is actively in the process of creating the employment required under section
			 203(b)(8)(A)(i)(I)(bb)(AA) and will create such employment before the
			 fourth anniversary of the alien’s lawful admission for permanent
			 residence; and</text>
												</clause></subparagraph><subparagraph id="H958B1EF488BF4871B907CA2E64BD937D"><enum>(C)</enum><text>the alien is otherwise conforming to the requirements of section 203(b)(8)(A)(i).</text>
											</subparagraph></paragraph><paragraph id="H1C430DB4365841D2B22B7B3F416A729D"><enum>(2)</enum><header>Period for filing petition</header>
											<subparagraph id="HA6D80304B1CC4A2F91F1E021123DF170"><enum>(A)</enum><header>90-day period before second anniversary</header><text>Except as provided in subparagraph (B), the petition under subsection (c)(1)(A) of this section
			 must be filed during the 90-day period before the third anniversary of the
			 alien’s lawful admission for permanent residence.</text>
											</subparagraph><subparagraph id="HD224F639D1C44C07B524EA669F288548"><enum>(B)</enum><header>Date petitions for good cause</header><text>Such a petition may be considered if filed after such date, but only if the alien establishes to
			 the satisfaction of the Secretary of Homeland Security good cause and
			 extenuating circumstances for failure to file the petition during the
			 period described in subparagraph (A).</text>
											</subparagraph><subparagraph id="HF5DDB749949449C69BB7FA860EA63424"><enum>(C)</enum><header>Filing of petitions during removal</header><text>In the case of an alien who is the subject of removal hearings as a result of failure to file a
			 petition on a timely basis in accordance with subparagraph (A), the
			 Secretary of Homeland Security may stay such removal proceedings against
			 an alien pending the filing of the petition under subparagraph (B).</text>
											</subparagraph></paragraph><paragraph id="H8356B1C175F0428DA3F2404083899F85"><enum>(3)</enum><header>Personal interview</header><text>The interview under subsection (c)(1)(B) shall be conducted within 90 days after the date of
			 submitting a petition under subsection (c)(1)(A) and at a local office of
			 the Department of Homeland Security, designated by the Secretary of
			 Homeland Security, which is convenient to the parties involved. The
			 Secretary, in the Secretary’s discretion, may waive the deadline for such
			 an interview or the requirement for such an interview in such cases as may
			 be appropriate.</text>
										</paragraph></subsection><subsection id="HD7C9457113754BEB85164A06D137DCDC"><enum>(e)</enum><header>Treatment of period for purposes of naturalization</header><text>For purposes of title III, in the case of an alien who is in the United States as a lawful
			 permanent resident on a conditional basis under this section, the alien
			 shall be considered to have been admitted as an alien lawfully admitted
			 for permanent residence and to be in the United States as an alien
			 lawfully admitted to the United States for permanent residence.</text>
									</subsection><subsection id="H59640388605F481B954C5BEA28899807"><enum>(f)</enum><header>Definitions</header><text>In this section:</text>
										<paragraph id="H59186D725DAB4535A838CDDEACCC1448"><enum>(1)</enum><text>The term <quote>alien entrepreneur</quote> means an alien who obtains the status of an alien lawfully admitted for permanent residence
			 (whether on a conditional basis or otherwise) under section
			 203(b)(8)(A)(i)(I) of this title.</text>
										</paragraph><paragraph id="H9E5A5030166A4A05A4F26F04EF243DD8"><enum>(2)</enum><text>The term <quote>alien spouse</quote> and the term <quote>alien child</quote> mean an alien who obtains the status of an alien lawfully admitted for permanent residence
			 (whether on a conditional basis or otherwise) by virtue of being the
			 spouse or child, respectively, of an alien entrepreneur.</text>
										</paragraph><paragraph id="HE85F988BA7FB41A4A7DFDE5428110119"><enum>(3)</enum><text>The term <quote>commercial enterprise</quote> includes a limited partnership.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph><subparagraph commented="no" id="H8D492764725C4DBCA9CB6076A20B48AC"><enum>(B)</enum><header>Clerical amendment</header><text>The table of contents for such Act is amended by inserting after the item relating to section 216A
			 the following:</text>

				<subsection id="H3C2967B8B29842CBA84D7C0E1E0780E2"><enum>(a)</enum><header>Worldwide level of employment-Based immigrants</header><text>Section 201(d)(1)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(d)(1)(A)</external-xref>), as amended by
			 section 101, is further amended by striking <quote>195,000</quote> and inserting <quote>235,000</quote>.</text>
				</subsection><subsection id="H43AF5557E5CA41F9BC8865E22BD58C27"><enum>(b)</enum><header>Priority workers</header><text>Section 203(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)(1)</external-xref>) is amended by striking <quote>28.6 percent of such worldwide level,</quote> and inserting <quote>40,040,</quote>.</text>

				</subsection><subsection id="H71F8BD90A15E45F2B99BEC187ABDD485"><enum>(f)</enum><header>Employment creation</header><text>Section 203(b)(5)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)(5)(A)</external-xref>) is amended by striking <quote>7.1 percent of such worldwide level,</quote> and inserting <quote>9,940,</quote>.</text>
				</subsection><subsection id="HE5CB909AB7234F069809D45451A8AC5B"><enum>(g)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on October 1, 2013, and shall apply with
			 respect to fiscal years beginning on or after such date.</text>
				</subsection><subsection id="H0638BE2A26854BB5B9AFC2574F0F15D5"><enum>(h)</enum><header>Adjustment of status for employment-based immigrants</header><text display-inline="yes-display-inline">Section 245 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref>) is amended by adding at the end the following:</text>

			 received optional practical training after completion of the alien’s
			 course of study, and any eligible dependents of such alien, who has filed
			 a petition or on whose behalf a petition has been filed for immigrant
			 status pursuant to subparagraph (E), (F), (G), or (H) of section
			 204(a)(1), may concurrently, or at any time thereafter, file an
			 application with the Secretary of Homeland Security for adjustment of
			 status if such petition has been approved, regardless of whether an
			 immigrant visa is immediately available at the time the application is
			 filed.</text>
							</paragraph><paragraph id="H0E3A47CCA492411FB6FB35AB3803B009"><enum>(2)</enum><header>Availability</header><text display-inline="yes-display-inline">An application filed pursuant to paragraph (1) may not be approved until the date on which an
			 immigrant visa becomes available.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="HF45EBD536109476485F91C2994459AD1"><enum>104.</enum><header>Employment creation immigrant visas</header>
				<subsection id="H022263DF4F2242F99FE321833598106E"><enum>(a)</enum><header>Changes to the general program</header>
					<paragraph id="HE9EB33D0120A4F4690A2ACF80652155E"><enum>(1)</enum><header>Capital</header><text>Section 203(b)(5)(C) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)(5)(C)</external-xref>) is amended by
			 adding at the end the following:</text>

							<clause id="HF2149227A7104C66B4F15EC2C2501F99"><enum>(v)</enum><header>Inflation adjustment</header>
								<subclause id="H04D5BA21314545C5935C77FC606E2774"><enum>(I)</enum><header>Initial adjustment</header><text>As of the date of enactment of the <short-title>SKILLS Visa Act</short-title>, the amount specified in the first sentence of clause (i) shall be increased by the percentage (if
			 any) by which the Consumer Price Index for the month preceding such
			 enactment date exceeds the Consumer Price Index for the same month of
			 calendar year 1990. The increase described in the preceding sentence shall
			 apply to aliens filing petitions under section 204(a)(1)(H) on or after
			 such enactment date.</text>
								</subclause><subclause id="H4289A78E81CF450D8EC1D20DA2363869"><enum>(II)</enum><header>Subsequent adjustments</header><text>Effective for the first fiscal year that begins more than 6 months after the date of the enactment
			 of this clause, and for each fiscal year thereafter, the amount described
			 in subclause (I) (as of the last increase to such amount) shall be
			 increased by the percentage (if any) by which the Consumer Price Index for
			 the month of June preceding the date on which such increase takes effect
			 exceeds the Consumer Price Index for the same month of the preceding
			 calendar year. An increase described in the preceding sentence shall apply
			 to aliens filing petitions under section 204(a)(1)(H) on or after the date
			 on which the increase takes effect.</text>
								</subclause><subclause id="HB68B8845A8CE4329B7764732C941D12E"><enum>(III)</enum><header>Definition</header><text>For purposes of this clause, the term <quote>Consumer Price Index</quote> means the Consumer Price Index for all urban consumers published by the Department of Labor.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>

						<subparagraph id="H5ED7FDFAD38047D0B2964960A77AD605"><enum>(A)</enum><header>Removal of conditional basis if favorable determination</header><text>Section 216A(c)(3)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1186b">8 U.S.C. 1186b(c)(3)(B)</external-xref>), is amended
			 to read as follows:</text>

			 complied with section (d)(1)(B)(i), the Secretary shall so notify the
			 alien involved and shall remove the conditional basis of the alien’s
			 status effective as of the second anniversary of the alien’s lawful
			 admission for permanent residence.</text>
									</clause><clause id="H1E377B3F88964DC1A768AFFE052F4CAE"><enum>(ii)</enum><header>Exception</header><text>If the petition demonstrates that the facts and information are true, including demonstrating that
			 the alien is in compliance with section (d)(1)(B)(ii), then the Secretary
			 of Homeland Security may in the Secretary’s discretion extend the
			 conditional status for an additional year at the end of which—</text>

			 admission for permanent residence demonstrating that the alien complied

			 basis of the alien’s status effective as of such third anniversary; or</text>
										</subclause><subclause id="H4A86128703A344348BE477E681220C71"><enum>(II)</enum><text>the conditional status shall terminate.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

			 area must fit entirely within a geographical unit that the Secretary of
			 Labor has determined has an unemployment rate of at least 150 percent of
			 the national average rate (and which determination has not been superseded
			 by a later determination in which the Secretary of Labor has found that
			 the unit did not have an unemployment rate of at least 150 percent of the
			 national average rate). The Secretary of Labor shall set forth a uniform
			 methodology for determining whether an area an area qualifies as having
			 experienced unemployment of at least 150 percent of the national average
			 rate. It shall be within the discretion of the Secretary of Homeland
			 Security to determine whether any particular area has experienced high
			 unemployment for purposes of this paragraph, and the Secretary shall not
			 be bound by the determination of any other governmental or nongovernmental
			 entity that a particular area has experienced high unemployment for
			 purposes of this paragraph.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="H14D973836EED43929853661C48829031"><enum>(b)</enum><header>Regional centers</header>
					<paragraph id="H1E0713BA93EA48E5AB49BD310C5A530E"><enum>(1)</enum><header>Permanent reauthorization of the regional center pilot program</header><text>Section 610 of the Departments of Commerce, Justice, and State, the Judiciary, and Related Agencies
			 Appropriations Act, 1993 (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153</external-xref> note) is amended—</text>
						<subparagraph id="H7B506A762DD446FD89037371967857E9"><enum>(A)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="traditional-inline">Pilot</header-in-text></quote>; and</text>
						</subparagraph><subparagraph id="HC33A4E15C0D24F5180E2C5E6AFADAFC1"><enum>(B)</enum><text>in subsection (b), by striking <quote>until September 30, 2015</quote>.</text>
						</subparagraph></paragraph><paragraph id="H09BF4523612243CC8DBB2205BBDFC619"><enum>(2)</enum><header>Persons barred from involvement in regional centers</header>
						<subparagraph id="H262F88F7DE334CE4A46DD337E8D79C4F"><enum>(A)</enum><header>Prohibition</header><text>Such section 610 is amended by adding at the end the following:</text>
							<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H2B9E53B7CE9842218846452C2629BB68" reported-display-style="italic" style="OLC">
								<subsection id="HD7640F8539A14C1A9EE3F77AD2F6B0C5"><enum>(e)</enum>
									<paragraph commented="no" display-inline="yes-display-inline" id="H65AD5CA6D6DD47D4AD260EA391AA5B37"><enum>(1)</enum><text>No person who—</text>
										<subparagraph changed="added" committee-id="HJU00" id="HFE5E876FE4744F36BE656CA48F4CD5FA" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>has been convicted of an aggravated felony (as defined in section 101(a)(43) of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(43)</external-xref>));</text>
										</subparagraph><subparagraph changed="added" committee-id="HJU00" id="HA7C969BDD9B44384859123DB0B915240" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>would be inadmissible under section 212(a)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)</external-xref>) if they were an
			 alien seeking admission; or</text>
										</subparagraph><subparagraph changed="added" committee-id="HJU00" id="HA95D398FA7DB422D8499BDAACAAE5F46" indent="up1" reported-display-style="italic"><enum>(C)</enum><text display-inline="yes-display-inline">has been convicted of violating, or found to have violated, a fraud provision of the Federal
			 securities laws (as such term is defined under section 3 of the Securities
			 Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78c">15 U.S.C. 78c</external-xref>)),</text></subparagraph><continuation-text changed="added" committee-id="HJU00" continuation-text-level="paragraph" indent="subsection" reported-display-style="italic">shall knowingly be permitted by any regional center to be involved with the regional center as its
			 principal, representative, administrator, owner, officer, board member,
			 manager, executive, general partner, fiduciary, member, or in other
			 similar position of substantive authority for the operations, management,
			 or promotion of the regional center.</continuation-text></paragraph><paragraph changed="added" committee-id="HJU00" id="HB2F44FAD216B404B86DDD931A8AA0965" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The Secretary of Homeland Security shall require such attestations and information (including
			 biometric information), and shall perform such criminal record checks and
			 other background checks with respect to a regional center, and persons
			 involved in a regional center as described in paragraph (1), as the
			 Secretary, in the Secretary’s discretion, considers appropriate to
			 determine whether the regional center is in compliance with paragraph (1).</text>
									</paragraph><paragraph changed="added" committee-id="HJU00" id="H60EDBB5A7C7249D89E7474E0A4067918" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>The Secretary may terminate any regional center from the program under this section if the
			 Secretary determines that—</text>
										<subparagraph id="HFDBE80D731874D138D58B4A2198D1403"><enum>(A)</enum><text>the regional center is in violation of paragraph (1);</text>
										</subparagraph><subparagraph id="H9113E81607394E459FECD74253BD23F2"><enum>(B)</enum><text>the regional center has provided any false attestation or information under paragraph (2), or
			 continues to allow any person who was involved with the regional center as
			 described in paragraph (1) to continue to be involved with the regional
			 center if the regional center knows that the person has provided any false
			 attestation or information under paragraph (2); or</text>
										</subparagraph><subparagraph id="HB5ADB958CE30452EB8812A041A0C702E"><enum>(C)</enum><text>the regional center fails to provide an attestation or information requested by the Secretary under
			 paragraph (2), or continues to allow any person who was involved with the
			 regional center as described in paragraph (1) to continue to be involved
			 with the regional center if the regional center knows that the person has
			 failed to provide an attestation or information requested by the Secretary
			 under paragraph (2).</text>
										</subparagraph></paragraph><paragraph changed="added" committee-id="HJU00" id="HFDE560B322AE4A7E94038197CA828A45" indent="up1" reported-display-style="italic"><enum>(4)</enum><text>For the purpose of this subsection, the term <quote>regional center</quote> shall, in addition to the regional center itself, include any commercial enterprise or job
			 creating enterprise in which a regional center has invested.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph><subparagraph id="H38F8571E006941DEB717D5ABC1459D10"><enum>(B)</enum><header>Compliance with securities laws</header><text>Such section 610, as amended by subparagraph (A), is further amended by adding at the end the
			 following:</text>
							<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H4E0865E77EA74FE699FD39508F480C39" reported-display-style="italic" style="OLC">
								<subsection id="HA9EEFE9D8FD3485B90A03898B75F470D"><enum>(f)</enum>
									<paragraph commented="no" display-inline="yes-display-inline" id="H1C6C07B9CC9C4249B3E5471C07AD04A9"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security shall not approve an application for regional center designation
			 or regional center amendment that does not certify that the regional
			 center and all parties to the regional center are in and will maintain
			 compliance with Federal securities laws (as such term is defined under
			 section 3 of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78c">15 U.S.C. 78c</external-xref>)).</text>
									</paragraph><paragraph changed="added" committee-id="HJU00" id="H9AD7ED91C7864553B929491C79E6E855" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The Secretary of Homeland Security shall immediately terminate the designation of any regional
			 center that does not provide the certification described in paragraph (1)
			 on an annual basis.</text>
									</paragraph><paragraph changed="added" committee-id="HJU00" id="H922A5EDB040B4BC7A7FCAF7217DE4DE2" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>In addition to any other authority provided to the Secretary of Homeland Security regarding the
			 program described in this section, the Secretary may suspend or terminate
			 the designation of any regional center if the Secretary determines that
			 the regional center, or any party to the regional center:</text>
										<subparagraph id="H11B0CE5130C84BCA921805C83EB19D18"><enum>(A)</enum><text>is permanently or temporarily enjoined by order, judgment, or decree of any court of competent
			 jurisdiction in connection with the purchase or sale of a security;</text>
										</subparagraph><subparagraph id="HA947EE5B591C46029AF9D51F362B39C7"><enum>(B)</enum><text>is subject to any order of the Securities and Exchange Commission that bars such person from
			 association with an entity regulated by the Securities and Exchange
			 Commission, or constitutes a final order based on violations in connection
			 with the purchase or sale of a security;</text>
										</subparagraph><subparagraph id="H84CA54AE5D0649ED862668248FE42C99"><enum>(C)</enum><text>has been convicted of violating, or found to have violated, a fraud provision of the Federal
			 securities laws (as such term is defined under section 3 of the Securities
			 Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78c">15 U.S.C. 78c</external-xref>)); or</text>
										</subparagraph><subparagraph id="HED8786216967481681744D5E2CDB97A4"><enum>(D)</enum><text>knowingly submitted or caused to be submitted a certification described in paragraphs (1) or (2) of
			 this subsection that contained an untrue statement of material fact, or
			 omitted to state a material fact necessary, in order to make the
			 statements made, in light of the circumstances under which they were made,
			 not misleading.</text>
										</subparagraph></paragraph><paragraph changed="added" committee-id="HJU00" id="H0F6AD14CF857447BA6E3F361EEB9DB6B" indent="up1" reported-display-style="italic"><enum>(4)</enum><text>Nothing in this subsection shall be construed to impair or limit the authority of the Securities
			 and Exchange Commission under the Federal securities laws.</text>
									</paragraph><paragraph changed="added" committee-id="HJU00" id="H37F77627DBC6449EA7CDB433E62E4645" indent="up1" reported-display-style="italic"><enum>(5)</enum><text>For the purpose of this subsection, the term <quote>party to the regional center</quote> shall include, in addition to the regional center itself, its agents, servants, employees,
			 attorneys, or any persons in active concert or participation with the
			 regional center.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection commented="no" id="H81C3B165550848A8A7000AB8591125B7"><enum>(c)</enum><header>Effective dates</header>
					<paragraph commented="no" id="H8D0F7CB47BE844B69393CDCD4C28A1CC"><enum>(1)</enum><header>In general</header><text>Except for the amendments made by paragraphs (1) and (2) of subsection (a), the amendments made by
			 subsections (a) and (b) shall take effect on the date of the enactment of
			 this Act and shall apply—</text>
						<subparagraph commented="no" id="H4C7E339C00C947F19DF3EAA0CB2627D6"><enum>(A)</enum><text>to aliens filing petitions under section 204(a)(1)(H) of the Immigration and Nationality Act (8
			 U.S.C. 1154(a)(1)(H)) on or after such date;</text>
						</subparagraph><subparagraph commented="no" id="H0EE6EB599ECF4A1E95C63520815AEF9B"><enum>(B)</enum><text>to a regional center (and any person involved with or a party to a regional center) designated
			 before, on, or after such date; and</text>
						</subparagraph><subparagraph commented="no" id="H1DE185A30E5A4601A1754CBADDED7477"><enum>(C)</enum><text>to any application to designate a regional center, and any person involved with or a party to the
			 regional center, that is pending on such date.</text>
						</subparagraph></paragraph><paragraph commented="no" id="HE6FFC097E3D643FABBA107B148414D96"><enum>(2)</enum><header>Definition of <quote>capital</quote></header><text display-inline="yes-display-inline">The amendment made by subsection (a)(1) shall take effect on the date of the enactment of this Act.</text>
					</paragraph><paragraph commented="no" id="H9449A26459604623858AD547005CD215"><enum>(3)</enum><header>Inflation adjustment</header><text>The amendment made by subsection (a)(2) shall take effect as provided in section 203(b)(5)(C)(v) of
			 the Immigration and Nationality Act, as added by subsection (a)(2) of this

			 section 203(a), visa numbers with respect to natives of that state or area
			 shall be allocated (to the extent practicable and otherwise consistent
			 with this section and section 203) in a manner so that, except as provided
			 in subsection (a)(4), the proportion of the visa numbers made available
			 under each of paragraphs (1) through (4) of section 203(a) is equal to the
			 ratio of the total number of visas made available under the respective
			 paragraph to the total number of visas made available under section
			 203(a).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H0DD4EDBA1536464784F2C5D9857A0F06"><enum>(c)</enum><header>Country-Specific offset</header><text display-inline="yes-display-inline">Section 2 of the Chinese Student Protection Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref> note) is amended—</text>

				</subsection></section><section id="H692F544DE0D547C8B58F663E4DAC9929"><enum>108.</enum><header>Physicians</header>
				<subsection id="HCB0F80AD49B741DFB13A08F90177D6CC"><enum>(a)</enum><header>Permanent authorization of the Conrad state 30 program</header><text display-inline="yes-display-inline">Section 220(c) of the Immigration and Nationality Technical Corrections Act of 1994 (Public Law
			 103–416; <external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref> note) is amended by striking <quote>and before September 30, 2015</quote>.</text>
				</subsection><subsection id="HF1D38F33B0EB4FCE95FA7295FD746FEC"><enum>(b)</enum><header>Allotment of Conrad 30 waivers</header>
					<paragraph id="H9926346594574FCC8BA8D4B7B334FDD2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 214(l) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(l)</external-xref>) is amended by adding at
			 the end the following:</text>
						<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H580943497571417DA1CA2CF461D5E425" reported-display-style="italic" style="OLC">
							<paragraph id="H884A9FAAF5754E2196EF32562A493B3E" indent="up1"><enum>(4)</enum>
								<subparagraph commented="no" display-inline="yes-display-inline" id="HEE2FC5C6EC564EA0BD5C2F39E4D084BA"><enum>(A)</enum>
									<clause commented="no" display-inline="yes-display-inline" id="H9016857FFBBE4393AEE9666D5C91EB28"><enum>(i)</enum><text>A State shall be allotted a total of 35 waivers under paragraph (1)(B) for a fiscal year if 90
			 percent of the waivers available to the State were used in the previous
			 fiscal year.</text>
									</clause><clause changed="added" committee-id="HJU00" id="H8871E86A09CA4589BC7FB2D698C834A2" indent="up2" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">When an allotment has occurred under clause (i), the State shall be allotted an additional 5
			 waivers under paragraph (1)(B) for each subsequent fiscal year if 90
			 percent of the waivers available to the State were used in the previous
			 fiscal year, except that if the State is allotted 60 or more waivers for a
			 fiscal year, the State shall be eligible for the additional 5 waivers
			 under this clause only if 90 percent of the waivers available to all
			 States receiving at least 1 waiver under paragraph (1)(B) were used in the
			 previous fiscal year.</text>
									</clause></subparagraph><subparagraph changed="added" committee-id="HJU00" id="H2D46870AE68042249F162835C5D0458F" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>Any increase in allotments under subparagraph (A) shall be maintained indefinitely, unless in a
			 fiscal year, the total number of such waivers granted is 5 percent lower
			 than in the last year in which there was an increase in the number of
			 waivers allotted pursuant to this paragraph, in which case—</text>
									<clause id="H7CD482BE8AB84BB3970A2B6D9681B348"><enum>(i)</enum><text>the number of waivers allotted shall be decreased by 5 for all States beginning in the next fiscal
			 year; and</text>
									</clause><clause id="H6E83346B0CAE426EB96BF2C256308189"><enum>(ii)</enum><text>each additional 5 percent decrease in such waivers granted from the last year in which there was an
			 increase in the allotment, shall result in an additional decrease of 5
			 waivers allotted for all States, provided that the number of waivers
			 allotted for all States shall not drop below 30.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H0142640702214609BB6866F530AFF638"><enum>(2)</enum><header>Academic medical centers</header><text>Section 214(l)(1)(D) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(l)(1)(D)</external-xref>) is amended—</text>
						<subparagraph id="H2AFBFF4BA81E4F919AC4A2BD702D7D75"><enum>(A)</enum><text>in clause (ii), by striking <quote>and</quote> at the end;</text>
						</subparagraph><subparagraph id="HFF1443344825405D893B3893F7DB021E"><enum>(B)</enum><text>in clause (iii), by striking the period at the end and inserting <quote>; and</quote>; and</text>
						</subparagraph><subparagraph id="HC31F0B21A6B54E329812A44DD5767C10"><enum>(C)</enum><text>by adding at the end the following:</text>
							<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H217593AA2D1C4DBDB973A7C49B2A9A45" reported-display-style="italic" style="OLC">
								<clause id="H49DABFE8791D4287A13FADB447A0EEAC" indent="up1"><enum>(iv)</enum><text>in the case of a request by an interested State agency—</text>
									<subclause id="H5068E88F6F0E4C2C8D4B063858824FEF"><enum>(I)</enum><text>the head of such agency determines that the alien is to practice medicine in, or be on the faculty
			 of a residency program at, an academic medical center (as that term is
			 defined in <external-xref legal-doc="regulation" parsable-cite="cfr/42/411.355">section 411.355(e)(2)</external-xref> of title 42, Code of Federal Regulations,
			 or similar successor regulation), without regard to whether such facility
			 is located within an area designated by the Secretary of Health and Human
			 Services as having a shortage of health care professionals; and</text>
									</subclause><subclause id="H35E84030D1FD4CB1BAAD2793DCBD852F"><enum>(II)</enum><text>the head of such agency determines that—</text>
										<item id="HF1762F63E10344EA96B4872AA3029B50"><enum>(aa)</enum><text>the alien physician’s work is in the public interest; and</text>
										</item><item id="H389288E062BB428692E3413C910B1B78"><enum>(bb)</enum><text>the grant of such waiver would not cause the number of the waivers granted on behalf of aliens for
			 such State for a fiscal year (within the limitation in subparagraph (B)
			 and subject to paragraph (4)) in accordance with the conditions of this
			 clause to exceed 3.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="H55D32D8AC6BD415E977D5581A6449D98"><enum>(c)</enum><header>Employment protections for physicians</header>
					<paragraph id="HC32BB9875BE14075979AA8692F32BDC4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 214(l)(1)(C) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(l)(1)(C)</external-xref>) is amended by
			 striking clauses (i) and (ii) and inserting the following:</text>
						<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="HC8DB52914AB646088A825BCA316064D0" reported-display-style="italic" style="OLC">
							<clause id="H37D83FB5022F47A29842CA3A6182E023" indent="up1"><enum>(i)</enum><text>the alien demonstrates a bona fide offer of full-time employment, at a health care organization,
			 which employment has been determined by the Secretary of Homeland Security
			 to be in the public interest; and</text>
							</clause><clause id="H5DCF40D1BBCF4C629655BD4FF2F75A30" indent="up1"><enum>(ii)</enum><text>the alien agrees to begin employment with the health facility or health care organization in a
			 geographic area or areas which are designated by the Secretary of Health
			 and Human Services as having a shortage of health care professionals by
			 the later of the date that is 90 days after receiving such waiver, 90 days
			 after completing graduate medical education or training under a program
			 approved pursuant to section 212(j)(1), or 90 days after receiving
			 nonimmigrant status or employment authorization, and agrees to continue to
			 work for a total of not less than 3 years in any status authorized for
			 such employment under this subsection unless—</text>
								<subclause id="H3A0E3756B2E94A2882640CF5DE83746D"><enum>(I)</enum><text>the Secretary determines that extenuating circumstances exist that justify a lesser period of
			 employment at such facility or organization, in which case the alien shall
			 demonstrate another bona fide offer of employment at a health facility or
			 health care organization, for the remainder of such 3-year period;</text>
								</subclause><subclause id="H6D15B9AEBC604FCFB27F8841433E8B7E"><enum>(II)</enum><text>the interested State agency that requested the waiver attests that extenuating circumstances exist
			 that justify a lesser period of employment at such facility or
			 organization in which case the alien shall demonstrate another bona fide
			 offer of employment at a health facility or health care organization so
			 designated by the Secretary of Health and Human Services, for the
			 remainder of such 3-year period; or</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="HDC7D96018DA74CF8A5E7BEB91D33894B"><enum>(III)</enum><text>if the alien elects not to pursue a determination of extenuating circumstances pursuant to
			 subclause (I) or (II), the alien terminates the alien’s employment
			 relationship with such facility or organization, in which case the alien
			 shall be employed for the remainder of such 3-year period, and 1
			 additional year for each determination, at another health facility or
			 health care organization in a geographic area or areas which are
			 designated by the Secretary of Health and Human Services as having a
			 shortage of health care professionals; and</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HC3BD609A90A142A2A421767253A894B6"><enum>(2)</enum><header>Contract requirements</header><text display-inline="yes-display-inline">Section 214(l) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(l)</external-xref>), as amended by subsection
			 (b)(1), is further amended by adding at the end the following:</text>
						<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="HBCBF0EE18EC34AA8AC8940B19F103442" reported-display-style="italic" style="OLC">
							<paragraph id="H6D99B5BA3695476C80E1CFBF23F00A1A" indent="up1"><enum>(5)</enum><text>An alien granted a waiver under paragraph (1)(C) shall enter into an employment agreement with the
			 contracting health facility or health care organization that—</text>
								<subparagraph id="HF5AF7D2EB8EF494B95B4C45149874712"><enum>(A)</enum><text>specifies the maximum number of on-call hours per week (which may be a monthly average) that the
			 alien will be expected to be available and the compensation the alien will
			 receive for on-call time;</text>
								</subparagraph><subparagraph id="H213B925CCE6842DD893365703B81C9E6"><enum>(B)</enum><text>specifies whether the contracting facility or organization will pay for the alien’s malpractice
			 insurance premiums, including whether the employer will provide
			 malpractice insurance and, if so, the amount of such insurance that will
			 be provided;</text>
								</subparagraph><subparagraph id="HD029D781E04540B7920A133A07CA12B1"><enum>(C)</enum><text>describes all of the work locations that the alien will work and a statement that the contracting
			 facility or organization will not add additional work locations without
			 the approval of the Federal agency or State agency that requested the
			 waiver; and</text>
								</subparagraph><subparagraph id="H8B9E0222786A4E3287417319551D4C63"><enum>(D)</enum><text>does not include a non-compete provision.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE7E3012EEB4A480294976ECD2AAE9297" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">An alien granted a waiver under paragraph (1)(C) whose employment relationship with a health
			 facility or health care organization terminates during the 3-year service
			 period required by such paragraph—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H539D08F00FAB4BA489D395A9DF288BAC"><enum>(A)</enum><text display-inline="yes-display-inline">shall have a period of 120 days beginning on the date of such determination of employment to submit
			 to the Secretary of Homeland Security applications or petitions to
			 commence employment with another contracting health facility or health
			 care organization in a geographic area or areas which are designated by
			 the Secretary of Health and Human Services as having a shortage of health
			 care professionals; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H73B68B638F77471EA306E68622E2C397"><enum>(B)</enum><text display-inline="yes-display-inline">shall be considered to be maintaining lawful status in an authorized stay during the 120-day period
			 referred to in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HA8349D3DEB89465684B177A5672868FE"><enum>(d)</enum><header>Amendments to the procedures, definitions, and other provisions related to physician immigration</header>
					<paragraph id="H5C2E52EE92E14B45A05DB34A24AD1B7E"><enum>(1)</enum><header>Dual intent for physicians seeking graduate medical training</header><text>Section 214(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(b)</external-xref>) is amended by striking <quote>(other than a nonimmigrant described in subparagraph (L) or (V) of section 101(a)(15), and other
			 than a nonimmigrant described in any provision of section 101(a)(15)(H)(i)
			 except subclause (b1) of such section)</quote> and inserting <quote>(other than a nonimmigrant described in subparagraph (L) or (V) of section 101(a)(15), a
			 nonimmigrant described in any provision of section 101(a)(15)(H)(i),
			 except subclause (b1) of such section, and an alien coming to the United
			 States to receive graduate medical education or training as described in
			 section 212(j) or to take examinations required to receive graduate
			 medical education or training as described in section 212(j))</quote>.</text>
					</paragraph><paragraph id="H58751E96C1874023A599D19DC4340D4D"><enum>(2)</enum><header>Allowable visa status for physicians fulfilling waiver requirements in medically underserved areas</header><text>Section 214(l)(2)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(l)(2)(A)</external-xref>) is amended by
			 striking <quote>an alien described in section 101(a)(15)(H)(i)(b).</quote> and inserting <quote>any status authorized for employment under this Act.</quote>.</text>
					</paragraph><paragraph id="HBAF71EC319AC4ABFB2552496D9B0695C"><enum>(3)</enum><header>Physician national interest waiver clarifications</header>
						<subparagraph id="H88774F2B29BA42529A64F0C457C5D26A"><enum>(A)</enum><header>Practice and geographic area</header><text>Section 203(b)(2)(B)(ii)(I) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)(2)(B)(ii)(I)</external-xref>)
			 is amended by striking items (aa) and (bb) and inserting the following:</text>
							<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="HD06C67E6B9DF41959FFE816708AD961A" reported-display-style="italic" style="OLC">

			 Secretary of Veterans Affairs; or</text>
								</item><item id="HC1EF071244FA404FACDF188F7C3BCD3B" indent="up2"><enum>(bb)</enum><text>the alien physician is pursuing such waiver based upon service at a facility or facilities that
			 serve patients who reside in a geographic area or areas designated by the
			 Secretary of Health and Human Services as having a shortage of health care
			 professionals (without regard to whether such facility or facilities are
			 located within such an area) and a Federal agency, or a local, county,
			 regional, or State department of public health determines the alien
			 physician’s work was or will be in the public interest.</text></item><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph><subparagraph id="H8373978C2CB946E79099A62BBB279A5E"><enum>(B)</enum><header>Five-year service requirement</header><text>Section 203(b)(2)(B)(ii)(II) of the Immigration and Nationality Act (8 U.S.C. 1153(B)(ii)(II)) is
			 amended—</text>
							<clause id="HABE3CEF29EA64F93A0154FB8EB128BEA"><enum>(i)</enum><text>by inserting <quote>(aa)</quote> after <quote>(II)</quote>; and</text>
							</clause><clause id="H0BDE416E300A4F9D82C702B43D50BFEE"><enum>(ii)</enum><text>by adding at the end the following:</text>
								<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H17934D6F3C3341FB92D671B412295127" reported-display-style="italic" style="OLC">
									<item id="H89AC390D8F9945D5A89AFA279A289364" indent="up3"><enum>(bb)</enum><text>The 5-year service requirement of item (aa) shall be counted from the date the alien physician
			 begins work in the shortage area in any legal status and not the date an
			 immigrant visa petition is filed or approved. Such service shall be
			 aggregated without regard to when such service began and without regard to
			 whether such service began during or in conjunction with a course of
			 graduate medical education.</text>
									</item><item id="H2B4A204F067648F5AD1999843B81246C" indent="up3"><enum>(cc)</enum><text>An alien physician shall not be required to submit an employment contract with a term exceeding the
			 balance of the 5-year commitment yet to be served, nor an employment
			 contract dated within a minimum time period prior to filing of a visa
			 petition pursuant to this subsection.</text>
									</item><item id="HC77D50EB76A04B4288DBB3A111B7D3E3" indent="up3"><enum>(dd)</enum><text>An alien physician shall not be required to file additional immigrant visa petitions upon a change
			 of work location from the location approved in the original national
			 interest immigrant petition.</text></item><after-quoted-block>.</after-quoted-block></quoted-block>
							</clause></subparagraph></paragraph><paragraph id="H0E18E29D3C0947728DD846875A808B08"><enum>(4)</enum><header>Technical clarification regarding advanced degree for physicians</header><text>Section 203(b)(2)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)(2)(A)</external-xref>) is amended by
			 adding at the end the following: <quote>An alien physician holding a foreign medical degree that has been deemed sufficient for acceptance
			 by an accredited United States medical residency or fellowship program is
			 a member of the professions holding an advanced degree or its equivalent.</quote>.</text>
					</paragraph><paragraph id="HAE8A762D736448D5B54EAF02198A5F2F"><enum>(5)</enum><header>Short-term work authorization for physicians completing their residencies</header><text>A physician completing graduate medical education or training as described in section 212(j) of the
			 Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(j)</external-xref>) as a nonimmigrant
			 described section 101(a)(15)(H)(i) of such Act (8 U.S.C.
			 1101(a)(15)(H)(i)) shall have such nonimmigrant status automatically
			 extended until October 1 of the fiscal year for which a petition for a
			 continuation of such nonimmigrant status has been submitted in a timely
			 manner and where the employment start date for the beneficiary of such
			 petition is October 1 of that fiscal year. Such physician shall be
			 authorized to be employed incident to status during the period between the
			 filing of such petition and October 1 of such fiscal year. However, the
			 physician’s status and employment authorization shall terminate 30 days
			 from the date such petition is rejected, denied or revoked. A physician’s
			 status and employment authorization will automatically extend to October 1
			 of the next fiscal year if all visas as described in such section
			 101(a)(15)(H)(i) authorized to be issued for the fiscal year have been
			 issued.</text>
					</paragraph><paragraph id="H03EA82E0145D47548A9B554EEF8B5826"><enum>(6)</enum><header>Applicability of section <enum-in-header>212(e)</enum-in-header> to spouses and children of J–1 exchange visitors</header><text>A spouse or child of an exchange visitor described in section 101(a)(15)(J) of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(J)</external-xref>) shall not be subject to the
			 requirements of section 212(e) of the Immigration and Nationality Act (8
			 U.S.C. 1182(e)).</text>
					</paragraph></subsection><subsection id="H1C259A410DC5440D81D1ED82551B3BD9"><enum>(e)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsections (a) and (c) shall take effect on the date of the enactment of
			 this Act and shall apply to aliens granted waivers before, on, or after
			 the date of the enactment of this Act. Subsection (d), and the amendments
			 made by subsections (b) and (d), shall take effect on October 1, 2013.</text>
				</subsection></section><section display-inline="no-display-inline" id="H2EC4F36DDBCD478895F0CD9FB7F8EB6B" section-type="subsequent-section"><enum>109.</enum><header>Permanent priority dates</header>
				<subsection id="H1568D779A5D64745AD3933599F422075"><enum>(a)</enum><header>In general</header><text>Section 203 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153</external-xref>) is amended by adding at the end
			 the following:</text>
					<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H3E57B73611184742A86B6E9BB49E0A8B" reported-display-style="italic" style="OLC">
						<subsection id="HD3CF55B3CDEF4A50B42B63E9D0A4A7B1"><enum>(i)</enum><header>Permanent priority dates</header>
							<paragraph id="HDFD3370D88A54713BD6A8AB5A780EE5B"><enum>(1)</enum><header>In general</header><text>Subject to subsection (h)(3) and paragraph (2), the priority date for any employment-based petition
			 shall be the date of filing of the petition with the Secretary of Homeland
			 Security (or the Secretary of State, if applicable), unless the filing of
			 the petition was preceded by the filing of a labor certification with the
			 Secretary of Labor, in which case that date shall constitute the priority
			 date.</text>
							</paragraph><paragraph id="HE9439273D0E1473C8ECAD78442C6903F"><enum>(2)</enum><header>Subsequent employment-based petitions</header><text display-inline="yes-display-inline">Subject to subsection (h)(3), an alien who is the beneficiary of any employment-based petition that
			 was approvable when filed (including self-petitioners) shall retain the
			 priority date assigned with respect to that petition in the consideration
			 of any subsequently filed employment-based petition (including
			 self-petitions).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HAE8B26F932BE483BBC19EBD466F10B5D"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall take effect on October 1, 2013, and shall apply to
			 aliens who are a beneficiary of a classification petition pending on or
			 after such date.</text>
				</subsection></section><section id="H32CF37BEB94E4B68AB49BFE4873E73B6"><enum>110.</enum><header>Set-aside for health care workers</header><text display-inline="no-display-inline">Section 203(b)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)(3)</external-xref>), as amended by this
			 Act, is further amended—</text>
				<paragraph id="HF8452D46A78E40779DA49EA2D1821E29"><enum>(1)</enum><text>in subparagraph (A), by inserting after clause (iii) the following:</text>
					<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H24BEB6641CD74F558A95A7BC09D42AB2" reported-display-style="italic" style="OLC">
						<clause id="H73A04AE52BEF4E998CB2DFF1B2CC1BDA"><enum>(iv)</enum><header>Health care workers</header><text display-inline="yes-display-inline">Qualified immigrants who are required to submit health care worker certificates pursuant to section
			 212(a)(5)(C) or certified statements pursuant to section 212(r) and will
			 be working in a rural area or a health professional shortage area (as
			 defined in section 332 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254e">42 U.S.C. 254e</external-xref>)).</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H37E4E74CD74E428F86E4E59AB62B383F"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H7453A1C949B348B093BF15D47979E67B" reported-display-style="italic" style="OLC">
						<subparagraph id="H7FA0E5CCF2954BB8BFF29B0FC34911CD"><enum>(D)</enum><header>Set aside for health care workers</header>
							<clause id="H6F735D0917004D42A7DF6AD9B7A9EB4E"><enum>(i)</enum><header>In general</header><text>Not less than 4,000 of the visas made available under this paragraph in each fiscal year shall be
			 reserved for qualified immigrants described in subparagraph (A)(iv).</text>
							</clause><clause id="H4D4A5C05559845C89C50165929FDAD78"><enum>(ii)</enum><header>Unused visas</header><text>If the number of visas reserved under clause (i) has not been exhausted at the end of a given
			 fiscal year, the Secretary of Homeland Security shall adjust upwards the
			 numerical limitation in subparagraph (A) for that fiscal year by the
			 amount remaining. Visas may be issued pursuant to such adjustment within
			 the first 45 days of the next fiscal year to aliens who had applied for
			 such visas during the fiscal year for which the adjustment was made.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="H63C61D23BBFE4DE8A3F82597F1531D48"><enum>II</enum><header>Nonimmigrant Visa Reforms</header>
			<section id="H3DFEC88F1A1D416396892F20A66B7880"><enum>201.</enum><header>H–1B visas</header>
				<subsection id="HD366AAD71AE84435B1D8FE6BF77D5EF8"><enum>(a)</enum><header>Increase in H–1B visa numerical limit</header><text display-inline="yes-display-inline">Section 214(g) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)</external-xref>) is amended—</text>
					<paragraph id="H78DC6C8B9BB94E6884D9862C79233803"><enum>(1)</enum><text>in paragraph (1)(A)—</text>
						<subparagraph id="HF5E60A392D6244F8995D03CB37282114"><enum>(A)</enum><text>in clause (vi), by striking <quote>and</quote> at the end;</text>
						</subparagraph><subparagraph id="HBFD5A690C59640FCBD7E51A82277E78F"><enum>(B)</enum><text>by amending clause (vii) to read as follows:</text>

					</paragraph></subsection><subsection id="HFE43CC8C24B445EC9F15D687F5AFFB39"><enum>(b)</enum><header>Wage level</header><text display-inline="yes-display-inline">Section 212(n)(1)(A)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(1)(A)(i)</external-xref>) is
			 amended—</text>
					<paragraph id="H02A86E32E68B4698A26A88900A63C344"><enum>(1)</enum><text>by striking <quote>, and</quote> at the end and inserting <quote>; or</quote>;</text>
					</paragraph><paragraph id="HC081011DEA2C48B286B54255CBD20BC8"><enum>(2)</enum><text>by redesignating subclauses (I) and (II) as items (aa) and (bb), respectively;</text>
					</paragraph><paragraph id="H3FE91F77457146CE8DAB15F9137CAB5E"><enum>(3)</enum><text>by striking <quote><header-in-text level="clause" style="OLC"><enum-in-header>(i)</enum-in-header></header-in-text></quote> and inserting <quote><header-in-text level="clause" style="OLC"><enum-in-header>(i)(I)</enum-in-header></header-in-text></quote>;</text>
					</paragraph><paragraph id="H5901C651AE2042A488D8C79FEE04D5D7"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting <quote>except as provided in subclause (II),</quote> before <quote>is offering</quote>; and</text>
					</paragraph><paragraph id="HB4024FEEB0EA4714A5CB9667ABA6DACC"><enum>(5)</enum><text>by adding at the end the following:</text>

			 alien admitted or provided status as an H-1B nonimmigrant and in the same
			 area of employment as the alien admitted or provided status as an H-1B
			 nonimmigrant are United States workers (as defined in paragraph (4)), is
			 offering and will offer during the period of authorized employment to
			 aliens admitted or provided status as an H-1B nonimmigrant wages that are
			 at least the actual wage level paid by the employer to all other
			 individuals with similar experience and qualifications for the specific
			 employment in question (but, in the case of an employer with more than 25
			 employees, in no event shall such wages be lower than the mean of the
			 lowest one-half of wages surveyed pursuant to subsection (p)(5)); and</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H9DE4F2C8A985453FA20A91EE526C0322"><enum>(c)</enum><header>Spousal employment</header><text>Section 214(c)(2)(E) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)(2)(E)</external-xref>) is amended by
			 striking <quote>101(a)(15)(L),</quote> and inserting <quote>subparagraph (H)(i)(b), (H)(i)(b1), (E)(iii), or (L) of section 101(a)(15)</quote>.</text>
				</subsection><subsection id="H35FC3056DEA74710A67A81CFF276F480"><enum>(d)</enum><header>Anti-Fraud measures</header>
					<paragraph id="H7B470A43D947413ABF2F594DF43B3DC0"><enum>(1)</enum><header>Foreign degrees</header>
						<subparagraph id="H2232FA04D36543E7A77BFEF5AA4D4A85"><enum>(A)</enum><header>Specialty occupation</header><text>Section 214(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(i)</external-xref>) is amended by adding at
			 the end the following:</text>
							<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H5A5D8ECD76704F329AA7C83B0943B9D7" reported-display-style="italic" style="traditional">
								<paragraph id="H4F1000E668A443EB88BF7399E0AE1C7A" indent="up1"><enum>(4)</enum>
									<subparagraph commented="no" display-inline="yes-display-inline" id="H057D881F1244473BB39B558EB3870360"><enum>(A)</enum><text>For purposes of paragraphs (1)(B) and (3)(B), the term <quote>bachelor’s or higher degree</quote> includes a foreign degree that is a recognized foreign equivalent of a bachelor’s or higher
			 degree.</text>
									</subparagraph><subparagraph changed="added" committee-id="HJU00" id="H881D982A331F4C6A9295342B69CB4D02" indent="up1" reported-display-style="italic"><enum>(B)</enum>
										<clause commented="no" display-inline="yes-display-inline" id="H48DB5E125EC9489F8FEEC816FE3740EF"><enum>(i)</enum><text>In the case of an alien with a foreign degree, any determination with respect to the equivalence of
			 that degree to a degree obtained in the United States shall be made by the
			 Secretary of State.</text>
										</clause><clause changed="added" committee-id="HJU00" id="H2720935D42BB4D8E9F72A6528654155B" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>In carrying out the preceding clause, the Secretary of State shall verify the authenticity of any
			 foreign degree proffered by an alien. The Secretary of State may enter
			 into contracts with public or private entities in conducting such
			 verifications.</text>
										</clause><clause changed="added" committee-id="HJU00" id="H40CC2689EA5540389EBE24BAECC1E887" indent="up1" reported-display-style="italic"><enum>(iii)</enum><text>In addition to any other fees authorized by law, the Secretary of State may impose a fee on an
			 employer filing a petition under subsection (c)(1) initially to grant an
			 alien nonimmigrant status described in section 101(a)(15)(H)(i)(b), if a
			 determination or verification described in clause (i) or (ii) is required
			 with respect to the petition. Fees collected under this clause shall be
			 deposited in the Treasury in accordance with section 286(t).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph><subparagraph id="HA4BF9331B7864C668902CD4323C5BD4F"><enum>(B)</enum><header>H–1B educational credential verification account</header><text>Section 286 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1356">8 U.S.C. 1356</external-xref>) is amended by adding at the end
			 the following:</text>
							<quoted-block changed="added" committee-id="HJU00" id="HF90807233C9E4B71865FFEFBF3B5C78C" reported-display-style="italic" style="OLC">
								<subsection id="H9B8DCC817D13480F80B01EA4E9DF9D48"><enum>(w)</enum><header>H–1B educational credential verification account</header><text>There is established in the general fund of the Treasury a separate account, which shall be known
			 as the <quote>H–1B Educational Credential Verification Account</quote>. Notwithstanding any other provision of law, there shall be deposited as offsetting receipts into
			 the account all fees collected under section 214(i)(4)(B)(iii). Amounts
			 deposited into the account shall remain available to the Secretary of
			 State until expended to carry out section 214(i)(4)(B).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="H2B67E34A97BE4BA1ABB3B8ACC6C6CAB4"><enum>(2)</enum><header>Investigations</header><text display-inline="yes-display-inline">The first sentence of subsection (n)(2)(F), and the first sentence of subsection (t)(3)(E) (as
			 added by section 402(b)(2) of <external-xref legal-doc="public-law" parsable-cite="pl/108/77">Public Law 108–77</external-xref> (117 Stat. 941)), of
			 section 212 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>) are
			 each amended by striking <quote>investigations</quote> and all that follows through the period at the end and inserting the following: <quote>investigations. An employer who has been subject to 2 random investigations may not be subject to
			 another random investigation within 4 years of the second investigation
			 unless the employer was found in the previous investigations or otherwise
			 to have committed a willful failure to meet a condition of paragraph (1)
			 (or has been found under paragraph (5) to have committed willful failure
			 to meet the condition of paragraph (1)(G)(i)(II)) or to have made a
			 willful misrepresentation of material fact in an application.</quote>.</text>
					</paragraph><paragraph id="H8B772D5E96984B5BACFC8E2CB9EB04B8"><enum>(3)</enum><header>Bona fide businesses</header><text>Section 214(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)</external-xref>) is amended by adding at
			 the end the following:</text>
						<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="HDAB10D8055EC4F368787B6E5C61F2495" reported-display-style="italic" style="traditional">
							<paragraph id="H0F3B14A3F4E54A2E8F3BE8BEBA3A68F0" indent="up1"><enum>(15)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security may not approve any petition under paragraph (1) filed by an
			 employer with respect to an alien seeking to obtain the status of a
			 nonimmigrant under subclause (b) or (b1) of section 101(a)(15)(H)(i) and
			 the Secretary of State may not approve a visa with respect to an alien
			 seeking to obtain the status of a nonimmigrant under subparagraph (E)(iii)
			 or (H)(i)(b1) of section 101(a)(15) unless—</text>
								<subparagraph id="H159E614966AC462CB125D885DBDDEF48"><enum>(A)</enum><text>the employer—</text>
									<clause id="H54E0174BBCC943688FBE61433B76886B"><enum>(i)</enum><text display-inline="yes-display-inline">is an institution of higher education (as defined in section 101(a) of the Higher Education Act of
			 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>)), or a governmental or nonprofit entity; or</text>
									</clause><clause id="HD67FF362112B499AA953F43FD226209C"><enum>(ii)</enum><text>maintains a place of business in the United States that is licensed in accordance with any
			 applicable State or local business licensing requirements and is used
			 exclusively for business purposes; and</text>
									</clause></subparagraph><subparagraph id="H1229165DD02E47628F868B3BF7CB9496"><enum>(B)</enum><text>the employer—</text>
									<clause id="HE593DE232B96441D9A458FEAB143B596"><enum>(i)</enum><text>is a governmental entity;</text>
									</clause><clause id="H016CAEC8113A4454B5835BAF05DDC64B"><enum>(ii)</enum><text>has aggregate gross assets with a value of not less than $50,000—</text>
										<subclause id="H31DB64C8EC9B4CA0A18EB6DDCF224978"><enum>(I)</enum><text>in the case of an employer that is a publicly held corporation, as determined using its most recent
			 report filed with the Securities and Exchange Commission; or</text>
										</subclause><subclause id="H2601F9171AF044D59A319A0F1020FD2C"><enum>(II)</enum><text>in the case of any other employer, as determined as of the date on which the petition is filed
			 under regulations promulgated by the Secretary of Homeland Security; or</text>
										</subclause></clause><clause id="H365620B52B044D03BE656878AA2810C8"><enum>(iii)</enum><text>provides appropriate documentation of business activity under regulations promulgated by the
			 Secretary of Homeland Security.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HF985667653BC41B79CC70E421D91906C"><enum>(4)</enum><header>Subpoena authority</header>
						<subparagraph id="HFB5658FBEF6B46E987DEA6FF8EF7F108"><enum>(A)</enum><header>H–1B application</header><text display-inline="yes-display-inline">Section 212(n)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(2)</external-xref>) is amended by adding
			 at the end the following:</text>
							<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="HAFF977E4C9E14274B31E182F0392AD9B" reported-display-style="italic" style="traditional">

						</subparagraph><subparagraph id="H76AACC114AE34D61A89CF540BFF837F1"><enum>(B)</enum><header>Attestation with respect to other nonimmigrant employees</header><text>Section 212(t)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(t)(3)</external-xref>) (as added by section 402(b)(2) of Public Law
			 108-77 (117 Stat. 941)) is amended by adding at the end the following:</text>
							<quoted-block changed="added" committee-id="HJU00" id="H34F15AFE4F8B4048B060274085D284AF" reported-display-style="italic" style="traditional">
								<subparagraph id="H4F90663AF2904539B69CD53B308A7D10" indent="up2"><enum>(G)</enum><text>The Secretary of Labor is authorized to issue subpoenas as may be necessary to assure employer
			 compliance with the terms and conditions of this subsection.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="H2BB373CBFA8243F88B0F63C45EFC15F8"><enum>(e)</enum><header>B visas in lieu of H–1B visas</header><text>Section 214(g) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)</external-xref>) is amended by adding at
			 the end the following:</text>
					<quoted-block changed="added" committee-id="HJU00" id="H513F3FFA07BE40AC9BDE18FCF5DEF6A6" reported-display-style="italic" style="traditional">
						<paragraph id="H0E01EF4CE9014AD280DA7C08BBC4BA63" indent="up1"><enum>(12)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, any alien admitted or provided status as a
			 nonimmigrant in order to provide services in a specialty occupation
			 described in paragraph (1) or (3) of subsection (i) (other than services
			 described in subparagraph (H)(ii)(a), (O), or (P) of section 101(a)(15))
			 or as a fashion model shall have been issued a visa (or otherwise been
			 provided nonimmigrant status) under subclause (b) or (b1) of section
			 101(a)(15)(H)(i) or section 101(a)(15)(E)(iii).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HDC8C31EAEC174C0588B0913AB5F78914"><enum>(f)</enum><header>Effective dates</header>
					<paragraph id="H0660AB7CD25D43C0A9C7AD6B26D1CB9A"><enum>(1)</enum><text>The amendments made by subsection (a) shall take effect on the date of the enactment of this Act
			 and shall apply to aliens issued visas or otherwise provided with
			 nonimmigrant status under section 101(a)(15)(H)(i)(b) of the Immigration
			 and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(i)(b)</external-xref>) beginning in fiscal
			 year 2014.</text>
					</paragraph><paragraph id="H1D27F1327F3D490ABF48DAD86B860B88"><enum>(2)</enum><text display-inline="yes-display-inline">The amendments made by subsection (b) shall take effect on the date of the enactment of this Act
			 and shall apply to the spouses of aliens issued visas or otherwise
			 provided with nonimmigrant status under subparagraph (H)(i)(b),
			 (H)(i)(b1), or (E)(iii) of section 101(a)(15) of the Immigration and
			 Nationality Act before, on, or after such date.</text>
					</paragraph><paragraph id="HF6742E0B2B3D46F1ACDAC9310187458D"><enum>(3)</enum><text display-inline="yes-display-inline">The amendments made by paragraphs (1) and (3) of subsection (c) shall take effect on the date of
			 the enactment of this Act and shall apply to petitions filed under section
			 214(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)</external-xref>) on or
			 after such date and to visa applications filed on or after such date where
			 no petition was filed because none was required under subparagraph
			 (H)(i)(b1) or (E)(iii) of section 101(a)(15) of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>).</text>
					</paragraph><paragraph id="HAE33E717C37C472982EB19471B1D62EE"><enum>(4)</enum><text display-inline="yes-display-inline">The amendments made by paragraphs (2) and (4) of subsection (c) shall take effect on the date of
			 the enactment of this Act and shall apply to employers of aliens issued
			 visas or otherwise provided with nonimmigrant status under subparagraph
			 (H)(i)(b), (H)(i)(b1), or (E)(iii) section 101(a)(15) of the Immigration
			 and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) before, on, or after such date.</text>
					</paragraph><paragraph id="H5F928A3A4075469AA182348A2CBD98CB"><enum>(5)</enum><text>The amendment made by subsection (d) shall take effect on the date of the enactment of this Act and
			 shall apply to aliens admitted or provided status as nonimmigrants on or
			 after such date.</text>
					</paragraph></subsection></section><section id="H7EA69BA2358442F4836EF24FA6411D78"><enum>202.</enum><header>L visas</header>
				<subsection id="HFD1E66D2B86F44E998F9239E1D660143"><enum>(a)</enum><header>In general</header><text>Section 214(c)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)(2)</external-xref>) is amended by adding
			 at the end the following:</text>
					<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H7D01F0FED0104A5FB4090CE4CC7906AC" reported-display-style="italic" style="traditional">
						<subparagraph id="HB9D5710DB64F4111A6B443D7DE41F15A" indent="up2"><enum>(G)</enum>
							<clause commented="no" display-inline="yes-display-inline" id="HA755631D015F422C80DFF22C1D4DB0A8"><enum>(i)</enum><text>An employer of an alien who will serve in a capacity for the employer involving specialized
			 knowledge under section 101(a)(15)(L) for a cumulative period of time in
			 excess of 6 months over a 2-year period—</text>
								<subclause changed="added" committee-id="HJU00" id="HE656333491CD4A0C85881B1498D2F961" indent="up1" reported-display-style="italic"><enum>(I)</enum>
									<item commented="no" display-inline="yes-display-inline" id="H314F932CDFB44DCABCECE59D6188806B"><enum>(aa)</enum><text display-inline="yes-display-inline">except as provided in item (bb), will offer to the alien during the period of authorized employment
			 wages that are at least—</text>
										<subitem changed="added" committee-id="HJU00" id="HB29FE1FFBFFA473FACA3BFB0360CF7A2" indent="up1" reported-display-style="italic"><enum>(AA)</enum><text>the actual wage level paid by the employer to all other individuals with similar experience and
			 qualifications for the specific employment in question; or</text>
										</subitem><subitem changed="added" committee-id="HJU00" id="H382D503C2F2F401F9CB4D64E5F6851BA" indent="up1" reported-display-style="italic"><enum>(BB)</enum><text>the prevailing wage level for the occupational classification in the area of employment, whichever
			 is greater, based on the best information available; or</text>
										</subitem></item><item changed="added" committee-id="HJU00" id="HB118791292F949EC903A106A043E2A27" indent="up1" reported-display-style="italic"><enum>(bb)</enum><text display-inline="yes-display-inline">if 80 percent or more of the employer’s workers in the same occupational classification as the
			 alien and in the same area of employment as the alien are United States
			 workers (as defined in section 212(n)(4)), will offer to the alien during
			 the period of authorized employment wages that are at least the actual
			 wage level paid by the employer to all other individuals with similar
			 experience and qualifications for the specific employment in question; and</text>
									</item></subclause><subclause changed="added" committee-id="HJU00" id="H43F4B007E22140E297C2A5CC9D2853B2" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>will provide working conditions for such alien that will not adversely affect the working
			 conditions of workers similarly employed.</text>
								</subclause></clause><clause changed="added" committee-id="HJU00" id="H255FDFA46CFE4B4BB39C650D9EAA3E93" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">In complying with the requirements of clause (i), an employer may keep the alien on their home
			 country payroll, and may take into account the value of wages paid by the
			 employer to the alien in the currency of the alien’s home country, the
			 value of benefits paid by the employer to the alien in the alien’s home
			 country, employer-provided housing or housing allowances,
			 employer-provided vehicles or transportation allowances, and other
			 benefits provided to the alien as an incident of the assignment in the
			 United States.</text>
							</clause><clause changed="added" committee-id="HJU00" id="HE2303C6B91524AD28F7258DC93460C53" indent="up1" reported-display-style="italic"><enum>(iii)</enum><text>The Secretary of Labor shall have the same investigatory and enforcement powers to ensure
			 compliance with this subparagraph as are set forth in section 212(n)(2).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H9AF806A2AA374072BB92C66F628A6E32"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act and
			 shall apply to employers with respect to aliens issued visas or otherwise
			 provided nonimmigrant status under section 101(a)(15)(L) of the
			 Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(L)</external-xref>) on or after such
			 date.</text>
				</subsection></section><section id="HBF7FEA92813C437EBD6BE903582ED48C"><enum>203.</enum><header>O visas</header>
				<subsection id="HAA74ACD1B6024BFD810B75A33006ADCC"><enum>(a)</enum><header>Portability of o visas</header><text display-inline="yes-display-inline">The first sentence of section 214(n)(1) of the Immigration and Nationality Act (8 U.S.C.
			 1184(n)(1)) is amended—</text>
					<paragraph id="H8AC1AB4214B548F3981DFC4AC97C60F9"><enum>(1)</enum><text>by striking <quote>section 101(a)(15)(H)(i)(b)</quote> and inserting <quote>subparagraphs (H)(i)(b) and (O)(i) of section 101(a)(15)</quote>; and</text>
					</paragraph><paragraph id="H44D35A2F9FAB4CCFA3F3FCDC41072B52"><enum>(2)</enum><text>by inserting <quote>under such sections</quote> after <quote>new employment</quote>.</text>
					</paragraph></subsection><subsection id="HFB1B7BC719FE4CB0A190F4E9A72CE402"><enum>(b)</enum><header>3-Year waiver of new O–1 consultations for arts and motion pictures and television and transparency
			 for O–1 visas for motion pictures and television</header>
					<paragraph id="H4152C0A577FF4E79BFE84E5AA8CE68B8"><enum>(1)</enum><header>In general</header><text>Section 214(c)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)(3)</external-xref>) is amended—</text>
						<subparagraph id="H425C57AAB25B4C9EB6558732C1EE2FFA"><enum>(A)</enum><text>by striking <quote>Attorney General</quote> each place such term appears and inserting <quote>Secretary of Homeland Security</quote>; and</text>
						</subparagraph><subparagraph id="HB730F1F614A04A508A964618F8A353AF"><enum>(B)</enum><text>by striking the first two sentences of the matter that follows subparagraph (B) and inserting the
			 following: <quote>In the case of an alien seeking entry for a motion picture or television production, (i) any
			 opinion under the previous sentence shall only be advisory, (ii) any such
			 opinion that recommends denial must be in writing, (iii) in making the
			 decision the Secretary of Homeland Security shall consider the exigencies
			 and scheduling of the production, (iv) the Secretary of Homeland Security
			 shall append to the decision any such opinion, and (v) upon making the
			 decision, the Secretary of Homeland Security shall immediately provide a
			 copy of the decision to the consulting labor and management organizations.
			 The Secretary of Homeland Security shall provide by regulation for the
			 waiver of the consultation requirement under subparagraph (A) in the case
			 of aliens who have been admitted as nonimmigrants under section
			 101(a)(15)(O)(i) because of extraordinary ability in the arts or
			 extraordinary achievement in motion picture or television production and
			 who seek readmission to perform similar services within 3 years after the
			 date of a consultation under such subparagraph provided that, in the case
			 of aliens admitted because of extraordinary achievement in motion picture
			 or television production, such waiver shall apply only if the prior
			 consultations by the appropriate union and management organization were
			 favorable or raised no objection to the approval of the petition.</quote>.</text>
						</subparagraph></paragraph><paragraph id="H030D00F398114FEFB9B8B2C207C9DD07"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall take effect on the date of the enactment of this Act and
			 shall apply to petitions filed under section 214(c) of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)</external-xref>) on or after such date and to
			 consultation decisions made before, on, or after such date.</text>
					</paragraph></subsection></section><section id="HEFA8ABBD85304254BE60A7F9FF26A35D"><enum>204.</enum><header>Mexican and Canadian professionals</header><text display-inline="no-display-inline">Section 214(e) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(e)</external-xref>) is amended by adding at
			 the end the following:</text>
				<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="HF5C9A865B21A432CA9667B62CF25A1F7" reported-display-style="italic" style="traditional">
					<paragraph id="H778EF901074745DD84C6522D706DFA5A" indent="up1"><enum>(7)</enum>
						<subparagraph commented="no" display-inline="yes-display-inline" id="HC7A92F6C1E0D43798D489200A277D905"><enum>(A)</enum><text display-inline="yes-display-inline">An employer of a Mexican or Canadian professional under this subsection—</text>
							<clause changed="added" committee-id="HJU00" id="H34A5AEFAA5EF42549F0AA7A3D07D2CC8" indent="up1" reported-display-style="italic"><enum>(i)</enum>
								<subclause commented="no" display-inline="yes-display-inline" id="H5F6166E4CE5F4766872165BD06744F72"><enum>(I)</enum><text display-inline="yes-display-inline">except as provided in subclause (II), will offer to the alien during the period of authorized
			 employment wages that are at least—</text>
									<item changed="added" committee-id="HJU00" id="H6A34951D8D434A7B9C5CF2581600D4FD" indent="up1" reported-display-style="italic"><enum>(aa)</enum><text>the actual wage level paid by the employer to all other individuals with similar experience and
			 qualifications for the specific employment in question; or</text>
									</item><item changed="added" committee-id="HJU00" id="H7F23721D50514011A0A29618EA3886FC" indent="up1" reported-display-style="italic"><enum>(bb)</enum><text>the prevailing wage level for the occupational classification in the area of employment, whichever
			 is greater, based on the best information available; or</text>
									</item></subclause><subclause changed="added" committee-id="HJU00" id="H683994DAA5E84EB38292EFE55C3FC04C" indent="up1" reported-display-style="italic"><enum>(II)</enum><text display-inline="yes-display-inline">if 80 percent or more of the employer’s workers in the same occupational classification as the
			 alien and in the same area of employment as the alien are United States
			 workers (as defined in section 212(n)(4)), will offer to the alien during
			 the period of authorized employment wages that are at least the actual
			 wage level paid by the employer to all other individuals with similar
			 experience and qualifications for the specific employment in question
			 (but, in the case of an employer with more than 25 employees, in no event
			 shall such wages be lower than the mean of the lowest one-half of wages
			 surveyed pursuant to section 212(p)(5)); and</text>
								</subclause></clause><clause changed="added" committee-id="HJU00" id="H909C637562C141159A6CE04756984A3C" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>will provide working conditions for such alien that will not adversely affect the working
			 conditions of workers similarly employed.</text>
							</clause></subparagraph><subparagraph changed="added" committee-id="HJU00" id="H8595B525671448308A5260D0095B6F1A" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary of Labor shall have the same investigatory and enforcement powers to ensure
			 compliance with this paragraph as are set forth in section 212(n)(2).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section display-inline="no-display-inline" id="HF148045DFAFA4F68BCB92AB0667CA2A3"><enum>205.</enum><header><enum-in-header>H-1B1</enum-in-header> and <enum-in-header>E-3</enum-in-header> visas</header><text display-inline="no-display-inline">Section 212(t)(1)(A)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(t)(1)(A)(i)</external-xref>) (as
			 added by section 402(b)(2) of <external-xref legal-doc="public-law" parsable-cite="pl/108/77">Public Law 108–77</external-xref> (117 Stat. 941)) is
			 amended—</text>
				<paragraph display-inline="no-display-inline" id="HE51B07C7B31F460E9D82942B4800F927"><enum>(1)</enum><text>by striking <quote>; and</quote> at the end and inserting <quote>; or</quote>;</text>
				</paragraph><paragraph id="H3AE94E1FF6894599BA3D10809CC2F97D"><enum>(2)</enum><text>by redesignating subclauses (I) and (II) as items (aa) and (bb), respectively;</text>
				</paragraph><paragraph id="H5E440434A9AD4A55956254C423E44226"><enum>(3)</enum><text>by striking <quote><header-in-text level="clause" style="OLC"><enum-in-header>(i)</enum-in-header></header-in-text></quote> and inserting <quote><header-in-text level="clause" style="OLC"><enum-in-header>(i)(I)</enum-in-header></header-in-text></quote>;</text>
				</paragraph><paragraph id="HD9FDCB07123745399728D32339A1D59F"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting <quote>except as provided in subclause (II),</quote> before <quote>is offering</quote>; and</text>
				</paragraph><paragraph id="H113549F7B20441DFAD563896B49C70D0"><enum>(5)</enum><text>by adding at the end the following:</text>
					<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H64E3865560CB42C5818C53475174013A" reported-display-style="italic" style="traditional">
						<subclause id="HC4FA00CAF2A148DDA3F46505412420D9" indent="up2"><enum>(II)</enum><text display-inline="yes-display-inline">if 80 percent or more of the employer’s workers in the same occupational classification as the
			 alien admitted or provided status under section 101(a)(15)(H)(i)(b1) or
			 101(a)(15)(E)(iii) and in the same area of employment as the alien
			 admitted or provided status under section 101(a)(15)(H)(i)(b1) or
			 101(a)(15)(E)(iii) are United States workers (as defined in subsection
			 (n)(4)), is offering and will offer during the period of authorized
			 employment to aliens admitted or provided status under section
			 101(a)(15)(H)(i)(b1) or section 101(a)(15)(E)(iii) wages that are at least
			 the actual wage level paid by the employer to all other individuals with
			 similar experience and qualifications for the specific employment in
			 question (but, in the case of an employer with more than 25 employees, in
			 no event shall such wages be lower than the mean of the lowest one-half of
			 wages surveyed pursuant to subsection (p)(5)); and</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HADBD3B380C124CE893C0612FE139774A"><enum>206.</enum><header>Students</header>
				<subsection display-inline="no-display-inline" id="HA9EF5FD271614A18A4701D015093A31A"><enum>(a)</enum><header>Dual intent</header>
					<paragraph id="H8A60F0785FD64F25B8B243F35B67557F"><enum>(1)</enum><header>In general</header><text>Section 101(a)(15)(F) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(F)</external-xref>) is amended
			 to read as follows:</text>
						<quoted-block changed="added" committee-id="HJU00" id="H09D3509044D64DA68773C776AE663C82" reported-display-style="italic" style="traditional">
							<subparagraph id="H2D77AD1944E6400789A1DBB50624318C" indent="up1"><enum>(F)</enum><text>an alien—</text>
								<clause id="H98294CCC63284AA4A17701836AA6CE68"><enum>(i)</enum><text>who—</text>
									<subclause id="HD0C661436B504BA9B315D55B1AC0B620"><enum>(I)</enum><text display-inline="yes-display-inline">is a bona fide student qualified to pursue a full course of study in a field of science,
			 technology, engineering, or mathematics (as defined in section
			 203(b)(6)(B)(ii)) leading to a bachelors or graduate degree and who seeks
			 to enter the United States for the purpose of pursuing such a course of
			 study consistent with section 214(m) at an institution of higher education
			 (as described in section 101(a) of the Higher Education Act of 1965 (20
			 U.S.C. 1001(a))) or a proprietary institution of higher education (as
			 defined in section 102(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(b)</external-xref>)) in the United
			 States, particularly designated by the alien and approved by the Secretary
			 of Homeland Security, after consultation with the Secretary of Education,
			 which institution shall have agreed to report to the Secretary of Homeland
			 Security the determination of attendance of each nonimmigrant student, and
			 if any such institution fails to make reports promptly the approval shall
			 be withdrawn; or</text>
									</subclause><subclause id="H757C5DD0CA8A4AFF9FE7F7E9AAB5CD70"><enum>(II)</enum><text>is engaged in temporary employment for optional practical training related to such alien’s area of
			 study following completion of the course of study described in subclause
			 (I);</text>
									</subclause></clause><clause id="HF9F541646C0E4F7CA29C04F46D0CB019"><enum>(ii)</enum><text>who—</text>
									<subclause id="HF0C7C40A75F841B6B9966A14447039A9"><enum>(I)</enum><text>has a residence in a foreign country which the alien has no intention of abandoning, who is a bona
			 fide student qualified to pursue a full course of study, and who seeks to
			 enter the United States temporarily and solely for the purpose of pursuing
			 such a course of study consistent with section 214(m) at an established
			 college, university, seminary, conservatory, academic high school,
			 elementary school, or other academic institution or in a language training
			 program in the United States, particularly designated by the alien and
			 approved by the Secretary of Homeland Security, after consultation with
			 the Secretary of Education, which institution of learning or place of
			 study shall have agreed to report to the Secretary of Homeland Security
			 the determination of attendance of each nonimmigrant student, and if any
			 such institution of learning or place of study fails to make reports
			 promptly the approval shall be withdrawn; or</text>
									</subclause><subclause id="H1AECA6605CDF4B7F8F29AC22B8E13C08"><enum>(II)</enum><text display-inline="yes-display-inline">is engaged in temporary employment for optional practical training related to such alien’s area of
			 study following completion of the course of study described in subclause
			 (I);</text>
									</subclause></clause><clause id="H021065D2296348F3AA2637AB14320B81"><enum>(iii)</enum><text>who is the spouse or minor child of an alien described in clause (i) or (ii) if accompanying or
			 following to join such an alien; or</text>
								</clause><clause id="HA61D5EFABF6B4CD3A42EB2C4FB69F64A"><enum>(iv)</enum><text display-inline="yes-display-inline">who is a national of Canada or Mexico, who maintains actual residence and place of abode in the
			 country of nationality, who is described in clause (i) or (ii) except that
			 the alien’s qualifications for and actual course of study may be full or
			 part-time, and who commutes to the United States institution or place of
			 study from Canada or Mexico;</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HB09795E1F4014413B3B1C99455A6E8F2"><enum>(2)</enum><header>Admission</header><text display-inline="yes-display-inline">Section 214(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(b)</external-xref>), as amended by section
			 108(d)(1) of this Act, is further amended by striking <quote>(L) or (V)</quote> inserting <quote>(F)(i), (L), or (V)</quote>.</text>
					</paragraph><paragraph id="HDAACA3C23D7C4F2E9308217C56A7CA06"><enum>(3)</enum><header>Conforming amendment</header><text>Section 214(m)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(m)(1)</external-xref>) is amended, in the
			 matter preceding subparagraph (A), by striking <quote>(i) or (iii)</quote> and inserting <quote>(i), (ii), or (iv)</quote>.</text>
					</paragraph></subsection><subsection id="HE4D1D6DFC9B544048B5FE23FCDF3F5BE"><enum>(b)</enum><header>Optional practical training for foreign students</header><text>Section 214 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184</external-xref>) is amended by adding at the end
			 the following:</text>
					<quoted-block changed="added" committee-id="HJU00" id="HD6AE968C28734E6BBD10DC45DB1489BB" reported-display-style="italic" style="traditional">
						<subsection id="HD0A5785CD653492DB63AB0BBDE86BF32"><enum>(s)</enum>
							<paragraph commented="no" display-inline="yes-display-inline" id="H2D70C009C98C4CF39A14E5E991A9E7E4"><enum>(1)</enum><text display-inline="yes-display-inline">An employer providing optional practical training to an alien who has been issued a visa or
			 otherwise provided nonimmigrant status under subparagraph (F) or (M) of
			 section 101(a)(15) after completion of the alien’s course of study—</text>
								<subparagraph changed="added" committee-id="HJU00" id="H1356DAF506DC450099C1AC6671161509" indent="up1" reported-display-style="italic"><enum>(A)</enum>
									<clause commented="no" display-inline="yes-display-inline" id="HB748EFD765694EECBC540034443D2EBA"><enum>(i)</enum><text display-inline="yes-display-inline">except as provided in clause (ii), shall offer to the alien during the period of optional practical
			 training wages that are at least—</text>
										<subclause changed="added" committee-id="HJU00" id="H1A30076EF4BF451B822FF1D31B3C9E8E" reported-display-style="italic"><enum>(I)</enum><text display-inline="yes-display-inline">the actual wage level paid by the employer to all other individuals with similar experience and
			 qualifications for the specific employment in question; or</text>
										</subclause><subclause changed="added" committee-id="HJU00" id="HC9806E66087347DCB987C2A727960181" reported-display-style="italic"><enum>(II)</enum><text display-inline="yes-display-inline">the prevailing wage level for the occupational classification in the area of employment, whichever
			 is greater, based on the best information available; or</text>
										</subclause></clause><clause changed="added" committee-id="HJU00" id="H56E9D93050CB4C07AA33E22367C57C91" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">if 80 percent or more of the employer’s workers in the same occupational classification as the
			 alien and in the same area of employment as the alien are United States
			 workers (as defined in section 212(n)(4)), shall offer to the alien during
			 the period of authorized employment wages that are at least the actual
			 wage level paid by the employer to all other individuals with similar
			 experience and qualifications for the specific employment in question
			 (but, in the case of an employer with more than 25 employees, in no event
			 shall such wages be lower than the mean of the lowest one-half of wages
			 surveyed pursuant to section 212(p)(5)); and</text>
									</clause></subparagraph><subparagraph changed="added" committee-id="HJU00" id="H95933E86C4FB489EBD66AA06FDA63000" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">shall provide working conditions for such alien that will not adversely affect the working
			 conditions of workers similarly employed.</text>
								</subparagraph></paragraph><paragraph changed="added" committee-id="HJU00" id="H0A9979A06FA146E39FFAE14F72A949D0" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The Secretary of Labor has the same investigatory and enforcement powers to ensure compliance with
			 paragraph (1) as are set forth in section 212(n)(2).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HF71A77BE9CBE4AB4850BCAAE17674F32"><enum>(c)</enum><header>Effective dates</header>
					<paragraph id="H7E8A9127471F452BAE76B551869DF15D"><enum>(1)</enum><text>The amendments made by subsection (a) shall take effect on the date of the enactment of this Act,
			 and shall apply to nonimmigrants who possess or are granted status under
			 section 101(a)(15)(F) of the Immigration and Nationality Act (8 U.S.C.
			 1101(a))(15)(F)) on or after such date.</text>
					</paragraph><paragraph id="H475424B8A35745F6A65DDD5CF565C9D3"><enum>(2)</enum><text>The amendment made by subsection (b) shall apply to employers with respect to aliens who begin
			 post-course of study optional practical training with them on or after the
			 date of the enactment of this Act.</text>
					</paragraph></subsection></section><section id="HC92EA1AC491445B2A1A184A811B6316C"><enum>207.</enum><header>Extension of employment eligibility while visa extension petition pending</header>
				<subsection id="H0215E872EB1E4424A58EF8DC9B70441F"><enum>(a)</enum><header>In general</header><text>Section 214 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184</external-xref>, as amended by section 205(b), is
			 further amended by adding at the end the following:</text>
					<quoted-block changed="added" committee-id="HJU00" id="H6C13066E88774555880810AB9C5518F9" reported-display-style="italic" style="OLC">
						<subsection id="HBB71026A1A234A99B89140D659C3B152"><enum>(t)</enum><text>A nonimmigrant issued a visa or otherwise provided nonimmigrant status under subparagraph (A), (E),
			 (G), (H), (I), (J), (L), (O), (P), (Q), or (R) of section 101(a)(15), or
			 section 214(e), and otherwise as the Secretary of Homeland Security may by
			 regulations prescribe, whose status has expired but who has, or whose
			 sponsoring employer or authorized agent has, filed a timely application or
			 petition for an extension of authorized status as provided under this
			 section, is authorized to continue employment with the same employer for a
			 period not to exceed 240 days beginning on the date of the expiration of
			 the authorized period of stay until and unless the application or petition
			 is denied. Such authorization shall be subject to the same conditions and
			 limitations noted on the original authorization.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H4B4235B4B26F4148A9311C026533527B"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act and
			 shall apply to aliens issued visas or otherwise provided nonimmigrant
			 status before, on, or after such date.</text>
				</subsection></section><section id="H8DF9EEF563F3494881C1C32CB679ADB4"><enum>208.</enum><header>Fraud detection and prevention fee</header><text display-inline="no-display-inline">Section 214(c)(12)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)(12)(A)</external-xref>) is amended
			 by adding at the end the following:</text>
				<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="HBF42C87349EC4EC59563CAFC5FF72BDB" reported-display-style="italic" style="traditional">
					<quoted-block-continuation-text indent="up1" quoted-block-continuation-text-level="subparagraph">The Secretary of Homeland Security shall also impose the fee described in the preceding sentence on
			 an employer filing an attestation under section 212(t)(1) or employing an
			 alien pursuant to subsection (e).</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H3F646E4BE9354A409890E80BF2C54D2A"><enum>209.</enum><header>Technical correction</header><text display-inline="no-display-inline">The second subsection designated as subsection (t) of section 212 of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>) (as added by section 1(b)(2)(B) of Public
			 Law 108–449 (118 Stat. 3470)) is redesignated as subsection (u) of such
			 section.</text>
			</section></title><title id="H7042816EE9874FE1BBA13D5B137A8F62"><enum>III</enum><header>Reforms Affecting Both Immigrant and Nonimmigrant Visas</header>
			<section id="H8571769EA3304394AC654A65BB0F8C76"><enum>301.</enum><header>Prevailing wages</header>
				<subsection id="H0ACA356EEE8141E9811F653F64256AEF"><enum>(a)</enum><header>In general</header><text>Section 212(p) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(p)</external-xref>) is amended—</text>
					<paragraph id="HBF2AAAA3F11944748914AB75AF9FFB1D"><enum>(1)</enum><text>in paragraph (1), by striking <quote>subsections (a)(5)(A), (n)(1)(A)(i)(II), and (t)(1)(A)(i)(II)</quote> and inserting <quote>subsections (a)(5)(A), (n)(1)(A)(i)(II), and (t)(1)(A)(i)(II) of this section, and subsections
			 (c)(2)(G), (e), and (s) of section 214,</quote>;</text>
					</paragraph><paragraph id="H061E2A8B0A8A4F06901FB03614D7EC69"><enum>(2)</enum><text>by redesignating paragraphs (2) through (4) as paragraphs (3) through (5), respectively;</text>
					</paragraph><paragraph id="HE5D1648E324F43C69FFABA899C0F2E51"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text>
						<quoted-block changed="added" committee-id="HJU00" id="H621ED0D02A61416784216AD4036BABD0" reported-display-style="italic" style="traditional">
							<paragraph id="H1940AC6826084639BB391BE7AADCF014" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In computing the prevailing wage level for an occupational classification in an area of employment
			 for purposes of subsections (a)(5)(A), (n)(1)(A)(i)(II), and
			 (t)(1)(A)(i)(II) of this section, and subsections (c)(2)(G), (e), and (s)
			 of section 214, the wage level shall be the wage level specified in
			 subparagraph (A), (B), or (C) of paragraph (5) depending on the
			 experience, education, and level of supervision required for the position.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H81203744C6B543B396C029034716F249"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (4) (as redesignated), by striking <quote>subsections (a)(5)(A), (n)(1)(A)(i)(II), and (t)(1)(A)(i)(II)</quote> and inserting <quote>subsections (a)(5)(A), (n)(1)(A)(i)(II), and (t)(1)(A)(i)(II) of this section, and subsections
			 (c)(2)(G), (e), and (s) of section 214,</quote>;</text>
					</paragraph><paragraph id="H174A1A1122A94FE0B1A06098B316C7CA"><enum>(5)</enum><text>by amending paragraph (5) (as redesignated) to read as follows:</text>
						<quoted-block changed="added" committee-id="HJU00" id="H0DE51FA2F14140F992A9B53208866E71" reported-display-style="italic" style="traditional">
							<paragraph id="H7E704105A14B4608BC39E516E8FD6559" indent="up1"><enum>(5)</enum><text>Subject to paragraph (2), the Secretary of Labor shall make available to employers a governmental
			 survey to determine the prevailing wage for each occupational
			 classification by metropolitan statistical area in the United States. Such
			 survey, or other survey approved by the Secretary of Labor, shall provide
			 3 levels of wages commensurate with experience, education, and level of
			 supervision. Such wage levels shall be determined as follows:</text>
								<subparagraph id="HB737F39360E7479486E20199B69845BF"><enum>(A)</enum><text>The first level shall be the mean of the lowest two-thirds of wages surveyed, but in no case less
			 than 80 percent of the mean of the wages surveyed.</text>
								</subparagraph><subparagraph id="H057AD59881974E4996C921155696C9DB"><enum>(B)</enum><text>The second level shall be the mean of wages surveyed.</text>
								</subparagraph><subparagraph id="H29584FC27CE54CD9BCFA7B0E1A69EA20"><enum>(C)</enum><text>The third level shall be the mean of the highest two-thirds of wages surveyed.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H0D9B67AB2D50492FB842783772CFCDAB"><enum>(6)</enum><text>by adding at the end the following:</text>
						<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="H639E160B9B7342C096DA8F6F4D2CE2B8" reported-display-style="italic" style="traditional">
							<paragraph id="HE3AF53E939F645ECA806EF9B0D7F23F3" indent="up1"><enum>(6)</enum><text>An employer may use an independent authoritative survey approved by the Secretary of Labor for
			 purposes of paragraph (5), if—</text>
								<subparagraph id="H9E14413BC9304C9283FB9B256E29A4D2"><enum>(A)</enum><text>the survey data was collected within 24 months;</text>
								</subparagraph><subparagraph id="H159D1612F1454AAA90DE91B24D42ED39"><enum>(B)</enum><text>the survey was published within the prior 24 months;</text>
								</subparagraph><subparagraph id="HB1854628DE8C483D843935A934281341"><enum>(C)</enum><text>the survey reflects the area of intended employment;</text>
								</subparagraph><subparagraph id="HB7E6B6FFE05E47B187168025625C0D22"><enum>(D)</enum><text>the employer’s job description adequately matches the job description in the survey;</text>
								</subparagraph><subparagraph id="HDD178DE987204775A01CC6EA7B14536D"><enum>(E)</enum><text>the survey is across industries that employ workers in the occupation;</text>
								</subparagraph><subparagraph id="H425389961F644006B5089D35F513D2DA"><enum>(F)</enum><text>the wage determination is based on the arithmetic mean (weighted average); and</text>
								</subparagraph><subparagraph id="HE38AAB414F584047862FBC8587A7A6D1"><enum>(G)</enum><text>the survey identifies a statistically valid methodology that was used to collect the data.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HA471ECD850824751A0D094115AF9A921"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on the date of the enactment of this Act,
			 and shall apply to employers with regard to labor certifications under
			 sections 212(a)(5)(A) of the Immigration and Nationality Act (8 U.S.C.
			 1182(a)(5)(A)), labor condition applications under section 212(n)(1) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)(1)</external-xref>), and attestations under section 212(t)(1)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(t)(1)</external-xref>), filed on or after such date, to
			 employers with regard to aliens issued visas or otherwise provided
			 nonimmigrant status under section 101(a)(15)(L) of such Act (8 U.S.C.
			 1101(a)(15)(L)) on or after such date, and to employers with regard to
			 aliens they provide post-course of study optional practical training that
			 begins on or after such date.</text>
				</subsection></section><section id="H32F811E906964B3F8C966FAE1825B1C0"><enum>302.</enum><header>Streamlining petitions for established employers</header>
				<subsection id="H99D1DBBF3E9A48868F6BBF7505264F3D"><enum>(a)</enum><header>In general</header><text>Section 214(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)</external-xref>), as amended by this Act,
			 is further amended by adding at the end the following:</text>
					<quoted-block changed="added" committee-id="HJU00" id="H8422C552357F4D6BA01E62E27A52CA18" reported-display-style="italic" style="traditional">
						<paragraph id="H03DD4C9B9A6F423F92380EDD56600569" indent="up1"><enum>(16)</enum><text>The Secretary of Homeland Security shall establish a pre-certification procedure for employers who
			 file multiple petitions described in this subsection or section
			 204(a)(1)(F). Such precertification procedure shall enable an employer to
			 avoid repeatedly submitting documentation that is common to multiple
			 petitions and establish, through a single filing, criteria relating to the
			 employer and the offered employment opportunity.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H366C54D10E964A5D918809F1D87FA6FF"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall take effect on the date of the enactment of this Act,
			 and shall apply to petitions filed under section 204(a)(1)(F) or 214(c) of
			 the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(F)</external-xref> or 1184(c))
			 beginning 180 days after such date.</text>
