		<section commented="no" id="HEABC719CB7724FF4ACDF41294DA4C830" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Energy Efficiency Improvement Act of 2014</short-title></quote>.</text>
		</section><title id="HF8696FAA56174529A729A708C9C927EF"><enum>I</enum><header>Better Buildings</header>
			<section id="HC2FEE87028F145A0BEC0540D76DCDFC8" section-type="subsequent-section"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Better Buildings Act of 2014</short-title></quote>.</text>
			</section><section id="HAB776A762E9C466996681B3DC4A43A92"><enum>102.</enum><header>Energy efficiency in Federal and other buildings</header>
				<subsection id="HE1F07AFFACE842D396B1B971D31D5A0E"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
					<paragraph id="HB10E12AF6F4F4C32A9092EEC353BB69D"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of General Services.</text>
					</paragraph><paragraph id="H51A06A9F82DB435FB8B8D119FFCC031B"><enum>(2)</enum><header>Cost-effective energy efficiency measure</header><text>The term <term>cost-effective energy efficiency measure</term> means any building product, material, equipment, or service, and the installing, implementing, or
			 operating thereof, that provides energy savings in an amount that is not
			 less than the cost of such installing, implementing, or operating.</text>
					</paragraph><paragraph id="HD9D739029D7E4E8981C2CB86372C3C5E"><enum>(3)</enum><header>Cost-effective water efficiency measure</header><text display-inline="yes-display-inline">The term <quote>cost-effective water efficiency measure</quote> means any building product, material, equipment, or service, and the installing, implementing, or
			 operating thereof, that provides water savings in an amount that is not
			 less than the cost of such installing, implementing, or operating.</text>
					</paragraph></subsection><subsection id="HDEB0308567CF4468BF9F49957577DC98"><enum>(b)</enum><header>Model provisions, policies, and best practices</header>
					<paragraph id="H54A5593876B64F9399894071D6B8575E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator, in consultation
			 with the Secretary of Energy and after providing the public with an
			 opportunity for notice and comment, shall develop model commercial leasing
			 provisions and best practices in accordance with this subsection.</text>
					</paragraph><paragraph id="HD591539EE7C546CF8784BB366B45661D"><enum>(2)</enum><header>Commercial leasing</header>
						<subparagraph id="H9523B4FB428F4FB9A28850F65CFB0311"><enum>(A)</enum><header>In general</header><text>The model commercial leasing provisions developed under this subsection shall, at a minimum, align
			 the interests of building owners and tenants with regard to investments in
			 cost-effective energy efficiency measures and cost-effective water
			 efficiency measures to encourage building owners and tenants to
			 collaborate to invest in such measures.</text>
						</subparagraph><subparagraph id="H6DFEB249011C430DBB1AF9E23BF4B8A4"><enum>(B)</enum><header>Use of model provisions</header><text display-inline="yes-display-inline">The Administrator may use the model commercial leasing provisions developed under this subsection
			 in any standard leasing document that designates a Federal agency (or
			 other client of the Administrator) as a landlord or tenant.</text>
						</subparagraph><subparagraph id="HFE5C53554CE74E2C854D63A2804CB5D7"><enum>(C)</enum><header>Publication</header><text display-inline="yes-display-inline">The Administrator shall periodically publish the model commercial leasing provisions developed
			 under this subsection, along with explanatory materials, to encourage
			 building owners and tenants in the private sector to use such provisions
			 and materials.</text>
						</subparagraph></paragraph><paragraph id="HE1F2B90D07DF4149909CB3064F4BB651"><enum>(3)</enum><header>Realty services</header><text>The Administrator shall develop policies and practices to implement cost-effective energy
			 efficiency measures and cost-effective water efficiency measures for the
			 realty services provided by the Administrator to Federal agencies (or
			 other clients of the Administrator), including periodic training of
			 appropriate Federal employees and contractors on how to identify and
			 evaluate those measures.</text>
					</paragraph><paragraph id="H53C67DFA73774FB3B877133AF9FCBDDC"><enum>(4)</enum><header>State and local assistance</header><text display-inline="yes-display-inline">The Administrator, in consultation with the Secretary of Energy, shall make available model
			 commercial leasing provisions and best practices developed under this
			 subsection to State, county, and municipal governments for use in managing
			 owned and leased building space in accordance with the goal of encouraging
			 investment in all cost-effective energy efficiency measures and
			 cost-effective water efficiency measures.</text>
					</paragraph></subsection></section><section id="H15E9504E55044082865EDB8146E405C0"><enum>103.</enum><header>Separate spaces with high-performance energy efficiency measures</header>
				<subsection id="HD45DC43A4B9A44A08991C3742FB9A8B0"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Subtitle B of title IV of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17081">42 U.S.C. 17081 et seq.</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block id="HB105C16241154BE486AAF01C10B39977" style="OLC">
						<section id="HABC786244B154A6281C02552E27B5783"><enum>424.</enum><header>Separate spaces with high-performance energy efficiency measures</header>
							<subsection id="H170D18A720844148B44A492498003EAD"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
								<paragraph id="H08EBEE614E014CF7AD9A6E90657E28C1"><enum>(1)</enum><header>High-performance energy efficiency measure</header><text>The term <term>high-performance energy efficiency measure</term> means a technology, product, or practice that will result in substantial operational cost savings
			 by reducing energy consumption and utility costs.</text>
								</paragraph><paragraph commented="no" id="HB36DC4EB821F46A59AB6C7976535FC1F"><enum>(2)</enum><header>Separate spaces</header><text>The term <term>separate spaces</term> means areas within a commercial building that are leased or otherwise occupied by a tenant or
			 other occupant for a period of time pursuant to the terms of a written
			 agreement.</text>
								</paragraph></subsection><subsection id="H7D26C350BE324881B2BE0951DB2D31D7"><enum>(b)</enum><header>Study</header>
								<paragraph id="HD083B094526E49A0BD49316A2A320613"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this section, the Secretary, acting through
			 the Assistant Secretary of Energy Efficiency and Renewable Energy, shall
			 complete a study on the feasibility of—</text>
									<subparagraph id="H6FEA8EE6318C4281BBC1545CB2823567"><enum>(A)</enum><text>significantly improving energy efficiency in commercial buildings through the design and
			 construction, by owners and tenants, of separate spaces with
			 high-performance energy efficiency measures; and</text>
									</subparagraph><subparagraph id="H1A67119F93EF476E98A7C3473D7384FB"><enum>(B)</enum><text>encouraging owners and tenants to implement high-performance energy efficiency measures in separate
			 spaces.</text>
									</subparagraph></paragraph><paragraph id="H62C0A79F4F8B4F2FB1F9FA4E7A8E86C4"><enum>(2)</enum><header>Scope</header><text>The study shall, at a minimum, include—</text>
									<subparagraph id="HFC795700B9034113BEE94B88CBFF1A8D"><enum>(A)</enum><text>descriptions of—</text>
										<clause id="HFBF910C57E02445FB480678A8A83876D"><enum>(i)</enum><text>high-performance energy efficiency measures that should be considered as part of the initial design
			 and construction of separate spaces;</text>
										</clause><clause id="H163F3ABE7E6D47C8A09281F605FD57C6"><enum>(ii)</enum><text>processes that owners, tenants, architects, and engineers may replicate when designing and
			 constructing separate spaces with high-performance energy efficiency
			 measures;</text>
										</clause><clause id="H929A045C53464249B6402F9D1963E07F"><enum>(iii)</enum><text>policies and best practices to achieve reductions in energy intensities for lighting, plug loads,
			 heating, cooling, cooking, laundry, and other systems to satisfy the needs
			 of the commercial building tenant;</text>
										</clause><clause id="HAEAA2C32A40F449F88804DE9E14285EF"><enum>(iv)</enum><text display-inline="yes-display-inline">return on investment and payback analyses of the incremental cost and projected energy savings of
			 the proposed set of high-performance energy efficiency measures, including
			 consideration of available incentives;</text>
										</clause><clause id="H7D2F089CF7A541A49FB50A2C5E01BF6D"><enum>(v)</enum><text>models and simulation methods that predict the quantity of energy used by separate spaces with
			 high-performance energy efficiency measures and that compare that
			 predicted quantity to the quantity of energy used by separate spaces
			 without high-performance energy efficiency measures but that otherwise
			 comply with applicable building code requirements;</text>
										</clause><clause id="HD83CF93DB3CD4C80B165C151C974CD38"><enum>(vi)</enum><text>measurement and verification platforms demonstrating actual energy use of high-performance energy
			 efficiency measures installed in separate spaces, and whether such
			 measures generate the savings intended in the initial design and
			 construction of the separate spaces;</text>
										</clause><clause id="HABE687E06CA34B85A48C7D0C16E014E6"><enum>(vii)</enum><text display-inline="yes-display-inline">best practices that encourage an integrated approach to designing and constructing separate spaces
			 to perform at optimum energy efficiency in conjunction with the central
			 systems of a commercial building; and</text>
										</clause><clause id="H800E03A2AEE54526B6527A68DCD64F70"><enum>(viii)</enum><text>any impact on employment resulting from the design and construction of separate spaces with
			 high-performance energy efficiency measures; and</text>
										</clause></subparagraph><subparagraph id="HF219E9F9AB4A4AFEB84016F58AA31A20"><enum>(B)</enum><text>case studies reporting economic and energy savings returns in the design and construction of
			 separate spaces with high-performance energy efficiency measures.</text>
									</subparagraph></paragraph><paragraph id="HDFCDF3B30A3C4CA5829D05C60CAF2992"><enum>(3)</enum><header>Public participation</header><text>Not later than 90 days after the date of the enactment of this section, the Secretary shall publish
			 a notice in the Federal Register requesting public comments regarding
			 effective methods, measures, and practices for the design and construction
			 of separate spaces with high-performance energy efficiency measures.</text>
								</paragraph><paragraph id="H44AAAFEDB7794D5AB152563BC9EA9381"><enum>(4)</enum><header>Publication</header><text>The Secretary shall publish the study on the website of the Department of Energy.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HFBFD84719B624F388A1A4DADE9153ECC"><enum>(b)</enum><header>Clerical Amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of the Energy Independence and Security Act of 2007 is
			 amended by inserting after the item relating to section 423 the following
			 new item:</text>

							<toc-entry level="section">Sec. 424. Separate spaces with high-performance energy efficiency measures.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H1F5680666DC445419EA7B558C046B732"><enum>104.</enum><header>Tenant star program</header>
				<subsection id="HE762822C914C4E439DBA08E7C46DBDAA"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Subtitle B of title IV of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17081">42 U.S.C. 17081 et seq.</external-xref>) (as amended by section 3) is amended by adding at the end the following:</text>
					<quoted-block id="H3BA5587B59CE43458E6840E826C9D3C4" style="OLC">
						<section id="H612E515641484DA9B0A70DDC6E16D9DD"><enum>425.</enum><header>Tenant star program</header>
							<subsection id="HEE088025F5264E078D96D23A7970DE3D"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
								<paragraph id="HEC43F10B03C844B28C60DD9E70BCB760"><enum>(1)</enum><header>High-performance energy efficiency measure</header><text>The term <term>high-performance energy efficiency measure</term> has the meaning given the term in section 424.</text>
								</paragraph><paragraph id="HFC2D41000E9A4AF18545A8CBC2747C9B"><enum>(2)</enum><header>Separate spaces</header><text>The term <term>separate spaces</term> has the meaning given the term in section 424.</text>
								</paragraph></subsection><subsection id="H08E7FE07CCC54E23A63070E020279514"><enum>(b)</enum><header>Tenant Star</header><text>The Administrator of the Environmental Protection Agency, in consultation with the Secretary of
			 Energy, shall develop a voluntary program within the Energy Star program
			 established by section 324A of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6294a">42 U.S.C. 6294a</external-xref>), which may be known as Tenant Star, to promote energy efficiency in separate spaces leased by
			 tenants or otherwise occupied within commercial buildings.</text>
							</subsection><subsection commented="no" id="HE320EB393F3242809D859732E03E5213"><enum>(c)</enum><header>Expanding survey data</header><text>The Secretary of Energy, acting through the Administrator of the Energy Information Administration,
			 shall—</text>
								<paragraph commented="no" id="HE2B4AF18D86F4C9F9A7D626C0F53A379"><enum>(1)</enum><text>collect, through each Commercial Buildings Energy Consumption Survey of the Energy Information
			 Administration that is conducted after the date of enactment of this
			 section, data on—</text>
									<subparagraph commented="no" id="H9BCF59233B7641429C5433C2E33E4E94"><enum>(A)</enum><text>categories of building occupancy that are known to consume significant quantities of energy, such
			 as occupancy by data centers, trading floors, and restaurants; and</text>
									</subparagraph><subparagraph commented="no" id="H6E79B79A2168432196FB278C834DD166"><enum>(B)</enum><text display-inline="yes-display-inline">other aspects of the property, building operation, or building occupancy determined by the
			 Administrator of the Energy Information Administration, in consultation
			 with the Administrator of the Environmental Protection Agency, to be
			 relevant in lowering energy consumption;</text>
									</subparagraph></paragraph><paragraph id="HCA0246461A44424D9259D4D08316FBF3"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to the first Commercial Buildings Energy Consumption Survey conducted after the date
			 of enactment of this section, to the extent full compliance with the
			 requirements of paragraph (1) is not feasible, conduct activities to
			 develop the capability to collect such data and begin to collect such
			 data; and</text>
								</paragraph><paragraph commented="no" id="H08B628C880914DD9B71C17E26AFF317B"><enum>(3)</enum><text display-inline="yes-display-inline">make data collected under paragraphs (1) and (2) available to the public in aggregated form and
			 provide such data, and any associated results, to the Administrator of the
			 Environmental Protection Agency for use in accordance with subsection (d).</text>
								</paragraph></subsection><subsection id="H6AA21803277B49BF935373B64F9D20AD"><enum>(d)</enum><header> Recognition of owners and tenants</header>
								<paragraph id="H527E4618DE2E49E2B42DCB2A5CFF45FB"><enum>(1)</enum><header>Occupancy-based recognition</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which sufficient data is received pursuant to subsection
			 (c), the Administrator of the Environmental Protection Agency shall,
			 following an opportunity for public notice and comment—</text>
									<subparagraph commented="no" id="H3664CB5489E34F218C98F712E72FFCEB"><enum>(A)</enum><text display-inline="yes-display-inline">in a manner similar to the Energy Star rating system for commercial buildings, develop policies and
			 procedures to recognize tenants in commercial buildings that voluntarily
			 achieve high levels of energy efficiency in separate spaces;</text>
									</subparagraph><subparagraph id="HCF34E454F08A4A0F885DE4831BB7F251"><enum>(B)</enum><text display-inline="yes-display-inline">establish building occupancy categories eligible for Tenant Star recognition based on the data
			 collected under subsection (c) and any other appropriate data sources; and</text>
									</subparagraph><subparagraph id="H8FF3F3E96753491A9F41C2A3D91DD258"><enum>(C)</enum><text>consider other forms of recognition for commercial building tenants or other occupants that lower
			 energy consumption in separate spaces.</text>
									</subparagraph></paragraph><paragraph id="H71C6F534751442E7B5628CA2B2F3898A"><enum>(2)</enum><header>Design- and construction-based recognition</header><text display-inline="yes-display-inline">After the study required by section 424(b) is completed, the Administrator of the Environmental
			 Protection Agency, in consultation with the Secretary and following an
			 opportunity for public notice and comment, may develop a voluntary program
			 to recognize commercial building owners and tenants that use
			 high-performance energy efficiency measures in the design and construction
			 of separate spaces.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H13C6188FFBB9420BB82EE21B5DEA7251"><enum>(b)</enum><header>Clerical Amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of the Energy Independence and Security Act of 2007 is
			 amended by inserting after the item relating to section 424 (as added by
			 section 3(b)) the following new item:</text>

							<toc-entry level="section">Sec. 425. Tenant Star program.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section></title><title id="H36A5D23E23F245A98ABF2A19C0A7B25E"><enum>II</enum><header>Grid-enabled water heaters</header>
			<section id="H65D6BE9F90FE4D4FAC2F9F12F0EA32BA" section-type="subsequent-section"><enum>201.</enum><header>Grid-enabled water heaters</header><text display-inline="no-display-inline">Part B of title III of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6291">42 U.S.C. 6291 et seq.</external-xref>) is amended—</text>
				<paragraph id="H357E0ED8A1FA407C82D3C5A69B40A199"><enum>(1)</enum><text>in section 325(e) (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(e)</external-xref>), by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H91C68B677D32448880D5BA1C23CE4252" style="OLC">
						<paragraph id="H2BA0944D1AC34DE19B41CC13772C3D41"><enum>(6)</enum><header>Additional standards for grid-enabled water heaters</header>
							<subparagraph id="H1170058E8C9544D6AAFD922C9142FD03"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text>
								<clause id="H2C148AEB775F4B77A637B9BEDA5BEE2E"><enum>(i)</enum><header>Activation lock</header><text display-inline="yes-display-inline">The term <term>activation lock</term> means a control mechanism (either a physical device directly on the water heater or a control
			 system integrated into the water heater) that is locked by default and
			 contains a physical, software, or digital communication that must be
			 activated with an activation key to enable the product to operate at its
			 designed specifications and capabilities and without which activation the
			 product will provide not greater than 50 percent of the rated first hour
			 delivery of hot water certified by the manufacturer.</text>
								</clause><clause id="H610BA9CFB7634DAB8BC97C67ACAFA2B2"><enum>(ii)</enum><header>Grid-enabled water heater</header><text>The term <term>grid-enabled water heater</term> means an electric resistance water heater that—</text>
									<subclause id="H80BCCCAE39594B019AEC34079B97D121"><enum>(I)</enum><text>has a rated storage tank volume of more than 75 gallons;</text>
									</subclause><subclause id="H567427EB22BE4F55BF06E1A1069BA8A3"><enum>(II)</enum><text>is manufactured on or after April 16, 2015;</text>
									</subclause><subclause id="H89B7A8AA386643BC8E11E5FB29AAA209"><enum>(III)</enum><text>has—</text>
										<item id="HA1FE2B5B3F384CEE9E0D86C4F4F69E11"><enum>(aa)</enum><text>an energy factor of not less than 1.061 minus the product obtained by multiplying—</text>
											<subitem id="HC0407AE13FAD451F99DBD2C97E584055"><enum>(AA)</enum><text>the rated storage volume of the tank, expressed in gallons; and</text>
											</subitem><subitem id="H46C790DA822B4AE899A84E290BF355BB"><enum>(BB)</enum><text>0.00168; or</text>
											</subitem></item><item id="HAF9CB1A2FB414804B494D5D9FF70AA4E"><enum>(bb)</enum><text display-inline="yes-display-inline">an equivalent alternative standard prescribed by the Secretary and developed pursuant to paragraph
			 (5)(E);</text>
										</item></subclause><subclause id="H74E82EB0D82B42398D055A43A93E670E"><enum>(IV)</enum><text>is equipped at the point of manufacture with an activation lock; and</text>
									</subclause><subclause id="H7535DBBB7E2E4D02997D500E141C7BD4"><enum>(V)</enum><text>bears a permanent label applied by the manufacturer that—</text>
										<item id="H2F8252D696614E9AB91EE789838C2D93"><enum>(aa)</enum><text>is made of material not adversely affected by water;</text>
										</item><item id="H219EEEC68CCC412A8FE8126BBD654CE8"><enum>(bb)</enum><text>is attached by means of non-water-soluble adhesive; and</text>
										</item><item id="H7DBAD6FFA51D4425BC39F1081F56BFF2"><enum>(cc)</enum><text>advises purchasers and end-users of the intended and appropriate use of the product with the
			 following notice printed in 16.5 point Arial Narrow Bold font:</text><non-statutory-material><para><quote>IMPORTANT INFORMATION: This water heater is intended only for use as part of an electric thermal
			 storage or demand response program. It will not provide adequate hot water
			 unless enrolled in such a program and activated by your utility company or
			 another program operator. Confirm the availability of a program in your
			 local area before purchasing or installing this product.</quote>. </para></non-statutory-material>
										</item></subclause></clause></subparagraph><subparagraph commented="no" id="H11887798AA2042919D2936C02EE51C02"><enum>(B)</enum><header>Requirement</header><text>The manufacturer or private labeler shall provide the activation key for a grid-enabled water
			 heater only to a utility or other company that operates an electric
			 thermal storage or demand response program that uses such a grid-enabled
			 water heater.</text>
							</subparagraph><subparagraph id="HA3EA17FE298A49D79A4DC4101013FCEB"><enum>(C)</enum><header>Reports</header>
								<clause id="HECD79789F24944B2B8AACA01266FF5C7"><enum>(i)</enum><header>Manufacturers</header><text>The Secretary shall require each manufacturer of grid-enabled water heaters to report to the
			 Secretary annually the quantity of grid-enabled water heaters that the
			 manufacturer ships each year.</text>
								</clause><clause id="HF267DBCD4B694CF1BE1B55CF56D336B4"><enum>(ii)</enum><header>Operators</header><text>The Secretary shall require utilities and other demand response and thermal storage program
			 operators to report annually the quantity of grid-enabled water heaters
			 activated for their programs using forms of the Energy Information Agency
			 or using such other mechanism that the Secretary determines appropriate
			 after an opportunity for notice and comment.</text>
								</clause><clause id="H91D51578B64B4346927A124717E88D11"><enum>(iii)</enum><header>Confidentiality requirements</header><text>The Secretary shall treat shipment data reported by manufacturers as confidential business
			 information.</text>
								</clause></subparagraph><subparagraph id="H69484A387CBF4302A5EF4B83F492DE44"><enum>(D)</enum><header>Publication of information</header>
								<clause id="H4396BCE9315C435EB016D16942237AB7"><enum>(i)</enum><header>In general</header><text>In 2017 and 2019, the Secretary shall publish an analysis of the data collected under subparagraph
			 (C) to assess the extent to which shipped products are put into use in
			 demand response and thermal storage programs.</text>
								</clause><clause id="H9B3FC969F8194ACDB5DB02FEC5531F8F"><enum>(ii)</enum><header>Prevention of product diversion</header><text>If the Secretary determines that sales of grid-enabled water heaters exceed by 15 percent or
			 greater the quantity of such products activated for use in demand response
			 and thermal storage programs annually, the Secretary shall, after
			 opportunity for notice and comment, establish procedures to prevent
			 product diversion for non-program purposes.</text>
								</clause></subparagraph><subparagraph id="H9DD7425D656D40BAB09C15C00247F481"><enum>(E)</enum><header>Compliance</header>
								<clause id="HD1E5CCC44F39438CA8AE5B844C0C0218"><enum>(i)</enum><header>In general</header><text>Subparagraphs (A) through (D) shall remain in effect until the Secretary determines under this
			 section that—</text>
									<subclause id="HBC08060B2C7D41789E78E7B10AD2D9E0"><enum>(I)</enum><text>grid-enabled water heaters do not require a separate efficiency requirement; or</text>
									</subclause><subclause commented="no" id="HE31A051AC0484E2B9F881AB20D416C9E"><enum>(II)</enum><text display-inline="yes-display-inline">sales of grid-enabled water heaters exceed by 15 percent or greater the quantity of such products
			 activated for use in demand response and thermal storage programs annually
			 and procedures to prevent product diversion for non-program purposes would
			 not be adequate to prevent such product diversion.</text>
									</subclause></clause><clause id="H19883EE727954CFFBAC25B74E27F0BAA"><enum>(ii)</enum><header>Effective date</header><text>If the Secretary exercises the authority described in clause (i) or amends the efficiency
			 requirement for grid-enabled water heaters, that action will take effect
			 on the date described in subsection (m)(4)(A)(ii).</text>
								</clause><clause id="H6F26D2560F604086A43ADF6C961C175C"><enum>(iii)</enum><header>Consideration</header><text>In carrying out this section with respect to electric water heaters, the Secretary shall consider
			 the impact on thermal storage and demand response programs, including any
			 impact on energy savings, electric bills, peak load reduction, electric
			 reliability, integration of renewable resources, and the environment.</text>
								</clause><clause id="H24C553E93D0145A7B5CD7B19C63EF97C"><enum>(iv)</enum><header>Requirements</header><text>In carrying out this paragraph, the Secretary shall require that grid-enabled water heaters be
			 equipped with communication capability to enable the grid-enabled water
			 heaters to participate in ancillary services programs if the Secretary
			 determines that the technology is available, practical, and
			 cost-effective.</text></clause></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
				</paragraph><paragraph id="H5DD6CF7DDC9B48E5B996F74A6DCEFD03"><enum>(2)</enum><text>in section 332(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/6302">42 U.S.C. 6302(a)</external-xref>)—</text>
					<subparagraph id="HA3F261284FB84E4BB8C970DE01A66D24"><enum>(A)</enum><text>in paragraph (5), by striking <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="HFFF03F8865E94572818686A5AD74454D"><enum>(B)</enum><text>in the first paragraph (6), by striking the period at the end and inserting a semicolon;</text>
					</subparagraph><subparagraph id="HCFB92039FFEC4766B2E2148DC200FA3C"><enum>(C)</enum><text>by redesignating the second paragraph (6) as paragraph (7);</text>

							<paragraph id="H1281F5700E57409EB632F6818FB23076"><enum>(8)</enum><text display-inline="yes-display-inline">for any person to—</text>
								<subparagraph id="HBDA898D66B034695B89165E4E296C0DD"><enum>(A)</enum><text>activate an activation lock for a grid-enabled water heater with knowledge that such water heater
			 is not used as part of an electric thermal storage or demand response
			 program;</text>
								</subparagraph><subparagraph id="H8CD8348946874664ADB903D9E74222D9"><enum>(B)</enum><text>distribute an activation key for a grid-enabled water heater with knowledge that such activation
			 key will be used to activate a grid-enabled water heater that is not used
			 as part of an electric thermal storage or demand response program;</text>
								</subparagraph><subparagraph id="HF41164ECA3C443E1B382A58E0877016A"><enum>(C)</enum><text>otherwise enable a grid-enabled water heater to operate at its designed specification and
			 capabilities with knowledge that such water heater is not used as part of
			 an electric thermal storage or demand response program; or</text>
								</subparagraph><subparagraph id="HCB64F1386CC547EA90F5657C79F1B7A2"><enum>(D)</enum><text>knowingly remove or render illegible the label of a grid-enabled water heater described in section
			 325(e)(6)(A)(ii)(V).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" id="HACF6A715024546EDB3287E4D6842BD70"><enum>(3)</enum><text>in section 333(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/6303">42 U.S.C. 6303(a)</external-xref>)—</text>

					</subparagraph></paragraph></section></title><title id="HD4161D6CDFB1403483AB4BFBE808BE64"><enum>III</enum><header>Energy Efficient Government Technology</header>
			<section id="H2B42FB8DCD8141DAA8351D7D7FCB3A06" section-type="subsequent-section"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Energy Efficient Government Technology Act</short-title></quote>.</text>
			</section><section id="H00A0D119E80E44B59FC2D52DD1D62C2F"><enum>302.</enum><header>Energy-efficient and energy-saving information technologies</header><text display-inline="no-display-inline">Subtitle C of title V of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/140">Public Law 110–140</external-xref>; 121 Stat. 1661) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HA4D38E2F25E7489090828A07345D855F" style="OLC">
					<section id="H4953F29C895A4F949367D4D973614335"><enum>530.</enum><header>Energy-efficient and energy-saving information technologies</header>
						<subsection id="H4FD3112A3FD643A587DDF4811572C176"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
							<paragraph id="H3DD802E0BD9E4D418A5D14148BA41D48"><enum>(1)</enum><header>Director</header><text>The term <quote>Director</quote> means the Director of the Office of Management and Budget.</text>
							</paragraph><paragraph id="H521771AC014A4F148B3E34D7624D102A"><enum>(2)</enum><header>Information technology</header><text>The term <quote>information technology</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/40/11101">section 11101</external-xref> of title 40, United States Code.</text>
							</paragraph></subsection><subsection id="H99B42047462E40E08192A45471D0EE12"><enum>(b)</enum><header>Development of implementation strategy</header><text>Not later than 1 year after the date of enactment of this section, each Federal agency shall
			 coordinate with the Director, the Secretary, and the Administrator of the
			 Environmental Protection Agency to develop an implementation strategy
			 (that includes best practices and measurement and verification techniques)
			 for the maintenance, purchase, and use by the Federal agency of
			 energy-efficient and energy-saving information technologies, taking into
			 consideration the performance goals established under subsection (d).</text>
						</subsection><subsection id="H0305D9974512410D897F04629C7C23DA"><enum>(c)</enum><header>Administration</header><text>In developing an implementation strategy under subsection (b), each Federal agency shall consider—</text>
							<paragraph id="HA378ECB0A05349C2A04734D5CEA1BEC3"><enum>(1)</enum><text>advanced metering infrastructure;</text>
							</paragraph><paragraph id="HC2D1D1DD96464A7BA28319EE303F5E24"><enum>(2)</enum><text>energy-efficient data center strategies and methods of increasing asset and infrastructure
			 utilization;</text>
							</paragraph><paragraph id="H5ED47D682FA5459BAB38F4216A4C89B7"><enum>(3)</enum><text>advanced power management tools;</text>
							</paragraph><paragraph id="H301CE982FBA64C189379686C00967B82"><enum>(4)</enum><text>building information modeling, including building energy management;</text>
							</paragraph><paragraph id="HF0031372E1974A588669BC9D6BFBFC37"><enum>(5)</enum><text>secure telework and travel substitution tools; and</text>
							</paragraph><paragraph id="H28348A8D693D4FB38FFC1E4A13382FEB"><enum>(6)</enum><text>mechanisms to ensure that the agency realizes the energy cost savings brought about through
			 increased efficiency and utilization.</text>
							</paragraph></subsection><subsection id="H95BF957A4B1944A7B75AF731E39D274F"><enum>(d)</enum><header>Performance goals</header>
							<paragraph id="HAE40C972650C48AC9FAA3AA3F880B562"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this section, the Director, in consultation
			 with the Secretary, shall establish performance goals for evaluating the
			 efforts of Federal agencies in improving the maintenance, purchase, and
			 use of energy-efficient and energy-saving information technology.</text>
							</paragraph><paragraph id="H64A050CB060F4E36BC3C82B5952C0019"><enum>(2)</enum><header>Best practices</header><text display-inline="yes-display-inline">The Chief Information Officers Council established under <external-xref legal-doc="usc" parsable-cite="usc/44/3603">section 3603</external-xref> of title 44, United States Code, shall recommend best practices for the attainment of the
			 performance goals, which shall include Federal agency consideration of the
			 use of—</text>
								<subparagraph id="H9BB32C40AE5148BC8F24A46B1CA09096"><enum>(A)</enum><text>energy savings performance contracting; and</text>
								</subparagraph><subparagraph id="HFF13E235A1C84B21ADAD3AF138F270ED"><enum>(B)</enum><text>utility energy services contracting.</text>
								</subparagraph></paragraph></subsection><subsection id="HD2D730B8D69D40229AB25EFD6220A72C"><enum>(e)</enum><header>Reports</header>
							<paragraph id="HD3FAA19DDEC04D0599C9B61C24B83CD7"><enum>(1)</enum><header>Agency reports</header><text>Each Federal agency shall include in the report of the agency under section 527 a description of
			 the efforts and results of the agency under this section.</text>
							</paragraph><paragraph id="HD88F360ADB204A73802FEB454CEAF3B5"><enum>(2)</enum><header>OMB government efficiency reports and scorecards</header><text>Effective beginning not later than October 1, 2015, the Director shall include in the annual report
			 and scorecard of the Director required under section 528 a description of
			 the efforts and results of Federal agencies under this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H53188BFAB1DE44D897426F282730DC3F"><enum>303.</enum><header>Energy efficient data centers</header><text display-inline="no-display-inline">Section 453 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17112">42 U.S.C. 17112</external-xref>) is amended—</text>
				<paragraph id="H3F4A3CB05A9242A284FC7AA8985D3C57"><enum>(1)</enum><text>by striking subsection (b)(3); and</text>
				</paragraph><paragraph id="H0F0D77E2B69F42299633FBD2BBF402E2"><enum>(2)</enum><text>by striking subsections (c) through (g) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H99D33DC1AC124C0C87378E5C7C501D12" style="OLC">
						<subsection id="HF2905DD714E64BBFAD6E51D6E76068B6"><enum>(c)</enum><header>Stakeholder involvement</header><text>The Secretary and the Administrator shall carry out subsection (b) in collaboration with
			 information technology industry and other key stakeholders, with the goal
			 of producing results that accurately reflect the best knowledge in the
			 most pertinent domains. In such collaboration, the Secretary and the
			 Administrator shall pay particular attention to organizations that—</text>
							<paragraph id="HF72B918B8CD6472EB9B113DF3B04D03A"><enum>(1)</enum><text>have members with expertise in energy efficiency and in the development, operation, and
			 functionality of data centers, information technology equipment, and
			 software, such as representatives of hardware manufacturers, data center
			 operators, and facility managers;</text>
							</paragraph><paragraph id="HDE2874474BD0443B833C0973EFA5FECE"><enum>(2)</enum><text>obtain and address input from Department of Energy National Laboratories or any college,
			 university, research institution, industry association, company, or public
			 interest group with applicable expertise;</text>
							</paragraph><paragraph id="HAEE7634BC75F49D09CDB788A6B1EAF82"><enum>(3)</enum><text>follow—</text>
								<subparagraph id="H1B3CB297F56E4AA38DAECD77C986DF13"><enum>(A)</enum><text>commonly accepted procedures for the development of specifications; and</text>
								</subparagraph><subparagraph id="HC560DE0A04A64CD88EEFE1D1BA7C2200"><enum>(B)</enum><text>accredited standards development processes; and</text>
								</subparagraph></paragraph><paragraph id="H28E78AF66B4D4872AD4C85F01E8EBAD0"><enum>(4)</enum><text>have a mission to promote energy efficiency for data centers and information technology.</text>
							</paragraph></subsection><subsection id="H3CB36D31A1464233B902DA2EEE8DD705"><enum>(d)</enum><header>Measurements and Specifications</header><text display-inline="yes-display-inline">The Secretary and the Administrator shall consider and assess the adequacy of the specifications,
			 measurements, and benchmarks described in subsection (b) for use by the
			 Federal Energy Management Program, the Energy Star Program, and other
			 efficiency programs of the Department of Energy or the Environmental
			 Protection Agency.</text>
						</subsection><subsection id="HE30789837BFF4EF58182E307505323A7"><enum>(e)</enum><header>Study</header><text>The Secretary, in collaboration with the Administrator, shall, not later than 18 months after the
			 date of enactment of the Energy Efficient Government Technology Act, make
			 available to the public an update to the Report to Congress on Server and
			 Data Center Energy Efficiency published on August 2, 2007, under section 1
			 of <external-xref legal-doc="public-law" parsable-cite="pl/109/431">Public Law 109–431</external-xref> (120 Stat. 2920), that provides—</text>
							<paragraph id="H76E88C90CDB84856848DE5AD47F63D55"><enum>(1)</enum><text>a comparison and gap analysis of the estimates and projections contained in the original report
			 with new data regarding the period from 2007 through 2014;</text>
							</paragraph><paragraph id="HAC81E48C790B439DA8D14C19DEE9DD64"><enum>(2)</enum><text display-inline="yes-display-inline">an analysis considering the impact of information technologies, to include virtualization and cloud
			 computing, in the public and private sectors;</text>
							</paragraph><paragraph id="H4C90DB1CC01A4C96B482B9224CF41B59"><enum>(3)</enum><text display-inline="yes-display-inline">an evaluation of the impact of the combination of cloud platforms, mobile devices, social media,
			 and big data on data center energy usage; and</text>
							</paragraph><paragraph id="H8B7C3629D05047E1BA970FECF20C1232"><enum>(4)</enum><text>updated projections and recommendations for best practices through fiscal year 2020.</text>
							</paragraph></subsection><subsection id="H0048AE43EC7744548B458D3A05C9FAC6"><enum>(f)</enum><header>Data center energy practitioner program</header><text>The Secretary, in collaboration with key stakeholders and the Director of the Office of Management
			 and Budget, shall maintain a data center energy practitioner program that
			 leads to the certification of energy practitioners qualified to evaluate
			 the energy usage and efficiency opportunities in Federal data centers.
			 Each Federal agency shall consider having the data centers of the agency
			 evaluated every 4 years by energy practitioners certified pursuant to such
			 program, whenever practicable using certified practitioners employed by
			 the agency.</text>
						</subsection><subsection id="HF1E69F544FBC4E9DBC7E91E380748DA8"><enum>(g)</enum><header>Open data initiative</header><text>The Secretary, in collaboration with key stakeholders and the Office of Management and Budget,
			 shall establish an open data initiative for Federal data center energy
			 usage data, with the purpose of making such data available and accessible
			 in a manner that encourages further data center innovation, optimization,
			 and consolidation. In establishing the initiative, the Secretary shall
			 consider the use of the online Data Center Maturity Model.</text>
						</subsection><subsection id="H38D47E953C6941B39488750C0D27AE26"><enum>(h)</enum><header>International specifications and metrics</header><text>The Secretary, in collaboration with key stakeholders, shall actively participate in efforts to
			 harmonize global specifications and metrics for data center energy
			 efficiency.</text>
						</subsection><subsection id="H28D3E8171C1E4C969214B1BC84DD7EC4"><enum>(i)</enum><header>Data center utilization metric</header><text>The Secretary, in collaboration with key stakeholders, shall facilitate in the development of an
			 efficiency metric that measures the energy efficiency of a data center
			 (including equipment and facilities).</text>
						</subsection><subsection id="HC6465738C8194B7C95F4E0ED9069A512"><enum>(j)</enum><header>Protection of proprietary information</header><text>The Secretary and the Administrator shall not disclose any proprietary information or trade secrets
			 provided by any individual or company for the purposes of carrying out
			 this section or the programs and initiatives established under this
			 section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="HECCDEFBD89EF452AB20C3FE1C41D489D"><enum>IV</enum><header>Energy information for commercial buildings</header>
			<section id="H8755DD42A728445FAD6CD0CB7A696D58"><enum>401.</enum><header>Energy information for commercial buildings</header>
				<subsection id="HC04AAE9203CE406CB2308C2695514723"><enum>(a)</enum><header>Requirement of benchmarking and disclosure for leasing buildings without energy star labels</header><text>Section 435(b)(2) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17091">42 U.S.C. 17091(b)(2)</external-xref>) is amended—</text>
					<paragraph id="HC4F5AB519C8A4F9EB14FEE3055088448"><enum>(1)</enum><text>by striking <quote>paragraph (2)</quote> and inserting <quote>paragraph (1)</quote>; and</text>
					</paragraph><paragraph id="H78DC2162890644BC9DB74127DF06A178"><enum>(2)</enum><text>by striking <quote>signing the contract,</quote> and all that follows through the period at the end and inserting the following:</text>
						<quoted-block id="H95741306B46D4746AE9AEE0F9A67362C" style="OLC"><text display-inline="no-display-inline">signing the contract, the following requirements are met:</text>
							<subparagraph id="HCBE63A3D52B24E70B06675318B93C190"><enum>(A)</enum><text>The space is renovated for all energy efficiency and conservation improvements that would be cost
			 effective over the life of the lease, including improvements in lighting,
			 windows, and heating, ventilation, and air conditioning systems.</text>
							</subparagraph><subparagraph id="H0E626C83657644EEAAE40134F33BF6E5"><enum>(B)</enum>
								<clause commented="no" display-inline="yes-display-inline" id="HADB2474E5C804D2EAB6C40BFADC8C185"><enum>(i)</enum><text>Subject to clause (ii), the space is benchmarked under a nationally recognized, online, free
			 benchmarking program, with public disclosure, unless the space is a space
			 for which owners cannot access whole building utility consumption data,
			 including spaces—</text>
									<subclause id="H74EB820AB9704926982788511A78BD5D" indent="up1"><enum>(I)</enum><text>that are located in States with privacy laws that provide that utilities shall not provide such
			 aggregated information to multitenant building owners; and</text>
									</subclause><subclause id="HEFE21EB9C892470391656DD0B9434000" indent="up1"><enum>(II)</enum><text>for which tenants do not provide energy consumption information to the commercial building owner in
			 response to a request from the building owner.</text>
									</subclause></clause><clause id="H9B6735211F384FC9839A54CF235050A0" indent="up1"><enum>(ii)</enum><text>A Federal agency that is a tenant of the space shall provide to the building owner, or authorize
			 the owner to obtain from the utility, the energy consumption information
			 of the space for the benchmarking and disclosure required by this
			 subparagraph.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H06B75791295344278F3A335AA60C4937"><enum>(b)</enum><header>Study</header>
					<paragraph id="HBF380BEACF4C4445A00F5E0123DC8D15"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary of Energy, in
			 collaboration with the Administrator of the Environmental Protection
			 Agency, shall complete a study—</text>
						<subparagraph id="H3EB6ED2F61DA420F82CD03B71E85DCB3"><enum>(A)</enum><text>on the impact of—</text>
							<clause id="H685370A9AA78416092C3652E52B8ED10"><enum>(i)</enum><text>State and local performance benchmarking and disclosure policies, and any associated building
			 efficiency policies, for commercial and multifamily buildings; and</text>
							</clause><clause id="H091C79A9DB254E6785D73FD73776A0EA"><enum>(ii)</enum><text>programs and systems in which utilities provide aggregated information regarding whole building
			 energy consumption and usage information to owners of multitenant
			 commercial, residential, and mixed-use buildings;</text>
							</clause></subparagraph><subparagraph id="HB759909CD32E4057BED0BF58634DC1A7"><enum>(B)</enum><text>that identifies best practice policy approaches studied under subparagraph (A) that have resulted
			 in the greatest improvements in building energy efficiency; and</text>
						</subparagraph><subparagraph id="H7750C1656AF943CA92A3201BCA6DD2C0"><enum>(C)</enum><text>that considers—</text>
							<clause id="HCF0F832A32084EAFB729842420133875"><enum>(i)</enum><text>compliance rates and the benefits and costs of the policies and programs on building owners,
			 utilities, tenants, and other parties;</text>
							</clause><clause id="HA2369030D74147CDBB21FC75CF568B87"><enum>(ii)</enum><text>utility practices, programs, and systems that provide aggregated energy consumption information to
			 multitenant building owners, and the impact of public utility commissions
			 and State privacy laws on those practices, programs, and systems;</text>
							</clause><clause id="H201FE559BF1740A7983820EA78754FA6"><enum>(iii)</enum><text>exceptions to compliance in existing laws where building owners are not able to gather or access
			 whole building energy information from tenants or utilities;</text>
							</clause><clause id="HA6E0A1ADFC2A4F459B77423DCD4CEDFF"><enum>(iv)</enum><text>the treatment of buildings with—</text>
								<subclause id="H69A05D74EC1A4C8A8510B80CC29E5D94"><enum>(I)</enum><text>multiple uses;</text>
								</subclause><subclause id="HDF0433C3DD994E6C97747CF367B5259C"><enum>(II)</enum><text>uses for which baseline information is not available; and</text>
								</subclause><subclause id="HF2EFC4C68B5A4D8CB7A503A8482C0824"><enum>(III)</enum><text>uses that require high levels of energy intensities, such as data centers, trading floors, and
			 televisions studios;</text>
								</subclause></clause><clause id="H5A2B477D38FB4813A5C1A1130177C9C1"><enum>(v)</enum><text>implementation practices, including disclosure methods and phase-in of compliance;</text>
							</clause><clause id="H4EAD099AC06E4C028478693995D4CEEA"><enum>(vi)</enum><text>the safety and security of benchmarking tools offered by government agencies, and the resiliency of
			 those tools against cyber-attacks; and</text>
							</clause><clause id="HDEFCAC9CC2324AE9933196ECA1AEF8E7"><enum>(vii)</enum><text>international experiences with regard to building benchmarking and disclosure laws and data
			 aggregation for multitenant buildings.</text>
							</clause></subparagraph></paragraph><paragraph id="HB20DF9249A174E62A34BE39FE41B61F0"><enum>(2)</enum><header>Submission to Congress</header><text>At the conclusion of the study, the Secretary shall submit to the Committee on Energy and Commerce
			 of the House of Representatives and Committee on Energy and Natural
			 Resources of the Senate a report on the results of the study.</text>
					</paragraph></subsection><subsection id="H84919BBC4AC848EDB9EAE90B35D01699"><enum>(c)</enum><header>Creation and maintenance of database</header>
					<paragraph id="H3EDD1B11E34D490383351182FB64AE51"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this Act and following opportunity for
			 public notice and comment, the Secretary of Energy, in coordination with
			 other relevant agencies, shall maintain, and if necessary create, a
			 database for the purpose of storing and making available public
			 energy-related information on commercial and multifamily buildings,
			 including—</text>
						<subparagraph id="H0F209D4B285B4FAF90344C803AAE0A68"><enum>(A)</enum><text>data provided under Federal, State, local, and other laws or programs regarding building
			 benchmarking and energy information disclosure;</text>
						</subparagraph><subparagraph id="HA92AF9478D1A40FB981CBDC782617753"><enum>(B)</enum><text>information on buildings that have disclosed energy ratings and certifications; and</text>
						</subparagraph><subparagraph id="HC977981DD48948DF82ABFAB93CC29A3C"><enum>(C)</enum><text>energy-related information on buildings provided voluntarily by the owners of the buildings, only
			 in an anonymous form unless the owner provides otherwise.</text>
						</subparagraph></paragraph><paragraph id="HF015EF1C97F24D04BB4CE461085B71C5"><enum>(2)</enum><header>Complementary programs</header><text>The database maintained pursuant to paragraph (1) shall complement and not duplicate the functions
			 of the Environmental Protection Agency’s Energy Star Portfolio Manager
			 tool.</text>
					</paragraph></subsection><subsection id="HCBA9DAED0F474FB8AC5A25FD6FE68ECA"><enum>(d)</enum><header>Input from stakeholders</header><text>The Secretary of Energy shall seek input from stakeholders to maximize the effectiveness of the
			 actions taken under this section.</text>
				</subsection><subsection id="HBF769B7A2CC64CCBBA01A5D58F514F7A"><enum>(e)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, and every 2 years thereafter, the
			 Secretary of Energy shall submit to the Committee on Energy and Commerce
			 of the House of Representatives and Committee on Energy and Natural
			 Resources of the Senate a report on the progress made in complying with
			 this section.</text>
