<legis-type>AN ACT</legis-type> 
<official-title display="yes">To eliminate taxpayer financing of political party conventions and reprogram savings to provide for a 10-year pediatric research initiative through the Common Fund administered by the National Institutes of Health, and for other purposes.</official-title>

<section id="H8C70D09C3B434CD98B2924395D71EFF7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Gabriella Miller Kids First Research Act</short-title></quote>.</text></section> 
<section id="HA35BEE143AD44B0EAD66864B9C062E88" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Termination of taxpayer financing of political party conventions; use of funds for pediatric research initiative</header> 
<subsection id="H31C66691E5B34E4EAC0C130673A36FA0"><enum>(a)</enum><header>Termination of Payments for Conventions; Use of Funds for Pediatric Research</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/9008">Section 9008</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="HCEBBFAC89F754E239FECB1645737E595" display-inline="no-display-inline"> 
<subsection id="H07D1ED92C9F8413F98F7D2AC2CF0C457"><enum>(i)</enum><header>Termination of Payments for Conventions; Use of Amounts for Pediatric Research Initiative</header><text display-inline="yes-display-inline">Effective on the date of the enactment of the <short-title>Gabriella Miller Kids First Research Act</short-title>—</text> 
<paragraph id="H080A869BD25C4709BE5E5959642B68B6"><enum>(1)</enum><text>the entitlement of any major party or minor party to a payment under this section shall terminate; and</text></paragraph> 
<paragraph id="H9AA8502E54054A0C82A23BF7A4FE8021"><enum>(2)</enum><text display-inline="yes-display-inline">all amounts in each account maintained for the national committee of a major party or minor party under this section shall be transferred to a fund in the Treasury to be known as the <quote>10-Year Pediatric Research Initiative Fund</quote>, which shall be available only for the purpose provided in section 402A(a)(2) of the Public Health Service Act, and only to the extent and in such amounts as are provided in advance in appropriation Acts.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC83AA899B8594AE8935F95C92F25D332"><enum>(b)</enum><header>Continuation of Priority of Payments From Accounts Over Payments to Candidates</header> 
<paragraph id="HCF6D396FFA3140E38BBB1F5FF1048EF7"><enum>(1)</enum><header>Availability of payments to candidates</header><text>The third sentence of section 9006(c) of such Code is amended by striking <quote>section 9008(b)(3),</quote> and inserting <quote>section 9008(i)(2),</quote>.</text></paragraph> 
<paragraph id="H3EB8DF083341475781D8AF24F574811D"><enum>(2)</enum><header>Availability of payments from presidential primary matching payment account</header><text display-inline="yes-display-inline">The second sentence of section 9037(a) of such Code is amended by striking <quote>section 9008(b)(3)</quote> and inserting <quote>section 9008(i)(2)</quote>.</text></paragraph></subsection> 
<subsection id="H293887711E324B0DA3A87463E41C4A41" display-inline="no-display-inline"><enum>(c)</enum><header>Conforming amendments</header> 
<paragraph id="HC08305AF44204C0AA51FAB7347BDD68E"><enum>(1)</enum><header>Elimination of reports by Federal election commission</header><text>Section 9009(a) of such Code is amended—</text> 
<subparagraph id="HFFB809D8CD56413EB7C8C839AB6AB743"><enum>(A)</enum><text>by adding <quote>and</quote> at the end of paragraph (2);</text></subparagraph> 
<subparagraph id="H46402221E04D4BD5A79DAF5AD0FFC1FF"><enum>(B)</enum><text>by striking the semicolon at the end of paragraph (3) and inserting a period; and</text></subparagraph> 
<subparagraph id="HEC637CD19548469D8B8BA48B38FAA495"><enum>(C)</enum><text>by striking paragraphs (4), (5), and (6).</text></subparagraph></paragraph> 
<paragraph id="H2AC4CAFD9E8F45DCBB0F84A3F582A341"><enum>(2)</enum><header>Elimination of penalties</header><text>Section 9012 of such Code is amended—</text> 
<subparagraph id="HD985356E54EB41BE8CD5FE9031F11F5B"><enum>(A)</enum><text>in subsection (a)(1), by striking the second sentence;</text></subparagraph> 
<subparagraph id="H87DAE71FEF9E4533B86A587187783B66"><enum>(B)</enum><text>in subsection (c), by striking paragraph (2) and redesignating paragraph (3) as paragraph (2);</text></subparagraph> 
<subparagraph id="H42F2013D78E74DE69F31CC440B965232"><enum>(C)</enum><text>in subsection (e)(1), by striking the second sentence; and</text></subparagraph> 
<subparagraph id="H3F42DAB1D1604C4F83F2F66CABB868E1"><enum>(D)</enum><text display-inline="yes-display-inline">in subsection (e)(3), by striking <quote>, or in connection with any expense incurred by the national committee of a major party or minor party with respect to a presidential nominating convention</quote>.</text></subparagraph></paragraph> </subsection> </section> 
<section id="HAD25B1F01BE74B6C93D3BC3AF1EAAB72"><enum>3.</enum><header>10–Year Pediatric Research Initiative</header> 
<subsection commented="no" id="H7620A758AAA04C8D90635D0B8C91D759"><enum>(a)</enum><header>Allocation of NIH funds in Common Fund for pediatric research</header><text>Paragraph (7) of section 402(b) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/282">42 U.S.C. 282(b)</external-xref>) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="HD1CE68DA70CE43DEB0275B0FCB3685D6" style="OLC"> 
<paragraph commented="no" id="H4E99971D4DCD4FD78C9D8D59DFD1EACF"><enum>(7)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H0CDA6CB3CF4D40C1A7C89E8AD56A825E"><enum>(A)</enum><text>shall, through the Division of Program Coordination, Planning, and Strategic Initiatives—</text> 
<clause commented="no" id="HB32D64B01699400EBBA483A696146E79" indent="up1"><enum>(i)</enum><text>identify research that represents important areas of emerging scientific opportunities, rising public health challenges, or knowledge gaps that deserve special emphasis and would benefit from conducting or supporting additional research that involves collaboration between 2 or more national research institutes or national centers, or would otherwise benefit from strategic coordination and planning;</text></clause> 
<clause commented="no" id="HD548EEA1116447788B92B462C08E2311" indent="up1"><enum>(ii)</enum><text>include information on such research in reports under section 403; and</text></clause> 
<clause commented="no" id="H2D4228491D7F47A0879F14CF2A161CB5" indent="up1"><enum>(iii)</enum><text>in the case of such research supported with funds referred to in subparagraph (B)—</text> 
<subclause commented="no" id="H3B855FE1BC794BA499FD92B9592B0CA2"><enum>(I)</enum><text>require as appropriate that proposals include milestones and goals for the research;</text></subclause> 
<subclause commented="no" id="H75451E49A533405F8DC445D378CF4626"><enum>(II)</enum><text>require that the proposals include timeframes for funding of the research; and</text></subclause> 
<subclause commented="no" id="H231B13D3C4944B9A9E5D025CB98D654C"><enum>(III)</enum><text>ensure appropriate consideration of proposals for which the principal investigator is an individual who has not previously served as the principal investigator of research conducted or supported by the National Institutes of Health;</text></subclause></clause></subparagraph> 
<subparagraph commented="no" id="H0BC2A83D70E144E3BD67768BF9027F1B" indent="up1"><enum>(B)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="H4BC87D1B20564B31A4722A9C767AE62B"><enum>(i)</enum><text>may, with respect to funds reserved under section 402A(c)(1) for the Common Fund, allocate such funds to the national research institutes and national centers for conducting and supporting research that is identified under subparagraph (A); and</text></clause> 
<clause commented="no" id="H99F1809904C4495A99AFAF1EBAA7790B" indent="up1"><enum>(ii)</enum><text>shall, with respect to funds appropriated to the Common Fund pursuant to section 402A(a)(2), allocate such funds to the national research institutes and national centers for making grants for pediatric research that is identified under subparagraph (A); and</text></clause></subparagraph> 
<subparagraph commented="no" id="H9C5C073C596040DC8504EC57465E43A4" indent="up1"><enum>(C)</enum><text>may assign additional functions to the Division in support of responsibilities identified in subparagraph (A), as determined appropriate by the Director;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H1F3221C49F82483FB93048B381BDC83E"><enum>(b)</enum><header>Funding for 10-Year pediatric research initiative</header><text display-inline="yes-display-inline">Section 402A of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/282a">42 U.S.C. 282a</external-xref>) is amended—</text> 
<paragraph commented="no" id="H252BD934312F43CBA63E7413D886855C"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph commented="no" id="H2F1830F0775D4BED9902DABCD3FC7318"><enum>(A)</enum><text>by redesignating paragraphs (1) through (3) as subparagraphs (A) through (C), respectively, and moving the indentation of each such subparagraph 2 ems to the right;</text></subparagraph> 
<subparagraph commented="no" id="HEDFACD45204147D3ACA298FB6C5DD262"><enum>(B)</enum><text>by striking <quote>For purposes of carrying out this title</quote> and inserting the following:</text>

<paragraph commented="no" id="HD0708F0B44D54F4CB405A365F80AE010"><enum>(1)</enum><header>This title</header><text display-inline="yes-display-inline">For purposes of carrying out this title</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph commented="no" id="HDCD2BFA1713B4537822DCDF59C8CF3B0"><enum>(C)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HCB044B6266A148F5872118441C3D6768" style="OLC"> 
<paragraph commented="no" id="H074CA1157B7C443EBB8BBE8A2331A814"><enum>(2)</enum><header>Funding for 10-year pediatric research initiative through common fund</header><text display-inline="yes-display-inline">For the purpose of carrying out section 402(b)(7)(B)(ii), there is authorized to be appropriated to the Common Fund, out of the 10-Year Pediatric Research Initiative Fund described in <external-xref legal-doc="usc" parsable-cite="usc/26/9008">section 9008</external-xref> of the Internal Revenue Code of 1986, and in addition to amounts otherwise made available under paragraph (1) of this subsection and reserved under subsection (c)(1)(B)(i) of this section, $12,600,000 for each of fiscal years 2014 through 2023.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph commented="no" id="H1B10D10A9E8E4E58BC4D0B8AEDBBF5E9"><enum>(2)</enum><text>in subsections (c)(1)(B), (c)(1)(D), and (d), by striking <quote>subsection (a)</quote> each place it appears and inserting <quote>subsection (a)(1)</quote>.</text></paragraph></subsection> 
<subsection commented="no" id="H68E587E8CA0048DD81D0367BE3633AC6"><enum>(c)</enum><header>Supplement, not supplant; prohibition against transfer</header><text>Funds appropriated pursuant to section 402A(a)(2) of the Public Health Service Act, as added by subsection (b)—</text> 
<paragraph commented="no" id="H1902BB01EE4D4EA28B7D7D4898895DA0"><enum>(1)</enum><text>shall be used to supplement, not supplant, the funds otherwise allocated by the National Institutes of Health for pediatric research; and</text></paragraph> 
<paragraph commented="no" id="HDFA9BE931C784157A4A230BA9BE21B91"><enum>(2)</enum><text>notwithstanding any transfer authority in any appropriation Act, shall not be used for any purpose other than allocating funds for making grants as described in section 402(b)(7)(B)(ii) of the Public Health Service Act, as added by subsection (a).</text></paragraph></subsection></section>
