<official-title display="yes">To designate certain Federal land in the San Juan National Forest in the State of Colorado as wilderness, and for other purposes.<pagebreak/></official-title>

<section id="H64E8F67F089B4095BECD546F68C86AE6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hermosa Creek Watershed Protection Act of 2014</short-title></quote>.</text></section>
<section id="HFE35056D7F5B486AA73FB6137B8E052F"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
<paragraph id="H151AB8FE25A042E0A631E548C156CA01"><enum>(1)</enum><text>to maintain the cultural, economic, and ecological health of the Hermosa Creek Watershed and the surrounding communities that rely on the Watershed;</text></paragraph>
<paragraph id="HABAF5B31E3BA4B2EAED0A1770045FFEC"><enum>(2)</enum><text>to protect the purity of water that comes from the Hermosa Creek Watershed and supplies residents of the Animas River Valley and the city of Durango, Colorado, with clean drinking water;</text></paragraph>
<paragraph id="HF11E1DCB3AE6473E943BADC90F7837B3"><enum>(3)</enum><text>to protect the purity of, and water supply from, the Hermosa Creek Watershed for agricultural purposes, including irrigation and stockwater uses;</text></paragraph>
<paragraph id="H762651FF938B4DEFA1CA3915CD350B9D"><enum>(4)</enum><text>to enhance the economic prosperity of local communities in the area who depend on the area for water, recreation, and sustainable natural resource uses;</text></paragraph>
<paragraph id="H20DC4C26C32A4F488415B5D0D2899E49"><enum>(5)</enum><text>to protect and provide residents and visitors the opportunity to enjoy the recreational, geological, cultural, natural, scientific, wildlife, riparian, historical, educational, and scenic resources of the Watershed;</text></paragraph>
<paragraph id="H9C1EFF9F11984BF5AB8773742555C75E"><enum>(6)</enum><text>to provide world-class opportunities for skiing, biking, hiking, fishing, hunting, horseback riding, snowmobiling, motorcycle riding, snowshoeing, and camping;</text></paragraph>
<paragraph id="H1B05A0500EE140D181C7BEA64C8C636C"><enum>(7)</enum><text>to provide for economic and natural resource development (including sustainable grazing, vegetation management, beneficial uses of water, and mineral extraction) in a manner consistent with protecting the overall integrity of the Watershed;</text></paragraph>
<paragraph id="H940D60BCB0C2458AB8942E6800AB0C44"><enum>(8)</enum><text>to protect a viable population of the native Colorado River cutthroat trout fishery located in the Watershed; </text></paragraph>
<paragraph id="HEA61105CC21047598172076CE0685C12"><enum>(9)</enum><text>to designate the Hermosa Creek Wilderness Area and the Hermosa Creek Special Management Area; and</text></paragraph>
<paragraph id="H526F90EB9FB648259D9C4F560AAC9906"><enum>(10)</enum><text>to conserve, protect, and manage a healthy Hermosa Creek Watershed for the long-term ecological integrity of the Watershed and the long-term economic health of surrounding communities by allowing sustainable economic development and traditional natural resource development in a manner consistent with the purposes described in paragraphs (1) through (8).</text></paragraph></section>
<section id="H7F9A935E215D4F9B996CCA72EF2721D2"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="HF6CA4911933F45E6AEDAE241D99EBA65"><enum>(1)</enum><header>City</header><text>The term <quote>City</quote> means Durango, Colorado.</text></paragraph>
<paragraph id="H3ED5122EA1F344D79386DD5182357D80"><enum>(2)</enum><header>County</header><text>The term <quote>County</quote> means La Plata County, Colorado.</text></paragraph>
<paragraph id="HE3D28EFF20BE4EDDAE98CA48B03FC78C"><enum>(3)</enum><header>Map</header><text>The term <quote>Map</quote> means the map entitled <quote>Hermosa Creek Proposed Watershed Protection Area</quote> and dated June 2, 2014.</text></paragraph>
<paragraph id="HE656B415214042A6A4EF23F45DD5D5BA"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture.</text></paragraph>
<paragraph id="HADAF5A88C2A94B068F4DF18C863B5504"><enum>(5)</enum><header>Special management area</header><text>The term <quote>Special Management Area</quote> means the Hermosa Creek Special Management Area designated by section 5(a).</text></paragraph>
<paragraph id="H51C7E4E4A1FB40248C7FF0D7577D33C2"><enum>(6)</enum><header>State</header><text>The term <quote>State</quote> means the State of Colorado.</text></paragraph></section>
<section id="H4032B57F7FEB435A9DEA7B711989300B"><enum>4.</enum><header>Hermosa Creek Watershed Protection Area</header><text display-inline="no-display-inline">Certain Federal land in the San Juan National Forest comprising approximately 107,866 acres, as generally depicted on the Map may be called the <quote>Hermosa Creek Watershed Protection Area</quote>.</text></section>
<section id="H84C5A918510D43838CCE171320A76B7A"><enum>5.</enum><header>Designation of Hermosa Creek Special Management Area</header>
<subsection id="H9E21688A27AD4F99AB240433C742B006"><enum>(a)</enum><header>Designation</header><text>Subject to valid existing rights, certain Federal land in the San Juan National Forest comprising approximately 68,289 acres, as generally depicted on the Map, is designated as the <quote>Hermosa Creek Special Management Area</quote>.</text></subsection>
<subsection id="H81F5011100C943A387065B2C7A743900"><enum>(b)</enum><header>Administration</header>
<paragraph id="H8612452774D04A1DBFCC094E8B3765CF"><enum>(1)</enum><header>In general</header><text>The Secretary shall administer the Special Management Area in accordance with—</text>
<subparagraph id="H58C4AE79E9494411BF760EA55C3145C2"><enum>(A)</enum><text>the National Forest Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600 et seq.</external-xref>);</text></subparagraph>
<subparagraph id="HC18D54BF5D5145DE89A81291244C86BF"><enum>(B)</enum><text>this Act; and</text></subparagraph>
<subparagraph id="H69C88D1FAA3D4741815F3DDA7E0D9EDD"><enum>(C)</enum><text>any other applicable laws.</text> </subparagraph></paragraph>
<paragraph id="HE9B897DF6DA04E48AC008A0AA957473F"><enum>(2)</enum><header>Uses</header>
<subparagraph id="HAD09BAC402BA480FBECD7D394060769E"><enum>(A)</enum><header>In general</header><text>The Secretary shall allow such uses of the Special Management Area that the Secretary determines would further the purposes described in section 2.</text></subparagraph>
<subparagraph id="HB8892337B3754BEFBA08E7BB509F4FF6"><enum>(B)</enum><header>Motorized and mechanized vehicles</header>
<clause id="H2C4A832F145F43E8A83FDE7AA9E27C2D"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii) and as needed for administrative purposes or to respond to an emergency, the use of motorized and mechanized vehicles in the Special Management Area shall be permitted only on roads and trails designated for use by such vehicles as identified on the Map as <quote>Trails Open to Motorized Uses</quote> and <quote>Trails Open to Mechanized Uses</quote>.</text></clause>
<clause id="H7F6F936F399446EF841426D12CFB5812"><enum>(ii)</enum><header>Over-snow vehicles</header><text>The Secretary shall authorize the use of snowmobiles and other over-snow vehicles within the Special Management Area—</text>
<subclause id="H50841C074AB540F1A46038F54B9E93F0"><enum>(I)</enum><text>when there is adequate snow coverage; and</text></subclause>
<subclause id="HBD6012D881A0453CB197297547D53AE7"><enum>(II)</enum><text>subject to such terms and conditions as the Secretary may require.</text></subclause></clause>
<clause id="H7939FC8F0EAD4D44815776641110388E"><enum>(iii)</enum><header>Continued Access</header><text display-inline="yes-display-inline">Within the Special Management Area, at a minimum, the Secretary shall maintain access for motorized and mechanized recreation opportunities as identified as <quote>Trails Open to Motorized Uses</quote> and <quote>Trails Open to Mechanized Uses</quote> on the Map.</text></clause></subparagraph>
<subparagraph id="HEDE1EE6AB840473D80A652B84CCECAC0"><enum>(C)</enum><header>Grazing</header><text>Grazing and other traditional economic activities are compatible with the Special Management Area designation and the Secretary shall permit grazing within the Special Management Area, where established before the date of enactment of this Act subject to all applicable laws (including regulations) and Executive orders.</text></subparagraph>
<subparagraph id="H23C509B867984792893ED674267494BF"><enum>(D)</enum><header>Prohibited activities</header><text>Within the area of the Special Management Area identified on the Map as <quote>East Hermosa Area</quote> the following activities shall be prohibited:</text>
<clause id="H511D112C9D614199A80FB5FBCA6D94C1"><enum>(i)</enum><text>New permanent or temporary road construction or the renovation of existing nonsystem roads, except as allowed under the final rule entitled <quote>Special Areas; Roadless Area Conservation; Applicability to the National Forests in Colorado</quote> (77 Fed. Reg. 39576 (July 3, 2012)).</text></clause>
<clause id="HAB846200A94F4CB99BE5F3DBD07C5E21"><enum>(ii)</enum><text>Projects undertaken for the purpose of harvesting commercial timber (other than activities relating to the harvest of merchantable products that are byproducts of activities conducted for ecological restoration or to further the purposes described in this Act).</text></clause></subparagraph></paragraph></subsection>
<subsection id="H1D413D5FF6204A21AAB86F9F28696BC3"><enum>(c)</enum><header>Map and legal description</header>
<paragraph id="HA107E0447F18448FB03BEC1A10D4C859"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall prepare a map and a legal description of the Special Management Area.</text></paragraph>
<paragraph id="H316AB2818B894686A199AFB6246D408D"><enum>(2)</enum><header>Force of law</header><text>The map and legal description prepared under paragraph (1) shall have the same force and effect as if included in this Act, except that the Secretary may correct clerical and typographical errors in the map and legal description.</text></paragraph>
<paragraph id="H8301DD5D53BE40D5AF01A66A5D1B9042"><enum>(3)</enum><header>Public availability</header><text>The map and legal description prepared under paragraph (1) shall be on file and available for public inspection in the appropriate offices of the Forest Service.</text></paragraph></subsection>
<subsection id="HD378DCA103374314B2040B330318168C"><enum>(d)</enum><header>Incorporation of acquired land and interests in land</header><text>Any land or interest in land that is acquired by the United States within the boundary of the Special Management Area shall—</text>
<paragraph id="HA04DAB790C8842578835B944FD7BF26E"><enum>(1)</enum><text>only occur through donation or exchange with the written consent of the property owner;</text></paragraph>
<paragraph id="H41B6FF8AB2FA450EBAE650134EEE32CB"><enum>(2)</enum><text>become part of the Special Management Area;</text></paragraph>
<paragraph id="H57D5839FB85647F69C06FCED0374077C"><enum>(3)</enum><text>be withdrawn in accordance with subsection (g); and</text></paragraph>
<paragraph id="HC9AF7E609BC84447B0318A55B7575DE9"><enum>(4)</enum><text>be managed in accordance with—</text>
<subparagraph id="H778855DBD32B45C59269B882BDF1BC48"><enum>(A)</enum><text>this Act; and</text></subparagraph>
<subparagraph id="H01427CAD458C4041AF7EB12CDA9AC685"><enum>(B)</enum><text>any other applicable laws.</text></subparagraph></paragraph></subsection>
<subsection id="H7A8BB0C2F3584A34A36A891D669F802A"><enum>(e)</enum><header>Fish and wildlife</header><text>Nothing in this Act affects the jurisdiction or responsibility of the State with respect to fish and wildlife in the State.</text></subsection>
<subsection id="H3279FD410A7A40B5BF450D3E151DE04A"><enum>(f)</enum><header>State and Federal water management</header><text display-inline="yes-display-inline">Nothing in this section shall affect the development, operation, or maintenance of a water storage reservoir, including necessary ancillary roads and transmission infrastructure, at the site in the Special Management Area that is identified in—</text>
<paragraph id="H6FE3EA99B4BE4D188F3775978472BC2B"><enum>(1)</enum><text>pages 17 through 20 of the Statewide Water Supply Initiative studies prepared by the Colorado Water Conservation Board and issued by the State in November 2004; and</text></paragraph>
<paragraph id="H471D3990575E4DEEB2EA58493B219670"><enum>(2)</enum><text>page 27 of the Colorado Dam Site Inventory prepared by the Colorado Water Conservation Board and dated August 1996.</text></paragraph></subsection>
<subsection id="HDE147EF1EF0B44F9AFAEDCD3656CB91F"><enum>(g)</enum><header>Withdrawal</header><text>Subject to valid rights in existence on the date of enactment of this Act, the Federal land within the Special Management Area is withdrawn from—</text>
<paragraph id="H6E837016D3F245F6B2C303104E7A7D78"><enum>(1)</enum><text>all forms of entry, appropriation, and disposal under the public land laws;</text></paragraph>
<paragraph id="H38859E06DE3D4D60A14A9CE58FBCD06D"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph>
<paragraph id="HC38610499B9B4AC2A172B145E7D60386"><enum>(3)</enum><text>operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text></paragraph></subsection>
<subsection id="HA3FBE18404E7402FAA7AEB4D62E46ECA"><enum>(h)</enum><header>Adjacent management</header>
<paragraph id="HCC9C2E19277C468CAFD38E25FDC26C76"><enum>(1)</enum><header>In general</header><text>The Special Management Area designated by subsection (a) or the wilderness designated by the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>; 107 Stat. 756, 114 Stat. 1955, 116 Stat. 1055) (as added by sections 7(a) and 10(b)) shall not create a protective perimeter or buffer zone around the Special Management Area or wilderness.</text></paragraph>
<paragraph id="H7058E458ED00436E91436794F80E4719"><enum>(2)</enum><header>Other activities</header><text display-inline="yes-display-inline">The fact that activities or uses can be seen, heard, or detected from areas within the wilderness designated by the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>; 107 Stat. 756, 114 Stat. 1955, 116 Stat. 1055) (as added by sections 7(a) and 10(b)) shall not preclude, limit, control, regulate, or determine the conduct of the activities or uses outside the boundary of the wilderness.</text></paragraph></subsection>
<subsection id="HB1526A538F4A4231B3D0A36B101F2E5C"><enum>(i)</enum><header>Winter skiing and related winter activities</header><text>Nothing in this Act alters or limits—</text>
<paragraph id="H9AD2AC6AFD38477991C0BCA306D9EE55"><enum>(1)</enum><text>a permit held by a ski area;</text></paragraph>
<paragraph id="HE4DC82E14F974E7BACFAFAF5DCB14C81"><enum>(2)</enum><text>the implementation of the activities governed by a ski area permit; or</text></paragraph>
<paragraph id="H88BCC86C49924EFFA40F2A0B66AB5F7A"><enum>(3)</enum><text>the authority of the Secretary to modify or expand an existing ski area permit.</text></paragraph></subsection>
<subsection id="HB46B919FFEC24072955A189B5FFA7DF9"><enum>(j)</enum><header>Vegetation management</header><text>Nothing in this section prevents the Secretary from conducting vegetation management projects within the Special Management Area—</text>
<paragraph id="H6E7D845243C049229BDC94FD58B302C3"><enum>(1)</enum><text>subject to—</text>
<subparagraph id="H6CD3062C51BB46B0ACCA9FCFBE74CA27"><enum>(A)</enum><text>such reasonable regulations, policies, and practices as the Secretary determines appropriate; and</text></subparagraph>
<subparagraph id="HD16C4D980C4E4BEEBA592EDB4C9243BD"><enum>(B)</enum><text>all applicable laws (including regulations); and</text></subparagraph></paragraph>
<paragraph id="H251B7D1CD0794C59BE8C958E882FD239"><enum>(2)</enum><text>in a manner consistent with—</text>
<subparagraph id="H571786AA50164EA98914F4E973880843"><enum>(A)</enum><text>the purposes and management described in section 2; and</text></subparagraph>
<subparagraph id="H0B796D4018864AF482988A9D04D744BE"><enum>(B)</enum><text>this section.</text></subparagraph></paragraph></subsection>
<subsection id="H5B3FEC67A0004E13B1BCE4E6A383ECB3"><enum>(k)</enum><header>Wildfire, insect, and disease management</header><text>Consistent with this section, the Secretary is authorized to take any measures that the Secretary determines to be necessary to manage wildland fire and treat hazardous fuels, insects, and diseases in the Special Management Area. The Secretary is further authorized to coordinate such measures with the appropriate State or local agency, should the Secretary determine such coordination to be necessary.</text></subsection>
<subsection id="HD1775FEE0F8F40ECABE4260E7C2CE103"><enum>(l)</enum><header>Management plan</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall develop a management plan for the long-term protection and management of the Special Management Area that—</text>
<paragraph id="H1FAD05647BF04B3AA8E4813DE4FDB96B"><enum>(1)</enum><text>takes into account public input and the purposes in section 2; and</text></paragraph>
<paragraph id="H6E21F59EB09449B99490260624199E33"><enum>(2)</enum><text display-inline="yes-display-inline">provides for the recreational opportunities referred to in section 2(6) to occur within the Special Management Area.</text></paragraph></subsection></section>
<section id="H5FFE07424C194F6BA68AC8215768FDFA"><enum>6.</enum><header>State water rights</header><text display-inline="no-display-inline">Nothing in section 5 affects access to, use, or allocation of any absolute or conditional water right decreed under the laws of the State and in existence on the date of enactment of this Act.</text></section>
<section id="HF25916DA41C348C8A729FAE5B9D3E606"><enum>7.</enum><header>Hermosa creek wilderness</header>
<subsection id="HBC94E295157D4A469E9C6BA9E4A6F3C2"><enum>(a)</enum><header>Designation of wilderness</header><text>Section 2(a) of the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>; 107 Stat. 756, 114 Stat. 1955, 116 Stat. 1055) is amended by adding at the end the following:</text>
<quoted-block id="H97A3CF5751B845C78A8DB37F1D078E42" style="OLC">
<paragraph id="H4747255BBE3740A5854818525DAB0EA8"><enum>(22)</enum><text>Certain land within the San Juan National Forest which comprise approximately 37,236 acres, as generally depicted on the Map, and which shall be known as the <quote>Hermosa Creek Wilderness</quote>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H24537F36FD974715A67BE305ACFB5C4E"><enum>(b)</enum><header>Effective date</header><text>Any reference in the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>) to the effective date of that Act shall be considered to be a reference to the date of enactment of this Act for purposes of administering the wilderness area designated by section 2(a)(22) of the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>; 107 Stat. 756, 114 Stat. 1955, 116 Stat. 1055) (as added by subsection (a)).</text></subsection>
<subsection id="H919F384926C8407FACD7B775A30FC5AC"><enum>(c)</enum><header>Fire, insects, and diseases</header><text display-inline="yes-display-inline">As provided in section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>), within the wilderness areas designated by section 2(a)(22) of the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>; 107 Stat. 756, 114 Stat. 1955, 116 Stat. 1055) (as added by subsection (a) and section 10(b)), the Secretary may take any measure that the Secretary determines to be necessary to control fire, insects, and diseases, subject to such terms and conditions as the Secretary determines to be appropriate.</text></subsection></section>
<section id="HE53613B0B64F4515855CD3F414B9596B"><enum>8.</enum><header>Durango area mineral withdrawal</header>
<subsection id="HE304C8DEE1CA4781929B09558C703876"><enum>(a)</enum><header>Withdrawal</header><text>Subject to valid existing rights, the land and mineral interests described in subsection (b) are withdrawn from all forms of—</text>
<paragraph id="H15871E38C78F4AB7A076B78C4EEFE7DD"><enum>(1)</enum><text>entry, appropriation, or disposal under public land laws;</text></paragraph>
<paragraph id="H43B37FD064884D61BD20E1CBF3BF837E"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph>
<paragraph id="H254B21FE451044A78A53746601454719"><enum>(3)</enum><text>disposition under all laws relating to mineral leasing, geothermal leasing, or mineral materials.</text></paragraph></subsection>
<subsection id="H0AB5A394ABEB4E88B4AD4D978B73FC58"><enum>(b)</enum><header>Description of land and mineral interests</header><text>The land and mineral interests referred to in subsection (a) are the Federal land and mineral interests generally depicted within the <quote>Withdrawal Areas</quote> on the map entitled <quote>Perins Peak &amp; Animas City Mountain, Horse Gulch and Lake Nighthorse Mineral Withdrawal</quote> and dated April 5, 2013.</text></subsection>
<subsection id="H52BC52713AC24066877402C05D292EB4"><enum>(c)</enum><header>Buffer</header><text>Nothing in this section shall require—</text>
<paragraph id="H2ABC0CAF478340D3A933ACA772053ACA"><enum>(1)</enum><text>the creation of a protective perimeter or buffer area outside the boundaries of the withdrawal area described in subsection (b); or</text></paragraph>
<paragraph id="HAAF4320136834E2999C7C22FF3B79563"><enum>(2)</enum><text>any prohibition or limitation on activities outside of the boundaries of the withdrawal area described in subsection (b) that can be seen, heard, or detected from within the boundaries of the withdrawal area.</text></paragraph></subsection>
<subsection id="H1027A5C995EB4DC5A7085A48B71DBBEB"><enum>(d)</enum><header>Public purpose conveyance</header><text>Notwithstanding subsection (a), the Secretary may convey any portion of the land described in subsection (b) to the City, the County, or the State—</text>
<paragraph id="H7495804839F44B71B9A1CCB57CAFF57A"><enum>(1)</enum><text>pursuant to the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869 et seq.</external-xref>); or</text></paragraph>
<paragraph id="HE15E1D65409B41AEB49CA0B9243B21A7"><enum>(2)</enum><text>by exchange in accordance with applicable laws (including regulations).</text></paragraph></subsection></section>
<section id="HCD364304F9034659B924B4A5D8DAFD36"><enum>9.</enum><header>Conveyance of Bureau of Land Management Land to La Plata County</header>
<subsection id="HAF622DD2D7B247C3B42C192DEC3E58BD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">On the expiration of the permit numbered COC 64651 (09) and dated February 24, 2009, upon request and agreement of the County, the Secretary of the Interior shall convey to the County, without consideration and subject to valid existing rights, all right, title, and interest of the United States in and to the land described in subsection (b), subject to such terms and conditions as the Secretary determines to be necessary.</text></subsection>
<subsection id="H6390A8CE493F4416B41F2D1228A74284"><enum>(b)</enum><header>Description of land</header><text>The land referred to in subsection (a) consists of approximately 111 acres of land managed by the Bureau of Land Management, Tres Rios District, Colorado, as generally depicted on the map entitled <quote>La Plata County Grandview Conveyance</quote> and dated March 27, 2013.</text></subsection>
<subsection id="HC950E0906E924C928DE7CB181C5755E5"><enum>(c)</enum><header>Map and legal description</header>
<paragraph id="H65E3A14BBBA94463989974776F359348"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary of the Interior shall finalize the legal description of the parcel to be conveyed under this section.</text></paragraph>
<paragraph id="H6E6D69DD3A9A4EB7B94EC8B9E79B32CE"><enum>(2)</enum><header>Minor errors</header><text>The Secretary of the Interior may correct any minor error in—</text>
<subparagraph id="HDC31521001764FE0A4F5A2A9B23E5E97"><enum>(A)</enum><text>the map; or</text></subparagraph>
<subparagraph id="H77710193153748F693F7953E0CE17F97"><enum>(B)</enum><text>the legal description.</text></subparagraph></paragraph>
<paragraph id="HE1CAAF8ADE1B4A90BE72894603E0E1D6"><enum>(3)</enum><header>Availability</header><text>The map and legal description shall be on file and available for public inspection in the appropriate offices of the Bureau of Land Management.</text></paragraph></subsection>
<subsection id="H4AD0307AA6F24D50861D5AADC8E1CE71"><enum>(d)</enum><header>Administrative costs</header><text>As a condition of the conveyance under subsection (a), the Secretary of the Interior shall require the County to pay all administrative costs and costs associated with the conveyance.</text></subsection></section>
<section id="H545F95A48BCB4DD59E5CADEDB709BD05"><enum>10.</enum><header>Molas Pass Recreation Area; Weminuche Wilderness Addition; Wilderness Study Area Release</header>
<subsection id="H558846A1B3C64F4689292FBBFF79D202"><enum>(a)</enum><header>Molas Pass Recreation Area</header>
<paragraph id="HF87CD77FA2F94C6B8401F2969959364F"><enum>(1)</enum><header>Designation</header><text display-inline="yes-display-inline">The approximately 461 acres of land in San Juan County, Colorado, that is generally depicted as <quote>Molas Pass Recreation Area</quote> on the map entitled <quote>West Needles Contiguous Wilderness Study Area</quote> and dated September 11, 2014, is designated as the Molas Pass Recreation Area.</text></paragraph>
<paragraph id="H8E32F98F4678493584251514E9BC2A42"><enum>(2)</enum><header>Legal description</header>
<subparagraph id="H351654023EFE4587A76D3F76F3C47483"><enum>(A)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall prepare a legal description of the Molas Pass Recreation Area.</text></subparagraph>
<subparagraph id="H616A4BC5D5A844C484DF35D99B64DAEC"><enum>(B)</enum><header>Force of law</header><text>The legal description under paragraph (1) shall have the same force and effect as if included in this Act, except that the Secretary may correct any errors in the legal description.</text></subparagraph>
<subparagraph id="H52F092FD0DBF4A29B888203833F65673"><enum>(C)</enum><header>Public availability</header><text>The legal description prepared under paragraph (1) shall be on file and available for public inspection in the appropriate offices of the Bureau of Land Management.</text></subparagraph></paragraph>
<paragraph id="H786178B4FF914F1CB2FAC586050D57A3"><enum>(3)</enum><header>Use of snowmobiles</header><text>The use of snowmobiles shall be authorized in the Molas Pass Recreation Area—</text>
<subparagraph id="H6DA489907AD547D49FA221FB4052B99B"><enum>(A)</enum><text>during periods of adequate snow coverage;</text></subparagraph>
<subparagraph id="H3928F345B2484D4DA1479FFC7E8F1D42"><enum>(B)</enum><text>in accordance with the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/42/1701">42 U.S.C. 1701 et seq.</external-xref>) and applicable laws and regulations;</text></subparagraph>
<subparagraph id="HC5BF28F63686483EAD32B841862E13BD"><enum>(C)</enum><text>on designated trails identified as <quote>Winter Use Routes and Grooming Trails</quote> and <quote>Historic Snow Dependent Use Route</quote> on the map entitled, <quote>Winter Use Routes and Grooming Trails</quote> and dated September 11, 2014;</text></subparagraph>
<subparagraph id="H4EA9A8A978D140CEA0DE7715CA7105F2"><enum>(D)</enum><text>in designated areas for open area motorized travel; and</text></subparagraph>
<subparagraph id="H4809910C7E40417A95826539FB5DCA80"><enum>(E)</enum><text display-inline="yes-display-inline">subject to such terms and conditions as the Secretary may require; however, the Secretary shall not close any road or trail, or a portion of a road or trail, in the Molas Pass Recreation Area without simultaneously opening a road or trail, or a portion of a road or trail, of equivalent value in the immediate vicinity; further, nothing in this subparagraph shall prevent the Secretary from temporarily closing a road or trail for reasons of public safety.</text></subparagraph></paragraph>
<paragraph id="HC9BADC266F8243948C664507856A3505"><enum>(4)</enum><header>Other recreational opportunities</header><text display-inline="yes-display-inline">The Secretary shall authorize other recreational uses in the Molas Pass Recreation Area including, but not limited to, mountain biking.</text></paragraph></subsection>
<subsection id="HDC08201C099546E39F079574C8944E96"><enum>(b)</enum><header>West needles contiguous WSA addition to the Weminuche Wilderness</header>
<paragraph id="H029C0D87DC374B6BA21C3DE7C17ECDB9"><enum>(1)</enum><header>Wilderness addition</header><text>Section 2(a)(16) of the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>; 107 Stat. 756, 114 Stat. 1955, 116 Stat. 1055) is amended by striking <quote>Certain</quote> and inserting <quote>Certain lands within the San Juan National Forest which comprise approximately 499 acres generally depicted as <quote>Weminuche Wilderness Addition</quote> on the map entitled <quote>West Needles Contiguous Wilderness Study Area</quote> and dated September 11, 2014, and certain</quote>. </text></paragraph>
<paragraph id="HB8709EA7376446E988839503AD3EC15D"><enum>(2)</enum><header>Effective date</header><text>Any reference in the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>) to the effective date of that Act shall be considered to be a reference to the date of enactment of this Act for purposes of administering the wilderness area designated by section 2(a)(16) of the Colorado Wilderness Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/77">Public Law 103–77</external-xref>; 107 Stat. 756, 114 Stat. 1955, 116 Stat. 1055) (as added by paragraph (1)).</text></paragraph>
<paragraph id="H41508F1DA5A54EA2BC6CD14A996386F8"><enum>(3)</enum><header>Transfer of administrative jurisdiction</header><text>Administrative jurisdiction over the Federal land designated as wilderness under paragraph (1) is transferred from the Bureau of Land Management to the Forest Service.</text></paragraph></subsection>
<subsection id="HD3795B3437F94DF59E50B61F34A6771D"><enum>(c)</enum><header>Release</header>
<paragraph id="HC281C8C759C14133B17F6E09188B3267"><enum>(1)</enum><header>Finding</header><text>Congress finds that the land described in paragraph (3) has been adequately studied for wilderness designation under section 603 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782</external-xref>).</text></paragraph>
<paragraph id="HF70A532D18AF457AA629D54434349153"><enum>(2)</enum><header>Release</header><text display-inline="yes-display-inline">Any public land described in paragraph (3)—</text>
<subparagraph id="H6BCEE0C266ED46EFBC9CEB72FA0D8815"><enum>(A)</enum><text>is no longer subject to—</text>
<clause id="HA52400724957448BA31FF425FF6D19C6"><enum>(i)</enum><text>section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>); and</text></clause>
<clause id="H1DDD3C29B36840C9B4080C8B933AD730"><enum>(ii)</enum><text>Secretarial Order 3310 issues on December 22, 2010; and</text></clause></subparagraph>
<subparagraph id="HCF92E9CC585B4573A5B308A44F7B704B"><enum>(B)</enum><text>shall be managed in accordance with land management plans adopted under section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>).</text></subparagraph></paragraph>
<paragraph id="H6BCD0C9594B040D089D797AEABFE4310"><enum>(3)</enum><header>Description of land</header><text display-inline="yes-display-inline">The land referred to in paragraphs (1) and (2) is the approximately 461 acres of land in the West Needles Contiguous Wilderness Study Area of San Juan County, Colorado, that is generally depicted as <quote>Molas Pass Recreation Area</quote> on the map entitled <quote>West Needles Contiguous Wilderness Study Area</quote> and dated September 11, 2014.</text></paragraph></subsection></section>
<section id="H2978E793AB2E4F50ABD5A550AC43724E"><enum>11.</enum><header>Military overflights</header><text display-inline="no-display-inline">Nothing in this Act restricts or precludes—</text>
<paragraph id="HB6A1F2FF8E8D461F80DB2D4B7AFD2264"><enum>(1)</enum><text display-inline="yes-display-inline">low-level overflights of military aircraft over the areas designated as wilderness under this Act, including military overflights that can be seen, heard, or detected within the wilderness areas;</text></paragraph>
<paragraph id="H3642AA4F8C5B46F1B01AE604EB916C9F"><enum>(2)</enum><text display-inline="yes-display-inline">flight testing and evaluation; or</text></paragraph>
<paragraph id="H620969E7D56A4D67B88A2D5AC72C42EE"><enum>(3)</enum><text display-inline="yes-display-inline">the designation or creation of new units of special use airspace, or the establishment of military flight training routes over the wilderness areas. </text></paragraph></section>
