<official-title display="yes">To ensure that the National Environmental Policy Act of 1969 applies to the declaration of national monuments, and for other purposes.</official-title>

<section id="H4F4781B692BF4B559A0CD8CDC37A8D8D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Public Involvement in the Creation of National Monuments Act</short-title></quote>.</text></section> 
<section id="HC6AC5ADBC9F24EBF8FC1DB20F3E95FE2"><enum>2.</enum><header>NEPA applicability to national monument declarations</header><text display-inline="no-display-inline">Section 2 of the Act of June 8, 1906 (<external-xref legal-doc="usc" parsable-cite="usc/16/431">16 U.S.C. 431</external-xref>; commonly known as the <quote><short-title>Antiquities Act of 1906</short-title></quote>) is amended—</text> 
<paragraph id="H7DCBFA4FDBAC47D1AE2189A13E054303"><enum>(1)</enum><text>by striking <quote><short-title>That the President</short-title></quote> and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H81F6C4D50D764345B9EC50430A9BFD01" style="OLC"> 
<subsection id="H2140178A39324EA384C9286BE125CBBA"><enum>(a)</enum><text display-inline="yes-display-inline">That the President</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H849FE2DAFBA84707B37B29E28DC776B1"><enum>(2)</enum><text>by striking <quote><short-title>discretion, to declare</short-title></quote> and inserting <quote><short-title>discretion, subject to the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), to declare</short-title></quote>;</text></paragraph> 
<paragraph id="H6EE03ABF347F4544AD3BCC81000BB0C3"><enum>(3)</enum><text>by inserting before the final period the following <quote><short-title>. No more than one declaration shall be made in a State during any presidential four-year term of office without an express Act of Congress</short-title></quote>; and</text></paragraph> 
<paragraph id="H248874EBF8AA478A9D474588F1E29322"><enum>(4)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HE0AC7B2FAFE340499B59D73976FABEF4" style="OLC"> 
<subsection id="H4340E5CEECD8475A903B0168D6AE9008"><enum>(b)</enum><text display-inline="yes-display-inline">A declaration under this section shall—</text> 
<paragraph id="H0AA0FFFA7A8B4D63B03C9DA3B260F2F7"><enum>(1)</enum><text display-inline="yes-display-inline">not include private property without the informed written consent of the owner of the private property affected by the declaration;</text></paragraph> 
<paragraph id="HAAD0E6C2646843E1A8F7E21BF22FFD2A"><enum>(2)</enum><text display-inline="yes-display-inline">be considered a major Federal action under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), except if it affects 5,000 acres or less, in which case—</text> 
<subparagraph id="HD686B3355EE941C98FB110647311D62C"><enum>(A)</enum><text display-inline="yes-display-inline">the declaration shall be categorically excluded from the National Environmental Policy Act of 1969; </text></subparagraph> 
<subparagraph id="H90999C9CC846437F9FF01B2A2E84D707"><enum>(B)</enum><text>the declaration shall expire three years after the date of the declaration; and</text></subparagraph> 
<subparagraph id="HE4C2C05B55C640F4A56B80F62DEDA090"><enum>(C)</enum><text>the declaration may become permanent if—</text> 
<clause id="H1A8ED486BB5B42C396B49D88E3657982"><enum>(i)</enum><text>specifically designated as a monument by Federal statute; or</text></clause> 
<clause id="H901D56E3C22D43348DBAE6263782FB67"><enum>(ii)</enum><text>the President follows the review process under the National Environmental Policy Act of 1969; and</text></clause></subparagraph></paragraph> 
<paragraph id="HEF69381614A54C23A49ED86F6B809D04"><enum>(3)</enum><text display-inline="yes-display-inline">be followed by a feasibility study that includes an estimate of the costs associated with managing the monument in perpetuity, including any loss of Federal and State revenue, and the benefits associated with managing the monument in perpetuity, including jobs created and tourism dollars associated with managing the monument, which shall be submitted to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate and made available on the website of the Department of the Interior not later than one year after the date of the declaration.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H8CC5A48D7CA9461D9692BD292D0BA227"><enum>3.</enum><header>Use of existing funds</header><text display-inline="no-display-inline">This Act shall not be construed to increase the amount of funds that are authorized to be appropriated for any fiscal year.</text></section>
