<official-title display="yes">To provide taxpayers with an annual report disclosing the cost and performance of Government programs and areas of duplication among them, and for other purposes.<pagebreak/></official-title>

<section id="HF91B2E5265F94E608C034C4CA4C5EA38" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Taxpayers Right-To-Know Act</short-title></quote>.</text> </section>
<section id="H5E2BBE20F2004290BEDDD3E07F06868B"><enum>2.</enum><header>Agency requirements relating to annual report on the cost and performance of Government programs and areas of duplication among programs</header> 
<subsection id="H36D58C2370C44B76859309763C0401F6"><enum>(a)</enum><header>Requirement To identify and describe programs</header><text>On an annual basis, for purposes of the report required by subsection (b), the head of each agency shall—</text> 
<paragraph id="HFFCA572E04474BCDA3CEBF6E8852FBC4"><enum>(1)</enum><text>identify and describe every program administered by the agency;</text> </paragraph>
<paragraph id="HFAAFE5E47CCB44A69C106BB0A76B1FA1"><enum>(2)</enum><text>for each such program—</text> 
<subparagraph id="HCAF60727B90B451193CBECEEEF96044C"><enum>(A)</enum><text>determine the total administrative costs of the program;</text> </subparagraph>
<subparagraph id="H1011C68A8F5A41579621129540830031"><enum>(B)</enum><text>determine the expenditures for services for the program;</text> </subparagraph>
<subparagraph id="HDA1120208B3D40469EB848F4ABF2A4EC"><enum>(C)</enum><text>estimate the number of clients served by the program and beneficiaries who received assistance under the program (if applicable); and</text> </subparagraph>
<subparagraph id="HA313636F4C8C4381B409E70C4FE3086A"><enum>(D)</enum><text>estimate—</text> 
<clause id="HC271D59ED36D4CAC9C67319D107DFC43"><enum>(i)</enum><text>the number of full-time employees who administer the program; and</text> </clause>
<clause id="HB2266D11339341E8A248FCB6D71C2636"><enum>(ii)</enum><text>the number of full-time equivalents (whose salary is paid in part or full by the Federal Government through a grant or contract, a subaward of a grant or contract, a cooperative agreement, or another form of financial award or assistance) who assist in administering the program; and</text> </clause></subparagraph></paragraph>
<paragraph id="H4043F61E1CED40AD8B42684B60658F7F"><enum>(3)</enum><text display-inline="yes-display-inline">identify programs within the agency with duplicative or overlapping missions, services, and allowable uses of funds<added-phrase reported-display-style="italic" committee-id="HGO00">, including any finding of duplication or overlap identified by internal review, an Inspector General, the Government Accountability Office, or other report to the agency about the program</added-phrase>.</text> </paragraph></subsection>
<subsection id="H343120BFC93F485BBB3E6FBC5CF75A8E"><enum>(b)</enum><header>Report</header><text>Not later than February 1 of each fiscal year, the head of each agency shall create a link on the homepage of the official public website of the agency to a report containing the following:</text> 
<paragraph id="H5AD0F014B2B94EEBBEC6F0FCF5DE8F94"><enum>(1)</enum><header>Identification and description of programs</header><text>The information required under subsection (a) with respect to the preceding fiscal year.</text> </paragraph>
<paragraph id="H597B882AAFC44181A4E6A50104D38A53"><enum>(2)</enum><header>Performance reviews</header><text display-inline="yes-display-inline">The latest performance reviews (including the program performance reports required under <external-xref legal-doc="usc" parsable-cite="usc/31/1116">section 1116</external-xref> of title 31, United States Code) of each program of the agency identified under subsection (a)(1), including performance indicators, performance goals, output measures, and other specific metrics used to review the program and how the program performed on each.</text> </paragraph>
<paragraph id="H178172A87A6A4B6FB01174E6AF1C1FB5"><enum>(3)</enum><header>Improper payment information</header><text>For all programs and activities that may be susceptible to significant improper payments, as identified by the head of the agency under section 2(a) of the Improper Payments Information Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/31/321">31 U.S.C. 321</external-xref> note), the latest improper payment rate and the total estimated amount of improper payments during the preceding fiscal year, including fraudulent payments and overpayments.</text> </paragraph>
<paragraph id="H490F2BDDA324420ABF41C2D142CF877D"><enum>(4)</enum><header>Expired grant funding</header><text>The total amount of undisbursed grant funding remaining in grant accounts for which the period of availability to the grantee has expired.</text> </paragraph>
<paragraph id="HA3F89DE3F0584C18B7BA8B7FB1185303"><enum>(5)</enum><header>Recommendations</header><text>Such recommendations as the head of the agency considers appropriate—</text> 
<subparagraph id="HB66B30EE8125434E8471D7046657CC3A"><enum>(A)</enum><text>to consolidate programs within the agency that are duplicative or overlapping;</text> </subparagraph>
<subparagraph id="H095ED5A045194B4EB07BB71AF9319D2E"><enum>(B)</enum><text>to eliminate waste and inefficiency; and</text> </subparagraph>
<subparagraph id="HC6A46DA4475A45F58D4AD4C99403CE2C"><enum>(C)</enum><text>to terminate lower priority, outdated, and unnecessary programs and initiatives.</text> </subparagraph></paragraph></subsection>
<subsection id="H32CF600444B446B1A2835F5CF5BF5467"><enum>(c)</enum><header>Relationship to catalog of domestic financial assistance</header><text>With respect to the requirements of subsections (a)(1) and (a)(2)(B), the head of an agency may use the same information provided in the Catalog of Domestic Financial Assistance if applicable.</text> </subsection>
<subsection id="H63C56D44FECA429BA0913AA1DCC11699"><enum>(d)</enum><header>Format</header><text>Each agency shall make reports required by subsection (b) available in a searchable, machine-readable format, and shall expend no funds for the printing of such reports, except when providing such documents to the Congress.</text> </subsection></section>
<section id="H228F3F3B46EF48DBA714975FAE869514"><enum>3.</enum><header>Office of Management and Budget requirements relating to annual report on the cost and performance of Government programs and areas of duplication among programs</header> 
<subsection id="H1C9E69EC763A4CB5881299F4CA8F9D4C"><enum>(a)</enum><header>Report by Office of Management and Budget</header><text>Not later than February 1 of each fiscal year, the Director of the Office of Management and Budget shall publish on the official public website of the Office of Management and Budget a report containing the following:</text> 
<paragraph id="HED96AB68583D48BEBA7E5CB6A9D315A4"><enum>(1)</enum><header>Identification of duplicative programs</header><text>An identification of programs across agencies with duplicative or overlapping missions, services, and allowable uses of funds.</text> </paragraph>
<paragraph id="H8B45E14D16034BD49F1D63DF78446DA3"><enum>(2)</enum><header>Recommendations</header><text>Such recommendations as the Director considers appropriate—</text> 
<subparagraph id="H69B1F3186A614E919582779ADD4561B6"><enum>(A)</enum><text>to consolidate programs across agencies that are duplicative or overlapping;</text> </subparagraph>
<subparagraph id="H49904B6945AE4364BBB26382267AA6BC"><enum>(B)</enum><text>to eliminate waste and inefficiency; and</text> </subparagraph>
<subparagraph id="HEA9271E3159E4FDE870A323B73AC0C3B"><enum>(C)</enum><text>to terminate lower priority, outdated, and unnecessary programs and initiatives.</text> </subparagraph></paragraph></subsection>
<subsection id="H43C77AB9D24E47BDBBAD7DD1E7C53762"><enum>(b)</enum><header>Relationship to president’s budget</header><text>With respect to the requirements of subsection (a)(2), the Director may use the same information provided in the President’s annual budget submission, if applicable.</text> </subsection>
<subsection commented="no" id="H2AC81D029B114BB59D33B197ACED13F0"><enum>(c)</enum><header>Database required</header><text>The Director shall maintain a database of information—</text> 
<paragraph commented="no" id="H344830B7013E46C2BE00C8A393FC1710"><enum>(1)</enum><text>used to create the report required by subsection (a); and</text> </paragraph>
<paragraph commented="no" id="H2ACBD21EF7B44FEF9C41A7D37E5B4FF1"><enum>(2)</enum><text display-inline="yes-display-inline">obtained through meeting the requirements of section 21 of the <short-title>Statutory Pay-As-You-Go Act of 2010</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/31/712">31 U.S.C. 712</external-xref> note).</text> </paragraph></subsection></section>
<section id="H03D5C8ECBD0A4F469DD03D3E62995354"><enum>4.</enum><header>Government Accountability Office requirements relating to identification, consolidation, and elimination of duplicative Government programs</header><text display-inline="no-display-inline">Section 21 of the <short-title>Statutory Pay-As-You-Go Act of 2010</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/31/712">31 U.S.C. 712</external-xref> note) is amended by inserting <quote>(a)</quote> before the first sentence and by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HEB75BF804AA54E9EA306957098C365BD" style="OLC"> 
<subsection id="H53F616E2A6F14502A6948155E5980B77"><enum>(b)</enum><text>The Comptroller General shall maintain and provide regular updates, on not less than an annual basis to a publicly available website that tracks the status of responses by Departments and the Congress to suggested actions that the Comptroller General has previously identified in annual reports under subsection (a). The status of these suggested actions shall be tracked for an appropriate period to be determined by the Comptroller General. The requirements of this subsection shall apply during the effective period of subsection (a).</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
<section id="H9B0D963EAEDC4750AD776118D8BA36AB"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph commented="no" id="H5BC25CBEE2D74FA6894CBA4021141436"><enum>(1)</enum><header>Administrative costs</header><text>The term <term>administrative costs</term> has the meaning as determined by the Director of the Office of Management and Budget under section 504(b)(2) of <external-xref legal-doc="public-law" parsable-cite="pl/111/85">Public Law 111–85</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/31/1105">31 U.S.C. 1105</external-xref> note), except the term shall also include, for purposes of that section and this section, with respect to an agency—</text> 
<subparagraph commented="no" id="H8F477BF7BB5441DFA7D1B03B24CD4F54"><enum>(A)</enum><text>costs incurred by the agency as well as costs incurred by grantees, subgrantees, and other recipients of funds from a grant program or other program administered by the agency; and</text> </subparagraph>
<subparagraph commented="no" id="H5D176BCB55A544D38A63A361101C468A"><enum>(B)</enum><text>expenses related to personnel salaries and benefits, property management, travel, program management, promotion, reviews and audits, case management, and communication about, promotion of, and outreach for programs and program activities administered by the agency.</text> </subparagraph></paragraph>
<paragraph id="HB3E9F22D4CF74F558E39BB2D6808EA69"><enum>(2)</enum><header>Services</header><text>The term <term>services</term> has the meaning provided by the Director of the Office of Management and Budget and shall be limited to only activities, assistance, and aid that provide a direct benefit to a recipient, such as the provision of medical care, assistance for housing or tuition, or financial support (including grants and loans).</text> </paragraph>
<paragraph id="H3ADB83138C8949CCB941E51F144221FC"><enum>(3)</enum><header>Agency</header><text>The term <term>agency</term> has the same meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/5/551">section 551(1)</external-xref> of title 5, United States Code, except that the term also includes offices in the legislative branch other than the Government Accountability Office.</text> </paragraph>
<paragraph id="H982183A56E1F4FDC97226B4796081FE0"><enum>(4)</enum><header>Performance indicator, performance goal, output measure</header><text display-inline="yes-display-inline">The terms <term>performance indicator</term>, <term>performance goal</term>, and <term>output measure</term> have the meanings provided those terms by <external-xref legal-doc="usc" parsable-cite="usc/31/1115">section 1115</external-xref> of title 31, United States Code.</text> </paragraph>
<paragraph id="H9CA1CCAAA868400D9C0E427250D7D639"><enum>(5)</enum><header>Program</header><text>The term <term>program</term> has the meaning provided by the Director of the Office of Management and Budget and shall include, with respect to an agency, any organized set of activities directed toward a common purpose or goal undertaken by the agency that includes services, projects, processes, or financial or other forms of assistance, including grants, contracts, cooperative agreements, compacts, loans, leases, technical support, consultation, or other guidance.</text> </paragraph></section>
<section id="H69555E7E819747B5ADDDD192AF10DE33"><enum>6.</enum><header>Classified information</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to require the disclosure of classified information.</text> </section>
<section id="HC2C059E868434C59A5958A6530178B93"><enum>7.</enum><header>Regulations and implementation</header> 
<subsection id="H2625FD26B78842009D9C3260FBB9F12B"><enum>(a)</enum><header>Regulations</header><text>Not later than 120 days after the date of the enactment of this Act, the Director of the Office of Management and Budget shall prescribe regulations to implement this Act.</text> </subsection>
<subsection id="H0993978F78CF4D2DA229156B207045F4"><enum>(b)</enum><header>Implementation</header><text>This Act shall be implemented not later than one year after the date of the enactment of this Act.</text> </subsection></section>
