			 such Act.</quote>, do pass with the following</text></section><amendment><amendment-instruction blank-lines-after="0"><text>At the end, add the following:</text></amendment-instruction><amendment-block blank-lines-after="1" changed="added" reported-display-style="italic"><section id="idBE8F6F1B240F4431BF007081EC8A49BC"><enum>12.</enum><header>Informed consent for newborn screening research</header><subsection id="idd8ffbcf7554f4b52a577c00a35ef7831"><enum>(a)</enum><header>In general</header><text>Research on newborn dried blood spots shall be considered research carried out on human subjects
			 meeting the
			 definition of
			 <external-xref legal-doc="regulation" parsable-cite="cfr/45/46.102">section 46.102(f)(2)</external-xref> of title 45, Code of Federal Regulations, for
			 purposes
			 of Federally funded research conducted pursuant to the Public Health
			 Service Act until such time as updates to the Federal Policy for the
			 Protection of Human Subjects (the Common Rule) are promulgated pursuant to
			 subsection (c). For purposes of this subsection, sections 46.116(c) and
			 46.116(d) of title 45, Code of Federal Regulations, shall not apply.</text></subsection><subsection id="id2b3ada9f1a364bd485fb4d1336709594"><enum>(b)</enum><header>Effective date</header><text>Subsection (a) shall apply only to newborn dried blood spots used for purposes of Federally funded
			 research that were collected not earlier than 90 days after the date of
			 enactment of this Act.</text></subsection><subsection id="idd5b2d32426394fbabcb0b392d87ee7c3"><enum>(c)</enum><header>Regulations</header><text>Not later than 6 months after the date of enactment of this Act, the Secretary of Health and Human
			 Services shall promulgate proposed regulations related to the updating of
			 the Federal Policy for the Protection of Human Subjects (the Common Rule),
			 particularly with respect to informed consent.  Not later than 2 years
			 after such date of enactment, the Secretary shall promulgate final
			 regulations based on such proposed regulations.</text></subsection></section></amendment-block></amendment></engrossed-amendment-body><attestation><attestation-group><attestor></attestor><role>Secretary</role></attestation-group></attestation><endorsement></endorsement></amendment-doc>
