<section id="H0E96A6EF28F7424BAD70D3FB11C0A6A8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coltsville National Historical Park Act</short-title></quote>.</text></section>
<section id="HC5DC971F11714DA2AFFE54A178457865"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act:</text>
<paragraph id="H9AA9E0ACC7694A6BBCFB2C914510768C"><enum>(1)</enum><header>City</header><text>The term <term>city</term> means the city of Hartford, Connecticut.</text></paragraph>
<paragraph id="HB027AB72590D4D4C9042E53730510F35"><enum>(2)</enum><header>Historic District</header><text>The term <term>Historic District</term> means the Coltsville Historic District.</text></paragraph>
<paragraph id="HAFB4BFF9C4934DE496C90D9ADE583EDA"><enum>(3)</enum><header>Map</header><text>The term <term>map</term> means the map titled <quote>Coltsville National Historical Park—Proposed Boundary</quote>, numbered T25/102087, and dated May 11, 2010.</text></paragraph>
<paragraph id="HD5298CF02419478186E2F4596AF6770E"><enum>(4)</enum><header>Park</header><text display-inline="yes-display-inline">The term <term>park</term> means the Coltsville National Historical Park in the State of Connecticut.</text></paragraph>
<paragraph id="H172231D7C4C04A4DA19752EF93109944"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph>
<paragraph id="HD4795B01471E4075997A22141404D2FF"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means the State of Connecticut.</text></paragraph></section>
<section id="H9A649A33AF754A27A70A717D4264386D"><enum>3.</enum><header>Coltsville National Historical Park</header>
<subsection id="HCDDAFA48FC09430680C301B95452FD60"><enum>(a)</enum><header>Establishment</header>
<paragraph id="HB44FC36F290349B39FB70303DC447EA9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), there is established in the State a unit of the National Park System to be known as the <quote>Coltsville National Historical Park</quote>.</text></paragraph>
<paragraph id="HE92567ED164C45DCB66EC1D4A1F19A86"><enum>(2)</enum><header>Conditions for establishment</header><text>The park shall not be established until the date on which the Secretary determines that—</text>
<subparagraph id="H52FEE4ACF1D340D1A8C29FBC93568308"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary has acquired by donation sufficient land or an interest in land within the boundary of the park to constitute a manageable unit;</text></subparagraph>
<subparagraph id="H3F6B2DE92F294A8AA10652027A8640D0"><enum>(B)</enum><text>the State, city, or private property owner, as appropriate, has entered into a written agreement with the Secretary to donate at least 10,000 square feet of space in the East Armory which would include facilities for park administration and visitor services; </text></subparagraph>
<subparagraph id="H183E7E55C163478BBEBFAE6038A6FA60"><enum>(C)</enum><text>the Secretary has entered into a written agreement with the State, city, or other public entity, as appropriate, providing that and owned by the State, city, or other public entity within the Coltsville Historic District shall be managed consistent with this section; and</text></subparagraph>
<subparagraph id="H02A47F7D7B0C406B9EE4E926C089BE6F"><enum>(D)</enum><text display-inline="yes-display-inline">prior to accepting the donation referred to in subparagraph (B), the Secretary has reviewed the plans and financial resources of the developer of the East Armory to ensure the viability of the park based on those resources.</text></subparagraph></paragraph></subsection>
<subsection id="HB9427C2CD543458C93415C7A947A103B"><enum>(b)</enum><header>Boundaries</header><text display-inline="yes-display-inline">The park may include and provide appropriate interpretation and viewing of the following sites, as generally depicted on the map:</text>
<paragraph id="H6F9EF3BCF4904AFCB41061565EF42505"><enum>(1)</enum><text>The East Armory.</text></paragraph>
<paragraph id="HAA6BAFCCAB5F4D53A5D909E3B7406A56"><enum>(2)</enum><text>The Church of the Good Shepherd.</text></paragraph>
<paragraph id="HC2832F67FA794E6593A4EF5C69376000"><enum>(3)</enum><text>The Caldwell/Colt Memorial Parish House.</text></paragraph>
<paragraph id="H40ABE65DD4644C16B6D32ED5094C7207"><enum>(4)</enum><text>Colt Park.</text></paragraph>
<paragraph id="HDE74764B38B94243A629146626FCB8A1"><enum>(5)</enum><text>The Potsdam Cottages.</text></paragraph>
<paragraph id="H079F82F33B0140C08DDD4A624FB6715B"><enum>(6)</enum><text>Armsmear.</text></paragraph>
<paragraph id="HE1397E799B244112A410B19371213407"><enum>(7)</enum><text display-inline="yes-display-inline">The James Colt House.</text></paragraph></subsection>
<subsection id="HD6405EF5798A45EB8B665959F3DE9EAB"><enum>(c)</enum><header>Written consent of the owner</header><text>No non-Federal property may be included in the park without the written consent of the owner.</text></subsection>
<subsection id="H4CFCCD76E0494976A1EB0AC0F56EF84E"><enum>(d)</enum><header>Availability of map</header><text>The map shall be on file and available for public inspection in the appropriate offices of the National Park Service.</text></subsection>
<subsection id="H6C1D9353FA6B4058ACDB739C917324E9"><enum>(e)</enum><header>Notice</header><text>No later than 30 days after the date on which the Secretary makes a determination under section 3(a)(2), the Secretary shall publish in the Federal Register notice of the establishment of the park.</text></subsection></section>
<section id="HB15EE39C1CD84992859F28D9AD00CF81"><enum>4.</enum><header>Administration</header>
<subsection id="H34B9EAAD59964EE1A9D45BBC0D14472E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall administer the park in accordance with—</text>
<paragraph id="HD4BCFDF6F9AB49FFAC67F804F3A5C5D9"><enum>(1)</enum><text>this Act; and</text></paragraph>
<paragraph id="HC7738831AD0A423083EC5B21E4E3763B"><enum>(2)</enum><text>the laws generally applicable to units of the National Park System, including—</text>
<subparagraph id="HC618C0598E9A4CA384BEF46CF8CD7396"><enum>(A)</enum><text>the National Park Service Organic Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1">16 U.S.C. 1 et seq.</external-xref>); and</text></subparagraph>
<subparagraph id="HA2893C21CA584005B16023EC4028BD41"><enum>(B)</enum><text>the Act of August 21, 1935 (<external-xref legal-doc="usc" parsable-cite="usc/16/461">16 U.S.C. 461 et seq.</external-xref>).</text></subparagraph></paragraph></subsection>
<subsection id="H299B7815A09B44BBA7B921DA10E646F9"><enum>(b)</enum><header>State and local jurisdiction</header><text display-inline="yes-display-inline">Nothing in this Act enlarges, diminishes, or modifies any authority of the State, or any political subdivision of the State (including the city)—</text>
<paragraph id="H38AFE44F6B63461295BB34976C4E6B05"><enum>(1)</enum><text>to exercise civil and criminal jurisdiction; or</text></paragraph>
<paragraph id="H3FFC6EDB6B0441C1B3145D14A2410F64"><enum>(2)</enum><text>to carry out State laws (including regulations) and rules on non-Federal land located within the boundary of the park.</text></paragraph></subsection>
<subsection id="H0018A8C6E2E748D381CCCE4175E1100A"><enum>(c)</enum><header>Cooperative agreements</header>
<paragraph id="HBDD4A5F00A7E459F80B24C091F74C46B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may enter into cooperative agreements to carry out this Act.</text></paragraph>
<paragraph id="H0CEEF3808CFD4076A2074130812DCFDC"><enum>(2)</enum><header>Right of access</header><text>A cooperative agreement entered into under paragraph (1) shall provide that the Secretary, acting through the Director of the National Park Service, shall have the right of access at all reasonable times to all public portions of the property covered by the agreement for the purposes of—</text>
<subparagraph id="H64AB9FD280524523BA97698DA50C20BD"><enum>(A)</enum><text>conducting visitors through the properties; and</text></subparagraph>
<subparagraph id="HC8572B2B9E1945FC8C611D394F5EFC72"><enum>(B)</enum><text>interpreting the properties for the public.</text></subparagraph></paragraph>
<paragraph id="HC346C7A8FE304DC8AD3FA58696833244"><enum>(3)</enum><header>Changes or alterations</header><text>No changes or alterations shall be made to any properties covered by a cooperative agreement entered into under paragraph (1) unless the Secretary and the other party to the agreement agree to the changes or alterations.</text></paragraph>
<paragraph id="H646E6BF3744243C78D2A108CFDF608B6"><enum>(4)</enum><header>Conversion, use, or disposal</header><text>Any payment by the Secretary under this subsection shall be subject to an agreement that the conversion, use, or disposal of a project for purposes contrary to the purposes of this section, as determined by the Secretary, shall entitle the United States to reimbursement in an amount equal to the greater of—</text>
<subparagraph id="H8B413D57528B40B1BD46BF5AFA91C9A8"><enum>(A)</enum><text>the amounts made available to the project by the United States; or</text></subparagraph>
<subparagraph id="HE7753E69C9FE4076A961F79D9AE4FB8C"><enum>(B)</enum><text>the portion of the increased value of the project attributable to the amounts made available under this subsection, as determined at the time of the conversion, use, or disposal.</text></subparagraph></paragraph>
<paragraph id="H55C67C9842A044B1A02AA96E072E5DE0"><enum>(5)</enum><header>Matching funds</header>
<subparagraph id="HA000F7180A8B4B3285BAD55F63EB49A3"><enum>(A)</enum><header>In general</header><text>As a condition of the receipt of funds under this subsection, the Secretary shall require that any Federal funds made available under a cooperative agreement shall be matched on a 1-to-1 basis by non-Federal funds.</text></subparagraph>
<subparagraph id="H6AAE7C2C75D341B094B46226293203CC"><enum>(B)</enum><header>Form</header><text>With the approval of the Secretary, the non-Federal share required under subparagraph (A) may be in the form of donated property, goods, or services from a non-Federal source, fairly valued.</text></subparagraph></paragraph></subsection>
<subsection id="H955F0FF8695B4866B8F97C49212D56CC"><enum>(d)</enum><header>Collections</header><text>The Secretary may enter into a written agreement with the State of Connecticut State Library, Wadsworth Atheneum, the Colt Trust, or other public entities, as appropriate, to gain appropriate access to Colt-related artifacts for routine display in the East Armory or within other areas of the park to enhance the visitor experience.</text></subsection>
<subsection id="HC0AD457CAD604DCCB766125166D2543D"><enum>(e)</enum><header>Acquisition of land</header><text display-inline="yes-display-inline">The Secretary is authorized to acquire land and interests in land by donation, purchase with donated funds, or exchange, except that land or interests in land owned by the State or any political subdivision of the State may be acquired only by donation.</text></subsection>
<subsection id="H7F11CC486C1A4BF29CCB8E616449F5AC"><enum>(f)</enum><header>Technical assistance and public interpretation</header><text>The Secretary may provide technical assistance and public interpretation of related historic and cultural resources within the boundary of the historic district.</text></subsection>
<subsection id="HFD1CEE5264AC4AE6B13CB2EC20F3A1AD"><enum>(g)</enum><header>No use of condemnation</header><text>The Secretary may not acquire by condemnation any land or interest in land under this Act or for the purposes of this Act.</text></subsection>
<subsection id="HBD1E8382753B46B78C2EC21918D288AA"><enum>(h)</enum><header>No buffer zone created</header><text>Nothing in this Act, the establishment of the park, or the management plan for the park shall be construed to create buffer zones outside of the park. That activities or uses can be seen, heard, or detected from areas within the park shall not preclude, limit, control, regulate or determine the conduct or management of activities or uses outside of the park.</text></subsection></section>
<section id="H76957C0A92C34DCB9BECFBA3CA0D3495"><enum>5.</enum><header>Management plan</header>
<subsection id="H29DC139CBA594ECE87E4928960393E1D"><enum>(a)</enum><header>In general</header><text>Not later than 3 fiscal years after the date on which funds are made available to carry out this Act, the Secretary shall complete a management plan for the park in accordance with—</text>
<paragraph id="H693877D6C12A4E0A9427182074E74530"><enum>(1)</enum><text display-inline="yes-display-inline">section 12(b) of the National Park Service General Authorities Act; and</text></paragraph>
<paragraph id="HD9FD1070B94D401CB72A82AF3BD39486"><enum>(2)</enum><text>other applicable laws.</text></paragraph></subsection>
<subsection id="H064CCE2F4CF94ED48D677C6DE48A4B2B"><enum>(b)</enum><header>Cost share</header><text>The management plan shall include provisions that identify costs to be shared by the Federal Government, the State, and the city, and other public or private entities or individuals for necessary capital improvements to, and maintenance and operations of, the park.</text></subsection>
<subsection id="H2D3C580FF7C24C5BA36C0487E7F09C8B"><enum>(c)</enum><header>Submission to Congress</header><text>On completion of the management plan, the Secretary shall submit the management plan to—</text>
<paragraph id="HCB5AE577E4FF4DB7883FD9F6C0C82476"><enum>(1)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text></paragraph>
<paragraph id="H1C4A446C9B7743B698133CF645E9A9C6"><enum>(2)</enum><text>the Committee on Energy and Natural Resources of the Senate.</text></paragraph></subsection></section>
