Disclosure requirement for official business conducted using non-official electronic messaging account.</toc-entry></toc></subsection></section><section id="HA838BC2DEA8A47B6A969752D473B7D49" section-type="subsequent-section"><enum>2.</enum><header>Presidential records</header><subsection id="H977351821F9F4D248A8AA12AC4761233"><enum>(a)</enum><header>Procedures for consideration of claims of constitutionally based privilege against disclosure</header><paragraph id="HCC97E235785343BA874685937BC04336"><enum>(1)</enum><header>Amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">Chapter 22</external-xref> of title 44, United States Code, is amended by adding at the end the following:</text><quoted-block id="H6F75B358C5B74ED9899620C2E201750B" style="USC"><section id="H6F9182988CF74EA5969A6C64B4935050"><enum>2208.</enum><header>Claims of constitutionally based privilege against disclosure</header><subsection id="H2FDB42FE051841508330F0DA14DB811A"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HA62C10BD277744C894AB5732AA214787"><enum>(1)</enum><text>When the Archivist determines under this chapter to make available to the public any Presidential record that has not previously been made available to the public, the Archivist shall—</text><subparagraph id="H2713A8B8090045758348BA160A8C8827" indent="up1"><enum>(A)</enum><text>promptly provide notice of such determination to—</text><clause id="H70580B92D36D47A0954141503ABFA496"><enum>(i)</enum><text>the former President during whose term of office the record was created; and</text></clause><clause id="HA468EAAED3664089B75C4FECBF7BD557"><enum>(ii)</enum><text>the incumbent President; and</text></clause></subparagraph><subparagraph id="H1A9FC0AF3B1D431F813DE29BDE898AF9" indent="up1"><enum>(B)</enum><text>make the notice available to the public.</text></subparagraph></paragraph><paragraph id="HCB9EF4DBCF07474BBE369C368FED3135" indent="up1"><enum>(2)</enum><text>The notice under paragraph (1)—</text><subparagraph id="H95017DF7A2664858AF94CBBCA99E78D0"><enum>(A)</enum><text>shall be in writing; and</text></subparagraph><subparagraph id="H57F6ACD81E244ECF8517E16BA29A21E0"><enum>(B)</enum><text>shall include such information as may be prescribed in regulations issued by the Archivist.</text></subparagraph></paragraph><paragraph id="HDF6D787F2B3D4DA1986B9319C73A2668" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H2D7DB35C48FB4486A3364EE5D562FE89"><enum>(A)</enum><text>Upon the expiration of the 60-day period (excepting Saturdays, Sundays, and legal public holidays) beginning on the date the Archivist provides notice under paragraph (1)(A), the Archivist shall make available to the public the Presidential record covered by the notice, except any record (or reasonably segregable part of a record) with respect to which the Archivist receives from a former President or the incumbent President notification of a claim of constitutionally based privilege against disclosure under subsection (b).</text></subparagraph><subparagraph id="H55D3B11419534AECAF55395AF5999682" indent="up1"><enum>(B)</enum><text>A former President or the incumbent President may extend the period under subparagraph (A) once for not more than 30 additional days (excepting Saturdays, Sundays, and legal public holidays) by filing with the Archivist a statement that such an extension is necessary to allow an adequate review of the record.</text></subparagraph><subparagraph id="HBD3F21740E804A9FA3D1856EFDE6EC6E" indent="up1"><enum>(C)</enum><text>Notwithstanding subparagraphs (A) and (B), if the 60-day period under subparagraph (A), or any extension of that period under subparagraph (B), would otherwise expire during the 6-month period after the incumbent President first takes office, then that 60-day period or extension, respectively, shall expire at the end of that 6-month period.</text></subparagraph></paragraph></subsection><subsection id="HEB50FAD6311C45A79B33DD4F0D5F2E7D"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H3132E98D091245FABEC337A1B517C6DC"><enum>(1)</enum><text display-inline="yes-display-inline">For purposes of this section, the decision to assert any claim of constitutionally based privilege against disclosure of a Presidential record (or reasonably segregable part of a record) must be made personally by a former President or the incumbent President, as applicable.</text></paragraph><paragraph id="HB089671F484E45A8B6A2EF79478B4772" indent="up1"><enum>(2)</enum><text>A former President or the incumbent President shall notify the Archivist, the Committee on Oversight and Government Reform of the House of Representatives, and the Committee on Homeland Security and Governmental Affairs of the Senate of a privilege claim under paragraph (1) on the same day that the claim is asserted under such paragraph.</text></paragraph></subsection><subsection id="H67CFE02F41B749B5A371F795876A7F08"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H6CA7B501F6D849DC8342417A48027D19"><enum>(1)</enum><text display-inline="yes-display-inline">If a claim of constitutionally based privilege against disclosure of a Presidential record (or reasonably segregable part of a record) is asserted under subsection (b) by a former President, the Archivist shall consult with the incumbent President, as soon as practicable during the period specified in paragraph (2)(A), to determine whether the incumbent President will uphold the claim asserted by the former President.</text></paragraph><paragraph id="H04E6DA0960D746F0A364A016F3075474" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HF33C7AEE65F94BF2A291AF4D9A6F5E54"><enum>(A)</enum><text display-inline="yes-display-inline">Not later than the end of the 30-day period beginning on the date of which the Archivist receives notification from a former President of the assertion of a claim of constitutionally based privilege against disclosure, the Archivist shall provide notice to the former President and the public of the decision of the incumbent President under paragraph (1) regarding the claim.</text></subparagraph><subparagraph id="H7935D508270C4DF0A91739E812840615" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">If the incumbent President upholds the claim of privilege asserted by the former President, the Archivist shall not make the Presidential record (or reasonably segregable part of a record) subject to the claim publicly available unless—</text><clause id="H4512D7EEEB1E443AB5CC275C9279EF2D"><enum>(i)</enum><text display-inline="yes-display-inline">the incumbent President withdraws the decision upholding the claim of privilege asserted by the former President; or</text></clause><clause id="H5CEC9689EF8F42688F9D50072B44699E"><enum>(ii)</enum><text>the Archivist is otherwise directed by a final court order that is not subject to appeal.</text></clause></subparagraph><subparagraph id="H8111BB14299E498892309512309D7DE7" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">If the incumbent President determines not to uphold the claim of privilege asserted by the former President, or fails to make the determination under paragraph (1) before the end of the period specified in subparagraph (A), the Archivist shall release the Presidential record subject to the claim at the end of the 90-day period beginning on the date on which the Archivist received notification of the claim, unless otherwise directed by a court order in an action initiated by the former President under section 2204(e) of this title or by a court order in another action in any Federal court.</text></subparagraph></paragraph></subsection><subsection id="H705BC171030D4DF8846B2121663206E8"><enum>(d)</enum><text>The Archivist shall not make publicly available a Presidential record (or reasonably segregable part of a record) that is subject to a privilege claim asserted by the incumbent President unless—</text><paragraph id="H3A5ABAFE27924C8E823D44AC299E1B06"><enum>(1)</enum><text>the incumbent President withdraws the privilege claim; or</text></paragraph><paragraph id="H42E7392B20FA4EBF8B8834CF55001F6A"><enum>(2)</enum><text>the Archivist is otherwise directed by a final court order that is not subject to appeal.</text></paragraph></subsection><subsection id="H8D577DF6948C4245AC6FEA04215FF713"><enum>(e)</enum><text>The Archivist shall adjust any otherwise applicable time period under this section as necessary to comply with the return date of any congressional subpoena, judicial subpoena, or judicial process.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H93423B309B70490B826AA209BABDC820"><enum>(2)</enum><header>Conforming amendments</header><subparagraph commented="no" display-inline="yes-display-inline" id="H99BBA58996C649E18FAF0191B7302986"><enum>(A)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/44/2204">Section 2204(d)</external-xref> of title 44, United States Code, is amended by inserting <quote>, except section 2208,</quote> after <quote>chapter</quote>.</text></subparagraph><subparagraph id="HF79541556E534E5EBEF492A92CA197A9" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/44/2205">Section 2205</external-xref> of title 44, United States Code, is amended—</text><clause id="HCD0E8AA160E0460688036F97C230886F"><enum>(i)</enum><text>in the matter preceding paragraph (1), by striking <quote>section 2204</quote> and inserting <quote>sections 2204 and 2208 of this title</quote>; and</text></clause><clause id="H50AF8663A76C41249BF8934C85C949C1"><enum>(ii)</enum><text>in paragraph (2)(A), by striking <quote>subpena</quote> and inserting <quote>subpoena</quote>.</text></clause></subparagraph><subparagraph id="H9F379316FFC54AFA9D5ED6FD4F0E193C" indent="up1"><enum>(C)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/44/2207">Section 2207</external-xref> of title 44, United States Code, is amended in the second sentence by inserting <quote>, except section 2208,</quote> after <quote>chapter</quote>.</text></subparagraph></paragraph><paragraph id="HCBD7372D6607478F8FCB203BEB18EC30"><enum>(3)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">chapter 22</external-xref> of title 44, United States Code, is amended by adding at the end the following:</text><quoted-block id="H3C343278FD0E4586832B42AA4639A0D9" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">2208. Claims of constitutionally based privilege against disclosure.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H2F7E55FB14FA4B50ACE74AC6DD6DA964"><enum>(4)</enum><header>Rule of construction</header><text>Nothing in the amendment made by paragraph (2)(C) shall be construed to—</text><subparagraph id="HE726FC5B4F9644779D9696B2AEFA36CE"><enum>(A)</enum><text>affect the requirement of <external-xref legal-doc="usc" parsable-cite="usc/44/2207">section 2207</external-xref> of title 44, United States Code, that Vice Presidential records shall be subject to chapter 22 of that title in the same manner as Presidential records; or</text></subparagraph><subparagraph id="HBB468974A9764E5280C1688AD8A48633"><enum>(B)</enum><text>affect any claim of constitutionally based privilege by a President or former President with respect to a Vice Presidential record.</text></subparagraph></paragraph></subsection><subsection id="H19E03D74D197413798295BD6509728F7"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/44/2201">Section 2201</external-xref> of title 44, United States Code, is amended—</text><paragraph id="HB04BFBD112FE4C2FAA35A584EA6207C0"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="HE70DF4ABDF684E45809212606B9A7478"><enum>(A)</enum><text>by striking <quote>memorandums</quote> and inserting <quote>memoranda</quote>;</text></subparagraph><subparagraph id="H34E741597F634232ACD82D82389D8692"><enum>(B)</enum><text>by striking <quote>audio, audiovisual</quote> and inserting <quote>audio and visual records</quote>; and</text></subparagraph><subparagraph id="H3D059BF44ED6492193B77DFFBEAE271F"><enum>(C)</enum><text>by inserting <quote>, whether in analog, digital, or any other form</quote> after <quote>mechanical recordations</quote>; and</text></subparagraph></paragraph><paragraph id="H7076D2F4542E4EF7BEE87582F3BE5262"><enum>(2)</enum><text>in paragraph (2), by striking <quote>advise and assist</quote> and inserting <quote>advise or assist</quote>.</text></paragraph></subsection><subsection id="HE1701E7310EB4E2DACBF6FDB63FC32E2"><enum>(c)</enum><header>Management and custody of Presidential records</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/44/2203">Section 2203</external-xref> of title 44, United States Code, is amended—</text><paragraph commented="no" id="HDE745424761A4BCAAE05515ABD964F0F"><enum>(1)</enum><text>in subsection (a), by striking <quote>maintained</quote> and inserting <quote>preserved and maintained</quote>;</text></paragraph><paragraph id="HA6088383A1254BC3A888812F55AD02D4"><enum>(2)</enum><text>in subsection (b), by striking <quote>advise and assist</quote> and inserting <quote>advise or assist</quote>;</text></paragraph><paragraph id="HA05F9E6AD1F040628AF51EF5303DB71D"><enum>(3)</enum><text>by redesignating subsection (f) as subsection (g);</text></paragraph><paragraph id="HF038F9E5155844D78AD07AC2948387CC"><enum>(4)</enum><text>by inserting after subsection (e) the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H5AE636E99A11435AA97AE3E4E31BC118" style="USC"><subsection commented="no" id="H81AFF30F0BF64B6999CB54A21840D8CF"><enum>(f)</enum><text display-inline="yes-display-inline">During a President’s term of office, the Archivist may maintain and preserve Presidential records on behalf of the President, including records in digital or electronic form. The President shall remain exclusively responsible for custody, control, and access to such Presidential records. The Archivist may not disclose any such records, except under direction of the President, until the conclusion of a President’s term of office, if a President serves consecutive terms upon the conclusion of the last term, or such other period provided for under section 2204 of this title.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HE40493BD811C48D2919EE91908E206BF"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (g)(1), as so redesignated, by striking <quote>Act</quote> and inserting <quote>chapter</quote>.</text></paragraph></subsection><subsection display-inline="no-display-inline" id="H28E87581A5AD4E189A8D9B47A3C6E100"><enum>(d)</enum><header>Restrictions on access to presidential records</header><text><external-xref legal-doc="usc" parsable-cite="usc/44/2204">Section 2204</external-xref> of title 44, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H5EAC7C65DD224DB5BA89D04056553BA7" style="USC"><subsection id="HA17EE34358BD4C0EA161A9027B3D2097"><enum>(f)</enum><text display-inline="yes-display-inline">The Archivist shall not make available any original Presidential records to any individual claiming access to any Presidential record as a designated representative under section 2205(3) of this title if that individual has been convicted of a crime relating to the review, retention, removal, or destruction of records of the Archives.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H801176EAD7E743B2B54FFE9CA0EE716C"><enum>(e)</enum><header>Disclosure requirement for official business conducted using non-official electronic messaging account</header><paragraph id="H6F649F86153F45F5990DDCF7669D32F9"><enum>(1)</enum><header>Amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">Chapter 22</external-xref> of title 44, United States Code, as amended by subsection (a)(1), is further amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="HC1DFEA71813F4C8080ABF149106E79D1" style="USC"><section id="H295571E461C74FB7AE5D54A99616A568"><enum>2209.</enum><header>Disclosure requirement for official business conducted using non-official electronic messaging accounts</header><subsection id="H693F40150C944DFAA5809B85B499959E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An officer or employee of an executive agency may not create or send a Presidential record using a non-official electronic messaging account unless such officer or employee—</text><paragraph id="HBF306ACAABA84A37A338BBD5C3BE16A9"><enum>(1)</enum><text display-inline="yes-display-inline">copies an official electronic messaging account of the officer or employee in the original creation or transmission of the Presidential record; or</text></paragraph><paragraph id="H639862C25C524F31ADD5461DDF54453C"><enum>(2)</enum><text>forwards a complete copy of the Presidential record to an official electronic messaging account of the officer or employee within five days after the original creation or transmission of the Presidential record.</text></paragraph></subsection><subsection id="H21339453407D47619D702DF098FAAA36"><enum>(b)</enum><header>Adverse actions</header><text display-inline="yes-display-inline">The intentional violation of subsection (a) (including any rules, regulations, or other implementing guidelines), as determined by the appropriate supervisor, shall be a basis for disciplinary action in accordance with subchapter I, II, or V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/75">chapter 75</external-xref> of title 5, as the case may be.</text></subsection><subsection id="H10672557E1224F399F72F81953AFE4AB"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H0227791D2AC54A63ABA4C66FE2269010"><enum>(1)</enum><header>Electronic messages</header><text display-inline="yes-display-inline">The term <quote>electronic messages</quote> means electronic mail and other electronic messaging systems that are used for purposes of communicating between individuals.</text></paragraph><paragraph id="HDE6EA424DD35423C8622E55615BB5FEE"><enum>(2)</enum><header>Electronic messaging account</header><text display-inline="yes-display-inline">The term <quote>electronic messaging account</quote> means any account that sends electronic messages.</text></paragraph><paragraph id="H6999DDB57ECA40D2A7FE3C96DDF10AB9"><enum>(3)</enum><header>Executive agency</header><text>The term <quote>executive agency</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HFC26D558A3F748C38412336E4C755A3C"><enum>(2)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">chapter 22</external-xref> of title 44, United States Code, as amended by subsection (a)(3), is further amended by adding at the end the following new item:</text><quoted-block id="H13A33AF30FE64A8FBCEF47F190DCABF6" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">2209. Disclosure requirement for official business conducted using non-official electronic messaging accounts.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HB18E069B51F24B74A99339190C7D1EC9"><enum>3.</enum><header>National Archives and Records Administration</header><subsection id="HF00370971D7A4F978BA6A38C1213A06E"><enum>(a)</enum><header>Acceptance of records for historical preservation</header><text><external-xref legal-doc="usc" parsable-cite="usc/44/2107">Section 2107</external-xref> of title 44, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HE74171287AC344268D543AF233866BD6" style="USC"><section id="HD1DDFED1201844AAA2451A48A47987AD"><enum>2107.</enum><header>Acceptance of records for historical preservation</header><subsection id="H45BF1E8FC51841F6AD4334559BB9F46C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">When it appears to the Archivist to be in the public interest, the Archivist may—</text><paragraph id="H2F584FA83B0A427FA69AD50AE1A4CFFF"><enum>(1)</enum><text display-inline="yes-display-inline">accept for deposit with the National Archives of the United States the records of a Federal agency, the Congress, the Architect of the Capitol, or the Supreme Court determined by the Archivist to have sufficient historical or other value to warrant their continued preservation by the United States Government;</text></paragraph><paragraph id="H93239B7F0360415C83F3B7CB7A10ED41"><enum>(2)</enum><text display-inline="yes-display-inline">direct and effect the transfer of records of a Federal agency determined by the Archivist to have sufficient historical or other value to warrant their continued preservation by the United States Government to the National Archives of the United States, as soon as practicable, and at a time mutually agreed upon by the Archivist and the head of that Federal agency not later than thirty years after such records were created or received by that agency, unless the head of such agency has certified in writing to the Archivist that such records must be retained in the custody of such agency for use in the conduct of the regular business of the agency;</text></paragraph><paragraph id="H0B0CA3A5651E44ABB3A0F7FD68A48221"><enum>(3)</enum><text display-inline="yes-display-inline">direct and effect, with the approval of the head of the originating Federal agency, or if the existence of the agency has been terminated, with the approval of the head of that agency’s successor in function, if any, the transfer of records, deposited or approved for deposit with the National Archives of the United States to public or educational institutions or associations; title to the records to remain vested in the United States unless otherwise authorized by Congress; and</text></paragraph><paragraph id="H9F94E829F40641959DEE97930E3E9116"><enum>(4)</enum><text display-inline="yes-display-inline">transfer materials from private sources authorized to be received by the Archivist by section 2111 of this title.</text></paragraph></subsection><subsection commented="no" id="H463B540BC99C4DCC96C9CFEECE3AF7AD"><enum>(b)</enum><header>Early transfer of records</header><text display-inline="yes-display-inline">The Archivist—</text><paragraph commented="no" id="H5D46288ED0D04A7894B91106C46461C5"><enum>(1)</enum><text>in consultation with the head of the originating Federal agency, is authorized to accept a copy of the records described in subsection (a)(2) that have been in existence for less than thirty years; and</text></paragraph><paragraph commented="no" id="H55998133467A4A6BB9EB9D6FD471FE22"><enum>(2)</enum><text>may not disclose any such records until the expiration of—</text><subparagraph commented="no" id="H0AABDDF05B77410FBC2C0983FCDDE324"><enum>(A)</enum><text>the thirty-year period described in paragraph (1);</text></subparagraph><subparagraph commented="no" id="H7EFECD7B4E684D0292ADA2D53544C4D2"><enum>(B)</enum><text>any longer period established by the Archivist by order; and</text></paragraph><paragraph id="HD00E1FA20AF841FA94C30579F236559B"><enum>(2)</enum><text>in the second sentence, by striking <quote>photographs or microphotographs</quote> and inserting <quote>photographs, microphotographs, or digitized records</quote>, each place it appears.</text></paragraph></subsection></section><section id="H5DA59372573145E6AB7BCC7299E23362"><enum>6.</enum><header>Procedures to prevent unauthorized removal of classified records from National Archives</header><subsection commented="no" id="H4D4FCAD152AE43558A4695E5AE3674F9"><enum>(a)</enum><header>Classified records</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Archivist shall prescribe internal procedures to prevent the unauthorized removal of classified records from the National Archives and Records Administration or the destruction or damage of such records, including when such records are accessed or searched electronically. Such procedures shall include, at a minimum, the following prohibitions:</text><paragraph commented="no" id="HCED19DF7BFEB4D2297E3A443E5373695"><enum>(1)</enum><text>An individual, other than covered personnel, may not view classified records in any room that is not secure, except in the presence of National Archives and Records Administration personnel or under video surveillance.</text></paragraph><paragraph commented="no" id="HCD1A3A8DE27841399FB0FAFAB65CF9F9"><enum>(2)</enum><text>An individual, other than covered personnel, may not be left alone with classified records, unless that individual is under video surveillance.</text></paragraph><paragraph commented="no" id="HEDBA8B9CEEF84F33A415BE592B1D9884"><enum>(3)</enum><text>An individual, other than covered personnel, may not review classified records while possessing any cellular phone, electronic personal communication device, or any other devices capable of photographing, recording, or transferring images or content.</text></paragraph><paragraph commented="no" id="H83ACC52FD05847C19ECD966378EDE57A"><enum>(4)</enum><text>An individual seeking access to review classified records, as a precondition to such access, must consent to a search of their belongings upon conclusion of their records review.</text></paragraph><paragraph commented="no" id="HE37A020E611548578F909D472D1A988D"><enum>(5)</enum><text>All notes and other writings prepared by an individual, other than covered personnel, during the course of a review of classified records shall be retained by the National Archives and Records Administration in a secure facility until such notes and other writings are determined to be unclassified, are declassified, or are securely transferred to another secure facility.</text></paragraph></subsection><subsection commented="no" id="HE1AD10515F1E43CE88C2070168874B87"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" id="H97CE4C3A238B4F6A882C0877473A885F"><enum>(1)</enum><header>Covered personnel</header><text display-inline="yes-display-inline">The term <term>covered personnel</term> means any individual—</text><subparagraph commented="no" id="H7C82C213C73546B185C90B93C3022B14"><enum>(A)</enum><text display-inline="yes-display-inline">who has an appropriate and necessary reason for accessing classified records, as determined by the Archivist; and</text></subparagraph><subparagraph commented="no" id="HEB8BD5A1A7F847088175F527B2E52593"><enum>(B)</enum><text>who is either—</text><clause commented="no" id="HCE259184C31B49038ADE5D0330C2AB40"><enum>(i)</enum><text>an officer or employee of the United States Government with appropriate security clearances; or</text></paragraph><paragraph id="HF8A849F0496749B88FA1EF1681F0752B"><enum>(2)</enum><text>forwards a complete copy of the record to an official electronic messaging account of the officer or employee within five days after the original creation or transmission of the record.</text></paragraph></subsection><subsection id="H8CBF549F12C442798C7BBED41C2FBDD5"><enum>(b)</enum><header>Adverse Actions</header><text display-inline="yes-display-inline">The intentional violation of subsection (a) (including any rules, regulations, or other implementing guidelines), as determined by the appropriate supervisor, shall be a basis for disciplinary action in accordance with subchapter I, II, or V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/75">chapter 75</external-xref> of title 5, as the case may be.</text></subsection><subsection id="H9D31AEDAEF6040BF871C724FD2FAF9F2"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H0EF5F9EBCBE143B294A661305FE6F038"><enum>(1)</enum><header>Electronic messages</header><text display-inline="yes-display-inline">The term <quote>electronic messages</quote> means electronic mail and other electronic messaging systems that are used for purposes of communicating between individuals.</text></paragraph><paragraph id="H919BE295FDDD4388A2355024BBBF413A"><enum>(2)</enum><header>Electronic messaging account</header><text display-inline="yes-display-inline">The term <quote>electronic messaging account</quote> means any account that sends electronic messages.</text></paragraph><paragraph id="H29248CA5E3864364AE02CBBBC45C8926"><enum>(3)</enum><header>Executive agency</header><text>The term <quote>executive agency</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD574AA2CB8A4411684A934FDDB63D18D"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/29">chapter 29</external-xref> of title 44, United States Code, is amended by adding at the end the following new item:</text><quoted-block id="H3E4539DCEF604A18A8BE1053C88232CE" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">2911.
