		<section id="HC2982378CA2D4795B7FBF47DD2B20894" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Success and Opportunity through Quality Charter Schools Act</short-title></quote>.</text>
		</section><section id="H72FE4CDB9AAC4CD6BD5F89E5CB96A347"><enum>2.</enum><header>References</header><text display-inline="no-display-inline">Except as otherwise specifically provided, whenever in this Act a section or other provision is
			 amended or repealed, such amendment or repeal shall be considered to be
			 made to that section or other provision of the Elementary and Secondary
			 Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>).</text>
		</section><section id="HC036887B36FA493DA611E891E3DFC43A"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">Section 5201 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221">20 U.S.C. 7221</external-xref>) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="HF8DA41E60C2D46B1B3B97EED8970EB3B" style="OLC">
				<section id="HAD022961853341F2A98A1DF1857E72A6"><enum>5201.</enum><header>Purpose</header><text display-inline="no-display-inline">It is the purpose of this subpart to—</text>
					<paragraph id="H5E4A7BDBDD8742B6B9940EFBFABD8EAA"><enum>(1)</enum><text display-inline="yes-display-inline">improve the United States education system and education opportunities for all Americans by
			 supporting innovation in public education in public school settings that
			 prepare students to compete and contribute to the global economy;</text>
					</paragraph><paragraph id="HA56813F1A5BE4A38BEA3E5CBDFF5BE74"><enum>(2)</enum><text>provide financial assistance for the planning, program design, and initial implementation of
			 charter schools;</text>
					</paragraph><paragraph id="HA2B78645CFC94573858C024A6C4E57E1"><enum>(3)</enum><text>expand the number of high-quality charter schools available to students across the Nation;</text>
					</paragraph><paragraph id="H55DDBB6471E740D3AA369D04FF62ABC3"><enum>(4)</enum><text>evaluate the impact of such schools on student achievement, families, and communities, and share
			 best practices between charter schools and other public schools;</text>
					</paragraph><paragraph id="H8235C24A368D48B79932607803C589D6"><enum>(5)</enum><text>encourage States to provide support to charter schools for facilities financing in an amount more
			 nearly commensurate to the amount the States have typically provided for
			 traditional public schools;</text>
					</paragraph><paragraph id="HDE387D2FE87F4C50B0A97619E3D571D8"><enum>(6)</enum><text display-inline="yes-display-inline">improve student services to increase opportunities for students with disabilities, limited English
			 proficient students, and other traditionally underserved students to
			 attend charter schools and meet challenging State academic achievement
			 standards;</text>
					</paragraph><paragraph id="H3AA92AD9B1F44AD897CB3499A160C42A"><enum>(7)</enum><text display-inline="yes-display-inline">support efforts to strengthen the charter school authorizing process to improve performance
			 management, including transparency, oversight, monitoring, and evaluation
			 of such schools; and</text>
					</paragraph><paragraph commented="no" id="H523C03C24D0240B7BC3850DE4F475ED5"><enum>(8)</enum><text>support quality accountability and transparency in the operational performance of all authorized
			 public chartering agencies, which include State educational agencies,
			 local educational agencies, and other authorizing entities.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H60BF1B57F3BD4F379758A11E2EA5D52A"><enum>4.</enum><header>Program authorized</header><text display-inline="no-display-inline">Section 5202 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221a">20 U.S.C. 7221a</external-xref>) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H7506B4D534214CC49982E4FF1747383F" style="OLC">
				<section id="H1D0288ED68154E4BBB31A5E96D55CF11"><enum>5202.</enum><header>Program authorized</header>
					<subsection id="H8B4DDD2298BC406A8C5EC984832C8147"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">This subpart authorizes the Secretary to carry out a charter school program that supports charter
			 schools that serve elementary school and secondary school students by—</text>
						<paragraph id="H07AC98C403DA4CD6A0E6E3E6F4AE1286"><enum>(1)</enum><text>supporting the startup of charter schools, and the replication and expansion of high-quality
			 charter schools;</text>
						</paragraph><paragraph id="HEF7D6E042B614A5FA9F59FF13AE7FE33"><enum>(2)</enum><text>assisting charter schools in accessing credit to acquire and renovate facilities for school use;
			 and</text>
						</paragraph><paragraph id="H857E0728F0314079925A2060E224C639"><enum>(3)</enum><text display-inline="yes-display-inline">carrying out national activities to support—</text>
							<subparagraph id="HFF52C6B2342D49B2AE65F08AD846827B"><enum>(A)</enum><text>charter school development;</text>
							</subparagraph><subparagraph id="H3F9F85EAB60044F4807983EFF767EA79"><enum>(B)</enum><text>the dissemination of best practices of charter schools for all schools;</text>
							</subparagraph><subparagraph id="HA8195BDA98F249B39B83B39EE7AF4997"><enum>(C)</enum><text>the evaluation of the impact of the program on schools participating in the program; and</text>
							</subparagraph><subparagraph id="H063CC26E3AA84359AD8558DA8AD4A5BA"><enum>(D)</enum><text>stronger charter school authorizing.</text>
							</subparagraph></paragraph></subsection><subsection id="HD77CF6ED7C8345A8AA8B59A8C0AFCFAE"><enum>(b)</enum><header>Funding Allotment</header><text>From the amount made available under section 5211 for a fiscal year, the Secretary shall—</text>
						<paragraph id="HA26054BBE5F54A59A465E99100B69682"><enum>(1)</enum><text>reserve 15 percent to support charter school facilities assistance under section 5204;</text>
						</paragraph><paragraph id="H90D87D14F36B4457A5A511FBAD5596B0"><enum>(2)</enum><text>reserve not more than 10 percent to carry out national activities under section 5205; and</text>
						</paragraph><paragraph id="H6C5D7AF9F5804202B9A1173D7C159329"><enum>(3)</enum><text>use the remaining amount after the Secretary reserves funds under paragraphs (1) and (2) to carry
			 out section 5203.</text>
						</paragraph></subsection><subsection id="H7E379BC1A3BC4E4B8A588B4FCA741D10"><enum>(c)</enum><header>Prior grants and subgrants</header><text display-inline="yes-display-inline">The recipient of a grant or subgrant under this subpart or subpart 2, as such subpart was in effect
			 on the day before the date of enactment of the <short-title>Success and Opportunity through Quality Charter Schools Act</short-title>, shall continue to receive funds in accordance with the terms and conditions of such grant or
			 subgrant.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HDC113292EF34408EB0289B4D935D5567"><enum>5.</enum><header>Grants to support high-quality charter schools</header><text display-inline="no-display-inline">Section 5203 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221b">20 U.S.C. 7221b</external-xref>) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H014E21A1FFA24C68AAD804DF3FA08498" style="OLC">
				<section id="HF764AD5A9BBD40E7B7451B34CDA45F09"><enum>5203.</enum><header>Grants to support high-quality charter schools</header>
					<subsection id="H8668DBE6CB464653B6DD5EC6977247F6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">From the amount reserved under section 5202(b)(3), the Secretary shall award grants to State
			 entities having applications approved pursuant to subsection (f) to enable
			 such entities to—</text>
						<paragraph id="H38D804C2207844CA8D8B6D76C697B460"><enum>(1)</enum><text>award subgrants to eligible applicants for opening and preparing to operate—</text>
							<subparagraph id="HF87631366335430A9B12AE7914260B3F"><enum>(A)</enum><text>new charter schools;</text>
							</subparagraph><subparagraph id="HB95EAF4201834C298C9A8C3A8BECDBC4"><enum>(B)</enum><text>replicated, high-quality charter school models; or</text>
							</subparagraph><subparagraph id="HFBAEC48B95CC4D6B823A3AA7C76D640F"><enum>(C)</enum><text>expanded, high-quality charter schools; and</text>
							</subparagraph></paragraph><paragraph id="H8A815A96BB9E49A0BD4A3A3985F127D1"><enum>(2)</enum><text display-inline="yes-display-inline">provide technical assistance to eligible applicants and authorized public chartering agencies in
			 carrying out the activities described in paragraph (1) and work with
			 authorized public chartering agencies in the State to improve authorizing
			 quality.</text>
						</paragraph></subsection><subsection id="HAC3A15ED2B68403D8586E0BFE3A5629F"><enum>(b)</enum><header>State uses of funds</header>
						<paragraph id="H06D4DDCD2C474510B976BBEAF67C0CB5"><enum>(1)</enum><header>In general</header><text>A State entity receiving a grant under this section shall—</text>
							<subparagraph display-inline="no-display-inline" id="H4FE6E76CFB9847B28A7A24647A7E40A5"><enum>(A)</enum><text display-inline="yes-display-inline">use not less than 90 percent of the grant funds to award subgrants to eligible applicants, in
			 accordance with the quality charter school program described in the State
			 entity’s application approved pursuant to subsection (f), for the purposes
			 described in subparagraphs (A) through (C) of subsection (a)(1);</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H774B6D3DAB1341B898DBAF140DE0499D"><enum>(B)</enum><text>reserve not less than 7 percent of such funds to carry out the activities described in subsection
			 (a)(2); and</text>
							</subparagraph><subparagraph commented="no" id="H093970686B284FF48AAB351FD720EEB5"><enum>(C)</enum><text>reserve not more than 3 percent of such funds for administrative costs which may include technical
			 assistance.</text>
							</subparagraph></paragraph><paragraph id="HDBE132A0B7E8476597E53FBA9C1A40E7"><enum>(2)</enum><header>Contracts and grants</header><text display-inline="yes-display-inline">A State entity may use a grant received under this section to carry out the activities described in
			 subparagraphs (A) and (B) of paragraph (1) directly or through grants,
			 contracts, or cooperative agreements.</text>
						</paragraph><paragraph id="H27E688ADC8314B3C9AFFCF997B585D76"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this Act shall prohibit the Secretary from awarding grants to States that use a weighted
			 lottery to give slightly better chances for admission to all or a subset
			 of educationally disadvantaged students if the use of weighted lotteries
			 in favor of such students is not prohibited by State law, and such State
			 law is consistent with laws described in section 5210(1)(G).</text>
						</paragraph></subsection><subsection id="H8F70195BBC1E420280B1D5CE183C7FF9"><enum>(c)</enum><header>Program periods; peer review; grant number and amount; diversity of projects; waivers</header>
						<paragraph commented="no" id="H4814F400E6694E3C96200BB83D19F399"><enum>(1)</enum><header>Program periods</header>
							<subparagraph id="H1CB361C8439E40B4A35FB492F6E2A946"><enum>(A)</enum><header>Grants</header><text display-inline="yes-display-inline">A grant awarded by the Secretary to a State entity under this section shall be for a period of not
			 more than 5 years.</text>
							</subparagraph><subparagraph id="H6F46ED8AE2174397821849FFF32E1526"><enum>(B)</enum><header>Subgrants</header><text>A subgrant awarded by a State entity under this section shall be for a period of not more than 5
			 years, of which an eligible applicant may use not more than 18 months for
			 planning and program design.</text>
							</subparagraph></paragraph><paragraph id="H94E57C19E790452CBFD0CEC34E95CA3F"><enum>(2)</enum><header>Peer Review</header><text display-inline="yes-display-inline">The Secretary, and each State entity receiving a grant under this section, shall use a peer review
			 process to review applications for assistance under this section.</text>
						</paragraph><paragraph id="H2BD8A9C0CC8943F59F7D7EC7D1AF38A1"><enum>(3)</enum><header>Grant awards</header><text>The Secretary shall—</text>
							<subparagraph id="HCB513BA78E334F96A506DE45B5D4E939"><enum>(A)</enum><text>for each fiscal year for which funds are appropriated under section 5211—</text>
								<clause id="H74B012D3F0CF467E95549A7800C3BE14"><enum>(i)</enum><text>award not less than 3 grants under this section;</text>
								</clause><clause id="H050351D4C4D0404B8E106A317B1C584E"><enum>(ii)</enum><text>wholly fund each grant awarded under this section, without making continuation awards; and</text>
								</clause><clause id="H2F58F8623A004FD2A9FF69AD24F8A544"><enum>(iii)</enum><text>fully obligate the funds appropriated for the purpose of awarding grants under this section in the
			 fiscal year for which such grants are awarded; and</text>
								</clause></subparagraph><subparagraph commented="no" id="H6C836ECF6743453A8D48B7B1CF3A8707"><enum>(B)</enum><text display-inline="yes-display-inline">midway through the grant period of each grant awarded under this section to a State entity, review
			 the grant to determine whether the State entity will meet the agreed upon
			 uses of funds in the State entity’s application, and if not, reallot the
			 grant funds that will not be used to other State entities during the
			 succeeding grant competition under this section.</text>
							</subparagraph></paragraph><paragraph id="H318E5653375F4B6B98CD0520D881088F"><enum>(4)</enum><header>Diversity of Projects</header><text>Each State entity receiving a grant under this section shall award subgrants under this section in
			 a manner that, to the extent possible, ensures that such subgrants—</text>
							<subparagraph id="H4FE76C68C82B4811A4AA30137971BC1B"><enum>(A)</enum><text>are distributed throughout different areas, including urban, suburban, and rural areas; and</text>
							</subparagraph><subparagraph id="H8AAD9628F44146A6AB7C0C7A6FD7EE3A"><enum>(B)</enum><text>will assist charter schools representing a variety of educational approaches.</text>
							</subparagraph></paragraph><paragraph id="HE9F17D0F435A42AB95EA93D8BB9973B0"><enum>(5)</enum><header>Waivers</header><text display-inline="yes-display-inline">The Secretary may waive any statutory or regulatory requirement over which the Secretary exercises
			 administrative authority except any such requirement relating to the
			 elements of a charter school described in section 5210(1), if—</text>
							<subparagraph id="H40A8FB07F6F54064BB51313997C20FF9"><enum>(A)</enum><text>the waiver is requested in an approved application under this section; and</text>
							</subparagraph><subparagraph id="HB57F76BEBFEA438A905004E38AD604BA"><enum>(B)</enum><text>the Secretary determines that granting such a waiver will promote the purpose of this subpart.</text>
							</subparagraph></paragraph></subsection><subsection id="H6A2EC1EDCE8448289B16F8469A1A0468"><enum>(d)</enum><header>Limitations</header>
						<paragraph id="H9B644B85A70D41C7B775AE275DF6DEAB"><enum>(1)</enum><header>Grants</header><text>A State entity may not receive more than 1 grant under this section for a 5-year period.</text>
						</paragraph><paragraph id="H3B25B0CD6B8F461FB3C7663E6D4C5B0E"><enum>(2)</enum><header>Subgrants</header><text display-inline="yes-display-inline">An eligible applicant may not receive more than 1 subgrant under this section per individual
			 charter school for a 5-year period, unless the eligible applicant
			 demonstrates to the State entity not less than 3 years of improved
			 educational results in the areas described in subparagraphs (A) and (D) of
			 section 5210(6) for students enrolled in such charter school.</text>
						</paragraph></subsection><subsection id="H3E4F74BD40F94FC3A2F5470A8475C44F"><enum>(e)</enum><header>Applications</header><text>A State entity desiring to receive a grant under this section shall submit an application to the
			 Secretary at such time and in such manner as the Secretary may require.
			 The application shall include the following:</text>
						<paragraph id="H70D13CBD0C094891B02CE3DE212224F0"><enum>(1)</enum><header>Description of Program</header><text display-inline="yes-display-inline">A description of the State entity’s objectives under this section and how the objectives of the
			 program will be carried out, including a description—</text>
							<subparagraph id="H692CF58793D84657B726A6FA1A78BB1E"><enum>(A)</enum><text>of how the State entity—</text>
								<clause id="HBD381920125F496F9440028D8AFA50AC"><enum>(i)</enum><text>will support the opening of new charter schools, replicated, high-quality charter school models,
			 and expanded, high-quality charter schools, and a description of the
			 proposed number of each type of charter school or model to be opened under
			 the State entity’s program;</text>
								</clause><clause id="H61CBAF60B08B4AC4AFA4B9067B52788F"><enum>(ii)</enum><text>will inform eligible charter schools, developers, and authorized public chartering agencies of the
			 availability of funds under the program;</text>
								</clause><clause id="HE12B965900E44F4184DC231B7631691F"><enum>(iii)</enum><text display-inline="yes-display-inline">will work with eligible applicants to ensure that the eligible applicants access all Federal funds
			 that they are eligible to receive, and help the charter schools supported
			 by the applicants and the students attending the charter schools—</text>
									<subclause id="H2B03D45FC83B42C89F0FFE3EAB18C702"><enum>(I)</enum><text>participate in the Federal programs in which the schools and students are eligible to participate;</text>
									</subclause><subclause id="HA7FD20FC6CFA4175B48F9EA82442EB82"><enum>(II)</enum><text>receive the commensurate share of Federal funds the schools and students are eligible to receive
			 under such programs; and</text>
									</subclause><subclause id="H52BAF877D9534FFF9A043E9EA121B2D1"><enum>(III)</enum><text>meet the needs of students served under such programs, including student with disabilities and
			 English learners;</text>
									</subclause></clause><clause id="H974DAC3C8ED046A5B05A1D6A40035854"><enum>(iv)</enum><text>in the case in which the State entity is not a State educational agency—</text>
									<subclause id="H8938B69F1E904B6FAED90AD69B66BF79"><enum>(I)</enum><text>will work with the State educational agency and the charter schools in the State to maximize
			 charter school participation in Federal and State programs for charter
			 schools; and</text>
									</subclause><subclause id="H8A1AEE45BD354E89B6C2E361B3149843"><enum>(II)</enum><text>will work with the State educational agency to adequately operate the State entity’s program under
			 this section, where applicable;</text>
									</subclause></clause><clause id="H33F39F53FEED46BA9E100275646FAE9B"><enum>(v)</enum><text>will ensure each eligible applicant that receives a subgrant under the State entity’s program to
			 open and prepare to operate a new charter school, a replicated,
			 high-quality charter school model, or an expanded, high-quality charter
			 school is prepared to continue to operate such school or model, in a
			 manner consistent with the eligible applicant’s application, after the
			 subgrant funds have expired;</text>
								</clause><clause id="HED8A3F7C8AD945FC935E8C799549236C"><enum>(vi)</enum><text>will support charter schools in local educational agencies with large numbers of schools identified
			 by the State for improvement;</text>
								</clause><clause id="H67FC6FE683AF48FBBAD92FB8CDD6B8F7"><enum>(vii)</enum><text display-inline="yes-display-inline">will work with charter schools to promote inclusion of all students and support all students once
			 they are enrolled to promote retention;</text>
								</clause><clause id="HEA602DC1F75B497E9018FC3258196CA2"><enum>(viii)</enum><text>will work with charter schools on recruitment practices, including efforts to engage groups that
			 may otherwise have limited opportunities to participate in charter
			 schools;</text>
								</clause><clause id="HFCF67C293141411B96ED8CAFA27D53A3"><enum>(ix)</enum><text display-inline="yes-display-inline">will share best and promising practices between charter schools and other public schools,
			 including, where appropriate, instruction and professional development in
			 science, math, technology, and engineering education;</text>
								</clause><clause id="H4D4D99D64C5245399DD15FD5E6762789"><enum>(x)</enum><text display-inline="yes-display-inline">will ensure the charter schools receiving funds under the State entity’s program meet the
			 educational needs of their students, including students with disabilities
			 and English learners;</text>
								</clause><clause id="H763867023A1C41D780A3320D97319176"><enum>(xi)</enum><text>will support efforts to increase quality initiatives, including meeting the quality authorizing
			 elements described in paragraph (2)(E);</text>
								</clause><clause id="H8E786682E0DE4684BE90B08CE1D802F5"><enum>(xii)</enum><text display-inline="yes-display-inline">will provide oversight of authorizing activity, including how the State will approve, actively
			 monitor, and re-approve or revoke the authority of an authorized public
			 chartering agency based on the performance of the charter schools
			 authorized by such agency in the areas of student achievement, student
			 safety, financial management, and compliance with all applicable statutes
			 and regulations; and</text>
								</clause><clause id="H869081631B914987B3E416C0043C6562"><enum>(xiii)</enum><text>in the case of a State entity defined in subsection (i)(4), will work with the State to provide
			 assistance to and oversight of authorized public chartering agencies for
			 authorizing activity described in clause (xii);</text>
								</clause></subparagraph><subparagraph id="HC45F0739D66046419D746282C3CCB171"><enum>(B)</enum><text>of the extent to which the State entity—</text>
								<clause id="HA386C1550B3C43DF8CB5F34676602EDE"><enum>(i)</enum><text>is able to meet and carry out the priorities listed in subsection (f)(2); and</text>
								</clause><clause id="HB824B104CED14D00B3D83C5C05D93E05"><enum>(ii)</enum><text display-inline="yes-display-inline">is working to develop or strengthen a cohesive statewide system to support the opening of new
			 charter schools, replicated, high-quality charter school models, or
			 expanded, high-quality charter schools;</text>
								</clause></subparagraph><subparagraph id="H707C6E0921D843AC8D2EA538765B7497"><enum>(C)</enum><text display-inline="yes-display-inline">of how the State entity will carry out the subgrant competition, including—</text>
								<clause id="H61F4DB31F59940C1AD3311D74C416BF2"><enum>(i)</enum><text>a description of the application each eligible applicant desiring to receive a subgrant will
			 submit, including—</text>
									<subclause id="HE8DD788F86BF489ABE4DAF5A66366BF0"><enum>(I)</enum><text>a description of the roles and responsibilities of eligible applicants, partner organizations, and
			 management organizations, including the administrative and contractual
			 roles and responsibilities;</text>
									</subclause><subclause id="H07CC9DB67D474EF9A464386B5A99708C"><enum>(II)</enum><text>a description of the quality controls agreed to between the eligible applicant and the authorized
			 public chartering agency involved, such as a contract or performance
			 agreement, how a school’s performance in the State’s academic
			 accountability system will be a primary factor for renewal or revocation
			 of the school’s charter, and how the State entity and the authorized
			 public chartering agency involved will reserve the right to revoke or not
			 renew a school’s charter based on financial, structural, or operational
			 factors involving the management of the school;</text>
									</subclause><subclause id="H3022305D0BD44B8580E76678483A2E19"><enum>(III)</enum><text display-inline="yes-display-inline">a description of how the eligible applicant will solicit and consider input from parents and other
			 members of the community on the implementation and operation of each
			 charter school receiving funds under the State entity’s program; and</text>
									</subclause><subclause commented="no" id="H53B32472FFCC4DF990FD634D317DC06F"><enum>(IV)</enum><text>a description of the planned activities and expenditures for the subgrant funds for purposes of
			 opening and preparing to operate a new charter school, a replicated,
			 high-quality charter school model, or an expanded, high-quality charter
			 school, and how the school or model will maintain financial sustainability
			 after the end of the subgrant period; and</text>
									</subclause></clause><clause id="H4D8E36B387BD4C9A8CB55439AFBB98B3"><enum>(ii)</enum><text>a description of how the State entity will review applications;</text>
								</clause></subparagraph><subparagraph id="H2818FB59DC234678B1EF4F528E4F603D"><enum>(D)</enum><text display-inline="yes-display-inline">in the case of an entity that partners with an outside organization to carry out the State entity’s
			 quality charter school program, in whole or in part, of the roles and
			 responsibilities of this partner;</text>
							</subparagraph><subparagraph id="H7435F5D658344347B75196081A124167"><enum>(E)</enum><text display-inline="yes-display-inline">of how the State entity will help the charter schools receiving funds under the State entity’s
			 program consider the transportation needs of the schools’ students; and</text>
							</subparagraph><subparagraph id="H8053511A6C7B44A793C7517B97BA536C"><enum>(F)</enum><text>of how the State entity will support diverse charter school models, including models that serve
			 rural communities.</text>
							</subparagraph></paragraph><paragraph id="H5598F05163104065942C369473E942D5"><enum>(2)</enum><header>Assurances</header><text display-inline="yes-display-inline">Assurances, including a description of how the assurances will be met, that—</text>
							<subparagraph id="H460F6F70205645B39B4AFECD48D8FE0E"><enum>(A)</enum><text display-inline="yes-display-inline">each charter school receiving funds under the State entity’s program will have a high degree of
			 autonomy over budget and operations;</text>
							</subparagraph><subparagraph id="HA31CA27E164441B9A449074E6B1C613F"><enum>(B)</enum><text display-inline="yes-display-inline">the State entity will support charter schools in meeting the educational needs of their students as
			 described in paragraph (1)(A)(x);</text>
							</subparagraph><subparagraph id="HE8542CB54D82422184544EA38B11B400"><enum>(C)</enum><text>the State entity will ensure that the authorized public chartering agency of any charter school
			 that receives funds under the State entity’s program—</text>
								<clause id="H3F084FEA12854714B732C2E299F27279"><enum>(i)</enum><text display-inline="yes-display-inline">adequately monitors each charter school in recruiting, enrolling, and meeting the needs of all
			 students, including students with disabilities and English learners; and</text>
								</clause><clause id="HCE9E5D1574B3482ABA22B740D32596C7"><enum>(ii)</enum><text display-inline="yes-display-inline">ensures that each charter school solicits and considers input from parents and other members of the
			 community on the implementation and operation of the school;</text>
								</clause></subparagraph><subparagraph id="H92FA81699FC443C594E8E4B774146AF6"><enum>(D)</enum><text>the State entity will provide adequate technical assistance to eligible applicants to—</text>
								<clause id="HB2508E91EC30440A9D835A45FF930BFA"><enum>(i)</enum><text>meet the objectives described in clauses (vii) and (viii) of paragraph (1)(A) and paragraph (2)(B);
			 and</text>
								</clause><clause id="HD5D646F3028B4DA08D8FD6C9D223CFC2"><enum>(ii)</enum><text display-inline="yes-display-inline">recruit, enroll, and retain traditionally underserved students, including students with
			 disabilities and English learners, at rates similar to traditional public
			 schools;</text>
								</clause></subparagraph><subparagraph id="H4B36D25252FE42F89CBC30B0FC1308FB"><enum>(E)</enum><text display-inline="yes-display-inline">the State entity will promote quality authorizing, such as through providing technical assistance
			 and supporting all authorized public chartering agencies in the State to
			 improve the oversight of their charter schools, including by—</text>
								<clause id="H8849EA4936E34980A747B05C8006F06E"><enum>(i)</enum><text display-inline="yes-display-inline">assessing annual performance data of the schools, including, as appropriate, graduation rates and
			 student academic growth;</text>
								</clause><clause id="H4B95F9D66E1443ABAEF55B84DCF6C489"><enum>(ii)</enum><text>reviewing the schools’ independent, annual audits of financial statements conducted in accordance
			 with generally accepted accounting principles, and ensuring any such
			 audits are publically reported; and</text>
								</clause><clause id="HF9287C83D5A74A48B5853F1A20E22C91"><enum>(iii)</enum><text>holding charter schools accountable to the academic, financial, and operational quality controls
			 agreed to between the charter school and the authorized public chartering
			 agency involved, such as through renewal, non-renewal, or revocation of
			 the school’s charter;</text>
								</clause></subparagraph><subparagraph id="H71FFD627B3014C4E97A36C75647681CB"><enum>(F)</enum><text>the State entity will work to ensure that charter schools are included with the traditional public
			 schools in decision-making about the public school system in the State;
			 and</text>
							</subparagraph><subparagraph commented="no" id="H6DE358800F1340F6B4E9AA60F6D73D30"><enum>(G)</enum><text display-inline="yes-display-inline">the State entity will ensure that each charter school in the State make publicly available,
			 consistent with the dissemination requirements of the annual State report
			 card, information to help parents make informed decisions about the
			 education options available to their children, including information on
			 the educational program, student support services, and annual performance
			 and enrollment data for the groups of students described in section
			 1111(b)(2)(C)(v)(II).</text>
							</subparagraph></paragraph><paragraph id="HD4E434BC93704D6680AB2B97EEFE2BC4"><enum>(3)</enum><header>Requests for waivers</header><text display-inline="yes-display-inline">A request and justification for waivers of any Federal statutory or regulatory provisions that the
			 State entity believes are necessary for the successful operation of the
			 charter schools that will receive funds under the State entity’s program
			 under this section, and a description of any State or local rules,
			 generally applicable to public schools, that will be waived, or otherwise
			 not apply to such schools or, in the case of a State entity defined in
			 subsection (i)(4), a description of how the State entity will work with
			 the State to request necessary waivers where applicable.</text>
						</paragraph></subsection><subsection id="H7D13BEEAC411407AA59196ED5B873C66"><enum>(f)</enum><header>Selection criteria; priority</header>
						<paragraph id="H0D21BA4AEEB84AC48CB82F0756DC65BA"><enum>(1)</enum><header>Selection criteria</header><text display-inline="yes-display-inline">The Secretary shall award grants to State entities under this section on the basis of the quality
			 of the applications submitted under subsection (e), after taking into
			 consideration—</text>
							<subparagraph id="HB8FEB595EAC94AB3A6758D942E8BAFA5"><enum>(A)</enum><text>the degree of flexibility afforded by the State’s public charter school law and how the State
			 entity will work to maximize the flexibility provided to charter schools
			 under the law;</text>
							</subparagraph><subparagraph id="HD9C6251E24BE4608A8F8A45F80C38305"><enum>(B)</enum><text>the ambitiousness of the State entity’s objectives for the quality charter school program carried
			 out under this section;</text>
							</subparagraph><subparagraph id="HBFB9DEE650A1404AAA0E3C26950387DE"><enum>(C)</enum><text>the quality of the strategy for assessing achievement of those objectives;</text>
							</subparagraph><subparagraph id="H05A37FD4A7614ACCBDB0DD15467ECDC9"><enum>(D)</enum><text>the likelihood that the eligible applicants receiving subgrants under the program will meet those
			 objectives and improve educational results for students;</text>
							</subparagraph><subparagraph id="HA9B30E94280B49688C92964391A34DAD"><enum>(E)</enum><text>the State entity’s plan to—</text>
								<clause id="H7E0B9C5788654326B90CCCEF3BC319A9"><enum>(i)</enum><text>adequately monitor the eligible applicants receiving subgrants under the State entity’s program;</text>
								</clause><clause id="HAAED2D3D0BA54C9F96AD73A027CB92CA"><enum>(ii)</enum><text>work with the authorized public chartering agencies involved to avoid duplication of work for the
			 charter schools and authorized public chartering agencies; and</text>
								</clause><clause commented="no" id="HCC5A47C25DD5462382C273BCBAE3C311"><enum>(iii)</enum><text>provide adequate technical assistance and support for—</text>
									<subclause commented="no" id="HAD55ECE195194AAEB7A4BA41278CAE95"><enum>(I)</enum><text>the charter schools receiving funds under the State entity’s program; and</text>
									</subclause><subclause commented="no" id="H63967901ABEE488492AD06B06145840E"><enum>(II)</enum><text>quality authorizing efforts in the State; and</text>
									</subclause></clause></subparagraph><subparagraph id="H798B02F0C90B489B986CFD138F88B64E"><enum>(F)</enum><text display-inline="yes-display-inline">the State entity’s plan to solicit and consider input from parents and other members of the
			 community on the implementation and operation of the charter schools in
			 the State.</text>
							</subparagraph></paragraph><paragraph id="HEBF36B21C95D4A40BE7D2ED8783D587C"><enum>(2)</enum><header>Priority</header><text>In awarding grants under this section, the Secretary shall give priority to State entities to the
			 extent that they meet the following criteria:</text>
							<subparagraph commented="no" id="H60F066FEB6344019AAA2858313D7C377"><enum>(A)</enum><text display-inline="yes-display-inline">In the case of a State entity located in a State that allows an entity other than a local
			 educational agency to be an authorized public chartering agency, the State
			 has a quality authorized public chartering agency that is an entity other
			 than a local educational agency.</text>
							</subparagraph><subparagraph id="H1E37F7C6D2C74661B0E61EFD0E042700"><enum>(B)</enum><text>The State entity is located in a State that does not impose any limitation on the number or
			 percentage of charter schools that may exist or the number or percentage
			 of students that may attend charter schools in the State.</text>
							</subparagraph><subparagraph id="H51E6531547C342FCAB35A2E0A0E08325"><enum>(C)</enum><text>The State entity is located in a State that ensures equitable financing, as compared to traditional
			 public schools, for charter schools and students in a prompt manner.</text>
							</subparagraph><subparagraph id="H10F09482EB904915A2D58F469477E9E7"><enum>(D)</enum><text>The State entity is located in a State that uses charter schools and best practices from charter
			 schools to help improve struggling schools and local educational agencies.</text>
							</subparagraph><subparagraph id="HEA203A0D79214ED3B122C905E36150B1"><enum>(E)</enum><text>The State entity partners with an organization that has a demonstrated record of success in
			 developing management organizations to support the development of charter
			 schools in the State.</text>
							</subparagraph><subparagraph id="H0F74EDDE5E384E2092104CA66EC6DC07"><enum>(F)</enum><text display-inline="yes-display-inline">The State entity supports charter schools that support at-risk students through activities such as
			 dropout prevention or dropout recovery.</text>
							</subparagraph><subparagraph id="HB192CD3E5B054563976F17234871B830"><enum>(G)</enum><text>The State entity authorizes all charter schools in the State to serve as school food authorities.</text>
							</subparagraph><subparagraph commented="no" id="H22379A00008A423691CE7A0138F3C407"><enum>(H)</enum><text>The State entity has taken steps to ensure that all authorizing public chartering agencies
			 implement best practices for charter school authorizing.</text>
							</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H9731F322F6494F36A81E0E714DCCCEC4"><enum>(g)</enum><header>Local uses of funds</header><text>An eligible applicant receiving a subgrant under this section shall use such funds to carry out
			 activities related to opening and preparing to operate a new charter
			 school, a replicated, high-quality charter school model, or an expanded,
			 high-quality charter school, such as—</text>
						<paragraph id="H64C9F67073914164A376EA2D493F76A1"><enum>(1)</enum><text display-inline="yes-display-inline">preparing teachers and school leaders, including through professional development;</text>
						</paragraph><paragraph id="HF1950A188AFD47B78FD2C262729E5D8F"><enum>(2)</enum><text>purchasing instructional materials; and</text>
						</paragraph><paragraph id="H6FF666A6F188443D941D45D351980286"><enum>(3)</enum><text>necessary renovations and minor facilities repairs (excluding construction).</text>
						</paragraph></subsection><subsection id="H52E3C51E8F444498A93C74E6BE45C2EE"><enum>(h)</enum><header>Reporting requirements</header><text display-inline="yes-display-inline">Each State entity receiving a grant under this section shall submit to the Secretary, at the end of
			 the third year of the 5-year grant period and at the end of such grant
			 period, a report on—</text>
						<paragraph id="HD4DC9579D966467AB0FE36BC4F732853"><enum>(1)</enum><text display-inline="yes-display-inline">the number of students served by each subgrant awarded under this section and, if applicable, how
			 many new students were served during each year of the subgrant period;</text>
						</paragraph><paragraph id="H3549AC98ECEE4C3D8C742F9B3F68E320"><enum>(2)</enum><text>the progress the State entity made toward meeting the priorities described in subsection (f)(2), as
			 applicable;</text>
						</paragraph><paragraph id="H6A6401CC4CE14F05A9DCCA6E16180C23"><enum>(3)</enum><text>how the State entity met the objectives of the quality charter school program described in the
			 State entity’s application under subsection (e);</text>
						</paragraph><paragraph id="H67A29F15A2B84C53885C55E8BB4B894F"><enum>(4)</enum><text>how the State entity complied with, and ensured that eligible applicants complied with, the
			 assurances described in the State entity’s application;</text>
						</paragraph><paragraph id="H36B8A13B6B98480A9617903748F7A9C4"><enum>(5)</enum><text display-inline="yes-display-inline">how the State entity worked with authorized public chartering agencies, including how the agencies
			 worked with the management company or leadership of the schools that
			 received subgrants under this section; and</text>
						</paragraph><paragraph id="HC8CA2D4DAE4F4D25A96C79ED088CD4C5"><enum>(6)</enum><text>the number of subgrants awarded under this section to carry out each of the following:</text>
							<subparagraph id="H62B26DD522D84327BFD1A2A25768F3AB"><enum>(A)</enum><text>The opening of new charter schools.</text>
							</subparagraph><subparagraph id="H956935FABE5C4241B54273CC58F96153"><enum>(B)</enum><text>The opening of replicated, high-quality charter school models.</text>
							</subparagraph><subparagraph id="H5CB371285A4A4A98AAECAB18305CFAA1"><enum>(C)</enum><text>The opening of expanded, high-quality charter schools.</text>
							</subparagraph></paragraph></subsection><subsection id="H5120B76803754AD284C509E812CC3B5B"><enum>(i)</enum><header>State entity defined</header><text>For purposes of this section, the term <term>State entity</term> means—</text>
						<paragraph id="H024AD99D117E4AD0A88DF0C4E5335DCE"><enum>(1)</enum><text>a State educational agency;</text>
						</paragraph><paragraph commented="no" id="HFAD7EC501E214245835399F0E8BFC5F9"><enum>(2)</enum><text>a State charter school board;</text>
						</paragraph><paragraph id="H98830137DFCE430AA63C85C614FFF69B"><enum>(3)</enum><text>a Governor of a State; or</text>
						</paragraph><paragraph commented="no" id="H4FE9F3724CB641A390321E840FEEC785"><enum>(4)</enum><text>a charter school support organization.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HC85C2D8029EE422F886D2246E158D8EB"><enum>6.</enum><header>Facilities Financing Assistance</header><text display-inline="no-display-inline">Section 5204 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221c">20 U.S.C. 7221c</external-xref>) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="HB7F55611925A48A1A30CC2E3F7848BC2" style="OLC">
				<section id="H763C1CB149BC49969BBFF8AD9602F94C"><enum>5204.</enum><header>Facilities Financing Assistance</header>
					<subsection id="H5CC1D9BEB4C04886BE58115854CA8DEC"><enum>(a)</enum><header>Grants to eligible entities</header>
						<paragraph id="HBADA30D8343B4686BD5DDFC2267B65DC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">From the amount reserved under section 5202(b)(1), the Secretary shall not use less than 50 percent
			 to award grants to eligible entities that have the highest-quality
			 applications approved under subsection (d), after considering the
			 diversity of such applications, to demonstrate innovative methods of
			 assisting charter schools to address the cost of acquiring, constructing,
			 and renovating facilities by enhancing the availability of loans or bond
			 financing.</text>
						</paragraph><paragraph id="H026199FBDF854119831893AD0FF46CB7"><enum>(2)</enum><header>Eligible entity defined</header><text>For purposes of this section, the term <term>eligible entity</term> means—</text>
							<subparagraph id="HD43C5F3D112D49A080C868D1E4CFC2A2"><enum>(A)</enum><text>a public entity, such as a State or local governmental entity;</text>
							</subparagraph><subparagraph id="HFE81843003964B7A8592B03D1DD9B312"><enum>(B)</enum><text>a private nonprofit entity; or</text>
							</subparagraph><subparagraph id="HC7E994C9130F497B93F786D0AB8A4D8E"><enum>(C)</enum><text>a consortium of entities described in subparagraphs (A) and (B).</text>
							</subparagraph></paragraph></subsection><subsection id="H4D552A20E1E948088024C9744F976B23"><enum>(b)</enum><header>Grantee Selection</header><text display-inline="yes-display-inline">The Secretary shall evaluate each application submitted under subsection (d), and shall determine
			 whether the application is sufficient to merit approval.</text>
					</subsection><subsection id="HC80EC7E0C5B648C293500FE4A5740E54"><enum>(c)</enum><header>Grant Characteristics</header><text>Grants under subsection (a) shall be of a sufficient size, scope, and quality so as to ensure an
			 effective demonstration of an innovative means of enhancing credit for the
			 financing of charter school acquisition, construction, or renovation.</text>
					</subsection><subsection id="H47C8F676B037458E99367D610E43C9DC"><enum>(d)</enum><header>Applications</header>
						<paragraph id="H529C077A94714F1C99131C918B3AD3E2"><enum>(1)</enum><header>In general</header><text>To receive a grant under subsection (a), an eligible entity shall submit to the Secretary an
			 application in such form as the Secretary may reasonably require.</text>
						</paragraph><paragraph id="HD14B492C8BF547AA84A558028CEB4AD0"><enum>(2)</enum><header>Contents</header><text>An application submitted under paragraph (1) shall contain—</text>
							<subparagraph id="H7C949441FBA94E8889AAA55EAE480594"><enum>(A)</enum><text>a statement identifying the activities proposed to be undertaken with funds received under
			 subsection (a), including how the eligible entity will determine which
			 charter schools will receive assistance, and how much and what types of
			 assistance charter schools will receive;</text>
							</subparagraph><subparagraph id="HA206BAFF6E764A0CA1F77C52FAA3117C"><enum>(B)</enum><text>a description of the involvement of charter schools in the application’s development and the design
			 of the proposed activities;</text>
							</subparagraph><subparagraph id="HA3EDF403141A4F57AEC3B60A40F07AC3"><enum>(C)</enum><text>a description of the eligible entity’s expertise in capital market financing;</text>
							</subparagraph><subparagraph id="H2B2D4D2C37E44D6BBDFC00C8483DC530"><enum>(D)</enum><text>a description of how the proposed activities will leverage the maximum amount of private-sector
			 financing capital relative to the amount of public funding used and
			 otherwise enhance credit available to charter schools, including how the
			 eligible entity will offer a combination of rates and terms more favorable
			 than the rates and terms that a charter school could receive without
			 assistance from the eligible entity under this section;</text>
							</subparagraph><subparagraph id="HABCE27093F8B434DBC861D14267F7F8D"><enum>(E)</enum><text>a description of how the eligible entity possesses sufficient expertise in education to evaluate
			 the likelihood of success of a charter school program for which facilities
			 financing is sought; and</text>
							</subparagraph><subparagraph id="H4AC1018E88E24C2A93E51E4E47B908C0"><enum>(F)</enum><text>in the case of an application submitted by a State governmental entity, a description of the
			 actions that the entity has taken, or will take, to ensure that charter
			 schools within the State receive the funding the charter schools need to
			 have adequate facilities.</text>
							</subparagraph></paragraph></subsection><subsection id="H053895D530F2426BA365121FDAA96E09"><enum>(e)</enum><header>Charter school objectives</header><text>An eligible entity receiving a grant under this section shall use the funds deposited in the
			 reserve account established under subsection (f) to assist one or more
			 charter schools to access private sector capital to accomplish one or more
			 of the following objectives:</text>
						<paragraph id="HA39C13614A5A40DE9AAA0148617C398F"><enum>(1)</enum><text>The acquisition (by purchase, lease, donation, or otherwise) of an interest (including an interest
			 held by a third party for the benefit of a charter school) in improved or
			 unimproved real property that is necessary to commence or continue the
			 operation of a charter school.</text>
						</paragraph><paragraph id="HFF2C122AB90A4A799E411A64BCC2F2DE"><enum>(2)</enum><text>The construction of new facilities, or the renovation, repair, or alteration of existing
			 facilities, necessary to commence or continue the operation of a charter
			 school.</text>
						</paragraph><paragraph commented="no" id="HB05AD5A03C5A4556A480C286BDC37210"><enum>(3)</enum><text display-inline="yes-display-inline">The predevelopment costs required to assess sites for purposes of paragraph (1) or (2) and which
			 are necessary to commence or continue the operation of a charter school.</text>
						</paragraph></subsection><subsection id="HD956EC188FB54021958EF4FD0534FE8B"><enum>(f)</enum><header>Reserve account</header>
						<paragraph id="H7D7421A5B4424E21A8A610E11ECB5CFA"><enum>(1)</enum><header>Use of funds</header><text display-inline="yes-display-inline">To assist charter schools to accomplish the objectives described in subsection (e), an eligible
			 entity receiving a grant under subsection (a) shall, in accordance with
			 State and local law, directly or indirectly, alone or in collaboration
			 with others, deposit the funds received under subsection (a) (other than
			 funds used for administrative costs in accordance with subsection (g)) in
			 a reserve account established and maintained by the eligible entity for
			 this purpose. Amounts deposited in such account shall be used by the
			 eligible entity for one or more of the following purposes:</text>
							<subparagraph id="H8E124E906FC54CDDB4170A7F13FCFC77"><enum>(A)</enum><text>Guaranteeing, insuring, and reinsuring bonds, notes, evidences of debt, loans, and interests
			 therein, the proceeds of which are used for an objective described in
			 subsection (e).</text>
							</subparagraph><subparagraph id="H68D8D8C52F23462DB8DEEEE2B3713D71"><enum>(B)</enum><text>Guaranteeing and insuring leases of personal and real property for an objective described in
			 subsection (e).</text>
							</subparagraph><subparagraph id="HEE3B116BA058431BB712353AEF820C86"><enum>(C)</enum><text>Facilitating financing by identifying potential lending sources, encouraging private lending, and
			 other similar activities that directly promote lending to, or for the
			 benefit of, charter schools.</text>
							</subparagraph><subparagraph id="HAAB624F99B0549689E7C4F7151503992"><enum>(D)</enum><text>Facilitating the issuance of bonds by charter schools, or by other public entities for the benefit
			 of charter schools, by providing technical, administrative, and other
			 appropriate assistance (including the recruitment of bond counsel,
			 underwriters, and potential investors and the consolidation of multiple
			 charter school projects within a single bond issue).</text>
							</subparagraph></paragraph><paragraph id="HF271DB88E41F45739261EF496731AF18"><enum>(2)</enum><header>Investment</header><text>Funds received under this section and deposited in the reserve account established under paragraph
			 (1) shall be invested in obligations issued or guaranteed by the United
			 States or a State, or in other similarly low-risk securities.</text>
						</paragraph><paragraph id="H752DD18D84E14CE49098BC4BF39FF9FB"><enum>(3)</enum><header>Reinvestment of Earnings</header><text>Any earnings on funds received under subsection (a) shall be deposited in the reserve account
			 established under paragraph (1) and used in accordance with such
			 paragraph.</text>
						</paragraph></subsection><subsection id="HD7987E19FEEA4EBE877B02F1C602C472"><enum>(g)</enum><header>Limitation on administrative costs</header><text>An eligible entity may use not more than 2.5 percent of the funds received under subsection (a) for
			 the administrative costs of carrying out its responsibilities under this
			 section (excluding subsection (k)).</text>
					</subsection><subsection id="HA901623658834BC08A6BBA449A1868D2"><enum>(h)</enum><header>Audits and reports</header>
						<paragraph id="H56444CCF5CC94A6FB751C5F69CD4626E"><enum>(1)</enum><header>Financial Record Maintenance and Audit</header><text>The financial records of each eligible entity receiving a grant under subsection (a) shall be
			 maintained in accordance with generally accepted accounting principles and
			 shall be subject to an annual audit by an independent public accountant.</text>
						</paragraph><paragraph id="HBF8770F83D5F476B9E5C557D87424B78"><enum>(2)</enum><header>Reports</header>
							<subparagraph id="H01F91BA8762C4A1997ED96E007781602"><enum>(A)</enum><header>Grantee annual reports</header><text display-inline="yes-display-inline">Each eligible entity receiving a grant under subsection (a) annually shall submit to the Secretary
			 a report of its operations and activities under this section.</text>
							</subparagraph><subparagraph id="H8ED65F9E1A32411587C273938C429D79"><enum>(B)</enum><header>Contents</header><text>Each annual report submitted under subparagraph (A) shall include—</text>
								<clause id="H9002EC325AB24C198A2ED620C90C3707"><enum>(i)</enum><text>a copy of the most recent financial statements, and any accompanying opinion on such statements,
			 prepared by the independent public accountant reviewing the financial
			 records of the eligible entity;</text>
								</clause><clause id="H3F4B2C2D8FEE4469939C4F9666D452BB"><enum>(ii)</enum><text>a copy of any report made on an audit of the financial records of the eligible entity that was
			 conducted under paragraph (1) during the reporting period;</text>
								</clause><clause id="HF8AEF10DD9604FDCA74ACE9B5DA50A3B"><enum>(iii)</enum><text>an evaluation by the eligible entity of the effectiveness of its use of the Federal funds provided
			 under subsection (a) in leveraging private funds;</text>
								</clause><clause id="H82DD91A3566C446285920530CA5BC579"><enum>(iv)</enum><text>a listing and description of the charter schools served during the reporting period, including the
			 amount of funds used by each school, the type of project facilitated by
			 the grant, and the type of assistance provided to the charter schools;</text>
								</clause><clause id="H5FB006B0BA8E4B349207A4FBF024353D"><enum>(v)</enum><text>a description of the activities carried out by the eligible entity to assist charter schools in
			 meeting the objectives set forth in subsection (e); and</text>
								</clause><clause id="HDF7CBBF4D44C487EA1F86CE675EE7537"><enum>(vi)</enum><text>a description of the characteristics of lenders and other financial institutions participating in
			 the activities undertaken by the eligible entity under this section
			 (excluding subsection (k)) during the reporting period.</text>
								</clause></subparagraph><subparagraph id="H9174742607E0476DA659FCF484CC9C2E"><enum>(C)</enum><header>Secretarial report</header><text display-inline="yes-display-inline">The Secretary shall review the reports submitted under subparagraph (A) and shall provide a
			 comprehensive annual report to Congress on the activities conducted under
			 this section (excluding subsection (k)).</text>
							</subparagraph></paragraph></subsection><subsection id="HC6FD25102FC44D7786B1E08597B1FA1C"><enum>(i)</enum><header>No full faith and credit for grantee obligation</header><text display-inline="yes-display-inline">No financial obligation of an eligible entity entered into pursuant to this section (such as an
			 obligation under a guarantee, bond, note, evidence of debt, or loan) shall
			 be an obligation of, or guaranteed in any respect by, the United States.
			 The full faith and credit of the United States is not pledged to the
			 payment of funds which may be required to be paid under any obligation
			 made by an eligible entity pursuant to any provision of this section.</text>
					</subsection><subsection id="HED683E7E6E3C4258900BAEA48F9642C7"><enum>(j)</enum><header>Recovery of funds</header>
						<paragraph id="H04303CC75A834FFAB397B0BB3AA7DFAE"><enum>(1)</enum><header>In General</header><text>The Secretary, in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/37">chapter 37</external-xref> of title 31, United States Code, shall collect—</text>
							<subparagraph id="H30515AC030124A489C7182E118F69470"><enum>(A)</enum><text>all of the funds in a reserve account established by an eligible entity under subsection (f)(1) if
			 the Secretary determines, not earlier than 2 years after the date on which
			 the eligible entity first received funds under this section (excluding
			 subsection (k)), that the eligible entity has failed to make substantial
			 progress in carrying out the purposes described in subsection (f)(1); or</text>
							</subparagraph><subparagraph id="HADE0CBD0CAB94EE5B543FF851FFA23F8"><enum>(B)</enum><text>all or a portion of the funds in a reserve account established by an eligible entity under
			 subsection (f)(1) if the Secretary determines that the eligible entity has
			 permanently ceased to use all or a portion of the funds in such account to
			 accomplish any purpose described in subsection (f)(1).</text>
							</subparagraph></paragraph><paragraph id="HFA77EC1206CC4B6DA327302715637E3F"><enum>(2)</enum><header>Exercise of Authority</header><text>The Secretary shall not exercise the authority provided in paragraph (1) to collect from any
			 eligible entity any funds that are being properly used to achieve one or
			 more of the purposes described in subsection (f)(1).</text>
						</paragraph><paragraph id="H1215DEBE16AA4E96BECAD5C47520F9DD"><enum>(3)</enum><header> Procedures</header><text>The provisions of sections 451, 452, and 458 of the General Education Provisions Act <external-xref legal-doc="usc" parsable-cite="usc/20/124">20 U.S.C. 124</external-xref>,
			 1234a, 1234g shall apply to the recovery of funds under paragraph (1).</text>
						</paragraph><paragraph id="H26DF31CBA5834A0CBDD24BFB0F85ED28"><enum>(4)</enum><header>Construction</header><text>This subsection shall not be construed to impair or affect the authority of the Secretary to
			 recover funds under part D of the General Education Provisions Act (20
			 U.S.C. 1234 et seq.).</text>
						</paragraph></subsection><subsection commented="no" id="HE619E354A0A241A39E0E7E90C99A36E1"><enum>(k)</enum><header>Per-Pupil facilities aid program</header>
						<paragraph commented="no" id="HF14A32B625C440AC950FAA83A91E23DE"><enum>(1)</enum><header>Definition of per-pupil facilities aid program</header><text display-inline="yes-display-inline">In this subsection, the term <term>per-pupil facilities aid program</term> means a program in which a State makes payments, on a per-pupil basis, to charter schools to
			 provide the schools with financing—</text>
							<subparagraph commented="no" id="H84DA11230A2840648536747B62E10FA4"><enum>(A)</enum><text>that is dedicated solely for funding charter school facilities; or</text>
							</subparagraph><subparagraph commented="no" id="H0F76BBF445324DA49D1C229F9495819F"><enum>(B)</enum><text>a portion of which is dedicated for funding charter school facilities.</text>
							</subparagraph></paragraph><paragraph commented="no" id="H8083D7EE301643BD825822FF132160FE"><enum>(2)</enum><header>Grants</header>
							<subparagraph commented="no" id="H5E62B8C08E3B4F6D9A7C8B497757850E"><enum>(A)</enum><header>In general</header><text>From the amount under section 5202(b)(1) remaining after the Secretary makes grants under
			 subsection (a), the Secretary shall make grants, on a competitive basis,
			 to States to pay for the Federal share of the cost of establishing or
			 enhancing, and administering per-pupil facilities aid programs.</text>
							</subparagraph><subparagraph commented="no" id="H2677BF167708400B86562FE5FF9E4BE5"><enum>(B)</enum><header>Period</header><text>The Secretary shall award grants under this subsection for periods of not more than 5 years.</text>
							</subparagraph><subparagraph commented="no" id="HDDABB6F425774FB1B74F98B50B3AD341"><enum>(C)</enum><header>Federal share</header><text>The Federal share of the cost described in subparagraph (A) for a per-pupil facilities aid program
			 shall be not more than—</text>
								<clause commented="no" id="H8E2A7C51440744E58628E843CC64BF61"><enum>(i)</enum><text>90 percent of the cost, for the first fiscal year for which the program receives assistance under
			 this subsection;</text>
								</clause><clause commented="no" id="HDF8D3C186BD3431BB1C0A33CC81A717D"><enum>(ii)</enum><text>80 percent in the second such year;</text>
								</clause><clause commented="no" id="HB884278D29F94AE6BDEC2335FF22A4E2"><enum>(iii)</enum><text>60 percent in the third such year;</text>
								</clause><clause commented="no" id="HEC29EC5479DF4025A721EEB3B1646BD0"><enum>(iv)</enum><text>40 percent in the fourth such year; and</text>
								</clause><clause commented="no" id="H68A2BD9223D641DFAB3460B2926AB4F7"><enum>(v)</enum><text>20 percent in the fifth such year.</text>
								</clause></subparagraph><subparagraph commented="no" id="H79FE26FF5D114855B031C37B0DF457F3"><enum>(D)</enum><header>State share</header><text display-inline="yes-display-inline">A State receiving a grant under this subsection may partner with 1 or more organizations to provide
			 up to 50 percent of the State share of the cost of establishing or
			 enhancing, and administering the per-pupil facilities aid program.</text>
							</subparagraph><subparagraph commented="no" id="HCE858A7339AB473AADE841FB800A0A12"><enum>(E)</enum><header>Multiple grants</header><text>A State may receive more than 1 grant under this subsection, so long as the amount of such funds
			 provided to charter schools increases with each successive grant.</text>
							</subparagraph></paragraph><paragraph commented="no" id="HB7883A147D4646F1B7A4272F46367445"><enum>(3)</enum><header>Use of funds</header>
							<subparagraph commented="no" id="H5D364718189549DF88399D4C02C1582E"><enum>(A)</enum><header>In general</header><text>A State that receives a grant under this subsection shall use the funds made available through the
			 grant to establish or enhance, and administer, a per-pupil facilities aid
			 program for charter schools in the State of the applicant.</text>
							</subparagraph><subparagraph commented="no" id="H0D1CC70947394143B49582D364900D2F"><enum>(B)</enum><header>Evaluations; technical assistance; dissemination</header><text>From the amount made available to a State through a grant under this subsection for a fiscal year,
			 the State may reserve not more than 5 percent to carry out evaluations, to
			 provide technical assistance, and to disseminate information.</text>
							</subparagraph><subparagraph commented="no" id="H310DA7773BDB4FCBACE06EB5B6ACD09C"><enum>(C)</enum><header>Supplement, not supplant</header><text>Funds made available under this subsection shall be used to supplement, and not supplant, State and
			 local public funds expended to provide per pupil facilities aid programs,
			 operations financing programs, or other programs, for charter schools.</text>
							</subparagraph></paragraph><paragraph commented="no" id="HD8D8FC8FBAD04F56975D6357993B7500"><enum>(4)</enum><header>Requirements</header>
							<subparagraph commented="no" id="H5C2810D7A98F40BE99DFE2ED73A4AC26"><enum>(A)</enum><header>Voluntary participation</header><text>No State may be required to participate in a program carried out under this subsection.</text>
							</subparagraph><subparagraph commented="no" id="HB57168E0255242869C47AFAE324AE4B8"><enum>(B)</enum><header>State law</header>
								<clause commented="no" id="H2AFC5135A4F24C108632E719568BD939"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), to be eligible to receive a grant under this subsection, a State
			 shall establish or enhance, and administer, a per-pupil facilities aid
			 program for charter schools in the State, that—</text>
									<subclause commented="no" id="HF3569AB4B4AD44C5B0D4D5996A6E151C"><enum>(I)</enum><text>is specified in State law; and</text>
									</subclause><subclause commented="no" id="H70ADAFA49A4447D7845FF09900DAD51E"><enum>(II)</enum><text>provides annual financing, on a per-pupil basis, for charter school facilities.</text>
									</subclause></clause><clause commented="no" id="H792444868A534592A8C2E3540047237A"><enum>(ii)</enum><header>Special Rule</header><text display-inline="yes-display-inline">Notwithstanding clause (i), a State that is required under State law to provide its charter schools
			 with access to adequate facility space, but which does not have a
			 per-pupil facilities aid program for charter schools specified in State
			 law, may be eligible to receive a grant under this subsection if the State
			 agrees to use the funds to develop a per-pupil facilities aid program
			 consistent with the requirements of this subsection.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" id="H9C249E3E4584434E84729CC19B095C6B"><enum>(5)</enum><header>Applications</header><text>To be eligible to receive a grant under this subsection, a State shall submit an application to the
			 Secretary at such time, in such manner, and containing such information as
			 the Secretary may require.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HC704D796A3674AABB5F03D13389A8E58"><enum>7.</enum><header>National activities</header><text display-inline="no-display-inline">Section 5205 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221d">20 U.S.C. 7221d</external-xref>) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="HE57F96A2CE654185BE3F815E89F7B2DC" style="OLC">
				<section id="H57F13BE809134FCE935EC94D30B58268"><enum>5205.</enum><header>National Activities</header>
					<subsection id="H4D4BBEFA3F174AF2A7B335D80F728BC0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">From the amount reserved under section 5202(b)(2), the Secretary shall—</text>
						<paragraph id="HBFDA186F245C417FA9F263897531AE1F"><enum>(1)</enum><text>use not less than 75 percent of such funds to award grants in accordance with subsection (b); and</text>
						</paragraph><paragraph id="HB8047B41BFD0424EAFF8C275D8F7B0BB"><enum>(2)</enum><text>use not more than 25 percent of such funds to—</text>
							<subparagraph id="H8426EBDD37B748EA8685A1F7298176DA"><enum>(A)</enum><text display-inline="yes-display-inline">disseminate technical assistance to State entities in awarding subgrants under section 5203, and
			 eligible entities and States receiving grants under section 5204;</text>
							</subparagraph><subparagraph id="H07D7D9CE9554487DAAB6797B2169EE03"><enum>(B)</enum><text>disseminate best practices; and</text>
							</subparagraph><subparagraph id="H324972FF7E814A2DA8C744733562C8EC"><enum>(C)</enum><text>evaluate the impact of the charter school program, including the impact on student achievement,
			 carried out under this subpart.</text>
							</subparagraph></paragraph></subsection><subsection id="H94C3D1B4FA6F41E18F49F5CC4838D684"><enum>(b)</enum><header> Grants</header>
						<paragraph id="H1ABBDE4F70A74685AC57E8E105B65EED"><enum>(1)</enum><header>In general</header><text>The Secretary shall make grants, on a competitive basis, to eligible applicants for the purpose of
			 carrying out the activities described in section 5202(a)(1), subparagraphs
			 (A) through (C) of section 5203(a)(1), and section 5203(g).</text>
						</paragraph><paragraph id="H5C013F464F15406E89379CBA21CBEB03"><enum>(2)</enum><header>Terms and conditions</header><text>Except as otherwise provided in this subsection, grants awarded under this subsection shall have
			 the same terms and conditions as grants awarded to State entities under
			 section 5203.</text>
						</paragraph><paragraph commented="no" id="H229C4851E94A4243820D367871824084"><enum>(3)</enum><header>Charter management organizations</header><text>The Secretary shall—</text>
							<subparagraph id="H6F3F2591723F44BCB2084FF59C53FDE9"><enum>(A)</enum><text>use not less than 75 percent of the funds described in subsection (a)(1) to make grants, on a
			 competitive basis, to eligible applicants described in paragraph (4)(C);
			 and</text>
							</subparagraph><subparagraph id="H37A4F6EE1446481EB249FD6132BBEDA9"><enum>(B)</enum><text>notwithstanding paragraphs (1)(A) and (2) of section 5203(f)—</text>
								<clause id="HA3A6ADB461664A1998FAFC9C8B2D9500"><enum>(i)</enum><text>award grants to eligible applicants on the basis of the quality of the applications submitted under
			 this subsection; and</text>
								</clause><clause id="H3FE2CF6F99FC42AD9E173CE393338643"><enum>(ii)</enum><text display-inline="yes-display-inline">in awarding grants to eligible applicants described in paragraph (4)(C), give priority to each such
			 eligible applicant that—</text>
									<subclause id="HF5115FBB4D6F425B97679BE3FBE2A5B0"><enum>(I)</enum><text>demonstrates a high proportion of high-quality charter schools within the network of the eligible
			 applicant;</text>
									</subclause><subclause id="H8C4D618EFDDE40D79FC5C4C80FAD6388"><enum>(II)</enum><text>demonstrates success in serving students who are educationally disadvantaged;</text>
									</subclause><subclause id="HC4C794ECBB7A4736BF16239693D70C4E"><enum>(III)</enum><text>does not have a significant proportion of charter schools that have been closed, had the charter
			 revoked for compliance issues, or the affiliation with such eligible
			 applicant revoked;</text>
									</subclause><subclause id="H11F2D72D364C4991B924A0D48D7322F1"><enum>(IV)</enum><text>has sufficient procedures in effect to ensure timely closure of low-performing or
			 financially mismanaged charter schools and clear plans and procedures in
			 effect for the students in such schools to attend other high-quality
			 schools; and</text>
									</subclause><subclause id="HBC4DA59ADDCE4CF794BCBE92935F72B9"><enum>(V)</enum><text>demonstrates success in working with schools identified for improvement by the State.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="H82408286C42B492D91D462ACA35B0D35"><enum>(4)</enum><header>Eligible applicant defined</header><text>For purposes of this subsection, the term <term>eligible applicant</term> means an eligible applicant (as defined in section 5210) that—</text>
							<subparagraph id="H0011A90CA5EE4D69B2867ED34B725464"><enum>(A)</enum><text>desires to open a charter school in—</text>
								<clause id="H7832AD63E59A4BCAB6BF6CA7AF147073"><enum>(i)</enum><text>a State that did not apply for a grant under section 5203; or</text>
								</clause><clause id="HBD93ED0E27DD4B8F972F512B3BB6CF6F"><enum>(ii)</enum><text>a State that did not receive a grant under section 5203; or</text>
								</clause></subparagraph><subparagraph commented="no" id="H383E16AE3700469EAF8464D9FD030165"><enum>(B)</enum><text>is a charter management organization.</text>
							</subparagraph></paragraph></subsection><subsection id="HE003A7C3CC674B0FBAEF83CECF1CFEAC"><enum>(c)</enum><header>Contracts and grants</header><text display-inline="yes-display-inline">The Secretary may carry out any of the activities described in this section directly or through
			 grants, contracts, or cooperative agreements.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H8D8232D2F418483191E0D6D6C3AF2DF2"><enum>8.</enum><header>Records transfer</header><text display-inline="no-display-inline">Section 5208 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221g">20 U.S.C. 7221g</external-xref>) is amended—</text>
			<paragraph id="H1B276E5104E44A2CB189B20B2AC02BFB"><enum>(1)</enum><text>by inserting <quote>as quickly as possible and</quote> before <quote>to the extent practicable</quote>; and</text>
			</paragraph><paragraph id="H20AD015957B240B1AE6A74B8EEE75260"><enum>(2)</enum><text>by striking <quote>section 602</quote> and inserting <quote>section 602(14)</quote>.</text>
			</paragraph></section><section id="HEBF63517D4DB4238BB824C4D25604881"><enum>9.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 5210 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221i">20 U.S.C. 7221i</external-xref>) is amended—</text>
			<paragraph id="H15A47B57FE594D6E895612A892CB0BF6"><enum>(1)</enum><text>by amending paragraph (1) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H0DBBF0C9BB1D468B8039B732387FFC08" style="OLC">
					<paragraph id="H608A412F7A8D465799A5368E4E3A8E36"><enum>(1)</enum><header>Charter school</header><text display-inline="yes-display-inline">The term <term>charter school</term> means a public school that—</text>
						<subparagraph id="HEE400F3F3DD94BA6967490E8413E0440"><enum>(A)</enum><text display-inline="yes-display-inline">in accordance with a specific State statute authorizing the granting of charters to schools, is
			 exempt from significant State or local rules that inhibit the flexible
			 operation and management of public schools, but not from any rules
			 relating to the other requirements of this paragraph;</text>
						</subparagraph><subparagraph id="HC1DB9F36D0F74A9EBA25154E96524D8E"><enum>(B)</enum><text display-inline="yes-display-inline">is created by a developer as a public school, or is adapted by a developer from an existing public
			 school, and is operated under public supervision and direction;</text>
						</subparagraph><subparagraph id="H1231171AC746498E9AD850DCE83DF3CB"><enum>(C)</enum><text display-inline="yes-display-inline">operates in pursuit of a specific set of educational objectives determined by the school’s
			 developer and agreed to by the authorized public chartering agency;</text>
						</subparagraph><subparagraph id="H2DF9E54B43024B0E9F3A1C7B635AA8C3"><enum>(D)</enum><text display-inline="yes-display-inline">provides a program of elementary or secondary education, or both;</text>
						</subparagraph><subparagraph id="H6D03809FB9DB41DF85A31196B38471E8"><enum>(E)</enum><text display-inline="yes-display-inline">is nonsectarian in its programs, admissions policies, employment practices, and all other
			 operations, and is not affiliated with a sectarian school or religious
			 institution;</text>
						</subparagraph><subparagraph id="HE2697F84869D4E659FE07CA649DBD8AB"><enum>(F)</enum><text display-inline="yes-display-inline">does not charge tuition;</text>
						</subparagraph><subparagraph id="HC122E7E4E773483ABECCCFBE2A0E5049"><enum>(G)</enum><text display-inline="yes-display-inline">complies with the Age Discrimination Act of 1975, title VI of the Civil Rights Act of 1964, title
			 IX of the Education Amendments of 1972, section 504 of the Rehabilitation
			 Act of 1973, part B of the Individuals with Disabilities Education Act,
			 the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>), and
			 section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232">20 U.S.C. 1232(g)</external-xref>)
			 (commonly known as the <quote>Family Education Rights and Privacy Act of 1974</quote>);</text>
						</subparagraph><subparagraph id="HCFE7878279E84EF295ADF1176C0D60F2"><enum>(H)</enum><text display-inline="yes-display-inline">is a school to which parents choose to send their children, and admits students on the basis of a
			 lottery if more students apply for admission than can be accommodated,
			 except that in cases in which students who are enrolled in an affiliated
			 charter school (such as one that is part of the same network) in the
			 immediate prior grade level are automatically enrolled, and, in such
			 exceptions, a lottery is used to fill seats created through regular
			 attrition in student enrollment in the affiliated charter school and the
			 enrolling charter school;</text>
						</subparagraph><subparagraph id="H7D41C2487B11471FB0973B0FE1393950"><enum>(I)</enum><text display-inline="yes-display-inline">agrees to comply with the same Federal and State audit requirements as do other elementary schools
			 and secondary schools in the State, unless such State audit requirements
			 are waived by the State;</text>
						</subparagraph><subparagraph id="HE076E957E560469F89AC05CFD0F1BF93"><enum>(J)</enum><text display-inline="yes-display-inline">meets all applicable Federal, State, and local health and safety requirements;</text>
						</subparagraph><subparagraph id="H3ABA5C56205842FDA733798057052AB0"><enum>(K)</enum><text display-inline="yes-display-inline">operates in accordance with State law;</text>
						</subparagraph><subparagraph id="H9F50188A546E480AAE913EB58BDEB141"><enum>(L)</enum><text display-inline="yes-display-inline">has a written performance contract with the authorized public chartering agency in the State that
			 includes a description of how student performance will be measured in
			 charter schools pursuant to State assessments that are required of other
			 schools and pursuant to any other assessments mutually agreeable to the
			 authorized public chartering agency and the charter school; and</text>
						</subparagraph><subparagraph id="HC6CFF959539842869C23330A28D77300"><enum>(M)</enum><text>may serve prekindergarten or postsecondary students.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HA4D9BCDE2DA44DAFA100040B6DDC9117"><enum>(2)</enum><text>by redesignating paragraphs (2) through (4) as paragraphs (4) through (6), respectively;</text>
			</paragraph><paragraph id="H7EC1BF0EDED6449382781E484DABAC66"><enum>(3)</enum><text>by inserting after paragraph (1), the following:</text>

			 centralized support, operations, and oversight.</text>
					</paragraph><paragraph commented="no" id="H0B461A192F73435BB84AEB0DB5408D6B"><enum>(3)</enum><header>Charter school support organization</header><text>The term <term>charter school support organization</term> means a nonprofit, nongovernmental entity that is not an authorized public chartering agency,
			 which provides on a statewide basis—</text>
						<subparagraph commented="no" id="H04EACB73E86041E18D113A77DB5B8A7E"><enum>(A)</enum><text>assistance to developers during the planning, program design, and initial implementation of a
			 charter school; and</text>
						</subparagraph><subparagraph commented="no" id="HCF359186E56643EEB4010A7A49F7C29E"><enum>(B)</enum><text>technical assistance to charter schools to operate such schools.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HB9904AD8C823473CACB2341573FF84FA"><enum>(4)</enum><text>in paragraph (5)(B), as so redesignated, by striking <quote>under section 5203(d)(3)</quote>; and</text>
			</paragraph><paragraph id="H12B36C42CD4943C1984D5DEA88314243"><enum>(5)</enum><text>by adding at the end the following:</text>

					</paragraph><paragraph id="HF4119A2411AA4B2783CDAA33DB3B31A5"><enum>(6)</enum><header>High-quality charter school</header><text>The term <term>high-quality charter school</term> means a charter school that—</text>
						<subparagraph id="H761D25E391324E5889165B37B5A1122A"><enum>(A)</enum><text>shows evidence of strong academic results, which may include strong academic growth as determined
			 by a State;</text>
						</subparagraph><subparagraph id="HF04877CF5C794EE6848CA89B83E82B6F"><enum>(B)</enum><text>has no significant issues in the areas of student safety, operational and financial management, or
			 statutory or regulatory compliance;</text>
						</subparagraph><subparagraph id="HF35C34D83E8E4ED793E319DC5FEFB76F"><enum>(C)</enum><text display-inline="yes-display-inline">has demonstrated success in significantly increasing student academic achievement, including
			 graduation rates where applicable, consistent with the requirements under
			 title I, for all students served by the charter school; and</text>
						</subparagraph><subparagraph id="H349759BD324946F4BF3DA5CF1B7738F6"><enum>(D)</enum><text display-inline="yes-display-inline">has demonstrated success in increasing student academic achievement, including graduation rates
			 where applicable, for the groups of students described in section
			 1111(b)(2)(C)(v)(II), except that such demonstration is not required in a
			 case in which the number of students in a group is insufficient to yield
			 statistically reliable information or the results would reveal personally
			 identifiable information about an individual student.</text>
						</subparagraph></paragraph><paragraph id="H81EC351221344ACD910CED1B6BB69D42"><enum>(7)</enum><header>Replicated, high-quality charter school model</header><text display-inline="yes-display-inline">The term <term>replicated, high-quality charter school model</term> means a high-quality charter school that has opened a new campus under an existing charter.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H5ECEB6C27A084E0C82470E3F391D83FD"><enum>10.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 5211 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221j">20 U.S.C. 7221j</external-xref>) is amended to read as follows:</text>
