		<official-title>To authorize the National Desert Storm Memorial
		  Association to establish the National Desert Storm and Desert Shield Memorial
		  as a commemorative work in the District of Columbia, and for other
		  purposes.</official-title>

		<section id="HDE3B2AC060C848B9ADE597F3D4AEFA3B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Desert Storm and Desert
			 Shield War Memorial Act</short-title></quote>.</text>
		</section><section id="H28D950253CEE46CBB934CF8FC2CA1BC3"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H24EF5A690E0145FDB1AE6A0BF2A1D466"><enum>(1)</enum><header>Association</header><text display-inline="yes-display-inline">The term <term>Association</term> means the
			 National Desert Storm Memorial Association, a corporation that is—</text>
				<subparagraph id="id40024E3E4B0B4C3BB80EFD134B8D86C1"><enum>(A)</enum><text display-inline="yes-display-inline">organized under the laws of the State of
			 Arkansas; and</text>
				</subparagraph><subparagraph id="id91CF63518AC541AAA81F313924660409"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id88FC5450E5F34905AAEA6D9E7530494F"><enum>(i)</enum><text display-inline="yes-display-inline">described in section 501(c)(3) of the
			 Internal Revenue Code of 1986; and</text>
					</clause><clause id="id6F2115BCD1AE4F07A576BC9D16D52B67" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">exempt from taxation under 501(a) of that
			 Code.</text>
					</clause></subparagraph></paragraph><paragraph id="H5077D0E4A46648F79F87F2CB6D41E9B8"><enum>(2)</enum><header>Memorial</header><text display-inline="yes-display-inline">The term <term>memorial</term> means the
			 National Desert Storm and Desert Shield Memorial authorized to be established
			 under section 3.</text>
			</paragraph></section><section id="H7F2F3CFF96E241EA8FC638D67EB41449"><enum>3.</enum><header>National desert
			 storm and desert shield Memorial</header>
			<subsection id="H5AA75162CA074F0996000A6F06B9F870"><enum>(a)</enum><header>Authorization To
			 establish commemorative work</header><text display-inline="yes-display-inline">The Association may establish the National
			 Desert Storm and Desert Shield Memorial as a commemorative work, on Federal
			 land in the District of Columbia to commemorate and honor the members of the
			 Armed Forces that served on active duty in support of Operation Desert Storm or
			 Operation Desert Shield.</text>
			</subsection><subsection id="HF9F56F911C684F01BA26D32CE2A616BC"><enum>(b)</enum><header>Compliance with
			 standards for commemorative works act</header><text display-inline="yes-display-inline">The establishment of the memorial under
			 this section shall be in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/89">chapter 89</external-xref> of title 40, United States
			 Code (commonly known as the <term>Commemorative Works Act</term>).</text>
			</subsection><subsection id="HEE629DFAE58A4A508EFC001B8D6366D8"><enum>(c)</enum><header>Use of federal
			 funds prohibited</header>
				<paragraph id="idF2C182691DAC40B9A7DD1617C0A6C9A4"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Federal funds may not
			 be used to pay any expense of the establishment of the memorial under this
			 section.</text>
				</paragraph><paragraph id="id5BABCE22D3C54BCAAB67D40E83742299"><enum>(2)</enum><header>Responsibility
			 of association</header><text display-inline="yes-display-inline">The
			 Association shall be solely responsible for acceptance of contributions for,
			 and payment of the expenses of, the establishment of the memorial.</text>
				</paragraph></subsection><subsection id="H83052EF00FD74282B13F89C3E02B18B7"><enum>(d)</enum><header>Deposit of
			 excess funds</header><text display-inline="yes-display-inline">If, on payment
			 of all expenses for the establishment of the memorial (including the
			 maintenance and preservation amount required by <external-xref legal-doc="usc" parsable-cite="usc/40/8906">section 8906(b)(1)</external-xref> of title 40,
			 United States Code), or on expiration of the authority for the memorial under
			 <external-xref legal-doc="usc" parsable-cite="usc/40/8903">section 8903(e)</external-xref> of title 40, United States Code, there remains a balance of
			 funds received for the establishment of the memorial, the Association shall
			 transmit the amount of the balance to the Secretary of the Interior for deposit
			 in the account provided for in <external-xref legal-doc="usc" parsable-cite="usc/40/8906">section 8906(b)(3)</external-xref> of title 40, United States
			 Code.</text>
