		<official-title>To ensure efficiency and fairness in the awarding of
		  Federal contracts in connection with natural disaster reconstruction
		  efforts.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Local Disaster Contracting
			 Fairness Act of 2013</short-title></quote>.</text>
		</section><section id="id0B4CCB5666F04640AE86B95ECAC7991D"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id826C1D6E261E4551817F0D1F476E5FAE"><enum>(1)</enum><header>Executive
			 agency</header><text>The term <term>executive agency</term> has the meaning
			 given such term in section 4 of the Office of Federal Procurement Policy Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/41/403">41 U.S.C. 403</external-xref>).</text>
			</paragraph><paragraph id="id14807416913042B9BBE9CC484C06C830"><enum>(2)</enum><header>Local
			 subcontractor</header><text>The term <term>local subcontractor</term> means,
			 with respect to a contract, a subcontractor who has a principal place of
			 business or regularly conducts operations in the area in which work is to be
			 performed under the contract by the subcontractor.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFE083355198E4147BB0D87F1129D7E7E"><enum>(3)</enum><header>Natural
			 disaster reconstruction efforts</header><text>The term <term>natural disaster
			 reconstruction efforts</term> means reconstruction efforts undertaken in an
			 area subject to a declaration by the President of a major disaster under
			 section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>).</text>
			</paragraph></section><section id="id07D2EE875F414FA19B9CF86E6888D9B3"><enum>3.</enum><header>Federal
			 contracting requirements</header>
			<subsection id="id734B52123ADE4B749AB48C0FDD231FCB"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The head of an
			 executive agency may not enter into an agreement for debris removal or
			 demolition services in connection with natural disaster reconstruction efforts
			 unless the agreement specifies that—</text>
				<paragraph id="id9947E594A0BF44979BC5AD7FC7506767"><enum>(1)</enum><text>all of the work
			 under the contract will be performed by the prime contractor or 1 or more
			 subcontractors at 1 tier under the contract;</text>
				</paragraph><paragraph id="id2DFD43FEDAF446B8BA6700073DE201B5"><enum>(2)</enum><text>any work
			 performed under the contract by subcontractors will be performed by local
			 subcontractors, except to the extent that local subcontractors are not
			 available to perform such work;</text>
				</paragraph><paragraph id="idF60FC65A183F4CC59449CBF622BB792B"><enum>(3)</enum><text>the prime
			 contractor will act as the project manager or construction manager for the
			 contract; and</text>
				</paragraph><paragraph id="id12E788E823984009BD8642168952B263"><enum>(4)</enum><text>the prime
			 contractor—</text>
					<subparagraph id="idAEDBF72BF719465D8A5D727B9C5F5CB5"><enum>(A)</enum><text>has primary
			 responsibility for managing all work under the contract; and</text>
					</subparagraph><subparagraph id="idB7D28118D5C64F1F9741F219A6DA5DB7"><enum>(B)</enum><text>will be paid a
			 certain percentage of the overall value of the contract as sole compensation
			 for assuming the risk associated with such responsibility.</text>
					</subparagraph></paragraph></subsection><subsection id="idF7C687C4103543F88D526C5AE660294E"><enum>(b)</enum><header>Preference for
			 subcontractors affected by natural disasters</header><text>In entering into an
			 agreement for debris removal or demolition services in connection with natural
			 disaster reconstruction efforts, the head of an executive agency shall give a
			 preference in the source selection process to each offeror who certifies that
			 any work that is to be performed under the contract by subcontractors will be
			 performed by local subcontractors.</text>
			</subsection></section><section id="id9D4E44704A9243928E8B62D4CB0CDD38"><enum>4.</enum><header>Applicability</header><text display-inline="no-display-inline">The requirements under section 3 shall apply
			 to agreements entered into on or after the date of the enactment of this
			 Act.</text>
