			 SELF-DETERMINATION</header>
			<section id="H6F4626C11C1245BE97BDBD3FF00F024F"><enum>101.</enum><header>Definitions;
			 reporting and audit requirements; application of provisions</header>
				<subsection id="H6D23F636EBD3495BBAF64AC461390B67"><enum>(a)</enum><header>Definitions</header><text>Section
			 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C.
			 450b) is amended by striking subsection (j) and inserting the following:</text>
					<quoted-block id="H51D6F9088BF84A4889DB74295FF26D22" style="OLC">
						<subsection id="H3EBC8244B9164BCA8C4E10CC9951500A"><enum>(j)</enum><text><term>self-determination
				contract</term> means a contract entered into under title I (or a grant or
				cooperative agreement used under section 9) between a tribal organization and
				the appropriate Secretary for the planning, conduct, and administration of
				programs or services that are otherwise provided to Indian tribes and members
				of Indian tribes pursuant to Federal law, subject to the condition that, except
				as provided in section 105(a)(3), no contract entered into under title I (or
				grant or cooperative agreement used under section 9) shall be—</text>
							<paragraph id="H464235DF326D4842AA0ECFED38253201"><enum>(1)</enum><text>considered to be a
				procurement contract; or</text>
							</paragraph><paragraph id="HEF1D31A7D6CA4864875B64B434928F6E"><enum>(2)</enum><text>except as provided
				in section 107(a)(1), subject to any Federal procurement law (including
				regulations);</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H4D4C04D9E4C64C4FBA203B0505891B34"><enum>(b)</enum><header>Reporting and
			 audit requirements</header><text>Section 5(b) of the Indian Self-Determination
			 and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450c">25 U.S.C. 450c(b)</external-xref>) is amended—</text>
					<paragraph id="H0F7FF75CA8D14AC187FCC9E0835180A5"><enum>(1)</enum><text>by striking
			 <quote>after completion of the project or undertaking referred to in the
			 preceding subsection of this section</quote> and inserting <quote>after the
			 retention period for the report that is submitted to the Secretary under
			 subsection (a)</quote>; and</text>
					</paragraph><paragraph id="H2A27E43CEB9947679FFE74579ACE9688"><enum>(2)</enum><text>by adding at the
			 end the following: <quote>The retention period shall be defined in regulations
			 promulgated by the Secretary pursuant to section 414.</quote>.</text>
					</paragraph></subsection><subsection id="H06986182837148CA8D9CFF9B30A02212"><enum>(c)</enum><header>Application of
			 other provisions</header><text>Sections 4, 5, 6, 7, 102(c), 104, 105(a)(1),
			 105(f), 110, and 111 of the Indian Self-Determination and Education Assistance
			 Act, as amended (<external-xref legal-doc="usc" parsable-cite="usc/25/450">25 U.S.C. 450 et seq.</external-xref>) (<external-xref legal-doc="public-law" parsable-cite="pl/93/638">Public Law 93–638</external-xref>; 88 Stat. 2203) and
			 section 314 of the Department of the Interior and Related Agencies
			 Appropriations Act, 1991 (<external-xref legal-doc="public-law" parsable-cite="pl/101/512">Public Law 101–512</external-xref>; 104 Stat. 1959), apply to
			 compacts and funding agreements entered into under title IV.</text>
				</subsection></section><section id="H2C5AFD8EE89A45A394B7DF8DE550B002"><enum>102.</enum><header>Contracts by
			 Secretary of the Interior</header><text display-inline="no-display-inline">Section 102 of the Indian Self-Determination
			 and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450f">25 U.S.C. 450f</external-xref>) is amended—</text>
				<paragraph id="HAA8501E3BE384519865EA9ADB537A56E"><enum>(1)</enum><text>in subsection
			 (c)(2), by striking <quote>economic enterprises</quote> and all that follows
			 through <quote>except that</quote> and inserting <quote>economic enterprises
			 (as defined in section 3 of the Indian Financing Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/25/1452">25 U.S.C. 1452</external-xref>)),
			 except that</quote>; and</text>
				</paragraph><paragraph id="HF0D4D1183C21401688F5AF62A18A5472"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="HDC46144DBD22439BACA20999A5433B35" style="OLC">
						<subsection id="H09ABE1723C05460886E0D5C2B276B58D"><enum>(f)</enum><header>Good faith
				requirement</header><text>Subject to section 202 of the
				<short-title>Department of the Interior Tribal
				Self-Governance Act of 2013</short-title>, in the negotiation of contracts and
				funding agreements, the Secretary shall—</text>
							<paragraph id="H984961CD41304CD297A0EC740FADE12B"><enum>(1)</enum><text>at all times
				negotiate in good faith to maximize implementation of the self-determination
				policy; and</text>
							</paragraph><paragraph id="H1FB0512C375046E686E15E86EA19524A"><enum>(2)</enum><text>carry out this Act
				in a manner that maximizes the policy of tribal self-determination, in a manner
				consistent with the purposes specified in section 3.</text>
							</paragraph></subsection><subsection id="H3356D7A567B546C9ACAEAB623D226445"><enum>(g)</enum><header>Rule of
				construction</header><text>Subject to section 202 of the
				<short-title>Department of the Interior Tribal
				Self-Governance Act of 2013</short-title>, each provision of this Act and each
				provision of a contract or funding agreement shall be liberally construed for
				the benefit of the Indian tribe participating in self-determination, and any
				ambiguity shall be resolved in favor of the Indian
				tribe.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H704BD495C2E14B3AB0C10752861BC086"><enum>103.</enum><header>Administrative
			 provisions</header><text display-inline="no-display-inline">Section 105 of the
			 Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450j">25 U.S.C. 450j</external-xref>) is
			 amended—</text>
				<paragraph id="H7F11DEF84AE14968B8A03F9B0E9A2E16"><enum>(1)</enum><text>in subsection (b),
			 in the first sentence, by striking <quote>pursuant to</quote> and all that
			 follows through <quote>of this Act</quote> and inserting <quote>pursuant to
			 sections 102 and 103</quote>; and</text>
				</paragraph><paragraph id="HF39159C76AD147FC8481A15C8A7153D6"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="HE0AD51E5A900418B8A97350FC8E8838D" style="OLC">
						<subsection id="HD86DDF506F304B10A406F5FC34845091"><enum>(p)</enum><header>Interpretation
				by secretary</header><text>Except as otherwise provided by law (including
				section 202 of the <short-title>Department of the Interior
				Tribal Self-Governance Act of 2013</short-title>), the Secretary shall
				interpret all Federal laws (including regulations) and Executive orders in a
				manner that facilitates, to the maximum extent practicable—</text>
							<paragraph id="H8A170CA21EF3491BAF8A578DD8F63B1C"><enum>(1)</enum><text>the inclusion in
				self-determination contracts and funding agreements of—</text>
								<subparagraph id="H10C31A88DE6A463E9B2832FB404B04D5"><enum>(A)</enum><text>applicable
				programs, services, functions, and activities (or portions thereof); and</text>
								</subparagraph><subparagraph id="H212102CF709E4593806160A7E7B82DCB"><enum>(B)</enum><text>funds associated
				with those programs, services, functions, and activities;</text>
								</subparagraph></paragraph><paragraph id="H50BB51CB70E44BE7820AD367B30CCEE6"><enum>(2)</enum><text>the implementation
				of self-determination contracts and funding agreements; and</text>
							</paragraph><paragraph id="H54322D0293034AA583FB75EFE20CFE4D"><enum>(3)</enum><text>the achievement of
				tribal health
				objectives.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HCAE4260DEBB74EABB7960F9F9D10CF04"><enum>104.</enum><header>Contract
			 funding and indirect costs</header><text display-inline="no-display-inline">Section 106(a)(3) of the Indian
			 Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450j-1">25 U.S.C. 450j–1(a)(3)</external-xref>) is
			 amended—</text>
				<paragraph id="H94289FD5DD0346C5959F7E9EF6066D47"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
					<subparagraph id="H7B74FD290F634DBD938FE963B2F1D617"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>, and</quote> and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph id="H2491C1AB8B724232ACCEC742B8638338"><enum>(B)</enum><text>in clause (ii), by
			 striking <quote>expense related to the overhead incurred</quote> and inserting
			 <quote>expense incurred by the governing body of the Indian tribe or tribal
			 organization and any overhead expense incurred</quote>;</text>
					</subparagraph></paragraph><paragraph id="HFE1749B3995E452CABE1B2456C6AA42A"><enum>(2)</enum><text>by redesignating
			 subparagraph (B) as subparagraph (C); and</text>
				</paragraph><paragraph id="HF18D3EB61BE54848975AFA235264BDF2"><enum>(3)</enum><text>by inserting after
			 subparagraph (A) the following:</text>
					<quoted-block id="H878879907E1841679AF56B2071545D08" style="OLC">
						<subparagraph id="HE2DE5446246A46D894526F1FE97D7FEA"><enum>(B)</enum><text>In calculating the
				reimbursement rate for expenses described in subparagraph (A)(ii), not less
				than 50 percent of the expenses described in subparagraph (A)(ii) that are
				incurred by the governing body of an Indian tribe or tribal organization
				relating to a Federal program, function, service, or activity carried out
				pursuant to the contract shall be considered to be reasonable and
				allowable.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HA774BBCC614D441AA416A5D1FBB16B85"><enum>105.</enum><header>Contract or
			 grant specifications</header><text display-inline="no-display-inline">Section
			 108 of the Indian Self-Determination and Education Assistance Act (25 U.S.C.
			 450l) is amended—</text>
				<paragraph id="H3509CF74729242CD886EC26C95D3E5F4"><enum>(1)</enum><text>in subsection
			 (a)(2), by inserting <quote>subject to subsections (a) and (b) of section
			 102,</quote> before <quote>contain</quote>; and</text>
				</paragraph><paragraph id="H48F26D653BAE4D4BB49B2ADAA2444D71"><enum>(2)</enum><text>in subsection
			 (f)(2)(A)(ii) of the model agreement contained in subsection (c), by inserting
			 <quote>subject to subsections (a) and (b) of section 102 of the Indian
			 Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450f">25 U.S.C. 450f</external-xref>),</quote>
			 before <quote>such other provisions</quote>.</text>
				</paragraph></section></title><title id="H61BD71962BD84A3F876CA501544BE8C5"><enum>II</enum><header>TRIBAL
			 SELF-GOVERNANCE</header>
			<section id="H001375B7391340AF8E34777F06078041"><enum>201.</enum><header>Tribal
			 self-governance</header>
				<subsection id="id7C3386FC046B4E508034B42CDF9241D3"><enum>(a)</enum><header>Definitions</header><text>Section
			 401 of the Indian Self-Determination and Education Assistance Act (25 U.S.C.
			 458aa) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id90504D31620243F0B907B1A1C187FBF2" style="OLC">
						<section id="H4E4F2C0E5A3D4C90850B4B5D1CFB3AF3"><enum>401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
							<paragraph id="HC138E77A04254380971A158E1CBFCB59"><enum>(1)</enum><header>Compact</header><text>The
				term <term>compact</term> means a self-governance compact entered into under
				section 404.</text>
							</paragraph><paragraph id="HA7DF29C9D7824EC6AD6D4877AD0CAFE9"><enum>(2)</enum><header>Construction
				program; construction project</header><text>The term <term>construction
				program</term> or <term>construction project</term> means a tribal undertaking
				relating to the administration, planning, environmental determination, design,
				construction, repair, improvement, or expansion of roads, bridges, buildings,
				structures, systems, or other facilities for purposes of housing, law
				enforcement, detention, sanitation, water supply, education, administration,
				community, health, irrigation, agriculture, conservation, flood control,
				transportation, or port facilities, or for other tribal purposes.</text>
							</paragraph><paragraph id="H7C81DCBC0C774071B764C84A6BC5D6EE"><enum>(3)</enum><header>Department</header><text>The
				term <term>Department</term> means the Department of the Interior.</text>
							</paragraph><paragraph id="H5B9061EC9E6D4BE88E5A2904A6654BF6"><enum>(4)</enum><header>Funding
				agreement</header><text>The term <term>funding agreement</term> means a funding
				agreement entered into under section 403.</text>
							</paragraph><paragraph id="H88B2B7091ECE424DAAB4C62FD31FD952"><enum>(5)</enum><header>Gross
				mismanagement</header><text>The term <term>gross mismanagement</term> means a
				significant violation, shown by a preponderance of the evidence, of a compact,
				funding agreement, or statutory or regulatory requirement applicable to Federal
				funds—</text>
								<subparagraph id="HE09D8B20406A4044BA2F2D37AFC939D9"><enum>(A)</enum><text>for a program
				administered by an Indian tribe; or</text>
								</subparagraph><subparagraph id="HC226C017553A4670B17888CE03B5AA71"><enum>(B)</enum><text>under a compact or
				funding agreement that results in a significant reduction of funds available
				for the programs assumed by an Indian tribe.</text>
								</subparagraph></paragraph><paragraph id="H4F1EE813EE5E46978E3C7675195E69AE"><enum>(6)</enum><header>Inherent federal
				function</header><text>The term <term>inherent Federal function</term> means a
				Federal function that may not legally be delegated to an Indian tribe.</text>
							</paragraph><paragraph id="H025FBED0304D45169230FFF14F064E8E"><enum>(7)</enum><header>Program</header><text>The
				term <term>program</term> means any program, function, service, or activity (or
				portion thereof) within the Department that is included in a funding
				agreement.</text>
							</paragraph><paragraph id="H7C09D43390244247802DB064E69154CC"><enum>(8)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of the Interior.</text>
							</paragraph><paragraph id="HB9F42BF297894ED4A1663168F3CF2E07"><enum>(9)</enum><header>Self-governance</header><text>The
				term <term>self-governance</term> means the Tribal Self-Governance Program
				established under section 402.</text>
							</paragraph><paragraph id="HFD5F9B4A8B434C87815DDBEEE3E30742"><enum>(10)</enum><header>Tribal
				share</header><text>The term <term>tribal share</term> means the portion of all
				funds and resources of an Indian tribe that—</text>
								<subparagraph id="HE6C5E123E4554062B4DAC18F4FEE33EA"><enum>(A)</enum><text>support any
				program within the Bureau of Indian Affairs, the Office of Special Trustee, or
				the Office of the Assistant Secretary for Indian Affairs; and</text>
								</subparagraph><subparagraph id="H77B97FE5E9A14428865388905740F003"><enum>(B)</enum><text>are not required
				by the Secretary for the performance of an inherent Federal
				function.</text>
								</subparagraph></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id4dd93a6cd8334e1585ec39d64a666009"><enum>(b)</enum><header>Establishment</header><text>Section
			 402 of the Indian Self-Determination and Education Assistance Act (25 U.S.C.
			 458bb) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idB26A8522DE04492DA2AA68733E865B3A" style="OLC">
						<section id="H95F363D3EE524F9DB446A5AC7EBFC60F"><enum>402.</enum><header>Tribal
				Self-Governance Program</header>
							<subsection id="id584C2253CE6546EAA327E4716ED8829F"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish and carry out
				a program within the Department to be known as the <term>Tribal Self-Governance
				Program</term>.</text>
							</subsection><subsection id="id3E5A24D8CD2147D39D3F11AD6E405A8B"><enum>(b)</enum><header>Selection of
				Participating Indian Tribes</header>
								<paragraph id="H6797597AE038454780721320BEA50F88"><enum>(1)</enum><header>In
				general</header>
									<subparagraph id="HE14936665754413580BDA800E060866B"><enum>(A)</enum><header>Eligibility</header><text>The
				Secretary, acting through the Director of the Office of Self-Governance, may
				select up to 50 new Indian tribes per year from those eligible under subsection
				(c) to participate in self-governance.</text>
									</subparagraph><subparagraph id="H9438743A2DD24F39AE812B3D25FEF414"><enum>(B)</enum><header>Joint
				participation</header><text>On the request of each participating Indian tribe,
				two or more otherwise eligible Indian tribes may be treated as a single Indian
				tribe for the purpose of participating in self-governance.</text>
									</subparagraph></paragraph><paragraph id="H7F1C030C9DBD48279CBECE23E396827D"><enum>(2)</enum><header>Other authorized
				Indian tribe or tribal organization</header><text>If an Indian tribe authorizes
				another Indian tribe or a tribal organization to plan for or carry out a
				program on its behalf under this title, the authorized Indian tribe or tribal
				organization shall have the rights and responsibilities of the authorizing
				Indian tribe (except as otherwise provided in the authorizing
				resolution).</text>
								</paragraph><paragraph id="H9F1437BD70B74C74B674F5CEFD4B9419"><enum>(3)</enum><header>Joint
				participation</header><text>Two or more Indian tribes that are not otherwise
				eligible under subsection (c) may be treated as a single Indian tribe for the
				purpose of participating in self-governance as a tribal organization if—</text>
									<subparagraph id="H55C6BDD221044658B2C37F59FDA5B3A3"><enum>(A)</enum><text>each Indian tribe
				so requests; and</text>
									</subparagraph><subparagraph id="H2C6F316818724652875700C3BD8E1CEE"><enum>(B)</enum><text>the tribal
				organization itself, or at least one of the Indian tribes participating in the
				tribal organization, is eligible under subsection (c).</text>
									</subparagraph></paragraph><paragraph id="HBCC71C3A582C4B999395509765884E8A"><enum>(4)</enum><header>Tribal
				withdrawal from a tribal organization</header>
									<subparagraph id="HA5669B05FE0F432EB1BDF36EEC06E9B7"><enum>(A)</enum><header>In
				general</header><text>An Indian tribe that withdraws from participation in a
				tribal organization, in whole or in part, shall be entitled to participate in
				self-governance if the Indian tribe is eligible under subsection (c).</text>
									</subparagraph><subparagraph id="H943050E8C88A40F0B002A80927927707"><enum>(B)</enum><header>Effect of
				withdrawal</header><text>If an Indian tribe withdraws from participation in a
				tribal organization, the Indian tribe shall be entitled to its tribal share of
				funds and resources supporting the programs that the Indian tribe is entitled
				to carry out under the compact and funding agreement of the Indian
				tribe.</text>
									</subparagraph><subparagraph id="HD470B1560EE347C6BA1DFA66EFACE622"><enum>(C)</enum><header>Participation in
				self-governance</header><text>The withdrawal of an Indian tribe from a tribal
				organization shall not affect the eligibility of the tribal organization to
				participate in self-governance on behalf of one or more other Indian tribes, if
				the tribal organization still qualifies under subsection (c).</text>
									</subparagraph><subparagraph id="HE23527E9AC6F49EAA255899C54D1DC04"><enum>(D)</enum><header>Withdrawal
				process</header>
										<clause id="H17FDDDCC3D49457A9515B9B06F916F58"><enum>(i)</enum><header>In
				general</header><text>An Indian tribe may, by tribal resolution, fully or
				partially withdraw its tribal share of any program in a funding agreement from
				a participating tribal organization.</text>
										</clause><clause id="H29010DDFD4BE49C6AE5D2894B9C1E8BB"><enum>(ii)</enum><header>Notification</header><text>The
				Indian tribe shall provide a copy of the tribal resolution described in clause
				(i) to the Secretary.</text>
										</clause><clause id="H8CF6678E62204F96976D4B26BA425D69"><enum>(iii)</enum><header>Effective
				date</header>
											<subclause id="HE0A2AB625F894BCA95EB43ACEAD9605F"><enum>(I)</enum><header>In
				general</header><text>A withdrawal under clause (i) shall become effective on
				the date that is specified in the tribal resolution and mutually agreed upon by
				the Secretary, the withdrawing Indian tribe, and the tribal organization that
				signed the compact and funding agreement on behalf of the withdrawing Indian
				tribe or tribal organization.</text>
											</subclause><subclause id="H0B1047EE129C400591A6FBDE862EF57A"><enum>(II)</enum><header>No specified
				date</header><text>In the absence of a date specified in the resolution, the
				withdrawal shall become effective on—</text>
												<item id="HC60AB03AD4624870BE270BD63F154E4E"><enum>(aa)</enum><text>the
				earlier of—</text>
													<subitem id="HED5BEA5F6D0847E59C39074A3C8810D4"><enum>(AA)</enum><text>1 year after the
				date of submission of the request; and</text>
													</subitem><subitem id="H2C63FA63521749FEAEC215C70269CA31"><enum>(BB)</enum><text>the date on which
				the funding agreement expires; or</text>
													</subitem></item><item id="H796F09AFE38B44889D3811F576E7CA1D"><enum>(bb)</enum><text>such date as may
				be mutually agreed upon by the Secretary, the withdrawing Indian tribe, and the
				tribal organization that signed the compact and funding agreement on behalf of
				the withdrawing Indian tribe or tribal organization.</text>
												</item></subclause></clause></subparagraph><subparagraph id="H814CD178B8EB487E9070572F3FA75752"><enum>(E)</enum><header>Distribution of
				funds</header><text>If an Indian tribe or tribal organization eligible to enter
				into a self-determination contract under title I or a compact or funding
				agreement under this title fully or partially withdraws from a participating
				tribal organization, the withdrawing Indian tribe—</text>
										<clause id="HE0013FF308514DCE9B1C2B1A0D43ADC7"><enum>(i)</enum><text>may elect to enter
				into a self-determination contract or compact, in which case—</text>
											<subclause id="H12EF009A2AB142D589EF6D5EBDE0218D"><enum>(I)</enum><text>the withdrawing
				Indian tribe or tribal organization shall be entitled to its tribal share of
				unexpended funds and resources supporting the programs that the Indian tribe
				will be carrying out under its own self-determination contract or compact and
				funding agreement (calculated on the same basis as the funds were initially
				allocated to the funding agreement of the tribal organization); and</text>
											</subclause><subclause id="HB0FFDC7EC9E94EE5846E5BB8F0BEC7EF"><enum>(II)</enum><text>the funds
				referred to in subclause (I) shall be withdrawn by the Secretary from the
				funding agreement of the tribal organization and transferred to the withdrawing
				Indian tribe, on the condition that sections 102 and 105(i), as appropriate,
				shall apply to the withdrawing Indian tribe; or</text>
											</subclause></clause><clause id="H2FA4D3509A1A47FD8945ABD709CE3860"><enum>(ii)</enum><text>may elect not to
				enter into a self-determination contract or compact, in which case all
				unexpended funds and resources associated with the withdrawing Indian tribe’s
				returned programs (calculated on the same basis as the funds were initially
				allocated to the funding agreement of the tribal organization) shall be
				returned by the tribal organization to the Secretary for operation of the
				programs included in the withdrawal.</text>
										</clause></subparagraph><subparagraph id="H54DE4AF8C69E42F58CBD441708453316"><enum>(F)</enum><header>Return to mature
				contract status</header><text>If an Indian tribe elects to operate all or some
				programs carried out under a compact or funding agreement under this title
				through a self-determination contract under title I, at the option of the
				Indian tribe, the resulting self-determination contract shall be a mature
				self-determination contract as long as the Indian tribe meets the requirements
				set forth in section 4(h).</text>
									</subparagraph></paragraph></subsection><subsection id="H5FAF6C3DB1C44979939DA6F7884353C5"><enum>(c)</enum><header>Eligibility</header><text>To
				be eligible to participate in self-governance, an Indian tribe shall—</text>
								<paragraph id="HA52E0FD417D84B40855F30BF32BC46A9"><enum>(1)</enum><text>successfully
				complete the planning phase described in subsection (d);</text>
								</paragraph><paragraph id="H1A4EE20AFC34412BAB92C24B3F18162C"><enum>(2)</enum><text>request
				participation in self-governance by resolution or other official action by the
				tribal governing body; and</text>
								</paragraph><paragraph id="HBBB9D5E6B30F483ABF55437FA2CE6C5B"><enum>(3)</enum><text>demonstrate, for
				the 3 fiscal years preceding the date on which the Indian tribe requests
				participation, financial stability and financial management capability as
				evidenced by the Indian tribe having no uncorrected significant and material
				audit exceptions in the required annual audit of its self-determination or
				self-governance agreements with any Federal agency.</text>
								</paragraph></subsection><subsection id="HB6E9A33C46D14C00A38F3379491ACDDD"><enum>(d)</enum><header>Planning
				phase</header>
								<paragraph id="H70E4EF28C9E14F5FA5A6BD3457CAFD2B"><enum>(1)</enum><header>In
				general</header><text>An Indian tribe seeking to begin participation in
				self-governance shall complete a planning phase as provided in this
				subsection.</text>
								</paragraph><paragraph id="HBB1E21BB940148279AB015A5E7A581D7"><enum>(2)</enum><header>Activities</header><text>The
				planning phase shall—</text>
									<subparagraph id="HDFC03E5A2BE741868BD8C00D2093738A"><enum>(A)</enum><text>be conducted to
				the satisfaction of the Indian tribe; and</text>
									</subparagraph><subparagraph id="HE4C61189314C4B7C96DA412D37171808"><enum>(B)</enum><text>include—</text>
										<clause id="H709D6F41DC6241BCAA10D31F77A719AE"><enum>(i)</enum><text>legal and
				budgetary research; and</text>
										</clause><clause id="H81B13FB5AF324ADBAC3238E84C22D20C"><enum>(ii)</enum><text>internal tribal
				government planning, training, and organizational preparation.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="HC839EF59EE634E2E8FC16970D400F836"><enum>(e)</enum><header>Grants</header>
								<paragraph id="H75F13FAE6AFD405EAA1BDD1378871724"><enum>(1)</enum><header>In
				general</header><text>Subject to the availability of appropriations, an Indian
				tribe or tribal organization that meets the requirements of paragraphs (2) and
				(3) of subsection (c) shall be eligible for grants—</text>
									<subparagraph id="H7533EA947D2D493B8434243F3B2E7FB1"><enum>(A)</enum><text>to plan for
				participation in self-governance; and</text>
									</subparagraph><subparagraph id="H7CA3CA2E10024F9BB7E2E7D1EB98067B"><enum>(B)</enum><text>to negotiate the
				terms of participation by the Indian tribe or tribal organization in
				self-governance, as set forth in a compact and a funding agreement.</text>
									</subparagraph></paragraph><paragraph id="H2FF523613B1047118EC3C6E617A55320"><enum>(2)</enum><header>Receipt of grant
				not required</header><text>Receipt of a grant under paragraph (1) shall not be
				a requirement of participation in
				self-governance.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id937490198f3242e2ab619bff3083cfb6"><enum>(c)</enum><header>Funding
			 agreements</header><text display-inline="yes-display-inline">Section 403 of the
			 Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/458cc">25 U.S.C. 458cc</external-xref>) is
			 amended—</text>
					<paragraph id="id0785d5019c65464dbf6b3ca4feab3fc1"><enum>(1)</enum><text>by striking
			 subsection (a) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="idBB0655125CDF44A2ABB782159F725C84" style="OLC">
							<subsection id="id26181d0bc08d4dc0b8b7f01a566904a4"><enum>(a)</enum><header>Authorization</header><text>The
				Secretary shall, on the request of any Indian tribe or tribal organization,
				enter into a written funding agreement with the governing body of the Indian
				tribe or the tribal organization in a manner consistent with—</text>
								<paragraph id="idfef285247c3e474181c90be97c6e8d1c"><enum>(1)</enum><text>the trust
				responsibility of the Federal Government, treaty obligations, and the
				government-to-government relationship between Indian tribes and the United
				States; and</text>
								</paragraph><paragraph id="id062a09093a0b472c8c3ce98cd075cfbb"><enum>(2)</enum><text>subsection
				(b).</text>
								</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id8f8cf7828cf743c2975d218aaddeda4e"><enum>(2)</enum><text>in subsection
			 (b)—</text>
						<subparagraph id="id3dd1e7d2e47444359d83169f7f52a25e"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
							<clause id="idd373e01518324f51ac046014fd4a67d5"><enum>(i)</enum><text>in
			 the matter preceding subparagraph (A), by striking <quote>without regard to the
			 agency or office of the Bureau of Indian Affairs</quote> and inserting
			 <quote>the Office of the Assistant Secretary for Indian Affairs, and the Office
			 of the Special Trustee, without regard to the agency or office of that Bureau
			 or those Offices</quote>;</text>
							</clause><clause id="id1aead803f04246da91f6d5d7d7f9a010"><enum>(ii)</enum><text>in
			 subparagraph (B), by striking <quote>and</quote>;</text>
							</clause><clause id="ideecf43b16ded4633b9c9297217bfbb68"><enum>(iii)</enum><text>in subparagraph
			 (C), by inserting <quote>and</quote> after the semicolon at the end; and</text>
							</clause><clause id="ida28f8a017fe144d5ab96ada889e5743e"><enum>(iv)</enum><text>by
			 adding at the end the following:</text>
								<quoted-block display-inline="no-display-inline" id="idF04DF3D41C134A4DB1F80569CA632B78" style="OLC">
									<subparagraph id="ida8e299018870404586bfd5c9b83ecbbe"><enum>(D)</enum><text>any other
				programs, services, functions, or activities (or portions thereof) that are
				provided through the Bureau of Indian Affairs, the Office of the Assistant
				Secretary for Indian Affairs, or the Office of the Special Trustee with respect
				to which Indian tribes or Indians are primary or significant
				beneficiaries;</text>
									</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
							</clause></subparagraph><subparagraph id="idcfb6a0be05bf4138bd6dc1cb90fd24c4"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
							<clause id="id3423ea33a42e46088b8e777de32f76c3"><enum>(i)</enum><text>by
			 striking <quote>section 405(c)</quote> and inserting <quote>section
			 413(c)</quote>; and</text>
							</clause><clause id="idaf18647e48a7488898ea3481395543a7"><enum>(ii)</enum><text>by
			 inserting <quote>and</quote> after the semicolon at the end;</text>
							</clause></subparagraph><subparagraph id="id303b62209008484ca92fdc082e262a84"><enum>(C)</enum><text>in paragraph (3),
			 by striking the semicolon at the end and inserting a period; and</text>
						</subparagraph><subparagraph id="id7490ade3dbec449a87e97bbe6b8296be"><enum>(D)</enum><text>by striking
			 paragraphs (4) through (9); and</text>
						</subparagraph></paragraph><paragraph id="id0579062390d14179b9866b32e00a86c7"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idfe97a008df6f444880a472b0fe34e6fd" style="OLC">
							<subsection id="id8f7e6c5072ea4ce994bfb5a9b5049747"><enum>(m)</enum><header>Other
				provisions</header>
								<paragraph id="id4a7357d79222484f9d32b7b7ae5fcef7"><enum>(1)</enum><header>Excluded
				funding</header><text>A funding agreement shall not authorize an Indian tribe
				to plan, conduct, administer, or receive tribal share funding under any program
				that—</text>
									<subparagraph id="idac93a8452e634921a020d309dc11a16a"><enum>(A)</enum><text>is provided under
				the Tribally Controlled Colleges and Universities Assistance Act of 1978 (25
				U.S.C. 1801 et seq.); and</text>
									</subparagraph><subparagraph id="id850f774b9af14178811f692fc8bd700f"><enum>(B)</enum><text>is provided for
				elementary and secondary schools under the formula developed under section 1127
				of the Education Amendments of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/25/2007">25 U.S.C. 2007</external-xref>).</text>
									</subparagraph></paragraph><paragraph id="id25588ffba16242f0b33489a583ebafb4"><enum>(2)</enum><header>Services,
				functions, and responsibilities</header><text>A funding agreement shall
				specify—</text>
									<subparagraph id="idad777c7c2895414190e932dabb38bf39"><enum>(A)</enum><text>the services to
				be provided under the funding agreement;</text>
									</subparagraph><subparagraph id="ide0a0517d216f4751a1d365fe2810ed5e"><enum>(B)</enum><text>the functions to
				be performed under the funding agreement; and</text>
									</subparagraph><subparagraph id="id41fdbe9382204e21a934234024d228c1"><enum>(C)</enum><text>the
				responsibilities of the Indian tribe and the Secretary under the funding
				agreement.</text>
									</subparagraph></paragraph><paragraph id="id29a0dc568c464b179e73137e3af73a76"><enum>(3)</enum><header>Base
				budget</header><text>A funding agreement shall, at the option of the Indian
				tribe, provide for a stable base budget specifying the recurring funds (which
				may include funds available under section 106(a)) to be transferred to the
				Indian tribe, for such period as the Indian tribe specifies in the funding
				agreement, subject to annual adjustment only to reflect changes in
				congressional appropriations.</text>
								</paragraph><paragraph id="iddd228c0eef9649fc9ff84b2fc72ce400"><enum>(4)</enum><header>No waiver of
				trust responsibility</header><text>A funding agreement shall prohibit the
				Secretary from waiving, modifying, or diminishing in any way the trust
				responsibility of the United States with respect to Indian tribes and
				individual Indians that exists under treaties, Executive orders, court
				decisions, and other laws.</text>
								</paragraph></subsection><subsection id="id84627ce271d340fd871eb02b4994c668"><enum>(n)</enum><header>Amendment</header><text>The
				Secretary shall not revise, amend, or require additional terms in a new or
				subsequent funding agreement without the consent of the Indian tribe, unless
				such terms are required by Federal law.</text>
							</subsection><subsection id="id2d842ab249a54533a929ccd9d1f81d36"><enum>(o)</enum><header>Effective
				date</header><text>A funding agreement shall become effective on the date
				specified in the funding agreement.</text>
							</subsection><subsection id="id24b90d895fb848ac81eb016da292e83f"><enum>(p)</enum><header>Existing and
				subsequent funding agreements</header>
								<paragraph id="id7ee36fcce2d7412a882d3e114fdca6c1"><enum>(1)</enum><header>Subsequent
				funding agreements</header><text>Absent notification from an Indian tribe that
				the Indian tribe is withdrawing or retroceding the operation of one or more
				programs identified in a funding agreement, or unless otherwise agreed to by
				the parties to the funding agreement or by the nature of any noncontinuing
				program, service, function, or activity contained in a funding
				agreement—</text>
									<subparagraph id="id09bbdf14bd7f4a069296a773688e22e2"><enum>(A)</enum><text>a funding
				agreement shall remain in full force and effect until a subsequent funding
				agreement is executed, with funding paid annually for each fiscal year the
				agreement is in effect; and</text>
									</subparagraph><subparagraph id="idc7d2da696294450598f9971b771632f5"><enum>(B)</enum><text>the term of the
				subsequent funding agreement shall be retroactive to the end of the term of the
				preceding funding agreement for the purposes of calculating the amount of
				funding to which the Indian tribe is entitled.</text>
									</subparagraph></paragraph><paragraph id="ida207f54ee93c49abbbf531590495f17f"><enum>(2)</enum><header>Disputes</header><text>Disputes
				over the implementation of paragraph (1)(A) shall be subject to section
				406(c).</text>
								</paragraph><paragraph id="id7421964960524b56809cc2086907c000"><enum>(3)</enum><header>Existing
				funding agreements</header><text>An Indian tribe that was participating in
				self-governance under this title on the date of enactment of the
				<short-title>Department of the Interior Tribal
				Self-Governance Act of 2013</short-title> shall have the option at any time
				after that date—</text>
									<subparagraph id="id532ca73005254d6bb1e3b8992fd1a9ea"><enum>(A)</enum><text>to retain its
				existing funding agreement (in whole or in part) to the extent that the
				provisions of that funding agreement are not directly contrary to any express
				provision of this title; or</text>
									</subparagraph><subparagraph id="idcc5a4630bb194ff5bc99feefb1b66bad"><enum>(B)</enum><text>to negotiate a
				new funding agreement in a manner consistent with this title.</text>
									</subparagraph></paragraph><paragraph id="idfc4bb035d7234e27874ce8b50ee759b1"><enum>(4)</enum><header>Multiyear
				funding agreements</header><text>An Indian tribe may, at the discretion of the
				Indian tribe, negotiate with the Secretary for a funding agreement with a term
				that exceeds 1
				year.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="idaed7395caa9946c9b627031a13ff64e1"><enum>(d)</enum><header>General
			 revisions</header><text>Title IV of the Indian Self-Determination and Education
			 Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450aa">25 U.S.C. 450aa et seq.</external-xref>) is amended by striking sections 404
			 through 408 and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id630ED607CC7845DABCBFE0B1079819E0" style="OLC">
						<section id="H4C356969B7BA49F3B127F507A6DC27A7"><enum>404.</enum><header>Compacts</header>
							<subsection id="H73BF1D521B7C4BC3974A1CE9314F7214"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall negotiate and enter into a written
				compact with each Indian tribe participating in self-governance in a manner
				consistent with the trust responsibility of the Federal Government, treaty
				obligations, and the government-to-government relationship between Indian
				tribes and the United States.</text>
							</subsection><subsection id="H43ADDE025A2644679C64EEF369A744E3"><enum>(b)</enum><header>Contents</header><text>A
				compact under subsection (a) shall—</text>
								<paragraph id="H7C844E4F59C042CEA08B1A07667CD95F"><enum>(1)</enum><text>specify and affirm
				the general terms of the government-to-government relationship between the
				Indian tribe and the Secretary; and</text>
								</paragraph><paragraph id="HDD11E11A24B1409A9BBDE6AC4FF2716E"><enum>(2)</enum><text>include such terms
				as the parties intend shall control during the term of the compact.</text>
								</paragraph></subsection><subsection id="H70631E6A52F7464790C752FBCADF4441"><enum>(c)</enum><header>Amendment</header><text>A
				compact under subsection (a) may be amended only by agreement of the
				parties.</text>
							</subsection><subsection id="H667F2018ECBC467EB9B49C39ACFB2D71"><enum>(d)</enum><header>Effective
				date</header><text>The effective date of a compact under subsection (a) shall
				be—</text>
								<paragraph id="HEB7B2CE49CE9469392E6DDA1CD2DE845"><enum>(1)</enum><text>the date of the
				execution of the compact by the parties; or</text>
								</paragraph><paragraph id="H5C1B47091891476187929DC74DB2A63A"><enum>(2)</enum><text>another date
				agreed upon by the parties.</text>
								</paragraph></subsection><subsection id="H56FDD0C9E0D4402FB473E3FAED8E3993"><enum>(e)</enum><header>Duration</header><text>A
				compact under subsection (a) shall remain in effect—</text>
								<paragraph id="H215CB88173974854841FA2FC1D852054"><enum>(1)</enum><text>for so long as
				permitted by Federal law; or</text>
								</paragraph><paragraph id="HCB8648D5173845B1B621872DBE0D001E"><enum>(2)</enum><text>until termination
				by written agreement, retrocession, or reassumption.</text>
								</paragraph></subsection><subsection id="H7BD94608E6744FC79831135F330F3C54"><enum>(f)</enum><header>Existing
				compacts</header><text>An Indian tribe participating in self-governance under
				this title, as in effect on the date of enactment of the
				<short-title>Department of the Interior Tribal
				Self-Governance Act of 2013</short-title>, shall have the option at any time
				after that date—</text>
								<paragraph id="H8BADAC4329494B628B2D3EBBD658437F"><enum>(1)</enum><text>to retain its
				negotiated compact (in whole or in part) to the extent that the provisions of
				the compact are not directly contrary to any express provision of this title;
				or</text>
								</paragraph><paragraph id="HE31E61C1704744748DA5F2B97259E344"><enum>(2)</enum><text>to negotiate a new
				compact in a manner consistent with this title.</text>
								</paragraph></subsection></section><section id="HFCF997824DBE406A9C50F0ABE353B13D"><enum>405.</enum><header>General
				provisions</header>
							<subsection id="HE3B7C75694274185ABCDB13C940F330F"><enum>(a)</enum><header>Applicability</header><text>An
				Indian tribe and the Secretary shall include in any compact or funding
				agreement provisions that reflect the requirements of this title.</text>
							</subsection><subsection id="H149C2E9B3B2E45C6B144A34F97137A57"><enum>(b)</enum><header>Conflicts of
				interest</header><text>An Indian tribe participating in self-governance shall
				ensure that internal measures are in place to address, pursuant to tribal law
				and procedures, conflicts of interest in the administration of programs.</text>
							</subsection><subsection id="H448942D92495400B9E9CB0F7E1E77A1C"><enum>(c)</enum><header>Audits</header>
								<paragraph id="HC4F178B8F4944E0682CFE8F9DA44FE96"><enum>(1)</enum><header>Single agency
				audit act</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/75">Chapter 75</external-xref> of title 31, United States Code, shall apply
				to a funding agreement under this title.</text>
								</paragraph><paragraph id="H5B4F23CF841043E7B07B11CB316F7F2E"><enum>(2)</enum><header>Cost
				principles</header><text>An Indian tribe shall apply cost principles under the
				applicable Office of Management and Budget circular, except as modified
				by—</text>
									<subparagraph id="H79D077EBFE4A475287020377E477BB4F"><enum>(A)</enum><text>any provision of
				law, including section 106; or</text>
									</subparagraph><subparagraph id="H34A0D05B806C421EB0B73B840704EFB7"><enum>(B)</enum><text>any exemptions to
				applicable Office of Management and Budget circulars subsequently granted by
				the Office of Management and Budget.</text>
									</subparagraph></paragraph><paragraph id="H1DF7138CE0A046809BAC5D7F5D205ADB"><enum>(3)</enum><header>Federal
				claims</header><text>Any claim by the Federal Government against an Indian
				tribe relating to funds received under a funding agreement based on any audit
				under this subsection shall be subject to section 106(f).</text>
								</paragraph></subsection><subsection id="H8397F36CBF684246B49CD6470AC577CD"><enum>(d)</enum><header>Redesign and
				consolidation</header><text>Except as provided in section 407, an Indian tribe
				may redesign or consolidate programs or reallocate funds for programs in any
				manner that the Indian tribe determines to be in the best interest of the
				Indian community being served, so long as that the redesign or consolidation
				does not have the effect of denying eligibility for services to population
				groups otherwise eligible to be served under applicable Federal law, except
				that, with respect to the reallocation, consolidation, and redesign of programs
				described in subsection (b)(2) or (c) of section 403, a joint agreement between
				the Secretary and the Indian tribe shall be required.</text>
							</subsection><subsection id="H1DE242D0CF0C4983979F397FDF7EEEF9"><enum>(e)</enum><header>Retrocession</header>
								<paragraph id="H857B92F18C7F461AB34BAAD648D7CE31"><enum>(1)</enum><header>In
				general</header><text>An Indian tribe may fully or partially retrocede to the
				Secretary any program under a compact or funding agreement.</text>
								</paragraph><paragraph id="H8C8880B8CAF7449395A7849245FE9033"><enum>(2)</enum><header>Effective
				date</header>
									<subparagraph id="HF1331F19192F41AA9DB7C5A4A7BAF556"><enum>(A)</enum><header>Agreement</header><text>Unless
				an Indian tribe rescinds a request for retrocession under paragraph (1), the
				retrocession shall become effective on the date specified by the parties in the
				compact or funding agreement.</text>
									</subparagraph><subparagraph id="H329D1C964AD949FEB98925D5668D63C6"><enum>(B)</enum><header>No
				agreement</header><text>In the absence of a specification of an effective date
				in the compact or funding agreement, the retrocession shall become effective
				on—</text>
										<clause id="H34371E65072E42D4ACE350ACEDBFE70C"><enum>(i)</enum><text>the earlier
				of—</text>
											<subclause id="H699386E2225145639834003212CE51A7"><enum>(I)</enum><text>1 year after the
				date on which the request is submitted; and</text>
											</subclause><subclause id="H4C9BB3F11A6642C7A4DDD8FC1EDF4FA0"><enum>(II)</enum><text>the date on which
				the funding agreement expires; or</text>
											</subclause></clause><clause id="HBD12C45AF26A47AC8AADF493FF64481D"><enum>(ii)</enum><text>such date as may
				be mutually agreed upon by the Secretary and the Indian tribe.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="HB4FA12F6A0DE4AFAAACC8DA39D905DCD"><enum>(f)</enum><header>Nonduplication</header><text>A
				funding agreement shall provide that, for the period for which, and to the
				extent to which, funding is provided to an Indian tribe under this title, the
				Indian tribe—</text>
								<paragraph id="H0280BF106CC74343B56FFEE2843D6DB3"><enum>(1)</enum><text>shall not be
				entitled to contract with the Secretary for funds under section 102, except
				that the Indian tribe shall be eligible for new programs on the same basis as
				other Indian tribes; and</text>
								</paragraph><paragraph id="H0880F2D0CF85460EAB8D088E2FA9B233"><enum>(2)</enum><text>shall be
				responsible for the administration of programs in accordance with the compact
				or funding agreement.</text>
								</paragraph></subsection><subsection id="H6A2AD355F05A464A8BBB5BBDAC4BE5CF"><enum>(g)</enum><header>Records</header>
								<paragraph id="H858B63D8662B4ACFAB740FBF30A852D6"><enum>(1)</enum><header>In
				general</header><text>Unless an Indian tribe specifies otherwise in the compact
				or funding agreement, records of an Indian tribe shall not be considered to be
				Federal records for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States
				Code.</text>
								</paragraph><paragraph id="H36922B970EF146DD9FA8BAECE894A411"><enum>(2)</enum><header>Recordkeeping
				system</header><text>An Indian tribe shall—</text>
									<subparagraph id="H27C7F086D2194057A191416ED8F8490D"><enum>(A)</enum><text>maintain a
				recordkeeping system; and</text>
									</subparagraph><subparagraph id="HEACD2F9D6D2044CD8CB341807F3BA929"><enum>(B)</enum><text>on a notice period
				of not less than 30 days, provide the Secretary with reasonable access to the
				records to enable the Department to meet the requirements of sections 3101
				through 3106 of title 44, United States Code.</text>
									</subparagraph></paragraph></subsection></section><section id="HB92D5F470E82493EBE3D829D8577E036"><enum>406.</enum><header>Provisions
				relating to the secretary</header>
							<subsection id="HB796940472A04CE88D5809D5043B8EF9"><enum>(a)</enum><header>Trust
				evaluations</header><text>A funding agreement shall include a provision to
				monitor the performance of trust functions by the Indian tribe through the
				annual trust evaluation.</text>
							</subsection><subsection id="HA5E47C3D98DE4073A6E7C8996CDB1944"><enum>(b)</enum><header>Reassumption</header>
								<paragraph id="HB66B2C6F123C4B9E945D6CBBFC3C96F9"><enum>(1)</enum><header>In
				general</header><text>A compact or funding agreement shall include provisions
				for the Secretary to reassume a program and associated funding if there is a
				specific finding relating to that program of—</text>
									<subparagraph id="H8A1622ACF6D2486B96B4CF4C63147665"><enum>(A)</enum><text>imminent jeopardy
				to a trust asset, natural resources, or public health and safety that—</text>
										<clause id="H9F282B133D5B488D837B641AC554D784"><enum>(i)</enum><text>is
				caused by an act or omission of the Indian tribe; and</text>
										</clause><clause id="HD872AA4E4CCE4D3797BA22C8A8597D3C"><enum>(ii)</enum><text>arises out of a
				failure to carry out the compact or funding agreement; or</text>
										</clause></subparagraph><subparagraph id="H5620436E03684F9EA62FF117EE5D644E"><enum>(B)</enum><text>gross
				mismanagement with respect to funds transferred to an Indian tribe under a
				compact or funding agreement, as determined by the Secretary in consultation
				with the Inspector General, as appropriate.</text>
									</subparagraph></paragraph><paragraph id="H19BC9A5803064015BFA74293F62C3C8F"><enum>(2)</enum><header>Prohibition</header><text>The
				Secretary shall not reassume operation of a program, in whole or part,
				unless—</text>
									<subparagraph id="H61A40DE1079B4241A5280D55F7B147B4"><enum>(A)</enum><text>the Secretary
				first provides written notice and a hearing on the record to the Indian tribe;
				and</text>
									</subparagraph><subparagraph id="HC521E0317AB6498AAB05E78C1FECD25E"><enum>(B)</enum><text>the Indian tribe
				does not take corrective action to remedy the mismanagement of the funds or
				programs, or the imminent jeopardy to a trust asset, natural resource, or
				public health and safety.</text>
									</subparagraph></paragraph><paragraph id="H7E285419C9404633BD0DDBE5999B0F59"><enum>(3)</enum><header>Exception</header>
									<subparagraph id="HAD3CA9145EF84994B0075D5CEE7B4F88"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding paragraph (2), the Secretary may, on
				written notice to the Indian tribe, immediately reassume operation of a program
				if—</text>
										<clause id="H0AB5C3AAEAA14F03B0B108996BEF60AA"><enum>(i)</enum><text>the Secretary
				makes a finding of imminent and substantial jeopardy and irreparable harm to a
				trust asset, a natural resource, or the public health and safety caused by an
				act or omission of the Indian tribe; and</text>
										</clause><clause id="H74AD3061BDC14B8B966536078A9294ED"><enum>(ii)</enum><text>the imminent and
				substantial jeopardy, and irreparable harm to the trust asset, natural
				resource, or public health and safety arises out of a failure by the Indian
				tribe to carry out the terms of an applicable compact or funding
				agreement.</text>
										</clause></subparagraph><subparagraph id="H98B293D6B9A34399BF8A5E09B2178452"><enum>(B)</enum><header>Reassumption</header><text>If
				the Secretary reassumes operation of a program under subparagraph (A), the
				Secretary shall provide the Indian tribe with a hearing on the record not later
				than 10 days after the date of reassumption.</text>
									</subparagraph></paragraph></subsection><subsection id="H9A2D6DCC2A6244A587DEEE4604141765"><enum>(c)</enum><header>Inability To
				agree on compact or funding agreement</header>
								<paragraph id="HD078C2DE70CD40DE871EA3AB5C9262F4"><enum>(1)</enum><header>Final
				offer</header><text>If the Secretary and a participating Indian tribe are
				unable to agree, in whole or in part, on the terms of a compact or funding
				agreement (including funding levels), the Indian tribe may submit a final offer
				to the Secretary.</text>
								</paragraph><paragraph id="H4CF5E9A678CE42A38F2DB4192DF010AB"><enum>(2)</enum><header>Determination</header><text>Not
				more than 60 days after the date of receipt of a final offer by the one or more
				officials designated pursuant to paragraph (4), the Secretary shall review and
				make a determination with respect to the final offer.</text>
								</paragraph><paragraph id="H75795CC85E3C496293C9B6F858D0DA2E"><enum>(3)</enum><header>Extensions</header><text>The
				deadline described in paragraph (2) may be extended for any length of time, as
				agreed upon by both the Indian tribe and the Secretary.</text>
								</paragraph><paragraph id="HF19857295A414E7AB0E4E5E98325CCAF"><enum>(4)</enum><header>Designated
				officials</header>
									<subparagraph id="id698E608364A5499BBECD83EDEDCE830E"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall designate one or more appropriate
				officials in the Department to receive a copy of the final offer described in
				paragraph (1).</text>
									</subparagraph><subparagraph id="id5d9c4600b3f54077abfe806f022d914b"><enum>(B)</enum><header>No
				designation</header><text>If no official is designated, the Executive
				Secretariat of the Secretary shall be the designated official.</text>
									</subparagraph></paragraph><paragraph id="HC6B2DCDABE8A4BC3B2B5749D0A51291F"><enum>(5)</enum><header>No timely
				determination</header><text>Except as otherwise provided in section 202 of the
				<short-title>Department of the Interior Tribal
				Self-Governance Act of 2013</short-title>, if the Secretary fails to make a
				determination with respect to a final offer within the period specified in
				paragraph (2), the Secretary shall be deemed to have agreed to the
				offer.</text>
								</paragraph><paragraph id="H6342159741E9490288BDC1CEE224AD9D"><enum>(6)</enum><header>Rejection of
				final offer</header>
									<subparagraph id="H2A782990E645419B8C6B41E9BB964B01"><enum>(A)</enum><header>In
				general</header><text>If the Secretary rejects a final offer (or one or more
				provisions or funding levels in a final offer), the Secretary shall—</text>
										<clause id="HB6445DBDBF4B40388469FAC4F2D7A11B"><enum>(i)</enum><text>provide timely
				written notification to the Indian tribe that contains a specific finding that
				clearly demonstrates, or that is supported by a controlling legal authority,
				that—</text>
											<subclause id="HAED90779C1504DB796AE79772F9C5026"><enum>(I)</enum><text>the amount of
				funds proposed in the final offer exceeds the applicable funding level as
				determined under section 106(a)(1);</text>
											</subclause><subclause id="HA1764CFB82B44DFBABB89A29F1F6D11F"><enum>(II)</enum><text>the program that
				is the subject of the final offer is an inherent Federal function or is subject
				to the discretion of the Secretary under section 403(c);</text>
											</subclause><subclause id="HA8B4ACAD6109424391E266A1F5F00E42"><enum>(III)</enum><text>the Indian tribe
				cannot carry out the program in a manner that would not result in significant
				danger or risk to the public health or safety, to natural resources, or to
				trust resources;</text>
											</subclause><subclause id="H4C9544FE20E340699D6B97E8099B9CB9"><enum>(IV)</enum><text>the Indian tribe
				is not eligible to participate in self-governance under section 402(c);</text>
											</subclause><subclause id="H2BF4900EB4EC412D9622A2DA84C8AA31"><enum>(V)</enum><text>the funding
				agreement would violate a Federal statute or regulation; or</text>
											</subclause><subclause id="id600575f9aac24b07aa91e6a917ee8517"><enum>(VI)</enum><text>with respect to
				a program or portion of a program included in a final offer pursuant to section
				403(b)(2), the program or the portion of the program is not otherwise available
				to Indian tribes or Indians under section 102(a)(1)(E);</text>
											</subclause></clause><clause id="H18D079A84EE5443A93DE8B21DBE36BEB"><enum>(ii)</enum><text>provide technical
				assistance to overcome the objections stated in the notification required by
				clause (i);</text>
										</clause><clause id="H32EBEFB3DEE04D41A13FD02455CB19F7"><enum>(iii)</enum><text>provide the
				Indian tribe with—</text>
											<subclause id="H573823EF8B774D41A2A9015995744402"><enum>(I)</enum><text>a hearing on the
				record with the right to engage in full discovery relevant to any issue raised
				in the matter; and</text>
											</subclause><subclause id="H9E4735CB0DE84A96A443B60128EB7E06"><enum>(II)</enum><text>the opportunity
				for appeal on the objections raised (except that the Indian tribe may, in lieu
				of filing such appeal, directly proceed to initiate an action in a United
				States district court under section 110(a)); and</text>
											</subclause></clause><clause id="HAF1FF037D2734E9BBD244BD7D6330E90"><enum>(iv)</enum><text>provide the
				Indian tribe the option of entering into the severable portions of a final
				proposed compact or funding agreement (including a lesser funding amount, if
				any), that the Secretary did not reject, subject to any additional alterations
				necessary to conform the compact or funding agreement to the severed
				provisions.</text>
										</clause></subparagraph><subparagraph id="HAA6B24B27AEF445CA2986852C1165823"><enum>(B)</enum><header>Effect of
				exercising certain option</header><text>If an Indian tribe exercises the option
				specified in subparagraph (A)(iv)—</text>
										<clause id="H7771B977241545289F3141340F4E780B"><enum>(i)</enum><text>the Indian tribe
				shall retain the right to appeal the rejection by the Secretary under this
				section; and</text>
										</clause><clause id="HBFAFB1DF4EDE420B9BB4C39E8A321914"><enum>(ii)</enum><text>clauses (i),
				(ii), and (iii) of subparagraph (A) shall apply only to the portion of the
				proposed final compact or funding agreement that was rejected by the
				Secretary.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="H17F8325DB2AA4D2C87CFE3133F3DE4F8"><enum>(d)</enum><header>Burden of
				proof</header><text>In any administrative action, hearing, or appeal or civil
				action brought under this section, the Secretary shall have the burden of
				proof—</text>
								<paragraph id="HF4ED62B270894EF888A739536CBD782E"><enum>(1)</enum><text display-inline="yes-display-inline">of demonstrating, by a preponderance of the
				evidence, the validity of the grounds for a reassumption under subsection (b);
				and</text>
								</paragraph><paragraph id="HE9A4570364974308A114209645DD641B"><enum>(2)</enum><text>of clearly
				demonstrating the validity of the grounds for rejecting a final offer made
				under subsection (c).</text>
								</paragraph></subsection><subsection id="H5A324CD6368A4558AB4901BBB7EB6EDE"><enum>(e)</enum><header>Good
				faith</header>
								<paragraph id="HEAFA7758EF9143BE9F8372A18071547C"><enum>(1)</enum><header>In
				general</header><text>Subject to section 202 of the
				<short-title>Department of the Interior Tribal
				Self-Governance Act of 2013</short-title>, in the negotiation of compacts and
				funding agreements, the Secretary shall at all times negotiate in good faith to
				maximize implementation of the self-governance policy.</text>
								</paragraph><paragraph id="H3901DCE756A44DF4A0239D56BFFF74FD"><enum>(2)</enum><header>Policy</header><text>Subject
				to section 202 of the <short-title>Department of the
				Interior Tribal Self-Governance Act of 2013</short-title>, the Secretary shall
				carry out this title in a manner that maximizes the policy of tribal
				self-governance.</text>
								</paragraph></subsection><subsection id="HB576F070694349C78FC4AE9CBEC41DFF"><enum>(f)</enum><header>Savings</header>
								<paragraph id="HABBBFF4AA58147519FC0E7CA5038022F"><enum>(1)</enum><header>In
				general</header><text>To the extent that programs carried out for the benefit
				of Indian tribes and tribal organizations under this title reduce the
				administrative or other responsibilities of the Secretary with respect to the
				operation of Indian programs and result in savings that have not otherwise been
				included in the amount of tribal shares and other funds determined under
				section 408(c), except for funding agreements entered into for programs under
				section 403(c), the Secretary shall make such savings available to the Indian
				tribes or tribal organizations for the provision of additional services to
				program beneficiaries in a manner equitable to directly served, contracted, and
				compacted programs.</text>
								</paragraph><paragraph id="H9344C9BAA0984DD5B758AD54788E778D"><enum>(2)</enum><header>Discretionary
				programs of special significance</header><text>For any savings generated as a
				result of the assumption of a program by an Indian tribe under section 403(c),
				such savings shall be made available to that Indian tribe.</text>
								</paragraph></subsection><subsection id="H1E14E82BB16A49C384AE957E65BDB9BF"><enum>(g)</enum><header>Trust
				responsibility</header><text>The Secretary may not waive, modify, or diminish
				in any way the trust responsibility of the United States with respect to Indian
				tribes and individual Indians that exists under treaties, Executive orders,
				other laws, or court decisions.</text>
							</subsection><subsection id="H1E2B9BB6F0654E2AB4373701C06242C2"><enum>(h)</enum><header>Decisionmaker</header><text>A
				decision that constitutes final agency action and relates to an appeal within
				the Department conducted under subsection (c)(4) may be made by—</text>
								<paragraph id="HB96218B3C0334E32AD2AF6B4FFDFD546"><enum>(1)</enum><text>an official of the
				Department who holds a position at a higher organizational level within the
				Department than the level of the departmental agency in which the decision that
				is the subject of the appeal was made; or</text>
								</paragraph><paragraph id="H37EF18A2F0C94013B8B4B7F037D8F2FB"><enum>(2)</enum><text>an administrative
				law judge.</text>
								</paragraph></subsection><subsection id="HCCD066CC82044DBE84B9BC642AB0BE07"><enum>(i)</enum><header>Rules of
				construction</header><text>Subject to section 202 of the
				<short-title>Department of the Interior Tribal
				Self-Governance Act of 2013</short-title>, each provision of this title and
				each provision of a compact or funding agreement shall be liberally construed
				for the benefit of the Indian tribe participating in self-governance, and any
				ambiguity shall be resolved in favor of the Indian tribe.</text>
							</subsection></section><section id="H0340AE493D1D4FFB820F30D397C3C9F9"><enum>407.</enum><header>Construction
				programs and projects</header>
							<subsection id="H636368C37B414D93B53F25CF87EAE4ED"><enum>(a)</enum><header>In
				general</header><text>Indian tribes participating in tribal self-governance may
				carry out construction projects under this title.</text>
							</subsection><subsection id="H66384F8E8AD14FDCB8B78CC589C69CC9"><enum>(b)</enum><header>Tribal option To
				carry out certain federal environmental activities</header><text>In carrying
				out a construction project under this title, an Indian tribe may, subject to
				the agreement of the Secretary, elect to assume some Federal responsibilities
				under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>),
				the National Historic Preservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/470">16 U.S.C. 470 et seq.</external-xref>), and related
				provisions of law and regulations that would apply if the Secretary were to
				undertake a construction project, by adopting a resolution—</text>
								<paragraph id="H12BD1053BDD54D04878432AA919A7322"><enum>(1)</enum><text>designating a
				certifying tribal officer to represent the Indian tribe and to assume the
				status of a responsible Federal official under those Acts or regulations;
				and</text>
								</paragraph><paragraph id="H85CE82723E0243AD940A4B0964506002"><enum>(2)</enum><text>accepting the
				jurisdiction of the United States courts for the purpose of enforcing the
				responsibilities of the certifying tribal officer assuming the status of a
				responsible Federal official under those Acts or regulations.</text>
								</paragraph></subsection><subsection id="H236681AE2C394B34AE8CFE6C782B84BD"><enum>(c)</enum><header>Savings
				clause</header><text>Notwithstanding subsection (b), nothing in this section
				authorizes the Secretary to include in any compact or funding agreement duties
				of the Secretary under the National Environmental Policy Act (42 U.S.C. 4321 et
				seq.), the National Historic Preservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/470">16 U.S.C. 470 et seq.</external-xref>), and
				other related provisions of law that are inherent Federal functions.</text>
							</subsection><subsection id="H5A463B63B0354195B829E79DDA213470"><enum>(d)</enum><header>Codes and
				standards</header><text>In carrying out a construction project under this
				title, an Indian tribe shall—</text>
								<paragraph id="H7A55710E2F4F4BB3A8E78215A10E2080"><enum>(1)</enum><text>adhere to
				applicable Federal, State, local, and tribal building codes, architectural and
				engineering standards, and applicable Federal guidelines regarding design,
				space, and operational standards, appropriate for the particular project;
				and</text>
								</paragraph><paragraph id="HB5D434E44FA645C68795B32C17278BEE"><enum>(2)</enum><text>use only
				architects and engineers who—</text>
									<subparagraph id="HBD28A08D1B374315B63F4761A328A7D6"><enum>(A)</enum><text>are licensed to
				practice in the State in which the facility will be built; and</text>
									</subparagraph><subparagraph id="H82608C616C29448A914EF1AF32E0BDDB"><enum>(B)</enum><text>certify
				that—</text>
										<clause id="HCFA5F423DF8C41238DD653C8E474A2AD"><enum>(i)</enum><text>they are qualified
				to perform the work required by the specific construction involved; and</text>
										</clause><clause id="H6A0D4B5DF43F4D3995D0E4B3E7E5105E"><enum>(ii)</enum><text>upon completion
				of design, the plans and specifications meet or exceed the applicable
				construction and safety codes.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="HF0E7C95D9D894211BCD96CB064977956"><enum>(e)</enum><header>Tribal
				accountability</header>
								<paragraph id="HF35EC6DE7D1E4400BD03E34601813524"><enum>(1)</enum><header>In
				general</header><text>In carrying out a construction project under this title,
				an Indian tribe shall assume responsibility for the successful completion of
				the construction project and of a facility that is usable for the purpose for
				which the Indian tribe received funding.</text>
								</paragraph><paragraph id="H98D88820F2264868B33957738FA62675"><enum>(2)</enum><header>Requirements</header><text>For
				each construction project carried out by an Indian tribe under this title, the
				Indian tribe and the Secretary shall negotiate a provision to be included in
				the funding agreement that identifies—</text>
									<subparagraph id="H1489070D47F343E1B18433B3C3BC4389"><enum>(A)</enum><text>the approximate
				start and completion dates for the project, which may extend over a period of
				one or more years;</text>
									</subparagraph><subparagraph id="H21B4EF4DEE924BEFAB3F933CA62E482C"><enum>(B)</enum><text>a general
				description of the project, including the scope of work, references to design
				criteria, and other terms and conditions;</text>
									</subparagraph><subparagraph id="H5D025A0554074675A0A6002C906643D2"><enum>(C)</enum><text>the
				responsibilities of the Indian tribe and the Secretary for the project;</text>
									</subparagraph><subparagraph id="H01F1D99E82D54873BED02893AC23F38B"><enum>(D)</enum><text>how
				project-related environmental considerations will be addressed;</text>
									</subparagraph><subparagraph id="H242E4F7D74104390B982B391F113A31B"><enum>(E)</enum><text>the amount of
				funds provided for the project;</text>
									</subparagraph><subparagraph id="HF5456422EDC441F99D27D1CD4E3AD087"><enum>(F)</enum><text>the obligations of
				the Indian tribe to comply with the codes referenced in subsection (c)(1) and
				applicable Federal laws and regulations;</text>
									</subparagraph><subparagraph id="HBEE11E2E5F2446A287A0BD4047C9204F"><enum>(G)</enum><text>the agreement of
				the parties over who will bear any additional costs necessary to meet changes
				in scope, or errors or omissions in design and construction; and</text>
									</subparagraph><subparagraph id="HECD4CCC272E244A3ACFEDA37C39FC20C"><enum>(H)</enum><text>the agreement of
				the Secretary to issue a certificate of occupancy, if requested by the Indian
				tribe, based upon the review and verification by the Secretary, to the
				satisfaction of the Secretary, that the Indian tribe has secured upon
				completion the review and approval of the plans and specifications, sufficiency
				of design, life safety, and code compliance by qualified, licensed, and
				independent architects and engineers.</text>
									</subparagraph></paragraph></subsection><subsection id="H44F92AA7B68443A29CD921CDA56CB78E"><enum>(f)</enum><header>Funding</header>
								<paragraph id="H833733F958F54B978342CB435A7F2F2B"><enum>(1)</enum><header>In
				general</header><text>Subject to section 202 of the
				<short-title>Department of the Interior Tribal
				Self-Governance Act of 2013</short-title>, funding appropriated for
				construction projects carried out under this title shall be included in funding
				agreements as annual or semiannual advance payments at the option of the Indian
				tribe.</text>
								</paragraph><paragraph id="HA540E12676D3494F9E27F581B31C69F6"><enum>(2)</enum><header>Advance
				payments</header><text>Subject to section 202 of the
				<short-title>Department of the Interior Tribal
				Self-Governance Act of 2013</short-title>, the Secretary shall include all
				associated project contingency funds with each advance payment, and the Indian
				tribe shall be responsible for the management of such contingency funds.</text>
								</paragraph></subsection><subsection id="H1BBCF0DC46D345C3BFE7B7E136876C92"><enum>(g)</enum><header>Negotiations</header><text>At
				the option of the Indian tribe, construction project funding proposals shall be
				negotiated pursuant to the statutory process in section 105, and any resulting
				construction project agreement shall be incorporated into the funding agreement
				as addenda.</text>
							</subsection><subsection id="H07248C87F7E84FA1BAB71CB70342D2DA"><enum>(h)</enum><header>Federal review
				and verification</header>
								<paragraph id="H5DD99CBD15624ED2B57D7AE9092F1272"><enum>(1)</enum><header>In
				general</header><text>On a schedule negotiated by the Secretary and the Indian
				tribe—</text>
									<subparagraph id="H764DF363F9894430A1F5B27BBB69E5EC"><enum>(A)</enum><text>the Secretary
				shall review and verify, to the satisfaction of the Secretary, that project
				planning and design documents prepared by the Indian tribe in advance of
				initial construction are in conformity with the obligations of the Indian tribe
				under subsection (c); and</text>
									</subparagraph><subparagraph id="H80D18587DB52498FAC5333EA7C499A87"><enum>(B)</enum><text>before the project
				planning and design documents are implemented, the Secretary shall review and
				verify to the satisfaction of the Secretary that subsequent document amendments
				which result in a significant change in construction are in conformity with the
				obligations of the Indian tribe under subsection (c).</text>
									</subparagraph></paragraph><paragraph id="HE1273F62B73B4261B289B4BA04DB88AB"><enum>(2)</enum><header>Reports</header><text>The
				Indian tribe shall provide the Secretary with project progress and financial
				reports not less than semiannually.</text>
								</paragraph><paragraph id="HCF1917161E3C48738F0F4281DAF4EC2C"><enum>(3)</enum><header>Oversight
				visits</header><text>The Secretary may conduct onsite project oversight visits
				semiannually or on an alternate schedule agreed to by the Secretary and the
				Indian tribe.</text>
								</paragraph></subsection><subsection id="H1ED27EFFF3ED4C7DA10A3FA80475D515"><enum>(i)</enum><header>Application of
				other laws</header><text>Unless otherwise agreed to by the Indian tribe and
				except as otherwise provided in this Act, no provision of the Office of Federal
				Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/401">41 U.S.C. 401 et seq.</external-xref>), the Federal Acquisition
				Regulations issued pursuant to that Act, or any other law or regulation
				pertaining to Federal procurement (including Executive orders) shall apply to
				any construction program or project carried out under this title.</text>
							</subsection><subsection id="H8A5D39652977443BA271A84F498E725F"><enum>(j)</enum><header>Future
				funding</header><text>Subject to section 202 of the
				<short-title>Department of the Interior Tribal
				Self-Governance Act of 2013</short-title>, upon completion of a facility
				constructed under this title, the Secretary shall include the facility among
				those eligible for annual operation and maintenance funding support comparable
				to that provided for similar facilities funded by the Department as annual
				appropriations are available and to the extent that the facility size and
				complexity and other factors do not exceed the funding formula criteria for
				comparable buildings.</text>
							</subsection></section><section id="H57EE96CFF44D46838D55311A14FE28C6"><enum>408.</enum><header>Payment</header>
							<subsection id="H469E64D5988445EFBF35C78C86809880"><enum>(a)</enum><header>In
				general</header><text>At the request of the governing body of an Indian tribe
				and under the terms of an applicable funding agreement, the Secretary shall
				provide funding to the Indian tribe to carry out the funding agreement.</text>
							</subsection><subsection id="H2C6F8B628FE84A6AA92F38B25EB258F1"><enum>(b)</enum><header>Advance annual
				payment</header><text>At the option of the Indian tribe, a funding agreement
				shall provide for an advance annual payment to an Indian tribe.</text>
							</subsection><subsection id="H938A9286C08345DC8AE5FE8D471CE1BA"><enum>(c)</enum><header>Amount</header>
								<paragraph id="H224984C56B974FC8897F710DD31FF202"><enum>(1)</enum><header>In
				general</header><text>Subject to subsection (e) and sections 403 and 405, the
				Secretary shall provide funds to the Indian tribe under a funding agreement for
				programs in an amount that is equal to the amount that the Indian tribe would
				have been entitled to receive under contracts and grants under this Act
				(including amounts for direct program and contract support costs and, in
				addition, any funds that are specifically or functionally related to the
				provision by the Secretary of services and benefits to the Indian tribe or its
				members) without regard to the organization level within the Department at
				which the programs are carried out.</text>
								</paragraph><paragraph id="HE58CB57C99E84B9FB965F148B6CB68ED"><enum>(2)</enum><header>Savings
				clause</header><text>Nothing in this section reduces programs, services, or
				funds of, or provided to, another Indian tribe.</text>
								</paragraph></subsection><subsection id="H802AB6B1212C4D69BF88E03839684256"><enum>(d)</enum><header>Timing</header>
								<paragraph id="HE2696F5B613D40B6B85B54CEF74E6F0B"><enum>(1)</enum><header>In
				general</header><text>Pursuant to the terms of any compact or funding agreement
				entered into under this title, the Secretary shall transfer to the Indian tribe
				all funds provided for in the funding agreement, pursuant to subsection (c),
				and provide funding for periods covered by joint resolution adopted by Congress
				making continuing appropriations, to the extent permitted by such
				resolution.</text>
								</paragraph><paragraph id="H33B5E0A26013478B8AE0910741445CBF"><enum>(2)</enum><header>Transfers</header><text>Not
				later than 1 year after the date of enactment of the
				<short-title>Department of the Interior Tribal
				Self-Governance Act of 2013</short-title>, in any instance in which a funding
				agreement requires an annual transfer of funding to be made at the beginning of
				a fiscal year or requires semiannual or other periodic transfers of funding to
				be made commencing at the beginning of a fiscal year, the first such transfer
				shall be made not later than 10 days after the apportionment of such funds by
				the Office of Management and Budget to the Department, unless the funding
				agreement provides otherwise.</text>
								</paragraph></subsection><subsection id="H16B7CE5689984F67BA6D3F2113DF287A"><enum>(e)</enum><header>Availability</header><text>Funds
				for trust services to individual Indians shall be available under a funding
				agreement only to the extent that the same services that would have been
				provided by the Secretary are provided to individual Indians by the Indian
				tribe.</text>
							</subsection><subsection id="HB5BF58197D384FD5BD143427ABA15572"><enum>(f)</enum><header>Multiyear
				funding</header><text>A funding agreement may provide for multiyear
				funding.</text>
							</subsection><subsection id="HB1CA3800A144407ABA7EA8954B7EE630"><enum>(g)</enum><header>Limitations on
				authority of the secretary</header><text>The Secretary shall not—</text>
								<paragraph id="HEA374CDC6B82447E85EEBB7849143B38"><enum>(1)</enum><text>fail to transfer
				to an Indian tribe its full share of any central, headquarters, regional, area,
				or service unit office or other funds due under this title for programs
				eligible under paragraph (1) or (2) of section 403(b), except as required by
				Federal law;</text>
								</paragraph><paragraph id="HAD0B721D357C4C82AFC3A8040D8AEB30"><enum>(2)</enum><text>withhold any
				portion of such funds for transfer over a period of years; or</text>
								</paragraph><paragraph id="HBF4B7A526265442C85B4D5483F499511"><enum>(3)</enum><text>reduce the amount
				of funds required under this title—</text>
									<subparagraph id="H904BB4A1E9B845C7A46393D7C648725E"><enum>(A)</enum><text>to make funding
				available for self-governance monitoring or administration by the
				Secretary;</text>
									</subparagraph><subparagraph id="HC0CE8879A5534AD9B55F18E9E1E8ED27"><enum>(B)</enum><text>in subsequent
				years, except as necessary as a result of—</text>
										<clause id="HFC9861253047439DB464AE19C8A096AA"><enum>(i)</enum><text>a
				reduction in appropriations from the previous fiscal year for the program to be
				included in a compact or funding agreement;</text>
										</clause><clause id="H624B601E2A57419192025AB85A64A9A5"><enum>(ii)</enum><text>a
				congressional directive in legislation or an accompanying report;</text>
										</clause><clause id="HCDAD855E33984BEF86EE71AE402ACEFD"><enum>(iii)</enum><text>a tribal
				authorization;</text>
										</clause><clause id="HAE3844C2E1A1458C8A6E09D22EC5DBE4"><enum>(iv)</enum><text>a
				change in the amount of pass-through funds subject to the terms of the funding
				agreement; or</text>
										</clause><clause id="H3048A6DA2B93475FA5A37ECC89EF03DF"><enum>(v)</enum><text>completion of an
				activity under a program for which the funds were provided;</text>
										</clause></subparagraph><subparagraph id="H95298AF461154D07BCA38C6D6C332F13"><enum>(C)</enum><text>to pay for Federal
				functions, including—</text>
										<clause id="HA503A051B80D430FBD4D29C694705F07"><enum>(i)</enum><text>Federal pay
				costs;</text>
										</clause><clause id="HC3E9417C7B73405681B1033967EC8286"><enum>(ii)</enum><text>Federal employee
				retirement benefits;</text>
										</clause><clause id="HDAC090F362F146DFBA5E81AEFC5E019A"><enum>(iii)</enum><text>automated data
				processing;</text>
										</clause><clause id="H18BADF628A62468FBB6F17BDFBD0CB49"><enum>(iv)</enum><text>technical
				assistance; and</text>
										</clause><clause id="H2ADD48679298424193516AEDA9371638"><enum>(v)</enum><text>monitoring of
				activities under this title; or</text>
										</clause></subparagraph><subparagraph id="H8C07392454674E5297FB838F769551DC"><enum>(D)</enum><text>to pay for costs
				of Federal personnel displaced by self-determination contracts under this Act
				or self-governance under this title.</text>
									</subparagraph></paragraph></subsection><subsection id="H7818AF14D8C64A65971746B618D85DAA"><enum>(h)</enum><header>Federal
				resources</header><text>If an Indian tribe elects to carry out a compact or
				funding agreement with the use of Federal personnel, Federal supplies
				(including supplies available from Federal warehouse facilities), Federal
				supply sources (including lodging, airline transportation, and other means of
				transportation, including the use of interagency motor pool vehicles), or other
				Federal resources (including supplies, services, and resources available to the
				Secretary under any procurement contracts in which the Department is eligible
				to participate), the Secretary shall, as soon as practicable, acquire and
				transfer such personnel, supplies, or resources to the Indian tribe under this
				title.</text>
							</subsection><subsection id="HA44C9A08CAFF4D9990E6B5AFC0B94DB3"><enum>(i)</enum><header>Prompt payment
				act</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/39">Chapter 39</external-xref> of title 31, United States Code, shall apply to
				the transfer of funds due under a compact or funding agreement authorized under
				this title.</text>
							</subsection><subsection id="HC5BC6EDBCB7C4A95AA57D3BF21EC7CE8"><enum>(j)</enum><header>Interest or
				other income</header>
								<paragraph id="H96EB7D0EB4284A9F860B4405073804A0"><enum>(1)</enum><header>In
				general</header><text>An Indian tribe may retain interest or income earned on
				any funds paid under a compact or funding agreement to carry out governmental
				purposes.</text>
								</paragraph><paragraph id="HA26C2812CA404A7CA61A7B992125F29F"><enum>(2)</enum><header>No effect on
				other amounts</header><text>The retention of interest or income under paragraph
				(1) shall not diminish the amount of funds an Indian tribe is entitled to
				receive under a funding agreement in the year the interest or income is earned
				or in any subsequent fiscal year.</text>
								</paragraph><paragraph id="H5A0AAE50830748E499CDF9F9019AC7B8"><enum>(3)</enum><header>Investment
				standard</header><text>Funds transferred under this title shall be managed by
				the Indian tribe using the prudent investment standard, provided that the
				Secretary shall not be liable for any investment losses of funds managed by the
				Indian tribe that are not otherwise guaranteed or insured by the Federal
				Government.</text>
								</paragraph></subsection><subsection id="H22C9219CD9564791A7D0FD7DB08C437F"><enum>(k)</enum><header>Carryover of
				funds</header>
								<paragraph id="HB7C19984028046B28B168C3FFB76A97B"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any provision of an appropriations Act,
				all funds paid to an Indian tribe in accordance with a compact or funding
				agreement shall remain available until expended.</text>
								</paragraph><paragraph id="H9754199C55DE4D0F8AC4A993CD6D7F69"><enum>(2)</enum><header>Effect of
				carryover</header><text>If an Indian tribe elects to carry over funding from 1
				year to the next, the carryover shall not diminish the amount of funds the
				Indian tribe is entitled to receive under a funding agreement in that fiscal
				year or any subsequent fiscal year.</text>
								</paragraph></subsection><subsection id="HA114E25397E3481382B4F292CB3D7F6D"><enum>(l)</enum><header>Limitation of
				costs</header>
								<paragraph id="H1B6FBAB9772A48EABC96CAAFEB89FFC6"><enum>(1)</enum><header>In
				general</header><text>An Indian tribe shall not be obligated to continue
				performance that requires an expenditure of funds in excess of the amount of
				funds transferred under a compact or funding agreement.</text>
								</paragraph><paragraph id="HD57286625E15414BB430A14ECB0A841D"><enum>(2)</enum><header>Notice of
				insufficiency</header><text>If at any time the Indian tribe has reason to
				believe that the total amount provided for a specific activity under a compact
				or funding agreement is insufficient, the Indian tribe shall provide reasonable
				notice of such insufficiency to the Secretary.</text>
								</paragraph><paragraph id="H181D7ABCA8D647B198351FBE5BCF7F14"><enum>(3)</enum><header>Suspension of
				performance</header><text>If, after notice under paragraph (2), the Secretary
				does not increase the amount of funds transferred under the funding agreement,
				the Indian tribe may suspend performance of the activity until such time as
				additional funds are transferred.</text>
								</paragraph><paragraph id="H4FEBBD3AC45644B49CF9B8CE42D2935C"><enum>(4)</enum><header>Savings
				clause</header><text>Nothing in this section reduces any programs, services, or
				funds of, or provided to, another Indian tribe.</text>
								</paragraph></subsection><subsection id="H91F268112E034CE8B018B1A28A844A5C"><enum>(m)</enum><header>Distribution of
				funds</header><text>The Office of Self-Governance shall be responsible for
				distribution of all Bureau of Indian Affairs funds provided under this title
				unless otherwise agreed by the parties to an applicable funding
				agreement.</text>
							</subsection><subsection id="id90c663ebba0d4838bc34f7f17bdbb191"><enum>(n)</enum><header>Applicability</header><text>Section
				202 of the <short-title>Department of the Interior Tribal
				Self-Governance Act of 2013</short-title> applies to subsections (a) through
				(m).</text>
							</subsection></section><section id="H52B1CCEB2FB8499A93923DD3CE007F75"><enum>409.</enum><header>Facilitation</header>
							<subsection id="HC8ACD10E8D3748C6AFA1FB54C9BB068F"><enum>(a)</enum><header>In
				general</header><text>Except as otherwise provided by law (including section
				202 of the <short-title>Department of the Interior Tribal
				Self-Governance Act of 2013</short-title>), the Secretary shall interpret each
				Federal law and regulation in a manner that facilitates—</text>
								<paragraph id="H7732F538A244406E8C87ACA53346E332"><enum>(1)</enum><text>the inclusion of
				programs in funding agreements; and</text>
								</paragraph><paragraph id="HAD5449F4E40245E59DD2B20A84D04876"><enum>(2)</enum><text>the implementation
				of funding agreements.</text>
								</paragraph></subsection><subsection id="HAD53D48A0F674636AF333415A67BEC92"><enum>(b)</enum><header>Regulation
				waiver</header>
								<paragraph id="HB03B03954F144C67B0B84AD9F9369CB6"><enum>(1)</enum><header>Request</header><text>An
				Indian tribe may submit to the Secretary a written request for a waiver of
				applicability of a Federal regulation, including—</text>
									<subparagraph id="H5C813BF5B76C46EF82748E17B1456A6A"><enum>(A)</enum><text>an identification
				of the specific text in the regulation sought to be waived; and</text>
									</subparagraph><subparagraph id="HB4A7A65811EF4755BA720092581ADCCD"><enum>(B)</enum><text>the basis for the
				request.</text>
									</subparagraph></paragraph><paragraph id="H26657FDEB88B49539F54EA1EA0458479"><enum>(2)</enum><header>Determination by
				the secretary</header><text>Not later than 120 days after receipt by the
				Secretary and the designated officials under paragraph (4) of a request under
				paragraph (1), the Secretary shall approve or deny the requested waiver in
				writing to the Indian tribe.</text>
								</paragraph><paragraph id="HBF7E4A900A5340B4933048BD642916A3"><enum>(3)</enum><header>Extensions</header><text>The
				deadline described in paragraph (2) may be extended for any length of time, as
				agreed upon by both the Indian tribe and the Secretary.</text>
								</paragraph><paragraph id="H6E525022A6944AACB53D380645A592E7"><enum>(4)</enum><header>Designated
				officials</header><text>The Secretary shall designate one or more appropriate
				officials in the Department to receive a copy of the waiver request described
				in paragraph (1).</text>
								</paragraph><paragraph id="H4DE909ED0EAE4F24BE806B937CCD4539"><enum>(5)</enum><header>Grounds for
				denial</header><text>The Secretary may deny a request under paragraph
				(1)—</text>
									<subparagraph id="H225BD2BC26754A71B0458241DAD0ACFF"><enum>(A)</enum><text>for a program
				eligible under paragraph (1) or (2) of section 403(b), only upon a specific
				finding by the Secretary that the identified text in the regulation may not be
				waived because such a waiver is prohibited by Federal law; and</text>
									</subparagraph><subparagraph id="HB27566592E30439781672763C7B2389A"><enum>(B)</enum><text>for a program
				eligible under section 403(c), upon a specific finding by the Secretary that
				the waiver is prohibited by Federal law or is inconsistent with the express
				provisions of the funding agreement.</text>
									</subparagraph></paragraph><paragraph id="H40D0F748CF314524B17D79728151C8A3"><enum>(6)</enum><header>Failure to make
				determination</header><text>If the Secretary fails to approve or deny a waiver
				request within the period required under paragraph (2), the Secretary shall be
				deemed to have approved the request.</text>
								</paragraph><paragraph id="HBDFB6632391040FDBB29FF18EF193FD5"><enum>(7)</enum><header>Finality</header><text>A
				decision of the Secretary under this section shall be final for the
				Department.</text>
								</paragraph></subsection></section><section id="HCB2944424D2340479E203460E92DDF6E"><enum>410.</enum><header>Disclaimers</header><text display-inline="no-display-inline">Nothing in this title expands or alters any
				statutory authority of the Secretary in a manner that authorizes the Secretary
				to enter into any agreement under section 403—</text>
							<paragraph id="H988A963F988949018D15B6656E4A9BC5"><enum>(1)</enum><text>with respect to an
				inherent Federal function;</text>
							</paragraph><paragraph id="H102BF6DE63E544C9B33DEEBEBF81543E"><enum>(2)</enum><text>in a case in which
				the law establishing a program explicitly prohibits the type of participation
				sought by the Indian tribe (without regard to whether one or more Indian tribes
				are identified in the authorizing law); or</text>
							</paragraph><paragraph id="H71B707D80EEB4FEAB433715F60812E6B"><enum>(3)</enum><text>that limits or
				reduces in any way the services, contracts, or funds that any other Indian
				tribe or tribal organization is eligible to receive under section 102 or any
				other applicable Federal law.</text>
							</paragraph></section><section id="HF00801BDB02B4ECB807BF95953372681"><enum>411.</enum><header>Discretionary
				application of other sections</header>
							<subsection id="HDF431324ED4F43A8B3B45B8AD7764DBB"><enum>(a)</enum><header>In
				general</header><text>Except as otherwise provided in section 101(c), at the
				option of a participating Indian tribe or Indian tribes, any of the provisions
				of title I may be incorporated in any compact or funding agreement under this
				title.</text>
							</subsection><subsection id="H5CD4A904F46C416C91E152FF77EC1714"><enum>(b)</enum><header>Effect</header><text>Each
				incorporated provision under subsection (a) shall—</text>
								<paragraph id="HF712C2D15CB6402DAD3C247CB48DED8F"><enum>(1)</enum><text>have the same
				force and effect as if set out in full in this title;</text>
								</paragraph><paragraph id="H63928F19A2FD41ECAB2996BD80886513"><enum>(2)</enum><text>supplement or
				replace any related provision in this title; and</text>
								</paragraph><paragraph id="H57D30340194E4DCBA9E61B834EEF71C1"><enum>(3)</enum><text>apply to any
				agency otherwise governed by this title.</text>
								</paragraph></subsection><subsection id="HBC734EE2CAA14EA798D3A2B631EAC333"><enum>(c)</enum><header>Effective
				date</header><text>If an Indian tribe requests incorporation at the negotiation
				stage of a compact or funding agreement, the incorporation shall—</text>
								<paragraph id="HD202CF8706EF4D999879D926EC876A67"><enum>(1)</enum><text>be effective
				immediately; and</text>
								</paragraph><paragraph id="H2139194964D94133A2197AE2B8147147"><enum>(2)</enum><text>control the
				negotiation and resulting compact and funding agreement.</text>
								</paragraph></subsection></section><section id="H2B68687062BC4099A2F8C0D21DB5CB5E"><enum>412.</enum><header>Annual Budget
				list</header><text display-inline="no-display-inline">The Secretary shall list,
				in the annual budget request submitted to Congress under section 1105 of title
				31, United States Code, any funds proposed to be included in funding agreements
				authorized under this Act.</text>
						</section><section id="H6B794A5CFB51491EB17D6DD97CC2F937"><enum>413.</enum><header>Reports</header>
							<subsection id="HB426FF7E431E4572AD53F501848FA195"><enum>(a)</enum><header>In
				general</header>
								<paragraph id="HB312082FE37A4F64BAD869B59068FB5A"><enum>(1)</enum><header>Requirement</header><text>On
				January 1 of each year, the Secretary shall submit to Congress a report
				regarding the administration of this title.</text>
								</paragraph><paragraph id="H427FB4CA58994657BC717168CA3CDC52"><enum>(2)</enum><header>Analysis</header><text>Any
				Indian tribe may submit to the Office of Self-Governance and to the appropriate
				Committees of Congress a detailed annual analysis of unmet tribal needs for
				funding agreements under this title.</text>
								</paragraph></subsection><subsection id="H0351A3107AF1413DBCE2484CC201E402"><enum>(b)</enum><header>Contents</header><text>The
				report under subsection (a)(1) shall—</text>
								<paragraph id="H73BC5DDA47A449D38069DBDD94586496"><enum>(1)</enum><text>be compiled from
				information contained in funding agreements, annual audit reports, and data of
				the Secretary regarding the disposition of Federal funds;</text>
								</paragraph><paragraph id="H851934F02A944C59B95C0F3112469AD2"><enum>(2)</enum><text>identify—</text>
									<subparagraph id="H9AAC18813FF445D29B378AC8EFC4CBAE"><enum>(A)</enum><text>the relative costs
				and benefits of self-governance;</text>
									</subparagraph><subparagraph id="HD743965925B949108EF88177C776DF1E"><enum>(B)</enum><text>with
				particularity, all funds that are specifically or functionally related to the
				provision by the Secretary of services and benefits to self-governance Indian
				tribes and members of Indian tribes;</text>
									</subparagraph><subparagraph id="H87F9EB1AFD744793B37E163FE15D036E"><enum>(C)</enum><text>the funds
				transferred to each Indian tribe and the corresponding reduction in the Federal
				employees and workload; and</text>
									</subparagraph><subparagraph id="HA14C7E3DB6194158A731573F1619E499"><enum>(D)</enum><text>the funding
				formula for individual tribal shares of all Central Office funds, together with
				the comments of affected Indian tribes, developed under subsection (d);</text>
									</subparagraph></paragraph><paragraph id="H60BC38FC335A44289AD3D30E2C240E1F"><enum>(3)</enum><text>before being
				submitted to Congress, be distributed to the Indian tribes for comment (with a
				comment period of no less than 30 days);</text>
								</paragraph><paragraph id="HD22C4A71F98647538B80C433103F2B0E"><enum>(4)</enum><text>include the
				separate views and comments of each Indian tribe or tribal organization;
				and</text>
								</paragraph><paragraph id="H6F20BEF5DB844457B3FEAE9EB923EC0F"><enum>(5)</enum><text>include a list
				of—</text>
									<subparagraph id="HC97528B4517345C4BE49D50245819E4B"><enum>(A)</enum><text>all such programs
				that the Secretary determines, in consultation with Indian tribes participating
				in self-governance, are eligible for negotiation to be included in a funding
				agreement at the request of a participating Indian tribe; and</text>
									</subparagraph><subparagraph id="H67937A4E4CEA4B39BE231E2C40ABD73A"><enum>(B)</enum><text>all such programs
				which Indian tribes have formally requested to include in a funding agreement
				under section 403(c) due to the special geographic, historical, or cultural
				significance of the program to the Indian tribe, indicating whether each
				request was granted or denied, and stating the grounds for any denial.</text>
									</subparagraph></paragraph></subsection><subsection id="H4EEEB99F623F4E99B29AA3C9A6FFB6BC"><enum>(c)</enum><header>Report on
				non-BIA, non-OST programs</header>
								<paragraph id="H0C9D293AD11E44AB8C5F52000D51B389"><enum>(1)</enum><header>In
				general</header><text>In order to optimize opportunities for including
				non-Bureau of Indian Affairs and non-Office of Special Trustee programs in
				agreements with Indian tribes participating in self-governance under this
				title, the Secretary shall review all programs administered by the Department,
				other than through the Bureau of Indian Affairs or Office of the Special
				Trustee, without regard to the agency or office concerned.</text>
								</paragraph><paragraph id="H6F27E813726C40DEB0CD553F12AAA78C"><enum>(2)</enum><header>Programmatic
				targets</header><text>The Secretary shall establish programmatic targets, after
				consultation with Indian tribes participating in self-governance, to encourage
				bureaus of the Department to ensure that an appropriate portion of those
				programs are available to be included in funding agreements.</text>
								</paragraph><paragraph id="H77D7C97328374408B56B5346E3ED6CCF"><enum>(3)</enum><header>Publication</header><text>The
				lists under subsection (b)(5) and targets under paragraph (2) shall be
				published in the Federal Register and made available to any Indian tribe
				participating in self-governance.</text>
								</paragraph><paragraph id="HD313606187DE4FFDA87FD4F2DD2FBD9F"><enum>(4)</enum><header>Annual
				review</header>
									<subparagraph id="HC5BB42ED850E4CFB8511AADB22366DB6"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall annually review and publish in the
				Federal Register, after consultation with Indian tribes participating in
				self-governance, revised lists and programmatic targets.</text>
									</subparagraph><subparagraph id="H3436547F53E04B659C6ADCB6B8464054"><enum>(B)</enum><header>Contents</header><text>In
				preparing the revised lists and programmatic targets, the Secretary shall
				consider all programs that were eligible for contracting in the original list
				published in the Federal Register in 1995, except for programs specifically
				determined not to be contractible as a matter of law.</text>
									</subparagraph></paragraph></subsection><subsection id="HA5EF5D4BD0F24701B18DC593844C91E4"><enum>(d)</enum><header>Report on
				central office funds</header><text>Not later than January 1, 2013, the
				Secretary shall, in consultation with Indian tribes, develop a funding formula
				to determine the individual tribal share of funds controlled by the Central
				Office of the Bureau of Indian Affairs and the Office of the Special Trustee
				for inclusion in the compacts.</text>
							</subsection></section><section id="H6DF741479D124BA3B12105107B0DA942"><enum>414.</enum><header>Regulations</header>
							<subsection id="HD9ADD7A8337B40FAACC77D7012652B94"><enum>(a)</enum><header>In
				general</header>
								<paragraph id="H908E31A738844DC59D72F02D21296FFB"><enum>(1)</enum><header>Promulgation</header><text>Not
				later than 90 days after the date of enactment of the
				<short-title>Department of the Interior Tribal
				Self-Governance Act of 2013</short-title>, the Secretary shall initiate
				procedures under subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, to
				negotiate and promulgate such regulations as are necessary to carry out this
				title.</text>
								</paragraph><paragraph id="H7E628E7B9E1546A896AC47001D69427C"><enum>(2)</enum><header>Publication of
				proposed regulations</header><text>Proposed regulations to implement this title
				shall be published in the Federal Register not later than 21 months after the
				date of enactment of the <short-title>Department of the
				Interior Tribal Self-Governance Act of 2013</short-title>.</text>
								</paragraph><paragraph id="H555CB31E8BC44218975969FCC83E4516"><enum>(3)</enum><header>Expiration of
				authority</header><text>The authority to promulgate regulations under paragraph
				(1) shall expire on the date that is 30 months after the date of enactment of
				the <short-title>Department of the Interior Tribal
				Self-Governance Act of 2013</short-title>.</text>
								</paragraph></subsection><subsection id="H7F01A3919B134E799D1ADF99A1E12E2E"><enum>(b)</enum><header>Committee</header>
								<paragraph id="HA2B57C4F95084574A0D13CBE08FC3AC7"><enum>(1)</enum><header>Membership</header><text>A
				negotiated rulemaking committee established pursuant to <external-xref legal-doc="usc" parsable-cite="usc/5/565">section 565</external-xref> of title 5,
				United States Code, to carry out this section shall have as its members only
				representatives of the Federal Government and tribal government.</text>
								</paragraph><paragraph id="H379DC5D9AB5E44979BCDDC05E39FB19B"><enum>(2)</enum><header>Lead
				agency</header><text>Among the Federal representatives described in paragraph
				(1), the Office of Self-Governance shall be the lead agency for the
				Department.</text>
								</paragraph></subsection><subsection id="H84A4B695E6AB45D5A2CB1D1CC7FA6E2C"><enum>(c)</enum><header>Adaptation of
				procedures</header><text>The Secretary shall adapt the negotiated rulemaking
				procedures to the unique context of self-governance and the
				government-to-government relationship between the United States and Indian
				tribes.</text>
							</subsection><subsection id="HC7E21BC9CEE44145AE4DD6146D628FBF"><enum>(d)</enum><header>Effect</header>
								<paragraph id="HE5F4AA488F3D45C68191B0A72DD80F9F"><enum>(1)</enum><header>Repeal</header><text>The
				Secretary may repeal any regulation that is inconsistent with this Act.</text>
								</paragraph><paragraph id="HC083BFC38EAB4C2A9A50B67C65AC02BE"><enum>(2)</enum><header>Conflicting
				provisions</header><text>Subject to section 202 of the
				<short-title>Department of the Interior Tribal
				Self-Governance Act of 2013</short-title>, this title shall supersede any
				conflicting provision of law (including any conflicting regulations).</text>
								</paragraph><paragraph id="HFA307C557F324E1A8302071EDCF9F75B"><enum>(3)</enum><header>Effectiveness
				without regard to regulations</header><text>The lack of promulgated regulations
				on an issue shall not limit the effect or implementation of this title.</text>
								</paragraph></subsection></section><section id="HB49BE92DE74145FFAA1F5BC930C1515D"><enum>415.</enum><header>Effect of
				circulars, policies, manuals, guidance, and rules</header><text display-inline="no-display-inline">Unless expressly agreed to by a
				participating Indian tribe in a compact or funding agreement, the participating
				Indian tribe shall not be subject to any agency circular, policy, manual,
				guidance, or rule adopted by the Department, except for—</text>
							<paragraph id="HEC7043DAACF9420D9FB88F78E068E5DC"><enum>(1)</enum><text>the eligibility
				provisions of section 105(g); and</text>
							</paragraph><paragraph id="H52DAF9B5E2AD45DD8126A10FBDD28088"><enum>(2)</enum><text>regulations
				promulgated pursuant to section 414.</text>
							</paragraph></section><section id="HB41877F513AE47DEBD73193742887999"><enum>416.</enum><header>Appeals</header><text display-inline="no-display-inline">Except as provided in section 406(d), in any
				administrative action, appeal, or civil action for judicial review of any
				decision made by the Secretary under this title, the Secretary shall have the
				burden of proof of demonstrating by a preponderance of the evidence—</text>
							<paragraph id="H15AA0CDE0470461796CFA2406AB776A3"><enum>(1)</enum><text>the validity of
				the grounds for the decision; and</text>
							</paragraph><paragraph id="HD45174FFA1B94401969B578C47A7F5DB"><enum>(2)</enum><text>the consistency of
				the decision with the requirements and policies of this title.</text>
							</paragraph></section><section id="H1A89E2BBC304451690F257DAB6A37EE3"><enum>417.</enum><header>Application of
				other provisions</header><text display-inline="no-display-inline">Section 314
				of the Department of the Interior and Related Agencies Appropriations Act, 1991
				(<external-xref legal-doc="public-law" parsable-cite="pl/101/512">Public Law 101–512</external-xref>; 104 Stat. 1959), shall apply to compacts and funding
				agreements entered into under this title.</text>
						</section><section id="H8EC84C10A49D470CA147ED4AF76B5AB3"><enum>418.</enum><header>Authorization
				of appropriations</header><text display-inline="no-display-inline">There are
				authorized to be appropriated such sums as are necessary to carry out this
				title.</text>
						</section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="id5d4e2edd5f474a3f8621e0827568a839"><enum>202.</enum><header>Effect of
			 certain provisions</header>
				<subsection id="id1db30b5f1ee94611999ac89305defbee"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="id29f98cb53bcf430d97ff55ae7962444a"><enum>(1)</enum><header>Funding
			 agreement</header><text>The term <term>funding agreement</term> means a funding
			 agreement entered into under section 403 of the ISDEAA (25 U.S.C.
			 458cc).</text>
					</paragraph><paragraph id="id803f71da4d0444edaccdd014f8a19cac"><enum>(2)</enum><header>ISDEAA</header><text>The
			 term <term>ISDEAA</term> means the Indian Self-Determination and Education
			 Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450">25 U.S.C. 450 et seq.</external-xref>).</text>
					</paragraph><paragraph id="idf623bfc272ed4d1e9794365f0d828f72"><enum>(3)</enum><header>Non-BIA
			 program</header><text>The term <term>non-BIA program</term> means all or a
			 portion of a program, function, service, or activity that is administered by
			 any bureau, service, office, or agency of the Department of the Interior other
			 than through—</text>
						<subparagraph id="id7c89e697160746199d67871d1bab3afc"><enum>(A)</enum><text>the Bureau of
			 Indian Affairs;</text>
						</subparagraph><subparagraph id="id10611ba12ae547d3b0915f5f210ac719"><enum>(B)</enum><text>the Office of the
			 Assistant Secretary for Indian Affairs; or</text>
						</subparagraph><subparagraph id="iddb585dfb563c425dbf37ec3a360ef029"><enum>(C)</enum><text>the Office of the
			 Special Trustee for American Indians.</text>
						</subparagraph></paragraph><paragraph id="idf4f40b31854d40a9806d848fc5637877"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
					</paragraph><paragraph id="idf46808fa14404c03b425fdae5772d878"><enum>(5)</enum><header>Self-determination
			 contract</header><text>The term <term>self-determination contract</term> means
			 a self-determination contract entered into under section 102 of the ISDEAA (25
			 U.S.C. 450f).</text>
					</paragraph><paragraph id="id89792e36ed9043ce90a247b22bd0158b"><enum>(6)</enum><header>Tribal water
			 settlement</header><text>The term <term>tribal water settlement</term> means
			 any settlement, compact, or other agreement entered into by an Indian tribe and
			 the United States, or by an Indian tribe, the United States, and one or more
			 parties that—</text>
						<subparagraph id="idc9403526ff25481eb2d2c44d713c4f10"><enum>(A)</enum><text>settles or
			 quantifies any Federal reserved water rights or any claims relating to those
			 rights of the Indian tribe; and</text>
						</subparagraph><subparagraph id="id707d156f5de84990ba924da9db78f172"><enum>(B)</enum><text>has been
			 authorized by an Act of Congress.</text>
						</subparagraph></paragraph></subsection><subsection id="id4ecb1318188a48aeafa68752976f0d7a"><enum>(b)</enum><header>Effect of
			 provisions</header><text>Nothing in this Act (including this section) or any
			 amendment made by this Act (including section 414 of the ISDEAA (relating to
			 regulations), as added by section 201)—</text>
					<paragraph id="id8769921dd3644fb7a2e6a75c27e5105c"><enum>(1)</enum><text>modifies or
			 affects the meaning, application, or effect of—</text>
						<subparagraph id="id7b69e8f78a404aed85d88842f170c1a3"><enum>(A)</enum><text>section
			 102(a)(1)(E) of the ISDEAA (<external-xref legal-doc="usc" parsable-cite="usc/25/450f">25 U.S.C. 450f(a)(1)(E)</external-xref>), as in effect on the day
			 before the date of enactment of this Act; or</text>
						</subparagraph><subparagraph id="idbf21e894d9254eb9a7e28de158f11b1a"><enum>(B)</enum><text>paragraph (2) or
			 (3) of subsection (b) or subsection (c) of section 403 of the ISDEAA (25 U.S.C.
			 458cc), as in effect on the day before the date of enactment of this
			 Act;</text>
						</subparagraph></paragraph><paragraph id="id4ac772e2b7114be4b16443cef678fbda"><enum>(2)</enum><text>increases,
			 limits, modifies, or otherwise affects any authority of the Secretary that the
			 Secretary held on the day before the date of enactment of this Act under
			 section 403(c) of the ISDEAA (<external-xref legal-doc="usc" parsable-cite="usc/25/458cc">25 U.S.C. 458cc(c)</external-xref>);</text>
					</paragraph><paragraph id="iddb4d6cdc2a604481b0b8d84bc8f37575"><enum>(3)</enum><text>authorizes the
			 inclusion of any non-BIA program in—</text>
						<subparagraph id="ideb8c24c067e443fa84240829ff8e134e"><enum>(A)</enum><text>a
			 self-determination contract as a program under section 102(a)(1)(E) of the
			 ISDEAA (<external-xref legal-doc="usc" parsable-cite="usc/25/450f">25 U.S.C. 450f(a)(1)(E)</external-xref>) if the inclusion of that non-BIA program in a
			 self-determination contract as a program under that section would not have been
			 authorized under the ISDEAA on the day before the date of enactment of this
			 Act;</text>
						</subparagraph><subparagraph id="id7a2ac48751d74b5684fd04cccf6d7896"><enum>(B)</enum><text>a funding
			 agreement as a program under section 403(b)(2) of the ISDEAA (25 U.S.C.
			 458cc(b)(2)) if the inclusion of that non-BIA program in a funding agreement as
			 a program under that section would not have been authorized on the day before
			 the date of enactment of this Act; or</text>
						</subparagraph><subparagraph id="id7371890f3fcc40b284fd9dc2a60b4700"><enum>(C)</enum><text>a funding
			 agreement as a program under section 403(c) of the ISDEAA (<external-xref legal-doc="usc" parsable-cite="usc/25/458cc">25 U.S.C. 458cc(c)</external-xref>)
			 if the inclusion of that non-BIA program in a funding agreement as a program
			 under that section would not have been authorized under the ISDEAA on the day
			 before the date of enactment of this Act;</text>
						</subparagraph></paragraph><paragraph id="idb0615b3c03aa45768d1a9cd0799fb4dc"><enum>(4)</enum><text>modifies or
			 otherwise affects the meaning, application, or effect of any provision of law
			 that—</text>
						<subparagraph id="id1dd33305dce3496e8343edefc017f27d"><enum>(A)</enum><text>is not contained
			 in the ISDEAA; and</text>
						</subparagraph><subparagraph id="id503066597860435f8cc6dc477e6008f7"><enum>(B)</enum><text>expressly
			 authorizes or prohibits contracting or compacting under title I or title IV of
			 the ISDEAA with respect to a specific program or project that is identified or
			 otherwise referred to in that provision of law;</text>
						</subparagraph></paragraph><paragraph id="idbd4ad32511ed42d8bcd8456deec238b1"><enum>(5)</enum><text>modifies or
			 otherwise affects the meaning, application, or effect of, or the performance
			 required of a party, or any payment or funding under—</text>
						<subparagraph id="id61bf2bb215d84d208485a688745f97be"><enum>(A)</enum><text>a tribal water
			 settlement; or</text>
						</subparagraph><subparagraph id="idb200e7c6f399429dbabac5bd20ff9ace"><enum>(B)</enum><text>any Act of
			 Congress approving, authorizing, or ratifying a tribal water settlement;
			 or</text>
						</subparagraph></paragraph><paragraph id="idcf81f21a178e483db8d017b663890941"><enum>(6)</enum><text>authorizes any
			 self-determination contract or funding agreement or approval of any
			 self-determination contract or funding agreement under the ISDEAA (as amended
			 by section 201) that would authorize an Indian tribe to plan, conduct,
			 consolidate, administer, or receive funding for any program, project, or
			 activity that is required, authorized, or funded by a tribal water settlement
			 or an Act of Congress approving, authorizing, or ratifying a tribal water
			 settlement in a manner that is inconsistent with the terms of that tribal water
			 settlement or that Act of Congress.</text>
					</paragraph></subsection></section></title></legis-body>
