		<official-title>To amend the National Oilheat Research Alliance Act of
		  2000 to reauthorize and improve that Act, and for other purposes.

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Oilheat Efficiency, Renewable Fuel
			 Research and Jobs Training Act of 2013</short-title></quote>.</text>
		</section><section id="id4fe4a1ff0d64475cbb98fb512c30b2d8"><enum>2.</enum><header>Findings and
			 purposes</header><text display-inline="no-display-inline">Section 702 of the
			 National Oilheat Research Alliance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note; Public Law
			 106–469) is amended—</text>
			<paragraph id="id6E446821C0F144188E32CBCE2267EE91"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking
			 <quote>and</quote> after the semicolon at the end;</text>
			</paragraph><paragraph id="id88295D1F4AFF4E8F854E6C9779056624"><enum>(2)</enum><text display-inline="yes-display-inline">by striking the period at the end and
			 inserting a semicolon; and</text>
			</paragraph><paragraph id="id1EBB4D2D7D294745B9D2AA5ABEFA4A6E"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id5b77157a025d41bf83a412602478490d" style="OLC">
					<paragraph id="idb353d86a6d7f42d2a3b1c33ea262f9f6"><enum>(6)</enum><text>consumers of
				oilheat fuel are provided service by thousands of small businesses that are
				unable to individually develop training programs to facilitate the entry of new
				and qualified workers into the oilheat fuel industry;</text>
					</paragraph><paragraph id="idbc98450ac64d444aaa378842b4222dae"><enum>(7)</enum><text>small businesses
				and trained employees are in an ideal position—</text>
						<subparagraph id="idD44259FA1D554C42A0C8416A03703C12"><enum>(A)</enum><text>to provide
				information to consumers about the benefits of improved efficiency; and</text>
						</subparagraph><subparagraph id="id1133EB432CAC461ABDBAE3FF2E05B619"><enum>(B)</enum><text>to encourage
				consumers to value efficiency in energy choices and assist individuals in
				conserving energy;</text>
						</subparagraph></paragraph><paragraph id="idd976087ca8ff4f7a9fd956e67c23f36f"><enum>(8)</enum><text>additional
				research is necessary—</text>
						<subparagraph id="id8C3A9E76876A4121A4436514C365C0D0"><enum>(A)</enum><text>to improve
				oilheat fuel equipment; and</text>
						</subparagraph><subparagraph id="id96E2C9B768884709926E7993C25E9141"><enum>(B)</enum><text>to develop
				domestic renewable resources that can be used to safely and affordably heat
				homes;</text>
						</subparagraph></paragraph><paragraph id="id8c9b74ff786c4d99a6c280f690746bfb"><enum>(9)</enum><text>since there are
				no Federal resources available to assist the oilheat fuel industry, it is
				necessary and appropriate to develop a self-funded program dedicated—</text>
						<subparagraph id="id8B7CCC28866549C78C9FA0BDE5BA8DB4"><enum>(A)</enum><text>to improving
				efficiency in customer homes;</text>
						</subparagraph><subparagraph id="id1952115D4F1A49AC8825C8F9CF00207B"><enum>(B)</enum><text>to assist
				individuals to gain employment in the oilheat fuel industry; and</text>
						</subparagraph><subparagraph id="id5B4DCC48837F4FD0A7157A8D67B5C065"><enum>(C)</enum><text>to develop
				domestic renewable resources;</text>
						</subparagraph></paragraph><paragraph id="idfcfa83b757b4495a8e03737e63fe11fa"><enum>(10)</enum><text>both consumers
				of oilheat fuel and retailers would benefit from the self-funded program;
				and</text>
					</paragraph><paragraph id="idcba56e74db784a64bbfaa6bbe071616a"><enum>(11)</enum><text>the oilheat fuel
				industry is committed to providing appropriate funding necessary to carry out
				the purposes of this title without passing additional costs on to residential
				consumers.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" id="id55f4939f5ef64ebe9556065a21c336dc"><enum>3.</enum><header>Definitions</header>
			<subsection commented="no" id="idB960CB4A8FBB4FAE9025314B473799E8"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 703 of the
			 National Oilheat Research Alliance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note; Public Law
			 106–469) is amended—</text>
				<paragraph commented="no" id="idd589dd1ee20b447bb9daf6cf14c6fed8"><enum>(1)</enum><text>by redesignating
			 paragraphs (3) through (15) as paragraphs (4) through (16),
			 respectively;</text>
				</paragraph><paragraph commented="no" id="ideeb2c74c16844823b070f6ab95febfaf"><enum>(2)</enum><text>by inserting
			 after paragraph (2) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id1F4AB21C4C314F26B437A2582E641A81" style="OLC">
						<paragraph id="id8c0f759815a541359c8f2a052ed755a5"><enum>(3)</enum><header>Cost-effective</header><text>The
				term <term>cost-effective</term>, with respect to a program or activity carried
				out under section 707(f)(4), means that the program or activity meets a total
				resource cost test under which—</text>
							<subparagraph id="id7ff2da2d98cc46cf9b37a0cc1c11e80f"><enum>(A)</enum><text>the net present
				value of economic benefits over the life of the program or activity, including
				avoided supply and delivery costs and deferred or avoided investments; is
				greater than</text>
							</subparagraph><subparagraph id="ida895bfa4d4c14f50b4dc05d6afe71b00"><enum>(B)</enum><text>the net present
				value of the economic costs over the life of the program or activity, including
				program costs and incremental costs borne by the energy
				consumer.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idEFC9FFF1BBBA466E98D9B89D8326AAB5"><enum>(3)</enum><text>by striking
			 paragraph (8) (as redesignated in paragraph (1)) and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idFE51B64C24394AAEA73F0C75CE4568A6" style="OLC">
						<paragraph id="id22a5ed1a2c354644a6a62bc178510c1f"><enum>(8)</enum><header>Oilheat
				fuel</header><text>The term <term>oilheat fuel</term> means fuel that—</text>
							<subparagraph id="id13b6fd077dca4dacb9c5def0c0ddaf38"><enum>(A)</enum><text>is—</text>
								<clause id="id0be336b11eb144eeb4134611a81ec54a"><enum>(i)</enum><text>No. 1
				distillate;</text>
								</clause><clause id="idc27df170f25a494abd1bda024a33fae6"><enum>(ii)</enum><text>No. 2 dyed
				distillate;</text>
								</clause><clause id="id37cfe03571c1466fbaa4375afdbf0953"><enum>(iii)</enum><text>a liquid
				blended with No. 1 distillate or No. 2 dyed distillate; or</text>
								</clause><clause id="id38e8e0713e154f3b951169fc19eb2632"><enum>(iv)</enum><text>a biobased
				liquid; and</text>
								</clause></subparagraph><subparagraph id="idf44aa249cd2d418bac4125f33520a453"><enum>(B)</enum><text>is used as a fuel
				for nonindustrial commercial or residential space or hot water
				heating.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idEA2866C4DFA54C57BE15912C109D0E28"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="id7F261690DB3F42799519092C9C707557"><enum>(1)</enum><text>The National
			 Oilheat Research Alliance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/469">Public Law 106–469</external-xref>)
			 is amended by striking <quote>oilheat</quote> each place it appears and
			 inserting <quote>oilheat fuel</quote>.</text>
				</paragraph><paragraph id="id00C0824E1062481A9CECE0AED1E37DA5"><enum>(2)</enum><text>Section 704(d) of
			 the National Oilheat Research Alliance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note; Public
			 Law 106–469) is amended in the subsection heading by striking
			 <quote><header-in-text level="subsection" style="OLC">oilheat</header-in-text></quote> and inserting
			 <quote><header-in-text level="subsection" style="OLC">oilheat
			 fuel</header-in-text></quote>.</text>
				</paragraph><paragraph id="id23EB707C47F64E5B8BDFBD19B94DEF59"><enum>(3)</enum><text>Section 706(c)(2)
			 of the National Oilheat Research Alliance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note;
			 <external-xref legal-doc="public-law" parsable-cite="pl/106/469">Public Law 106–469</external-xref>) is amended in the paragraph heading by striking
			 <quote><header-in-text level="paragraph" style="OLC">oilheat</header-in-text></quote> and inserting
			 <quote><header-in-text level="paragraph" style="OLC">oilheat
			 fuel</header-in-text></quote>.</text>
				</paragraph><paragraph id="id9347EB14DC834FD4B017530EA77C2938"><enum>(4)</enum><text>Section 707(c) of
			 the National Oilheat Research Alliance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note; Public
			 Law 106–469) is amended in the subsection heading by striking
			 <quote><header-in-text level="subsection" style="OLC">oilheat</header-in-text></quote> and inserting
			 <quote><header-in-text level="subsection" style="OLC">oilheat
			 fuel</header-in-text></quote>.</text>
				</paragraph></subsection></section><section id="id10eeef550f71437687a18ec47792d88b"><enum>4.</enum><header>Membership</header>
			<subsection id="ida706a17f0ef54c52b7c2d9fce2249395"><enum>(a)</enum><header>Selection</header><text>Section
			 705 of the National Oilheat Research Alliance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note;
			 <external-xref legal-doc="public-law" parsable-cite="pl/106/469">Public Law 106–469</external-xref>) is amended by striking subsection (a) and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id0A6FC6B7E05B4337B76823A2B1EF2236" style="OLC">
					<subsection id="id85607b6ce6e642cb9c78d85729f74b87"><enum>(a)</enum><header>Selection</header>
						<paragraph id="ida0dc81005bf34723a7b6e02dd9bf14db"><enum>(1)</enum><header>List</header>
							<subparagraph id="id21811d91f90047efb5d357ca7a2f6f98"><enum>(A)</enum><header>In
				general</header><text>The Alliance shall provide to the Secretary a list of
				qualified nominees for membership in the Alliance.</text>
							</subparagraph><subparagraph id="ida848353fa8454bb2aed0028fa945ed7d"><enum>(B)</enum><header>Requirement</header><text>Except
				as provided in subsection (c)(1)(C), members of the Alliance shall be
				representatives of the oilheat fuel industry in a State, selected from a list
				of nominees submitted by the qualified State association in the State.</text>
							</subparagraph></paragraph><paragraph id="id0260054515bf4930b6abb1a69823a3aa"><enum>(2)</enum><header>Vacancies</header><text>A
				vacancy in the Alliance shall be filled in the same manner as the original
				selection.</text>
						</paragraph><paragraph id="id91021da13763474faab40246cb4dd1e9"><enum>(3)</enum><header>Secretarial
				action</header>
							<subparagraph id="idb14c1a8fbb67437a81159b4a9b8387d5"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall have 60 days to review nominees
				provided under paragraph (1).</text>
							</subparagraph><subparagraph id="id33249e35dd98497e967d0b00ea22deee"><enum>(B)</enum><header>Failure to
				Act</header><text>If the Secretary takes no action during the 60-day period
				described in subparagraph (A), the nominees shall be considered to be members
				of the
				Alliance.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id528c5e616b464f22847fc892f45b3a95"><enum>(b)</enum><header>Representation</header><text>Section
			 705(b) of the National Oilheat Research Alliance Act of 2000 (42 U.S.C. 6201
			 note; <external-xref legal-doc="public-law" parsable-cite="pl/106/469">Public Law 106–469</external-xref>) is amended in the matter preceding paragraph (1) by
			 striking <quote>qualified industry organization</quote> and inserting
			 <quote>Alliance</quote>.</text>
			</subsection><subsection id="id8f76c06a5eb6470f8486cd22a9717931"><enum>(c)</enum><header>Number of
			 members</header><text>Section 705(c) of the National Oilheat Research Alliance
			 Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/469">Public Law 106–469</external-xref>) is amended—</text>
				<paragraph id="id3aa83f316a1a4583b0686fe1ab49b2a7"><enum>(1)</enum><text>by striking
			 paragraph (1) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idE06A77906A194FEFBC32065E49571DF2" style="OLC">
						<paragraph id="idb04a8c6ac51f4878967c923ea9a4947c"><enum>(1)</enum><header>In
				general</header><text>The Alliance shall be composed of the following
				members:</text>
							<subparagraph id="idce863460706149b191f915da6ce33ea1"><enum>(A)</enum><text>1 member
				representing each State participating in the Alliance.</text>
							</subparagraph><subparagraph id="id1e6d11aa13184adeacf76187d7c12bce"><enum>(B)</enum><text>5 representatives
				of retail marketers, of whom 1 shall be selected by each of the qualified State
				associations of the 5 States with the highest volume of annual oilheat fuel
				sales.</text>
							</subparagraph><subparagraph id="idb7f8ab9eb8a14b2f845670eb3f1c58df"><enum>(C)</enum><text>5 additional
				representatives of retail marketers.</text>
							</subparagraph><subparagraph id="idb555f3304208414580e9863df3282c4d"><enum>(D)</enum><text>21
				representatives of wholesale distributors.</text>
							</subparagraph><subparagraph id="id3975faa68aaa4e33825314a71b56d4c2"><enum>(E)</enum><text>6 public members,
				who shall be representatives of significant users of oilheat fuel, the oilheat
				fuel research community, State energy officials, or other groups with expertise
				in oilheat fuel, including consumer and low-income advocacy
				groups.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id8f84a8e42e434a2eb4e49d3fb79f3719"><enum>(2)</enum><text>in paragraph (2),
			 by striking <quote>the qualified industry organization or</quote>.</text>
				</paragraph></subsection></section><section id="id99d00d6064b349b9a5467dfdf6fc896d"><enum>5.</enum><header>Functions</header>
			<subsection commented="no" id="id9d4fe9811482431ea22105bd6ea72458"><enum>(a)</enum><header>Renewable fuel
			 research</header><text>Section 706(a)(3)(B)(i)(I) of the National Oilheat
			 Research Alliance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/469">Public Law 106–469</external-xref>) is
			 amended by inserting before the semicolon at the end the following: <quote>,
			 including research to develop renewable fuels and to examine the compatibility
			 of different renewable fuels with oilheat fuel utilization equipment, with
			 priority given to research on the development and use of advanced
			 biofuels</quote>.</text>
			</subsection><subsection commented="no" id="id46954C7884484055943D33742709902D"><enum>(b)</enum><header>Biennial
			 budgets</header><text>Section 706(e) of the National Oilheat Research Alliance
			 Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/469">Public Law 106–469</external-xref>) is amended—</text>
				<paragraph id="idabbf25c515194d85a7a4ce72d439e63a"><enum>(1)</enum><text>by striking
			 paragraph (1) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id06EBF14731504A24A4721E013A47E003" style="OLC">
						<paragraph id="id41bb82e1d8c44c238cc657d09de1a31b"><enum>(1)</enum><header>Publication of
				proposed budget</header><text>Not later than August 1, 2013, and every 2 years
				thereafter, the Alliance shall, in consultation with the Secretary, develop and
				publish for public review and comment a proposed biennial budget for the next 2
				calendar years, including the probable operating and planning costs of all
				programs, projects, and contracts and other
				agreements.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ide3334ddbb5594fac80fc9e0bf6e7a0d0"><enum>(2)</enum><text>by striking
			 paragraph (4) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id7A4A7487702449CE9BF674FFC7F86A82" style="OLC">
						<paragraph id="ide3e747f129fb448e98aa198a7722709a"><enum>(4)</enum><header>Implementation</header>
							<subparagraph id="id6cb45861fcf74c059ebbf5a7de1518bd"><enum>(A)</enum><header>In
				general</header><text>The Alliance shall not implement a proposed budget until
				the expiration of 60 days after submitting the proposed budget to the
				Secretary.</text>
							</subparagraph><subparagraph id="id741ef5bcefcc49fcb93cc6e04ec76f8d"><enum>(B)</enum><header>Recommendations
				for changes by Secretary</header>
								<clause id="id32936cc3abd44280aa1063b5c45d5aba"><enum>(i)</enum><header>In
				general</header><text>The Secretary may recommend to the Alliance changes to
				the budget programs and activities of the Alliance that the Secretary considers
				appropriate.</text>
								</clause><clause id="ida101706108014906b558bfd0d47f3592"><enum>(ii)</enum><header>Response by
				alliance</header><text>Not later than 30 days after the receipt of any
				recommendations made under clause (i), the Alliance shall submit to the
				Secretary a final budget for the next 2 calendar years that incorporates or
				includes a description of the response of the Alliance to any changes
				recommended under clause
				(i).</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="id402c8f12620c4ad4b5092255c711f62a"><enum>6.</enum><header>Assessments</header>
			<subsection id="id7B045480065C4E19AD03E8DDE10DFAD5"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 707 of the
			 National Oilheat Research Alliance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note; Public Law
			 106–469) is amended—</text>
				<paragraph id="id1e8d96b2a2a645199b1dd2851d461506"><enum>(1)</enum><text>by striking
			 subsection (a) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idAFA27EE1763A4AA48EF098B36B67004D" style="OLC">
						<subsection id="idc013d6f9342942b3a0df275a62115718"><enum>(a)</enum><header>Rate</header>
							<paragraph id="idb06758ffc94f4704a5555f8bf468c94f"><enum>(1)</enum><header>In
				general</header><text>The assessment rate for calendar years 2013 and 2014
				shall be equal to <fraction>2/10</fraction> of 1 cent per gallon of oilheat
				fuel.</text>
							</paragraph><paragraph id="id6007ff742e7649f083ab79b7815e21b5"><enum>(2)</enum><header>Subsequent
				assessments</header><text>Subject to paragraph (3), effective beginning with
				calendar year 2015, the annual assessment rate shall be sufficient to cover the
				costs of the plans and programs developed by the Alliance.</text>
							</paragraph><paragraph id="idc1b39bc0a5e14c2191fae96623e76ef7"><enum>(3)</enum><header>Limitations on
				increase</header>
								<subparagraph id="id9f173ea1d1d94505901736df37d3dc48"><enum>(A)</enum><header>In
				general</header><text>The annual assessment shall not exceed
				<fraction>1/2</fraction> of 1 cent per gallon of oilheat fuel.</text>
								</subparagraph><subparagraph id="id0853b6fc9d4e4461b147ed1e4941551b"><enum>(B)</enum><header>Limitation</header><text>The
				annual assessment may not change by more than <fraction>1/10</fraction> of 1
				cent per gallon of oilheat fuel in any 12 month-period.</text>
								</subparagraph><subparagraph id="id0fb8373420bd4e42abea214afb68b47b"><enum>(C)</enum><header>Approval</header><text>No
				increase in the assessment may occur unless—</text>
									<clause id="id2d67ed806ae34502bc47645a0c7f6b17"><enum>(i)</enum><text>the increase is
				approved by <fraction>3/4</fraction> of the members voting at a regularly
				scheduled meeting of the Alliance; and</text>
									</clause><clause id="id10fbd31c9db644a5bdb69124502607a9"><enum>(ii)</enum><text>at least 90 days
				before the date of the meeting of the Alliance, the Alliance provides notice of
				the proposed increase to the Committee on Energy and Natural Resources of the
				Senate and the Committee on Energy and Commerce of the House of
				Representatives.</text>
									</clause></subparagraph></paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idab425b639ce14ffd9d4965fd0dd40468"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id92FF926159B44497B355443F22AA3B2F" style="OLC">
						<paragraph id="id28594b7ee7d74716b7d3dae41518a610"><enum>(8)</enum><header>Prohibition on
				pass through</header><text>None of the assessments collected under this title
				may be passed through or otherwise required to be paid by residential consumers
				of oilheat
				fuel.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id1ed33b6b0d224218a5fab1545a9b45f5"><enum>(b)</enum><header>Funds made
			 available to qualified State associations</header><text display-inline="yes-display-inline">Section 707(e)(2) of the National Oilheat
			 Research Alliance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/469">Public Law 106–469</external-xref>) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id246F36477F5D4C0181417EFA46D178B1" style="OLC">
					<subparagraph id="id7C6ED81194F74B91A927A7EA9EC2EBAF"><enum>(B)</enum><header>Separate
				accounts</header><text display-inline="yes-display-inline">As a condition of
				receipt of funds made available to a qualified State association under this
				title, the qualified State association shall deposit the funds in an account
				that is separate from other funds of the qualified State
				association.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id216a1ccb1b3640aa972fd504c688d7dd"><enum>(c)</enum><header>Administration</header><text display-inline="yes-display-inline">Section 707 of the National Oilheat
			 Research Alliance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/469">Public Law 106–469</external-xref>) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id888C369C1EBF4F0292D398BC6127F39D" style="OLC">
					<subsection id="id81B0CF34AB5F4F17B23D05CFC41E8F13"><enum>(f)</enum><header>Use of
				Assessments</header>
						<paragraph id="id35C7926D39F04731ACC7CC21DF5F363E"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of this title, the Secretary and the Alliance shall ensure that
				assessments collected for each calendar year under this title are allocated and
				used in accordance with this subsection.</text>
						</paragraph><paragraph id="idEF9AE0AC500B4A729A86126AF94665AF"><enum>(2)</enum><header>Research,
				development, and demonstration</header>
							<subparagraph commented="no" id="id8164EBAED6CB43F8993614B569DBB3A8"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Alliance shall
				ensure that not less than 30 percent of the assessments collected for each
				calendar year under this title are used by qualified State associations or the
				Alliance to conduct research, development, and demonstration activities
				relating to oilheat fuel, including the development of energy-efficient heating
				and the transition and facilitation of the entry of energy-efficient heating
				systems into the marketplace.</text>
							</subparagraph><subparagraph commented="no" id="id241249CB1ADB49AB8B967CED800836B2"><enum>(B)</enum><header>Coordination</header><text>The
				Alliance shall coordinate with the Secretary to develop priorities for the use
				of assessments under this paragraph.</text>
							</subparagraph><subparagraph id="id4d9ede6887fb469792a365a334159892"><enum>(C)</enum><header>Plan</header><text>The
				Alliance shall develop a coordinated research plan to carry out research
				programs and activities under this section.</text>
							</subparagraph><subparagraph commented="no" id="id47c8ff7d0b174919a83cd80714fdee9b"><enum>(D)</enum><header>Report</header>
								<clause commented="no" id="id29793D3001AE49509098B2563CBCEF0F"><enum>(i)</enum><header>In
				general</header><text>No later than 1 year after date of enactment of this
				subsection, the Alliance shall prepare a report on the use of biofuels in
				oilheat fuel utilization equipment.</text>
								</clause><clause commented="no" id="id92123CC958024BBFA3BB7672FBC59ACE"><enum>(ii)</enum><header>Contents</header><text>The
				report required under clause (i) shall—</text>
									<subclause commented="no" id="id2FBAD24F02F6459287839CA8BAD85318"><enum>(I)</enum><text>provide
				information on the environmental benefits, economic benefits, and any technical
				limitations on the use of biofuels in oilheat fuel utilization equipment;
				and</text>
									</subclause><subclause commented="no" id="idE87DC988D3344121887C553C307A25DA"><enum>(II)</enum><text>describe market
				acceptance of the fuel, and information on State and local governments that are
				encouraging the use of biofuels in oilheat fuel utilization equipment.</text>
									</subclause></clause><clause commented="no" id="idACAD1D754ABF4F50B6530F83686EF1D1"><enum>(iii)</enum><header>Copies</header><text>The
				Alliance shall submit a copy of the report required under clause (i) to—</text>
									<subclause commented="no" id="id1272F358729742A6835FEE2B56D59C5C"><enum>(I)</enum><text>Congress;</text>
									</subclause><subclause commented="no" id="idF36D9C0F51734ACBA0A2CA72877398E2"><enum>(II)</enum><text>the Governor of
				each State, and other appropriate State leaders, in which the Alliance is
				operating; and</text>
									</subclause><subclause commented="no" id="id22EE341D9806434BA3D82BB5B3B9E4C7"><enum>(III)</enum><text>the
				Administrator of the Environmental Protection Agency.</text>
									</subclause></clause></subparagraph><subparagraph commented="no" id="idff407c88c502473582bcb64dafb34f93"><enum>(E)</enum><header>Consumer
				education materials</header><text>The Alliance, in conjunction with an
				institution or organization engaged in biofuels research, shall develop
				consumer education materials describing the benefits of using biofuels as or in
				oilheat fuel based on the technical information developed in the report
				required under subparagraph (D) and other information generally
				available.</text>
							</subparagraph></paragraph><paragraph id="id16D03AAF81004F72A54D2AB9D5FEE348"><enum>(3)</enum><header>Cost
				sharing</header>
							<subparagraph id="ida6b84bdfe5ba4be888a47080c01261a3"><enum>(A)</enum><header>In
				general</header><text>In carrying out a research, development, demonstration,
				or commercial application program or activity that is commenced after the date
				of enactment of this subsection, the Alliance shall require cost sharing in
				accordance with this section.</text>
							</subparagraph><subparagraph id="idddf3d8560a2b429ebce4c633380714cc"><enum>(B)</enum><header>Research and
				development</header>
								<clause id="idc64858b6725b496995b2ad8410f716d6"><enum>(i)</enum><header>In
				general</header><text>Except as provided in clauses (ii) and (iii), the
				Alliance shall require that not less than 20 percent of the cost of a research
				or development program or activity described in subparagraph (A) to be provided
				by a source other than the Alliance.</text>
								</clause><clause id="idc9937b128be045cc8cb0a82dac06e918"><enum>(ii)</enum><header>Exclusion</header><text>Clause
				(i) shall not apply to a research or development program or activity described
				in subparagraph (A) that is of a basic or fundamental nature, as determined by
				the Alliance.</text>
								</clause><clause id="idcc7aea3f5f6a441488abc47ee7847a44"><enum>(iii)</enum><header>Reduction</header><text>The
				Alliance may reduce or eliminate the requirement of clause (i) for a research
				and development program or activity of an applied nature if the Alliance
				determines that the reduction is necessary and appropriate.</text>
								</clause></subparagraph><subparagraph id="id15b1e9f259034e0db3c9771f03cd8d88"><enum>(C)</enum><header>Demonstration
				and commercial application</header><text>The Alliance shall require that not
				less than 50 percent of the cost of a demonstration or commercial application
				program or activity described in subparagraph (A) to be provided by a source
				other than the Alliance.</text>
							</subparagraph></paragraph><paragraph id="idb5a32b409bdc4fca9c55c527415f9abd"><enum>(4)</enum><header>Heating oil
				efficiency and upgrade program</header>
							<subparagraph id="idbe7ce9e2b0804422b7bc91a5e5c85441"><enum>(A)</enum><header>In
				general</header><text>The Alliance shall ensure that not less than 15 percent
				of the assessments collected for each calendar year under this title are used
				by qualified State associations or the Alliance to carry out programs to assist
				consumers—</text>
								<clause id="id16899ee3ba9e4b4bb71ea99bcd4fbd22"><enum>(i)</enum><text>to make
				cost-effective upgrades to more fuel efficient heating oil systems or otherwise
				make cost-effective modifications to an existing heating system to improve the
				efficiency of the system;</text>
								</clause><clause id="id3b5ec2d1adfc4d0a80aa85438ca802dd"><enum>(ii)</enum><text>to improve
				energy efficiency or reduce energy consumption through cost-effective energy
				efficiency programs for consumers; or</text>
								</clause><clause id="id59bc9d9a3f084e0699cd9ed7daf5ee28"><enum>(iii)</enum><text>to improve the
				safe operation of a heating system.</text>
								</clause></subparagraph><subparagraph id="idc6fd32343c1945d8857e05816e2b8cf8"><enum>(B)</enum><header>Plan</header><text>The
				Alliance shall, to the maximum extent practicable, coordinate, develop, and
				implement the programs and activities of the Alliance in conjunction with
				existing State energy efficiency program administrators.</text>
							</subparagraph><subparagraph id="id7432070bbbb146008f519dc42f68fd99"><enum>(C)</enum><header>Administration</header>
								<clause id="id16589a817b6043cb92e8b6b2a4fc91ff"><enum>(i)</enum><header>In
				general</header><text>In carrying out this paragraph, the Alliance shall, to
				the maximum extent practicable, ensure that heating system conversion
				assistance is coordinated with, and developed after consultation with, persons
				or organizations responsible for administering—</text>
									<subclause id="ideec949d5535e4fe6ac267af7ff3e6a4a"><enum>(I)</enum><text>the low-income
				home energy assistance program established under the Low-Income Home Energy
				Assistance Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/8621">42 U.S.C. 8621 et seq.</external-xref>);</text>
									</subclause><subclause id="idd99e8211c9d141ac8e52e50c9e0c5f2e"><enum>(II)</enum><text>the
				Weatherization Assistance Program for Low-Income Persons established under part
				A of title IV of the Energy Conservation and Production Act (42 U.S.C. 6861 et
				seq.); or</text>
									</subclause><subclause id="idea42cb1b205f4870a9e60a401e899212"><enum>(III)</enum><text>other energy
				efficiency programs administered by the State or other parties in the
				State.</text>
									</subclause></clause><clause id="id34b3da8f1af4482eb4e10737222f612e"><enum>(ii)</enum><header>Distribution
				of funds</header><text>The Alliance shall ensure that funds distributed to
				carry out this paragraph are—</text>
									<subclause id="idae2ae6414d3444d887ab25c68392c20d"><enum>(I)</enum><text>distributed
				equitably to States based on the proportional contributions of the States
				through collected assessments;</text>
									</subclause><subclause id="id2f5807aec299473a8a74ddd32f238484"><enum>(II)</enum><text>used to
				supplement (and not supplant) State or alternative sources of funding for
				energy efficiency programs; and</text>
									</subclause><subclause id="id167ec37e0e044c8a8e7ca10b9568324c"><enum>(III)</enum><text>used only to
				carry out this paragraph.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="id346ed14f62994586b978cfe4460ba8cc"><enum>(5)</enum><header>Consumer
				education, safety, and training</header><text>The Alliance shall ensure that
				not more than 35 percent of the assessments collected for each calendar year
				under this title are used—</text>
							<subparagraph id="id869f27a1e4cd43f28ba1dc881dd778ee"><enum>(A)</enum><text>to conduct
				consumer education activities relating to oilheat fuel, including providing
				information to consumers on—</text>
								<clause id="idd6cf09675cdb49bea2240ef53a1c7819"><enum>(i)</enum><text>energy
				conservation strategies;</text>
								</clause><clause id="id92fb21f056064ac89f45a46cdcb3df8d"><enum>(ii)</enum><text>safety;</text>
								</clause><clause id="idc4916a129f6743c78ba0fc998df47b90"><enum>(iii)</enum><text>new
				technologies that reduce consumption or improve safety and comfort;</text>
								</clause><clause id="id75c194ceb06a41718739c439f398cc6a"><enum>(iv)</enum><text>the use of
				biofuels blends; and</text>
								</clause><clause id="id249305780e1f4c22b1cc5ae89647fa9a"><enum>(v)</enum><text>Federal, State,
				and local programs designed to assist oilheat fuel consumers;</text>
								</clause></subparagraph><subparagraph id="idc35cd6d783fc421780cba7d0a286d408"><enum>(B)</enum><text>to conduct worker
				safety and training activities relating to oilheat fuel, including energy
				efficiency training (including classes to obtain Building Performance Institute
				or Residential Energy Services Network certification);</text>
							</subparagraph><subparagraph id="id8ab5aa49074e441dabaa01f19a622f99"><enum>(C)</enum><text>to carry out
				other activities recommended by the Secretary; or</text>
							</subparagraph><subparagraph id="idacf37f09b9c147f19e975ac80f398d41"><enum>(D)</enum><text>to the maximum
				extent practicable, a data collection process established, in collaboration
				with the Secretary or other appropriate Federal agencies, to track equipment,
				service, and related safety issues and to develop measures to improve
				safety.</text>
							</subparagraph></paragraph><paragraph id="id0f361109477b4027b65962cb947b2388"><enum>(6)</enum><header>Administrative
				costs</header>
							<subparagraph id="idD5DD4990670942F2AEC06F4F8CA6C742"><enum>(A)</enum><header>In
				general</header><text>The Alliance shall ensure that not more than 5 percent of
				the assessments collected for each calendar year under this title are used
				for—</text>
								<clause id="id07B69458D3954FD887022AAC78019B2B"><enum>(i)</enum><text>administrative
				costs; or</text>
								</clause><clause id="id1106A74D6E2B4E44BD609E9FDA5EA24A"><enum>(ii)</enum><text>indirect costs
				incurred in carrying out paragraphs (1) through (5).</text>
								</clause></subparagraph><subparagraph id="idFCC75CEEE81940FCAD1725573BB3CCA8"><enum>(B)</enum><header>Administration</header><text>Activities
				under this section shall be documented pursuant to a transparent process and
				procedures developed in coordination with the Secretary.</text>
							</subparagraph></paragraph><paragraph id="idf917ae73079545abb20f23c64daccff6"><enum>(7)</enum><header>Reports</header>
							<subparagraph id="idf44f458be3194faeb1744bd4f7415b0d"><enum>(A)</enum><header>Annual
				reports</header>
								<clause id="id4539C31626CD483D833796245465F71D"><enum>(i)</enum><header>In
				general</header><text>Each qualified State association or the Alliance shall
				prepare an annual report describing the development and administration of this
				section, and yearly expenditures under this section.</text>
								</clause><clause id="idf170330973af45e7a4c50c42651451b4"><enum>(ii)</enum><header>Contents</header><text>Each
				report required under clause (i) shall include a description of the use of
				proceeds under this section, including a description of—</text>
									<subclause id="id071bd6c74c68443dad76397c70820009"><enum>(I)</enum><text>advancements made
				in energy-efficient heating systems and biofuel heating oil blends; and</text>
									</subclause><subclause id="id14ab893689ed420eb683c4e8eb5b7bae"><enum>(II)</enum><text>heating system
				upgrades and modifications and energy efficiency programs funded under this
				section.</text>
									</subclause></clause><clause id="id240f4fbbc7e2499c9dcb702370e06a08"><enum>(iii)</enum><header>Verification</header>
									<subclause id="id53143690bb5340878466d4a6b554c641"><enum>(I)</enum><header>In
				general</header><text>The Alliance shall ensure that an independent third-party
				reviews each report described in clause (i) and verifies the accuracy of the
				report.</text>
									</subclause><subclause id="idfaa34e6cb28d421e8be80a443df6e295"><enum>(II)</enum><header>Councils</header><text>If
				a State has a stakeholder efficiency oversight council, the council shall be
				the entity that reviews and verifies the report of the State association or
				Alliance for the State under clause (i).</text>
									</subclause></clause></subparagraph><subparagraph id="id5144a9adab434315bb6e2e4413b7368e"><enum>(B)</enum><header>Reports on
				heating oil efficiency and upgrade program</header><text>At least once every 3
				years, the Alliance shall prepare a detailed report describing the consumer
				savings, cost-effectiveness of, and the lifetime and annual energy savings
				achieved by heating system upgrades and modifications and energy efficiency
				programs funded under paragraph (4).</text>
							</subparagraph><subparagraph id="id1c828a2ef80348a1a02a108c8a74da8b"><enum>(C)</enum><header>Availability</header><text>Each
				report, and any subsequent changes to the report, described in this paragraph
				shall be made publically available, with notice of availability provided to the
				Secretary, and posted on the website of the
				Alliance.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="iddde330873c644f06a3133749b023fbf4"><enum>7.</enum><header>Market survey
			 and consumer protection</header><text display-inline="no-display-inline">Section 708 of the National Oilheat Research
			 Alliance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/469">Public Law 106–469</external-xref>) is
			 repealed.</text>
		</section><section id="id0a6c8e283c0f4860aedb83f68dd32a07"><enum>8.</enum><header>Lobbying
			 restrictions</header><text display-inline="no-display-inline">Section 710 of
			 the National Oilheat Research Alliance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note; Public
			 Law 106–469) is amended—</text>
			<paragraph id="idAA288E5D04A749B6A5CFA3B1FFCD835B"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>No funds</quote> and
			 inserting the following:</text>

					<subsection id="id7FDAB979B08C4C1BB5548440141972BD"><enum>(b)</enum><header>Assessments</header>
						<paragraph id="id57DD3FE0D42B4272AD9F87CE50BCB21F"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), no funds derived from
				assessments collected by the Alliance under section 707 shall be used, directly
				or indirectly, to influence Federal, State, or local legislation or elections,
				or the manner of administering of a law.</text>
						</paragraph><paragraph id="idC36220E99C7A46879EA1F1C9980FB1BF"><enum>(2)</enum><header>Information</header><text>The
				Alliance may use funds described in paragraph (1) to provide information
				requested by a Member of Congress, or an official of any Federal, State, or
				local agency, in the course of the official business of the Member or
				official.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id24013758945f4da587beecb86b28d860"><enum>9.</enum><header>Noncompliance</header><text display-inline="no-display-inline">Section 712 of the National Oilheat Research
			 Alliance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/469">Public Law 106–469</external-xref>) is amended by
			 adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id120CCD8D3224428EA40D47B677004893" style="OLC">
				<subsection id="id04F6D0F2B966462EB4D73044E004CC88"><enum>(g)</enum><header>Noncompliance</header><text display-inline="yes-display-inline">If the Alliance, a qualified State
				association, or any other entity or person violates this title, the Secretary
				shall—</text>
					<paragraph id="idB2A7C0CDD53B416192C79DF1C451BE90"><enum>(1)</enum><text display-inline="yes-display-inline">notify Congress of the noncompliance;
				and</text>
					</paragraph><paragraph id="idB9F7AB2783014701A1BA792F0B25DD71"><enum>(2)</enum><text display-inline="yes-display-inline">provide notice of the noncompliance on the
				Alliance
				website.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id9d17807b1f9b4d88a6e0e5b73722c7b5"><enum>10.</enum><header>Sunset</header><text display-inline="no-display-inline">Section 713 of the National Oilheat
			 Research, Consumer Education, and Efficiency Act of 2011 (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> note;
			 <external-xref legal-doc="public-law" parsable-cite="pl/106/469">Public Law 106–469</external-xref>) is amended by striking <quote>9 years</quote> and inserting
			 <quote>19 years</quote>.</text>
