		<official-title>To clarify State of residence requirements for aliens and
		  nonimmigrant requirements for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States
		  Code. </official-title>

		<section id="id5C2F4ACF1A7C463C9EFC5F5EBD021CE9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Alien Gun Violence Prevention Act of
			 2013</short-title></quote>.</text>
		</section><section id="idB8DC65A8A1D44C19842A433B985B9CDA" section-type="subsequent-section"><enum>2.</enum><header>State of residence
			 clarification</header><text display-inline="no-display-inline">Chapter 44 of
			 title 18, United States Code, is amended—</text>
			<paragraph id="idAAAA12B005F542BBAECA52B1CB274483"><enum>(1)</enum><text display-inline="yes-display-inline">in section 921, by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id56BD2695323E453BA6D6B2876177183B" style="OLC">
					<subsection id="id61D278A1040E4B528959B1718650333A"><enum>(c)</enum><text>For purposes of
				this chapter, an alien, as defined in section 101(a)(3) of the Immigration and
				Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(3)</external-xref>), who is legally in the United States
				shall be considered to be a resident of a State only if the alien—</text>
						<paragraph id="idDDDD7347562B4529BDC729A956EC22B4"><enum>(1)</enum><text>is residing in
				the State; and</text>
						</paragraph><paragraph id="id1D7B93856F3E4DE58D4BB27768E10CCE"><enum>(2)</enum><text>has resided in
				the State for not less than 90 days before the date of sale or delivery of a
				firearm.</text>
						</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id0D2CC3A4F5A44691B5CDE195F27E1245"><enum>(2)</enum><text display-inline="yes-display-inline">in section 922—</text>
				<subparagraph id="id80F51F7BF0C5461DAE851F2B512AC6DB"><enum>(A)</enum><text>in subsection
			 (d)(5)(B), by striking <quote>(y)(2)</quote> and all that follows and inserting
			 <quote>(y), is in the United States not as an alien lawfully admitted for
			 permanent residence;</quote>;</text>
				</subparagraph><subparagraph id="id7CC136556A9D4955B1E1AD4BCA81E6EB"><enum>(B)</enum><text>in subsection
			 (g)(5)(B), by striking <quote>(y)(2)</quote> and all that follows and inserting
			 <quote>(y), is in the United States not as an alien lawfully admitted for
			 permanent residence;</quote>; and</text>
				</subparagraph><subparagraph id="id0DA147663F0149D8A15B01C57CAB4C5A"><enum>(C)</enum><text>in subsection
			 (y)—</text>
					<clause id="idB3AE3F88BF2043A19791BB75682C0E7B"><enum>(i)</enum><text>in
			 the heading by striking <quote><header-in-text level="subsection" style="USC">admitted under nonimmigrant visas</header-in-text></quote> and
			 inserting <quote><header-in-text level="subsection" style="USC">not lawfully
			 admitted for permanent residence</header-in-text></quote>;</text>
					</clause><clause id="id09A995FFF1884DFC87CCA03ED126950A"><enum>(ii)</enum><text>in
			 paragraph (1), by amending subparagraph (B) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="id0A6FDFEB7A65412E850064FAED3DA13B" style="OLC">
							<subparagraph id="id9FA94BFDE1694C48A29DE7E17BDAB730" indent="up1"><enum>(B)</enum><text>the term <term>lawfully admitted for
				permanent residence</term> has the same meaning as in section 101(a)(20) of the
				Immigration and Nationality Act (8 U.S.C.
				1101(a)(20)).</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</clause><clause id="idCA213828046746FB95051CCCAEBDE8B7"><enum>(iii)</enum><text>in paragraph
			 (2), by striking <quote>under a nonimmigrant visa</quote> and inserting
			 <quote>but not lawfully admitted for permanent residence</quote>; and</text>
					</clause><clause id="id3F34B1F20C3A43FABEA971866DA523D8"><enum>(iv)</enum><text>in
			 paragraph (3)(A), by striking <quote>admitted to the United States under a
			 nonimmigrant visa</quote> and inserting <quote>lawfully admitted to the United
			 States but not as an alien lawfully admitted for permanent
			 residence</quote>.</text>
