			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Egg Products Inspection Act
			 Amendments of 2013</short-title></quote>.</text>
		</section><section id="iddf19b56f29b94f3bbc7e63ece4b7a0f3"><enum>2.</enum><header>Hen housing and
			 treatment standards</header>
			<subsection id="id5cf2a811c0e64f18a6404fa6eb37a905"><enum>(a)</enum><header>Definitions</header><text>Section
			 4 of the Egg Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1033">21 U.S.C. 1033</external-xref>) is amended—</text>
				<paragraph id="id5a0ab84a15824962a5edace4b88a0761"><enum>(1)</enum><text>by redesignating
			 subsection (a) as subsection (c);</text>
				</paragraph><paragraph id="id1fba3d61f50e447cb8f3936946bebd05"><enum>(2)</enum><text>by redesignating
			 subsections (b), (c), (d), (e), (f), and (g) as subsections (f), (g), (h), (i),
			 (j), and (k), respectively;</text>
				</paragraph><paragraph id="ida8e09ae1d7eb4391a28dfbbe26135225"><enum>(3)</enum><text>by redesignating
			 subsections (h) and (i) as subsections (n) and (o), respectively;</text>
				</paragraph><paragraph id="id012042fe0d4f4e858776e14ac2bd6584"><enum>(4)</enum><text>by redesignating
			 subsections (j), (k), and (l) as subsections (r), (s), and (t),
			 respectively;</text>
				</paragraph><paragraph id="id663504f4672544f1b6a04a745bf9f164"><enum>(5)</enum><text>by redesignating
			 subsections (m), (n), (o), (p), (q), (r), (s), (t), (u), (v), (w), (x), (y),
			 and (z) as subsections (v), (w), (x), (y), (z), (aa), (bb), (cc), (dd), (ee),
			 (ff), (gg), (hh), and (ii), respectively;</text>
				</paragraph><paragraph id="id74a302cd36ca4298a2e3edcaa9c1aeb5"><enum>(6)</enum><text>by inserting
			 before subsection (c), as redesignated by paragraph (1), the following new
			 subsections:</text>
					<quoted-block display-inline="no-display-inline" id="idff6b47e9bd714f6996c7709658142f57" style="OLC">
						<subsection id="id09a3faca1c6b4e7480674039a9a9ffa8"><enum>(a)</enum><text>The term
				<term>adequate environmental enrichments</term> means adequate perch space,
				dust bathing or scratching areas, and nest space, as defined by the Secretary
				of Agriculture, based on the best available science, including the most recent
				studies available at the time that the Secretary defines the term.</text>
						</subsection><subsection id="id84c0878255014b3ab3b458f97f6ba934"><enum>(b)</enum><text>The term
				<term>adequate housing-related labeling</term> means a conspicuous, legible
				marking on the front or top of a package of eggs accurately indicating the type
				of housing that the egg-laying hens were provided during egg production, in 1
				of the following formats:</text>
							<paragraph id="id2a247fdd497d4ac28ceb63eb6971fd00"><enum>(1)</enum><text><quote>Eggs from
				free-range hens</quote> to indicate that the egg-laying hens from which the
				eggs or egg products were derived were, during egg production—</text>
								<subparagraph id="idb1362252704546cebd6d557beeefa50c"><enum>(A)</enum><text>not housed in
				caging devices; and</text>
								</subparagraph><subparagraph id="id90bf51e78cf44b30adda01d84751ee34"><enum>(B)</enum><text>provided with
				outdoor access.</text>
								</subparagraph></paragraph><paragraph id="id09f6fc79b6b84bb8a4988f2689a93e86"><enum>(2)</enum><text><quote>Eggs from
				cage-free hens</quote> to indicate that the egg-laying hens from which the eggs
				or egg products were derived were, during egg production, not housed in caging
				devices.</text>
							</paragraph><paragraph id="id830215ac452146b492949b540b2964cc"><enum>(3)</enum><text><quote>Eggs from
				enriched cages</quote> to indicate that the egg-laying hens from which the eggs
				or egg products were derived were, during egg production, housed in caging
				devices that—</text>
								<subparagraph id="id20c1daa38c8b4c95837799d174003471"><enum>(A)</enum><text>contain adequate
				environmental enrichments; and</text>
								</subparagraph><subparagraph id="idad1706bb23ce4acfa1c518e7e87e3e5b"><enum>(B)</enum><text>provide the hens
				a minimum of 116 square inches of individual floor space per brown hen and 101
				square inches of individual floor space per white hen.</text>
								</subparagraph></paragraph><paragraph id="id0f2f0721c05d4cd899c6e078f474284f"><enum>(4)</enum><text><quote>Eggs from
				caged hens</quote> to indicate that the egg-laying hens from which the eggs or
				egg products were derived were, during egg production, housed in caging devices
				that either—</text>
								<subparagraph id="id41c0921fae844560bc5e1ebc3ebe6a0b"><enum>(A)</enum><text>do not contain
				adequate environmental enrichments; or</text>
								</subparagraph><subparagraph id="id1b35ee4e40f74a0d811384bafdd27ef6"><enum>(B)</enum><text>do not provide
				the hens a minimum of 116 square inches of individual floor space per brown hen
				and 101 square inches of individual floor space per white
				hen.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idc9d815e0937e42adb864a57eb64f2b4f"><enum>(7)</enum><text>by inserting
			 after subsection (c), as redesignated by paragraph (1), the following new
			 subsections:</text>
					<quoted-block display-inline="no-display-inline" id="id24abcc84e05d4a1caeae7dc129fb9fe7" style="OLC">
						<subsection id="ideaecbb97834b4687b3f92ac2b7921bf2"><enum>(d)</enum><text>The term
				<term>brown hen</term> means a brown egg-laying hen used for commercial egg
				production.</text>
						</subsection><subsection id="idc9de39215cb343cf96821f8bbe74da20"><enum>(e)</enum><text>The term
				<term>caging device</term> means any cage, enclosure, or other device used for
				the housing of egg-laying hens for the production of eggs in commerce, but does
				not include an open barn or other fixed structure without internal caging
				devices.</text>
						</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idcceff8feb85641cc9b994599fd9c7864"><enum>(8)</enum><text>by inserting
			 after subsection (k), as redesignated by paragraph (2), the following new
			 subsections:</text>
					<quoted-block display-inline="no-display-inline" id="id895ead14b50e44debf3db9f9f78e41dc" style="OLC">
						<subsection id="id3b8f434161544a568bdec7bca6e6c4b0"><enum>(l)</enum><text>The term
				<term>egg-laying hen</term> means any female domesticated chicken, including
				white hens and brown hens, used for the commercial production of eggs for human
				consumption.</text>
						</subsection><subsection id="idf7e98afdc4e740a28e76500427a54874"><enum>(m)</enum><text>The term
				<term>existing caging device</term> means any caging device that was
				continuously in use for the production of eggs in commerce up through and
				including December 31,
				2011.</text>
						</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id48a8382c39ec41f684e03818f7c4186a"><enum>(9)</enum><text>by inserting
			 after subsection (o), as redesignated by paragraph (3), the following new
			 subsections:</text>
					<quoted-block display-inline="no-display-inline" id="id49e9145d81d54689b2282c92ca7e7c92" style="OLC">
						<subsection id="ide2dba6113101412e8b58e00a32ab75b0"><enum>(p)</enum><text>The term
				<term>feed-withdrawal molting</term> means the practice of preventing food
				intake for the purpose of inducing egg-laying hens to molt.</text>
						</subsection><subsection id="idd5340c374c8046e38b7428571abbddac"><enum>(q)</enum><text>The term
				<term>individual floor space</term> means the amount of total floor space in a
				caging device available to each egg-laying hen in the device, which is
				calculated by measuring the total floor space of the caging device and dividing
				by the total number of egg-laying hens in the
				device.</text>
						</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idd49f4f0d7eb94ee6a5f604ff6c0481a7"><enum>(10)</enum><text>by inserting
			 after subsection (t), as redesignated by paragraph (4), the following new
			 subsection:</text>
					<quoted-block display-inline="no-display-inline" id="id2a427af40c5e49d7b134b36615a397ad" style="OLC">
						<subsection id="id797322381cce437fa936fe809841b5e5"><enum>(u)</enum><text>The term
				<term>new caging device</term> means any caging device that was not
				continuously in use for the production of eggs in commerce on or before
				December 31, 2011.</text>
						</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idc8cc4e5e561943fba12c39e32cf1cc72"><enum>(11)</enum><text>by inserting at
			 the end the following new subsections:</text>
					<quoted-block display-inline="no-display-inline" id="id004b0059a64a423cb11ce6d36cd0a027" style="OLC">
						<subsection id="id502b49fc8529446988ba3cb316c52d42"><enum>(jj)</enum><text>The term
				<term>water-withdrawal molting</term> means the practice of preventing water
				intake for the purpose of inducing egg-laying hens to molt.</text>
						</subsection><subsection id="id20db41ff57a747fe9a51658d61dab272"><enum>(kk)</enum><text>The term
				<term>white hen</term> means a white egg-laying hen used for commercial egg
				production.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id61dcd1d445c547d9a66f5a2c362f7916"><enum>(b)</enum><header>Housing and
			 treatment of egg-Laying hens</header><text>The Egg Products Inspection Act (21
			 U.S.C. 1031 et seq.) is amended by inserting after section 7 (<external-xref legal-doc="usc" parsable-cite="usc/21/1036">21 U.S.C. 1036</external-xref>)
			 the following new sections:</text>
				<quoted-block display-inline="no-display-inline" id="ide68c61be06e04bf69f6667a99abe1f43" style="OLC">
					<section id="idc16c2b87c2bc4caca9bc73256bbf74f8"><enum>7A.</enum><header>Housing and
				treatment of egg-laying hens</header>
						<subsection id="id4e332a18ac6d4a05ba410a0c549e5bbf"><enum>(a)</enum><header>Environmental
				enrichments</header>
							<paragraph id="idaba52f0dcf574cbf8a954e5bb7b8a782"><enum>(1)</enum><header>Existing caging
				devices</header><text>Beginning 15 years after the date of enactment of the
				<short-title>Egg Products Inspection Act Amendments of
				2013</short-title>, all existing caging devices shall provide egg-laying hens
				housed therein adequate environmental enrichments.</text>
							</paragraph><paragraph id="id75d78532c4ad439abaf74e3ee3f08478"><enum>(2)</enum><header>New caging
				devices</header><text>Beginning 9 years after the date of enactment of the
				<short-title>Egg Products Inspection Act Amendments of
				2013</short-title>, all new caging devices shall provide egg-laying hens housed
				therein adequate environmental enrichments.</text>
							</paragraph><paragraph id="id713dbb9d117d491f8b33ead08e954320"><enum>(3)</enum><header>Caging devices
				in California</header>
								<subparagraph id="id2966abef735c4b81ae5b46c63a7899d4"><enum>(A)</enum><header>New caging
				devices</header><text>All caging devices in California installed after the date
				of enactment of the <short-title>Egg Products Inspection
				Act Amendments of 2013</short-title> shall provide egg-laying hens housed
				therein adequate environmental enrichments beginning 3 months after that date
				of enactment.</text>
								</subparagraph><subparagraph id="idcf9d3d7ff8924a0fb309b42a2869d808"><enum>(B)</enum><header>Existing caging
				devices</header><text>All caging devices in California installed before the
				date of enactment of the <short-title>Egg Products
				Inspection Act Amendments of 2013</short-title> shall provide egg-laying hens
				housed therein adequate environmental enrichments beginning January 1,
				2024.</text>
								</subparagraph></paragraph></subsection><subsection id="id977d2d619f27448db8bcdf55da6afdff"><enum>(b)</enum><header>Floor
				space</header>
							<paragraph id="ide9a127ee512d4815891f80a2cf868adc"><enum>(1)</enum><header>Existing caging
				devices</header><text>All existing cages devices shall provide egg-laying hens
				housed therein—</text>
								<subparagraph id="id3c0084fa22294609a86a2729bdaddeac"><enum>(A)</enum><text>beginning 4 years
				after the date of enactment of the <short-title>Egg
				Products Inspection Act Amendments of 2013</short-title> and until the date
				that is 15 years after the date of enactment of the
				<short-title>Egg Products Inspection Act Amendments of
				2013</short-title>, a minimum of 76 square inches of individual floor space per
				brown hen and 67 square inches of individual floor space per white hen;
				and</text>
								</subparagraph><subparagraph id="id3dc339603b0f408bb41d6a946670c1fa"><enum>(B)</enum><text>beginning 15
				years after the date of enactment of the <short-title>Egg
				Products Inspection Act Amendments of 2013</short-title>, a minimum of 144
				square inches of individual floor space per brown hen and 124 square inches of
				individual floor space per white hen.</text>
								</subparagraph></paragraph><paragraph id="id1df67fedba494409a6aef8a50605a1b2"><enum>(2)</enum><header>New caging
				devices</header><text>All new caging devices shall provide egg-laying hens
				housed therein—</text>
								<subparagraph id="id1c89700333bc46909f9ae40c1359133c"><enum>(A)</enum><text>beginning 3 years
				after the date of enactment of the <short-title>Egg
				Products Inspection Act Amendments of 2013</short-title> and until the date
				that is 6 years after the date of enactment of the
				<short-title>Egg Products Inspection Act Amendments of
				2013</short-title>, a minimum of 90 square inches of individual floor space per
				brown hen and 78 square inches of individual floor space per white hen;</text>
								</subparagraph><subparagraph id="idd9a9bc5f13d94480ab9dc3f922a6c1fa"><enum>(B)</enum><text>beginning 6 years
				after the date of enactment of the <short-title>Egg
				Products Inspection Act Amendments of 2013</short-title> and until the date
				that is 9 years after the date of enactment of the
				<short-title>Egg Products Inspection Act Amendments of
				2013</short-title>, a minimum of 102 square inches of individual floor space
				per brown hen and 90 square inches of individual floor space per white
				hen;</text>
								</subparagraph><subparagraph id="id57adac59148846adbc95e131ec750cd0"><enum>(C)</enum><text>beginning 9 years
				after the date of enactment of the <short-title>Egg
				Products Inspection Act Amendments of 2013</short-title> and until the date
				that is 12 years after the date of enactment of the
				<short-title>Egg Products Inspection Act Amendments of
				2013</short-title>, a minimum of 116 square inches of individual floor space
				per brown hen and 101 square inches of individual floor space per white
				hen;</text>
								</subparagraph><subparagraph id="id4dfd90d1a14a4bf59fdfa19d0fdbb7e4"><enum>(D)</enum><text>beginning 12
				years after the date of enactment of the <short-title>Egg
				Products Inspection Act Amendments of 2013</short-title> and until the date
				that is 15 years after the date of enactment of the
				<short-title>Egg Products Inspection Act Amendments of
				2013</short-title>, a minimum of 130 square inches of individual floor space
				per brown hen and 113 square inches of individual floor space per white hen;
				and</text>
								</subparagraph><subparagraph id="id6874dc7b183e44f99003270b9a00c84f"><enum>(E)</enum><text>beginning 15
				years after the date of enactment of the <short-title>Egg
				Products Inspection Act Amendments of 2013</short-title>, a minimum of 144
				square inches of individual floor space per brown hen and 124 square inches of
				individual floor space per white hen.</text>
								</subparagraph></paragraph><paragraph id="id3695bf1997bc49a895161db07b6b95ce"><enum>(3)</enum><header>California
				caging devices</header>
								<subparagraph id="id278747bd377548d28a923717c745a7a2"><enum>(A)</enum><header>Existing caging
				devices</header><text>All caging devices in California installed before the
				date of enactment of the <short-title>Egg Products
				Inspection Act Amendments of 2013</short-title> shall provide egg-laying hens
				housed therein—</text>
									<clause id="ida66e213f9bc943e0b6d8efc92424f93d"><enum>(i)</enum><text>beginning January
				1, 2015, and through December 31, 2023, a minimum of 134 square inches of
				individual floor space per brown hen and 116 square inches of individual floor
				space per white hen; and</text>
									</clause><clause id="idc5658a6718084bed89c638922356f7d3"><enum>(ii)</enum><text>beginning
				January 1, 2024, a minimum of 144 square inches of individual floor space per
				brown hen and 124 square inches of individual floor space per white hen.</text>
									</clause></subparagraph><subparagraph id="id07e96cea0bf4465685643346b5b6f0ba"><enum>(B)</enum><header>New caging
				devices</header><text>All caging devices in California installed after the date
				of enactment of the <short-title>Egg Products Inspection
				Act Amendments of 2013</short-title> shall provide egg-laying hens housed
				therein—</text>
									<clause id="idf15497446d304d04b74f9511915f2498"><enum>(i)</enum><text>beginning 3
				months after the date of enactment of the <short-title>Egg
				Products Inspection Act Amendments of 2013</short-title>, and through December
				31, 2023, a minimum of 134 square inches of individual floor space per brown
				hen and 116 square inches of individual floor space per white hen; and</text>
									</clause><clause id="ide4ca2d9df6f04516875b2380906d94de"><enum>(ii)</enum><text>beginning
				January 1, 2024, a minimum of 144 square inches of individual floor space per
				brown hen and 124 square inches of individual floor space per white hen.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="idf71a2168eed949d186528cebc5406528"><enum>(c)</enum><header>Air
				quality</header>
							<paragraph id="id679a006e9e2a47f5a7eab24664bf6583"><enum>(1)</enum><header>In
				general</header><text>Beginning 2 years after the date of enactment of the
				<short-title>Egg Products Inspection Act Amendments of
				2013</short-title>, an egg handler shall provide all egg-laying hens under his
				ownership or control with acceptable air quality, which does not exceed more
				than 25 parts per million of ammonia during normal operations.</text>
							</paragraph><paragraph id="id8c9352364d454047ae943cc78265a48e"><enum>(2)</enum><header>Temporary
				excess ammonia levels allowed</header><text>Notwithstanding paragraph (1), an
				egg handler may provide egg-laying hens under the ownership or control of such
				handler with air quality containing more than 25 parts per million of ammonia
				for temporary periods as necessary because of extraordinary weather
				circumstances or other unusual circumstances.</text>
							</paragraph></subsection><subsection id="ide7062ee13b634180be1bb0779f859dff"><enum>(d)</enum><header>Forced
				molting</header><text>Beginning 2 years after the date of enactment of the
				<short-title>Egg Products Inspection Act Amendments of
				2013</short-title>, no egg handler may subject any egg-laying hen under his
				ownership or control to feed-withdrawal or water-withdrawal molting.</text>
						</subsection><subsection id="idc5e4fd4954474da595a5a7fa3ce099c0"><enum>(e)</enum><header>Euthanasia</header><text>Beginning
				2 years after the date of enactment of the <short-title>Egg Products Inspection Act Amendments of
				2013</short-title>, an egg handler shall provide, when necessary, all
				egg-laying hens under his ownership or control with euthanasia that is humane
				and uses a method deemed <quote>Acceptable</quote> by the American Veterinary
				Medical Association.</text>
						</subsection><subsection id="id01aa7fd710934831ac4586d0e46c231a"><enum>(f)</enum><header>Prohibition on
				new unenrichable cages</header><text>No person shall build, construct,
				implement, or place into operation any new caging device for the production of
				eggs to be sold in commerce unless the device—</text>
							<paragraph id="idff9283767e1a4bbb9ff419fd38879766"><enum>(1)</enum><text>provides the
				egg-laying hens to be contained therein a minimum of 76 square inches of
				individual floor space per brown hen or 67 square inches of individual floor
				space per white hen; and</text>
							</paragraph><paragraph id="idc8114b769898438694b218ab4cb3d294"><enum>(2)</enum><text>is capable of
				being adapted to accommodate adequate environmental enrichments.</text>
							</paragraph></subsection><subsection id="id79911888a3d74d5290f3f0382b3b3b0d"><enum>(g)</enum><header>Exemptions</header>
							<paragraph id="idc20b3b0855c84a409b01ed2e3fd6502e"><enum>(1)</enum><header>Recently-installed
				existing caging devices</header><text>The requirements under subsections (a)(1)
				and (b)(1)(B) shall not apply to any existing caging device that was first
				placed into operation between January 1, 2008, and December 31, 2011. This
				exemption shall expire on December 31, 2029, at which time the requirements
				contained in subsections (a)(1) and (b)(1)(B) shall apply to all existing
				caging devices.</text>
							</paragraph><paragraph id="id3ad701183b4c43509811d1d2e155f60f"><enum>(2)</enum><header>Hens already in
				production</header><text>The requirements under subsections (a)(1), (a)(2),
				(b)(1)(B), and (b)(2) shall not apply to any caging device containing
				egg-laying hens who are already in egg production on the date that such
				requirement takes effect. This exemption shall expire on the date that such
				egg-laying hens are removed from egg production.</text>
							</paragraph><paragraph id="id728122ceb4c44080acc264929b1f3f34"><enum>(3)</enum><header>Small
				producers</header><text>This section shall not apply to an egg handler who
				buys, sells, handles, or processes eggs or egg products solely from 1 flock of
				not more than 3,000 egg-laying hens.</text>
							</paragraph><paragraph id="iddd587cfc60e140e6a4310d104e276f38"><enum>(4)</enum><header>Educational and
				research institutions</header><text>The provisions of this section related to
				housing, treatment, or housing-related labeling shall not apply to egg
				production at an accredited educational or research institution, or to the
				purchase, sale, handling, or processing of eggs or egg products in connection
				with such production.</text>
							</paragraph><paragraph id="idb388560d3be84f01807f47fe37db1951"><enum>(5)</enum><header>Individual
				enclosures</header><text>The environmental enrichment requirements under
				subsection (a) shall not apply to any caging device that contains only 1
				egg-laying hen.</text>
							</paragraph><paragraph id="id6abf4acd9b344e8185a1e4c8faba7bfc"><enum>(6)</enum><header>Other livestock
				or poultry production</header><text>This section shall apply only to commercial
				egg production. This section shall not apply to the production of pork, beef,
				turkey, dairy, broiler chicken, veal, or other livestock or poultry.</text>

				conversion requirements</header>
						<subsection id="id250c016b171e47a8baadc1762d9c54a8"><enum>(a)</enum><header>National
				conversion requirements</header>
							<paragraph id="ida103fef4f0b94483b0a12300290d0140"><enum>(1)</enum><header>First
				conversion phase</header><text>Beginning 6 years after the date of enactment of
				the <short-title>Egg Products Inspection Act Amendments of
				2013</short-title>, at least 25 percent of the egg-laying hens in commercial
				egg production shall be housed either in new caging devices or in existing
				caging devices that provide the hens contained therein with a minimum of 102
				square inches of individual floor space per brown hen and 90 square inches of
				individual floor space per white hen.</text>
							</paragraph><paragraph id="id3d2653fbbf0e45c49e23607e1f744e8e"><enum>(2)</enum><header>Second
				conversion phase</header><text>Beginning 12 years after the date of enactment
				of the <short-title>Egg Products Inspection Act Amendments
				of 2013</short-title>, at least 55 percent of the egg-laying hens in commercial
				egg production shall be housed either in new caging devices or in existing
				caging devices that provide the hens contained therein with a minimum of 130
				square inches of individual floor space per brown hen and 113 square inches of
				individual floor space per white hen.</text>
							</paragraph><paragraph id="id74fb1a0aa89941748b701cb2e65647d2"><enum>(3)</enum><header>Final
				conversion phase</header><text>Beginning December 31, 2029, all egg-laying hens
				confined in caging devices shall be provided adequate environmental enrichments
				and a minimum of 144 square inches of individual floor space per brown hen and
				124 square inches of individual floor space per white hen.</text>
							</paragraph></subsection><subsection id="id02a6516d941240f49031649554eda14a"><enum>(b)</enum><header>California
				conversion requirements</header>
							<paragraph id="id98e332d040034d3fb4af58fbc4892f58"><enum>(1)</enum><header>First
				conversion phase</header><text>Beginning 2 years and 6 months after the date of
				enactment of the <short-title>Egg Products Inspection Act
				Amendments of 2013</short-title>, at least 25 percent of the egg-laying hens in
				commercial egg production in California shall be provided adequate
				environmental enrichments and a minimum of 134 square inches of individual
				floor space per brown hen and 116 square inches of individual floor space per
				white hen.</text>
							</paragraph><paragraph id="id93e2827abdd542a58073adce070f4113"><enum>(2)</enum><header>Second
				conversion phase</header><text>Beginning 5 years after the date of enactment of
				the <short-title>Egg Products Inspection Act Amendments of
				2013</short-title>, at least 50 percent of the egg-laying hens in commercial
				egg production in California shall be provided adequate environmental
				enrichments and a minimum of 134 square inches of individual floor space per
				brown hen and 116 square inches of individual floor space per white hen.</text>
							</paragraph><paragraph id="idae9c89a2add1457bad5448c21dcf8b2d"><enum>(3)</enum><header>Third
				conversion phase</header><text>Beginning 7 years and 6 months after the date of
				enactment of the <short-title>Egg Products Inspection Act
				Amendments of 2013</short-title>, at least 75 percent of the egg-laying hens in
				commercial egg production in California shall be provided adequate
				environmental enrichments and a minimum of 134 square inches of individual
				floor space per brown hen and 116 square inches of individual floor space per
				white hen.</text>
							</paragraph><paragraph id="idef32e5d0f61642ec8cfecc247aa507b6"><enum>(4)</enum><header>Final
				conversion phase</header><text>Beginning 10 years after the date of enactment
				of the <short-title>Egg Products Inspection Act Amendments
				of 2013</short-title>, all egg-laying hens in commercial egg production in
				California shall be provided adequate environmental enrichments and a minimum
				of 144 square inches of individual floor space per brown hen and 124 square
				inches of individual floor space per white hens.</text>
							</paragraph></subsection><subsection id="id47842b273204492ba52afcb64424b8bf"><enum>(c)</enum><header>Compliance</header>
							<paragraph id="idd530231464ae402b88e78f3090c96904"><enum>(1)</enum><header>In
				general</header><text>At the end of 6 years after the date of enactment of the
				<short-title>Egg Products Inspection Act Amendments of
				2013</short-title>, the Secretary shall determine, after having reviewed and
				analyzed the results of an independent, national survey of caging devices,
				whether—</text>
								<subparagraph id="id893603893eab4383886d890ea6658e48"><enum>(A)</enum><text>the requirements
				of subsection (a)(1) have been met; and</text>
								</subparagraph><subparagraph id="id2e4a135e370147c2beedbabed4ba1a09"><enum>(B)</enum><text>the requirements
				of subsection (b)(2) have been met.</text>
								</subparagraph></paragraph><paragraph id="id8e95a417f2f248edb0193153f456efb9"><enum>(2)</enum><header>Requirements
				met</header><text>If the Secretary finds that the requirements of subsection
				(a)(1) have not been met, then beginning January 1, 2020, the floor space
				requirements (irrespective of the date such requirements expire) related to new
				caging devices contained in subsection (b)(2)(B) of section 7A shall apply to
				existing caging devices placed into operation prior to January 1, 1995.</text>
							</paragraph><paragraph id="idc35f1619b21b4877a6ff2e68b7fa078f"><enum>(3)</enum><header>Requirements
				not met</header><text>If the Secretary finds that the requirements of
				subsection (b)(2) have not been met, then beginning 1 year from the date of the
				Secretary’s finding, the floor space and enrichments requirements (irrespective
				of the date such requirements come into force) contained in subsection
				(a)(3)(A) and subsection (b)(3)(B)(ii) of section 7A shall apply to all caging
				devices in California.</text>
							</paragraph><paragraph id="id375245704b87415d85a55e16f1eafc76"><enum>(4)</enum><header>Report</header><text>At
				the end of 12 years after the date of enactment of the
				<short-title>Egg Products Inspection Act Amendments of
				2013</short-title>, and again after December 31, 2029, the Secretary shall
				submit to the Committee on Agriculture of the House of Representatives and the
				Committee on Agriculture, Nutrition, and Forestry of the Senate a report on
				compliance with subsections (a) and (b).</text>
							</paragraph><paragraph id="id6b36af42609446189bdbb2fce52ccf37"><enum>(5)</enum><header>Relationship to
				other law</header><text>Notwithstanding section 12, the remedies provided in
				this subsection shall be the exclusive remedies for violations of this
				section.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id2b6d043e02fc4234a787da051238038c"><enum>(c)</enum><header>Inspections</header><text>Section
			 5 of the Egg Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1034">21 U.S.C. 1034</external-xref>) is amended—</text>
				<paragraph id="id09f9c7425c4f4c318d95939442b251a7"><enum>(1)</enum><text>in subsection
			 (d), in the first sentence, by inserting <quote>(other than requirements with
			 respect to housing, treatment, and housing-related labeling)</quote> after
			 <quote>as he deems appropriate to assure compliance with such
			 requirements</quote>; and</text>
				</paragraph><paragraph id="idc51d049fffae43979e29d12594dfadca"><enum>(2)</enum><text>in subsection
			 (e)—</text>
					<subparagraph id="id6fefce35701b47d290b416e13d7a2947"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
						<clause id="id3c6a2ca4bf1940c99d67c69a5993d954"><enum>(i)</enum><text>in
			 subparagraph (A), by striking <quote>and</quote>;</text>
						</clause><clause id="idcb1ce4eaf74b4e95971258badfcf2a99"><enum>(ii)</enum><text>by
			 redesignating subparagraph (B) as subparagraph (C);</text>
						</clause><clause id="idc0c50e6767634f2a8bebe28aa7a5c4c1"><enum>(iii)</enum><text>by inserting
			 after subparagraph (A) the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="iddb1c1be978f144e989261468f622ccca" style="OLC">
								<subparagraph id="id34b66313eff548de8d179a329f2062bb"><enum>(B)</enum><text>are derived from
				egg-laying hens housed and treated in compliance with section 7A;
				and</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause><clause id="id0c15f09160cf4ed2bb59bd3b5fed67ff"><enum>(iv)</enum><text>in
			 subparagraph (C), as redesignated by clause (ii), by inserting <quote>adequate
			 housing-related labeling and</quote> after <quote>contain</quote>;</text>
						</clause></subparagraph><subparagraph id="id1741084f95704c8d9ee95e920d56a2e5"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>In the case of a shell egg packer</quote> and inserting
			 <quote>In the cases of an egg handler with a flock of more than 3,000
			 egg-laying hens and a shell egg packer</quote>;</text>
					</subparagraph><subparagraph id="id6d932f2af8ba40b39b1e1b1689568465"><enum>(C)</enum><text>in paragraph (3),
			 by inserting <quote>(other than requirements with respect to housing,
			 treatment, and housing-related labeling)</quote> after <quote>to ensure
			 compliance with the requirements of paragraph (1)</quote>; and</text>
					</subparagraph><subparagraph id="ida18df124351f49a8ab4bcf0f56296167"><enum>(D)</enum><text>in paragraph (4),
			 by striking <quote>with a flock of not more than 3,000 layers.</quote> and
			 inserting <quote>who buys, sells, handles, or processes eggs or egg products
			 solely from 1 flock of not more than 3,000 egg-laying hens.</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="id0c51ac6f6a484bf9a6eef0b48549f892"><enum>(d)</enum><header>Labeling</header><text>Section
			 7(a) of the Egg Products Inspection Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/21/1036">21 U.S.C. 1036(a)</external-xref>) is amended
			 by inserting <quote>adequate housing-related labeling,</quote> after
			 <quote>plant where the products were processed,</quote>.</text>
			</subsection><subsection id="id6a1c8c4ca9d241dfabee62211bf4cfd7"><enum>(e)</enum><header>Limitation on
			 exemptions by secretary</header><text>Section 15(a) of the Egg Products
			 Inspection Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/21/1044">21 U.S.C. 1044(a)</external-xref>) is amended in the matter preceding
			 paragraph (1) by inserting <quote>(not including subsection (c) of section
			 8)</quote> after <quote>exempt from specific provisions</quote>.</text>
			</subsection><subsection id="id9335079c49304e4d958465e726962e4d"><enum>(f)</enum><header>Imports</header><text>Section
			 17(a)(2) of the Egg Products Inspection Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/21/1046">21 U.S.C. 1046(a)(2)</external-xref>) is
			 amended by striking <quote>subdivision thereof and are labeled and
			 packaged</quote> and inserting <quote>subdivision thereof; and no eggs or egg
			 products capable of use as human food shall be imported into the United States
			 unless they are produced, labeled, and packaged</quote>.</text>
			</subsection></section><section id="idf66a0804e122497e9561a72a0d200998"><enum>3.</enum><header>Enforcement of
			 hen housing and treatment standards</header><text display-inline="no-display-inline">Section 8 of the Egg Products Inspection Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/21/1037">21 U.S.C. 1037</external-xref>) is amended—</text>
			<paragraph id="ide945520639d34b9bbc04e803f4e4b74f"><enum>(1)</enum><text>by redesignating
			 subsections (c), (d), (e), and (f) as subsections (d), (e), (f), and (g),
			 respectively;</text>
			</paragraph><paragraph id="idd693540146404272a6a3d78d419cc26c"><enum>(2)</enum><text>by inserting
			 after subsection (b) the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="idcdd98fb276f24cc496af72115b7a1546" style="OLC">
					<subsection id="idc4b8d5c1a54e425cbbf9f291dd9ef2fe"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idDBA11C27F1B94432BF569CA980C854AA"><enum>(1)</enum><text>No person shall buy,
				sell, or transport, or offer to buy or sell, or offer or receive for
				transportation, in any business or commerce any eggs or egg products derived
				from egg-laying hens housed or treated in violation of any provision of section
				7A.</text>
						</paragraph><paragraph id="idbe166e80f8f349b698801f96b86cdb2d" indent="up1"><enum>(2)</enum><text>No person shall buy, sell, or
				transport, or offer to buy or sell, or offer or receive for transportation, in
				any business or commerce any eggs or egg products derived from egg-laying hens
				unless the container or package, including any immediate container, of the eggs
				or egg products, beginning 1 year after the date of enactment of the
				<short-title>Egg Products Inspection Act Amendments of
				2013</short-title>, contains adequate housing-related labeling.</text>
						</paragraph><paragraph id="idb684835438754c889abe1f5ab85c9286" indent="up1"><enum>(3)</enum><text>No person shall buy, sell, or
				transport, or offer to buy or sell, or offer or receive for transportation, in
				any business or commerce, in California, any eggs or egg products derived from
				egg-laying hens unless the egg-laying hens are provided floor space and
				enrichments equivalent to that required under subsections (a)(3) and (b)(3) of
				section 7A of this Act regardless of where the eggs are
				produced.</text>
						</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id7898ca6b01ef4bdea2c29108fbf292b7"><enum>(3)</enum><text>in subsection (e)
			 (as redesignated by paragraph (1)) , in the matter preceding paragraph (1), by
			 inserting <quote>7A,</quote> after <quote>section</quote>.</text>
			</paragraph></section><section id="id6c83dc28063049e8841dd355a0d703f0"><enum>4.</enum><header>State and local
			 authority</header><text display-inline="no-display-inline">Section 23 of the
			 Egg Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1052">21 U.S.C. 1052</external-xref>) is amended—</text>
			<subsection id="id6bbf4bb39aa84224b28b72d23bd89350"><enum>(a)</enum><text>by redesignating
			 subsections (c) and (d) as subsections (d) and (e), respectively;</text>
			</subsection><subsection id="idad54a7f904d645c19d96a595069db1f2"><enum>(b)</enum><text>by inserting
			 after subsection (b) the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="id6fee89a64b8443639a946ffcec606ca3" style="OLC">
					<subsection id="id1f798dabb1864b52be21b08f3f166f4a"><enum>(c)</enum><header>Prohibition
				against additional or different requirements than federal requirements related
				to minimum space allotments for housing egg-Laying hens in commercial egg
				production</header><text>Requirements within the scope of this Act with respect
				to minimum floor space allotments or enrichments for egg-laying hens housed in
				commercial egg production which are in addition to or different than those made
				under this Act may not be imposed by any State or local jurisdiction. Otherwise
				the provisions of this Act shall not invalidate any law or other provisions of
				any State or other jurisdiction in the absence of a conflict with this
				Act.</text>
					</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</subsection><subsection id="id5c25eee6fd1a405b9ef64c5a9008f4b6"><enum>(c)</enum><text>by inserting
			 after subsection (e) (as redesignated by subsection (a)) the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="id4352f286c9c245418c7ba0fdc643377f" style="OLC">
					<subsection id="id543106e472904d3bb17b67edd5a111b3"><enum>(f)</enum><header>Role of
				california department of food and agriculture</header><text>With respect to
				eggs produced, shipped, handled, transported, or received in California prior
				to the date that is 15 years after the date of enactment of the
				<short-title>Egg Products Inspection Act Amendments of
				2013</short-title>, the Secretary shall delegate to the California Department
				of Food and Agriculture the authority to enforce sections 7A(a)(3), 7A(b)(3),
				8(c)(3), and
				11.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id23ed05d7195846f7a3a0bc9dc3d66491"><enum>5.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act shall take
			 effect on the date of enactment of this Act.</text>
