		<official-title>To amend the Omnibus Public Land Management Act of 2009
		  to provide for the conduct of stewardship end result contracting

		<section id="idEF786EDA6BB5478B977C0891AA592FFD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Stewardship End Result Contracting
			 Project Act</short-title></quote>.</text>
		</section><section id="idBD299AD7683B44D4861BFEA29B10458E"><enum>2.</enum><header>Stewardship end
			 result contracting projects</header>
			<subsection id="id58c0ed2e1c8d4326b1a6fd1bea847edf"><enum>(a)</enum><header>In
			 general</header><text>Title IV of the Omnibus Public Land Management Act of
			 2009 is amended—</text>
				<paragraph id="id11E5FFC849E241DC994BD4805DDA0095"><enum>(1)</enum><text>by redesignating
			 section 4004 (<external-xref legal-doc="usc" parsable-cite="usc/16/7304">16 U.S.C. 7304</external-xref>) as section 4005;</text>
				</paragraph><paragraph id="id79142731A66B4BAE9F2FD960D0CDFF5A"><enum>(2)</enum><text>by inserting
			 after section 4003 (<external-xref legal-doc="usc" parsable-cite="usc/16/7303">16 U.S.C. 7303</external-xref>) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idF5499CA47EAF4A7E84E7723C648093AD" style="OLC">
						<section id="id2416187D224D4CA19790931F7D32613C"><enum>4004.</enum><header>Stewardship
				end result contracting projects</header>
							<subsection id="id1499e4638e5b46d7ab4404671536ba9a"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="id8FD6AA3EB38046ED96A5D66F80684A8B"><enum>(1)</enum><header>Chief</header><text>The
				term <term>Chief</term> means the Chief of the Forest Service.</text>
								</paragraph><paragraph id="idC6E334D3957E419DBF0C6CD993A08A75"><enum>(2)</enum><header>Director</header><text>The
				term <term>Director</term> means the Director of the Bureau of Land
				Management.</text>
								</paragraph><paragraph id="id7E1126384E5C494ABD537B1AEC8A954E"><enum>(3)</enum><header>Eligible
				land</header><text>The term <term>eligible land</term> means land located on
				National Forest System land or Bureau of Land Management land located west of
				the 100th meridian.</text>
								</paragraph></subsection><subsection id="id780950EE5996452B9648086659DD1C2A"><enum>(b)</enum><header>Projects</header><text>The
				Chief and the Director, via agreement or contract as appropriate, may enter
				into stewardship contracting projects with private persons or other public or
				private entities to perform services to achieve land management goals for
				eligible land that meets local and rural community needs.</text>
							</subsection><subsection id="id671c172933ca4909822a0811bfb9f290"><enum>(c)</enum><header>Land management
				goals</header><text>The land management goals of a project under subsection (b)
				may include—</text>
								<paragraph id="idd972885329c74722a221cf1091748985"><enum>(1)</enum><text>road and trail
				maintenance or obliteration to restore or maintain water quality;</text>
								</paragraph><paragraph id="id2e48f869fbf14888b2af939c9a8ff16a"><enum>(2)</enum><text>soil
				productivity, habitat for wildlife and fisheries, or other resource
				values;</text>
								</paragraph><paragraph id="id23f0d334f32e429b8fbd1fc0d9bb87db"><enum>(3)</enum><text>setting of
				prescribed fires to improve the composition, structure, condition, and health
				of stands or to improve wildlife habitat;</text>
								</paragraph><paragraph id="id14e1df1bfbbc42fbaf61fe4258faed47"><enum>(4)</enum><text>removing
				vegetation or other activities to promote healthy forest stands, reduce fire
				hazards, or achieve other land management objectives;</text>
								</paragraph><paragraph id="iddb1612d2d48b431cac770bcd5c415952"><enum>(5)</enum><text>watershed
				restoration and maintenance;</text>
								</paragraph><paragraph id="id6661af64600a4ff8abf3b8f7e8ae6271"><enum>(6)</enum><text>restoration and
				maintenance of wildlife and fish; or</text>
								</paragraph><paragraph id="idc7dc7cc30a974fa1bfdd9cd011cd4652"><enum>(7)</enum><text>control of
				noxious and exotic weeds and reestablishing native plant species.</text>
								</paragraph></subsection><subsection id="id12ca5aa984ab43259b0787be4e34f1e5"><enum>(d)</enum><header>Agreements or
				contracts</header>
								<paragraph id="id0e1efffc9f35473999d40fe8d5cdb9c1"><enum>(1)</enum><header>Procurement
				procedure</header><text>A source for performance of an agreement or contract
				under subsection (b) shall be selected on a best-value basis, including
				consideration of source under other public and private agreements or
				contracts.</text>
								</paragraph><paragraph id="id3fd8fb71e6314affb458c3990f007e9b"><enum>(2)</enum><header>Contract for
				sale of property</header><text>A contract entered into under this section may,
				at the discretion of the Secretary of Agriculture, be considered a contract for
				the sale of property under such terms as the Secretary may prescribe without
				regard to any other provision of law.</text>
								</paragraph><paragraph id="id918e66ac0fda452e9a0002d5ae769c4e"><enum>(3)</enum><header>Term</header>
									<subparagraph id="idC4EE27FFB9E145EDA5F3294B6E280580"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), the Chief and the
				Director may enter into a contract under subsection (b) in accordance with
				<external-xref legal-doc="usc" parsable-cite="usc/41/3903">section 3903</external-xref> of title 41, United States Code.</text>
									</subparagraph><subparagraph id="id2D5B5277682440EEAE00BD7CD4CD52F4"><enum>(B)</enum><header>Maximum</header><text>The
				period of the contract under subsection (b) may exceed 5 years but may not
				exceed 10 years.</text>
									</subparagraph></paragraph><paragraph id="id4d0d55fa173e4e1c9785463bc9eaf648"><enum>(4)</enum><header>Offsets</header>
									<subparagraph id="id28fa019300594280b053a24355044d27"><enum>(A)</enum><header>In
				general</header><text>The Chief and the Director may apply the value of timber
				or other forest products removed as an offset against the cost of services
				received under the agreement or contract described in subsection (b).</text>
									</subparagraph><subparagraph id="idec4fbcfa3620495b987f270ca3decbae"><enum>(B)</enum><header>Methods of
				appraisal</header><text>The value of timber or other forest products used as an
				offset under subparagraph (A)—</text>
										<clause id="id9b926fd6697e49f9ab8c3cfb8ca315ad"><enum>(i)</enum><text>shall be
				determined using appropriate methods of appraisal commensurate with the
				quantity of products to be removed; and</text>
										</clause><clause id="id6d0e8c8955014afda556facd69ab1fce"><enum>(ii)</enum><text>may—</text>
											<subclause id="idFE365F5A8BE9478EA45FFE74444636FA"><enum>(I)</enum><text>be determined
				using a unit of measure appropriate to the contracts; and</text>
											</subclause><subclause id="id9a04cd1c95fc46709a91454b8e784425"><enum>(II)</enum><text>may include
				valuing products on a per-acre basis.</text>
											</subclause></clause></subparagraph></paragraph><paragraph id="idd8ce1c59fdc54734abe50f0f1cfbd30b"><enum>(5)</enum><header>Relation to
				other laws</header><text>Notwithstanding subsections (d) and (g) of section 14
				of the National Forest Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/16/472a">16 U.S.C. 472a</external-xref>), the Chief may
				enter into an agreement or contract under subsection (b).</text>
								</paragraph><paragraph id="id696f0266f10345a59dd7d027b1cac3bd"><enum>(6)</enum><header>Contracting
				officer</header><text>Notwithstanding any other provision of law, the Secretary
				or the Secretary of the Interior may determine the appropriate contracting
				officer to enter into and administer an agreement or contract under subsection
				(b).</text>
								</paragraph></subsection><subsection id="id278d29a9708941e9ba1d594298e4964b"><enum>(e)</enum><header>Receipts</header>
								<paragraph id="ide0b17b1578ed460cbc19f02e4b51797c"><enum>(1)</enum><header>In
				general</header><text>The Chief and the Director may collect monies from an
				agreement or contract under subsection (b) if the collection is a secondary
				objective of negotiating the contract that will best achieve the purposes of
				this section.</text>
								</paragraph><paragraph id="id20881fc8466b4c859b27be7162aca7c8"><enum>(2)</enum><header>Use</header><text>Monies
				from an agreement or contract under subsection (b)—</text>
									<subparagraph id="id66BEB599AB7546EA9D0299162D927241"><enum>(A)</enum><text>may be retained
				by the Chief and the Director; and</text>
									</subparagraph><subparagraph id="idE662A6ED676A44DFB07DDECA8623C24B"><enum>(B)</enum><text>shall be
				available for expenditure without further appropriation at the project site
				from which the monies are collected or at another project site.</text>
									</subparagraph></paragraph><paragraph id="idc7408490a8e4462ba8bfd4259b0fb62b"><enum>(3)</enum><header>Relation to
				other laws</header>
									<subparagraph id="id95B2C507F65042B6B7B9F38ADA988C41"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, the value of
				services received by the Chief or the Director under a stewardship contract
				project conducted under this section, and any payments made or resources
				provided by the contractor, Chief, or Director shall not be considered monies
				received from the National Forest System or the public lands.</text>
									</subparagraph><subparagraph id="id15022AD56ED643D299C7B0E2BA193869"><enum>(B)</enum><header>Knutson-Vanderberg
				Act</header><text>The Act of June 9, 1930 (commonly known as the
				<quote>Knutson-Vanderberg Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/576">16 U.S.C. 576 et seq.</external-xref>) shall not apply
				to any agreement or contract under subsection (b).</text>
									</subparagraph></paragraph></subsection><subsection id="id7093b91d36244ff499604626bd7c634b"><enum>(f)</enum><header>Costs of
				removal</header><text>Notwithstanding the fact that a contractor did not
				harvest the timber, the Chief may collect deposits from a contractor covering
				the costs of removal of timber or other forest products under—</text>
								<paragraph id="id4E8ECB59297F4E349BAB1D96F5BDBC89"><enum>(1)</enum><text>the Act of August
				11, 1916 (<external-xref legal-doc="usc" parsable-cite="usc/16/490">16 U.S.C. 490</external-xref>); and</text>
								</paragraph><paragraph id="idA52614A445324CC080793B6AF0F9439F"><enum>(2)</enum><text>and the Act of
				June 30, 1914 (<external-xref legal-doc="usc" parsable-cite="usc/16/498">16 U.S.C. 498</external-xref>).</text>
								</paragraph></subsection><subsection id="idc74bfdff073f4235bd7e5a50608b3a81"><enum>(g)</enum><header>Performance and
				payment guarantees</header>
								<paragraph id="idf8bee1cc21454766a63eaf725351251c"><enum>(1)</enum><header>In
				general</header><text>The Chief and the Director may require performance and
				payment bonds under sections 28.103–2 and 28.103–3 of the Federal Acquisition
				Regulation, in an amount that the contracting officer considers sufficient to
				protect the investment in receipts by the Federal Government generated by the
				contractor from the estimated value of the forest products to be removed under
				a contract under subsection (b).</text>
								</paragraph><paragraph id="id7bcfb44406ca4e369aff0d427b7a595d"><enum>(2)</enum><header>Excess offset
				value</header><text>If the offset value of the forest products exceeds the
				value of the resource improvement treatments, the Chief and the Director
				may—</text>
									<subparagraph id="id0681e4f7783e46e0aa67c51c89cf54dd"><enum>(A)</enum><text>collect any
				residual receipts under the Act of June 9, 1930 (commonly known as the
				<quote>Knutson-Vanderberg Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/576">16 U.S.C. 576 et seq.</external-xref>); and</text>
									</subparagraph><subparagraph id="id73fdf8d2502c44cda3c94d767ac6d14c"><enum>(B)</enum><text>apply the excess
				to other authorized stewardship projects.</text>
									</subparagraph></paragraph></subsection><subsection id="id2b9316875f9e474aa15a0f118c4177b0"><enum>(h)</enum><header>Monitoring and
				evaluation</header>
								<paragraph id="idCC33500A45EA40A49110685E554E25E3"><enum>(1)</enum><header>In
				general</header><text>The Chief and the Director shall establish a multiparty
				monitoring and evaluation process that accesses the stewardship contracting
				projects conducted under this section.</text>
								</paragraph><paragraph id="idC3DF2786C52A4A20A5744892638744C0"><enum>(2)</enum><header>Participants</header><text>Other
				than the Chief and Director, participants in the process described in paragraph
				(1) may include—</text>
									<subparagraph id="idC2C98C734E1C44588FA2CF2A4BDD48BE"><enum>(A)</enum><text>any cooperating
				governmental agencies, including tribal governments; and</text>
									</subparagraph><subparagraph id="idBAE61ED0C2F64153B2E565E8C00CC59F"><enum>(B)</enum><text>any other
				interested groups or individuals.</text>
									</subparagraph></paragraph></subsection><subsection id="id9C4EDC9AEB8F44C68D037C663F345583"><enum>(i)</enum><header>Reporting</header><text>Not
				later than 1 year after the date of enactment of this section, and annually
				thereafter, the Chief and the Director shall report to the Committee on Energy
				and Natural Resources of the Senate and the Committee on Natural Resources of
				the House of Representatives on—</text>
								<paragraph id="id148af4ff94ab428bb299a2bf05626bb7"><enum>(1)</enum><text>the status of
				development, execution, and administration of agreements or contracts under
				subsection (b);</text>
								</paragraph><paragraph id="idf12c82126b374dc6a3c85a111a542b0a"><enum>(2)</enum><text>the specific
				accomplishments that have resulted; and</text>
								</paragraph><paragraph id="idf389d04a331042d98045371c1f511785"><enum>(3)</enum><text>the role of local
				communities in the development of agreements or contract
				plans.</text>
								</paragraph></subsection></section><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idCD1B4B67695F46AF98840AC814D4D431"><enum>(3)</enum><text>in section 4005
			 (as so redesignated), by inserting <quote>, other than section 4004</quote>
			 after <quote>title</quote>.</text>
				</paragraph></subsection><subsection id="idCD2B2CC376B842388E32B67EDA9E88FA"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 347 of the Department of the Interior and
			 Related Agencies Appropriations Act, 1999 (<external-xref legal-doc="usc" parsable-cite="usc/16/2104">16 U.S.C. 2104</external-xref> note; Public Law
			 105–277) is repealed.</text>
