		<section changed="deleted" committee-id="SSHR00" display-inline="no-display-inline" id="H73995FCBB79F405095C1672C9C56E540" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Employment Non-Discrimination Act of
			 2013</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSHR00" id="H5DA431329E134C93934B85E5EEC7EFCF" reported-display-style="strikethrough"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph id="H2BA9967F325B430394E9073D30009E50"><enum>(1)</enum><text display-inline="yes-display-inline">to address the history and persistent,
			 widespread pattern of discrimination, including unconstitutional
			 discrimination, on the bases of sexual orientation and gender identity by
			 private sector employers and local, State, and Federal Government
			 employers;</text>
			</paragraph><paragraph id="H069687E916824FB8AA4B4FA0E46A50FA"><enum>(2)</enum><text>to provide an
			 explicit, comprehensive Federal prohibition against employment discrimination
			 on the bases of sexual orientation and gender identity, including meaningful
			 and effective remedies for any such discrimination; and</text>
			</paragraph><paragraph id="H3380B6D8CBA54063AE8E2B7298C1F67F"><enum>(3)</enum><text display-inline="yes-display-inline">to invoke congressional powers, including
			 the powers to enforce the 14th Amendment to the Constitution, and to regulate
			 interstate commerce pursuant to section 8 of article I of the Constitution, in
			 order to prohibit employment discrimination on the bases of sexual orientation
			 and gender identity.</text>
			</paragraph></section><section changed="deleted" committee-id="SSHR00" id="H34D546A9FEAE466FAE618BBD5F79CC99" reported-display-style="strikethrough"><enum>3.</enum><header>Definitions</header>
			<subsection id="H81BAA148B56F40E1A3EF9ABF1F64DEAC"><enum>(a)</enum><header>In
			 general</header><text>In this Act:</text>
				<paragraph id="H45AF4D9ACE9643F59DC1385CDC7F187B"><enum>(1)</enum><header>Commission</header><text>The
			 term <term>Commission</term> means the Equal Employment Opportunity
			 Commission.</text>
				</paragraph><paragraph id="H6490701AC863422B8688184DEE334A7B"><enum>(2)</enum><header>Covered
			 entity</header><text>The term <term>covered entity</term> means an employer,
			 employment agency, labor organization, or joint labor-management
			 committee.</text>
				</paragraph><paragraph id="H06C67DFB566E4C22BACDBA68F90BB06D"><enum>(3)</enum><header>Employee</header>
					<subparagraph id="H6FEDA0A17D954730A14ADF0748EF1742"><enum>(A)</enum><header>In
			 general</header><text>The term <term>employee</term> means—</text>
						<clause id="H764A9C10E3494A28B6002FCA47E35C7A"><enum>(i)</enum><text>an employee as
			 defined in section 701(f) of the Civil Rights Act of 1964 (42 U.S.C.
			 2000e(f));</text>
						</clause><clause id="H341AFE0F1D0D459F8D028E3527BE9B94"><enum>(ii)</enum><text>a State employee
			 to which section 302(a)(1) of the Government Employee Rights Act of 1991 (42
			 U.S.C. 2000e–16b(a)(1)) applies;</text>
						</clause><clause id="H1CFAC957D6434475A1E739BC84EE79CE"><enum>(iii)</enum><text>a covered
			 employee, as defined in section 101 of the Congressional Accountability Act of
			 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>) or <external-xref legal-doc="usc" parsable-cite="usc/3/411">section 411(c)</external-xref> of title 3, United States Code;
			 or</text>
						</clause><clause id="H31A0BA5C3BFE42718FC57D8CDEAA4554"><enum>(iv)</enum><text>an employee or
			 applicant to which section 717(a) of the Civil Rights Act of 1964 (42 U.S.C.
			 2000e–16(a)) applies.</text>
						</clause></subparagraph><subparagraph id="HD95647B61491451985ADC05C34AFB945"><enum>(B)</enum><header>Exception</header><text>The
			 provisions of this Act that apply to an employee or individual shall not apply
			 to a volunteer who receives no compensation.</text>
					</subparagraph></paragraph><paragraph id="HD7118239FB4442919B8842F184CAD89A"><enum>(4)</enum><header>Employer</header><text>The
			 term <term>employer</term> means—</text>
					<subparagraph id="H81F5FC057FD649AC869E1CD443CCB4D8"><enum>(A)</enum><text>a person engaged
			 in an industry affecting commerce (as defined in section 701(h) of the Civil
			 Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e(h)</external-xref>) who has 15 or more employees (as
			 defined in subparagraphs (A)(i) and (B) of paragraph (3)) for each working day
			 in each of 20 or more calendar weeks in the current or preceding calendar year,
			 and any agent of such a person, but does not include a bona fide private
			 membership club (other than a labor organization) that is exempt from taxation
			 under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986;</text>
					</subparagraph><subparagraph id="H619ACA50815A45C4BCB8664347E0D640"><enum>(B)</enum><text>an employing
			 authority to which section 302(a)(1) of the Government Employee Rights Act of
			 1991 applies;</text>
					</subparagraph><subparagraph id="H2A184AA2DD1C4B7BBA598F0091A1B71F"><enum>(C)</enum><text>an employing
			 office, as defined in section 101 of the Congressional Accountability Act of
			 1995 or <external-xref legal-doc="usc" parsable-cite="usc/3/411">section 411(c)</external-xref> of title 3, United States Code; or</text>
					</subparagraph><subparagraph id="H58BFE2917621468F8C6FA3218A746795"><enum>(D)</enum><text>an entity to which
			 section 717(a) of the Civil Rights Act of 1964 applies.</text>
					</subparagraph></paragraph><paragraph id="H3A22CCE1D6294900B4BEEC702120A7C3"><enum>(5)</enum><header>Employment
			 agency</header><text>The term <term>employment agency</term> has the meaning
			 given the term in section 701(c) of the Civil Rights Act of 1964 (42 U.S.C.
			 2000e(c)).</text>
				</paragraph><paragraph id="HB9D17D8CBEA04C76BF8F66714702A2F5"><enum>(6)</enum><header>Gender
			 identity</header><text>The term <term>gender identity</term> means the
			 gender-related identity, appearance, or mannerisms or other gender-related
			 characteristics of an individual, with or without regard to the individual’s
			 designated sex at birth.</text>
				</paragraph><paragraph id="HF249E4D8F3764ADB8C12E15808E3600A"><enum>(7)</enum><header>Labor
			 organization</header><text>The term <term>labor organization</term> has the
			 meaning given the term in section 701(d) of the Civil Rights Act of 1964 (42
			 U.S.C. 2000e(d)).</text>
				</paragraph><paragraph id="H3BB430432BD34FF2848C00E36E139257"><enum>(8)</enum><header>Person</header><text>The
			 term <term>person</term> has the meaning given the term in section 701(a) of
			 the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e(a)</external-xref>).</text>
				</paragraph><paragraph id="H0DBDAB7FEE85404883304F6D8E51E39C"><enum>(9)</enum><header>Sexual
			 orientation</header><text>The term <term>sexual orientation</term> means
			 homosexuality, heterosexuality, or bisexuality.</text>
				</paragraph><paragraph id="HD5D57EDE6F76406B89B71E9517A55991"><enum>(10)</enum><header>State</header><text>The
			 term <term>State</term> has the meaning given the term in section 701(i) of the
			 Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e(i)</external-xref>).</text>
				</paragraph></subsection><subsection id="H9FB874DDE3C846DDACA87F2B76D44D64"><enum>(b)</enum><header>Application of
			 definitions</header><text>For purposes of this section, a reference in section
			 701 of the Civil Rights Act of 1964—</text>
				<paragraph id="H750D4C8E73454557922160C75EABF4A0"><enum>(1)</enum><text>to an employee or
			 an employer shall be considered to refer to an employee (as defined in
			 subsection (a)(3)) or an employer (as defined in subsection (a)(4)),
			 respectively, except as provided in paragraph (2) of this subsection;
			 and</text>
				</paragraph><paragraph id="HDAAE9613D4AA420FB1543175273321AB"><enum>(2)</enum><text>to an employer in
			 subsection (f) of that section shall be considered to refer to an employer (as
			 defined in subsection (a)(4)(A)).</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSHR00" id="HAAC27F12F72C4369A9AD8A62CCC059FE" reported-display-style="strikethrough"><enum>4.</enum><header>Employment
			 discrimination prohibited</header>
			<subsection id="H2733B0E2AE1B4B8AA00C24F200B0AD08"><enum>(a)</enum><header>Employer
			 practices</header><text>It shall be an unlawful employment practice for an
			 employer—</text>
				<paragraph id="H927A051859D64C2A8E3A2054A054A515"><enum>(1)</enum><text display-inline="yes-display-inline">to fail or refuse to hire or to discharge
			 any individual, or otherwise discriminate against any individual with respect
			 to the compensation, terms, conditions, or privileges of employment of the
			 individual, because of such individual’s actual or perceived sexual orientation
			 or gender identity; or</text>
				</paragraph><paragraph id="H4C5588CA34AC440994C153811AEAA647"><enum>(2)</enum><text display-inline="yes-display-inline">to limit, segregate, or classify the
			 employees or applicants for employment of the employer in any way that would
			 deprive or tend to deprive any individual of employment or otherwise adversely
			 affect the status of the individual as an employee, because of such
			 individual’s actual or perceived sexual orientation or gender identity.</text>
				</paragraph></subsection><subsection id="HDF2A7094A2604A2FAAF3CA158746D8AF"><enum>(b)</enum><header>Employment
			 agency practices</header><text display-inline="yes-display-inline">It shall be
			 an unlawful employment practice for an employment agency to fail or refuse to
			 refer for employment, or otherwise to discriminate against, any individual
			 because of the actual or perceived sexual orientation or gender identity of the
			 individual or to classify or refer for employment any individual on the basis
			 of the actual or perceived sexual orientation or gender identity of the
			 individual.</text>
			</subsection><subsection id="HABE5D0C3847B4C08BBF6F4B1C09EEAB7"><enum>(c)</enum><header>Labor
			 organization practices</header><text>It shall be an unlawful employment
			 practice for a labor organization—</text>
				<paragraph id="HFD5713F857DF4571A92E3F8E4B236414"><enum>(1)</enum><text display-inline="yes-display-inline">to exclude or to expel from its membership,
			 or otherwise to discriminate against, any individual because of the actual or
			 perceived sexual orientation or gender identity of the individual;</text>
				</paragraph><paragraph id="HA70FD52142B246CCA0E9C227AE9C9D99"><enum>(2)</enum><text display-inline="yes-display-inline">to limit, segregate, or classify its
			 membership or applicants for membership, or to classify or fail or refuse to
			 refer for employment any individual, in any way that would deprive or tend to
			 deprive any individual of employment, or would limit such employment or
			 otherwise adversely affect the status of the individual as an employee or as an
			 applicant for employment because of such individual’s actual or perceived
			 sexual orientation or gender identity; or</text>
				</paragraph><paragraph id="HD0442C63BA7E459DBE4C4FF119E51CF5"><enum>(3)</enum><text>to cause or
			 attempt to cause an employer to discriminate against an individual in violation
			 of this section.</text>
				</paragraph></subsection><subsection id="HE5036C30FA3D4F8D87C5B2997438134C"><enum>(d)</enum><header>Training
			 programs</header><text display-inline="yes-display-inline">It shall be an
			 unlawful employment practice for any employer, labor organization, or joint
			 labor-management committee controlling apprenticeship or other training or
			 retraining, including on-the-job training programs, to discriminate against any
			 individual because of the actual or perceived sexual orientation or gender
			 identity of the individual in admission to, or employment in, any program
			 established to provide apprenticeship or other training.</text>
			</subsection><subsection id="H00D9D37DFC7646328C842E6CAE0D70EF"><enum>(e)</enum><header>Association</header><text display-inline="yes-display-inline">An unlawful employment practice described
			 in any of subsections (a) through (d) shall be considered to include an action
			 described in that subsection, taken against an individual based on the actual
			 or perceived sexual orientation or gender identity of a person with whom the
			 individual associates or has associated.</text>
			</subsection><subsection id="H73170693639F499194D7A8B54C5488AF"><enum>(f)</enum><header>No preferential
			 treatment or Quotas</header><text>Nothing in this Act shall be construed or
			 interpreted to require or permit—</text>
				<paragraph id="H87777BF813DA4F74B93CE6AF9BAB2B36"><enum>(1)</enum><text display-inline="yes-display-inline">any covered entity to grant preferential
			 treatment to any individual or to any group because of the actual or perceived
			 sexual orientation or gender identity of such individual or group on account of
			 an imbalance which may exist with respect to the total number or percentage of
			 persons of any actual or perceived sexual orientation or gender identity
			 employed by any employer, referred or classified for employment by any
			 employment agency or labor organization, admitted to membership or classified
			 by any labor organization, or admitted to, or employed in, any apprenticeship
			 or other training program, in comparison with the total number or percentage of
			 persons of such actual or perceived sexual orientation or gender identity in
			 any community, State, section, or other area, or in the available work force in
			 any community, State, section, or other area; or</text>
				</paragraph><paragraph id="HE6253D7075F440F0A6D00B6B5363634F"><enum>(2)</enum><text display-inline="yes-display-inline">the adoption or implementation by a covered
			 entity of a quota on the basis of actual or perceived sexual orientation or
			 gender identity.</text>
				</paragraph></subsection><subsection id="HF6F920E990254498B452816D4AA5950A"><enum>(g)</enum><header>Disparate
			 impact</header><text>Only disparate treatment claims may be brought under this
			 Act.</text>
			</subsection></section><section changed="deleted" committee-id="SSHR00" id="H0B99A311994349A7BBEAECE9E7E50A52" reported-display-style="strikethrough"><enum>5.</enum><header>Retaliation
			 prohibited</header><text display-inline="no-display-inline">It shall be an
			 unlawful employment practice for a covered entity to discriminate against an
			 individual because such individual—</text>
			<paragraph id="idA203FA283DFC45C6B874FEEAF6175CF6"><enum>(1)</enum><text display-inline="yes-display-inline">opposed any practice made an unlawful
			 employment practice by this Act; or</text>
			</paragraph><paragraph id="id90A4B75DE7DD41488AAC76A8A3D3FC05"><enum>(2)</enum><text display-inline="yes-display-inline">made a charge, testified, assisted, or
			 participated in any manner in an investigation, proceeding, or hearing under
			 this Act.</text>
			</paragraph></section><section changed="deleted" committee-id="SSHR00" display-inline="no-display-inline" id="H028F0CA217F54F93A014A110F68A5F0C" reported-display-style="strikethrough"><enum>6.</enum><header>Exemption for
			 Religious Organizations</header><text display-inline="no-display-inline">This
			 Act shall not apply to a corporation, association, educational institution or
			 institution of learning, or society that is exempt from the religious
			 discrimination provisions of title VII of the Civil Rights Act of 1964 pursuant
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>) to section 702(a) or 703(e)(2) of such Act (42 U.S.C.
			 2000e–1(a), 2000e–2(e)(2)).</text>
		</section><section changed="deleted" committee-id="SSHR00" id="H14AD5418DF18428890B2424F2B19B849" reported-display-style="strikethrough"><enum>7.</enum><header>Nonapplication to
			 members of the armed forces; veterans’ preferences</header>
			<subsection id="H482FAB7B010D49FEAC5A60DF4F4ABD79"><enum>(a)</enum><header>Armed
			 forces</header>
				<paragraph id="H6B00247ADBD24569AA3D272870637664"><enum>(1)</enum><header>Employment</header><text>In
			 this Act, the term <term>employment</term> does not apply to the relationship
			 between the United States and members of the Armed Forces.</text>
				</paragraph><paragraph id="H31196C12EEE1435BAE6EF716CA5D533A"><enum>(2)</enum><header>Armed
			 forces</header><text>In paragraph (1) the term <term>Armed Forces</term> means
			 the Army, Navy, Air Force, Marine Corps, and Coast Guard.</text>
				</paragraph></subsection><subsection id="H826B6BE609FF4404AAAB3C46213B1F3A"><enum>(b)</enum><header>Veterans’
			 preferences</header><text>This title does not repeal or modify any Federal,
			 State, territorial, or local law creating a special right or preference
			 concerning employment for a veteran.</text>
			</subsection></section><section changed="deleted" committee-id="SSHR00" id="H6FE271A997164C819FB7D464F02BB45D" reported-display-style="strikethrough"><enum>8.</enum><header>Construction</header>
			<subsection id="id81643CF2F1E14D53BDF3E5BEF2B44EE2"><enum>(a)</enum><header>Dress or
			 grooming standards</header><text display-inline="yes-display-inline">Nothing in
			 this Act shall prohibit an employer from requiring an employee, during the
			 employee’s hours at work, to adhere to reasonable dress or grooming standards
			 not prohibited by other provisions of Federal, State, or local law, provided
			 that the employer permits any employee who has undergone gender transition
			 prior to the time of employment, and any employee who has notified the employer
			 that the employee has undergone or is undergoing gender transition after the
			 time of employment, to adhere to the same dress or grooming standards as apply
			 for the gender to which the employee has transitioned or is
			 transitioning.</text>
			</subsection><subsection id="ida35e25b3cf184eae9154600a1087e940"><enum>(b)</enum><header>Additional
			 facilities not required</header><text>Nothing in this Act shall be construed to
			 require the construction of new or additional facilities.</text>
			</subsection></section><section changed="deleted" committee-id="SSHR00" id="HE916B53D906F4FF48275F0E84E03CC46" reported-display-style="strikethrough"><enum>9.</enum><header>Collection of
			 statistics prohibited</header><text display-inline="no-display-inline">The
			 Commission shall neither compel the collection of nor require the production of
			 statistics on actual or perceived sexual orientation or gender identity from
			 covered entities.</text>
		</section><section changed="deleted" committee-id="SSHR00" id="HE30010E9A9274A588909FBCD33DB0164" reported-display-style="strikethrough"><enum>10.</enum><header>Enforcement</header>
			<subsection id="H3003C57214994AFDBBED77995309B894"><enum>(a)</enum><header>Enforcement
			 powers</header><text>With respect to the administration and enforcement of this
			 Act in the case of a claim alleged by an individual for a violation of this
			 Act—</text>
				<paragraph id="H33187AD826B94815A6BFF65EF2599175"><enum>(1)</enum><text>the Commission
			 shall have the same powers as the Commission has to administer and
			 enforce—</text>
					<subparagraph id="H16BBA3BC44CF4D3D9797B2D8B909EF00"><enum>(A)</enum><text>title VII of the
			 Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>); or</text>
					</subparagraph><subparagraph id="H13AFC0ED7579422D87C7B15FFC8E2A94"><enum>(B)</enum><text>sections 302 and
			 304 of the Government Employee Rights Act of 1991 (42 U.S.C. 2000e–16b and
			 2000e–16c),</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">in the case of a claim alleged by
			 such individual for a violation of such title, or of section 302(a)(1) of the
			 Government Employee Rights Act of 1991 (42 U.S.C. 2000e–16b(a)(1)),
			 respectively;</continuation-text></paragraph><paragraph id="HE6B9DB4146194C20AB02DE6FE763DC32"><enum>(2)</enum><text>the Librarian of
			 Congress shall have the same powers as the Librarian of Congress has to
			 administer and enforce title VII of the Civil Rights Act of 1964 (42 U.S.C.
			 2000e et seq.) in the case of a claim alleged by such individual for a
			 violation of such title;</text>
				</paragraph><paragraph id="HFFA2C040920B40518117825223421B48"><enum>(3)</enum><text>the Board (as
			 defined in section 101 of the Congressional Accountability Act of 1995 (2
			 U.S.C. 1301)) shall have the same powers as the Board has to administer and
			 enforce the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301 et seq.</external-xref>) in
			 the case of a claim alleged by such individual for a violation of section
			 201(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1311">2 U.S.C. 1311(a)(1)</external-xref>);</text>
				</paragraph><paragraph id="HC410313615AB47459300C04795B5AFDC"><enum>(4)</enum><text>the Attorney
			 General shall have the same powers as the Attorney General has to administer
			 and enforce—</text>
					<subparagraph id="H0C5419FDD35C468D98AAA5D9426B6A70"><enum>(A)</enum><text>title VII of the
			 Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>); or</text>
					</subparagraph><subparagraph id="H52792A18B1094F2DB101CF11B7334131"><enum>(B)</enum><text display-inline="yes-display-inline">sections 302 and 304 of the Government
			 Employee Rights Act of 1991 (42 U.S.C. 2000e–16b and 2000e–16c);</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">in the case of a claim alleged by
			 such individual for a violation of such title, or of section 302(a)(1) of the
			 Government Employee Rights Act of 1991 (42 U.S.C. 2000e–16b(a)(1)),
			 respectively;</continuation-text></paragraph><paragraph id="H4D049B6CB7694296888EC35AF5AF47C8"><enum>(5)</enum><text>the President, the
			 Commission, and the Merit Systems Protection Board shall have the same powers
			 as the President, the Commission, and the Board, respectively, have to
			 administer and enforce <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/3/5">chapter 5</external-xref> of title 3, United States Code, in the case of
			 a claim alleged by such individual for a violation of section 411 of such
			 title; and</text>
				</paragraph><paragraph id="H4FF6E20B453A40A6BD5287831654B53A"><enum>(6)</enum><text>a court of the
			 United States shall have the same jurisdiction and powers as the court has to
			 enforce—</text>
					<subparagraph id="H4B2150A9C3FB4FED81A79097908D280F"><enum>(A)</enum><text>title VII of the
			 Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>) in the case of a claim
			 alleged by such individual for a violation of such title;</text>
					</subparagraph><subparagraph id="H8024A31659D84FED84A985370DC57AB7"><enum>(B)</enum><text display-inline="yes-display-inline">sections 302 and 304 of the Government
			 Employee Rights Act of 1991 (42 U.S.C. 2000e–16b and 2000e–16c) in the case of
			 a claim alleged by such individual for a violation of section 302(a)(1) of such
			 Act (42 U.S.C. 2000e–16b(a)(1));</text>
					</subparagraph><subparagraph id="H21EFD5F5D26F4E1387A49897EA030B26"><enum>(C)</enum><text>the Congressional
			 Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301 et seq.</external-xref>) in the case of a claim
			 alleged by such individual for a violation of section 201(a)(1) of such Act (2
			 U.S.C. 1311(a)(1)); and</text>
					</subparagraph><subparagraph id="H24C79CE8FA164F96849D6F007B262A8F"><enum>(D)</enum><text>chapter 5 of title
			 3, United States Code, in the case of a claim alleged by such individual for a
			 violation of section 411 of such title.</text>
					</subparagraph></paragraph></subsection><subsection id="HFD105D579B494213BB72CFE87A5EFB7D"><enum>(b)</enum><header>Procedures and
			 remedies</header><text>The procedures and remedies applicable to a claim
			 alleged by an individual for a violation of this Act are—</text>
				<paragraph id="HA53F5EC089544FD39BDBC3E74E1CD669"><enum>(1)</enum><text>the procedures and
			 remedies applicable for a violation of title VII of the Civil Rights Act of
			 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>) in the case of a claim alleged by such
			 individual for a violation of such title;</text>
				</paragraph><paragraph id="H91A3E3C7AB024854A45EC93B038DCAF3"><enum>(2)</enum><text>the procedures and
			 remedies applicable for a violation of section 302(a)(1) of the Government
			 Employee Rights Act of 1991 (42 U.S.C. 2000e–16b(a)(1)) in the case of a claim
			 alleged by such individual for a violation of such section;</text>
				</paragraph><paragraph id="H8E9DDF49F8F64121B4AA4B41095B52B5"><enum>(3)</enum><text>the procedures and
			 remedies applicable for a violation of section 201(a)(1) of the Congressional
			 Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1311">2 U.S.C. 1311(a)(1)</external-xref>) in the case of a claim alleged
			 by such individual for a violation of such section; and</text>
				</paragraph><paragraph id="H7E5BA09AA7D544828E29092E7A1AAD59"><enum>(4)</enum><text>the procedures and
			 remedies applicable for a violation of <external-xref legal-doc="usc" parsable-cite="usc/3/411">section 411</external-xref> of title 3, United States
			 Code, in the case of a claim alleged by such individual for a violation of such
			 section.</text>
				</paragraph></subsection><subsection id="HAD83E87E893741E3B7F2A0FE01BEEAC5"><enum>(c)</enum><header>Other applicable
			 provisions</header><text>With respect to a claim alleged by a covered employee
			 (as defined in section 101 of the Congressional Accountability Act of 1995 (2
			 U.S.C. 1301)) for a violation of this Act, title III of the Congressional
			 Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1381">2 U.S.C. 1381 et seq.</external-xref>) shall apply in the same
			 manner as such title applies with respect to a claim alleged by such a covered
			 employee for a violation of section 201(a)(1) of such Act (2 U.S.C.
			 1311(a)(1)).</text>
			</subsection></section><section changed="deleted" committee-id="SSHR00" id="H7435C304DDBF4F3293522044D309EF2D" reported-display-style="strikethrough"><enum>11.</enum><header>State and
			 Federal immunity</header>
			<subsection id="HFEFDF64CF1A04350AA8AC8DEDD2A6256"><enum>(a)</enum><header>Abrogation of
			 State immunity</header><text>A State shall not be immune under the 11th
			 Amendment to the Constitution from a suit brought in a Federal court of
			 competent jurisdiction for a violation of this Act.</text>
			</subsection><subsection id="H3D54506AD470447EB60E75FF3B8E3512"><enum>(b)</enum><header>Waiver of State
			 immunity</header>
				<paragraph id="H4180D7FC35FF47C9AAB48D9A3F3E63DD"><enum>(1)</enum><header>In
			 general</header>
					<subparagraph id="H4DC6A70B93FC48F0801690570D3F3D5A"><enum>(A)</enum><header>Waiver</header><text>A
			 State’s receipt or use of Federal financial assistance for any program or
			 activity of a State shall constitute a waiver of sovereign immunity, under the
			 11th Amendment to the Constitution or otherwise, to a suit brought by an
			 employee or applicant for employment of that program or activity under this Act
			 for a remedy authorized under subsection (d).</text>
					</subparagraph><subparagraph id="H833FEFC154034D11897A8263322D8A41"><enum>(B)</enum><header>Definition</header><text>In
			 this paragraph, the term <term>program or activity</term> has the meaning given
			 the term in section 606 of the Civil Rights Act of 1964 (42 U.S.C.
			 2000d–4a).</text>
					</subparagraph></paragraph><paragraph id="H948311429B24491C92D1710833674ED5"><enum>(2)</enum><header>Effective
			 date</header><text>With respect to a particular program or activity, paragraph
			 (1) applies to conduct occurring on or after the day, after the date of
			 enactment of this Act, on which a State first receives or uses Federal
			 financial assistance for that program or activity.</text>
				</paragraph></subsection><subsection id="HCFC757B00837429D8AC42BB52B6758E8"><enum>(c)</enum><header>Remedies Against
			 State Officials</header><text display-inline="yes-display-inline">An official
			 of a State may be sued in the official capacity of the official by any employee
			 or applicant for employment who has complied with the applicable procedures of
			 section 10, for equitable relief that is authorized under this Act. In such a
			 suit the court may award to the prevailing party those costs authorized by
			 section 722 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1988">42 U.S.C. 1988</external-xref>).</text>
			</subsection><subsection id="HA50C4AB69A92419EB53324FDB007F417"><enum>(d)</enum><header>Remedies against
			 the United States and the States</header><text>Notwithstanding any other
			 provision of this Act, in an action or administrative proceeding against the
			 United States or a State for a violation of this Act, remedies (including
			 remedies at law and in equity, and interest) are available for the violation to
			 the same extent as the remedies are available for a violation of title VII of
			 the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>) by a private entity,
			 except that—</text>
				<paragraph id="HAA24FBDD527345F3BA0E1808BBE2514E"><enum>(1)</enum><text>punitive damages
			 are not available; and</text>
				</paragraph><paragraph id="H82475947896F45A9BA5A03F70A1909BD"><enum>(2)</enum><text>compensatory
			 damages are available to the extent specified in section 1977A(b) of the
			 Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1981a">42 U.S.C. 1981a(b)</external-xref>).</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSHR00" id="H257C4B0A5782465E9CAA4BDFF0FCFBC2" reported-display-style="strikethrough"><enum>12.</enum><header>Attorneys’
			 fees</header><text display-inline="no-display-inline">Notwithstanding any other
			 provision of this Act, in an action or administrative proceeding for a
			 violation of this Act, an entity described in section 10(a) (other than
			 paragraph (4) of such section), in the discretion of the entity, may allow the
			 prevailing party, other than the Commission or the United States, a reasonable
			 attorney’s fee (including expert fees) as part of the costs. The Commission and
			 the United States shall be liable for the costs to the same extent as a private
			 person.</text>
		</section><section changed="deleted" committee-id="SSHR00" id="H318C4EC8B6BE4000BF724D54C3C8ED47" reported-display-style="strikethrough"><enum>13.</enum><header>Posting
			 notices</header><text display-inline="no-display-inline">A covered entity who
			 is required to post notices described in section 711 of the Civil Rights Act of
			 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-10">42 U.S.C. 2000e–10</external-xref>) shall post notices for employees, applicants for
			 employment, and members, to whom the provisions specified in section 10(b)
			 apply, that describe the applicable provisions of this Act in the manner
			 prescribed by, and subject to the penalty provided under, section 711 of the
			 Civil Rights Act of 1964.</text>
		</section><section changed="deleted" committee-id="SSHR00" id="HBE3CEF23641F43C2866079161C4C903C" reported-display-style="strikethrough"><enum>14.</enum><header>Regulations</header>
			<subsection id="HF4B29BCAF5C346BDBCF612E4E850B2A2"><enum>(a)</enum><header>In
			 general</header><text>Except as provided in subsections (b), (c), and (d), the
			 Commission shall have authority to issue regulations to carry out this
			 Act.</text>
			</subsection><subsection id="HE3EF846E8D454032BECFAF15F75720D6"><enum>(b)</enum><header>Librarian of
			 Congress</header><text>The Librarian of Congress shall have authority to issue
			 regulations to carry out this Act with respect to employees and applicants for
			 employment of the Library of Congress.</text>
			</subsection><subsection id="H9923156CF2D04F009979AE2A6EE889B1"><enum>(c)</enum><header>Board</header><text>The
			 Board referred to in section 10(a)(3) shall have authority to issue regulations
			 to carry out this Act, in accordance with section 304 of the Congressional
			 Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1384">2 U.S.C. 1384</external-xref>), with respect to covered employees,
			 as defined in section 101 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>).</text>
			</subsection><subsection id="H19C5A3F82BF44B95A8BC52C57C28E2B0"><enum>(d)</enum><header>President</header><text>The
			 President shall have authority to issue regulations to carry out this Act with
			 respect to covered employees, as defined in <external-xref legal-doc="usc" parsable-cite="usc/3/411">section 411(c)</external-xref> of title 3, United
			 States Code, and applicants for employment as such employees.</text>
			</subsection></section><section changed="deleted" committee-id="SSHR00" id="HF01EA14E0FB24FCAA8DD621C5CBDEF58" reported-display-style="strikethrough"><enum>15.</enum><header>Relationship to
			 other laws</header><text display-inline="no-display-inline">This Act shall not
			 invalidate or limit the rights, remedies, or procedures available to an
			 individual claiming discrimination prohibited under any other Federal law or
			 regulation or any law or regulation of a State or political subdivision of a
			 State.</text>
		</section><section changed="deleted" committee-id="SSHR00" id="H9092B10FE2A542FB99AC08EBAEF2AA6F" reported-display-style="strikethrough"><enum>16.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, or the
			 application of the provision to any person or circumstance, is held to be
			 invalid, the remainder of this Act and the application of the provision to any
			 other person or circumstances shall not be affected by the invalidity.</text>
		</section><section changed="deleted" committee-id="SSHR00" id="HB044C1B8ACC34FEEB7A077B5B6DCBE70" reported-display-style="strikethrough"><enum>17.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act shall take
			 effect on the date that is 6 months after the date of enactment of this Act and
			 shall not apply to conduct occurring before the effective date.</text>

	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SSHR00" display-inline="no-display-inline" id="id39e2b89d-b05f-4af1-9df7-09baf49d4333" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Employment Non-Discrimination Act of
			 2013</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSHR00" id="id7efba88b-27a8-442e-96ae-144a65766037" reported-display-style="italic"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph id="id12e7f91e-f9f6-4284-b9d5-607e138e5a5c"><enum>(1)</enum><text display-inline="yes-display-inline">to address the history and persistent,
			 widespread pattern of discrimination, including unconstitutional
			 discrimination, on the bases of sexual orientation and gender identity by
			 private sector employers and local, State, and Federal Government
			 employers;</text>
			</paragraph><paragraph id="idcc533bcf-cd26-4cdb-8562-9e614cb847d9"><enum>(2)</enum><text>to provide an explicit,
			 comprehensive Federal prohibition against employment discrimination on the
			 bases of sexual orientation and gender identity, including meaningful and
			 effective remedies for any such discrimination; and</text>
			</paragraph><paragraph id="id5e4db9d5-2e3f-43d0-992b-43fbe5e2fd29"><enum>(3)</enum><text display-inline="yes-display-inline">to invoke congressional powers, including
			 the powers to enforce the 14th Amendment to the Constitution, and to regulate
			 interstate commerce pursuant to section 8 of article I of the Constitution, in
			 order to prohibit employment discrimination on the bases of sexual orientation
			 and gender identity.</text>
			</paragraph></section><section changed="added" committee-id="SSHR00" id="id80734b50-0387-4ceb-bec2-aa6c602aa997" reported-display-style="italic"><enum>3.</enum><header>Definitions</header>
			<subsection id="id55fe7543-ff66-46e8-9f32-525d96b0e206"><enum>(a)</enum><header>In
			 general</header><text>In this Act:</text>
				<paragraph id="id76f2835b-f260-4355-b352-be84413288e1"><enum>(1)</enum><header>Commission</header><text>The
			 term <term>Commission</term> means the Equal Employment Opportunity
			 Commission.</text>
				</paragraph><paragraph id="id156fb418-9c21-4d20-a23b-f3d0d4e710af"><enum>(2)</enum><header>Covered
			 entity</header><text>The term <term>covered entity</term> means an employer,
			 employment agency, labor organization, or joint labor-management
			 committee.</text>
				</paragraph><paragraph id="idA198ABB90E384562A24B8C6F64CAA1E5"><enum>(3)</enum><header>Demonstrates</header><text>The
			 term <term>demonstrates</term> means meets the burdens of production and
			 persuasion.</text>
				</paragraph><paragraph id="ide396cbfb-2e9c-4437-84a9-cdb24ed69d93"><enum>(4)</enum><header>Employee</header>
					<subparagraph id="id69d9a1a8-5ea6-4232-8fa3-65a683ec7db0"><enum>(A)</enum><header>In
			 general</header><text>The term <term>employee</term> means—</text>
						<clause id="id9dac7bc8-cb4a-46a5-b095-7fc15e7a258a"><enum>(i)</enum><text>an employee as defined in
			 section 701(f) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e(f)</external-xref>);</text>
						</clause><clause id="id5558b867-43ac-4a15-8287-71bb61680cc8"><enum>(ii)</enum><text>a State employee to
			 which section 302(a)(1) of the Government Employee Rights Act of 1991 (42
			 U.S.C. 2000e–16b(a)(1)) applies;</text>
						</clause><clause id="idc1f4b15c-3380-4cce-bff0-031337666c69"><enum>(iii)</enum><text>a covered employee, as
			 defined in section 101 of the Congressional Accountability Act of 1995 (2
			 U.S.C. 1301) or <external-xref legal-doc="usc" parsable-cite="usc/3/411">section 411(c)</external-xref> of title 3, United States Code; or</text>
						</clause><clause id="idc11c3756-b1e6-4186-8929-1165c2a15add"><enum>(iv)</enum><text>an employee or applicant
			 to which section 717(a) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-16">42 U.S.C. 2000e–16(a)</external-xref>)
			 applies.</text>
						</clause></subparagraph><subparagraph id="id29c3fc91-15a5-4ae6-bdd8-f5caa68d90cf"><enum>(B)</enum><header>Exception</header><text>The
			 provisions of this Act that apply to an employee or individual shall not apply
			 to a volunteer who receives no compensation.</text>
					</subparagraph></paragraph><paragraph id="id88636677-96b5-47e0-805c-4a9855fa69b9"><enum>(5)</enum><header>Employer</header><text>The
			 term <term>employer</term> means—</text>
					<subparagraph id="id7b7db5f3-b249-4ffd-bcd9-83a9fc70f659"><enum>(A)</enum><text>a person engaged in an
			 industry affecting commerce (as defined in section 701(h) of the Civil Rights
			 Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e(h)</external-xref>) who has 15 or more employees (as defined in
			 subparagraphs (A)(i) and (B) of paragraph (4)) for each working day in each of
			 20 or more calendar weeks in the current or preceding calendar year, and any
			 agent of such a person, but does not include a bona fide private membership
			 club (other than a labor organization) that is exempt from taxation under
			 <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986;</text>
					</subparagraph><subparagraph id="id5e62f435-43d5-49c3-9fd3-94c8abd2c87d"><enum>(B)</enum><text>an employing authority to
			 which section 302(a)(1) of the Government Employee Rights Act of 1991
			 applies;</text>
					</subparagraph><subparagraph id="id3176380f-8316-4929-95a1-124d9b98bcb7"><enum>(C)</enum><text>an employing office, as
			 defined in section 101 of the Congressional Accountability Act of 1995 or
			 <external-xref legal-doc="usc" parsable-cite="usc/3/411">section 411(c)</external-xref> of title 3, United States Code; or</text>
					</subparagraph><subparagraph id="ida117bf9e-c73b-4ab3-8e34-673f80cc494e"><enum>(D)</enum><text>an entity to which
			 section 717(a) of the Civil Rights Act of 1964 applies.</text>
					</subparagraph></paragraph><paragraph id="id06bca832-6aec-4b83-bcef-77c27dfb4b09"><enum>(6)</enum><header>Employment
			 agency</header><text>The term <term>employment agency</term> has the meaning
			 given the term in section 701(c) of the Civil Rights Act of 1964 (42 U.S.C.
			 2000e(c)).</text>
				</paragraph><paragraph id="ida396a1d3-457f-4759-a56f-2e8ab2571ea5"><enum>(7)</enum><header>Gender
			 identity</header><text>The term <term>gender identity</term> means the
			 gender-related identity, appearance, or mannerisms or other gender-related
			 characteristics of an individual, with or without regard to the individual’s
			 designated sex at birth.</text>
				</paragraph><paragraph id="ida1689e08-4656-4d3d-bb49-809725268d64"><enum>(8)</enum><header>Labor
			 organization</header><text>The term <term>labor organization</term> has the
			 meaning given the term in section 701(d) of the Civil Rights Act of 1964 (42
			 U.S.C. 2000e(d)).</text>
				</paragraph><paragraph id="id17aec5c3-e88f-4c8e-aded-2dd912ecfe62"><enum>(9)</enum><header>Person</header><text>The
			 term <term>person</term> has the meaning given the term in section 701(a) of
			 the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e(a)</external-xref>).</text>
				</paragraph><paragraph id="id6b089215-709e-4e43-b48c-81c8e8de2c1f"><enum>(10)</enum><header>Sexual
			 orientation</header><text>The term <term>sexual orientation</term> means
			 homosexuality, heterosexuality, or bisexuality.</text>
				</paragraph><paragraph id="id65dec02d-a13f-43cd-a7a7-5196760df019"><enum>(11)</enum><header>State</header><text>The
			 term <term>State</term> has the meaning given the term in section 701(i) of the
			 Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e(i)</external-xref>).</text>
				</paragraph></subsection><subsection id="id3421974f-2a49-4e91-b8b9-f696404a2714"><enum>(b)</enum><header>Application of
			 definitions</header><text>For purposes of this section, a reference in section
			 701 of the Civil Rights Act of 1964—</text>
				<paragraph id="ida472c5ad-9eaa-4d19-ba82-e6e25989bd8c"><enum>(1)</enum><text>to an employee or an
			 employer shall be considered to refer to an employee (as defined in subsection
			 (a)(4)) or an employer (as defined in subsection (a)(5)), respectively, except
			 as provided in paragraph (2) of this subsection; and</text>
				</paragraph><paragraph id="idce20bd69-e94e-4814-bf9e-2b3d582d0d1a"><enum>(2)</enum><text>to an employer in
			 subsection (f) of that section shall be considered to refer to an employer (as
			 defined in subsection (a)(5)(A)).</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSHR00" id="idac209b9d-d4ea-465e-94a3-30ebc9e357c3" reported-display-style="italic"><enum>4.</enum><header>Employment
			 discrimination prohibited</header>
			<subsection id="idf6c1020e-e6e9-4af2-a909-bc0cd5a299c9"><enum>(a)</enum><header>Employer
			 practices</header><text>It shall be an unlawful employment practice for an
			 employer—</text>
				<paragraph id="idddcd3cbf-e1d2-4e83-9c2b-f19b0e26971a"><enum>(1)</enum><text display-inline="yes-display-inline">to fail or refuse to hire or to discharge
			 any individual, or otherwise discriminate against any individual with respect
			 to the compensation, terms, conditions, or privileges of employment of the
			 individual, because of such individual’s actual or perceived sexual orientation
			 or gender identity; or</text>
				</paragraph><paragraph id="id472903c1-881f-44c6-8a3b-1e34f18e3624"><enum>(2)</enum><text display-inline="yes-display-inline">to limit, segregate, or classify the
			 employees or applicants for employment of the employer in any way that would
			 deprive or tend to deprive any individual of employment or otherwise adversely
			 affect the status of the individual as an employee, because of such
			 individual’s actual or perceived sexual orientation or gender identity.</text>
				</paragraph></subsection><subsection id="id05c5aeae-35f7-4431-bb9d-26363a50876d"><enum>(b)</enum><header>Employment agency
			 practices</header><text display-inline="yes-display-inline">It shall be an
			 unlawful employment practice for an employment agency to fail or refuse to
			 refer for employment, or otherwise to discriminate against, any individual
			 because of the actual or perceived sexual orientation or gender identity of the
			 individual or to classify or refer for employment any individual on the basis
			 of the actual or perceived sexual orientation or gender identity of the
			 individual.</text>
			</subsection><subsection id="id49b6a21e-8c13-4e09-863c-e514d4e7bc29"><enum>(c)</enum><header>Labor organization
			 practices</header><text>It shall be an unlawful employment practice for a labor
			 organization—</text>
				<paragraph id="id50de94a8-3d72-4e86-8f13-8e11c7649da2"><enum>(1)</enum><text display-inline="yes-display-inline">to exclude or to expel from its membership,
			 or otherwise to discriminate against, any individual because of the actual or
			 perceived sexual orientation or gender identity of the individual;</text>
				</paragraph><paragraph id="id8feee49b-17d6-4b6e-a67e-3a13115078a0"><enum>(2)</enum><text display-inline="yes-display-inline">to limit, segregate, or classify its
			 membership or applicants for membership, or to classify or fail or refuse to
			 refer for employment any individual, in any way that would deprive or tend to
			 deprive any individual of employment, or would limit such employment or
			 otherwise adversely affect the status of the individual as an employee or as an
			 applicant for employment because of such individual’s actual or perceived
			 sexual orientation or gender identity; or</text>
				</paragraph><paragraph id="idd4fbb81c-8bc1-45f9-85a1-75440fb4b99e"><enum>(3)</enum><text>to cause or attempt to
			 cause an employer to discriminate against an individual in violation of this
			 section.</text>
				</paragraph></subsection><subsection id="iddf6960d1-6553-4ad2-b079-6cb56ca0869a"><enum>(d)</enum><header>Training
			 programs</header><text display-inline="yes-display-inline">It shall be an
			 unlawful employment practice for any employer, labor organization, or joint
			 labor-management committee controlling apprenticeship or other training or
			 retraining, including on-the-job training programs, to discriminate against any
			 individual because of the actual or perceived sexual orientation or gender
			 identity of the individual in admission to, or employment in, any program
			 established to provide apprenticeship or other training.</text>
			</subsection><subsection id="id8c94f5fc-a1ff-418e-b0d0-f6e3644103fb"><enum>(e)</enum><header>Association</header><text display-inline="yes-display-inline">An unlawful employment practice described
			 in any of subsections (a) through (d) shall be considered to include an action
			 described in that subsection, taken against an individual based on the actual
			 or perceived sexual orientation or gender identity of a person with whom the
			 individual associates or has associated.</text>
			</subsection><subsection id="ideaf772e8-0439-4dc6-85cd-af161a8367b6"><enum>(f)</enum><header>No preferential
			 treatment or Quotas</header><text>Nothing in this Act shall be construed or
			 interpreted to require or permit—</text>
				<paragraph id="id451560b6-6c6a-452a-aa58-6dd229c93445"><enum>(1)</enum><text display-inline="yes-display-inline">any covered entity to grant preferential
			 treatment to any individual or to any group because of the actual or perceived
			 sexual orientation or gender identity of such individual or group on account of
			 an imbalance which may exist with respect to the total number or percentage of
			 persons of any actual or perceived sexual orientation or gender identity
			 employed by any employer, referred or classified for employment by any
			 employment agency or labor organization, admitted to membership or classified
			 by any labor organization, or admitted to, or employed in, any apprenticeship
			 or other training program, in comparison with the total number or percentage of
			 persons of such actual or perceived sexual orientation or gender identity in
			 any community, State, section, or other area, or in the available work force in
			 any community, State, section, or other area; or</text>
				</paragraph><paragraph id="ida943ede0-9a89-4689-9e92-ac91adeba789"><enum>(2)</enum><text display-inline="yes-display-inline">the adoption or implementation by a covered
			 entity of a quota on the basis of actual or perceived sexual orientation or
			 gender identity.</text>
				</paragraph></subsection><subsection id="id36c58856-bf28-4b1b-a600-5b5aa2ebf1ce"><enum>(g)</enum><header>No disparate impact
			 claims</header><text>Only disparate treatment claims may be brought under this
			 Act.</text>
			</subsection><subsection id="idD1D6A96BE02D4D7F8E748E549FEA78AF"><enum>(h)</enum><header>Standards of
			 proof</header><text>Except as otherwise provided, an unlawful employment
			 practice is established when the complaining party demonstrates that sexual
			 orientation or gender identity was a motivating factor for any employment
			 practice, even though other factors also motivated the practice.</text>
			</subsection></section><section changed="added" committee-id="SSHR00" id="idbfe2123c-8854-47f9-b1e0-6cba94ad9e39" reported-display-style="italic"><enum>5.</enum><header>Retaliation
			 prohibited</header><text display-inline="no-display-inline">It shall be an
			 unlawful employment practice for a covered entity to discriminate against an
			 individual because such individual—</text>
			<paragraph id="id906704f6-fa44-47f3-a681-805a3a048132"><enum>(1)</enum><text display-inline="yes-display-inline">opposed any practice made an unlawful
			 employment practice by this Act; or</text>
			</paragraph><paragraph id="id5d0d57c7-412f-4eb7-bd22-649a49eb94f5"><enum>(2)</enum><text display-inline="yes-display-inline">made a charge, testified, assisted, or
			 participated in any manner in an investigation, proceeding, or hearing under
			 this Act.</text>
			</paragraph></section><section changed="added" committee-id="SSHR00" display-inline="no-display-inline" id="id9a43bb49-15d2-4a92-ab6c-e7278d4ef15e" reported-display-style="italic"><enum>6.</enum><header>Exemption for Religious
			 Organizations</header><text display-inline="no-display-inline">This Act shall
			 not apply to a corporation, association, educational institution or institution
			 of learning, or society that is exempt from the religious discrimination
			 provisions of title VII of the Civil Rights Act of 1964 (42 U.S.C. 2000e et
			 seq.) pursuant to section 702(a) or 703(e)(2) of such Act (42 U.S.C.
			 2000e–1(a), 2000e–2(e)(2)).</text>
		</section><section changed="added" committee-id="SSHR00" id="id5a003fa7-a834-4e54-836d-2bcedda7dce6" reported-display-style="italic"><enum>7.</enum><header>Nonapplication to
			 members of the armed forces; veterans’ preferences</header>
			<subsection id="id8d57c5df-e7ff-414e-a8f2-edc4f2cdee17"><enum>(a)</enum><header>Armed forces</header>
				<paragraph id="id8d37cbfe-5ac2-4468-a96a-68fcfdcf5398"><enum>(1)</enum><header>Employment</header><text>In
			 this Act, the term <term>employment</term> does not apply to the relationship
			 between the United States and members of the Armed Forces.</text>
				</paragraph><paragraph id="idfde75ae2-9256-4011-9f96-47b8757bb265"><enum>(2)</enum><header>Armed
			 forces</header><text>In paragraph (1) the term <term>Armed Forces</term> means
			 the Army, Navy, Air Force, Marine Corps, and Coast Guard.</text>
				</paragraph></subsection><subsection id="idbeb5c61f-a2df-443c-9fb4-c897725e9e14"><enum>(b)</enum><header>Veterans’
			 preferences</header><text>This title does not repeal or modify any Federal,
			 State, territorial, or local law creating a special right or preference
			 concerning employment for a veteran.</text>
			</subsection></section><section changed="added" committee-id="SSHR00" id="idf39739d1-17fa-4d57-9c2a-51706cf9f7f1" reported-display-style="italic"><enum>8.</enum><header>Construction</header>
			<subsection id="id8e081ca1-a43f-46d8-ba3d-4c0dd7e34c18"><enum>(a)</enum><header>Dress or grooming
			 standards</header><text display-inline="yes-display-inline">Nothing in this Act
			 shall prohibit an employer from requiring an employee, during the employee’s
			 hours at work, to adhere to reasonable dress or grooming standards not
			 prohibited by other provisions of Federal, State, or local law, provided that
			 the employer permits any employee who has undergone gender transition prior to
			 the time of employment, and any employee who has notified the employer that the
			 employee has undergone or is undergoing gender transition after the time of
			 employment, to adhere to the same dress or grooming standards as apply for the
			 gender to which the employee has transitioned or is transitioning.</text>
			</subsection><subsection id="id83dc65d3-7b90-4a4a-ab1b-8bbb576291b1"><enum>(b)</enum><header>Additional facilities
			 not required</header><text>Nothing in this Act shall be construed to require
			 the construction of new or additional facilities.</text>
			</subsection></section><section changed="added" committee-id="SSHR00" id="idfc14b485-9fb0-4430-a2fa-4a2d1d4fac74" reported-display-style="italic"><enum>9.</enum><header>Collection of statistics
			 prohibited</header><text display-inline="no-display-inline">The Commission and
			 the Secretary of Labor shall neither compel the collection of nor require the
			 production of statistics on actual or perceived sexual orientation or gender
			 identity from covered entities pursuant to this Act.</text>
		</section><section changed="added" committee-id="SSHR00" id="ide4217ff6-f26d-4db4-967b-23c1d793e48c" reported-display-style="italic"><enum>10.</enum><header>Enforcement</header>
			<subsection id="id6c0f4937-cf75-443f-987c-7d9a20aea267"><enum>(a)</enum><header>Enforcement
			 powers</header><text>With respect to the administration and enforcement of this
			 Act in the case of a claim alleged by an individual for a violation of this
			 Act—</text>
				<paragraph id="id18190987-7f18-43ff-b9d0-b6d2cd316f29"><enum>(1)</enum><text>the Commission shall have
			 the same powers as the Commission has to administer and enforce—</text>
					<subparagraph id="idd93a0cff-c96f-4a8c-bd1d-f634af8a0463"><enum>(A)</enum><text>title VII of the Civil
			 Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>); or</text>
					</subparagraph><subparagraph id="id15056d26-8fd7-4455-be97-edffeeba238b"><enum>(B)</enum><text>sections 302 and 304 of
			 the Government Employee Rights Act of 1991 (42 U.S.C. 2000e–16b and
			 2000e–16c),</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">in
			 the case of a claim alleged by such individual for a violation of such title,
			 or of section 302(a)(1) of the Government Employee Rights Act of 1991 (42
			 U.S.C. 2000e–16b(a)(1)), respectively;</continuation-text></paragraph><paragraph id="idc0e38afc-aa2b-425e-aec5-91e051784e67"><enum>(2)</enum><text>the Librarian of Congress
			 shall have the same powers as the Librarian of Congress has to administer and
			 enforce title VII of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>) in
			 the case of a claim alleged by such individual for a violation of such
			 title;</text>
				</paragraph><paragraph id="idcb8775d1-9d03-4d19-a4c6-5110b9526def"><enum>(3)</enum><text>the Board (as defined in
			 section 101 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>))
			 shall have the same powers as the Board has to administer and enforce the
			 Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301 et seq.</external-xref>) in the case of
			 a claim alleged by such individual for a violation of section 201(a)(1) of such
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1311">2 U.S.C. 1311(a)(1)</external-xref>);</text>
				</paragraph><paragraph id="idd425cb27-d07e-4b59-ae36-40e193fa93e7"><enum>(4)</enum><text>the Attorney General
			 shall have the same powers as the Attorney General has to administer and
			 enforce—</text>
					<subparagraph id="id318382ff-5925-4b3a-b292-3a26a5face7f"><enum>(A)</enum><text>title VII of the Civil
			 Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>); or</text>
					</subparagraph><subparagraph id="idd57f0567-f622-4c39-98de-0fb700bcbb33"><enum>(B)</enum><text display-inline="yes-display-inline">sections 302 and 304 of the Government
			 Employee Rights Act of 1991 (42 U.S.C. 2000e–16b and 2000e–16c);</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">in
			 the case of a claim alleged by such individual for a violation of such title,
			 or of section 302(a)(1) of the Government Employee Rights Act of 1991 (42
			 U.S.C. 2000e–16b(a)(1)), respectively;</continuation-text></paragraph><paragraph id="iddd6293c9-a5e5-4ef0-a369-b64fe779b398"><enum>(5)</enum><text>the President, the
			 Commission, and the Merit Systems Protection Board shall have the same powers
			 as the President, the Commission, and the Board, respectively, have to
			 administer and enforce <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/3/5">chapter 5</external-xref> of title 3, United States Code, in the case of
			 a claim alleged by such individual for a violation of section 411 of such
			 title; and</text>
				</paragraph><paragraph id="id0204d328-fb33-4a80-8f6a-04d84a39b824"><enum>(6)</enum><text>a court of the United
			 States shall have the same jurisdiction and powers as the court has to
			 enforce—</text>
					<subparagraph id="id6b6435f7-158e-43e6-8c42-e9dd8c1345b1"><enum>(A)</enum><text>title VII of the Civil
			 Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>) in the case of a claim alleged by
			 such individual for a violation of such title;</text>
					</subparagraph><subparagraph id="idcc3cdf24-ca21-4a94-b4da-b278b8b0b757"><enum>(B)</enum><text display-inline="yes-display-inline">sections 302 and 304 of the Government
			 Employee Rights Act of 1991 (42 U.S.C. 2000e–16b and 2000e–16c) in the case of
			 a claim alleged by such individual for a violation of section 302(a)(1) of such
			 Act (42 U.S.C. 2000e–16b(a)(1));</text>
					</subparagraph><subparagraph id="id663df935-0460-435b-a1c8-51e8e9443426"><enum>(C)</enum><text>the Congressional
			 Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301 et seq.</external-xref>) in the case of a claim
			 alleged by such individual for a violation of section 201(a)(1) of such Act (2
			 U.S.C. 1311(a)(1)); and</text>
					</subparagraph><subparagraph id="id0d2df0ad-c436-401e-ae05-3def50636a91"><enum>(D)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/3/5">chapter 5</external-xref> of title 3,
			 United States Code, in the case of a claim alleged by such individual for a
			 violation of section 411 of such title.</text>
					</subparagraph></paragraph></subsection><subsection id="id7568ab24-de3a-4e83-a329-6ee8043c38be"><enum>(b)</enum><header>Procedures and
			 remedies</header><text>Except as provided in section 4(g), the procedures and
			 remedies applicable to a claim alleged by an individual for a violation of this
			 Act are—</text>
				<paragraph id="id5e48f37b-0ea3-418a-a23c-0410cca8efbf"><enum>(1)</enum><text>the procedures and
			 remedies applicable for a violation of title VII of the Civil Rights Act of
			 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>) in the case of a claim alleged by such
			 individual for a violation of such title;</text>
				</paragraph><paragraph id="idaead21c3-d91a-4006-9f68-dc4d3ca355ed"><enum>(2)</enum><text>the procedures and
			 remedies applicable for a violation of section 302(a)(1) of the Government
			 Employee Rights Act of 1991 (42 U.S.C. 2000e–16b(a)(1)) in the case of a claim
			 alleged by such individual for a violation of such section;</text>
				</paragraph><paragraph id="id2a6745e9-944a-4e41-9cad-ee16bf0c233e"><enum>(3)</enum><text>the procedures and
			 remedies applicable for a violation of section 201(a)(1) of the Congressional
			 Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1311">2 U.S.C. 1311(a)(1)</external-xref>) in the case of a claim alleged
			 by such individual for a violation of such section; and</text>
				</paragraph><paragraph id="id29f6836c-d201-4d4e-8f00-6d79505f2a17"><enum>(4)</enum><text>the procedures and
			 remedies applicable for a violation of <external-xref legal-doc="usc" parsable-cite="usc/3/411">section 411</external-xref> of title 3, United States
			 Code, in the case of a claim alleged by such individual for a violation of such
			 section.</text>
				</paragraph></subsection><subsection id="id3a1d499f-801c-4f8d-8e3b-40d3533c060d"><enum>(c)</enum><header>Other applicable
			 provisions</header><text>With respect to a claim alleged by a covered employee
			 (as defined in section 101 of the Congressional Accountability Act of 1995 (2
			 U.S.C. 1301)) for a violation of this Act, title III of the Congressional
			 Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1381">2 U.S.C. 1381 et seq.</external-xref>) shall apply in the same
			 manner as such title applies with respect to a claim alleged by such a covered
			 employee for a violation of section 201(a)(1) of such Act (2 U.S.C.
			 1311(a)(1)).</text>
			</subsection><subsection commented="no" id="idC08732143FD341AAAE53CFA98E736DF5"><enum>(d)</enum><header>No double
			 recovery</header><text>An individual who files claims alleging that a practice
			 is an unlawful employment practice under this Act and an unlawful employment
			 practice because of sex under title VII of the Civil Rights Act of 1964 (42
			 U.S.C. 2000e et seq.) shall not be permitted to recover damages for such
			 practice under both of—</text>
				<paragraph commented="no" id="id76DE9C0C24D84FC8A8D66B5B63418B5E"><enum>(1)</enum><text>this Act; and</text>
				</paragraph><paragraph commented="no" id="id1A32AF4818BD4EE4932606B7643E4711"><enum>(2)</enum><text>section 1977A of the
			 Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1981a">42 U.S.C. 1981a</external-xref>) and title VII of the Civil Rights Act of
			 1964.</text>
				</paragraph></subsection><subsection id="id840D172027D54C59A14C9CBCEB4C5B64"><enum>(e)</enum><header>Motivating factor
			 decisions</header><text>On a claim in which an individual proved a violation
			 under section 4(h) and a respondent demonstrates that the respondent would have
			 taken the same action in the absence of the impermissible motivating factor,
			 the court—</text>
				<paragraph id="id1e45c69f46724671a11052297bbb88d1"><enum>(1)</enum><text>may grant declaratory
			 relief, injunctive relief (except as provided in paragraph (2)), and attorney's
			 fees and costs demonstrated to be directly attributable only to the pursuit of
			 a claim under section 4(h); and</text>
				</paragraph><paragraph id="id4c8d6d6d82e4426da178c38404232cf6"><enum>(2)</enum><text>shall not award damages
			 or issue an order requiring any admission, reinstatement, hiring, promotion, or
			 payment.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSHR00" id="idea74952c-91e9-4fcb-bbac-6b975c66c057" reported-display-style="italic"><enum>11.</enum><header>State and Federal
			 immunity</header>
			<subsection id="id06d18dd0-7c6b-4dbc-8f12-cb72d217b069"><enum>(a)</enum><header>Abrogation of State
			 immunity</header><text>A State shall not be immune under the 11th Amendment to
			 the Constitution from a suit brought in a Federal court of competent
			 jurisdiction for a violation of this Act.</text>
			</subsection><subsection id="id4ed15894-9d64-491e-88fd-08ac76032d59"><enum>(b)</enum><header>Waiver of State
			 immunity</header>
				<paragraph id="id82502c13-3dfe-419a-b780-bced0f3adb48"><enum>(1)</enum><header>In general</header>
					<subparagraph id="id17f3e37d-9503-4df7-b2ec-70b8492d81ed"><enum>(A)</enum><header>Waiver</header><text>A
			 State’s receipt or use of Federal financial assistance for any program or
			 activity of a State shall constitute a waiver of sovereign immunity, under the
			 11th Amendment to the Constitution or otherwise, to a suit brought by an
			 employee or applicant for employment of that program or activity under this Act
			 for a remedy authorized under subsection (d).</text>
					</subparagraph><subparagraph id="id1d7c0715-1d11-48a0-8e3a-82f9f3b676a0"><enum>(B)</enum><header>Definition</header><text>In
			 this paragraph, the term <term>program or activity</term> has the meaning given
			 the term in section 606 of the Civil Rights Act of 1964 (42 U.S.C.
			 2000d–4a).</text>
					</subparagraph></paragraph><paragraph id="idd01b06b3-80c6-4b65-b988-540f0997daf3"><enum>(2)</enum><header>Effective
			 date</header><text>With respect to a particular program or activity, paragraph
			 (1) applies to conduct occurring on or after the day, after the date of
			 enactment of this Act, on which a State first receives or uses Federal
			 financial assistance for that program or activity.</text>
				</paragraph></subsection><subsection id="ida3084240-5a39-47d2-b407-3eb943fb7c36"><enum>(c)</enum><header>Remedies Against State
			 Officials</header><text display-inline="yes-display-inline">An official of a
			 State may be sued in the official capacity of the official by any employee or
			 applicant for employment who has complied with the applicable procedures of
			 section 10, for equitable relief that is authorized under this Act. In such a
			 suit the court may award to the prevailing party those costs authorized by
			 section 722 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1988">42 U.S.C. 1988</external-xref>).</text>
			</subsection><subsection id="id23d2ad7e-eac0-4e45-8b0f-bd4eb65e9d01"><enum>(d)</enum><header>Remedies against the
			 United States and the States</header><text>Notwithstanding any other provision
			 of this Act, in an action or administrative proceeding against the United
			 States or a State for a violation of this Act, remedies (including remedies at
			 law and in equity, and interest) are available for the violation to the same
			 extent as the remedies are available for a violation of title VII of the Civil
			 Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>) by a private entity, except
			 that—</text>
				<paragraph id="idab8e345c-db6b-46c7-ada3-1b15f2d28cc0"><enum>(1)</enum><text>punitive damages are not
			 available; and</text>
				</paragraph><paragraph id="idefa5d4e5-09c2-4263-8554-b26c170186b4"><enum>(2)</enum><text>compensatory damages are
			 available to the extent specified in section 1977A(b) of the Revised Statutes
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1981a">42 U.S.C. 1981a(b)</external-xref>).</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSHR00" id="idFB88A77EC32F4A0F843D469F14918F27" reported-display-style="italic"><enum>12.</enum><header>Attorneys’
			 fees</header>
			<subsection id="id3F0DDC3C66D0465490E4FE38ED26F151"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this section, the term
			 <quote>decisionmaker</quote> means an entity described in section 10(a) (other
			 than paragraph (4) of such section), acting in the discretion of the
			 entity.</text>
			</subsection><subsection id="id62D27212CFF84D2CA31D9268BFB445BD"><enum>(b)</enum><header>Authority</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
			 Act, in an action or administrative proceeding for a violation of this Act, a
			 decisionmaker may allow the prevailing party, other than the Commission or the
			 United States, a reasonable attorney’s fee (including expert fees) as part of
			 the costs, to the same extent as is permitted under title VII of the Civil
			 Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>), sections 302 and 304 of the
			 Government Employee Rights Act of 1991 (42 U.S.C. 2000e–16b and 2000e–16c), the
			 Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301 et seq.</external-xref>), or chapter 5
			 of title 3, United States Code, whichever applies to the prevailing party in
			 that action or proceeding. The Commission and the United States shall be liable
			 for the costs to the same extent as a private person.</text>
			</subsection></section><section changed="added" committee-id="SSHR00" id="id00a4f713-a294-4a17-8baf-c07f325945f5" reported-display-style="italic"><enum>13.</enum><header>Posting
			 notices</header><text display-inline="no-display-inline">A covered entity who
			 is required to post a notice described in section 711 of the Civil Rights Act
			 of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-10">42 U.S.C. 2000e–10</external-xref>) may be required to post an amended notice,
			 including a description of the applicable provisions of this Act, in the manner
			 prescribed by, and subject to the penalty provided under, section 711 of the
			 Civil Rights Act of 1964. Nothing in this Act shall be construed to require a
			 separate notice to be posted.</text>
		</section><section changed="added" committee-id="SSHR00" id="idbd3b5224-449f-48dd-ab4f-77384f996773" reported-display-style="italic"><enum>14.</enum><header>Regulations</header>
			<subsection id="id74ee4632-9481-4818-8329-3b4f06022fc8"><enum>(a)</enum><header>In
			 general</header><text>Except as provided in subsections (b), (c), and (d), the
			 Commission shall have authority to issue regulations to carry out this
			 Act.</text>
			</subsection><subsection id="id02fd56fb-e717-45ad-b7f0-3c18d1b60829"><enum>(b)</enum><header>Librarian of
			 Congress</header><text>The Librarian of Congress shall have authority to issue
			 regulations to carry out this Act with respect to employees and applicants for
			 employment of the Library of Congress.</text>
			</subsection><subsection id="id1685f0af-068d-4ea3-86ac-bd808f5c47c2"><enum>(c)</enum><header>Board</header><text>The
			 Board referred to in section 10(a)(3) shall have authority to issue regulations
			 to carry out this Act, in accordance with section 304 of the Congressional
			 Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1384">2 U.S.C. 1384</external-xref>), with respect to covered employees,
			 as defined in section 101 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>).</text>
			</subsection><subsection id="id900ac538-2fe5-4046-8c05-05a9fb439991"><enum>(d)</enum><header>President</header><text>The
			 President shall have authority to issue regulations to carry out this Act with
			 respect to covered employees, as defined in <external-xref legal-doc="usc" parsable-cite="usc/3/411">section 411(c)</external-xref> of title 3, United
			 States Code, and applicants for employment as such employees.</text>
			</subsection></section><section changed="added" committee-id="SSHR00" id="id0f54a2e4-a23d-412d-a86a-26e50ed9a8ae" reported-display-style="italic"><enum>15.</enum><header>Relationship to other
			 laws</header><text display-inline="no-display-inline">This Act shall not
			 invalidate or limit the rights, remedies, or procedures available to an
			 individual claiming discrimination prohibited under any other Federal law or
			 regulation or any law or regulation of a State or political subdivision of a
			 State.</text>
		</section><section changed="added" committee-id="SSHR00" id="id3c401614-8e34-49b8-865c-ff111f70e195" reported-display-style="italic"><enum>16.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, or the
			 application of the provision to any person or circumstance, is held to be
			 invalid, the remainder of this Act and the application of the provision to any
			 other person or circumstances shall not be affected by the invalidity.</text>
		</section><section changed="added" committee-id="SSHR00" id="id254d9b8a-83e6-4c4d-9660-7600be183c36" reported-display-style="italic"><enum>17.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act shall take
			 effect on the date that is 6 months after the date of enactment of this Act and
			 shall not apply to conduct occurring before the effective date.</text>
