		<section id="idC0B84F38FBC6418DACA1A519C75BFB40" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Explosive Materials Background Check
			 Act</short-title></quote>.</text>
		</section><section id="idD0ABBD29AA0A431E93A92FA0706B303E"><enum>2.</enum><header>Explosive
			 materials background checks</header>
			<subsection id="id6494AEC4601B455E86C016C85360A47E"><enum>(a)</enum><header>Amendments to
			 title 18</header><text display-inline="yes-display-inline">Chapter 40 of title
			 18, United States Code, is amended—</text>
				<paragraph id="id8D9A21C2D6C647E09025F11832FAD1BA"><enum>(1)</enum><text>in section
			 841—</text>
					<subparagraph id="id4AD186CDF43E4DEEB6076DA860BF4F0B"><enum>(A)</enum><text>in subsection
			 (d), by inserting <quote>smokeless powder and black powder substitutes,</quote>
			 after <quote>black powder,</quote>; and</text>
					</subparagraph><subparagraph id="id5B3A255EDB3F4E3193E11676051C2D98"><enum>(B)</enum><text>in subsection
			 (h), by striking <quote>the business of</quote>;</text>
					</subparagraph></paragraph><paragraph id="id0E6A31202B564F4C92DACAEFB57FF244"><enum>(2)</enum><text>in section
			 842—</text>
					<subparagraph id="id31D5FB4BB3194D9C9A216604A15F3AA0"><enum>(A)</enum><text>in subsection
			 (d)—</text>
						<clause id="idBBAB90AB841145E7AA6E721BA805296E"><enum>(i)</enum><text>in
			 paragraph (9), by striking the period and inserting a semicolon; and</text>
						</clause><clause id="idA7409E2B2F194C04A7516B35FA03EBBA"><enum>(ii)</enum><text>inserting at the
			 end the following:</text>
							<quoted-block display-inline="no-display-inline" id="idD87ADEE88F264DDAA210D0D537BDBA1D" style="OLC">
								<paragraph id="id2C4C4DD01FFD4486A7AC4B5DE8156074"><enum>(10)</enum><text>is subject to a
				court order that restrains such person from harassing, stalking, or threatening
				an intimate partner of such person or child of such intimate partner or person,
				or engaging in other conduct that would place an intimate partner in reasonable
				fear of bodily injury to the partner or child, except that this paragraph shall
				only apply to a court order that—</text>
									<subparagraph id="idC8CEFE51B1E34D8CA4B6EA8C11431AB7"><enum>(A)</enum><text>was issued after
				a hearing of which such person received actual notice, and at which such person
				had the opportunity to participate; and</text>
									</subparagraph><subparagraph id="idE2B1F9DBC1D445C9BCBE18ED84DF7A9E"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idEB22CA543D064866B2D6D3F8483430AA"><enum>(i)</enum><text>includes a finding that
				such person represents a credible threat to the physical safety of such
				intimate partner or child; or</text>
										</clause><clause id="id5CA67041D7604F9D9107CCD2AC440716" indent="up1"><enum>(ii)</enum><text>by its terms explicitly prohibits
				the use, attempted use, or threatened use of physical force against such
				intimate partner or child that would reasonably be expected to cause bodily
				injury;</text>
										</clause></subparagraph></paragraph><paragraph id="id20788715DEBD4CD78EF72772643E0E02"><enum>(11)</enum><text>has been
				convicted in any court of a misdemeanor crime of domestic violence; or</text>
								</paragraph><paragraph id="id30B661D527B247C680B7DD1A54D64D75"><enum>(12)</enum><text>has received
				actual notice of the Attorney General's determination made pursuant to
				subsection (d)(1)(B) or (j) of section 843 of this
				title.</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="id10291A3BF0CD4F8F8468D3E23E414605"><enum>(B)</enum><text>in subsection
			 (i)—</text>
						<clause id="id864A4C209370416FBD2AC123307C7B08"><enum>(i)</enum><text>in
			 paragraph (7), by inserting a semicolon after <quote>person</quote>;</text>
						</clause><clause id="idB510835B988C4FC4989185CEA1F95F7B"><enum>(ii)</enum><text>inserting at the
			 end the following:</text>
							<quoted-block display-inline="no-display-inline" id="idD8DC8446913143EA93C61B7D89845023" style="OLC">
								<paragraph id="idEC141205DC8E4BEE9F3CFFAF574EA103"><enum>(8)</enum><text>is subject to a
				court order that restrains such person from harassing, stalking, or threatening
				an intimate partner of such person or child of such intimate partner or person,
				or engaging in other conduct that would place an intimate partner in reasonable
				fear of bodily injury to the partner or child, except that this paragraph shall
				only apply to a court order that—</text>
									<subparagraph id="id43322FEEF2EB4726810D8EF20724968D"><enum>(A)</enum><text>was issued after
				a hearing of which such person received actual notice, and at which such person
				had the opportunity to participate; and</text>
									</subparagraph><subparagraph id="id31EDEF823DD44F46BCF8C4D5480EF324"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idE274B300DC5B4500996DD41360B85D5E"><enum>(i)</enum><text>includes a finding that
				such person represents a credible threat to the physical safety of such
				intimate partner or child; or</text>
										</clause><clause id="id718B27CC2EA043178062B3CE56B852B8" indent="up1"><enum>(ii)</enum><text>by its terms explicitly prohibits
				the use, attempted use, or threatened use of physical force against such
				intimate partner or child that would reasonably be expected to cause bodily
				injury;</text>
										</clause></subparagraph></paragraph><paragraph id="id4DCF6FB73F3F477593541439F41A81A6"><enum>(9)</enum><text>has been
				convicted in any court of a misdemeanor crime of domestic violence; or</text>
								</paragraph><paragraph id="idD55BC77A89F04D6B9734B56F8AB37E9C"><enum>(10)</enum><text>has received
				actual notice of the Attorney General's determination made pursuant to
				subsection (d)(1)(B) or (j) of section 843 of this
				title.</text>
								</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph><paragraph id="idE26D604FA02B4998BA07A40553C8CA76"><enum>(3)</enum><text>in section
			 843—</text>
					<subparagraph id="id297C88BDA54847B2B6F2821AF6785BB4"><enum>(A)</enum><text>in subsection
			 (b)—</text>
						<clause id="idE7CAD9CFDBAB465785521439972A1E37"><enum>(i)</enum><text>by
			 striking <quote>Upon</quote> and inserting <quote>Except as provided in
			 subsection (j), upon</quote>;</text>
						</clause><clause id="id67DE75158F8A4E34B7D2DDC16CA4E12F"><enum>(ii)</enum><text>in
			 paragraph (6), by striking <quote>and</quote> after the semicolon;</text>
						</clause><clause id="id96FFCDAA7A8842689ABB9E744AF62610"><enum>(iii)</enum><text>in paragraph
			 (7), by striking the period and inserting <quote>; and</quote>; and</text>
						</clause><clause id="id016E471E09994B5380B5CAA5C57A8786"><enum>(iv)</enum><text>by
			 inserting at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="idC4CBCFE4AF9D42A6BE32CB6CECD62C54" style="OLC">
								<paragraph id="id56434B367E2F498D96A1A9BEAAFBEDDC"><enum>(8)</enum><text>in the case of a
				limited permit holder, the applicant certifies the permit will only be used to
				purchase black powder, black powder substitute, and smokeless powder in which
				case the limitation in paragraph (7) shall not
				apply.</text>
								</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="idD2F56A9A067343D5BE037499168FE642"><enum>(B)</enum><text>in subsection
			 (d)—</text>
						<clause id="id43799BD2FE13426B95811C14C3005E5F"><enum>(i)</enum><text>by
			 inserting <quote>(1)</quote> after <quote>(d)</quote>;</text>
						</clause><clause id="id3F698F0ADE9B4C43B8DD9A4556E153B5"><enum>(ii)</enum><text>by
			 striking <quote>if in the opinion</quote> and inserting the following:
			 “if—</text>
						</clause></subparagraph><subparagraph id="idB211B5B653024964945FFC1E47A34EE3"><enum>“(A)</enum><text>in the opinion”;
			 and</text>
						<clause id="id734720142F8D4E6DBECC3A3698CCEC33"><enum>(iii)</enum><text>by striking
			 <quote>. The Secretary's action</quote> and inserting the following: “;
			 or</text>
							<quoted-block display-inline="no-display-inline" id="id53A4CBD91B0B45ED8078EC16F95E9071" style="OLC">
								<subparagraph id="id00BC306655C94E12AE34607A242C3651"><enum>(B)</enum><text>the Attorney
				General determines that the licensee or holder (or any responsible person or
				employee possessor thereof) is known (or appropriately suspected) to be or have
				been engaged in conduct constituting, in preparation for, in aid of, or related
				to terrorism, or providing material support or resources for terrorism, and
				that the Attorney General has a reasonable belief that the person may use
				explosives in connection with terrorism.</text>
								</subparagraph><paragraph id="id9520B88A9DBD47DAAE95AE3B9BAEBC06"><enum>(2)</enum><text>The Attorney
				General's action</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="idBC0394A0E9D8469BB5FD1DF7D7450A21"><enum>(C)</enum><text>in subsection
			 (e)—</text>
						<clause id="idAEF6AB2E8E68464B99615B6669B84020"><enum>(i)</enum><text>in
			 paragraph (1), by inserting after the first sentence the following:
			 <quote>However, if the denial or revocation is based upon an Attorney General
			 determination under subsection (j) or (d)(1)(B), any information which the
			 Attorney General relied on for this determination may be withheld from the
			 petitioner if the Attorney General determines that disclosure of the
			 information would likely compromise national security.</quote>; and</text>
						</clause><clause id="idC43289EF207F41A88A8C6CA62245A837"><enum>(ii)</enum><text>in
			 paragraph (2), by adding at the end the following: <quote>In responding to any
			 petition for review of a denial or revocation based upon an Attorney General
			 determination under subsection (j) or (d)(1)(B), the United States may submit,
			 and the court may rely upon, summaries or redacted versions of documents
			 containing information the disclosure of which the Attorney General has
			 determined would likely compromise national security.</quote>;</text>
						</clause></subparagraph><subparagraph id="idB2A17FC5668D4897975B389278C8C80A"><enum>(D)</enum><text>in subsection
			 (h)(2)—</text>
						<clause id="id29735B9CBE2045218373D1CAA2089C79"><enum>(i)</enum><text>in
			 subparagraph (A), by inserting <quote>or in subsection (j) of this section (on
			 grounds of terrorism)</quote> after <quote>section 842(i)</quote>; and</text>
						</clause><clause id="idE7B6803AA975466CAF8A472456EEC247"><enum>(ii)</enum><text>in
			 subparagraph (B)—</text>
							<subclause id="id8D4B43C438D941669ADE9A30846BA415"><enum>(I)</enum><text>in the matter
			 preceding clause (i), by inserting <quote>or in subsection (j) of this
			 section,</quote> after <quote>section 842(i),</quote>; and</text>
							</subclause><subclause id="id7645A12FBAB54A4995DEFC460A15FDAE"><enum>(II)</enum><text>in clause (ii),
			 by inserting <quote>, except that any information that the Attorney General
			 relied on for a determination pursuant to subsection (j) may be withheld if the
			 Attorney General concludes that disclosure of the information would likely
			 compromise national security</quote> after <quote>determination</quote> ;
			 and</text>
							</subclause></clause></subparagraph><subparagraph id="idB9D679CD3AA349D395863C7528FF54C9"><enum>(E)</enum><text>by inserting at
			 the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idCC100C77FC474A758ED8A46E89F7C345" style="OLC">
							<subsection id="id3C00A062D59A404BB52620898B88A8F9"><enum>(j)</enum><header>Attorney
				General discretionary denial of Federal explosives licenses and
				permits</header><text>The Attorney General may deny the issuance of a permit or
				license to an applicant if the Attorney General determines that the applicant
				or a responsible person or employee possessor thereof is known (or
				appropriately suspected) to be or have been engaged in conduct constituting, in
				preparation of, in aid of, or related to terrorism, or providing material
				support or resources for terrorism, and the Attorney General has a reasonable
				belief that the person may use explosives in connection with
				terrorism.</text>
							</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="id01E04DA0F8EF44B1B55A8D27C1EAE7EE"><enum>(4)</enum><text>in section
			 845(a)—</text>
					<subparagraph id="id9E336F0A64914C50A51F38CA3EA88778"><enum>(A)</enum><text>in paragraph (4),
			 by inserting after <quote>and components thereof</quote> the following:
			 <quote>, except for smokeless powder and black powder substitutes</quote>;
			 and</text>
					</subparagraph><subparagraph id="id72563123D9B34A0B91DA363752F73833"><enum>(B)</enum><text>in paragraph (5),
			 by striking <quote>black powder in quantities not to exceed fifty
			 pounds,</quote>.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2A7628B683764091A15654E945C55C97"><enum>(b)</enum><header>Guidelines</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id2494CF0D974349F58CBB368C72E72E28"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General shall issue guidelines describing
			 the circumstances under which the Attorney General will exercise the authority
			 and make determinations under subsections (d)(1)(B) and (j) of section 843 of
			 title 18, United States Code, as amended by this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2DD44816BEAC471DA1F1558D86968783"><enum>(2)</enum><header>Contents</header><text>The
			 guidelines issued under paragraph (1) shall—</text>
					<subparagraph id="IDbcfe7a2577ca433dba0ae11f5d9618a0"><enum>(A)</enum><text>provide
			 accountability and a basis for monitoring to ensure that the intended goals
			 for, and expected results of, the grant of authority under subsections
			 (d)(1)(B) and (j) of <external-xref legal-doc="usc" parsable-cite="usc/18/843">section 843</external-xref> of title 18, United States Code, as amended by
			 this Act, are being achieved; and</text>
					</subparagraph><subparagraph id="ID4077bb23bc374421bf8b065665a140fe"><enum>(B)</enum><text>ensure that
			 terrorist watch list records are used in a manner that safeguards privacy and
			 civil liberties protections, in accordance with requirements outlines in
			 Homeland Security Presidential Directive 11 (dated August 27, 2004).</text>
					</subparagraph></paragraph></subsection></section></legis-body>
