		<official-title>To amend title 35, United States Code, to provide for an
		  exception from infringement for certain component parts of motor
		  vehicles.</official-title>

		<section id="H9520B4FC6940423990436077C5A4BB14" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Promoting Automotive Repair, Trade,
			 and Sales Act of 2013</short-title></quote> or the <quote><short-title>PARTS Act</short-title></quote>.</text>
		</section><section id="H9D5BE3EC9BC8490F9994F34DA3101B12"><enum>2.</enum><header>Exception from
			 infringement for certain component parts of motor vehicles</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/35/271">Section 271</external-xref> of title 35, United States Code,
			 is amended by adding at the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H6B965073498746CA90741BC7B062408B" style="OLC">
				<subsection id="H4303EBEE9C0D45F9B9C4011C792200D4"><enum>(j)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H044FA9B4009142289E79FEBB1C02F38E"><enum>(1)</enum><text display-inline="yes-display-inline">With respect to a design patent that claims
				a component part of a motor vehicle as originally manufactured—</text>
						<subparagraph id="H9676001D37594E858E263FB1143C598D" indent="up1"><enum>(A)</enum><text>it shall not be an act of infringement
				of such design patent to make or offer to sell within the United States, or
				import into the United States, any article of manufacture that is similar or
				the same in appearance to the component part that is claimed in such design
				patent if the purpose of such article of manufacture is for the repair of a
				motor vehicle so as to restore such vehicle to its appearance as originally
				manufactured; and</text>
						</subparagraph><subparagraph id="HE4978590C18147ADABF4A124E41511F7" indent="up1"><enum>(B)</enum><text>after the expiration of a period of 30
				months beginning on the first day on which any such component part is first
				offered to the public for sale as part of a motor vehicle in any country, it
				shall not be an act of infringement of such design patent to use or sell within
				the United States any article of manufacture that is similar or the same in
				appearance to the component part that is claimed in such design patent if the
				purpose of such article of manufacture is for the repair of a motor vehicle so
				as to restore such vehicle to its appearance as originally manufactured.</text>
						</subparagraph></paragraph><paragraph id="HEFAAF7C2C40C4A82B562363A7677DE86" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of this subsection—</text>
						<subparagraph id="HE45D824C0F5049D78988EB3AEDFDAADE"><enum>(A)</enum><text>the term <quote>component
				part</quote>—</text>
							<clause id="id6560FFB8FE5643F4887ACCAC046D1A20"><enum>(i)</enum><text>means a component part of the
				exterior of a motor vehicle only, such as a hood, fender, tail light, side
				mirror, or quarter panel; and</text>
							</clause><clause id="idA3F84FDE572C485AB6795894C571B963"><enum>(ii)</enum><text>does not include an inflatable
				restraint system or other component part located in the interior of a motor
				vehicle;</text>
							</clause></subparagraph><subparagraph id="idF1CB7FDA7F23418A9F395796A0B33760"><enum>(B)</enum><text>the term <term>motor vehicle</term>
				has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/49/32101">section 32101(7)</external-xref> of title 49;</text>
						</subparagraph><subparagraph id="H38E56591C19D488D96F69B00AF6F220C"><enum>(C)</enum><text display-inline="yes-display-inline">the term <term>make</term> includes any
				testing of an article of manufacture; and</text>
						</subparagraph><subparagraph id="HC3432474C11648C783C6BEB9AF5747AD"><enum>(D)</enum><text display-inline="yes-display-inline">the term <term>offer to sell</term>
				includes any marketing of an article of manufacture to prospective purchasers
				or users and any pre-sale distribution of the article of
				manufacture.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" id="H2D5636C2DB8F4C25BCB603DECACEB130"><enum>3.</enum><header>Conforming
			 amendment</header><text display-inline="no-display-inline">Section 289 of title
			 35, United States Code, is amended—</text>
			<paragraph id="H5494722AFA694F8FA037F8D7B7AED1CD"><enum>(1)</enum><text>in the first
			 paragraph, by striking <quote>Whoever</quote> and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H3B087B589B9C41CFB4E2FA5FE8D9B135" style="OLC">
					<subsection id="H4E2DBAE197194BE5B80565CAE95E554B"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Whoever</text>
					</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H482AA34526F848F596BE53F08A85DB25"><enum>(2)</enum><text>in the second
			 paragraph, by striking <quote>Nothing</quote> and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H8AB6B61D352041D5A651A37898DEC7A9" style="OLC">
					<subsection id="H7545FAFE3001496AB145CBEFC7ACCCC4"><enum>(c)</enum><header>Relationship to
				other remedies</header><text display-inline="yes-display-inline">Nothing</text>
					</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H61AAF6B294BC46E69AEAA66A85062304"><enum>(3)</enum><text>by inserting after
			 subsection (a), as designated by paragraph (1), the following:</text>
				<quoted-block display-inline="no-display-inline" id="H6FC1B1DFB28F484D8DA052F96F3438CB" style="OLC">
					<subsection id="H309BA12A98DA40589CA627332AF07E21"><enum>(b)</enum><header>Inapplicability</header><text display-inline="yes-display-inline">This section shall not apply to an act
				described in paragraph (1) or (2) of subsection (a) if that act would not be
				considered an act of infringement under section
				271(j)</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H00A283E6FD514333B93A9E437F080FB0"><enum>4.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall take effect upon the expiration of the 90-day period beginning
			 on the date of the enactment of this Act and shall apply to any patent issued,
			 or application for patent filed, before, on, or after that effective
			 date.</text>
