		  prevent the abuse of dextromethorphan, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Preventing Abuse of Cough
			 Treatments Act of 2013</short-title></quote> or the <quote><short-title>PACT Act</short-title></quote>.</text>
		</section><section id="ID30de16938cff4a25b15d4b3c8f3b2f29"><enum>2.</enum><header>Sales of
			 over-the-counter drugs containing dextromethorphan</header>
			<subsection id="id10E4A49A0FEA44778BFB0ABC77E2EED0"><enum>(a)</enum><header>Prohibited
			 act</header><text display-inline="yes-display-inline">Section 301 of the
			 Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>) is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id2BECE1C7C481466D86CA98BB1D887219" style="OLC">
					<subsection id="IDa7fdbc50cc91487b86a9e1f1b9949089"><enum>(ccc)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id399065195477459F98ABD3F1B9075A37"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id26C40319B2AF452F9134CAD8CEEA2795"><enum>(A)</enum><text>Except as provided in
				subparagraph (2), the sale or offering for sale of a drug containing
				dex­tro­me­thor­phan to an individual under 18 years of age, including any such
				sale using the Internet, provided the drug is not subject to section
				503(b)(1).</text>
							</subparagraph><subparagraph id="id6E45E4B5725E493192631428F30B57E2" indent="up2"><enum>(B)</enum><text>If a person fails to request
				identification from an individual under 18 years of age and sells a product
				containing dextromethorphan to that individual, that person shall be deemed to
				have known that the individual was under 18 years of age, unless from the
				individual’s outward appearance the person making the sale would reasonably
				presume the individual to be 25 years of age or older.</text>
							</subparagraph><subparagraph commented="no" id="idC6AC0533D93847A2B6D157E4E67FB93E" indent="up2"><enum>(C)</enum><text>It shall be an affirmative defense to
				an alleged violation of clause (A) that the person selling a product containing
				dextromethorphan examined the purchaser's identification card and, based on
				that examination, that person reasonably concluded that the identification was
				valid and indicated that the purchaser was not less than 18 years of
				age.</text>
							</subparagraph></paragraph><paragraph id="idF6622E1068EC4DE8A4668F7EF55BAC1B" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id19871E496E3B401EA7E496C4C847BDF8"><enum>(A)</enum><text>This paragraph shall
				not apply to any sale made pursuant to a validly issued prescription.</text>
							</subparagraph><subparagraph id="id107B6EEEFE4C400391549BC7DDB5AADA" indent="up1"><enum>(B)</enum><text>This paragraph shall not apply to the
				sale or offering for sale of a drug containing dextromethorphan to an
				individual under 18 years of age if such individual supplies proof at the time
				of such sale that such individual is actively enrolled in the military and
				presents a valid military identification card.</text>
							</subparagraph></paragraph><paragraph id="idE49D824C2D144D5DB0A2C850DD6343DF" indent="up1"><enum>(3)</enum><text>In this paragraph, the term
				<term>identification card</term> mean an identification card that—</text>
							<subparagraph id="id928D12469B504A5595E46C0AE96AD2DE"><enum>(A)</enum><text>includes a photograph and the date of
				birth of the individual; and</text>
							</subparagraph><subparagraph id="id43575B434B604820913776DF49C83797"><enum>(B)</enum><text>is issued by a State or the Federal
				Government or is considered acceptable for purposes of sections
				274a.2(b)(1)(v)(A) and 274a.2(b)(1)(v)(B)(1) of title 8, Code of Federal
				Regulations (as in effect on or after the date of the enactment of the
				<short-title>Preventing Abuse of Cough Treatments Act of
				2013</short-title>).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id32E06D293EE74C49915076CD41827B38"><enum>(b)</enum><header>Civil
			 penalties</header><text>Section 303 of the Federal Food, Drug, and Cosmetic Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/21/333">21 U.S.C. 333</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idF69F372FA9B941ACB893F87ACAEA6454" style="OLC">
					<subsection id="idA89E49A55B8B4B5E8FCD2FA34CED85EB"><enum>(h)</enum><text>Notwithstanding
				subsection (a), the following provisions shall apply to violations of section
				301(ccc):</text>
						<paragraph id="id14D23F09393C46948A55DE08FB8031BE"><enum>(1)</enum><text>A person who
				violates section 301(ccc) shall—</text>
							<subparagraph id="id707D75B4AD744728A80E9D65936968DC"><enum>(A)</enum><text>receive a warning
				letter from the Secretary for the first such violation; and</text>
							</subparagraph><subparagraph id="id0666AB602A63453A9A43AA74008FF551"><enum>(B)</enum><text>be subject to a
				civil penalty in an amount—</text>
								<clause id="idFA87507AC27A4DD9A2A45230494E3BB0"><enum>(i)</enum><text>not more than
				$1,000 for the second such violation by a person;</text>
								</clause><clause id="id880ED1D5D81F434C96A0E7F5E1FC613B"><enum>(ii)</enum><text>not more than
				$2,000 for the third such violation by a person; and</text>
								</clause><clause id="id2E6D34FC691746879B3B4EED61667BAA"><enum>(iii)</enum><text>not more than
				$5,000 for the fourth such violation, or a subsequent such violation, by a
				person.</text>
								</clause></subparagraph></paragraph><paragraph id="idFBE80D1AD7FF4AF698EF92192DD9883D"><enum>(2)</enum><text>In determining
				the amount of a civil penalty under this subsection for a person who is a
				retailer, the Secretary shall consider whether the retailer has taken
				appropriate steps to prevent subsequent violations, such as the establishment
				and administration of a documented employee training program to ensure all
				employees are familiar with and abiding by the provisions of section 301(ccc),
				where such program includes—</text>
							<subparagraph id="idC7D59317EFA2494FAEFEEE4F2CDEAB68"><enum>(A)</enum><text>educating
				employees regarding products containing dextromethorphan;</text>
							</subparagraph><subparagraph id="idF7315050465944868C95E4CD962E2268"><enum>(B)</enum><text>instruction on
				the correct method of checking a purchaser’s identification card; and</text>
							</subparagraph><subparagraph id="id67EB4F6440584796A93E884749D887B0"><enum>(C)</enum><text>notifying
				employees of the civil penalties under this subsection.</text>
							</subparagraph></paragraph><paragraph id="idA4A4C489BF114A42A97A4978CCD31ABA"><enum>(3)</enum><text>If a person who
				is a retailer transacts sales of products containing dextromethorphan at more
				than one physical location, for purposes of determining the number of
				violations by that person under this subsection, each individual physical
				location operated by that retailer shall be considered a separate
				person.</text>
						</paragraph><paragraph commented="no" id="id06C471CFA36944579B18EBF59254F3C9"><enum>(4)</enum><text>The Secretary
				shall notify persons found to have violated section 301(ccc) as soon as
				practicable after the Secretary discovers such violation. Such notification
				shall include details of the violation, such as—</text>
							<subparagraph id="id4841a4c5ad4848ddb66293f5e2685c4d"><enum>(A)</enum><text>the date and time
				of the sale;</text>
							</subparagraph><subparagraph id="id9c69646dc2404500b0f773aa3a7493c8"><enum>(B)</enum><text>a sales receipt
				or credit card receipt documenting the sale; and</text>
							</subparagraph><subparagraph id="id41055def529446b48fa49381e3518e03"><enum>(C)</enum><text>the name or
				description of the employee involved in the sale.</text>
							</subparagraph></paragraph><paragraph id="id9B2A85DA36B744F68C955C3F01A3802E"><enum>(5)</enum><text>Notwithstanding
				any other provision of this subsection or section 301(ccc), an employee shall
				not be subject to penalties under this subsection unless such employee
				knowingly and willfully participates in a conspiracy to violate section
				301(ccc). For purposes of this paragraph, a conspiracy shall consist of an
				agreement between two or more persons with the intent to violate section
				301(ccc) and the commission of at least one overt act in furtherance of the
				agreement.</text>
						</paragraph><paragraph id="idBAB6272BB9214642AE05D333A067ABFD"><enum>(6)</enum><text>In this
				subsection—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idB3C5162C75F64532BECDE5B78981EEEF"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>employee</term> means an
				individual who is employed by a retailer in a clerical or other non-managerial
				position; and</text>
							</subparagraph><subparagraph id="idDB2FCE5C66BE409B82A82E94967AE7A1"><enum>(B)</enum><text>the term
				<term>retailer</term> means a grocery store, general merchandise store, drug
				store, pharmacy, convenience store, or other entity or person whose activities
				as a distributor relating to products containing dextromethorphan are limited
				almost exclusively to sales for personal use, both in number of sales and
				volume of sales, either directly to walk-in customers or in face-to-face
				transactions by direct
				sales.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="IDb92b7b19cd674e2781c1102e7f159588"><enum>3.</enum><header>Restrictions on
			 distribution of bulk dextromethorphan</header><text display-inline="no-display-inline">The Federal Food, Drug, and Cosmetic Act (21
			 U.S.C. 321 et seq.) is amended—</text>
			<paragraph id="IDbcc0d60477fa42ffb0da5646e922c1a8"><enum>(1)</enum><text>in section 501,
			 by inserting at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idF9AF035F452845EC97525A46608E8FAD" style="OLC">
					<subsection id="IDfd1c6a090d9946b788f10de42be9ef8d"><enum>(k)</enum><text>If it is
				unfinished dextromethorphan and is possessed, received, or distributed in
				violation of section 506G.</text>
					</subsection><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph id="IDcc9d1d9885dc41e3b5e2159d021ea004"><enum>(2)</enum><text>by inserting
			 after section 506F the following:</text>
				<quoted-block display-inline="no-display-inline" id="id80C360F92CFC4246ACD1F40FBDC3D752" style="OLC">
					<section id="ID14868f0534bc40b687a0e3c94aaf1482"><enum>506G.</enum><header>Restrictions
				on the distribution of bulk dextromethorphan</header>
						<subsection id="id21B93424BBCB4D7EAE06892F8B7F2114"><enum>(a)</enum><header>In
				general</header><text>No person shall—</text>
							<paragraph id="ID4591f45b1852490197b9feaba4bd883c"><enum>(1)</enum><text>possess or
				receive unfinished dex­tro­me­thor­phan, unless the person is registered under
				section 510 or otherwise registered, licensed, or approved pursuant to Federal
				or State law to engage in the practice of pharmacy, pharmaceutical production,
				or manufacture or distribution of drug ingredients; or</text>
							</paragraph><paragraph id="ID6c4720c2b84345f2aa609016102e2a1c"><enum>(2)</enum><text>distribute
				unfinished dextromethorphan to any person other than a person registered under
				section 510 or otherwise registered, licensed, or approved pursuant to Federal
				or State law to engage in the practice of pharmacy, pharmaceutical production,
				or manufacture or distribution of drug ingredients.</text>
							</paragraph></subsection><subsection id="IDe3e7e2d1d67e4413a49805371d894dfd"><enum>(b)</enum><header>Exception for
				common carriers</header><text>This section does not apply to a common carrier
				that possesses, receives, or distributes unfinished dextromethorphan for
				purposes of distributing such unfinished dex­tro­me­thor­phan between persons
				described in subsection (a) as registered, licensed, or approved.</text>
						</subsection><subsection id="idBE868FB8A60F4FF29019A9EA20061686"><enum>(c)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="ID4eff666b222544398918618b5a6a75ce"><enum>(1)</enum><text>The term
				<term>common carrier</term> means any person that holds itself out to the
				general public as a provider for hire of the transportation by water, land, or
				air of merchandise, whether or not the person actually operates the vessel,
				vehicle, or aircraft by which the transportation is provided, between a port or
				place and a port or place in the United States.</text>
							</paragraph><paragraph id="ID26da97f858364bb8b121ab9853a30a2c"><enum>(2)</enum><text>The term
				<term>unfinished dextromethorphan</term> means dextromethorphan that is not
				contained in a drug that is in finished dosage
				form.</text>
							</paragraph></subsection></section><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id760AAAA9A66247069378D1F5ABB077CA"><enum>(3)</enum><text>by amending
			 section 303, as amended by section 2(b), by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id5AA92D3538F04DC7AC5D16530455A7BC" style="OLC">
					<subsection id="id3F0D8CD99F9741FDB34337E553C2DBFF"><enum>(i)</enum><text>Notwithstanding
				subsection (a), a person who violates section 506G shall be subject to a civil
				penalty of not more than
				$100,000.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
