		<official-title>To amend title 10, United States Code, to extend the
		  duration of the Physical Disability Board of Review and to the expand the
		  authority of such Board to review of the separation of members of the Armed
		  Forces on the basis of a mental condition not amounting to disability,
		  including separation on the basis of a personality or adjustment
		  disorder.</official-title>

	<legis-body id="H1AA818920BA0447384FCFF31C49BECB3" style="OLC">
		<section id="H26800C0AC58246C4BBDFC08378053A7D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Servicemember Mental Health Review
			 Act</short-title></quote>.</text>
		</section><section id="H898A4BD8E9A84F40975FCA900D21AC67"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="HDFE1575B8E4D4F67AD1AD977331C1B69"><enum>(1)</enum><text display-inline="yes-display-inline">Since September 11, 2001, approximately
			 30,000 veterans have been separated from the Armed Forces on the basis of a
			 personality disorder or adjustment disorder.</text>
			</paragraph><paragraph id="H4A38EDA9656B42129A2E854EB05B97B7"><enum>(2)</enum><text display-inline="yes-display-inline">Nearly all veterans who are separated on
			 the basis of a personality or adjustment disorder are prohibited from accessing
			 service-connected disability compensation, disability severance pay, and
			 disability retirement pay.</text>
			</paragraph><paragraph id="H2811BA6717CC4369B005E3BDEE2A1151"><enum>(3)</enum><text display-inline="yes-display-inline">Many veterans who are separated on the
			 basis of a personality or adjustment disorder are unable to find employment
			 because of the <term>personality disorder</term> or <term>adjustment
			 disorder</term> label on their Certificate of Release or Discharge from Active
			 Duty.</text>
			</paragraph><paragraph id="HA0689CD3E41F4932B0884CA5F231520A"><enum>(4)</enum><text display-inline="yes-display-inline">The Government Accountability Office has
			 found that the regulatory compliance of the Department of Defense in separating
			 members of the Armed Forces on the basis of a personality or adjustment
			 disorder was as low as 40 percent between 2001 and 2007.</text>
			</paragraph><paragraph id="HBBCE3483406B4B6F96562C7C7CD3175D"><enum>(5)</enum><text display-inline="yes-display-inline">Expansion of the authority of the Physical
			 Disability Board of Review to include review of the separation of members of
			 the Armed Forces on the basis of a mental condition not amounting to
			 disability, including separation on the basis of a personality or adjustment
			 disorder, is warranted in order to ensure that any veteran wrongly separated on
			 such basis will have the ability to access disability benefits and employment
			 opportunities available to veterans.</text>
			</paragraph></section><section id="HA6C824CDBCD24A4F8EEC8503BA43624A"><enum>3.</enum><header>Review by
			 Physical Disability Board of Review of military separation on basis of a mental
			 condition not amounting to disability</header>
			<subsection id="H0265CD86E4514EE1B992F806AD3FC148"><enum>(a)</enum><header>Members entitled
			 to review by Physical Disability Board of Review</header><text>Section 1554a of
			 title 10, United States Code, is amended—</text>
				<paragraph id="H874E390C00E84AC7A1F896C9CD7599BF"><enum>(1)</enum><text>in subsection
			 (a)(1), by striking <quote>disability determinations of covered individuals by
			 Physical Evaluation Boards</quote> and inserting <quote>disability and
			 separation determinations regarding certain members and former members of the
			 armed forces described in subsection (b)</quote>; and</text>
				</paragraph><paragraph id="H9C3E0DB50AD64D50837AF9BA62563BA2"><enum>(2)</enum><text>by striking
			 subsection (b) and inserting the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HAF1B35DF9B4349819F9BC4099F117647" style="OLC">
						<subsection id="H3F2684DC66E0440B9153FD91F57F1C3F"><enum>(b)</enum><header>Covered
				individuals</header><text display-inline="yes-display-inline">For purposes of
				this section, covered individuals are members and former members of the armed
				forces who—</text>
							<paragraph id="HBB99AA3A5612433C9E7547E075E5CFA0"><enum>(1)</enum><text display-inline="yes-display-inline">during the period beginning on September
				11, 2001, and ending on December 31, 2014, are separated from the armed forces
				due to unfitness for duty because of a medical condition with a disability
				rating of 20 percent disabled or less and are found to be not eligible for
				retirement; or</text>
							</paragraph><paragraph id="H3A09ED72C0EE43ABB0F535C6AB5A3266"><enum>(2)</enum><text display-inline="yes-display-inline">before December 31, 2014, are separated
				from the armed forces due of unfitness for duty because of a mental condition
				not amounting to disability, including separation on the basis of a personality
				disorder or adjustment
				disorder.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HDF22DA1279024983A77096F832749882"><enum>(b)</enum><header>Nature and scope
			 of review</header><text>Such section is further amended—</text>
				<paragraph id="H6AD9D43807184DAA8B6401779D823F8F"><enum>(1)</enum><text>by redesignating
			 subsections (d), (e), and (f) as subsections (e), (f), and (g), respectively;
			 and</text>
				</paragraph><paragraph id="H9EB55C4962674731A15F36E11C885288"><enum>(2)</enum><text>by inserting after
			 subsection (c) the following new subsection (d):</text>
					<quoted-block display-inline="no-display-inline" id="HB8C9087B8EE84B2C93DC4488D6467020" style="OLC">
						<subsection id="H35819253F6324F668AFDA5B08432F5AC"><enum>(d)</enum><header>Review of
				separations due to unfitness for duty because of a mental condition not
				amounting to disability</header><paragraph commented="no" display-inline="yes-display-inline" id="H3CE946C53C094915BD8A39B156E23F79"><enum>(1)</enum><text display-inline="yes-display-inline">Upon the request of a covered individual
				described in paragraph (2) of subsection (b), or a surviving spouse, next of
				kin, or legal representative of a covered individual described in such
				paragraph, the Physical Disability Board of Review shall review the findings
				and decisions of the Physical Evaluation Board with respect to such covered
				individual. In addition, the Physical Disability Board of Review may review,
				upon its own motion, the findings and decisions of the Physical Evaluation
				Board with respect to a covered individual described in such paragraph.</text>
							</paragraph><paragraph id="H0B04F356D1204C889EE28137F4358865" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Whenever a review is conducted under
				paragraph (1), the members of the Physical Disability Board of Review shall
				include at least one licensed psychologist and one licensed psychiatrist who
				has not had any fiduciary responsibility to the Department of Defense since
				December 31, 2001.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H0B4D90C03B7A4483A169EAD3C0088463" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In conducting the review under paragraph
				(1), the Physical Disability Board of Review shall consider—</text>
								<subparagraph id="H43636D0CFE23447495487F1D68F8DB21"><enum>(A)</enum><text>the findings of the psychologist or
				psychiatrist of the Department of Defense who diagnosed the mental
				condition;</text>
								</subparagraph><subparagraph id="HF4F567BBF60744E3B31772CC920D35D3"><enum>(B)</enum><text>the findings and decisions of the
				separation authority with respect to the covered individual; and</text>
								</subparagraph><subparagraph id="H9412E289DCD1478BBB0034F796CEFA23"><enum>(C)</enum><text>whether the separation authority
				correctly followed the process for separation as set forth in law, including
				Department of Defense regulations, directives, and policies.</text>
								</subparagraph></paragraph><paragraph id="H61F89AEBF2664A1A83BAB98878E831DA" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The review by the Physical Disability Board
				of Review under paragraph (1) shall be based on the records of the Department
				of Defense and the Department of Veterans Affairs and such other evidence as
				may be presented to the Board. The Board shall consider any and all evidence to
				be considered, including private mental health records submitted by the covered
				individual in support of the claim.</text>
							</paragraph><paragraph id="H6B8F332590B1424E8C399E6DCBEDFDEC" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">If the Physical Disability Board of Review
				proposes, upon its own motion, to conduct a review under paragraph (1) with
				respect to a covered individual, the Board shall notify the covered individual,
				or a surviving spouse, next of kin, or legal representative of the covered
				individual, of the proposed review and obtain the consent of the covered
				individual or a surviving spouse, next of kin, or legal representative of the
				covered individual before proceeding with the review.</text>
							</paragraph><paragraph id="HB29FB97DF9EB45C0B24FE5F91A839AFB" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">After the Physical Disability Board of
				Review has completed the review under this subsection with respect to the
				separation of a covered individual, the Board shall provide the claimant with a
				statement of reasons concerning the Board’s decision. The covered individual
				has the right to raise with the Board a motion for reconsideration if—</text>
								<subparagraph id="H5A5B56D2C7F94D5E8BD351038E0AC7F3"><enum>(A)</enum><text>new evidence can be presented that
				would address the issues raised in the Board’s statement of reasons; or</text>
								</subparagraph><subparagraph id="H7BB9C7DEDB5A4F1C9CA1501308296347"><enum>(B)</enum><text display-inline="yes-display-inline">the Board has made a plain error in making
				its
				recommendation.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HD0A07EAF90EB4067A48D84E79DEC414A"><enum>(c)</enum><header>Correction of
			 military records</header><text display-inline="yes-display-inline">Subsection
			 (f) of such section, as redesignated by subsection (b)(1), is amended to read
			 as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H1CCF0C0EA3DF49839BB82B5D1EACB4F9" style="OLC">
					<subsection id="HB164217857B44F79AD814E2CA7BBC322"><enum>(f)</enum><header>Correction of
				military records</header><paragraph commented="no" display-inline="yes-display-inline" id="H3E6A8EF3EC0444819A89DCF269A0B1BD"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary of the military department
				concerned shall correct the military records of a covered individual in
				accordance with the recommendation made by the Physical Disability Board of
				Review under subsection (e) unless the Secretary determines that the Board has
				made a clearly erroneous recommendation. Any such correction shall be made
				effective as of the date of the separation of the covered individual.</text>
						</paragraph><paragraph id="HD4A85A9AFBE3482B88CAE568FB1CC468" indent="up1"><enum>(2)</enum><text>In the case of a covered individual
				previously separated with a lump-sum or other payment of back pay and
				allowances at separation, the amount of pay or other monetary benefits to which
				such individual would be entitled based on the individual’s military record as
				corrected shall be adjusted to take into account receipt of such lump-sum or
				other payment in such manner as the Secretary of the military department
				concerned considers appropriate.</text>
						</paragraph><paragraph id="H6E0EDA6813054F81B2CBA68DDEEDAE25" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">If the Physical Disability Board of Review
				makes a recommendation not to correct the military records of a covered
				individual, the action taken on the report of the Physical Evaluation Board to
				which such recommendation relates shall be treated as final as of the date of
				such
				action.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H56532F4CD7BF489D8A2367C13A5D0BC1"><enum>(d)</enum><header>Conforming
			 amendments</header><text>Such section is further amended—</text>
				<paragraph id="HFD634C94B1A641FD956D5533A5202AD3"><enum>(1)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="HFF535D54F3C24565B62932730D131A9E"><enum>(A)</enum><text>by inserting after
			 <quote><header-in-text level="subsection" style="OLC">Review</header-in-text></quote> the following:
			 <quote><header-in-text level="subsection" style="OLC">of separations due to
			 unfitness for duty because of medical condition with a low disability
			 rating</header-in-text></quote>; and</text>
					</subparagraph><subparagraph id="H9B42FB3CFF7A48C8B43B088244E8F48B"><enum>(B)</enum><text>in paragraph
			 (1)—</text>
						<clause id="H3AAC587237974A998C6DF3AFB9F61ACB"><enum>(i)</enum><text>by
			 inserting <quote>described in paragraph (1) of subsection (b)</quote> after
			 <quote>a covered individual</quote> the first place it appears;</text>
						</clause><clause id="H91F60C205CD3459EA47598340F2ECD4A"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting <quote>described in such
			 paragraph</quote> after <quote>a covered individual</quote> the second place it
			 appears; and</text>
						</clause><clause id="HD36062D0A3F2462AB929D6781282DB9F"><enum>(iii)</enum><text>by
			 striking the second sentence and inserting the following new sentence:
			 <quote>In addition, the Physical Disability Board of Review may review, upon
			 its own motion, the findings and decisions of the Physical Evaluation Board
			 with respect to a covered individual described in such paragraph.</quote>;
			 and</text>
						</clause></subparagraph></paragraph><paragraph id="H5E1497AF32894AC6800C79286B58A3FC"><enum>(2)</enum><text>in subsection (e),
			 as redesignated by subsection (b)(1), by striking <quote>under subsection
			 (c)</quote> and inserting <quote>conducted under subsection (c) or
			 (d)</quote>.</text>
				</paragraph></subsection><subsection id="H0D6D05FA5287493E8C36B7BCB7B93376"><enum>(e)</enum><header>Notification of
			 new availability of review</header>
				<paragraph display-inline="no-display-inline" id="H2C84819D0E0543749FE8E42AFC17974F"><enum>(1)</enum><header>Notification
			 requirement</header><text display-inline="yes-display-inline">In the case of
			 individuals described in subsection (b)(2) of <external-xref legal-doc="usc" parsable-cite="usc/10/1554a">section 1554a</external-xref> of title 10, United
			 States Code, as amended by subsection (a), who have been separated from the
			 Armed Forces during the period beginning on September 11, 2001, and ending on
			 the date of the enactment of this Act or who are separated after that date, the
			 Secretary of Defense shall ensure, to the greatest extent practicable, that
			 such individuals receive oral and written notification of their right to a
			 review of their separation from the Armed Forces under such section
			 1554a.</text>
				</paragraph><paragraph id="HCA056B9296774965BCFBB1750A14AE9F"><enum>(2)</enum><header>Compliance</header><text display-inline="yes-display-inline">The Secretary of the military department
			 with jurisdiction over the Armed Force in which the individual served
			 immediately before separation shall be responsible for providing to the
			 individual the notification required by paragraph (1). The Secretary of Defense
			 shall monitor compliance with this notification requirement and promptly notify
			 Congress of any failures to comply.</text>
				</paragraph><paragraph id="H5B35EB65F7A74F3D93A1ACB0363A4459"><enum>(3)</enum><header>Legal
			 counsel</header><text display-inline="yes-display-inline">The notification
			 required by paragraph (1) shall—</text>
					<subparagraph id="H14338D50D9DA497987EBFDC3B0870AE6"><enum>(A)</enum><text display-inline="yes-display-inline">inform the individual of the right to
			 obtain legal or non-legal counsel to represent the individual before the
			 Physical Disability Board of Review; and</text>
					</subparagraph><subparagraph id="HF717EF845BF4437D8C46F110CAC94B4D"><enum>(B)</enum><text>include a list of
			 organizations that may provide such counsel at no cost to the
			 individual.</text>
					</subparagraph></paragraph></subsection><subsection id="HABC810CF7D884BEEA7255223CC489F0E"><enum>(f)</enum><header>Clerical
			 amendments</header>
				<paragraph id="H159A003C8C004306B8BFAB8BE76AD6D8"><enum>(1)</enum><header>Section
			 heading</header><text display-inline="yes-display-inline">The heading of such
			 section is amended to read as follows:</text>
