1.This Act may be cited as
the School Turnaround and Rewards Act
of 2013
or the STAR Act of 2013
.
2.The purposes of this Act are to—
(1)significantly
improve outcomes for students in persistently low-performing schools by—
(A)building the
capacity of State educational agencies and local educational agencies to
improve student academic achievement in low-performing and persistently
low-performing schools;
(B)supporting States
and local educational agencies in implementing school intervention models;
and
(C)targeting State
and local supports and strategies on the persistently lowest-performing schools
in each State; and
(2)create a culture
of recognizing, rewarding, and replicating educational excellence in every
State by—
(A)providing
financial and other incentives and rewards to schools that are identified as
Reward Schools; and
(B)supporting State
educational agency efforts to identify, collect, and disseminate effective
practices for increasing student academic achievement used by Reward
Schools.

ribbon schools</header>
<section commented="no" display-inline="no-display-inline" id="id0A1ED4A77A064760A93EB36AB10AE8A8"><enum>101.</enum><header>Blue ribbon
schools</header>
<subsection commented="no" display-inline="no-display-inline" id="id119CF5EDB4094FB792A539BBEBAD8DA9"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Section 1117 of the
Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6317">20 U.S.C. 6317</external-xref>) is amended to
read as follows:</text>

<section commented="no" display-inline="no-display-inline" id="id0AB0B4AA30754C7D806481E44FE90CD0" section-type="subsequent-section"><enum>1117.</enum><header display-inline="yes-display-inline">Blue ribbon schools</header>
<subsection commented="no" display-inline="no-display-inline" id="ID150e47865b1e4815afe5c09749822572"><enum>(a)</enum><header display-inline="yes-display-inline">Program purpose</header><text display-inline="yes-display-inline">It is the purpose of this section to assist
States and local educational agencies in identifying and rewarding
high-performing public schools.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="idBE3FD4CF37FB4784B866A90F04160D29"><enum>(b)</enum><header display-inline="yes-display-inline">Blue ribbon schools</header>
<paragraph commented="no" display-inline="no-display-inline" id="ID68399162b157449887ef55fc194edcae"><enum>(1)</enum><header display-inline="yes-display-inline">Identification of blue ribbon
schools</header><text display-inline="yes-display-inline">Each State receiving
a grant under this part may—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id3534D1CC882B431AAA46FDEB78818661"><enum>(A)</enum><text display-inline="yes-display-inline">define the category of blue ribbon schools,
consistent with paragraph (2), for the State as part of its State plan in
section 1111(b); and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id38CDC78F8BFB4AEB890D7FFE1C4872BE"><enum>(B)</enum><text display-inline="yes-display-inline">identify, for each school year, the schools
in the State that are blue ribbon schools for such year.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id33C5FE6DBE4B4FC9B8795A436AD7A2CE"><enum>(2)</enum><header display-inline="yes-display-inline">Blue ribbon school criteria</header>
<subparagraph commented="no" display-inline="no-display-inline" id="id1EB75380A8C54ECF979AF47B5476FDAB"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If a State elects to carry out this
subsection, the State’s blue ribbon schools shall consist of the top 5 percent
of the State's public elementary schools and secondary schools, as designated
by the State based on—</text>
<clause commented="no" display-inline="no-display-inline" id="ID428bae96240a4aeaa8e987c6ab27c045"><enum>(i)</enum><text display-inline="yes-display-inline">the percentage of students who are on track
to college and career readiness, as defined by the Secretary, for English or
language arts, and mathematics;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDfa1e84ae218544bc9da59c0d79b184e2"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of high schools, the school’s
graduation rates;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDfe0598f0eb8f427ca8b9e18cc310337e"><enum>(iii)</enum><text display-inline="yes-display-inline">the performance of each subgroup of
students, as defined by the Secretary;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDef2ce87282564b03bacb1065db89c56a"><enum>(iv)</enum><text display-inline="yes-display-inline">student growth, as defined by the
Secretary; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="idBB6913E669CB4082A1DD5EEE790C23F8"><enum>(v)</enum><text display-inline="yes-display-inline">school gains.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8b1fb8b479334be6890ed121b7b10e46"><enum>(B)</enum><header display-inline="yes-display-inline">Noneligibility for blue ribbon
status</header><text display-inline="yes-display-inline">A school identified
under section 1116(b) for a year shall not be eligible for blue ribbon school
status for the same year.</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5f533bc1de4840e9b3bb3ae21054d39f"><enum>(c)</enum><header display-inline="yes-display-inline">Rewards for blue ribbon schools</header>
<paragraph commented="no" display-inline="no-display-inline" id="id1F2BB9401EA24B8E8E025A651B468818"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each State that defines and identifies blue
ribbon schools under subsection (b)(1) for a school year may—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="idA4F8E993FF444A23956001AFC2625B2B"><enum>(A)</enum><text display-inline="yes-display-inline">provide each blue ribbon school in the
State with increased autonomy over the school’s budget, staffing, and
time;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9DC55ECDB00240F2BCFB7831DD017D35"><enum>(B)</enum><text display-inline="yes-display-inline">allow each blue ribbon school to have
flexibility in the use of any funds provided to the school under this Act for
any purpose allowed under this Act (notwithstanding any other provision of this
Act), as long as such use is consistent with the Civil Rights Act of 1964,
title IX of the Education Amendments of 1972, section 504 of the Rehabilitation
Act of 1973, the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101</external-xref>), and
part B of the Individuals with Disabilities Education Act; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD78C493F54FD4CF2999FD57DFFF01324"><enum>(C)</enum><text display-inline="yes-display-inline">reserve not more than .5 percent of the
funds allotted to the State under subpart 2 and use such reserved amounts to
distribute rewards, on a competitive basis, to local educational agencies that
serve 1 or more blue ribbon schools identified under subsection (b) that
receive funds under subpart 2 to enable the local educational agencies to
provide awards to such blue ribbon schools that receive funds under such
subpart.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD6B38454BE05410DB649A36664B570C9"><enum>(2)</enum><header display-inline="yes-display-inline">Use
of rewards</header><text display-inline="yes-display-inline">As a condition of
receiving an award from a local educational agency under this subsection, a
blue ribbon school shall agree to use the award funds to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id1587F2F0C8734F1085E788DDBB2AB2F8"><enum>(A)</enum><text display-inline="yes-display-inline">improve student achievement; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id369EA6F5D0B14B7BB9AA5DDDE1B2F1D4"><enum>(B)</enum><text display-inline="yes-display-inline">provide technical assistance to the
lowest-achieving schools in the State that have characteristics similar to the
blue ribbon school.</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8B63039AA95B441AB7D9CBA9F3A46DCA"><enum>(d)</enum><header>Authorization
of appropriations</header><text>There are authorized to be appropriated to
carry out this section $300,000,000 for fiscal year 2014 and such sums as may
be necessary for each of the 5 succeeding fiscal
years.</text>
</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection commented="no" display-inline="no-display-inline" id="idB6AA6FE876944E419EEC6FE201E49D83"><enum>(b)</enum><header>Table of
contents</header><text>The table of contents in section 2 of the Elementary and
Secondary Education Act of 1965 is amended by striking the item relating to
section 1117 and inserting the following:</text>

</subsection></section><enum>II</enum><header>School
turnaround</header>
<section id="idD0ABC865C4A040C6B3886B9D005D6B30"><enum>201.</enum><header>School
turnaround</header><text display-inline="no-display-inline">Section 1116 of the
Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6316">20 U.S.C. 6316</external-xref>) is amended by
adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="id024AA392553746569B557E23A5FD031C" style="OLC">
<subsection commented="no" display-inline="no-display-inline" id="IDb17fbb452094466b8a0ac9631338c611"><enum>(i)</enum><header display-inline="yes-display-inline">Persistently low-Achieving schools</header>
<paragraph commented="no" display-inline="no-display-inline" id="IDb9f2d070da7c4088adee5bacf7c5b682"><enum>(1)</enum><header display-inline="yes-display-inline">Lowest-achieving schools in the
State</header>
<subparagraph commented="no" display-inline="no-display-inline" id="id9840EDE898A8459387235E9FDCF28260"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each State receiving a grant under this
part shall, beginning in the 2013–2014 school year and every year thereafter,
determine the lowest-achieving schools in the State, which shall
include—</text>
<clause commented="no" display-inline="no-display-inline" id="idAE3149464695459BAA30F40CC57FF460"><enum>(i)</enum><text display-inline="yes-display-inline">the lowest-achieving 5 percent of public
high schools, and the lowest-achieving 5 percent of public elementary schools
and secondary schools that are not high schools, in the State, based on—</text>
<subclause commented="no" display-inline="no-display-inline" id="ID15dc8735ac3942e0982bd22778b273ff"><enum>(I)</enum><text display-inline="yes-display-inline">student performance on the State academic
assessments in reading or language arts, and mathematics, including student
absolute performance;</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="id493809D3AE7B4CE9B46EC92A40DBC288"><enum>(II)</enum><text display-inline="yes-display-inline">in the case of high schools, graduation
rates; and</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="ID3165f9ec8e564c0eb54f917145a930ec"><enum>(III)</enum><text display-inline="yes-display-inline">if the State so chooses—</text>
<item commented="no" display-inline="no-display-inline" id="id0EE113DFC0EE450AA0011CBAE81B5BBD"><enum>(aa)</enum><text display-inline="yes-display-inline">schoolwide gains; and</text>
</item><item commented="no" display-inline="no-display-inline" id="IDf5a2bd65a5704a47a9496fb021669f29"><enum>(bb)</enum><text display-inline="yes-display-inline">absolute student performance; and</text>
</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idAACB43DB2CCB44959E2C142F7F70A2CE"><enum>(ii)</enum><text display-inline="yes-display-inline">the public high schools in the State that
have less than a 60-percent graduation rate.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9AEFAFB9B43F416FACCCC79402DA7498"><enum>(B)</enum><header display-inline="yes-display-inline">Data rule</header><text display-inline="yes-display-inline">In identifying the lowest-achieving schools
under this paragraph, a State shall—</text>
<clause commented="no" display-inline="no-display-inline" id="id28A2D3961B894D3C8B99FBC529FE3982"><enum>(i)</enum><text display-inline="yes-display-inline">use data for the most recent year for which
data are available; or</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id7A305CA7E3E144DDBE9453BE8AF66B5F"><enum>(ii)</enum><text display-inline="yes-display-inline">average data for the most recent 2- to
3-year period for which data are available.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0F5458E7EDAD4ECC9E071D0812F74048"><enum>(C)</enum><header display-inline="yes-display-inline">Parental notification</header><text display-inline="yes-display-inline">Each year, a State shall provide timely
notification to all parents of students enrolled in each school identified
under subparagraph (A) that the school is one of the State's lowest-achieving
schools for such year.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6A3A54EB9A984F8094840B1AB6185B3D"><enum>(D)</enum><header display-inline="yes-display-inline">List of targeted low-achieving
schools</header><text display-inline="yes-display-inline">Each year, the State
shall—</text>
<clause commented="no" display-inline="no-display-inline" id="idA845B3E0AAEE48A995C8E8DBD2DB6553"><enum>(i)</enum><text display-inline="yes-display-inline">compile a list of the schools identified
under subparagraph (A) that—</text>
<subclause commented="no" display-inline="no-display-inline" id="id9FDF4AE159514AFC96539677C67A41D3"><enum>(I)</enum><text display-inline="yes-display-inline">receive assistance under this part;</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="idF6C110883C3A4870AA37CD6181FF3CE4"><enum>(II)</enum><text display-inline="yes-display-inline">are public high schools for which not less
than 50 percent of each school's students are from low-income families, as
determined by the local educational agency under section 1113; or</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="id3A3C89AE82FB4AA7AB71294FBE4CB765"><enum>(III)</enum><text display-inline="yes-display-inline">are public high schools that have less than
a 60-percent graduation rate;</text>
</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idA65C01E0E8744467ABBB31F8DEB08A17"><enum>(ii)</enum><text display-inline="yes-display-inline">submit the list described in clause (i) to
the Secretary;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="idCBE12C119AC641B1999347832DE76D50"><enum>(iii)</enum><text display-inline="yes-display-inline">distribute the list described in clause (i)
to the local educational agencies, elementary schools, and secondary schools in
the State; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id5BA4ECFEB3374D8FA52162A1C30853DC"><enum>(iv)</enum><text display-inline="yes-display-inline">make such list publicly available,
including through the Internet.</text>
</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFACA748B384D4B35AB46FA2E9098DC2B"><enum>(2)</enum><header display-inline="yes-display-inline">Identification as persistently
low-achieving</header>
<subparagraph commented="no" display-inline="no-display-inline" id="id58874EF3FA8D455686F1210114BD68DD"><enum>(A)</enum><header display-inline="yes-display-inline">Identification</header><text display-inline="yes-display-inline">For the 2013–2014 school year, each State
receiving a grant under this part shall identify each school included on the
list under paragraph (1)(D)(i) for the preceding school year as a persistently
low-achieving school. For the 2014–2015 school year, and each subsequent school
year, each such State shall identify each school that has been included on the
list under such paragraph for the 2 preceding consecutive school years as a
persistently low-achieving school.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id49E5035DE54F4CE589DABD603FA2A74D"><enum>(B)</enum><header display-inline="yes-display-inline">5-year period</header><text display-inline="yes-display-inline">A school that is identified by the State
under subparagraph (A) shall be a persistently low-achieving school for the
5-year period following the school's identification, except as provided in
paragraph (6).</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id40ACAFADDC654EE6A1AB2AFD10676CE0"><enum>(3)</enum><header display-inline="yes-display-inline">State waiver</header><text display-inline="yes-display-inline">If a State determines that all schools that
would otherwise be considered to be in the lowest-achieving 5 percent of
schools under paragraph (1)(A)(i) are actually performing at a satisfactory
level of performance based on the measures used by the State to identify
persistently low-achieving schools, the State may apply to the Secretary to
waive the requirements of this subsection.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0F3C7AF2CA28481883EC0A7EA3990A5E"><enum>(4)</enum><header display-inline="yes-display-inline">Needs
analysis</header><text display-inline="yes-display-inline">Each local
educational agency receiving assistance under this part shall conduct a
data-driven needs analysis, which may involve an external partner with
expertise in conducting such needs analysis, of each school identified under
paragraph (2) by the State to determine the most appropriate school improvement
strategies to improve student performance. Such needs analysis shall
include—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID1cc26cbb110a4a908c5889a45e334660"><enum>(A)</enum><text display-inline="yes-display-inline">a diagnostic review of data related to
students and instructional staff;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5145047f2f73407898859b5cf87c99ff"><enum>(B)</enum><text display-inline="yes-display-inline">an analysis of the school governance,
curriculum, instruction, student supports, conditions for learning, and parent
and family engagement practices relative to the needs of the student
population; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcf082358acf5472d885a29db72064ea4"><enum>(C)</enum><text display-inline="yes-display-inline">the resources, which may include
community-based supports and early childhood education and care, available at
the school, local educational agency, and community levels to meet student
needs and support improved student achievement and outcomes and the
implementation of any school improvement strategy.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB68A9BCD389D4A16AAF3B86974FC8BED"><enum>(5)</enum><header display-inline="yes-display-inline">State and local responsibilities</header>
<subparagraph commented="no" display-inline="no-display-inline" id="ID2fe137bde2df41548c8f52c1707fd790"><enum>(A)</enum><header display-inline="yes-display-inline">State responsibilities</header><text display-inline="yes-display-inline">Each State receiving a grant under this
part shall ensure that a local educational agency receiving assistance carries
out the requirements of subparagraph (B) for each persistently low-achieving
school in the State.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEE6E13B7530145A6B4934FE3D3F21B47"><enum>(B)</enum><header display-inline="yes-display-inline">Local educational agency
responsibilities</header><text display-inline="yes-display-inline">Each local
educational agency receiving assistance under this part shall, consistent with
the State's accountability system under section 1111, for each school
identified under paragraph (2) that it serves—</text>
<clause commented="no" display-inline="no-display-inline" id="ID3007883129aa416c8bc0c083e6af98b8"><enum>(i)</enum><text display-inline="yes-display-inline">establish a process for selecting an
appropriate school improvement strategy for the school that uses information
from the needs analysis under paragraph (4);</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID844ac3429f1f42bbac2692680689591a"><enum>(ii)</enum><text display-inline="yes-display-inline">select the school improvement strategy to
be used in each identified school and the timeline for implementing the
selected school improvement strategy in such school;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID262e36aef3264b2bb44fd6bc0ca50f76"><enum>(iii)</enum><text display-inline="yes-display-inline">develop a detailed budget covering the
5-year identification period, including planned expenditures at the school
level for activities supporting full and effective implementation of the
selected school improvement strategy;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDfd86fdce814647d4b835c41d383e6bf4"><enum>(iv)</enum><text display-inline="yes-display-inline">implement a school improvement strategy at
the school in accordance with the requirements of paragraph (6);</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id3EE8705893DC497C8724FBC041982091"><enum>(v)</enum><text display-inline="yes-display-inline">use appropriate measures to monitor the
effectiveness of the implementation;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDe391e25133dd46bf9f6d55fc6ea9225d"><enum>(vi)</enum><text display-inline="yes-display-inline">review and select turnaround partners to
assist in implementing school improvement strategies;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID72993de2d8314dc886c41af98517cfc7"><enum>(vii)</enum><text display-inline="yes-display-inline">align other Federal, State, and local
resources with the school improvement strategy;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID2fc470d8be84419e9c552b543d30e3f3"><enum>(viii)</enum><text display-inline="yes-display-inline">provide the school with the operational
flexibility, including autonomy over staffing, time, and budget, needed to
enable full and effective implementation of the selected strategy, including
through the modification of practices or policies, if necessary;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID6794e9d4d71c40fba6d6fb0144c7d7a2"><enum>(ix)</enum><text display-inline="yes-display-inline">collect and use data on an ongoing basis to
adjust implementation of the school improvement strategy to improve student
achievement;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID5b7a307c56f440a785c69b188ae4cb12"><enum>(x)</enum><text display-inline="yes-display-inline">provide an assurance that the
implementation of the selected school improvement strategy addresses the needs
of all the subgroups of students;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDf8a21d096fae41c7b819e1dbc6fb2517"><enum>(xi)</enum><text display-inline="yes-display-inline">take steps to sustain successful reforms
and practices after the school is no longer identified under paragraph (2);
and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID40477e2522d042ba92a6ee529ad2e289"><enum>(xii)</enum><text display-inline="yes-display-inline">provide technical assistance and other
support to ensure effective implementation of the school improvement strategy
in the school, which may include assistance in—</text>
<subclause commented="no" display-inline="no-display-inline" id="ID13e1dba910fe43738349a7480232025c"><enum>(I)</enum><text display-inline="yes-display-inline">data collection and analysis;</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="ID81097824c391454f91ef6703e31e8e7d"><enum>(II)</enum><text display-inline="yes-display-inline">recruiting and retaining staff;</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="IDd7ee63fa472643d98a0e1760073fe083"><enum>(III)</enum><text display-inline="yes-display-inline">teacher and principal evaluation;</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="ID0532026c6e9a4de4bb1f08a02aeea1d6"><enum>(IV)</enum><text display-inline="yes-display-inline">professional development;</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="IDc5fa8e0c743442ca8aca4d1bbf58b6f6"><enum>(V)</enum><text display-inline="yes-display-inline">parent and family engagement;</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="ID53e32874b48243279ced0b9017f4156a"><enum>(VI)</enum><text display-inline="yes-display-inline">coordination of services with early
childhood education and care providers;</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="ID789a01a2df804041be86f33d54731425"><enum>(VII)</enum><text display-inline="yes-display-inline">coordination of services to address
students’ social, emotional, and health needs; and</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="ID18155e112e4249f7944499a4b6daeecb"><enum>(VIII)</enum><text display-inline="yes-display-inline">monitoring the implementation of the school
improvement strategy selected under paragraph (6).</text>
</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID035e18061c0f4d5287e17cb98339b47c"><enum>(C)</enum><header display-inline="yes-display-inline">State as local educational
agency</header><text display-inline="yes-display-inline">A State may take over
a persistently low-achieving school and act as the local educational agency for
purposes of this subsection, if permitted under State law.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0bec9221af044b19aca3b2fa080f7553"><enum>(6)</enum><header display-inline="yes-display-inline">School improvement strategies</header>
<subparagraph commented="no" display-inline="no-display-inline" id="ID39e88c11fa824908b55911fd7cf5e023"><enum>(A)</enum><header display-inline="yes-display-inline">Required activities for all school
improvement strategies</header><text display-inline="yes-display-inline">A
local educational agency implementing any strategies under this paragraph for a
school shall—</text>
<clause commented="no" display-inline="no-display-inline" id="ID79c89da854dc4ac5bc570502089d2f03"><enum>(i)</enum><text display-inline="yes-display-inline">provide staff at the school with ongoing
professional development, consistent with the needs analysis described in
paragraph (4);</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID067ec6dcd9854669ae65d0ee4e26b493"><enum>(ii)</enum><text display-inline="yes-display-inline">conduct regular evaluations for the
teachers and principals at the school that provide specific feedback on areas
of strength and in need of improvement;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id596720BE185A46FD9A95C95EABFB3F1C"><enum>(iii)</enum><text display-inline="yes-display-inline">provide time for collaboration among
instructional staff at the school to improve student achievement;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDbb9094121f474516892405f262cd0254"><enum>(iv)</enum><text display-inline="yes-display-inline">provide instructional staff at the school
with timely access to student data to inform instruction and meet the academic
needs of individual students, which may include, in elementary school, school
readiness data;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID277f93a42cff4d70ac62a226d9f0a8fb"><enum>(v)</enum><text display-inline="yes-display-inline">collaborate with parents, the community,
teachers, and other school personnel at the school on the selection and
implementation of the strategy;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDbcfd0add7c594cab84b47de9b1ae6ff8"><enum>(vi)</enum><text display-inline="yes-display-inline">use data to identify and implement a
research-based instructional program that—</text>
<subclause commented="no" display-inline="no-display-inline" id="ID3ad6370996e5413687a2ecbac9d72732"><enum>(I)</enum><text display-inline="yes-display-inline">analyzes student progress and performance
and develops appropriate interventions for students who are not making adequate
progress; and</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="ID793e6b4994e0494fb73a87ec77d9dcea"><enum>(II)</enum><text display-inline="yes-display-inline">provides differentiated instruction and
related instructional supports;</text>
</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id09E8044EBA47454EB764CBA16A145FB6"><enum>(vii)</enum><text display-inline="yes-display-inline">in the case of an elementary school with
kindergarten entry, consider the issue of school readiness in such school
by—</text>
<subclause commented="no" display-inline="no-display-inline" id="IDc05ec5d0dc054556a23a5fc3eaa62db1"><enum>(I)</enum><text display-inline="yes-display-inline">examining factors that contribute to school
readiness as part of the needs analysis conducted under paragraph (4);
and</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="ID1d5e8a04a594456d89bffd72a9182d5a"><enum>(II)</enum><text display-inline="yes-display-inline">if school readiness is identified in the
needs analysis as an area in need of improvement—</text>
<item commented="no" display-inline="no-display-inline" id="idC2653F51B3F94D268BD1003B56A6F56C"><enum>(aa)</enum><text display-inline="yes-display-inline">coordinating with appropriate early
childhood programs, such as programs under the Child Care Development and Block
Grant Act of 1990, the Head Start Act, prekindergarten programs, and other
similar Federal, State, and local programs, in order to align instruction to
better prepare students for elementary school; and</text>
</item><item commented="no" display-inline="no-display-inline" id="ID633c1e396828426c97d0ce3b8387cf31"><enum>(bb)</enum><text display-inline="yes-display-inline">developing a plan to improve or expand
early childhood options which may include the use of funds under this part for
such purposes;</text>
</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID5cda36a905134241aaa12d994b60c5d4"><enum>(viii)</enum><text display-inline="yes-display-inline">provide ongoing mechanisms for parent and
family engagement; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID663dcafeb4be49aaad6defdd85cbb6c3"><enum>(ix)</enum><text display-inline="yes-display-inline">provide appropriate services and supports
for students as identified in the school’s needs analysis.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb9be7ae6664c4256bdc122bdbee96ed7"><enum>(B)</enum><header display-inline="yes-display-inline">Strategies</header><text display-inline="yes-display-inline">A local educational agency shall identify a
school improvement strategy for a school from among the following
strategies:</text>
<clause id="ID4de8af11c0a54197804cd75c33335fb8"><enum>(i)</enum><header>Transformation
model</header><text>A transformation model is one in which the local
educational agency—</text>
<subclause id="IDf97062e175f44de09fd9b80245d58f38"><enum>(I)</enum><text>if the principal
has led the school for 2 or more years, replaces the principal with a new
principal who has demonstrated effectiveness in turning around a low-performing
school;</text>
</subclause><subclause id="ID32f91d85db184584aae3d562102a33ec"><enum>(II)</enum><text>uses rigorous,
transparent, and equitable evaluation systems to—</text>
<item id="ID0c4997b916c744cbb76a5d3696b5ac28"><enum>(aa)</enum><text>identify and
reward school leaders, teachers, and other staff who, in implementing the
model, increase student achievement and, if applicable, high school graduation
rates; and</text>
</item><item id="ID6a477e7eed3f45efbb27fc3f648d03ef"><enum>(bb)</enum><text>identify and
remove school leaders, teachers, and other staff who, after ample opportunities
have been provided for such individuals to improve their professional
practice—</text>
<subitem id="idFFED5FE6A6EF487A95ECB816634D92BA"><enum>(AA)</enum><text>do not increase
student achievement;</text>
</subitem><subitem id="id97EEF78701FA4E3389E19D5C3D5A44BF"><enum>(BB)</enum><text>if applicable,
do not increase high school graduation rates; and</text>
</subitem><subitem id="id501A7564B9DC42F4B2821FD7D182040E"><enum>(CC)</enum><text>have not
demonstrated effectiveness according to the local educational agency's
evaluation system;</text>
</subitem></item></subclause><subclause id="IDf41e092148914b2782477e056d2bbbab"><enum>(III)</enum><text>provides staff
with ongoing, high-quality, job-embedded professional development that is
aligned with the school’s instructional program and evaluation system and
facilitates effective teaching and learning, and supports the implementation of
school-reform strategies;</text>
</subclause><subclause id="ID51b64bb10f454dad9e02feb9b33bd2a6"><enum>(IV)</enum><text>implements
strategies, such as financial incentives, increased opportunities for promotion
and career growth, and more flexible work conditions that are designed to
recruit, place, and retain staff with the skills necessary to meet the needs of
the students in the school;</text>
</subclause><subclause id="IDcbc138f981424db0b1a0fc752458d9b6"><enum>(V)</enum><text>uses data to
identify and implement a research-based instructional program that—</text>
<item id="id288CB561632A43B2BA47616E74E37CCD"><enum>(aa)</enum><text>is
aligned with State challenging academic content standards and challenging
student academic achievement standards; and</text>
</item><item id="id9D3C0515CCCE467A852E1A75DF96AB4C"><enum>(bb)</enum><text>has proven to
raise student academic achievement by not less than 10 percent in 1
year;</text>
</item></subclause><subclause id="id32D867D73D114383B4B3EA793D8EA489"><enum>(VI)</enum><text>establishes
schedules and strategies that provide increased learning time, which may
include offering full-day kindergarten or a high-quality preschool program or
using a longer school day, week, or year that increases the total number of
school hours for the school year at a school by not fewer than 300 hours to
significantly increase the total number of school hours to include additional
time for—</text>
<item id="idE8F2B859B8794DD2A85FC3C38E9B20A0"><enum>(aa)</enum><text>instruction in
core academic subjects, instructions in such core academic subjects as,
English, reading or language arts, mathematics, science, foreign languages,
civics and government, economics, arts, history, and geography; and</text>
</item><item commented="no" display-inline="no-display-inline" id="id8B59D7BCFC2345B8A4C6C4632D7DF6CA"><enum>(bb)</enum><text>instruction in
other subjects and enrichment activities that contribute to a well-rounded
education, such as physical education, service learning, and experiential and
work-based learning opportunities that are provided by partnering, as
appropriate, with other organizations;</text>
</item></subclause><subclause id="IDdb18a6081a074f9eb462f5252de6487b"><enum>(VII)</enum><text>promotes the
continuous use of student data to provide instruction that meets the academic
needs of individual students, which may include, in elementary school,
individual students’ levels of school readiness;</text>
</subclause><subclause id="ID2a20b17659764bc7bb0dcda5215a92fa"><enum>(VIII)</enum><text>establishes
schedules and strategies that provide increased learning time, which may
include expanding the school program to offer full-day kindergarten or a
high-quality preschool program;</text>
</subclause><subclause id="ID138b7476a5724ad48d8381513b9091ac"><enum>(IX)</enum><text>provides ongoing
mechanisms for family and community engagement;</text>
</subclause><subclause id="ID94eaa7cc18e64800bce036fdbfd22f33"><enum>(X)</enum><text>gives the school
sufficient operational flexibility in programming, staffing, budgeting, and
scheduling to fully implement a comprehensive strategy designed to
substantially improve student achievement and, if applicable, increase the
graduation rate;</text>
</subclause><subclause id="IDf1b5de4892d64e019696cb0e08675fe5"><enum>(XI)</enum><text>ensures that the
school receives ongoing, intensive technical assistance and related support
from the local educational agency, the State educational agency, or a
designated external lead partner organization; and</text>
</subclause><subclause id="ID9f2337889432495a8ab81512ea6f0eb7"><enum>(XII)</enum><text>provides
appropriate social-emotional and community-oriented services and supports for
students and, at the discretion of the local educational agency, uses not more
than 10 percent of the funds available for such school under this part to
provide services to meet those needs.</text>
</subclause></clause><clause id="ID95d920ebc71f4f4b8237028aad629cfc"><enum>(ii)</enum><header>Restart
model</header><text>A restart model is one in which the local educational
agency—</text>
<subclause id="ID9328700461e0450f895aa423194fd558"><enum>(I)</enum><text>converts a school
or closes and reopens the school—</text>
<item id="id2531838A333F4C039864A3224D04F316"><enum>(aa)</enum><text>under a charter
school operator, a charter management organization, or an education management
organization; or</text>
</item><item id="id1572F32A44C840BD8FCEEF82E2C15FA0"><enum>(bb)</enum><text>as
an autonomous or redesigned school;</text>
</item></subclause><subclause id="IDb11670ca86bc483087de7f7b4a5a8c46"><enum>(II)</enum><text>implements a
rigorous review process to select such a charter school operator, charter
management organization, or education management organization, as applicable,
which includes an assurance from such operator or organization that it will
make significant changes in the leadership and staffing of the school;
and</text>
</subclause><subclause id="IDcd230b54a57542c7b9a240460fb5a4e0"><enum>(III)</enum><text>enrolls in the
school, within the grades it serves, any former student who wishes to attend
the school.</text>
</subclause></clause><clause id="ID880d2ed439d44e8187df220179d72352"><enum>(iii)</enum><header>School
closure</header><text>A school closure model is one in which the local
educational agency—</text>
<subclause id="ID90c5b31075e647d8a324ca8c94560445"><enum>(I)</enum><text>closes a school
and enrolls the students who attended such school in other public schools
served by the local educational agency that are higher performing, provided the
other schools are within reasonable proximity to the closed school; and</text>
</subclause><subclause id="ID279ca004e5344905afe0add713572a0c"><enum>(II)</enum><text>provides
information, in a timely fashion, in the appropriate language, and prior to
closing the school, to children who attended such closed school and their
parents, about high-quality educational options and transition and support
services.</text>
</subclause></clause><clause id="IDc1e8efd323dd49f0a7ca9b529eefbd10"><enum>(iv)</enum><header>Turnaround
model</header><text>A turnaround model is one in which the local educational
agency—</text>
<subclause id="idFD47F6C53253492DB83E1DF17511B8B5"><enum>(I)</enum><text>if the principal
has led the school for 2 or more years, replaces the principal with a new
principal who has demonstrated effectiveness in turning around a low-performing
school;</text>
</subclause><subclause id="id72275AA6C6554EF3AB198032A48716CD"><enum>(II)</enum><text>gives the new
principal sufficient operational flexibility (including over staffing, the
school day and school calendar, and budgeting) to fully implement a
comprehensive approach to improve student outcomes;</text>
</subclause><subclause id="ID28a560ec77b94878950c1474525a274a"><enum>(III)</enum><text>using
comprehensive evaluation systems, including the use of student achievement data
to measure the effectiveness of staff who can work within the turnaround
environment to meet the needs of students—</text>
<item id="id88BB276670F644B88D1F2891F6DFF056"><enum>(aa)</enum><text>screens all
existing staff and retains not more than 50 percent of such staff; and</text>
</item><item id="id0985BA4E056B4A819ED4CDE5BB720A2A"><enum>(bb)</enum><text>requires the
principal to justify personnel decisions, such as hiring, dismissal, and
providing rewards, based on results of such evaluations;</text>
</item></subclause><subclause id="IDcb328995a880452e88de8610f0215d51"><enum>(IV)</enum><text>provides staff
with ongoing, high-quality, job-embedded professional development that is
aligned with the school’s instructional program, facilitates effective teaching
and learning, and supports the implementation of school-reform
strategies;</text>
</subclause><subclause id="IDadc41fb4b9374feda04e2606048b0119"><enum>(V)</enum><text>adopts a new
governance structure for the school, which may include requiring the school to
report to a new turnaround office in the local educational agency or State
educational agency, hire a turnaround leader who reports directly to the
Superintendent or Chief Academic Officer, or enter into a multi-year agreement
with the local educational agency or State educational agency to obtain added
flexibility in exchange for greater accountability;</text>
</subclause><subclause id="ID95fa24bc2be84bfb9e496c556b86d8ce"><enum>(VI)</enum><text>uses data to
identify and implement a research-based instructional program and promotes the
continuous use of data to evaluate school improvement strategies and to inform
the differentiated instruction in order to meet the academic needs of
individual students;</text>
</subclause><subclause id="id53C0850DDE8A4471BDEBACE60F002EED"><enum>(VII)</enum><text>encourages the
use of extended learning time partnerships;</text>
</subclause><subclause id="ID6ba8f814fe5e439da90445ef44bcb4fe"><enum>(VIII)</enum><text>establishes
schedules and strategies that provide increased learning time, which may
include offering full-day kindergarten or a high-quality preschool program or
using a longer school day, week, or year that increases the total number of
school hours for the school year at a school by not fewer than 300 hours to
significantly increase the total number of school hours to include additional
time for—</text>
<item id="id6A5A944C34DC4F4AA4F2B23F872BA78E"><enum>(aa)</enum><text>instruction in
such core academic subjects as English, reading or language arts, mathematics,
science, foreign languages, civics and government, economics, arts, history,
and geography;</text>
</item><item id="id8A3BF40573C441D5AEDE4B0BCA3A3B25"><enum>(bb)</enum><text>instruction in
other subjects and enrichment activities that contribute to a well-rounded
education, such as physical education, service learning, and experiential and
work-based learning opportunities that are provided by partnering, as
appropriate, with other organizations; and</text>
</item><item id="id822ED54738DB460C8EEA14327CE42C92"><enum>(cc)</enum><text>teachers to
collaborate, plan, and engage in professional development within and across
grades and subjects;</text>
</item></subclause><subclause id="IDa265e5a09fa543dab0132f20fe88d72a"><enum>(IX)</enum><text>provides ongoing
mechanisms for family and community engagement;</text>
</subclause><subclause id="IDc8b552dc351e4be688add92aae3b57a6"><enum>(X)</enum><text>provides
appropriate social-emotional and community-oriented services and supports for
students; and</text>
</subclause><subclause id="ID99e3166c2727411a8353577d3bc18923"><enum>(XI)</enum><text>may include any
of the strategies described in clause (i).</text>
</subclause></clause></subparagraph><subparagraph commented="no" id="ID3ade8cd3cb4d46f68d412eb5b774fb12"><enum>(C)</enum><header>Using funds for
comprehensive services To address issues</header><text>In implementing any of
the school intervention models described in subparagraph (B), the local
educational agency—</text>
<clause commented="no" id="id6386984460DA4C2E925091BD38E6C08A"><enum>(i)</enum><text>shall identify
and address issues that may contribute to low academic achievement in those
schools; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id7F7BCFED0F79452B80B8788D6D4BD913"><enum>(ii)</enum><text>may use funds
under this subsection to provide comprehensive services to address those issues
and meet the full range of student needs.</text>
</clause></subparagraph></paragraph><paragraph id="idB548FE4B5BCC4ABCB6FA8C5EB607C940"><enum>(7)</enum><header>Reservation and
allotments</header><text display-inline="yes-display-inline">From the total
amount appropriated under paragraph (8), the Secretary may reserve not more
than 10 percent to carry out activities of national significance, such
as—</text>
<subparagraph id="id18A1FA7595174A8FA83190EAE7DB7823"><enum>(A)</enum><text>building State
and local educational agency turnaround capacity, including through technical
assistance and support, identification and dissemination of best practices, and
facilitating the creation and operation of communities of practice;</text>
</subparagraph><subparagraph id="id013FF829FE3D43B4BEEF375A7768A6E9"><enum>(B)</enum><text>supporting the
use of school quality review teams by making grants to State educational
agencies, consortia of such agencies, or partnerships of State educational
agencies or State consortia and public or private nonprofit organizations to
develop and implement school quality review teams that review and provide
support and technical assistance to local educational agencies and schools for
activities such as expanded learning time;</text>
</subparagraph><subparagraph id="id2EDB76F998E040A7A554F431A7679B59"><enum>(C)</enum><text>identifying and
disseminating effective rural turnaround practices, making available targeted
technical assistance, and expanding the availability and capacity of turnaround
partners that operate in rural areas;</text>
</subparagraph><subparagraph id="idE2BC92EB5D3547218C891C0D3C756FC7"><enum>(D)</enum><text>identifying
schools and school improvement partners that are effectively implementing
school intervention models and other effective strategies to improve schools,
and making information on those schools available to State educational
agencies, local educational agencies, and schools in a manner that facilitates
replication of effective practices; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id62C17D2728494871900E034420D8EA94"><enum>(E)</enum><text>other activities
designed to support State and local efforts to turn around persistently
low-performing schools.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1DFB04C1C1DD4DE7A3C6D63028AB3331"><enum>(8)</enum><header>Authorization
of appropriations</header><text>There are authorized to be appropriated to
carry out this subsection $600,000,000 for fiscal year 2014 and such sums as
may be necessary for each of the 5 succeeding fiscal
years.</text>
