			 <quote><short-title>Lead Exposure Reduction Amendments Act
			 of 2013</short-title></quote>.</text>
		</section><section id="H905AFCABEEB4433A82324DFCD2D4E500"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 401 of the Toxic Substances Control
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2681">15 U.S.C. 2681</external-xref>) is amended—</text>
			<paragraph id="HE5D87D56B1C5421DBC80C4DCE4C807AC"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
				<subparagraph id="H4DAB864D148346B581EE39447762BC00"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (A) and (B)
			 as clauses (i) and (ii), respectively, and indenting the clauses
			 appropriately;</text>
				</subparagraph><subparagraph id="H3121E3416ECF43A498C0438839AC9A3B"><enum>(B)</enum><text>in the first
			 sentence, by striking <quote>The term</quote> and inserting the
			 following:</text>

				term <term>abatement</term> does not include any renovation, remodeling, or
				other activity—</text>
							<clause id="HD41B36620BD14E529A47D517B866547E"><enum>(i)</enum><text display-inline="yes-display-inline">the primary purpose of which is to repair,
				restore, or remodel target housing, public buildings constructed before 1978,
				or commercial buildings; and</text>
							</clause><clause id="HCF59E0FDA0C04A69BA0CBEFA55983B62"><enum>(ii)</enum><text>that incidentally
				results in a reduction or elimination of lead-based paint
				hazards.</text>
							</clause></subparagraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HF001727339724C1FB693489A4C0880D0"><enum>(2)</enum><text>by
			 redesignating—</text>
				<subparagraph id="HB19B5C3EB43F490C8941F609BC145A84"><enum>(A)</enum><text>paragraphs (4)
			 through (12) as paragraphs (5) through (13);</text>
				</subparagraph><subparagraph id="H36E8A68AC6394574B6006D3A1BA981B5"><enum>(B)</enum><text>paragraph (13) as
			 paragraph (15); and</text>
				</subparagraph><subparagraph id="H1ABE82A7E1F04651AD0968122B4186C3"><enum>(C)</enum><text>paragraphs (14)
			 through (17) and paragraphs (18) through (21), respectively;</text>
				</subparagraph></paragraph><paragraph id="H9A9EF24C71D14D3E82BFFBBE9DB2C090"><enum>(3)</enum><text>by inserting after
			 paragraph (3) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HA8F5C9B0C8AE4DD5B5ABF604E88075A6" style="OLC">
					<paragraph id="H12FED65AFB6E41A48B1C8BF8404CC496"><enum>(4)</enum><header>Emergency
				renovation</header><text display-inline="yes-display-inline">The term
				<term>emergency renovation</term> means a renovation or remodeling activity
				that is carried out in response to an event—</text>
						<subparagraph commented="no" id="HA7548BBEEE38494DBA467372EB2D75FE"><enum>(A)</enum><text>that is an act of
				God, as that term is defined in section 101(1) of the Comprehensive
				Environmental Response, Compensation, and Liability Act of 1980; or</text>
						</subparagraph><subparagraph id="H616DAF77749847C99F48A7085B29B9D8"><enum>(B)</enum><text display-inline="yes-display-inline">that if not attended to as soon as is
				practicable—</text>
							<clause id="H8880CDEF279F429982BF388E5DCB75D8"><enum>(i)</enum><text>presents a risk to
				the public health or safety; or</text>
							</clause><clause id="H88E08734F2B247DE91118EE48C258CA8"><enum>(ii)</enum><text>threatens to
				cause significant damage to equipment or
				property.</text>
							</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H56805D2427034DB18FACBA6702278C52"><enum>(4)</enum><text>by striking
			 paragraph (10) (as redesignated by paragraph (2)) and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HB0B04CC2594841DFB28F687BFA3C8BD9" style="OLC">
					<paragraph commented="no" id="H9E2E5DC25BF64160B3B4D760E3C04140"><enum>(10)</enum><header>Lead-based
				paint</header>
						<subparagraph commented="no" id="H55340279C7DF49779C60DB46F4485917"><enum>(A)</enum><header>In
				general</header><text>The term <term>lead-based paint</term> means paint or
				other surface coatings that contain lead in excess of—</text>
							<clause commented="no" id="H6B0FDDD40021492B85CD4C85D3534C23"><enum>(i)</enum><text>1.0 milligrams per
				centimeter squared; or</text>
							</clause><clause commented="no" id="H28465ACFA1D04E3A98829001EF05A2D7"><enum>(ii)</enum><text>0.5 percent by
				weight.</text>
							</clause></subparagraph><subparagraph commented="no" id="H95544396A10846DAA3657977B9F5DEBE"><enum>(B)</enum><header>Target
				housing</header><text display-inline="yes-display-inline">With respect to paint
				or other surface coatings on target housing, the term <term>lead-based
				paint</term> means paint or other surface coatings that contain lead in excess
				of the lower of—</text>
							<clause commented="no" id="H42474F0A79624DEF9FB663CAC77002F2"><enum>(i)</enum><text>the level
				described in subparagraph (A); or</text>
							</clause><clause commented="no" id="HBEF230A5198E4A2CBED0748CC2B12568"><enum>(ii)</enum><text>a level
				established by the Secretary of Housing and Urban Development under section
				302(c) of the Lead-Based Paint Poisoning Prevention
				Act.</text>
							</clause></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" id="H45356777625543C2983BA684DDE5EAB5"><enum>(5)</enum><text>by inserting after
			 paragraph (13) (as redesignated by paragraph (2)) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H3F46B9216B3E475B955206DC89B263F7" style="OLC">
					<paragraph commented="no" id="H79836A3C77454CA8936266B6A19E1F81"><enum>(14)</enum><header>Postabatement
				clearance testing</header><text>The term <term>postabatement clearance
				testing</term> means testing that—</text>
						<subparagraph commented="no" id="H8D85F95D9332452BAFB69382891B4B45"><enum>(A)</enum><text>is carried out
				upon the completion of any lead-based paint activity to ensure that—</text>
							<clause commented="no" id="HD778EAE9B66347F8AC7D30CEC785CA3C"><enum>(i)</enum><text>the reduction is
				complete; and</text>
							</clause><clause commented="no" id="H6AC38FA6FB33478FB5768FEF5C359316"><enum>(ii)</enum><text display-inline="yes-display-inline">no lead-based paint hazards remain in the
				area in which the lead-based paint activity occurs; and</text>
							</clause></subparagraph><subparagraph commented="no" id="H2EB47689C80846FA86597E2E44537A20"><enum>(B)</enum><text display-inline="yes-display-inline">includes a visual assessment and the
				collection and analysis of environmental samples from an area in which
				lead-based paint activities occur.</text>
						</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" id="H5754D31173CE40BDB9A90C511E0D5DBC"><enum>(6)</enum><text display-inline="yes-display-inline">by inserting after paragraph (15) (as
			 redesignated by paragraph (2)) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDD1C7C92C95643549F68EC6EADB3D065" style="OLC">
					<paragraph commented="no" id="HBB374857FB3F4AA8B6380283232C1C14"><enum>(16)</enum><header>Renovation</header><text>The
				term <term>renovation</term> has the meaning given such term in section 745.83
				of title 40, Code of Federal Regulations, as in effect on the date of enactment
				of this paragraph.</text>
					</paragraph><paragraph commented="no" id="HE12611BB27C843E983FAF419FBCF7DE6"><enum>(17)</enum><header>Renovation and
				remodeling regulation</header><text display-inline="yes-display-inline">The
				term <term>renovation and remodeling regulation</term> means a regulation
				promulgated under section 402(a) and revised pursuant to section 402(c)(3)(A),
				as such regulation is applied to renovation or remodeling activities in target
				housing, public buildings constructed before 1978, and commercial
				buildings.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H1670711B9B7443A3ABDC29DB8EFD9F14"><enum>3.</enum><header>Lead-based paint
			 activities training and certification</header><text display-inline="no-display-inline">Section 402(c) of the Toxic Substances
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2682">15 U.S.C. 2682(c)</external-xref>) is amended—</text>
			<paragraph id="H3592D1D841E04FD7BC5B81F4175EF8F2"><enum>(1)</enum><text>by striking
			 paragraph (2) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HA1C195DD6ACC4580B4F910C1E266D158" style="OLC">
					<paragraph id="HA2EDB28885DB482CB88231DB60F3F90F"><enum>(2)</enum><header>Study of
				certification</header>
						<subparagraph id="HE1EFCE554DC04499A23E0D67C9CF21D6"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 1 year
				prior to proposing any renovation and remodeling regulation after the date of
				enactment of the Lead Exposure Reduction Amendments Act of 2012, the
				Administrator shall conduct, submit to the Congress, and make available for
				public comment (after peer review) the results of, a study of the extent to
				which persons engaged in various types of renovation and remodeling activities
				in target housing, public buildings constructed before 1978, or commercial
				buildings—</text>
							<clause id="H3F97FCC512CE438EA0F2EC3DE99BC297"><enum>(i)</enum><text>are exposed to
				lead in the conduct of such activities; and</text>
							</clause><clause id="HB264B6C48EC84EC496F658AB9109554B"><enum>(ii)</enum><text>disturb lead and
				create a lead-based paint hazard on a regular or occasional basis in the
				conduct of such activities.</text>
							</clause></subparagraph><subparagraph commented="no" id="H5FB34E9C06E049D4B7AB017477DDF4A0"><enum>(B)</enum><header>Scope and
				coverage</header><text display-inline="yes-display-inline">Each study conducted
				under subparagraph (A) shall consider the risks described in clauses (i) and
				(ii) of such subparagraph with respect to each separate building type described
				in such subparagraph, as the regulation to be proposed would apply to each such
				building type.</text>
						</subparagraph></paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HB980665A9628478E99C7541FE83A8E45"><enum>(2)</enum><text>in paragraph
			 (3)—</text>
				<subparagraph id="H9A582BF078274E0185BF59C1DD8FBD8A"><enum>(A)</enum><text>in the first
			 sentence by striking <quote>Within 4 years</quote> and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HD97CC023304246CEBD786E94A4911720" style="OLC">
						<subparagraph id="HE19611A74F8042DD9F51B2150C125FC4"><enum>(A)</enum><header>In
				general</header><text>Not later than 4
				years</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="H0D94CB579492421DA6BEFCACD1F6507F"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H9D253F0C33F7420E88332E710B0A7EB1" style="OLC">
						<subparagraph id="HD5A3BA2121D54390A80CA2D9F7AC7B6B"><enum>(B)</enum><header>Exemption</header><text display-inline="yes-display-inline">An emergency renovation shall be exempt
				from any renovation and remodeling regulation, and a person carrying out an
				emergency renovation shall be exempt from any regulation promulgated under
				section 406(b) with respect to the emergency renovation.</text>
						</subparagraph><subparagraph id="HCCB02A9389B94B71AD78B0CBCB8B2A9A"><enum>(C)</enum><header>Prohibition on
				postabatement clearance requirement</header><text display-inline="yes-display-inline">No renovation and remodeling regulation may
				require postabatement clearance
				testing.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H838DE1BF98264039A7E6A82388501F84"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD6E602D1713F41009A7338E6E8D8F425" style="OLC">
					<paragraph id="HBF622B3010B8433BA0678CDF1695AFCC"><enum>(4)</enum><header>Target housing
				owners</header>
						<subparagraph id="H1189AC5DD7264C13AD30F999AA089900"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 60
				days after the date of enactment of this paragraph, and subject to subparagraph
				(B), the Administrator shall promulgate regulations to permit an owner of a
				residential dwelling that is target housing, who resides in such residential
				dwelling, to authorize a contractor to forgo compliance with the requirements
				of a renovation and remodeling regulation with respect to such residential
				dwelling.</text>
						</subparagraph><subparagraph id="H1307242CAB11423F81E1D870DCD7A361"><enum>(B)</enum><header>Written
				certification</header><text>The regulations promulgated under subparagraph (A)
				shall require that an owner of a residential dwelling that is target housing,
				who resides in such residential dwelling, may only authorize a contractor to
				forgo compliance with the requirements of a renovation and remodeling
				regulation if the owner submits to such contractor a written certification
				stating that—</text>
							<clause id="HA89C9164A2E84F129D6E89EA1F3EAFA0"><enum>(i)</enum><text display-inline="yes-display-inline">the renovation or remodeling project is to
				be carried out at the residential dwelling in which the owner resides;</text>
							</clause><clause id="HC58D95CC001F496FA463D9B2F7049A65"><enum>(ii)</enum><text display-inline="yes-display-inline">no pregnant woman or child under the age of
				6 resides in the residential dwelling as of the date on which the renovation or
				remodeling project commences, or will reside in the residential dwelling for
				the duration of such project; and</text>
							</clause><clause id="H55CA259537D44CC48DCE0FF85AAF2F2B"><enum>(iii)</enum><text display-inline="yes-display-inline">the owner acknowledges that, in carrying
				out the project, such contractor will be exempt from the requirements of a
				renovation and remodeling regulation.</text>
							</clause></subparagraph><subparagraph id="H5A8718E302284F71B5CEFADA21B25544"><enum>(C)</enum><header>Restriction</header><text>A
				contractor may not forgo compliance with the requirements of a renovation and
				remodeling regulation pursuant to a written certification submitted under
				subparagraph (B) if such contractor has actual knowledge of a pregnant woman or
				child under the age of 6 residing in the residential dwelling as of the date on
				which the renovation or remodeling commences (and for the duration of such
				project).</text>
						</subparagraph><subparagraph commented="no" id="H4368CC4A8F364639868242F67FC11D16"><enum>(D)</enum><header>Limitation of
				contractor liability</header><text>The Administrator may not hold a contractor
				responsible for a misrepresentation made by the owner of a residential dwelling
				in a written certification submitted under subparagraph (B), unless the
				contractor has actual knowledge of such a misrepresentation.</text>
						</subparagraph></paragraph><paragraph id="H4C598437CA7F430DA3F54CD6EE1CBC77"><enum>(5)</enum><header>Test
				kits</header>
						<subparagraph commented="no" id="HEECC333F39654AB0A0A68B1F60AA91E5"><enum>(A)</enum><header>In
				general</header>
							<clause commented="no" id="H7784BD56B02647188C52F35AE0CD3431"><enum>(i)</enum><header>Recognition</header><text>The
				Administrator shall recognize for use under this title a qualifying test kit,
				and publish in the Federal Register notice of such recognition.</text>
							</clause><clause commented="no" id="HBC6A7DEB7C104196985D37511EA8D4C8"><enum>(ii)</enum><header>Suspension of
				enforcement of certain regulations</header><text display-inline="yes-display-inline">If, not later than 1 year after the date of
				enactment of this paragraph, the Administrator does not recognize a qualifying
				test kit under clause (i), the Administrator—</text>
								<subclause commented="no" id="H121813B23EC84D18A40795F548782A13"><enum>(I)</enum><text>shall publish in
				the Federal Register notice of such failure to recognize a qualifying test kit;
				and</text>
								</subclause><subclause commented="no" id="H0D8B44FFA92043E3AE461D434AA37DF7"><enum>(II)</enum><text>except as
				provided in clause (iii), may not enforce any post-1960 building renovation and
				remodeling regulation, with respect to a period beginning on the date that is 1
				year after the date of enactment of this paragraph and ending on the date that
				is 6 months after the date on which the Administrator—</text>
									<item commented="no" id="HA7B96193E9E54F73AACF14C45694107A"><enum>(aa)</enum><text>recognizes for
				use under this title a qualifying test kit; and</text>
									</item><item commented="no" id="HAB4734E407C54E74BA6608EA23984B95"><enum>(bb)</enum><text>publishes in the
				Federal Register notice of such recognition and of the date on which
				enforcement of the post-1960 building renovation and remodeling regulations
				will resume.</text>
									</item></subclause></clause><clause commented="no" id="H25D1C48CAB954BD59CEDD92D6C8F2172"><enum>(iii)</enum><header>Applicability
				of suspension</header><text display-inline="yes-display-inline">The
				Administrator shall not suspend enforcement of any post-1960 building
				renovation and remodeling regulation for the period described in clause
				(ii)(II) with respect to a residential dwelling in which a pregnant woman or
				child under the age of 6 resides.</text>
							</clause></subparagraph><subparagraph id="H22F69820B2374BEB8C2348B219279FA7"><enum>(B)</enum><header>Qualifying test
				kit</header><text display-inline="yes-display-inline">In this subsection, the
				term <term>qualifying test kit</term> means a chemical test that—</text>
							<clause id="HC2EC8CDF93AA48F0A075F1994C90A18B"><enum>(i)</enum><text display-inline="yes-display-inline">can determine the presence of lead-based
				paint, as defined in section 401(10)(A);</text>
							</clause><clause id="H835DBC0126E242EB902C05D3CC0779C7"><enum>(ii)</enum><text>has a false
				positive response rate of 10 percent or less;</text>
							</clause><clause id="H89864264D1C24384ADF4ACB4AE6B27A8"><enum>(iii)</enum><text>has a false
				negative response rate of 5 percent or less;</text>
							</clause><clause id="HCF34FD1E78C045ADBD94F15EA0DAC708"><enum>(iv)</enum><text>does not require
				the use of off-site laboratory analysis to obtain results;</text>
							</clause><clause id="H175DFDE0D5994BC2A99621DB0002963E"><enum>(v)</enum><text>is
				inexpensively and commercially available; and</text>
							</clause><clause id="HEB47472A530141A2A0C9B5BABB15F071"><enum>(vi)</enum><text>does not require
				special training to use.</text>
							</clause></subparagraph><subparagraph commented="no" id="H057446540A344A6A8C3BDE67E8B14AF5"><enum>(C)</enum><header>Post-1960
				building renovation and remodeling regulation</header><text>In this subsection,
				the term <term>post-1960 building renovation and remodeling regulation</term>
				means a renovation and remodeling regulation, as it applies to—</text>
							<clause commented="no" id="HB6A32D50A6DF45A3B97628E6545D1F52"><enum>(i)</enum><text>target housing
				constructed after January 1, 1960;</text>
							</clause><clause commented="no" id="H73E0E802527E4D87B970BBF6F13EE5BC"><enum>(ii)</enum><text display-inline="yes-display-inline">public buildings constructed between
				January 1, 1960 and January 1, 1978; and</text>
							</clause><clause commented="no" id="H013C12F80E984A6BB9F338866746B35A"><enum>(iii)</enum><text display-inline="yes-display-inline">commercial buildings constructed after
				January 1, 1960.</text>
							</clause></subparagraph></paragraph><paragraph id="HAAE9E495A5C4485ABBCA23AEB2C4E3BA"><enum>(6)</enum><header>Applicability of
				certain penalties</header><text>Any renovation and remodeling regulation
				requiring the submission of documentation to the Administrator shall
				provide—</text>
						<subparagraph id="H7883537C46C14636B022CA6E1A68A1FB"><enum>(A)</enum><text>an exemption from
				an applicable penalty for failure to comply with such requirement for a person
				who—</text>
							<clause id="HCAEF104F2F7C4909B21AF05D20D0D087"><enum>(i)</enum><text>is
				submitting the required documentation for the first time; and</text>
							</clause><clause id="H57EE33672C8F4CDE8845A9C36A66B0ED"><enum>(ii)</enum><text>submits
				documentation that contains only de minimus or typographical errors, as
				determined by the Administrator; and</text>
							</clause></subparagraph><subparagraph id="H2ED880AE9FD94793A998A927C420B388"><enum>(B)</enum><text>a process by which
				a person described in subparagraph (A) may resubmit the required
				documentation.</text>
						</subparagraph></paragraph><paragraph commented="no" id="HC5507AD663D64FC2A22143FA99F90020"><enum>(7)</enum><header>Accreditation of
				recertification courses</header><text display-inline="yes-display-inline">The
				hands-on training requirements required by subsection (a)(2)(D) shall not apply
				to any recertification course accredited by the Environmental Protection Agency
				that is otherwise required to be completed under this title by a person that is
				certified to engage in renovation and remodeling
				activities.</text>
