		<official-title>To amend the Elementary and Secondary Education Act of
		  1965 by establishing a program to support the modernization, renovation, or
		  repair of career and technical education facilities, and for other
		  purposes.</official-title>

		<section id="id53E93EB2E4974073B84165D0196B08F2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Career and Technical Education
			 Facilities Modernization Act</short-title></quote>.</text>
		</section><section id="id24DA3C2FEF694166A68437B7BF67647B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="id2002da3079ea4f5da861870cbd0dc7ed"><enum>(1)</enum><text>Career and
			 technical education teaches academic subject matter in ways that are relevant
			 and consistent to the real world.</text>
			</paragraph><paragraph id="idb47f044260ce4ed5ba228e146ef12f8a"><enum>(2)</enum><text>Vocational
			 education can reflect developmental needs by helping students recognize their
			 interests, aptitudes, and abilities in age- and stage-appropriate ways.</text>
			</paragraph><paragraph id="ida03e6eb6c71f4029b52b8a73fe7bde89"><enum>(3)</enum><text>In order for
			 students to be high-performing, the education facilities used by the students
			 must also be high-performing.</text>
			</paragraph><paragraph id="id1f05c8d28bc04713a3a263e7d5af2c7b"><enum>(4)</enum><text>Many school
			 facilities that offer vocational or career and technical education are
			 inefficient and outdated.</text>
			</paragraph></section><section id="id91E8E41C562947049A2F20F126F6D86C"><enum>3.</enum><header>Career and
			 technical education facilities</header>
			<subsection id="id1E2BC06B84EB4D9B9AF8DD9EE3682D97"><enum>(a)</enum><header>Career and
			 technical education facilities</header><text display-inline="yes-display-inline">Part D of title V of the Elementary and
			 Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7241">20 U.S.C. 7241 et seq.</external-xref>) is amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id25B759EEDA844926A69296B7C87D2BD2" style="OLC">
					<subpart id="id3233266B3EFA495AA0FACC14B712C9DF"><enum>22<?LEXA-Enum 22?></enum><header>Career and technical education facilities</header>
						<section id="idfac001b3bfe14c02bf60903d15e10662"><enum>5621.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subpart:</text>
							<paragraph id="id1d2e03e0416a4c5e9d591c94fd593d2f"><enum>(1)</enum><header>Career and
				technical education</header><text>The term <term>career and technical
				education</term> has the meaning given the term in section 3 of the Carl D.
				Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>).</text>
							</paragraph><paragraph id="idbbdf5fe963aa41afb0418b8129065b9c"><enum>(2)</enum><header>Community
				college</header><text>The term <term>community college</term> means—</text>
								<subparagraph id="id5930986533dc49af8973ba0b60005aa7"><enum>(A)</enum><text>a junior or
				community college, as that term is defined in section 312(f) of the Higher
				Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1058">20 U.S.C. 1058(f)</external-xref>); or</text>
								</subparagraph><subparagraph id="id759daf37755744f89ba680324975c021"><enum>(B)</enum><text>an institution of
				higher education (as defined in section 101 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)) that
				awards a significant number of degrees and certificates, as determined by the
				Secretary, that are not—</text>
									<clause id="id56912cc83d234a1cb1987132d97f8483"><enum>(i)</enum><text>baccalaureate
				degrees (or an equivalent); or</text>
									</clause><clause id="idc75763d53c69455fb8182d336807677c"><enum>(ii)</enum><text>master’s,
				professional, or other advanced degrees.</text>
									</clause></subparagraph></paragraph><paragraph id="idD62ED623AAAF49E08B01CD3C1D336608"><enum>(3)</enum><header>Eligible
				entity</header><text>The term <term>eligible entity</term> means a local
				educational agency, community college, or other entity determined appropriate
				by the Secretary.</text>
							</paragraph><paragraph id="ide3ce09c5e14840dfb1f38c0011854c30"><enum>(4)</enum><header>Qualified
				project</header><text>The term <term>qualified project</term>—</text>
								<subparagraph id="id9072A539CE3B4AFEB452D5D60FE29BEB"><enum>(A)</enum><text>means the
				modernization, renovation, or repair of a facility that will be used to improve
				the quality and availability of science, technology, engineering, mathematics,
				or career and technical education instruction to public elementary school or
				secondary school, or community college students, and that may include—</text>
									<clause id="id1c5efe4940a841a2b0864e4dee9c750e"><enum>(i)</enum><text>improving the
				energy efficiency of the facility;</text>
									</clause><clause id="id29aa632df8644de58d9ac10b476e806e"><enum>(ii)</enum><text>improving the
				cost-effectiveness of the facility in delivering quality education;</text>
									</clause><clause id="id1ed07c0632d342a4ace742ec0e53f42e"><enum>(iii)</enum><text>improving
				student, faculty, and staff health and safety at the facility;</text>
									</clause><clause id="id7c570a495f44499fa560d59f1e3ad409"><enum>(iv)</enum><text>improving,
				installing, or upgrading educational technology infrastructure;</text>
									</clause><clause id="idf8ab44f889a94bdda7689f9f825ea10f"><enum>(v)</enum><text>retrofitting an
				existing building for career and technical education purposes; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id543ff04e3b3b46599ad0ae7562ffbe4e"><enum>(vi)</enum><text>a one-time
				repair of serviceable equipment at the facility, or replacement of equipment at
				the facility that is at the end of its serviceable lifespan, that will be used
				to further educational outcomes; and</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id890E932835924E3B865FCEF8BDB78DBF"><enum>(B)</enum><text>does not include
				new construction or the payment of routine maintenance costs.</text>
								</subparagraph></paragraph></section><section id="idE8ED7B5BFCB74617A4B3289327774675"><enum>5622.</enum><header>Career and
				technical education facilities improvement</header>
							<subsection id="id811958E004EE468EAC1E43A6CFAE944A"><enum>(a)</enum><header>Program
				authorized</header><text display-inline="yes-display-inline">From amounts
				appropriated under section 5401(b), the Secretary shall carry out a program to
				improve career and technical education facilities by—</text>
								<paragraph id="idD0B1C67ADBB141ADA572004582ECB463"><enum>(1)</enum><text display-inline="yes-display-inline">awarding grants to eligible entities to
				enable the eligible entities to carry out qualified projects;</text>
								</paragraph><paragraph id="id2C27178991A440A597BA9EA5E88CB9E8"><enum>(2)</enum><text display-inline="yes-display-inline">guaranteeing loans made to eligible
				entities for qualified projects; or</text>
								</paragraph><paragraph id="idE02E4BCC61C44F99B3AFC1925944850C"><enum>(3)</enum><text display-inline="yes-display-inline">making payments of interest on bonds,
				loans, or other financial instruments (other than a refinancing) that are
				issued to eligible entities for qualified projects.</text>
								</paragraph></subsection><subsection id="ide6b8c687c96743b78c1320863bcf2bc5"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity that desires to receive
				a grant, loan guarantee, or payment of interest under this subpart shall submit
				an application to the Secretary at such a time, in such a manner, and
				containing such information as the Secretary may require. The application shall
				include—</text>
								<paragraph id="id6e7404b0e71c4b6ab514ec68c8887060"><enum>(1)</enum><text>a detailed
				description of the qualified project;</text>
								</paragraph><paragraph id="id47A844FBAFAE470E9BB2C51E936FCE81"><enum>(2)</enum><text>in the case of a
				qualified project described in section 5621(4)(A)(vi), a description of the
				educational outcomes to be furthered by the one-time repair of serviceable
				equipment or replacement of equipment;</text>
								</paragraph><paragraph id="id053391ee261f46d1bf2e23cd7c345d78"><enum>(3)</enum><text>an indication as
				to whether the eligible entity prefers to receive a grant, loan guarantee, or
				payment of interest;</text>
								</paragraph><paragraph id="id9c8193b535f14293a50813f8095b8047"><enum>(4)</enum><text>a description of
				the need for the qualified project;</text>
								</paragraph><paragraph id="id32113f6be3d04ecbbe9fa68300dee3dc"><enum>(5)</enum><text>a description of
				how the eligible entity will ensure that the qualified project will be
				adequately maintained;</text>
								</paragraph><paragraph id="id4ab73b758ae740728512213f2fb7b460"><enum>(6)</enum><text>an identification
				of any public elementary school or secondary school or community college that
				will benefit from the qualified project;</text>
								</paragraph><paragraph id="iddd8a1c281b7649b1978ec900515d390b"><enum>(7)</enum><text>a description of
				how the qualified project will improve instruction and educational outcomes at
				the facility;</text>
								</paragraph><paragraph id="id693ccc858d7841588cb6d63784acbd00"><enum>(8)</enum><text>a description of
				how the facility supported by the qualified project will be used for providing
				educational services in science, technology, engineering, mathematics, or
				career and technical education;</text>
								</paragraph><paragraph id="id5b8a0ec976f44722b7434a9b658919f9"><enum>(9)</enum><text>a description of
				how the eligible entity will ensure that the modernization, renovation, or
				repair supported by the qualified project meets Leadership in Energy and
				Environmental Design (LEED) building rating standards, Energy Star standards,
				Collaborative for High Performance Schools (CHPS) criteria, Green Building
				Initiative environmental design and rating standards (Green Globes), or
				equivalent standards adopted by entities with jurisdiction over or related to
				the eligible entity;</text>
								</paragraph><paragraph id="idfa7bc368730f455eb9070692f80ed023"><enum>(10)</enum><text>a description of
				the fiscal capacity of the eligible entity;</text>
								</paragraph><paragraph id="id701297c043b34458911088ab4254ab88"><enum>(11)</enum><text>the percentage
				of students enrolled in the public elementary school or secondary school or
				community college to be served by the qualified project who are from low-income
				families;</text>
								</paragraph><paragraph commented="no" id="id92da76025fef44dbb2cc6f69bf0ae8d2"><enum>(12)</enum><text>in the case of a
				qualified project at a facility that is used by students in a secondary school,
				the secondary school graduation rates; and</text>
								</paragraph><paragraph id="id94d5368a087847c784452481e7b0dfb5"><enum>(13)</enum><text>such additional
				information and assurances as the Secretary may require.</text>
								</paragraph></subsection><subsection id="idbe6e824896e34eb68a21f3f30c6d49a0"><enum>(c)</enum><header>Priority</header><text>In
				making awards under this subpart, the Secretary shall use not less than a total
				of 25 percent of the funds appropriated under section 5401(b) to eligible
				entities for qualified projects to benefit—</text>
								<paragraph id="id2168720FC2394790901769C18F83D581"><enum>(1)</enum><text>public elementary
				schools or secondary schools served by local educational agencies that are
				eligible to receive assistance under part B of title VI; or</text>
								</paragraph><paragraph id="id5F4EEFA55E3C4D6AB7E318FA06CD9562"><enum>(2)</enum><text>community
				colleges serving a substantial number of rural students, as determined by the
				Secretary.</text>
								</paragraph></subsection><subsection id="id7ec6acc011624660bdd89ec2f7e9ac9c"><enum>(d)</enum><header>Supplement not
				supplant</header><text>Funds made available under this subpart shall be used to
				supplement, and not supplant, other Federal and State funds available to carry
				out the activities supported under this subpart.</text>
							</subsection><subsection id="id2492deea5b55449aa572d6326f00342a"><enum>(e)</enum><header>Technical
				assistance and administrative costs</header><text>The Secretary may reserve not
				more than 3 percent of funds appropriated under section 5401(b) for the
				administrative costs of this subpart and to provide technical assistance to
				community colleges and local educational agencies concerning best practices in
				school facility renovation, repair, and modernization.</text>
							</subsection><subsection id="idaa32f2b1182a445b9ac4e51d3f716002"><enum>(f)</enum><header>Reporting
				requirements</header><text display-inline="yes-display-inline">Not later than 1
				year after funds are appropriated to carry out this subpart, and every 2 years
				thereafter, the Secretary shall prepare and submit to the appropriate
				committees of Congress a report on the effect of the qualified projects
				supported under this subpart on improving academic
				achievement.</text>
							</subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id18DE15D898EC49C68B11FD2F42AA1FB5"><enum>(b)</enum><header>Authorization
			 of appropriations</header><text>Section 5401 of the Elementary and Secondary
			 Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7241">20 U.S.C. 7241</external-xref>) is amended—</text>
				<paragraph id="id439289CD72224AF4B005DF2680D7682B"><enum>(1)</enum><text>by striking the
			 matter preceding paragraph (1) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id97690E0592924192A4E972D591BFB3BE" style="OLC">
						<subsection id="id618BA8D913A7435AAA37EF5396696526"><enum>(a)</enum><header>In
				general</header><text>There are authorized to be appropriated to carry out this
				part (except for subpart 22) the following
				amounts:</text>
						</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id4448CAEDB10E4D57BF600E4D9BD2C50D"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id5A641B682C1E4096B2A041257A1E8DDB" style="OLC">
						<subsection id="id1776ADF67F474A5FA77F3B2652F4C103"><enum>(b)</enum><header>Authorization
				for subpart 22</header><text>There are authorized to be appropriated to carry
				out subpart 22 $75,000,000 for fiscal year 2014 and each succeeding fiscal
				year.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idD773CA69DF39440488E5F354BE443A1B"><enum>(c)</enum><header>Conforming
			 amendments</header><text>The table of contents in section 2 of the Elementary
			 and Secondary Education Act of 1965 is amended by inserting after the item
			 relating to section 5619 the following:</text>
