			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Criminal Antitrust
			 Anti-Retaliation Act of 2013</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id5c600dbc-cf42-42ac-8417-7ff59ba456bc" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Amendment to
			 ACPERA</header><text display-inline="no-display-inline">The Antitrust Criminal
			 Penalty Enhancement and Reform Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/237">Public Law 108–237</external-xref>; 15 U.S.C. 1
			 note) is amended by adding after section 215 the following:</text><quoted-block display-inline="no-display-inline" id="id6eb9254d-5c0d-41b8-92bb-87f5ef2c14fc" style="OLC"><section commented="no" display-inline="no-display-inline" id="idf793b30b-0a2c-4738-b48b-ca8a99ff4289" section-type="subsequent-section"><enum>216.</enum><header display-inline="yes-display-inline">Anti-retaliation
				protection for whistleblowers</header><subsection commented="no" display-inline="no-display-inline" id="idce1954c1-55ee-42a4-a3c1-7b78de6ec417"><enum>(a)</enum><header display-inline="yes-display-inline">Whistleblower
				protections for employees, contractors, subcontractors, and agents</header><paragraph commented="no" display-inline="no-display-inline" id="id93505ec5-24fd-4e20-8bf9-e97f05c82ad8"><enum>(1)</enum><header display-inline="yes-display-inline">In
				general</header><text display-inline="yes-display-inline">No employer may discharge, demote, suspend, threaten,
				harass, or in any other manner discriminate against a covered individual in the
				terms and conditions of employment of the covered individual because—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc5202239-ba77-4ac1-a66e-1fd8d3af860e"><enum>(A)</enum><text display-inline="yes-display-inline">the covered
				individual provided or caused to be provided to the employer or the Federal
				Government information relating to—</text><clause commented="no" display-inline="no-display-inline" id="id43ee5586-556c-473f-a11b-a14b28bff1af"><enum>(i)</enum><text display-inline="yes-display-inline">any violation of,
				or any act or omission the covered individual reasonably believes to be a
				violation of the antitrust laws; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id410a5eb4-e60e-4bab-b77f-ab7ee2fca713"><enum>(ii)</enum><text display-inline="yes-display-inline">any violation
				of, or any act or omission the covered individual reasonably believes to be a
				violation of another criminal law committed in conjunction with a potential
				violation of the antitrust laws or in conjunction with an investigation by the
				Department of Justice of a potential violation of the antitrust laws; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id442fbcbd-fc52-4035-a846-5f8370815802"><enum>(B)</enum><text display-inline="yes-display-inline">the covered
				individual filed, caused to be filed, testified, participated in, or otherwise
				assisted an investigation or a proceeding filed or about to be filed (with any
				knowledge of the employer) relating to—</text><clause commented="no" display-inline="no-display-inline" id="idbfec7938-8654-4b01-8dda-0766c233b566"><enum>(i)</enum><text display-inline="yes-display-inline">any violation of,
				or any act or omission the covered individual reasonably believes to be a
				violation of the antitrust laws; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idf488ebcf-077d-454d-8247-f14c41fe8358"><enum>(ii)</enum><text display-inline="yes-display-inline">any violation
				of, or any act or omission the covered individual reasonably believes to be a
				violation of another criminal law committed in conjunction with a potential
				violation of the antitrust laws or in conjunction with an investigation by the
				Department of Justice of a potential violation of the antitrust laws.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0a72d942-ace7-452d-a680-abe87cbb64b0"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation on
				protections</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply to any covered
				individual if—</text><subparagraph commented="no" display-inline="no-display-inline" id="id87fb9b9d-7f3b-4298-9aa9-18ce91c35275"><enum>(A)</enum><text display-inline="yes-display-inline">the covered
				individual planned and initiated a violation or attempted violation of the
				antitrust laws;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idafa46851-2bc1-425f-9747-5d354642a535"><enum>(B)</enum><text display-inline="yes-display-inline">the covered
				individual planned and initiated a violation or attempted violation of another
				criminal law in conjunction with a violation or attempted violation of the
				antitrust laws; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb6f438e4-f6c1-4ecd-a5a3-5375d236ea92"><enum>(C)</enum><text display-inline="yes-display-inline">the covered
				individual planned and initiated an obstruction or attempted obstruction of an
				investigation by the Department of Justice of a violation of the antitrust
				laws.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfc9e1072-f6a5-40e1-8b9d-91c2c772872a"><enum>(3)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In
				this section:</text><subparagraph commented="no" display-inline="no-display-inline" id="ide29eb6b0-b635-416e-8208-42a1b122e9b0"><enum>(A)</enum><header display-inline="yes-display-inline">Antitrust
				laws</header><text display-inline="yes-display-inline">The term <term>antitrust laws</term> means section 1 or 3 of
				the Sherman Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1">15 U.S.C. 1</external-xref>, 3).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD44F02A1311940C1BDD43D9A7B0DDB50"><enum>(B)</enum><header display-inline="yes-display-inline">Covered
				individual</header><text display-inline="yes-display-inline">The term <term>covered individual</term> means an
				employee, contractor, subcontractor, or agent of an employer.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBE4A41B642CB4C9C9418B3F65066578D"><enum>(C)</enum><header display-inline="yes-display-inline">Employer</header><text display-inline="yes-display-inline">The
				term <term>employer</term> means a person, or any officer, employee,
				contractor, subcontractor, or agent of such person.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id23F87BD0D8A14A0C94C6F2E80A7D9961"><enum>(D)</enum><header display-inline="yes-display-inline">Person</header><text display-inline="yes-display-inline">The
				term <term>person</term> has the same meaning as in subsection (a) of the first
				section of the Clayton Act (<external-xref legal-doc="usc" parsable-cite="usc/15/12">15 U.S.C. 12(a)</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDB39AFC69BB74AA6B42BA3216580DCB5"><enum>(4)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">The term <term>violation</term>, with respect to the antitrust laws, shall not be construed to include a civil violation of any law that is not also a criminal violation.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id34fcfc21-1e73-458b-9207-120c7a30c05e"><enum>(b)</enum><header display-inline="yes-display-inline">Enforcement
				action</header><paragraph commented="no" display-inline="no-display-inline" id="idf214a688-f078-484c-b977-d89990c15d66"><enum>(1)</enum><header display-inline="yes-display-inline">In
				general</header><text display-inline="yes-display-inline">A covered individual who alleges discharge or other
				discrimination by any employer in violation of subsection (a) may seek relief
				under subsection (c) by—</text><subparagraph commented="no" display-inline="no-display-inline" id="id42d1f1e9-a727-400c-9b3a-35132afe5422"><enum>(A)</enum><text display-inline="yes-display-inline">filing a
				complaint with the Secretary of Labor; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id22574a50-c69c-4849-819a-1bda6d1fcc4f"><enum>(B)</enum><text display-inline="yes-display-inline">if the Secretary
				has not issued a final decision within 180 days of the filing of the complaint
				and there is no showing that such delay is due to the bad faith of the
				claimant, bringing an action at law or equity for de novo review in the
				appropriate district court of the United States, which shall have jurisdiction
				over such an action without regard to the amount in controversy.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idba2ce9e1-1d38-4ae7-a047-15d0ed3df922"><enum>(2)</enum><header display-inline="yes-display-inline">Procedure</header><subparagraph commented="no" display-inline="no-display-inline" id="idc5ab35fe-f414-4d2d-8d89-042341aa650c"><enum>(A)</enum><header display-inline="yes-display-inline">In
				general</header><text display-inline="yes-display-inline">A complaint filed with the Secretary of Labor under
				paragraph (1)(A) shall be governed under the rules and procedures set forth in
				<external-xref legal-doc="usc" parsable-cite="usc/49/42121">section 42121(b)</external-xref> of title 49, United States Code.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3036031e-af87-4449-9d93-373fe50d04c9"><enum>(B)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">Notification
				made under <external-xref legal-doc="usc" parsable-cite="usc/49/42121">section 42121(b)(1)</external-xref> of title 49, United States Code, shall be made
				to any individual named in the complaint and to the employer.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf27d5934-3167-4579-8116-7b2f2df007d8"><enum>(C)</enum><header display-inline="yes-display-inline">Burdens of
				proof</header><text display-inline="yes-display-inline">A complaint filed with the Secretary of Labor under
				paragraph (1)(A) shall be governed by the legal burdens of proof set forth in
				<external-xref legal-doc="usc" parsable-cite="usc/49/42121">section 42121(b)</external-xref> of title 49, United States Code.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7fdf80f2-3bce-4372-ae3a-cdaf718255db"><enum>(D)</enum><header display-inline="yes-display-inline">Statute of
				limitations</header><text display-inline="yes-display-inline">A complaint under paragraph (1)(A) shall be filed
				with the Secretary of Labor not later than 180 days after the date on which the
				violation occurs.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb8aa2c2b-c1f6-4faf-8280-104b436cc76a"><enum>(E)</enum><header display-inline="yes-display-inline">Civil actions
				to enforce</header><text display-inline="yes-display-inline">If a person fails to comply with an order or
				preliminary order issued by the Secretary of Labor pursuant to the procedures
				in section 42121(b), the Secretary of Labor or the person on whose behalf the
				order was issued may bring a civil action to enforce the order in the district
				court of the United States for the judicial district in which the violation
				occurred.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7a8ebfaa-7424-40a0-8628-b27444232de8"><enum>(c)</enum><header display-inline="yes-display-inline">Remedies</header><paragraph commented="no" display-inline="no-display-inline" id="id65b5d6d1-5368-40a8-ba9d-1de64e3e3910"><enum>(1)</enum><header display-inline="yes-display-inline">In
				general</header><text display-inline="yes-display-inline">A covered individual prevailing in any action under
				subsection (b)(1) shall be entitled to all relief necessary to make the covered
				individual whole.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id13172e00-aa73-433f-889a-15f8bd3c6ff6"><enum>(2)</enum><header display-inline="yes-display-inline">Compensatory
				damages</header><text display-inline="yes-display-inline">Relief for any action under paragraph (1) shall
				include—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbea39029-c92f-46ff-9f75-7b6bace4a94c"><enum>(A)</enum><text display-inline="yes-display-inline">reinstatement
				with the same seniority status that the covered individual would have had, but
				for the discrimination;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6b699649-52af-4bb9-a14c-d3d7883cb97b"><enum>(B)</enum><text display-inline="yes-display-inline">the amount of
				back pay, with interest; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc32c7ed2-8ef0-4deb-aad4-ec8a25c6bdb3"><enum>(C)</enum><text display-inline="yes-display-inline">compensation for
				any special damages sustained as a result of the discrimination including
				litigation costs, expert witness fees, and reasonable attorney’s fees.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id73049c49-3688-4f6b-9f5d-1983a68b3d54"><enum>(d)</enum><header display-inline="yes-display-inline">Rights retained
				by whistleblowers</header><text display-inline="yes-display-inline">Nothing in this section shall be deemed to
				diminish the rights, privileges, or remedies of any covered individual under
				any Federal or State law, or under any collective bargaining
