		<official-title>To enable concrete masonry products manufacturers to
		  establish, finance, and carry out a coordinated program of research, education,
		  and promotion to improve, maintain, and develop markets for concrete masonry
		  products. </official-title>

		<section id="H2184C9B8CF3A4BD88A59EF0F5F6F2C3D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Concrete Masonry Products Research,
			 Education, and Promotion Act of 2013</short-title></quote>.</text>
		</section><section id="HE4E612FDED1F4790881D33F50C235C0A"><enum>2.</enum><header>Findings and
			 declaration of policy</header>
			<subsection id="HAED211455CC5456B8904FB271844C27C"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds the following:</text>
				<paragraph id="HC57C1EA3FBD746399D4DE142DD68F80E"><enum>(1)</enum><text>The production of
			 concrete masonry products plays a significant role in the economy of the United
			 States.</text>
				</paragraph><paragraph id="H8F0BA9FE89844BD28CBC44447702D1FD"><enum>(2)</enum><text>Concrete masonry
			 products are produced by hundreds of concrete manufacturers and utilized
			 throughout the United States and foreign countries.</text>
				</paragraph><paragraph id="H3CD69BB0C1D6446AB38CE2A38CA72E8A"><enum>(3)</enum><text>Concrete masonry
			 products move in the channels of interstate and foreign commerce, and concrete
			 masonry products that do not move in such channels of commerce directly burden
			 or affect interstate commerce of concrete masonry products.</text>
				</paragraph><paragraph id="HFA01A4038BF44CD389F763A4F0BBB9A7"><enum>(4)</enum><text>The concrete
			 masonry products industry employs thousands of workers and positively impacts
			 economic stability throughout the United States.</text>
				</paragraph><paragraph id="H4AD2E798D86B46F29499C8CE5647085D"><enum>(5)</enum><text>The maintenance
			 and expansion of existing markets for concrete masonry products and the
			 development of new markets is vital to the welfare of concrete manufacturers in
			 the United States and those concerned with marketing and using concrete masonry
			 products as well as the general economic welfare of the United States.</text>
				</paragraph><paragraph id="H971382706ABD4409A2279B4A3DF2F30F"><enum>(6)</enum><text>The concrete
			 masonry products industry plays a vital role in providing safe, environmentally
			 sustainable, and economical construction for citizens of the United States and
			 abroad.</text>
				</paragraph><paragraph id="id9033452C04934DD785878CF7C9A39C60"><enum>(7)</enum><text>Concrete masonry
			 products are used for the construction of structures that protect and provide
			 shelter for citizens during disasters (earthquakes, floods, hurricanes,
			 tornados, fire, et cetera).</text>
				</paragraph><paragraph id="id97E2E2AD9F374880A1991047CA43551C"><enum>(8)</enum><text>Concrete masonry
			 structures provide energy efficiencies to reduce American energy
			 demands.</text>
				</paragraph><paragraph id="id0DD8829ADBA24E78AE34DF8C988D20B4"><enum>(9)</enum><text>Concrete masonry
			 provides for durable structures that support sustainability objectives,
			 reducing long-term demands on natural resources.</text>
				</paragraph><paragraph id="id71BA69A60BD145E4AD6CEA460F8FFB51"><enum>(10)</enum><text>Concrete masonry
			 products are made using locally available resources throughout the United
			 States, reducing transportation and infrastructure demands.</text>
				</paragraph><paragraph id="idF44BFE9964144D2B83E991B1EC0FE37D"><enum>(11)</enum><text>Concrete masonry
			 products are used to support the construction of durable and cost-efficient,
			 low-income housing.</text>
				</paragraph></subsection><subsection id="H139D4C14197A4DF1B6AF0053D3682E60"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this Act is to authorize the establishment of an orderly program for
			 developing, financing, and carrying out an effective, continuous, and
			 coordinated program of research, education, and promotion, including funds for
			 marketing and market research activities, that is designed to—</text>
				<paragraph id="H059E95B89D0F4C2B89476B1B5C6B5E85"><enum>(1)</enum><text>strengthen the
			 position of the concrete masonry products industry in the domestic
			 marketplace;</text>
				</paragraph><paragraph id="H12CE7D4CC3204090A64CBFC79937B22F"><enum>(2)</enum><text>maintain, develop,
			 and expand markets and uses for concrete masonry products in the domestic and
			 foreign marketplaces; and</text>
				</paragraph><paragraph id="HA2F4F2F686F64FD29C667D718D07AFF1"><enum>(3)</enum><text>promote the use of
			 concrete masonry products in environmentally sustainable construction and
			 building.</text>
				</paragraph></subsection><subsection id="H71647988603E4DD7A37513E78ABA5097"><enum>(c)</enum><header>Limitation</header><text display-inline="yes-display-inline">Nothing in this Act may be construed to
			 provide for the control of production or otherwise limit the right of any
			 person to manufacture concrete masonry products.</text>
			</subsection></section><section id="H1AABA81ECDA2440E871665BF0C9D8BF6"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act:</text>
			<subsection id="H8BDAD0092C7F4E6090C7E3B4FE290521"><enum>(a)</enum><header>Block
			 machine</header><text>The term <term>block machine</term> means a piece of
			 equipment that utilizes vibration and compaction to form concrete masonry
			 products.</text>
			</subsection><subsection id="H12596C8568F64AFDB0752D02C1EEA688"><enum>(b)</enum><header>Board</header><text>The
			 term <term>Board</term> means the Concrete Masonry Products Board established
			 under <internal-xref idref="HD84CC13F3A584ED2869F734EDE3D87DC" legis-path="5.">section 5</internal-xref>.</text>
			</subsection><subsection id="H16EE05181C1D4E80B5224D4EC318B56B"><enum>(c)</enum><header>Cavity</header><text>The
			 term <term>cavity</term> means the open space in the mold of a block machine
			 capable of forming a single concrete masonry unit having nominal plan
			 dimensions of 8 inches by 16 inches.</text>
			</subsection><subsection id="H26E90D9B2B9345D6819F9A13665139AE"><enum>(d)</enum><header>Commerce</header><text>The
			 term <term>commerce</term> includes interstate, foreign, and intrastate
			 commerce.</text>
			</subsection><subsection id="H7DC642D5B635456098CAE0F66EBE9224"><enum>(e)</enum><header>Concrete masonry
			 products</header><text>The term <term>concrete masonry products</term> refers
			 to a broader class of products, including concrete masonry units as well as
			 hardscape products such as concrete pavers and segmental retaining wall units,
			 manufactured on a block machine using dry-cast concrete.</text>
			</subsection><subsection id="H84F637E9515C4F65A36928A127459028"><enum>(f)</enum><header>Concrete masonry
			 unit</header><text>The term <term>concrete masonry unit</term> means a concrete
			 masonry product that is a manmade masonry unit having an actual width of 3
			 inches or greater and manufactured from dry-cast concrete using a block
			 machine. Such term includes concrete block and related concrete units used in
			 masonry applications.</text>
			</subsection><subsection id="H8E82D815171547F6AF879E7D2CE0EDD4"><enum>(g)</enum><header>Department</header><text>The
			 term <term>Department</term> means the Department of Commerce.</text>
			</subsection><subsection id="H5E0F98ACA02548339768CCD8F87B491E"><enum>(h)</enum><header>Dry-Cast
			 concrete</header><text>The term <term>dry-cast concrete</term> means a
			 composite material that is composed essentially of aggregates embedded in a
			 binding medium composed of a mixture of cementitious materials (including
			 hydraulic cement, pozzolans, or other cementitious materials) and water of such
			 a consistency to maintain its shape after forming in a block machine.</text>
			</subsection><subsection id="HE5D744AE5C7F4F7592CC095A802E798C"><enum>(i)</enum><header>Education</header><text display-inline="yes-display-inline">The term <term>education</term> means
			 programs that will educate or communicate the benefits of concrete masonry
			 products in safe and environmentally sustainable development, advancements in
			 concrete masonry product technology and development, and other information and
			 programs designed to generate increased demand for commercial, residential,
			 multi-family, and institutional projects using concrete masonry products and to
			 generally enhance the image of concrete masonry products.</text>
			</subsection><subsection commented="no" id="HD531EEBDCD3445A4BAC6B1AFCE174C88"><enum>(j)</enum><header>Machine
			 cavities</header><text>The term <term>machine cavities</term> means the
			 cavities with which a block machine could be equipped.</text>
			</subsection><subsection id="H505CA9F615704ADC888CD804E6435358"><enum>(k)</enum><header>Machine cavities
			 in operation</header><text>The term <term>machine cavities in operation</term>
			 means those machine cavities associated with a block machine that have produced
			 concrete masonry units within the last 6 months of the date set for determining
			 eligibility and is fully operable and capable of producing concrete masonry
			 units.</text>
			</subsection><subsection id="H7E5292EDE0A744D787FE1B1580D14900"><enum>(l)</enum><header>Masonry
			 unit</header><text>The term <term>masonry unit</term> means a noncombustible
			 building product intended to be laid by hand or joined using mortar, grout,
			 surface bonding, post-tensioning or some combination of these methods.</text>
			</subsection><subsection id="HD71206AFCA774C5DBBCA0DFCE4BBBB94"><enum>(m)</enum><header>Manufacturer</header><text>The
			 term <term>manufacturer</term> means any person engaged in the manufacturing of
			 commercial concrete masonry products.</text>
			</subsection><subsection id="H3C266AB4526246E3AE56340678EC0D15"><enum>(n)</enum><header>Order</header><text>The
			 term <term>order</term> means an order issued under section 4.</text>
			</subsection><subsection id="H02EFC5569B85488A92A3B53381DF70A1"><enum>(o)</enum><header>Person</header><text>The
			 term <term>person</term> means any individual, group of individuals,
			 partnership, corporation, association, cooperative, or any other entity.</text>
			</subsection><subsection id="H7D8DC7FE56024EB3B1B41376BD995814"><enum>(p)</enum><header>Promotion</header><text>The
			 term <term>promotion</term> means any action, including paid advertising, to
			 advance the image and desirability of concrete masonry products with the
			 express intent of improving the competitive position and stimulating sales of
			 concrete masonry products in the marketplace.</text>
			</subsection><subsection id="H5238A40A85B0484A87F6614C05F732A8"><enum>(q)</enum><header>Research</header><text>The
			 term <term>research</term> means studies testing the effectiveness of market
			 development and promotion efforts, studies relating to the improvement of
			 concrete masonry products and new product development, and studies documenting
			 the performance of concrete masonry.</text>
			</subsection><subsection id="H18085F97280442EDA8D08D7F92F9257E"><enum>(r)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Commerce.</text>
			</subsection><subsection id="H83F85CF1D0E9460EB2DD80BAC8D71758"><enum>(s)</enum><header>United
			 States</header><text>The term <term>United States</term> means the several
			 States and the District of Columbia.</text>
			</subsection></section><section id="H18746D982DEB42A6B7A582021C143339"><enum>4.</enum><header>Issuance of
			 orders</header>
			<subsection id="HA118369D7BA1410D8042327F8DCB361A"><enum>(a)</enum><header>In
			 general</header>
				<paragraph id="H19685A1EE31544C4B00AAD5E5B96F7AF"><enum>(1)</enum><header>Issuance</header><text display-inline="yes-display-inline">The Secretary, subject to the procedures
			 provided in
			 <internal-xref idref="H020FD06185FD4289801A23EBB815626D" legis-path="4.(b)">subsection (b)</internal-xref>, shall issue orders under
			 this Act applicable to manufacturers of concrete masonry products.</text>
				</paragraph><paragraph id="H5CB51C65667D4DE58101646BFD3074A8"><enum>(2)</enum><header>Scope</header><text>Any
			 order shall be national in scope.</text>
				</paragraph><paragraph id="HAC8C4B5908F14C008E440A5E82754271"><enum>(3)</enum><header>One
			 order</header><text>Not more than one order shall be in effect at any one
			 time.</text>
				</paragraph></subsection><subsection id="H020FD06185FD4289801A23EBB815626D"><enum>(b)</enum><header>Procedures</header>
				<paragraph id="H7DF28F06944241CF858492E2ACE0DA58"><enum>(1)</enum><header>Development or
			 receipt of proposed order</header><text display-inline="yes-display-inline">A
			 proposed order with respect to concrete masonry products may be—</text>
					<subparagraph id="HDA51708027244ABBA0F93F33D684273E"><enum>(A)</enum><text>prepared by the
			 Secretary at any time; or</text>
					</subparagraph><subparagraph id="HE2D22456240A44928DD9992777691F59"><enum>(B)</enum><text>requested by or
			 submitted to the Secretary by—</text>
						<clause id="HE0613B14CBDF463D9467655A3B99B1E5"><enum>(i)</enum><text>an
			 existing national organization of concrete masonry product manufacturers;
			 or</text>
						</clause><clause id="H3A5D08A6BBCB4E19808271C7DCDB4AFC"><enum>(ii)</enum><text>any
			 person that may be affected by the issuance of an order with respect to
			 concrete masonry products.</text>
						</clause></subparagraph></paragraph><paragraph id="H7D73CF1B191548D8871CF3AB43A0BC5F"><enum>(2)</enum><header>Publication of
			 proposed order</header><text display-inline="yes-display-inline">Not later than
			 60 days after receiving a proposed order or a request for a proposed order in
			 accordance with subparagraph (B) of paragraph (1), the Secretary shall publish
			 a proposed order in the Federal Register and give 30 days notice and
			 opportunity for public comment on the proposed order.</text>
				</paragraph><paragraph id="H577C6A6F313343FF8515D246FDE6633A"><enum>(3)</enum><header>Issuance of
			 order</header>
					<subparagraph id="H7FA0B1B088A946FCB6283A066401E534"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">After notice and
			 opportunity for public comment are provided in accordance with
			 <internal-xref idref="H7D73CF1B191548D8871CF3AB43A0BC5F" legis-path="4.(b)(2)">paragraph (2)</internal-xref>, the Secretary shall issue
			 the order, taking into consideration the comments received and including in the
			 order such provisions as are necessary to ensure that the order is in
			 conformity with this Act.</text>
					</subparagraph><subparagraph commented="no" id="HF711DD2065324E9289ABF9BD62D6C04C"><enum>(B)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The order shall be
			 issued and become effective only after an affirmative vote in a referendum as
			 provided in
			 <internal-xref idref="HFF1F482941454F35B707DF3534306B8A" legis-path="7.">section 7</internal-xref>, but not later than 120 days after
			 publication of the proposed order.</text>
					</subparagraph></paragraph></subsection><subsection id="HAA7DAD1D577746DE8506E13892ED8EDE"><enum>(c)</enum><header>Amendments</header><text>The
			 Secretary may, from time to time, amend an order. The provisions of this Act
			 applicable to an order shall be applicable to any amendment to an order.</text>
			</subsection></section><section id="HD84CC13F3A584ED2869F734EDE3D87DC"><enum>5.</enum><header>Required terms in
			 orders</header>
			<subsection id="HCFD6A7896CB941DC8C7CD3673A0A1D7B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Any order issued
			 under this Act shall contain the terms and provisions specified in this
			 section.</text>
			</subsection><subsection id="H6AE991424E1441C9BE0F48738E14DB2B"><enum>(b)</enum><header>Concrete Masonry
			 Products Board</header>
				<paragraph id="H0C97300A6E504CE8897AD3C7ADE3B3A1"><enum>(1)</enum><header>Establishment
			 and membership</header>
					<subparagraph id="HD5E4D6C8ADEC4D5BB68052AA14688703"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">The order shall provide for the
			 establishment of a Concrete Masonry Products Board to carry out a program of
			 generic promotion, research, and information regarding concrete masonry
			 products.</text>
					</subparagraph><subparagraph id="H21AFC6739DE6404CBFD9772F21AA6968"><enum>(B)</enum><header>Membership</header>
						<clause id="HA92B039F76B241FDBFC81C4EEA0AF0B1"><enum>(i)</enum><header>Number of
			 members</header><text display-inline="yes-display-inline">The board shall
			 consist of not more than 25 members.</text>
						</clause><clause id="H6892D23A03D74011BB242E20F176FB1F"><enum>(ii)</enum><header>Appointment</header><text>The
			 members of the Board shall be appointed by the Secretary from nominations
			 submitted as provided in this subsection.</text>
						</clause><clause id="H6093F6FCDB3645EB8EEEE4BC43C5745E"><enum>(iii)</enum><header>Composition</header><text>The
			 Board shall consist of manufacturers.</text>
						</clause></subparagraph></paragraph><paragraph id="H8740BD866B954BF3B6C62B5995BFE78A"><enum>(2)</enum><header>Distribution of
			 appointments</header>
					<subparagraph id="H22F221EEBFC54FF0B065FA5B841CABA1"><enum>(A)</enum><header>Geographical
			 representation</header><text>To ensure fair and equitable representation of the
			 concrete masonry products industry, the composition of the Board shall reflect
			 the geographical distribution of the manufacture of concrete masonry products
			 in the United States and the types of concrete masonry products
			 manufactured.</text>
					</subparagraph><subparagraph id="H736BD3AF4C294C38AD7AD9EA0214762C"><enum>(B)</enum><header>Adjustment in
			 board representation</header><text display-inline="yes-display-inline">Three
			 years after the assessment of concrete masonry products commences pursuant to
			 an order, and at the end of each 3-year period thereafter, the Board, subject
			 to the review and approval of the Secretary, shall, if warranted, recommend to
			 the Secretary the reapportionment of the Board membership to reflect changes in
			 the geographical distribution of the manufacture of concrete masonry products
			 and the types of concrete masonry products manufactured.</text>
					</subparagraph></paragraph><paragraph id="H8E4D145CDFF54B71BD1BEB2BE3C1BD66"><enum>(3)</enum><header>Nominations
			 Process</header><text display-inline="yes-display-inline">The order shall
			 provide the following:</text>
					<subparagraph id="HD09A9FC7A3B44DD5BCEC518DDAF6685E"><enum>(A)</enum><header>Number of
			 nominations</header><text>Two nominees shall be submitted for each appointment
			 to the Board.</text>
					</subparagraph><subparagraph id="HDC22E646F6A24936A9B9250B9826FE01"><enum>(B)</enum><header>Procedure</header><text>Nominations
			 for each appointment of a manufacturer shall be made by manufacturers in
			 accordance with procedures specified in the order.</text>
					</subparagraph><subparagraph id="H8A55C96082304833BC6F948387D07E75"><enum>(C)</enum><header>Failure to
			 nominate</header><text>In any case in which manufacturers fail to nominate
			 individuals for an appointment to the Board, the Secretary may appoint an
			 individual to fill the vacancy on a basis provided in the order or other
			 regulations of the Secretary.</text>
					</subparagraph><subparagraph id="H7AA98DE73B7F4F70A3A28A06F7E4A7CE"><enum>(D)</enum><header>Failure to
			 appoint</header><text>If the Secretary fails to make an appointment to the
			 Board within 30 days of receiving nominations for such appointment, the first
			 nominee for such appointment shall be deemed appointed.</text>
					</subparagraph></paragraph><paragraph id="HECFA8539380640858C10538CBF208780"><enum>(4)</enum><header>Alternates</header><text display-inline="yes-display-inline">The order shall provide for the selection
			 of alternate members of the Board by the Secretary in accordance with
			 procedures specified in the order.</text>
				</paragraph><paragraph id="H0691759DC6ED4FF996C5D39ACBFD6583"><enum>(5)</enum><header>Terms</header>
					<subparagraph id="H0F3C50ACAB504682996FCC707BCCDEF3"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The members and any
			 alternates of the Board shall each serve for a term of 3 years, except that
			 members and any alternates initially appointed to the Board shall serve for
			 terms of not more than 2, 3, and 4 years, as specified by the order.</text>
					</subparagraph><subparagraph id="HDA980C2657704A788EC54336460AD49E"><enum>(B)</enum><header>Limitation on
			 consecutive terms</header><text>A member or alternate may serve not more than 2
			 consecutive terms.</text>
					</subparagraph><subparagraph id="H14F38D8F3D1640CEA3BF48767FD9E4BD"><enum>(C)</enum><header>Continuation of
			 term</header><text display-inline="yes-display-inline">Notwithstanding
			 <internal-xref idref="HDA980C2657704A788EC54336460AD49E" legis-path="5.(b)(5)(B)">subparagraph (B)</internal-xref>, each member or
			 alternate shall continue to serve until a successor is appointed by the
			 Secretary.</text>
					</subparagraph><subparagraph id="HBF21C7FAAE69465289022D1AE5485CA2"><enum>(D)</enum><header>Vacancies</header><text>A
			 vacancy arising before the expiration of a term of office of an incumbent
			 member or alternate of the Board shall be filled in a manner provided for in
			 the order.</text>
					</subparagraph></paragraph><paragraph id="H0B1EDEFE9D534D7E9C65C607B1599FC9"><enum>(6)</enum><header>Disqualification
			 from Board service</header><text display-inline="yes-display-inline">The order
			 shall provide that if a member or alternate of the Board who was appointed as a
			 manufacturer ceases to qualify as a manufacturer, such member or alternate
			 shall be disqualified from serving on the Board.</text>
				</paragraph><paragraph id="H51D247D0BFC14FAC918E6CF920C1E58A"><enum>(7)</enum><header>Compensation</header>
					<subparagraph id="H77E1CB3DFD5C41BF8ACFDBE41911B3D0"><enum>(A)</enum><header>In
			 general</header><text>Members and any alternates of the Board shall serve
			 without compensation.</text>
					</subparagraph><subparagraph id="H2F525C1E77804C79AEDA5ACC0E1B854D"><enum>(B)</enum><header>Travel
			 expenses</header><text>If approved by the Board, members or alternates shall be
			 reimbursed for reasonable travel expenses, which may include per diem allowance
			 or actual subsistence incurred while away from their homes or regular places of
			 business in the performance of services for the Board.</text>
					</subparagraph></paragraph></subsection><subsection id="H4D8F26AA25A64A7394EBEA06BD23F004"><enum>(c)</enum><header>Powers and
			 duties of the Board</header><text display-inline="yes-display-inline">The order
			 shall specify the powers and duties of the Board, which shall include the power
			 and duty—</text>
				<paragraph id="HD5203C3898F5428883A9126B9EA29200"><enum>(1)</enum><text display-inline="yes-display-inline">to administer the order in accordance with
			 its terms and conditions and to collect assessments;</text>
				</paragraph><paragraph id="HAB95FCF51DE944F39B577E648CF307C6"><enum>(2)</enum><text display-inline="yes-display-inline">to develop and recommend to the Secretary
			 for approval such bylaws as may be necessary for the functioning of the board
			 and such rules as may be necessary to administer the order, including
			 activities authorized to be carried out under the order;</text>
				</paragraph><paragraph id="HFE1E10853A61418D93F4779DD4A469C8"><enum>(3)</enum><text>to meet, organize,
			 and select from among members of the Board a chairperson, other officers, and
			 committees and subcommittees, as the Board determines appropriate;</text>
				</paragraph><paragraph id="H15F137880A914560A1C379A3E7BA3902"><enum>(4)</enum><text>to establish
			 regional organizations or committees to administer regional initiatives;</text>
				</paragraph><paragraph id="H5140E7E29A5941399DB5C3CC7F7C1DA3"><enum>(5)</enum><text>to establish
			 working committees of persons other than Board members;</text>
				</paragraph><paragraph id="HF1477C3A34504D979393B65F6F64516F"><enum>(6)</enum><text display-inline="yes-display-inline">to employ such persons, other than the
			 members, as the board considers necessary, and to determine the compensation
			 and specify the duties of the persons;</text>
				</paragraph><paragraph commented="no" id="H242ED8D5F5434C03B1C42E5A0DEC8342"><enum>(7)</enum><text display-inline="yes-display-inline">to prepare and submit for the approval of
			 the Secretary, before the beginning of each fiscal year, rates of assessment
			 under <internal-xref idref="HD654FE7EE3AE4C52B6CF88C3A917251D" legis-path="6.">section 6</internal-xref> and an annual budget of the
			 anticipated expenses to be incurred in the administration of the order,
			 including the probable cost of each promotion, research, and information
			 activity proposed to be developed or carried out by the Board;</text>
				</paragraph><paragraph id="H62F9ACFEFE4C46E7B3C9FF8C024290A9"><enum>(8)</enum><text>to borrow funds
			 necessary for the startup expenses of the order;</text>
				</paragraph><paragraph commented="no" id="H659E7A0125E7489D8834A4111A2DB0B7"><enum>(9)</enum><text display-inline="yes-display-inline">to carry out research, education, and
			 promotion programs and projects, and to pay the costs of such programs and
			 projects with assessments collected under
			 <internal-xref idref="HD654FE7EE3AE4C52B6CF88C3A917251D" legis-path="6.">section 6</internal-xref>;</text>
				</paragraph><paragraph commented="no" id="H345873EB441D46F9835F3D1B1D1201CC"><enum>(10)</enum><text display-inline="yes-display-inline">subject to
			 <internal-xref idref="HC839F1A8DB4A4686AC6A5F8AF8105C4D" legis-path="5.(e)">subsection (e)</internal-xref>, to enter into contracts or
			 agreements to develop and carry out programs or projects of research,
			 education, and promotion relating to concrete masonry products;</text>
				</paragraph><paragraph id="H6C642BEC59DD4E48BB5B25081D862A75"><enum>(11)</enum><text display-inline="yes-display-inline">to keep minutes, books, and records that
			 reflect the actions and transactions of the Board, and promptly report minutes
			 of each Board meeting to the Secretary;</text>
				</paragraph><paragraph id="HE4943B2D4F5A44019C176B93239EBCC3"><enum>(12)</enum><text>to receive,
			 investigate, and report to the Secretary complaints of violations of the
			 order;</text>
				</paragraph><paragraph id="HE2755E7AC0D54003AE071E4A63260EB7"><enum>(13)</enum><text>to furnish the
			 Secretary with such information as the Secretary may request;</text>
				</paragraph><paragraph id="HE54CC4DAEB984AC1A6411D454E6AF1C2"><enum>(14)</enum><text>to recommend to
			 the Secretary such amendments to the order as the Board considers appropriate;
			 and</text>
				</paragraph><paragraph id="H11646E533B324BB28F567A8D71BEADEA"><enum>(15)</enum><text>to provide the
			 Secretary with advance notice of meetings.</text>
				</paragraph></subsection><subsection id="H93115B138AFA496082B20F022C1B06CB"><enum>(d)</enum><header>Programs and
			 projects; budgets; expenses</header>
				<paragraph id="H943DEC9B3289459FA16A3196F662AE11"><enum>(1)</enum><header>Programs and
			 projects</header><text display-inline="yes-display-inline">The order shall
			 require the Board to submit to the Secretary for approval any program or
			 project of research, education, or promotion.</text>
				</paragraph><paragraph id="HD1237544D6974E929F5408488FF6C7C7"><enum>(2)</enum><header>Budgets</header>
					<subparagraph id="H9DF274AC12684CB8B53029D65D83D5BB"><enum>(A)</enum><header>Submission</header><text>The
			 order shall require the Board to submit to the Secretary for approval a budget
			 of the anticipated expenses and disbursements of the Board in the
			 implementation of the order, including the projected costs of concrete masonry
			 products research, education, and promotion programs and projects.</text>
					</subparagraph><subparagraph id="HCC779C0273784F488216631768622828"><enum>(B)</enum><header>Timing</header><text>The
			 budget shall be submitted before the beginning of a fiscal year and as
			 frequently as may be necessary after the beginning of the fiscal year.</text>
					</subparagraph><subparagraph id="HA03B660DBDFC4E13B5A721D7BE1F058A"><enum>(C)</enum><header>Approval</header><text display-inline="yes-display-inline">If the Secretary fails to approve or reject
			 a budget within 30 days of receipt, such budget shall be deemed
			 approved.</text>
					</subparagraph></paragraph><paragraph id="H48A946F6B50A499097513CAE83579E5A"><enum>(3)</enum><header>Administrative
			 Expenses</header>
					<subparagraph id="HA09F8D27F0FA4B728D5F5FD04C677FD3"><enum>(A)</enum><header>Incurring
			 expenses</header><text display-inline="yes-display-inline">A board may incur
			 the expenses described in
			 <internal-xref idref="HD1237544D6974E929F5408488FF6C7C7" legis-path="5.(d)(2)">paragraph (2)</internal-xref> and other expenses for the
			 administration, maintenance, and functioning of the Board as authorized by the
			 Secretary.</text>
					</subparagraph><subparagraph commented="no" id="H997C40BCE1874918879A9812C4415793"><enum>(B)</enum><header>Payment of
			 expenses</header><text display-inline="yes-display-inline">Expenses incurred
			 under
			 <internal-xref idref="HA09F8D27F0FA4B728D5F5FD04C677FD3" legis-path="5.(d)(3)(A)">subparagraph (A)</internal-xref> shall be paid by the
			 Board using assessments collected under
			 <internal-xref idref="HD654FE7EE3AE4C52B6CF88C3A917251D" legis-path="6.">section 6</internal-xref>, earnings obtained from assessments,
			 and other income of the Board. Any funds borrowed by the Board shall be
			 expended only for startup costs and capital outlays.</text>
					</subparagraph><subparagraph id="H972400433F7C404D96366B06E5658A9A"><enum>(C)</enum><header>Limitation on
			 spending</header><text>For fiscal years beginning 3 or more years after the
			 date of the establishment of the Board, the Board may not expend for
			 administration (except for reimbursement to the Secretary required under
			 <internal-xref idref="H11DBB8AF08FD4B77BC3E1E9F742CD606" legis-path="5.(d)(3)(D)">subparagraph (D)</internal-xref>), maintenance, and
			 functioning of the Board in a fiscal year an amount that exceeds 10 percent of
			 the assessment and other income received by the Board for the fiscal
			 year.</text>
					</subparagraph><subparagraph id="H11DBB8AF08FD4B77BC3E1E9F742CD606"><enum>(D)</enum><header>Reimbursement of
			 Secretary</header><text display-inline="yes-display-inline">The order shall
			 require that the Secretary be reimbursed from assessments for all expenses
			 incurred by the Secretary in the implementation, administration, and
			 supervision of the order, including all referenda costs incurred in connection
			 with the order.</text>
					</subparagraph></paragraph></subsection><subsection id="HC839F1A8DB4A4686AC6A5F8AF8105C4D"><enum>(e)</enum><header>Contracts and
			 agreements</header>
				<paragraph id="H9C28DB69897347ACB74540011D54E975"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The order shall
			 provide that, with the approval of the Secretary, the Board may—</text>
					<subparagraph id="HF282448F8CBF42678B97FF6ABD913A56"><enum>(A)</enum><text>enter into
			 contracts and agreements to carry programs and projects of research, education,
			 and promotion activities relating to concrete masonry products, including
			 contracts and agreements with manufacturer associations or other entities as
			 considered appropriate by the Secretary;</text>
					</subparagraph><subparagraph id="HB23CEF6DFBD942DB93F7A25FF75CABEA"><enum>(B)</enum><text>enter into
			 contracts and agreements for administrative services; and</text>
					</subparagraph><subparagraph commented="no" id="HA7B12FC02F944C54B1054CF1723AFECA"><enum>(C)</enum><text>pay the cost of
			 approved research, education, and promotion programs and projects using
			 assessments collected under
			 <internal-xref idref="HD654FE7EE3AE4C52B6CF88C3A917251D" legis-path="6.">section 6</internal-xref>, earnings obtained from assessments,
			 and other income of the Board.</text>
					</subparagraph></paragraph><paragraph id="H11C8BDA0605C4C8EBE9F27F53811147B"><enum>(2)</enum><header>Requirements</header><text>Each
			 contract or agreement shall provide that any person who enters into the
			 contract or agreement with the Board shall—</text>
					<subparagraph id="H8FFBC32B7F8D442B8BBC43455785CCF0"><enum>(A)</enum><text>develop and submit
			 to the Board a proposed activity together with a budget that specifies the cost
			 to be incurred to carry out the activity;</text>
					</subparagraph><subparagraph id="H10AFB1DF95344A9FA1D9051671853F2B"><enum>(B)</enum><text>keep accurate
			 records of all of transactions relating to the contract or agreement;</text>
					</subparagraph><subparagraph id="H8B860EB2C0E74816BC38126DCF8E8C87"><enum>(C)</enum><text>account for funds
			 received and expended in connection with the contract or agreement;</text>
					</subparagraph><subparagraph id="H2461699FA7A44D39B2B0F924C52595F6"><enum>(D)</enum><text>make periodic
			 reports to the Board of activities conducted under the contract or agreement;
			 and</text>
					</subparagraph><subparagraph id="HA8A560D170F94CF089CD3164285BFA5B"><enum>(E)</enum><text>make such other
			 reports as the Board or the Secretary considers relevant.</text>
					</subparagraph></paragraph><paragraph id="H223AF6B745DC4F17AF83A029DCB38B65"><enum>(3)</enum><header>Failure to
			 approve</header><text display-inline="yes-display-inline">If the Secretary
			 fails to approve or reject a contract or agreement entered into under
			 <internal-xref idref="H9C28DB69897347ACB74540011D54E975" legis-path="5.(e)(1)">paragraph (1)</internal-xref> within 30 days of receipt,
			 the contract or agreement shall be deemed approved.</text>
				</paragraph></subsection><subsection id="H9A25132999FE4DF592D881A02D82AAD9"><enum>(f)</enum><header>Books and
			 records of Board</header>
				<paragraph id="HDC82B9C3BFD74850A985BDEC0966736D"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The order shall
			 require the Board to—</text>
					<subparagraph id="H12CBDB8F71E04BB595D23A4D004861B1"><enum>(A)</enum><text display-inline="yes-display-inline">maintain such books and records (which
			 shall be available to the Secretary for inspection and audit) as the Secretary
			 may require;</text>
					</subparagraph><subparagraph id="H8B69B06BC9774FAC9F928F6CCB75368F"><enum>(B)</enum><text>collect and submit
			 to the Secretary, at any time the Secretary may specify, any information the
			 Secretary may request; and</text>
					</subparagraph><subparagraph id="H6124A9F7419A40CF8DBB099EC3986F3F"><enum>(C)</enum><text>account for the
			 receipt and disbursement of all funds in the possession, or under the control,
			 of the Board.</text>
					</subparagraph></paragraph><paragraph id="HFCEAB232CA2C48438D31164731FA019A"><enum>(2)</enum><header>Audits</header><text>The
			 order shall require the Board to have—</text>
					<subparagraph id="H7070B2A0B17B453D854C002567844419"><enum>(A)</enum><text>the books and
			 records of the Board audited by an independent auditor at the end of each
			 fiscal year; and</text>
					</subparagraph><subparagraph id="H5426C3473B164D76B47EF46CB3BD1367"><enum>(B)</enum><text>a report of the
			 audit submitted directly to the Secretary.</text>
					</subparagraph></paragraph></subsection><subsection id="HC6B7C905456F49B799A03EB700C24751"><enum>(g)</enum><header>Prohibited
			 activities</header>
				<paragraph id="HF3AAC058844B4F5D9B3FDFC73120E84B"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to
			 <internal-xref idref="HAB771243F9F54DAF82C149D8B23FA04C" legis-path="5.(g)(2)">paragraph (2)</internal-xref>, the Board shall not engage
			 in any action to, nor shall any funds received by the Board under this Act be
			 used to—</text>
					<subparagraph id="H99093F051E614E60B94C2B3DEA8EC684"><enum>(A)</enum><text>influence
			 legislation or governmental action;</text>
					</subparagraph><subparagraph id="HF92E4CEFABC64B249912DD083F0F06AE"><enum>(B)</enum><text>engage in an
			 action that would be a conflict of interest; or</text>
					</subparagraph><subparagraph id="H3AF51C1594B9419AB233DCD379722C72"><enum>(C)</enum><text>engage in
			 advertising that is false or misleading.</text>
					</subparagraph></paragraph><paragraph id="HAB771243F9F54DAF82C149D8B23FA04C"><enum>(2)</enum><header>Exceptions</header><text><internal-xref idref="HF3AAC058844B4F5D9B3FDFC73120E84B" legis-path="5.(g)(1)">Paragraph
			 (1)</internal-xref> does not preclude—</text>
					<subparagraph id="HFA13A4DCD77346DB87174CFBCB0355AC"><enum>(A)</enum><text>the development
			 and recommendation of amendments to the order;</text>
					</subparagraph><subparagraph id="H611870A61EEE4E35961AFBCD73E9FEEE"><enum>(B)</enum><text>the communication
			 to appropriate government officials of information relating to the conduct,
			 implementation, or results of research, education, and promotion activities
			 under the order; or</text>
					</subparagraph><subparagraph id="HBB8F1B5A318344E0B763B3C1391896E1"><enum>(C)</enum><text>any action
			 designed to market concrete masonry products directly to a foreign government
			 or political subdivision of a foreign government.</text>
					</subparagraph></paragraph></subsection><subsection id="HE6549FAC065841FDB93D1296EB0A1005"><enum>(h)</enum><header>Periodic
			 evaluation</header><text display-inline="yes-display-inline">The order shall
			 require the Board to provide for the independent evaluation of all research,
			 education, and promotion activities undertaken under the order.</text>
			</subsection><subsection id="H2B3D6CB519BE4173B6D0EE918F2E1471"><enum>(i)</enum><header>Books and
			 records of persons covered by order</header>
				<paragraph id="HC5270B6FEE2D40A7B42273D4AFC757D3"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The order shall
			 require that manufacturers and importers of concrete masonry products
			 shall—</text>
					<subparagraph id="HA544E4771B0C419581FA2F64138D3AA9"><enum>(A)</enum><text>maintain records
			 sufficient to ensure compliance with the order and regulations;</text>
					</subparagraph><subparagraph id="H2E4FCB3BDD03485780FB8F319F42B98C"><enum>(B)</enum><text>submit to the
			 Board any information required by the Board to carry out its responsibilities;
			 and</text>
					</subparagraph><subparagraph id="H1D87CAAE4FCD442D9AEE6CBA1C7C9745"><enum>(C)</enum><text>make the records
			 described in
			 <internal-xref idref="HA544E4771B0C419581FA2F64138D3AA9" legis-path="5.(i)(1)(A)">subparagraph (A)</internal-xref> available, during
			 normal business hours, for inspection by employees or agents of the Board or
			 the Department, including any records necessary to verify information required
			 under
			 <internal-xref idref="H2E4FCB3BDD03485780FB8F319F42B98C" legis-path="5.(i)(1)(B)">subparagraph (B)</internal-xref>.</text>
					</subparagraph></paragraph><paragraph id="H8DA250E6618D4512A3402E42B71C8F72"><enum>(2)</enum><header>Time
			 requirement</header><text>Any record required to be maintained under
			 <internal-xref idref="HC5270B6FEE2D40A7B42273D4AFC757D3" legis-path="5.(i)(1)">paragraph (1)</internal-xref> shall be maintained for
			 such time period as the Secretary may prescribe.</text>
				</paragraph><paragraph id="HAAA0A2EB3F8049C3987F017D0D935EAC"><enum>(3)</enum><header>Confidentiality
			 of information</header>
					<subparagraph commented="no" id="H970033B76F8F4FEF8E1F52A6D4BC6BDF"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as otherwise
			 provided in this Act, all information obtained under
			 <internal-xref idref="HC5270B6FEE2D40A7B42273D4AFC757D3" legis-path="5.(i)(1)">paragraph (1)</internal-xref> or as part of a referendum
			 under <internal-xref idref="HFF1F482941454F35B707DF3534306B8A" legis-path="7.">section 7</internal-xref> shall be kept confidential by all
			 officers, employees, and agents of the Department and of the Board.</text>
					</subparagraph><subparagraph id="H4537C7140A824D4E92790CD2E8D2F488"><enum>(B)</enum><header>Suits and
			 hearings</header><text>Information referred to in
			 <internal-xref idref="H970033B76F8F4FEF8E1F52A6D4BC6BDF" legis-path="5.(i)(4)(A)">subparagraph (A)</internal-xref> may be disclosed only
			 if—</text>
						<clause id="HA7D7D1249B984F24A56329ABABAC6116"><enum>(i)</enum><text>the
			 Secretary considers the information relevant; and</text>
						</clause><clause id="H68DA42FD6DC64C32BB6D890EC27672BC"><enum>(ii)</enum><text>the
			 information is revealed in a judicial proceeding or administrative hearing
			 brought at the direction or on the request of the Secretary or to which the
			 Secretary or any officer of the Department is a party.</text>
						</clause></subparagraph><subparagraph id="H3FA45AA863DA4BF8B8D3C30050AA37BE"><enum>(C)</enum><header>General
			 statements and publications</header><text>This paragraph does not
			 prohibit—</text>
						<clause id="H39A8616C92CB4C778846E208E2999374"><enum>(i)</enum><text>the
			 issuance of general statements based on reports or on information relating to a
			 number of persons subject to an order if the statements do not identify the
			 information furnished by any person; or</text>
						</clause><clause id="H1FDF3F7203494523B63ACE0AC6CA71C8"><enum>(ii)</enum><text>the
			 publication, by direction of the Secretary, of the name of any person violating
			 any order and a statement of the particular provisions of the order violated by
			 the person.</text>
						</clause></subparagraph><subparagraph id="H33CC3CFB1609409E94118716CE9A329B"><enum>(D)</enum><header>Penalty</header><text>Any
			 person who willfully violates this subsection shall be fined not more than
			 $5,000, imprisoned not more than 1 year, or both.</text>
					</subparagraph></paragraph><paragraph id="H179A8710598F4D0597F621958B0FA189"><enum>(4)</enum><header>Withholding
			 information</header><text>This subsection does not authorize the withholding of
			 information from Congress.</text>
				</paragraph></subsection></section><section id="HD654FE7EE3AE4C52B6CF88C3A917251D"><enum>6.</enum><header>Assessments</header>
			<subsection id="HCA34D8BA88C4464394B67470EE1150DB"><enum>(a)</enum><header>Assessments</header><text>The
			 order shall provide that assessments shall be paid by manufacturers with
			 respect to concrete masonry products manufactured and marketed in the United
			 States.</text>
			</subsection><subsection id="HB51B8BEE00B94741A0A7326BDEDEF645"><enum>(b)</enum><header>Collection</header>
				<paragraph id="H61D40CE7BCD24221B844B633A4484B22"><enum>(1)</enum><header>In
			 general</header><text>Assessments required under the order shall be remitted by
			 the manufacturer to the Board in the manner prescribed by the order.</text>
				</paragraph><paragraph id="H8B25699FAD1C42A8881C4FE720CF1A2D"><enum>(2)</enum><header>Timing</header><text>The
			 order shall provide that assessments required under the order shall be remitted
			 to the Board not less frequently than quarterly.</text>
				</paragraph><paragraph id="H321332AE3D834EFF88B0C20D11C39237"><enum>(3)</enum><header>Records</header><text display-inline="yes-display-inline">As part of the remittance of assessments,
			 manufacturers shall identify the total amount due in assessments on all sales
			 receipts, invoices or other commercial documents of sale as a result of the
			 sale of concrete masonry units in a manner as prescribed by the Board to ensure
			 compliance with the order.</text>
				</paragraph></subsection><subsection id="HB08A011ADDF34429B56CE9CCCC419724"><enum>(c)</enum><header>Assessment
			 rates</header><text display-inline="yes-display-inline">With respect to
			 assessment rates, the order shall contain the following terms:</text>
				<paragraph id="HD6EB96E68812470DBDA0E938B5554698"><enum>(1)</enum><header>Initial
			 rate</header><text>The assessment rate on concrete masonry products shall be
			 $0.01 per concrete masonry unit sold.</text>
				</paragraph><paragraph id="H92BED6221E034749AEAC0969E1E01A66"><enum>(2)</enum><header>Changes in the
			 rate</header>
					<subparagraph id="H005737A6E6394C4A9AA27325CB4EC52E"><enum>(A)</enum><header>Authority to
			 change rate</header><text display-inline="yes-display-inline">The Board shall
			 have the authority to change the assessment rate. A two-thirds majority of
			 voting members of the Board shall be required to approve a change in the
			 assessment rate.</text>
					</subparagraph><subparagraph id="HB60B8A172D9E4A0FB29F6128EABEE2DA"><enum>(B)</enum><header>Limitation on
			 increases</header><text>An increase or decrease in the assessment rate with
			 respect to concrete masonry products may not exceed $0.01 per concrete masonry
			 unit sold.</text>
					</subparagraph><subparagraph id="HF8859FFCC7D94C4E80A8163C8AA87337"><enum>(C)</enum><header>Maximum
			 rate</header><text>The assessment rate shall not be in excess of $0.05 per
			 concrete masonry unit.</text>
					</subparagraph><subparagraph id="HFC6F01BC5CD44004AFD34CC081B027D3"><enum>(D)</enum><header>Limitation on
			 frequency of changes</header><text display-inline="yes-display-inline">The
			 assessment rate may not be increased or decreased more than once
			 annually.</text>
					</subparagraph></paragraph></subsection><subsection id="H65CA0606B26A4352A3127E65FF957195"><enum>(d)</enum><header>Late-Payment and
			 interest charges</header>
				<paragraph id="HB720066FA9BD4BF399C87E0C96047C31"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Late-payment and
			 interest charges may be levied on each person subject to the order who fails to
			 remit an assessment in accordance with
			 <internal-xref idref="HB51B8BEE00B94741A0A7326BDEDEF645" legis-path="6.(b)">subsection (b)</internal-xref>.</text>
				</paragraph><paragraph id="HBE3B9DF70A064D0988D5A4F8D5FF66DE"><enum>(2)</enum><header>Rate</header><text>The
			 rate for late-payment and interest charges shall be specified by the
			 Secretary.</text>
				</paragraph></subsection><subsection id="HD13F5B336B7343CFA95DBFAE6341B776"><enum>(e)</enum><header>Investment of
			 assessments</header><text display-inline="yes-display-inline">Pending
			 disbursement of assessments under a budget approved by the Secretary, a board
			 may invest assessments collected under this section in—</text>
				<paragraph id="HF4980D3AD8594A6CB50FD701157558E7"><enum>(1)</enum><text>obligations of the
			 United States or any agency of the United States;</text>
				</paragraph><paragraph id="H27D4DF4186764BA3BFC89DD242A4CE55"><enum>(2)</enum><text>general
			 obligations of any State or any political subdivision of a State;</text>
				</paragraph><paragraph id="H95F0E942B5BC4897A3DF532EC7F1B436"><enum>(3)</enum><text>interest-bearing
			 accounts or certificates of deposit of financial institutions that are members
			 of the Federal Reserve System; or</text>
				</paragraph><paragraph id="H1733459E6A3D4882AFA4867DB7167E2A"><enum>(4)</enum><text>obligations fully
			 guaranteed as to principal and interest by the United States.</text>
				</paragraph></subsection><subsection id="H658A5896C8FF4A2CB726CA1F5B9D44D8"><enum>(f)</enum><header>Assessment funds
			 for Regional Initiatives</header>
				<paragraph id="H09831F2AA1104C348091984867076451"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The order shall
			 provide that no less than 50 percent of the assessments (less administration
			 expenses) paid by a manufacturer shall be used to support research, education,
			 and promotion plans and projects in support of the geographic region of the
			 manufacturer.</text>
				</paragraph><paragraph id="H411C5AA13AA549BFAF120EF1853D6C16"><enum>(2)</enum><header>Geographic
			 regions</header><text display-inline="yes-display-inline">The order shall
			 provide for the following geographic regions:</text>
					<subparagraph id="H3014CE57AE604221975580DA851C8A13"><enum>(A)</enum><text>Region I shall
			 comprise Connecticut, Delaware, Maine, Maryland, Massachusetts, New Hampshire,
			 New Jersey, New York, Pennsylvania, Rhode Island, Vermont, and West
			 Virginia.</text>
					</subparagraph><subparagraph id="H0AD5D47910FE4902AA3BEE454CBE2729"><enum>(B)</enum><text>Region II shall
			 comprise Alabama, Florida, Georgia, Mississippi, North Carolina, South
			 Carolina, Tennessee, and Virginia.</text>
					</subparagraph><subparagraph id="H372EFC6E899940108AAA590E120005F4"><enum>(C)</enum><text>Region III shall
			 comprise Illinois, Indiana, Iowa, Kentucky, Michigan, Minnesota, Nebraska,
			 North Dakota, Ohio, South Dakota, and Wisconsin.</text>
					</subparagraph><subparagraph id="HDD2F19035BB44271AFF29DD854EB0574"><enum>(D)</enum><text>Region IV shall
			 comprise Arizona, Arkansas, Kansas, Louisiana, Missouri, New Mexico, Oklahoma,
			 and Texas.</text>
					</subparagraph><subparagraph id="H1D49D11CA3944B268A8368455F8C63B8"><enum>(E)</enum><text>Region V shall
			 comprise Alaska, California, Colorado, Hawaii, Idaho, Montana, Nevada, Oregon,
			 Utah, Washington, and Wyoming.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H3928BF1C3DC8464DB2204D33C352F161"><enum>(3)</enum><header>Adjustment of
			 geographic regions</header><text>The order shall provide that the Secretary
			 may, upon recommendation of the Board, modify the composition of the geographic
			 regions described in
			 <internal-xref idref="H411C5AA13AA549BFAF120EF1853D6C16" legis-path="6.(f)(2)">paragraph (2)</internal-xref>.</text>
				</paragraph></subsection></section><section id="HFF1F482941454F35B707DF3534306B8A"><enum>7.</enum><header>Referenda</header>
			<subsection id="H80AC7AA412C8405A854A949DAA647578"><enum>(a)</enum><header>Initial
			 Referendum</header>
				<paragraph commented="no" id="H5AC0E3121F3A44E791E6652A0073E0E2"><enum>(1)</enum><header>Referendum
			 required</header><text display-inline="yes-display-inline">During the 60-day
			 period immediately preceding the proposed effective date of the order issued
			 under section 4, the Secretary shall conduct a referendum among manufacturers
			 required to pay assessments under the order, as provided in
			 <internal-xref idref="HD654FE7EE3AE4C52B6CF88C3A917251D" legis-path="6.">section 6</internal-xref>.</text>
				</paragraph><paragraph id="H80547F99BD74437599B4EEB08AA5729A"><enum>(2)</enum><header>Approval of
			 order needed</header><text>The order shall become effective only if the
			 Secretary determines that the order has been approved by a simple majority of
			 all votes cast in the referendum.</text>
				</paragraph></subsection><subsection id="HACAC40A6521B4213B823F0B9459E63D6"><enum>(b)</enum><header>Votes
			 permitted</header>
				<paragraph id="HADB5E8EF490F43E3BC0CA8C176FB7047"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Each manufacturer
			 eligible to vote in a referendum conducted under this section shall be entitled
			 to cast one vote for each machine cavity in operation that is operated by such
			 manufacturer if they satisfy the eligibility requirements as defined in
			 paragraph (2).</text>
				</paragraph><paragraph id="HC62B82B836F2434DA291FE1905E5CF86"><enum>(2)</enum><header>Eligibility</header><text>For
			 purposes of paragraph (1), manufacturers shall be considered to be eligible to
			 vote if they have manufactured concrete masonry products during a period of at
			 least 180 days prior to the referendum.</text>
				</paragraph></subsection><subsection id="H5057777429364C618354FC77DEB027DE"><enum>(c)</enum><header>Manner of
			 conducting referenda</header>
				<paragraph id="HDAEB8891655142D9B988E507C77047F2"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Referenda conducted
			 pursuant to this section shall be conducted in a manner determined by the
			 Secretary.</text>
				</paragraph><paragraph id="H10BBEDBA0CD94FF5AD5883E9F47A04D7"><enum>(2)</enum><header>Advance
			 registration</header><text display-inline="yes-display-inline">A manufacturer
			 who chooses to vote in any referendum conducted under this section shall
			 register with the Secretary prior to the voting period, after receiving notice
			 from the Secretary concerning the referendum under
			 <internal-xref idref="H30C9B6C2744B456C85D1EFC98444DC6D" legis-path="7.(c)(4)">paragraph (4)</internal-xref>.</text>
				</paragraph><paragraph id="H7B5E937977BD41219421C76D6589BB87"><enum>(3)</enum><header>Voting</header><text display-inline="yes-display-inline">The Secretary shall establish procedures
			 for voting in any referendum conducted under this section. The ballots and
			 other information or reports that reveal or tend to reveal the identity or vote
			 of voters shall be strictly confidential.</text>
				</paragraph><paragraph id="H30C9B6C2744B456C85D1EFC98444DC6D"><enum>(4)</enum><header>Notice</header><text display-inline="yes-display-inline">Not later than 30 days before a referendum
			 is conducted under this section with respect to an order, the Secretary shall
			 notify all manufacturers, in such a manner as determined by the Secretary, of
			 the period during which voting in the referendum will occur. The notice shall
			 explain any registration and voting procedures established under this
			 subsection.</text>
				</paragraph></subsection><subsection id="H98E099CF501B44509D69518F16312D22"><enum>(d)</enum><header>Subsequent
			 referenda</header><text display-inline="yes-display-inline">If an order is
			 approved in a referendum conducted under
			 <internal-xref idref="H80AC7AA412C8405A854A949DAA647578" legis-path="7.(a)">subsection (a)</internal-xref>, the Secretary shall conduct
			 a subsequent referendum—</text>
				<paragraph commented="no" id="H7F6D52CB740945EC87C64B2E36595866"><enum>(1)</enum><text>at the request of
			 the Board, subject to the voting requirements of
			 <internal-xref idref="HACAC40A6521B4213B823F0B9459E63D6" legis-path="7.(b)">subsections (b)</internal-xref> and (c), to ascertain
			 whether eligible manufacturers favor suspension, termination, or continuance of
			 the order; or</text>
				</paragraph><paragraph id="HF83D0CBF4F11467782FD7EBAC8AFA711"><enum>(2)</enum><text>effective
			 beginning on the date that is 5 years after the date of the approval of the
			 order, and at 5-year intervals thereafter, at the request of 25 percent or more
			 of the number of persons eligible to vote under
			 <internal-xref idref="HACAC40A6521B4213B823F0B9459E63D6" legis-path="7.(b)">subsection (b)</internal-xref>.</text>
				</paragraph></subsection><subsection id="H88A3899068DD4F0EBA856EBAC405394E"><enum>(e)</enum><header>Suspension or
			 termination</header><text display-inline="yes-display-inline">If, as a result
			 of a referendum conducted under
			 <internal-xref idref="H98E099CF501B44509D69518F16312D22" legis-path="7.(d)">subsection (d)</internal-xref>, the Secretary determines
			 that suspension or termination of the order is favored by a simple majority of
			 all votes cast in the referendum, the Secretary shall—</text>
				<paragraph id="H6488F83FC4B747A68AB00F770A77ADCC"><enum>(1)</enum><text>not later than 180
			 days after the referendum, suspend or terminate, as appropriate, collection of
			 assessments under the order; and</text>
				</paragraph><paragraph id="HFFD7780F15E84F5AB0D8192D3511C2C0"><enum>(2)</enum><text>suspend or
			 terminate, as appropriate, activities under the order as soon as practicable
			 and in an orderly manner.</text>
				</paragraph></subsection><subsection id="HFBCE042F26B74C5B9E563CD649D43537"><enum>(f)</enum><header>Costs of
			 referenda</header><text display-inline="yes-display-inline">The Board
			 established under an order with respect to which a referendum is conducted
			 under this section shall reimburse the Secretary from assessments for any
			 expenses incurred by the Secretary to conduct the referendum.</text>
			</subsection></section><section id="HFA8B8171494A4E23B302CED7C5792987"><enum>8.</enum><header>Petition and
			 review</header>
			<subsection id="HBE83076554CD4539895D6264BACE3367"><enum>(a)</enum><header>Petition</header>
				<paragraph id="H2516BB3D9EBA40229F44E30608C30B14"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">A person subject to
			 an order issued under this Act may file with the Secretary a petition—</text>
					<subparagraph id="H6221FBBA76C04B078068D4FF1517473E"><enum>(A)</enum><text>stating that the
			 order, any provision of the order, or any obligation imposed in connection with
			 the order, is not established in accordance with law; and</text>
					</subparagraph><subparagraph id="HBB185E9B166B4087A801DBD9134DC39E"><enum>(B)</enum><text>requesting a
			 modification of the order or an exemption from the order.</text>
					</subparagraph></paragraph><paragraph id="H77418B03671C4F20BBA7E726CE821205"><enum>(2)</enum><header>Hearing</header><text display-inline="yes-display-inline">The Secretary shall give the petitioner an
			 opportunity for a hearing on the petition, in accordance with regulations
			 issued by the Secretary.</text>
				</paragraph><paragraph id="H8489165B8FEC466EAEF2DA84833657A6"><enum>(3)</enum><header>Ruling</header><text display-inline="yes-display-inline">After the hearing, the Secretary shall make
			 a ruling on the petition. The ruling shall be final, subject to review as set
			 forth in
			 <internal-xref idref="HBB580E4BFE0842958EFEE7ED73CC5D80" legis-path="8.(b)">subsection (b)</internal-xref>.</text>
				</paragraph><paragraph id="HCE90E18917EC4242B1AFE7F7C9A4E6E8"><enum>(4)</enum><header>Limitation on
			 petition</header><text>Any petition filed under this subsection challenging an
			 order, any provision of the order, or any obligation imposed in connection with
			 the order, shall be filed within 2 years after the effective date of the order,
			 provision, or obligation subject to challenge in the petition.</text>
				</paragraph></subsection><subsection id="HBB580E4BFE0842958EFEE7ED73CC5D80"><enum>(b)</enum><header>Review</header>
				<paragraph id="H77937A0742814934BC3467239B8E72CC"><enum>(1)</enum><header>Commencement of
			 action</header><text display-inline="yes-display-inline">The district courts of
			 the United States in any district in which a person who is a petitioner under
			 <internal-xref idref="HBE83076554CD4539895D6264BACE3367" legis-path="8.(a)">subsection (a)</internal-xref> resides or conducts business
			 shall have jurisdiction to review the ruling of the Secretary on the petition
			 of the person, if a complaint requesting the review is filed no later than 20
			 days after the date of the entry of the ruling by the Secretary.</text>
				</paragraph><paragraph id="H39FD58D820E541AAB9BBCCE8669ED440"><enum>(2)</enum><header>Process</header><text display-inline="yes-display-inline">Service of process in proceedings under
			 this subsection shall be conducted in accordance with the Federal Rules of
			 Civil Procedure.</text>
				</paragraph><paragraph id="H54BFEB8C6C8F4AFCB838276E553B24FB"><enum>(3)</enum><header>Remands</header><text display-inline="yes-display-inline">If the court in a proceeding under this
			 subsection determines that the ruling of the Secretary on the petition of the
			 person is not in accordance with law, the court shall remand the matter to the
			 Secretary with directions—</text>
					<subparagraph id="HAF3DC5E93B5D4561BE6BB992B25A1DC2"><enum>(A)</enum><text>to make such
			 ruling as the court shall determine to be in accordance with law; or</text>
					</subparagraph><subparagraph id="HF2E8042D938C47C6A610EC8A25A32E6B"><enum>(B)</enum><text>to take such
			 further action as, in the opinion the court, the law requires.</text>
					</subparagraph></paragraph></subsection><subsection id="HAB2C126ADDDB4AA4A3A5D5E33A619D2D"><enum>(c)</enum><header>Enforcement</header><text display-inline="yes-display-inline">The pendency of proceedings instituted
			 under this section shall not impede, hinder, or delay the Attorney General or
			 the Secretary from obtaining relief under
			 <internal-xref idref="H93E3CF064DAC4744B8AC74C9D42C31C7" legis-path="9.">section 9</internal-xref>.</text>
			</subsection></section><section id="H93E3CF064DAC4744B8AC74C9D42C31C7"><enum>9.</enum><header>Enforcement</header>
			<subsection id="H99C9CE5F8B7E4EF7A1EB74434BD478B3"><enum>(a)</enum><header>Jurisdiction</header><text display-inline="yes-display-inline">A district court of the United States shall
			 have jurisdiction to enforce, and to prevent and restrain any person from
			 violating, this Act or an order or regulation issued by the Secretary under
			 this Act.</text>
			</subsection><subsection id="H3514FC6E86C04E60AB3D6D609D4A5BE0"><enum>(b)</enum><header>Referral to
			 Attorney General</header><text display-inline="yes-display-inline">A civil
			 action authorized to be brought under this section shall be referred to the
			 Attorney General of the United States for appropriate action.</text>
			</subsection><subsection id="H07BDB6A4B7F547CE9C2B04B030A6D441"><enum>(c)</enum><header>Civil penalties
			 and orders</header>
				<paragraph id="H48FD5723CE0946DD9FB367298B9D80BD"><enum>(1)</enum><header>Civil
			 penalties</header><text display-inline="yes-display-inline">A person who
			 willfully violates an order or regulation issued by the Secretary under this
			 Act may be assessed by the Secretary a civil penalty of not more than $5,000
			 for each violation.</text>
				</paragraph><paragraph id="HFBA86695CEF545E5BB067A93E7233B54"><enum>(2)</enum><header>Separate
			 offense</header><text display-inline="yes-display-inline">Each violation and
			 each day during which there is a failure to comply with an order or regulation
			 issued by the Secretary shall be considered to be a separate offense.</text>
				</paragraph><paragraph id="HEDD35203E1EE4E5CAB38505B21CFC581"><enum>(3)</enum><header>Cease-and-desist
			 orders</header><text display-inline="yes-display-inline">In addition to, or in
			 lieu of, a civil penalty, the Secretary may issue an order requiring a person
			 to cease and desist from violating the order or regulation.</text>
				</paragraph><paragraph id="H9917CE8E4D674F8D8AA67A6969F7C76D"><enum>(4)</enum><header>Notice and
			 hearing</header><text display-inline="yes-display-inline">No order assessing a
			 penalty or cease-and-desist order may be issued by the Secretary under this
			 subsection unless the Secretary provides notice and an opportunity for a
			 hearing on the record with respect to the violation.</text>
				</paragraph><paragraph id="H1FD339D046F34BCA979748CA8E3AC261"><enum>(5)</enum><header>Finality</header><text display-inline="yes-display-inline">An order assessing a penalty or a
			 cease-and-desist order issued under this subsection by the Secretary shall be
			 final and conclusive unless the person against whom the order is issued files
			 an appeal from the order with the appropriate district court of the United
			 States, as provided in
			 <internal-xref idref="H758828ABE36C48B0B623F5D9CB66D7B5" legis-path="9.(d)">subsection (d)</internal-xref>.</text>
				</paragraph></subsection><subsection id="H1AAEB8E088A14E97BD86B2532357833E"><enum>(d)</enum><header>Additional
			 remedies</header><text>The remedies provided in this Act shall be in addition
			 to, and not exclusive of, other remedies that may be available.</text>
			</subsection></section><section id="H3C80E1CFC4DD41A9AFEC962C76FBCB6C"><enum>10.</enum><header>Investigation
			 and power to subpoena</header>
			<subsection id="H1108D05E126F4E2A98F9A9CB46EAA7D2"><enum>(a)</enum><header>Investigations</header><text display-inline="yes-display-inline">The Secretary may conduct such
			 investigations as the Secretary considers necessary for the effective
			 administration of this Act, or to determine whether any person has engaged or
			 is engaging in any act that constitutes a violation of this Act or any order or
			 regulation issued under this Act.</text>
			</subsection><subsection id="H56B4B51FAB6A4EC6B544E598ED991EE8"><enum>(b)</enum><header>Subpoenas,
			 oaths, and affirmations</header>
				<paragraph id="H33406A5CC845490BAC6B43F59BF67564"><enum>(1)</enum><header>Investigations</header><text>For
			 the purpose of conducting an investigation under
			 <internal-xref idref="H1108D05E126F4E2A98F9A9CB46EAA7D2" legis-path="10.(a)">subsection (a)</internal-xref>, the Secretary may
			 administer oaths and affirmations, subpoena witnesses, compel the attendance of
			 witnesses, take evidence, and require the production of any records that are
			 relevant to the inquiry. The production of the records may be required from any
			 place in the United States.</text>
				</paragraph><paragraph id="HAF1ABA09F3304B9AB14DBF58508813B6"><enum>(2)</enum><header>Administrative
			 hearings</header><text>For the purpose of an administrative hearing held under
			 <internal-xref idref="H77418B03671C4F20BBA7E726CE821205" legis-path="8.(a)(2)">section 8(a)(2)</internal-xref> or
			 <internal-xref idref="H9917CE8E4D674F8D8AA67A6969F7C76D" legis-path="9.(c)(4)">section 9(c)(4)</internal-xref>, the presiding officer
			 may administer oaths and affirmations, subpoena witnesses, compel the
			 attendance of witnesses, take evidence, and require the production of any
			 records that are relevant to the inquiry. The attendance of witnesses and the
			 production of the records may be required from any place in the United
			 States.</text>
				</paragraph></subsection><subsection id="HA8C61939EE84491AABD174BDC714DD95"><enum>(c)</enum><header>Aid of
			 courts</header>
				<paragraph id="HD8288AF181D84968B40404C7D09587D9"><enum>(1)</enum><header>In
			 general</header><text>In the case of contumacy by, or refusal to obey a
			 subpoena issued under
			 <internal-xref idref="H56B4B51FAB6A4EC6B544E598ED991EE8" legis-path="10.(b)">subsection (b)</internal-xref> to, any person, the
			 Secretary may invoke the aid of any court of the United States within the
			 jurisdiction of which the investigation or proceeding is conducted, or where
			 the person resides or conducts business, in order to enforce a subpoena issued
			 under
			 <internal-xref idref="H56B4B51FAB6A4EC6B544E598ED991EE8" legis-path="10.(b)">subsection (b)</internal-xref>.</text>
				</paragraph><paragraph id="HAA788954A4DF4CD3A649A57A590DAD2C"><enum>(2)</enum><header>Order</header><text>The
			 court may issue an order requiring the person referred to in a
			 <internal-xref idref="HD8288AF181D84968B40404C7D09587D9" legis-path="10.(c)(1)">paragraph (1)</internal-xref> to comply with a subpoena
			 referred to in
			 <internal-xref idref="HD8288AF181D84968B40404C7D09587D9" legis-path="10.(c)(1)">paragraph (1)</internal-xref>.</text>
				</paragraph><paragraph id="H1E37699199A94406BD6AC5005A4984E2"><enum>(3)</enum><header>Failure to
			 obey</header><text>Any failure to obey the order of the court may be punished
			 by the court as a contempt of court.</text>
				</paragraph><paragraph id="HC31B83AACE9A4093A55A8DCC4041B0F1"><enum>(4)</enum><header>Process</header><text>Process
			 in any proceeding under this subsection may be served in the United States
			 judicial district in which the person being proceeded against resides or
			 conducts business, or wherever the person may be found.</text>
				</paragraph></subsection></section><section id="HF012C962546445109014D8E4A0E1C1DD"><enum>11.</enum><header>Suspension or
			 termination</header>
			<subsection id="H230E9022643D424E9AB3BFEA74D97F9B"><enum>(a)</enum><header>Mandatory
			 suspension or termination</header><text display-inline="yes-display-inline">The
			 Secretary shall suspend or terminate an order or a provision of an order if the
			 Secretary finds that an order or provision of an order obstructs or does not
			 tend to effectuate the purpose of this Act, or if the Secretary determines that
			 the order or a provision of an order is not favored by persons voting in a
			 referendum conducted under
			 <internal-xref idref="HFF1F482941454F35B707DF3534306B8A" legis-path="7.">section 7</internal-xref>.</text>
			</subsection><subsection id="H34DADDED00514BF899B70E7197EC99A8"><enum>(b)</enum><header>Implementation
			 of suspension or termination</header><text>If, as a result of a referendum
			 conducted under
			 <internal-xref idref="HFF1F482941454F35B707DF3534306B8A" legis-path="7.">section 7</internal-xref>, the Secretary determines that the
			 order is not approved, the Secretary shall—</text>
				<paragraph id="H8E15A0ACF5B74444B53D4A63F3B6CB2D"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 180 days after making the
			 determination, suspend or terminate, as the case may be, collection of
			 assessments under the order; and</text>
				</paragraph><paragraph id="H706E4E8C5B784EA6B1709369A1BB7C50"><enum>(2)</enum><text>as soon as
			 practicable, suspend or terminate, as the case may be, activities under the
			 order in an orderly manner.</text>
				</paragraph></subsection></section><section id="HE2AD094D540246B1835EE325E8E22431"><enum>12.</enum><header>Confidentiality</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to
			 require the Board to disclose information or records under section 552 of title
			 5, United States Code.</text>
		</section><section id="HAAE51E838DC440A29E36AC0BD2F26A25"><enum>13.</enum><header>Amendments to
			 orders</header><text display-inline="no-display-inline">The provisions of this
			 Act applicable to the order shall be applicable to any amendment to the order,
			 except that section 8 shall not apply to an amendment.</text>
		</section><section id="H3868C33C30C149188FB64AA32649BEF8"><enum>14.</enum><header>Effect on other
			 laws</header><text display-inline="no-display-inline">This Act shall not affect
			 or preempt any other Federal or State law authorizing research, education, and
			 promotion relating to concrete masonry products.</text>
		</section><section id="H8F6A7DDF5A114FC2B255F17275278529"><enum>15.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary may issue such regulations as
			 may be necessary to carry out this Act and the power vested in the Secretary
			 under this Act.</text>
		</section><section id="H2BA9BCAAB7D2409F99FBDD342D207EA5"><enum>16.</enum><header>Limitation on
			 expenditures for administrative expenses</header><text display-inline="no-display-inline">Funds appropriated to carry out this Act may
			 not be used for the payment of the expenses or expenditures of the Board in
			 administering the order.</text>
