		<official-title>To amend the Consolidated Farm and Rural Development Act
		  to provide and improve housing in rural areas for educators, public safety
		  officers, and medical providers, and their households, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Rural Educator and American
			 Community Housing Act of 2013</short-title></quote>.</text>
		</section><section id="id4F6528D2D4D8479F8A51A2084ECBC877"><enum>2.</enum><header>Housing for
			 educators, public safety officers, and medical providers</header><text display-inline="no-display-inline">Section 306(a) of the Consolidated Farm and
			 Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926">7 U.S.C. 1926(a)</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="id0902A4DAF87A4D78A175BC7D51B4CC72" style="OLC">
				<paragraph id="idC950A990DC10429D9221FDC92440AC1F"><enum>(26)</enum><header>Grants and
				loan guarantees to provide housing for educators, public safety officers, and
				medical providers</header>
					<subparagraph id="id2509E91CAA2C4F25BB98E1F994BF7D54"><enum>(A)</enum><header>Definitions</header><text>In
				this paragraph:</text>
						<clause id="idA89E650644194B238695E0711F7A70B7"><enum>(i)</enum><header>Educator</header><text>The
				term <term>educator</term> means an individual who—</text>
							<subclause id="idEC40907D721A4EC39E876A402DBD22EE"><enum>(I)</enum><text>is employed
				full-time as a teacher, principal, or administrator by—</text>
								<item id="id41F9417D0968478AB8E05E43D98525C2"><enum>(aa)</enum><text>a
				public elementary school or secondary school that provides direct services to
				students in grades prekindergarten through grade 12, or a Head Start program;
				and</text>
								</item><item id="idE0F6715E9F5C4F539E1A83C2D5060366"><enum>(bb)</enum><text>meets the
				appropriate teaching certification or licensure requirements of the State for
				the position in which the individual is employed; or</text>
								</item></subclause><subclause id="id32F9621CDF32476895247E7C97354CFE"><enum>(II)</enum><text>is employed
				full-time as a librarian, a career guidance or counseling provider, an
				education aide, or in another instructional or administrative position for a
				public elementary school or secondary school.</text>
							</subclause></clause><clause id="id973AEB1549C34D5383F076F29FCBB478"><enum>(ii)</enum><header>Medical
				provider</header><text>The term <term>medical provider</term> means—</text>
							<subclause id="idA3D399EF38D14CB598F180C36681224C"><enum>(I)</enum><text>a licensed doctor
				of medicine or osteopathy;</text>
							</subclause><subclause id="id6B31CF828D4F4D05BEE21548CAAF44CD"><enum>(II)</enum><text>an American
				Indian, Alaska Native, or Native Hawaiian recognized as a traditional healing
				practitioner;</text>
							</subclause><subclause id="id5339C8D1A820441297B25F0958F72251"><enum>(III)</enum><text>a health care
				provider that—</text>
								<item id="idB4B0CFFD4E4B4E0C97135E4308B4E407"><enum>(aa)</enum><text>is
				licensed or certified under Federal or State law, as applicable; and</text>
								</item><item id="idA6BE19B2760A43FC89AA9A017FF9304B"><enum>(bb)</enum><text>is
				providing services that are eligible for coverage under a plan under the
				Federal Employees Health Benefits Program under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/89">chapter 89</external-xref> of title 5, United
				States Code;</text>
								</item></subclause><subclause id="id88C06EEBC1A34ADAA95BD17426A9B6B6"><enum>(IV)</enum><text>a provider
				authorized under section 119 of the Indian Health Care Improvement Act (25
				U.S.C. 1616<italic>l</italic>); or</text>
							</subclause><subclause id="id37635C0D475F408681D16BD04ED38BB0"><enum>(V)</enum><text>any other
				individual that the Secretary determines is capable of providing health care
				services.</text>
							</subclause></clause><clause id="id27BB9FBC965640FB89074D001D44B906"><enum>(iii)</enum><header>Public safety
				officer</header><text>The term <term>public safety officer</term> means an
				individual who is employed full-time—</text>
							<subclause id="id52344F5FC1FB44F0866D39CC04C4A66D"><enum>(I)</enum><text>as a law
				enforcement officer by a law enforcement agency of the Federal Government, a
				State, a unit of general local government, or an Indian tribe; or</text>
							</subclause><subclause id="id9ECC276BC83843279BC957651F535DA2"><enum>(II)</enum><text>as a firefighter
				by a fire department of the Federal Government, a State, a unit of general
				local government, or an Indian tribe.</text>
							</subclause></clause><clause commented="no" id="id06406A01AEC74684A554F8B7463A0D36"><enum>(iv)</enum><header>Qualified
				community</header><text>The term <term>qualified community</term> means any
				open country, or any place, town, village, or city—</text>
							<subclause commented="no" id="id8600E0A77D0648F895AE6445EA66DF9D"><enum>(I)</enum><text>that is not part
				of or associated with an urban area; and</text>
							</subclause><subclause commented="no" id="idCD110959EECE419B91E9FF3157DBBCA6"><enum>(II)</enum><text>that—</text>
								<item commented="no" id="id1732B8B5E9E44F6387A1187AB2F26E29"><enum>(aa)</enum><text>has a population
				of not more than 2,500; or</text>
								</item><item commented="no" id="idEC7437B7E57C41088DE3B47C4DD4C2CE"><enum>(bb)</enum><subitem commented="no" display-inline="yes-display-inline" id="id02C418346E6D43E481E04640E3A3EDCA"><enum>(AA)</enum><text>has a population of
				not more than 10,000; and</text>
									</subitem><subitem commented="no" id="idF6CBFEA888C1497488CD48B46904A23A" indent="up1"><enum>(BB)</enum><text>is not accessible by a motor vehicle, as
				defined in <external-xref legal-doc="usc" parsable-cite="usc/49/30102">section 30102</external-xref> of title 49, United States Code.</text>
									</subitem></item></subclause></clause><clause commented="no" id="id49C8AFE11FCE4B48948F495340C6AAC0"><enum>(v)</enum><header>Qualified
				housing</header><text>The term <term>qualified housing</term> means housing for
				educators, public safety officers, or medical providers that is located in a
				qualified community.</text>
						</clause><clause commented="no" id="id64DD1FE23F96446CBB01554E45E54A0F"><enum>(vi)</enum><header>Qualified
				project</header><text>The term <term>qualified project</term> means—</text>
							<subclause id="idD18963F72B574ACDA8E724DB9C20011A"><enum>(I)</enum><text>the construction,
				modernization, renovation, or repair of qualified housing;</text>
							</subclause><subclause id="idB470DD6B150C4B068D08220C142C5FE8"><enum>(II)</enum><text>the payment of
				interest on bonds or other financing instruments (excluding instruments used
				for refinancing) that are issued for the construction, modernization,
				renovation, or repair of qualified housing;</text>
							</subclause><subclause id="id3A911F693EDD48F9B2E145ABDE89E2F3"><enum>(III)</enum><text>the repayment
				of a loan used—</text>
								<item id="idB34A8B25895E4BCEA29669BBAF0BC450"><enum>(aa)</enum><text>for the
				construction, modernization, renovation, or repair of qualified housing;
				or</text>
								</item><item id="idC87E5AB5664F4781975FEB85A889AA24"><enum>(bb)</enum><text>to
				purchase real property on which qualified housing will be constructed;</text>
								</item></subclause><subclause id="idE9D5D19519364FEE87DD22204F077DE5"><enum>(IV)</enum><text>purchasing or
				leasing real property on which qualified housing will be constructed,
				renovated, modernized, or repaired; or</text>
							</subclause><subclause id="idE1793FE2853B4CDAB2139097790791D5"><enum>(V)</enum><text>any other
				activity normally associated with the construction, modernization, renovation,
				or repair of qualified housing, as determined by the Secretary.</text>
							</subclause></clause><clause id="id534C537F40CE417F9584AF1C3BB48D35"><enum>(vii)</enum><header>Educational
				service agency, elementary school, local educational agency, secondary school,
				State educational agency</header><text>The terms <term>educational service
				agency</term>, <term>elementary school</term>, <term>local educational
				agency</term>, <term>secondary school</term>, and <term>State educational
				agency</term> have the meanings given those terms in section 9101 of the
				Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
						</clause></subparagraph><subparagraph id="id4CDD352EB94145C09B3437D6546057AF"><enum>(B)</enum><header>Grants</header><text>The
				Secretary may make a grant to an applicant to carry out a qualified
				project.</text>
					</subparagraph><subparagraph id="id9F69C241B35E4F718C49460B4E2D6ECA"><enum>(C)</enum><header>Loan
				guarantees</header><text>The Secretary may guarantee a loan made to an
				applicant for the construction, modernization, renovation, or repair of
				qualified housing.</text>
					</subparagraph><subparagraph id="idFC4AAC3E6E1349D280A643D444C7AC60"><enum>(D)</enum><header>Financing
				mechanisms</header><text>The Secretary may make payments of interest on bonds,
				loans, or other financial instruments (other than financial instruments used
				for refinancing) that are issued to an applicant for a qualified
				project.</text>
					</subparagraph><subparagraph id="idD0DA64AD010E4FEE9D66540970448BAF"><enum>(E)</enum><header>Application</header><text>An
				applicant that desires a grant, loan guarantee, or payment of interest under
				this paragraph shall submit to the Secretary an application that—</text>
						<clause id="id1D2878A77FE1487692C48C5A9DD14A58"><enum>(i)</enum><text>indicates whether
				the qualified housing for which the grant, loan guarantee, or payment of
				interest is sought is located in a qualified community;</text>
						</clause><clause id="id87D7DD51CEC94BA4BB1634DADCC483D7"><enum>(ii)</enum><text>identifies the
				applicant;</text>
						</clause><clause id="idA2714A72FCA0450DAC9F313A738AF95B"><enum>(iii)</enum><text>indicates
				whether the applicant prefers to receive a grant, loan guarantee, or payment of
				interest under this paragraph;</text>
						</clause><clause id="idC14622FEB667409B90E967DDD015F39D"><enum>(iv)</enum><text>describes how
				the applicant would ensure the adequate maintenance of qualified housing
				assisted under this paragraph;</text>
						</clause><clause id="id2062C063E9AE4649BEAD987B5F52B14F"><enum>(v)</enum><text>demonstrates a
				need for qualified housing in a qualified community, which may include a
				deficiency of affordable housing, a deficiency of habitable housing, or the
				need to modernize, renovate, or repair housing;</text>
						</clause><clause id="idA2F9D8C894004E34999F7C67677737AF"><enum>(vi)</enum><text>describes the
				expected impact of the grant, loan guarantee, or payment of interest on—</text>
							<subclause id="id9EFB15B3877641DF9268D4284B241FEA"><enum>(I)</enum><text>educators, public
				safety officers, and medical providers in a qualified community, including the
				impact on recruitment and retention of educators, public safety officers, and
				medical providers; and</text>
							</subclause><subclause id="id5DAD297FA11143B8A295BAF8F3A25398"><enum>(II)</enum><text>the economy of a
				qualified community, including—</text>
								<item id="idD30E8571FB274D4083A4369C028E6612"><enum>(aa)</enum><text>any plans to use
				small business concerns for the construction, modernization, renovation, or
				repair of qualified housing; and</text>
								</item><item id="id4C128393EB824D6AB0D343035002BCF4"><enum>(bb)</enum><text>the short- and
				long-term impact on the rate of employment in the qualified community;
				and</text>
								</item></subclause></clause><clause id="id6713B02643424745A41A7DF7E368BB37"><enum>(vii)</enum><text>describes how
				the applicant would ensure that qualified housing assisted under this paragraph
				is used for educators, public safety officers, and medical providers.</text>
						</clause></subparagraph><subparagraph id="id7C0586CBAEE44096A215C90EB504EC30"><enum>(F)</enum><header>Input from
				State Director of Rural Development</header><text>The State Director of Rural
				Development for a State may submit to the Secretary an evaluation of any
				application for a qualified project in the State for which an application for
				assistance under this paragraph is submitted and the Secretary shall take into
				consideration the evaluation in determining whether to provide
				assistance.</text>
					</subparagraph><subparagraph id="id973B2874804E4FBCAFC35E0399C2E6CC"><enum>(G)</enum><header>Priority</header><text>In
				awarding grants and making loan guarantees and payments of interest under this
				paragraph, the Secretary shall give priority to an applicant that is—</text>
						<clause id="id6A85775496BB4BB2AD5B5030504B725B"><enum>(i)</enum><text>a
				State educational agency or local educational agency;</text>
						</clause><clause id="idA5316615DBDB43F78DF31630B07AEE22"><enum>(ii)</enum><text>an educational
				service agency;</text>
						</clause><clause id="id5E4A82E7A52E401F802BD7145D749F95"><enum>(iii)</enum><text>a State or
				local housing authority;</text>
						</clause><clause id="id5264CB574B164292A244B8D61AF22DA0"><enum>(iv)</enum><text>an Indian tribe
				or tribal organization, as those terms are defined in section 4 of the Indian
				Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>);</text>
						</clause><clause id="id0EFEDA7A0393491D80279FCE7229085C"><enum>(v)</enum><text>a
				tribally designated housing entity;</text>
						</clause><clause id="idA9AE252955044446A256CFB7F62973FE"><enum>(vi)</enum><text>a local
				government; or</text>
						</clause><clause id="idDE100402F9214C7A86342DFF205E3617"><enum>(vii)</enum><text>a consortium of
				any of the entities described in clauses (i) through (vi).</text>
						</clause></subparagraph><subparagraph id="id9B69D3FFCB5B454FB57D2786FC539ABC"><enum>(H)</enum><header>Limitation</header><text>The
				Secretary may provide assistance to the same applicant under only 1 of
				subparagraphs (B), (C), and (D).</text>
					</subparagraph><subparagraph id="id8E319522C3534ADEBABB222CF63208D5"><enum>(I)</enum><header>Requirement</header><text>As
				a condition of eligibility for a grant, loan guarantee, or payment of interest
				under this paragraph, at least 1 named applicant shall be required to maintain
				ownership of the qualified housing that is the subject of the grant, loan
				guarantee, or payment of interest during the greater of—</text>
						<clause id="idEB39E33525554F4688CD3C24D963F44E"><enum>(i)</enum><text>15 years;
				or</text>
						</clause><clause id="id3722B4EBF9F54F21841AB649B2506E2E"><enum>(ii)</enum><text>the period of
				the loan for which a loan guarantee or payment of interest is made under this
				paragraph.</text>
						</clause></subparagraph><subparagraph id="id35307D504D0542CA8B6B20DE0DBCCC86"><enum>(J)</enum><header>Reporting</header>
						<clause id="id92ECA1803EE8413086DF0D5E1DD1F831"><enum>(i)</enum><header>By
				applicants</header><text>Not later than 2 years after the date on which an
				applicant receives a grant, loan guarantee, or payment of interest under this
				paragraph, the applicant shall submit to the Secretary a report that—</text>
							<subclause id="idAB9B28832C0E4702BB4D0ACB4C5F06A1"><enum>(I)</enum><text>describes how the
				grant, loan guarantee, or payment of interest was used; and</text>
							</subclause><subclause id="id668DAF350F584E7D99CF787A3FCEB6C6"><enum>(II)</enum><text>contains an
				estimate of the number of jobs created or maintained by use of the grant, loan
				guarantee, or payment of interest.</text>
							</subclause></clause><clause id="id429FBF88341F4689950774206B352E63"><enum>(ii)</enum><header>By
				GAO</header><text>Not later than 2 years after the date of enactment of this
				paragraph, the Comptroller General of the United States shall submit to
				Congress a report evaluating the program under this paragraph.</text>
						</clause></subparagraph><subparagraph id="id6C3EEAFD539A42ADA26D53C7FFE3709C"><enum>(K)</enum><header>Authorization
				of appropriations</header>
						<clause id="id8818D09651F74D5DB82A07309B258FBA"><enum>(i)</enum><header>In
				general</header><text>There is authorized to be appropriated to the Secretary
				$50,000,0000 for fiscal year 2013, and each fiscal year thereafter.</text>
						</clause><clause id="id6907FD50B20E40E398663FFCF10ED844"><enum>(ii)</enum><header>Availability</header><text>Any
				amounts appropriated to carry out this paragraph shall remain available for
				obligation by the Secretary during the 3-year period beginning on the date of
				the appropriation.</text>
						</clause><clause id="id54A8CCF63F1244068B2FC9F0511C033F"><enum>(iii)</enum><header>Use of
				funds</header><text>Of any amounts appropriated for a fiscal year to carry out
				this paragraph, the Secretary shall use—</text>
							<subclause id="id3DE7E36658224377A02295E02A664D58"><enum>(I)</enum><text>not less than 50
				percent to make grants under this paragraph;</text>
							</subclause><subclause id="id40F5CA897A7B4FE0A26932E0EFAFCAB6"><enum>(II)</enum><text>not more than 5
				percent to carry out national activities under this paragraph, including
				providing technical assistance and conducting outreach to qualified
				communities; and</text>
							</subclause><subclause id="idCB90B3DB2D2E4264A3083361C2157CB9"><enum>(III)</enum><text>any amounts not
				expended in accordance with subclauses (I) and (II) to make loan guarantees and
				payments of interest under this
				paragraph.</text>
							</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
