		  Code, to add a definition of spouse for purposes of military personnel policies
		  and military and veteran benefits that recognizes new State definitions of

		<section id="H36883ABD364C4269A3D811BA70DFD239" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Charlie Morgan Military Spouses Equal
			 Treatment Act of 2013</short-title></quote>.</text>
		</section><section id="H727A5A6C9F994A3EAA804C0A955B1094"><enum>2.</enum><header>Definition of
			 spouse for purposes of military personnel policies and military and veteran
			 benefits to reflect new State definitions of spouse</header>
			<subsection id="HE20CCE1D159E4F0481B420C33C298980"><enum>(a)</enum><header>Title
			 10</header>
				<paragraph id="HE95147F1512D4722909FE5825AFF8500"><enum>(1)</enum><header>Definition</header><text display-inline="yes-display-inline">Paragraph (5) of section 101(f) of title
			 10, United States Code, is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H3E11CE666C7E48B0834B3C0F414AF268" style="OLC">
						<paragraph id="HD621AA1E565E48059E8BA8C147769B39"><enum>(5)</enum><text display-inline="yes-display-inline">Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/1/7">section 7</external-xref> of title 1, an
				individual shall be considered a <quote>spouse</quote> if the marriage of the
				individual is valid in the State in which the marriage was entered into or, in
				the case of a marriage entered into outside any State, if the marriage is valid
				in the place in which the marriage was entered into and the marriage could have
				been entered into in a State. In this paragraph, the term <quote>State</quote>
				means the several States, the District of Columbia, the Commonwealth of Puerto
				Rico, the Commonwealth of the Northern Mariana Islands, and the territories and
				possessions.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HE85C001011CE4978B82A8472C7E88FCD"><enum>(2)</enum><header>Conforming
			 amendments</header><text>Such section is further amended—</text>
					<subparagraph id="HC7C8CD64AF4C4E2D813BA5B112DA6BF8"><enum>(A)</enum><text>in the matter
			 preceding paragraph (1), by striking <quote>In this title—</quote> and
			 inserting <quote>The following rules of construction apply in this
			 title:</quote>;</text>
					</subparagraph><subparagraph id="H266276A2F7E04B3CAFAFD1505D6CDFFF"><enum>(B)</enum><text>in paragraph
			 (1)—</text>
						<clause id="HF6DEF47198E242BBBD6E3B0A673C15C7"><enum>(i)</enum><text>by
			 inserting <quote>The term</quote> after <quote>(1)</quote>; and</text>
						</clause><clause id="HCCE38D81F5D24FACA04C198EF3F45C9B"><enum>(ii)</enum><text>by
			 striking the semicolon at the end and inserting a period;</text>
						</clause></subparagraph><subparagraph id="H1A8DDA44A31A4CBA88469BD846E38885"><enum>(C)</enum><text>in paragraph
			 (2)—</text>
						<clause id="HB114F5FDF8EE49509D62EB10C4082206"><enum>(i)</enum><text>by
			 inserting <quote>The term</quote> after <quote>(2)</quote>; and</text>

			 striking the semicolon at the end and inserting a period;</text>
						</clause></subparagraph><subparagraph id="H2F7A9A3E81F641F8AF5B3EEEA53E984A"><enum>(D)</enum><text>in paragraph
			 (3)—</text>

			 inserting <quote>The phrase</quote> after <quote>(3)</quote>; and</text>
						</clause><clause id="H235FBEC713F6464AA2861DFBF9339665"><enum>(ii)</enum><text>by
			 striking the semicolon at the end and inserting a period; and</text>
						</clause></subparagraph><subparagraph id="HE2CA5D68C1174A048AF555BBA74542B2"><enum>(E)</enum><text>in paragraph
			 (4)—</text>
						<clause id="H4AEE1D00856F40D0884794CEEBD54D6A"><enum>(i)</enum><text>by
			 inserting <quote>The term</quote> after <quote>(4)</quote>; and</text>
						</clause><clause id="H50CD9E05A0B441B9AC4A0FE53C2EFC3F"><enum>(ii)</enum><text>by
			 striking <quote>; and</quote> and inserting a period.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H285FCB49816E42B3A5A62ECD5DFF6533"><enum>(b)</enum><header>Title
			 32</header><text>Paragraph (18) of <external-xref legal-doc="usc" parsable-cite="usc/32/101">section 101</external-xref> of title 32, United States Code,
			 is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H7F3E2D3B908347F8A1D9DD91374C75BB" style="OLC">
					<paragraph id="HF978F2589B2A4CC787074486DDDF5671"><enum>(18)</enum><text display-inline="yes-display-inline">Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/1/7">section 7</external-xref> of title 1, an
				individual shall be considered a <quote>spouse</quote> if the marriage of the
				individual is valid in the State in which the marriage was entered into or, in
				the case of a marriage entered into outside any State, if the marriage is valid
				in the place in which the marriage was entered into and the marriage could have
				been entered into in a State. In this paragraph, the term <quote>State</quote>

			</subsection><subsection id="H81307F3427454687A9F198539976BA1B"><enum>(c)</enum><header>Title
			 37</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/37/101">Section 101</external-xref> of title 37,
			 United States Code, is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HBB3C1620A77D4A9DB0D020FD09B3883E" style="OLC">
					<paragraph id="H939EF7BB324047BD9CD9909CC2E0A91C"><enum>(27)</enum><text display-inline="yes-display-inline">Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/1/7">section 7</external-xref> of title 1, an
				individual shall be considered a <quote>spouse</quote> if the marriage of the
				individual is valid in the State in which the marriage was entered into or, in
				the case of a marriage entered into outside any State, if the marriage is valid
				in the place in which the marriage was entered into and the marriage could have
				been entered into in a State. In this paragraph, the term <quote>State</quote>
				means the several States, the District of Columbia, the Commonwealth of Puerto
				Rico, the Commonwealth of the Northern Mariana Islands, and the territories and
				possessions.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA246DF97FCCB4AC88ACFA77F1308BE47"><enum>(d)</enum><header>Title
			 38</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/101">Section 101</external-xref> of title 38,
			 United States Code, is amended—</text>
				<paragraph id="H7F3CA988CEB04ACF9175F0226F21E8BB"><enum>(1)</enum><text>in paragraph (3),
			 by striking <quote>of the opposite sex</quote>; and</text>
				</paragraph><paragraph id="HADF289C7BBEE4C618FFA7B75C83C1CD9"><enum>(2)</enum><text>by striking
			 paragraph (31) and inserting the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H9E42194F5AF34596912BC4CBE70F9C0F" style="OLC">
						<paragraph id="HDBAA97691A8E4AC7A8F00EFF8B1BEC74" indent="up1"><enum>(31)</enum><text display-inline="yes-display-inline">Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/1/7">section 7</external-xref> of title 1, an
				individual shall be considered a <quote>spouse</quote> if the marriage of the
				individual is valid in the State in which the marriage was entered into or, in
				the case of a marriage entered into outside any State, if the marriage is valid
				in the place in which the marriage was entered into and the marriage could have
				been entered into in a State. In this paragraph, the term <quote>State</quote>
				has the meaning given that term in paragraph (20), except that the term also
				includes the Commonwealth of the Northern Mariana
				Islands.</text>
