		<official-title display="yes">To increase public safety by permitting the
		  Attorney General to deny the transfer of firearms or the issuance of firearms
		  and explosives licenses to known or suspected dangerous
		  terrorists.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Denying Firearms and Explosives to
			 Dangerous Terrorists Act of 2013</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idAD88A0613646408894DA2C004F3A8BBE" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Granting the Attorney General the authority
			 to deny the sale, delivery, or transfer of a firearm or the issuance of a
			 firearms or explosives license or permit to dangerous terrorists</header>
			<subsection commented="no" display-inline="no-display-inline" id="id17F58F28F93748BDA37E2C1FD02041BC"><enum>(a)</enum><header display-inline="yes-display-inline">Standard for exercising Attorney General
			 discretion regarding transferring firearms or issuing firearms permits to
			 dangerous terrorists</header><text display-inline="yes-display-inline">Chapter
			 44 of title 18, United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id1832E8C25AD045789E836BFA152F1D6D"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting after section 922 the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idE15D1A0AEF364FAE956816CDACC40ADD" style="USC">
						<section commented="no" display-inline="no-display-inline" id="idF4FEF22C506E4718A97D3358BF274B8F" section-type="subsequent-section"><enum>922A.</enum><header display-inline="yes-display-inline">Attorney General's discretion to deny
				transfer of a firearm.</header><text display-inline="no-display-inline">The
				Attorney General may deny the transfer of a firearm under section
				922(t)(1)(B)(ii) of this title if the Attorney General—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id180712C1559B4B6494286B33FEC6FC57"><enum>(1)</enum><text display-inline="yes-display-inline">determines that the transferee is known (or
				appropriately suspected) to be or have been engaged in conduct constituting, in
				preparation for, in aid of, or related to terrorism, or providing material
				support or resources for terrorism; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8EA26302AFE5474FB9F8B5A7DF8CDB52"><enum>(2)</enum><text display-inline="yes-display-inline">has a reasonable belief that the
				prospective transferee may use a firearm in connection with terrorism.</text>
							</paragraph></section><section commented="no" display-inline="no-display-inline" id="id57A9A7F95B4E4ACC847EA637307A7D78" section-type="subsequent-section"><enum>922B.</enum><header display-inline="yes-display-inline">Attorney General's discretion regarding
				applicants for firearm permits which would qualify for the exemption provided
				under section 922(t)(3).</header><text display-inline="no-display-inline">The
				Attorney General may determine that—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idE451C309AAE44CB6B00C1C365712E468"><enum>(1)</enum><text display-inline="yes-display-inline">an applicant for a firearm permit which
				would qualify for an exemption under section 922(t) is known (or appropriately
				suspected) to be or have been engaged in conduct constituting, in preparation
				for, in aid of, or related to terrorism, or providing material support or
				resources for terrorism; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7876EFEDB271400ABF975C69DE909AD5"><enum>(2)</enum><text display-inline="yes-display-inline">the Attorney General has a reasonable
				belief that the applicant may use a firearm in connection with
				terrorism.</text>
							</paragraph></section><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id257602CBE66B46018FEA6A6B6F1103AD"><enum>(2)</enum><text display-inline="yes-display-inline">in section 921(a), by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idBB8EF8C09A0B44048503A9A7905FBF87" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="idE406ECB9758F4C9093553702EF24EE99"><enum>(36)</enum><text display-inline="yes-display-inline">The term <term>terrorism</term> includes
				international terrorism and domestic terrorism, as defined in section 2331 of
				this title.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5452C908B3DC4C43B94538A81A86C8FF"><enum>(37)</enum><text display-inline="yes-display-inline">The term <term>material support or
				resources</term> has the meaning given the term in section 2339A of this
				title.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDCC8C57B7B8B437AA23CB432B3FC83DE"><enum>(38)</enum><text display-inline="yes-display-inline">The term <term>responsible person</term>
				means an individual who has the power, directly or indirectly, to direct or
				cause the direction of the management and policies of the applicant or licensee
				pertaining to firearms.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE8F907184E6C48398DDC2A05F95350F0"><enum>(3)</enum><text display-inline="yes-display-inline">in the table of sections, by inserting
			 after the item relating to section 922 the following:</text>
					<quoted-block display-inline="no-display-inline" id="idaa666b35-3d78-4a6c-b9a5-1ea4cae5b368" style="USC">

							<toc-entry bold="off" idref="idF4FEF22C506E4718A97D3358BF274B8F" level="section">922A. Attorney General's discretion to deny transfer of a
				firearm.</toc-entry>
							<toc-entry bold="off" idref="id57A9A7F95B4E4ACC847EA637307A7D78" level="section">922B. Attorney General's discretion regarding applicants for
				firearm permits which would qualify for the exemption provided under section
				922(t)(3).</toc-entry>
						</toc>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB04BDCB4C2964A3B9B522C636B62839F"><enum>(b)</enum><header display-inline="yes-display-inline">Effect of Attorney General discretionary
			 denial through the National Instant Criminal Background Check System (NICS) on
			 firearms permits</header><text display-inline="yes-display-inline">Section
			 922(t) of title 18, United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id9C9EAB5921F7445C9C5EC873ADB1F263"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(B)(ii), by inserting
			 <quote>or State law, or that the Attorney General has determined to deny the
			 transfer of a firearm pursuant to section 922A of this title</quote> before the
			 semicolon;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCBB1122502CA4BC5818522CF53E108FA"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), in the matter preceding
			 subparagraph (A), by inserting <quote>, or if the Attorney General has not
			 determined to deny the transfer of a firearm pursuant to section 922A of this
			 title</quote> after <quote>or State law</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC1FA0797271B479AA989E183BE1FC111"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id81252F56FA5E4C16894840194A159BB0"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text>

							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id4DE43FEC410B42718E6AE988CBCAE464"><enum>(ii)</enum><text display-inline="yes-display-inline">in clause (ii), by inserting
			 <quote>and</quote> after the semicolon; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id71F197DC186147009592CDB382001E29"><enum>(iii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="id092487CF928642B79EE95605DC0C1FA9" style="OLC">
								<clause commented="no" display-inline="no-display-inline" id="id1D455F5CB50D4E84917569D06E077398" indent="up2"><enum>(iii)</enum><text display-inline="yes-display-inline">the State issuing the permit agrees to deny
				the permit application if such other person is the subject of a determination
				by the Attorney General pursuant to section 922B of this
				title;</text>

						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5A97BC8E45514DA08BF8943E3A8A90C8"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (4), by inserting <quote>, or
			 if the Attorney General has not determined to deny the transfer of a firearm
			 pursuant to section 922A of this title</quote> after <quote>or State
			 law</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92A3BBC3CE634794A2BEFC2ECB8C8A78"><enum>(5)</enum><text display-inline="yes-display-inline">in paragraph (5), by inserting <quote>, or
			 if the Attorney General has determined to deny the transfer of a firearm
			 pursuant to section 922A of this title</quote> after <quote>or State
			 law</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9AE6B402F2124719A468232228CA5483"><enum>(c)</enum><header display-inline="yes-display-inline">Unlawful sale or disposition of firearm
			 based upon Attorney General discretionary denial</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/922">Section 922(d)</external-xref> of title 18, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idCBE9304A027F4F9C90F93F0838DD1871"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (8), by striking
			 <quote>or</quote> at the end;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCD89EAD7AE1F423E9B650CB72DFA5608"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (9), by striking the period at
			 the end and inserting <quote>; or</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF4BAA9F1777A4EF2978DD38C46E3DFF1"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id2C0838EC87FF41DBBF12A48F6A519A7C" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="id804D2C17B14648A5A4438A527C7E73BC"><enum>(10)</enum><text display-inline="yes-display-inline">has been the subject of a determination by
				the Attorney General under section 922A, 922B, 923(d)(3), or 923(e) of this
				title.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id31B344B5126445608004F63055B23DC3"><enum>(d)</enum><header display-inline="yes-display-inline">Attorney General discretionary denial as
			 prohibitor</header><text display-inline="yes-display-inline">Section 922(g) of
			 title 18, United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id45F85FFB5C1C4D1D8170933899192086"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (8), by striking
			 <quote>or</quote> at the end;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE215363532F84A0496B2AECB6880D1FF"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (9), by striking the comma at
			 the end and inserting <quote>; or</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8CE28C7CB7FA4C6B9292731D3B87CFCA"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (9) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id9504CB909FD640EF9A360075BF387D17" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="id5C9EFCA3C1B94D088CC143E1E30F3AFB"><enum>(10)</enum><text display-inline="yes-display-inline">who has received actual notice of the
				Attorney General's determination made under section 922A, 922B, 923(d)(3) or
				923(e) of this
				title,</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5DECED76B9E04EA8A9300F911E6B4CFC"><enum>(e)</enum><header display-inline="yes-display-inline">Attorney General discretionary denial of
			 Federal firearms licenses</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/923">Section 923(d)</external-xref> of title 18, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id0361943DA5D14707A96988D2717058D1"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), in the matter preceding
			 subparagraph (A), by striking <quote>Any</quote> and inserting <quote>Except as
			 provided in paragraph (3), any</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95B8C26FD21F467685436C9BB7BCEC17"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

				application if the Attorney General determines that the applicant (including

				been engaged in conduct constituting, in preparation for, in aid of, or related
				to terrorism, or providing material support or resources for terrorism, and the
				Attorney General has a reasonable belief that the applicant may use a firearm
				in connection with
				terrorism.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5451229361554B0D9A815AB3475EC414"><enum>(f)</enum><header display-inline="yes-display-inline">Discretionary revocation of Federal
			 firearms licenses</header><text display-inline="yes-display-inline">Section
			 923(e) of title 18, United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id59777EFB176744A58E6F0EBC71A4A3BE"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(1)</quote> after
			 <quote>(e)</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5702071829BA4DFA8817B3B6A50BD2D4"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>revoke any
			 license</quote> and inserting the following: “revoke—</text>
					<quoted-block display-inline="no-display-inline" id="id404EE49F9BA344B9A65CC0E8C2E059AE" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="id2A4975A9CC4B4B96987840F2FDE507BC" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">any
				license</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8BF077D9CD534600918499C854D1B481"><enum>(3)</enum><text display-inline="yes-display-inline">by striking <quote>. The Attorney General
			 may, after notice and opportunity for hearing, revoke the license</quote> and
			 inserting the following: “;</text>
					<quoted-block display-inline="no-display-inline" id="idC596F031F86F4D57A02F5E08D8BBC3BF" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="id527EA53BF669491D868296310803EB46" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the
				license</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id677F000AAF3D4486B89376E583863392"><enum>(4)</enum><text display-inline="yes-display-inline">by striking <quote>. The Secretary's
			 action</quote> and inserting the following: “; or</text>
					<quoted-block display-inline="no-display-inline" id="id5D23BC41FE0C4C7BBB148F307CC84DF4" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="id483EE66C5A6344FB875C93D46133BDC1" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">any license issued under this section if
				the Attorney General determines that the holder of such license (including any
				responsible person) is known (or appropriately suspected) to be or have been
				engaged in conduct constituting, in preparation for, in aid of, or related to
				terrorism or providing material support or resources for terrorism, and the
				Attorney General has a reasonable belief that the applicant may use a firearm
				in connection with terrorism.</text>
						</subparagraph><paragraph commented="no" display-inline="no-display-inline" id="idA03BF248E72E4FA8925A054B89CBF5F7" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Attorney General's
				action</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD4019DB22B7E43C5B9A8EC73DFA413A2"><enum>(g)</enum><header display-inline="yes-display-inline">Attorney General's ability To withhold
			 information in firearms license denial and revocation suit</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id2638605898524E1C94E4FC7682C3DE42"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/923">Section 923(f)(1)</external-xref> of title 18, United
			 States Code, is amended by inserting after the first sentence the following:
			 <quote>However, if the denial or revocation is pursuant to subsection (d)(3) or
			 (e)(1)(C), any information upon which the Attorney General relied for this
			 determination may be withheld from the petitioner, if the Attorney General
			 determines that disclosure of the information would likely compromise national
			 security.</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id047A8B7BEBF041FC8E64E942940715EA"><enum>(2)</enum><header display-inline="yes-display-inline">Summaries</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/923">Section 923(f)(3)</external-xref> of title 18, United
			 States Code, is amended by inserting after the third sentence the following:
			 <quote>With respect to any information withheld from the aggrieved party under
			 paragraph (1), the United States may submit, and the court may rely upon,
			 summaries or redacted versions of documents containing information the
			 disclosure of which the Attorney General has determined would likely compromise
			 national security.</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6C19E80232424B92A17D956FBEBED789"><enum>(h)</enum><header display-inline="yes-display-inline">Attorney General's ability To withhold
			 information in relief from disabilities lawsuits</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/925">Section 925(c)</external-xref> of title 18, United States
			 Code, is amended by inserting after the third sentence the following: <quote>If
			 the person is subject to a disability under section 922(g)(10) of this title,
			 any information which the Attorney General relied on for this determination may
			 be withheld from the applicant if the Attorney General determines that
			 disclosure of the information would likely compromise national security. In
			 responding to the petition, the United States may submit, and the court may
			 rely upon, summaries or redacted versions of documents containing information
			 the disclosure of which the Attorney General has determined would likely
			 compromise national security.</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id6A9AAD2A43F04D45BF290E9D61E57B26"><enum>(i)</enum><header display-inline="yes-display-inline">Penalties</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/924">Section 924(k)</external-xref> of title 18, United States
			 Code, is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id784F7BDA578A45148D53B07379423CFD"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/925A">Section 925A</external-xref> of title 18, United States
			 Code, is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id43F59F4501E24EA69B62E9E27FA8CD91"><enum>(A)</enum><text display-inline="yes-display-inline">in the section heading, by striking
			 <quote><header-in-text level="section" style="USC">Remedy for erroneous denial
			 of firearm</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Remedies</header-in-text></quote>;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3439B4BBE82E4AB3A181E21CDFBF9C24"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>Any person denied a

						<quoted-block display-inline="no-display-inline" id="id20D74D9A66204C88BFC3E6B4566737C6" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="id075C82B40E4C460E8FC636CAE473302D"><enum>(b)</enum><text display-inline="yes-display-inline">In any case in which the Attorney General
				has denied the transfer of a firearm to a prospective transferee pursuant to
				section 922A of this title or has made a determination regarding a firearm
				permit applicant pursuant to section 922B of this title, an action challenging
				the determination may be brought against the United States. The petition shall
				be filed not later than 60 days after the petitioner has received actual notice
				of the Attorney General's determination under section 922A or 922B of this
				title. The court shall sustain the Attorney General's determination upon a
				showing by the United States by a preponderance of evidence that the Attorney
				General's determination satisfied the requirements of section 922A or 922B, as
				the case may be. To make this showing, the United States may submit, and the
				court may rely upon, summaries or redacted versions of documents containing
				information the disclosure of which the Attorney General has determined would
				likely compromise national security. Upon request of the petitioner or the
				court's own motion, the court may review the full, undisclosed documents ex
				parte and in camera. The court shall determine whether the summaries or
				redacted versions, as the case may be, are fair and accurate representations of
				the underlying documents. The court shall not consider the full, undisclosed
				documents in deciding whether the Attorney General's determination satisfies
				the requirements of section 922A or
				922B.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD00DEC1EBBBE44E0A0D6BDAEA1997BA5"><enum>(2)</enum><header display-inline="yes-display-inline">Technical and conforming
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, is amended by striking
			 the item relating to section 925A and inserting the following:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idBEE23BE2D8A04B21A4F21FA60FC32C16"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (f)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id9D3663A1597C4BE395DF860065AB6C4B"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>or the Attorney General
			 has made a determination regarding an applicant for a firearm permit pursuant

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idBB6C1FA46E0145C3B251F459DCED2931"><enum>(o)</enum><header display-inline="yes-display-inline">Attorney General discretionary revocation
			 of Federal explosives licenses and permits</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/843">Section 843(d)</external-xref> of title 18, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id1839AFDAE9EB4A498BEFD442BF48DF08"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(1)</quote> after
			 <quote>(d)</quote>;</text>

			 information in explosives license and permit denial and revocation
			 suits</header><text display-inline="yes-display-inline">Section 843(e) of title
			 18, United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id69CD673D6BF14248BC9368E01BEA4637"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting after the
			 first sentence the following: <quote>However, if the denial or revocation is
			 based upon an Attorney General determination under subsection (j) or (d)(1)(B),
			 any information which the Attorney General relied on for this determination may
			 be withheld from the petitioner if the Attorney General determines that
			 disclosure of the information would likely compromise national
			 security.</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2E3E9E59C76E4E1B88A204091446A238"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by adding at the end the
			 following: <quote>In responding to any petition for review of a denial or
			 revocation based upon an Attorney General determination under subsection (j) or
			 (d)(1)(B), the United States may submit, and the court may rely upon, summaries
			 or redacted versions of documents containing information the disclosure of
			 which the Attorney General has determined would likely compromise national

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idF3B45A552CB34ACABD2D192F65A19B00"><enum>(q)</enum><header display-inline="yes-display-inline">Ability To withhold information in
			 communications to employers</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/843">Section 843(h)(2)</external-xref> of title 18, United
			 States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id14427213B20844D89DD7B0D4A546AA68"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting <quote>or
			 in subsection (j) of this section (on grounds of terrorism)</quote> after
			 <quote>section 842(i)</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id64F310265BDE447C828B37D960D4A782"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id310AC6ACE4064DD3AF09E6DBC1C95E15"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), by
			 inserting <quote>or in subsection (j) of this section,</quote> after
			 <quote>section 842(i),</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7F064969A3134E62B10278FB7766E304"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (ii), by inserting <quote>,
			 except that any information that the Attorney General relied on for a
			 determination pursuant to subsection (j) may be withheld if the Attorney

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id56A5C88AACEE4CABBED4CA69F0DA5236"><enum>(r)</enum><header display-inline="yes-display-inline">Conforming amendment to Immigration and
			 Nationality Act</header><text display-inline="yes-display-inline">Section
			 101(a)(43)(E)(ii) of the Immigration and Nationality Act (8 U.S.C.
			 1101(a)(43)(E)(ii)) is amended by striking <quote>or (5)</quote> and inserting
			 <quote>(5), or (10)</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id2A7628B683764091A15654E945C55C97"><enum>(s)</enum><header>Guidelines</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id2494CF0D974349F58CBB368C72E72E28"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General shall issue guidelines describing
			 the circumstances under which the Attorney General will exercise the authority
			 and make determinations under subsections (d)(1)(B) and (j) of section 843 and
			 sections <external-xref legal-doc="usc" parsable-cite="usc/18/922A">922A</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/18/922">922B</external-xref> of title 18, United States Code, as amended by this
			 Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2DD44816BEAC471DA1F1558D86968783"><enum>(2)</enum><header>Contents</header><text>The
			 guidelines issued under paragraph (1) shall—</text>
					<subparagraph id="IDbcfe7a2577ca433dba0ae11f5d9618a0"><enum>(A)</enum><text>provide
			 accountability and a basis for monitoring to ensure that the intended goals
			 for, and expected results of, the grant of authority under subsections
			 (d)(1)(B) and (j) of section 843 and sections <external-xref legal-doc="usc" parsable-cite="usc/18/922A">922A</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/18/922">922B</external-xref> of title 18, United
			 States Code, as amended by this Act, are being achieved; and</text>
					</subparagraph><subparagraph id="ID4077bb23bc374421bf8b065665a140fe"><enum>(B)</enum><text>ensure that
			 terrorist watch list records are used in a manner that safeguards privacy and
			 civil liberties protections, in accordance with requirements outlines in
			 Homeland Security Presidential Directive 11 (dated August 27, 2004).</text>
					</subparagraph></paragraph></subsection></section></legis-body>
