		<official-title>To amend the Public Health Service Act to establish
		  safeguards and standards of quality for research and transplantation of organs
		  infected with human immunodeficiency virus (HIV).</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>HIV Organ Policy Equity
			 Act</short-title></quote>.</text>
		</section><section id="H0C51606D2E964D1CB4DDD4D67D3F550F"><enum>2.</enum><header>Amendments to the
			 Public Health Service Act</header>
			<subsection id="HDE8E85AEA9E94AFE97DA0147FEFAB97E"><enum>(a)</enum><header>Standards of
			 quality for the acquisition and transportation of donated organs</header>
				<paragraph id="H6F9DEB1BB88F475C814E5EF6F19F2899"><enum>(1)</enum><header>Organ
			 Procurement and Transplantation Network</header><text>Section 372(b) of the
			 Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/274">42 U.S.C. 274(b)</external-xref>) is amended—</text>
					<subparagraph id="H74337C60B19E4AE292FEA7820EFBD245"><enum>(A)</enum><text>in paragraph
			 (2)(E), by striking <quote>, including standards for preventing the acquisition
			 of organs that are infected with the etiologic agent for acquired immune
			 deficiency syndrome</quote>; and</text>
					</subparagraph><subparagraph id="H85168DAE88714625B6F9AD6EA12660AF"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H19B4B65697C04492AE0A033F46D60CEF" style="OLC">
							<paragraph id="H0F06D64F70CE4F6FA01DE50CBE9A461B"><enum>(3)</enum><header>Clarification</header><text display-inline="yes-display-inline">In adopting and using standards of quality
				under paragraph (2)(E), the Organ Procurement and Transplantation Network may
				adopt and use such standards with respect to organs infected with human
				immunodeficiency virus (HIV), provided that any such standards ensure that
				organs infected with human immunodeficiency virus may be transplanted only into
				individuals who are infected with such virus before receiving such
				organ.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HE8728F60962C47198E7D11EB310D5C56"><enum>(2)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section
			 371(b)(3)(C) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/273">42 U.S.C. 273(b)(3)(C)</external-xref>; relating
			 to organ procurement organizations) is amended by striking <quote>including
			 arranging for testing with respect to preventing the acquisition of organs that
			 are infected with the etiologic agent for acquired immune deficiency
			 syndrome</quote> and inserting <quote>including arranging for testing with
			 respect to identifying organs that are infected with human immunodeficiency
			 virus (HIV)</quote>.</text>
				</paragraph></subsection><subsection id="H523D36315ABB42DE85D9B26174DF6D8F"><enum>(b)</enum><header>Publication of
			 research guidelines</header><text>Part H of title III of the Public Health
			 Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/273">42 U.S.C. 273 et seq.</external-xref>) is amended by inserting after section 377D
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H3B7779335AE64558B894BDBA1F53C565" style="OLC">
					<section id="H42524A5C8F734BF2B1843F2C1F62E714"><enum>377E.</enum><header>Guidelines,
				standards, and regulations with respect to organs infected with HIV</header>
						<subsection id="H80A27702459148A09A7A55CF000F4925"><enum>(a)</enum><header>In
				general</header><text>Not later than 1 year after the date of the enactment of
				the <short-title>HIV Organ Policy Equity
				Act</short-title>, the Secretary shall develop and publish guidelines for the
				conduct of research relating to transplantation of organs from donors infected
				with human immunodeficiency virus (in this section referred to as
				<quote>HIV</quote>).</text>
						</subsection><subsection id="H98E5EE8BBE10493D8EB6411DFA25F834"><enum>(b)</enum><header>Corresponding
				changes to standards and regulations applicable to research</header><text>Not
				later than 1 year after the date of the enactment of the
				<short-title>HIV Organ Policy Equity Act</short-title>, to
				the extent determined by the Secretary to be necessary to allow the conduct of
				research in accordance with the guidelines developed under subsection
				(a)—</text>
							<paragraph id="H727D1A23DE0F459584BF41659A91D5A2"><enum>(1)</enum><text>the Organ
				Procurement and Transplantation Network shall revise the standards of quality
				adopted under section 372(b)(2)(E); and</text>
							</paragraph><paragraph id="H84535491F05F43E4A25183612094AA42"><enum>(2)</enum><text>the Secretary
				shall revise <external-xref legal-doc="regulation" parsable-cite="cfr/42/121.6">section 121.6</external-xref> of title 42, Code of Federal Regulations (or any
				successor regulations).</text>
							</paragraph></subsection><subsection id="H08362A3B82A844E4A693904124569487"><enum>(c)</enum><header>Revision of
				standards and regulations generally</header><text>Not later than 2 years after
				the date of the enactment of the <short-title>HIV Organ
				Policy Equity Act</short-title>, and annually thereafter, the Secretary,
				shall—</text>
							<paragraph id="H1E579D5F2C2F4510B3D90914A65151BE"><enum>(1)</enum><text>review the results
				of scientific research in conjunction with the Organ Procurement and
				Transplantation Network to determine whether the results warrant revision of
				the standards of quality adopted under section 372(b)(2)(E) with respect to
				donated organs infected with HIV and with respect to the safety of cross-strain
				transplantation;</text>
							</paragraph><paragraph id="HB4D98B2B9E024982BFD4A7504DBAF3A6"><enum>(2)</enum><text>if the Secretary
				determines under paragraph (1) that such results warrant revision of the
				standards of quality adopted under section 372(b)(2)(E) with respect to donated
				organs infected with HIV and with respect to cross-strain transplantation,
				direct the Organ Procurement and Transplantation Network to revise such
				standards, consistent with section 372 and in a way that ensures the changes
				will not reduce the safety of organ transplantation; and</text>
							</paragraph><paragraph id="H2DB56A2F98F9406E8CE4C28E3A306455"><enum>(3)</enum><text>in conjunction
				with any revision of such standards under paragraph (2), shall revise section
				121.6 of title 42, Code of Federal Regulations (or any successor regulations)
				for consistency with such
				standards.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HF99A636B61F8480A964AC688FAFF86CC"><enum>3.</enum><header>Conforming
			 amendment to title 18 of the United States Code</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1122">Section 1122</external-xref> of title 18, United States
			 Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HFAA81439F508407998996882C250C424" style="USC">
				<subsection id="H9170CE596E8944A5BAB21BDD2447429E"><enum>(d)</enum><header>Exception</header><text display-inline="yes-display-inline">An organ donation does not violate this
				section if the donation is in accordance with all applicable guidelines and
				regulations of the Secretary made under section 377E of the Public Health
				Service
				Act.</text>
