		<section id="IDC6BAB8F5C5AC4E62BF645E2A9322E363" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Child Custody Protection Act of
			 2013</short-title></quote>.</text>
		</section><section id="ID41DD650046BE4172AE9E7F77A5A5E1F9"><enum>2.</enum><header>Transportation
			 of minors in circumvention of certain laws relating to abortion</header>
			<subsection id="IDC081290CD2924E00AFAE0FCF7C187B15"><enum>(a)</enum><header>In
			 general</header><text>Title 18, United States Code, is amended by inserting
			 after chapter 117 the following:</text>

					<chapter id="ID33729937EE324AA693F629DF712FB16E"><enum>117A</enum><header>Transportation
				of minors in circumvention of certain laws relating to abortion</header>
						<toc regeneration="no-regeneration">
							<toc-entry level="section">Sec.</toc-entry>
							<toc-entry level="section">2431. Transportation of minors in
				  circumvention of certain laws relating to abortion.</toc-entry>
							<toc-entry bold="off" level="section">2432. Transportation of
				  minors in circumvention of certain laws relating to incest.</toc-entry>
						</toc>
						<section id="ID27EC362AB0F7416CA51372B5F1CA323F"><enum>2431.</enum><header>Transportation
				of minors in circumvention of certain laws relating to abortion</header>
							<subsection id="ID5123FF9E716D4A71A4896BE1775DD9CF"><enum>(a)</enum><header>Definitions</header><text>In
				this section—</text>
								<paragraph id="ID8F632790A4CB42BB9114E0BBDC510B74"><enum>(1)</enum><text>the term
				<term>law requiring parental involvement in a minor’s abortion decision</term>
				means a law in force in the State in which a minor resides—</text>
									<subparagraph id="ID65DA857323B64273AFBCF4D3FFDE1A5C"><enum>(A)</enum><text>that requires,
				before an abortion is performed on the minor—</text>
										<clause id="IDE16FBEECCF4D4ED1A6F07188A89308AD"><enum>(i)</enum><text>notification to,
				or consent of, a parent of the minor; or</text>
										</clause><clause id="IDA788F272F6804C02851107C69BF95ED2"><enum>(ii)</enum><text>judicial
				authorization from a State court; and</text>
										</clause></subparagraph><subparagraph id="ID73EAA43DA4BA4115B1A7F01686946F59"><enum>(B)</enum><text>that does not
				provide as an alternative to the requirements described in subparagraph
				(A)—</text>
										<clause id="id5631977975C04B01BB8DBCE6FF6B0A28"><enum>(i)</enum><text>notification to,
				or consent of, an individual who is not a parent of the minor; or</text>
										</clause><clause id="idF4B5C4346C9A4ECA8B5187499C638D94"><enum>(ii)</enum><text>authorization
				from an entity that is not a State court;</text>
										</clause></subparagraph></paragraph><paragraph id="ID5A3B613D06BF4950BFA31764A69143D3"><enum>(2)</enum><text>the term
				<term>parent</term> means—</text>
									<subparagraph id="ID86635F88EAE74F588CF2C9D98D7827CC"><enum>(A)</enum><text>a parent or
				guardian;</text>
									</subparagraph><subparagraph id="ID5A4A30830F8D49D4ACDBADD196E6B7F7"><enum>(B)</enum><text>a legal
				custodian; or</text>
									</subparagraph><subparagraph id="ID364A48C80F1A429A9EC5F8AD7D7EEEA0"><enum>(C)</enum><text>an individual
				standing in loco parentis who has care and control of a minor, with whom the
				minor regularly resides, and who is designated by a law requiring parental
				involvement in the minor's abortion decision as an individual to whom
				notification, or from whom consent, is required;</text>
									</subparagraph></paragraph><paragraph id="ID4828B4AB3CD4467E978933E451C0E245"><enum>(3)</enum><text>the term
				<term>minor</term> means an individual who is not older than the maximum age
				requiring parental notification or consent, or judicial authorization from a
				State court, under a law requiring parental involvement in a minor's abortion
				decision; and</text>
								</paragraph><paragraph id="IDB5BE64E71FDF4E75B9C57F312CF724CF"><enum>(4)</enum><text>the term
				<term>State</term> includes the District of Columbia and any commonwealth,
				possession, or other territory of the United States.</text>
								</paragraph></subsection><subsection id="ID54757177E2424E6795FBCC1381EFBE99"><enum>(b)</enum><header>Offense</header>
								<paragraph id="IDD6552086346A4D8C92A77323BE2175E5"><enum>(1)</enum><header>Generally</header><text>Except
				as provided in subsection (c), whoever knowingly transports a minor across a
				State line, with the intent that the minor obtain an abortion, and thereby in
				fact abridges the right of a parent of the minor under a law requiring parental
				involvement in a minor's abortion decision, shall be fined under this title or
				imprisoned not more than 1 year, or both.</text>
								</paragraph><paragraph id="IDFA7AD6D6CB9F4F50B911F542C0D3CDFD"><enum>(2)</enum><header>Definition</header><text>For
				purposes of this subsection, an abridgement of the right of a parent of a minor
				occurs if an abortion is performed on the minor, in a State other than the
				State in which the minor resides, without the parental consent or notification,
				or the judicial authorization, that would have been required under a law
				requiring parental involvement in a minor's abortion decision, had the abortion
				been performed in the State where the minor resides.</text>
								</paragraph></subsection><subsection id="ID05E7BA5A9A89466FB8C0EE38474ACC1B"><enum>(c)</enum><header>Exceptions</header>
								<paragraph id="ID51BAC8EFA0ED491B9D92EDEB5D114DAA"><enum>(1)</enum><header>Life-endangering
				conditions</header><text>The prohibition under subsection (b) shall not apply
				in the case of an abortion that is necessary to save the life of a minor
				because her life is endangered by a physical disorder, physical injury, or
				physical illness, including a life-endangering physical condition caused by or
				arising from the pregnancy itself.</text>
								</paragraph><paragraph id="ID209FB3849F244633A083D2DA55B8D9FC"><enum>(2)</enum><header>Minors and
				parents</header><text>A minor transported in violation of this section, and any
				parent of the minor, may not be prosecuted or sued for a violation of this
				section, a conspiracy to violate this section, or an offense under section 2 or
				3 based on a violation of this section.</text>
								</paragraph></subsection><subsection id="ID6E5E224C48EC4E6AB6CC847F74B47B8C"><enum>(d)</enum><header>Affirmative
				defense</header><text>It is an affirmative defense to a prosecution for an
				offense, or to a civil action, based on a violation of this section that the
				defendant reasonably believed, based on information the defendant obtained
				directly from a parent of the minor or other compelling facts, that before the
				minor obtained the abortion, the parental consent or notification, or judicial
				authorization, that would have been required under the law requiring parental
				involvement in a minor's abortion decision, had the abortion been performed in
				the State where the minor resides, took place.</text>
							</subsection><subsection id="ID687AA355167A449D966D4A78439C4BF2"><enum>(e)</enum><header>Civil
				action</header><text>Any parent who suffers harm from a violation of subsection
				(b) may obtain appropriate relief in a civil action, unless the parent has
				committed an act of incest with the minor who was transported in violation of
				subsection (b).</text>
							</subsection></section><section id="ID48F9F536DA4C41E69CB571FDEB66C8E2"><enum>2432.</enum><header>Transportation
				of minors in circumvention of certain laws relating to incest</header><text display-inline="no-display-inline">Notwithstanding section 2431(c)(2), whoever
				has committed an act of incest with a minor and knowingly transports the minor
				across a State line with the intent that the minor obtain an abortion, shall be
				fined under this title or imprisoned not more than 1 year, or
				both.</text>

			</subsection><subsection id="ID2CF9FDF345534D118ADB61A82C6BAEC7"><enum>(b)</enum><header>Technical and
			 conforming amendment</header><text>The table of chapters for part I of title
			 18, United States Code, is amended by inserting after the item relating to
			 chapter 117 the following:</text>
