		<official-title>To rescind funds made available to the Administrator of
		  the Environmental Protection Agency if the Administrator fails to meet certain
		  deadlines.</official-title>
	</form>
	<legis-body>
		<section id="id68DE224FF87F4910959F91518D812EEF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Environmental Protection Agency
			 Accountability Act of 2013</short-title></quote>.</text>
		</section><section id="id12C6AF210C5D487ABED67577DE9FDF3B"><enum>2.</enum><header>Definition of
			 Administrator</header><text display-inline="no-display-inline">In this Act, the
			 term <term>Administrator</term> means the Administrator of the Environmental
			 Protection Agency.</text>
		</section><section id="id42636226CA7C4D3B944C46D4AFBC24CF"><enum>3.</enum><header>Interim
			 assessment of regulatory requirements and applicable penalties</header>
			<subsection id="id1cf11805755e47f392eb75ad34e21b03"><enum>(a)</enum><header>In
			 general</header><text>Not later than 30 days after the date of enactment of
			 this Act, the Administrator shall ensure that the requirements described in
			 subsection (b) are satisfied.</text>
			</subsection><subsection id="idBC8E7189EE654F98A96414C822A28FBC"><enum>(b)</enum><header>Requirements</header><text>The
			 Administrator shall satisfy—</text>
				<paragraph id="id46A10EA439B245BAAA3621A007DDC7BD"><enum>(1)</enum><text>section 4 of
			 Executive Order 12866 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note) (relating to regulatory planning and
			 review) and Executive Order 13563 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note) (relating to improving
			 regulation and regulatory review) (or any successor Executive order
			 establishing requirements applicable to the uniform reporting of regulatory and
			 deregulatory agendas);</text>
				</paragraph><paragraph id="idC3C3FBFBFED04176B9357903384DA7AF"><enum>(2)</enum><text>section 602 of
			 title 5, United States Code;</text>
				</paragraph><paragraph id="id5105576A05144451A63B394411DAE360"><enum>(3)</enum><text>section 8 of
			 Executive Order 13132 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note) (relating to federalism); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id36CA04C1BB1940A8920EDF9466B6961C"><enum>(4)</enum><text>section 202(a) of
			 the Unfunded Mandates Reform Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1532">2 U.S.C. 1532(a)</external-xref>).</text>
				</paragraph></subsection><subsection id="id7c6ebc16d6ed47f8997170b9243fc497"><enum>(c)</enum><header>Financial
			 penalty provisions</header>
				<paragraph id="id39b2d2ee8519442a90810bed533bb8a0"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), if the Comptroller General of
			 the United States determines that the Administrator fails to satisfy any
			 requirement described in subsection (b), an amount of funding equal to $20,000
			 per week shall be rescinded from the Office of the Administrator, and once each
			 week thereafter until all the requirements are satisfied.</text>
				</paragraph><paragraph id="id250437ca8d434317b3b3c59110256cfe"><enum>(2)</enum><header>Limitations</header>
					<subparagraph id="idD05AAB76D1F94ADD9D6AF768DC84A073"><enum>(A)</enum><header>1 day grace
			 period</header><text>Paragraph (1) shall not apply if each requirement listed
			 in subsection (b) is satisfied not later than 1 day after the deadline for the
			 requirement.</text>
					</subparagraph><subparagraph id="idBEF560E82AF14E8D8F49036DEE3C7879"><enum>(B)</enum><header>Maximum amount
			 of rescinded funds</header><text>No rescission of funds under paragraph (1)
			 shall exceed, in any fiscal year, an amount equal to 7 percent of the funds
			 made available to the Office of the Administrator.</text>
					</subparagraph></paragraph><paragraph id="id44995603e26642c38d015a3940296339"><enum>(3)</enum><header>Audits</header><text>In
			 any fiscal year in which any funds are rescinded from the Administrator
			 pursuant to this Act, the Inspector General of the Environmental Protection
			 Agency shall—</text>
					<subparagraph id="idf3817d6d7d7c44cd8bc4321524e6d917"><enum>(A)</enum><text>conduct an audit
			 to assess compliance with the requirements of this paragraph; and</text>
					</subparagraph><subparagraph id="id50acc0cf4e434a0d8658540628438d0c"><enum>(B)</enum><text>not later than
			 120 days after the end of the fiscal year during which any funds are rescinded
			 under paragraph (1), submit to the Committee on Environment and Public Works of
			 the Senate, the Committee on Transportation and Infrastructure of the House of
			 Representatives, the Committee on Appropriations of the Senate, and the
			 Committee on Appropriations of the House of Representatives a report describing
			 the reasons why the funds were rescinded, including allocations of
			 resources.</text>
					</subparagraph></paragraph><paragraph id="id647dd4d1297044cebb378397e0a33fcc"><enum>(4)</enum><header>Effect of
			 paragraph</header><text>Nothing in this paragraph affects or limits the
			 application of, or obligation to comply with, any Federal, State, local, or
			 tribal law.</text>
				</paragraph></subsection></section></legis-body>
