		<official-title>To amend title 38, United States Code, to improve the
		  disability compensation evaluation procedure of the Secretary of Veterans
		  Affairs for veterans with mental health conditions related to military sexual
		  trauma, and for other purposes.</official-title>

		<section id="H14FA085A63934AF583AB50638A4D055E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Ruth Moore Act of
			 2013</short-title></quote>.</text>
		</section><section id="H1784BD1BF01D4FA09DEF9DEE2A55D936" section-type="subsequent-section"><enum>2.</enum><header>Standard of proof for
			 service-connection of mental health conditions related to military sexual
			 trauma</header>
			<subsection id="H790B5262CE47424AA6DF86DF34858153"><enum>(a)</enum><header>Standard of
			 proof</header><text display-inline="yes-display-inline">Section 1154 of title
			 38, United States Code, is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H4DD1D02912364CB6AB8E6759BF233C36" style="USC">
					<subsection id="H12A8E1A6FF1F45E7B705C16137DC9AEC"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HF3BD4959B0274717A87A153D076A7A94"><enum>(1)</enum><text display-inline="yes-display-inline">In the case of any veteran who claims that
				a covered mental health condition was incurred in or aggravated by military
				sexual trauma during active military, naval, or air service, the Secretary
				shall accept as sufficient proof of service-connection a diagnosis of such
				mental health condition by a mental health professional together with
				satisfactory lay or other evidence of such trauma and an opinion by the mental
				health professional that such covered mental health condition is related to
				such military sexual trauma, if consistent with the circumstances, conditions,
				or hardships of such service, notwithstanding the fact that there is no
				official record of such incurrence or aggravation in such service, and, to that
				end, shall resolve every reasonable doubt in favor of the veteran.
				Service-connection of such covered mental health condition may be rebutted by
				clear and convincing evidence to the contrary. The reasons for granting or
				denying service-connection in each case shall be recorded in full.</text>
						</paragraph><paragraph id="H716D9B6B3FDC4F508B9ACA2CA784AC19" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of this subsection, in the
				absence of clear and convincing evidence to the contrary, and provided that the
				claimed military sexual trauma is consistent with the circumstances,
				conditions, or hardships of the veteran’s service, the veteran’s lay testimony
				alone may establish the occurrence of the claimed military sexual
				trauma.</text>
						</paragraph><paragraph id="H44ED1ACBF7D44E5E9C085DAED4433AE9" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In this subsection:</text>
							<subparagraph id="H69D7AF048339469A967D6AAEDDD70168"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>covered mental health
				condition</term> means post-traumatic stress disorder, anxiety, depression, or
				other mental health diagnosis described in the current version of the
				Diagnostic and Statistical Manual of Mental Disorders published by the American
				Psychiatric Association that the Secretary determines to be related to military
				sexual trauma.</text>
							</subparagraph><subparagraph id="HD16C0160FB4D450B82CA12CD51AC31B4"><enum>(B)</enum><text display-inline="yes-display-inline">The term <term>military sexual
				trauma</term> means, with respect to a veteran, psychological trauma, which in
				the judgment of a mental health professional, resulted from a physical assault
				of a sexual nature, battery of a sexual nature, or sexual harassment which
				occurred during active military, naval, or air
				service.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HAF017F52D9A94C0BA876B989D7C343EC"><enum>(b)</enum><header>Annual
			 reports</header>
				<paragraph id="H2288A7CD61EE409C8092B2E365E6F465"><enum>(1)</enum><header>In
			 general</header><text>Subchapter VI of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">chapter 11</external-xref> of title 38, United States
			 Code, is amended by adding at the end the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H0075CFC106F146A09E20D280B5D1EA72" style="USC">
						<section id="H5A0F4306FF73402B8CCCEA700574271A"><enum>1164.</enum><header>Reports on
				claims for disabilities incurred or aggravated by military sexual
				trauma</header>
							<subsection id="H1F2A2DE2C4D34C6980CA83B50E9B0B25"><enum>(a)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than December 1, 2014, and each
				year thereafter through 2018, the Secretary shall submit to Congress a report
				on covered claims submitted during the previous fiscal year.</text>
							</subsection><subsection id="HE1C7042BE1A0473FAF4229291D050304"><enum>(b)</enum><header>Elements</header><text display-inline="yes-display-inline">Each report under subsection (a) shall
				include the following:</text>
								<paragraph id="H1FF64536C0914ECEB654E18E455CB21E"><enum>(1)</enum><text display-inline="yes-display-inline">The number of covered claims submitted to
				or considered by the Secretary during the fiscal year covered by the
				report.</text>
								</paragraph><paragraph id="H0EFA80F6C87743658E40FF12312ADFC9"><enum>(2)</enum><text>Of the covered
				claims listed under paragraph (1), the number and percentage of such
				claims—</text>
									<subparagraph id="HC5F9292D9C544E2BA7292A387880F47D"><enum>(A)</enum><text display-inline="yes-display-inline">submitted by each sex;</text>
									</subparagraph><subparagraph id="H0742F0378A824A098FE21F6B631177C9"><enum>(B)</enum><text display-inline="yes-display-inline">that were approved, including the number
				and percentage of such approved claims submitted by each sex; and</text>
									</subparagraph><subparagraph id="HA5629D34C1C942A291390D6781099215"><enum>(C)</enum><text display-inline="yes-display-inline">that were denied, including the number and
				percentage of such denied claims submitted by each sex.</text>
									</subparagraph></paragraph><paragraph id="HEF4DF87146654704A6DB5C174DBFE49E"><enum>(3)</enum><text display-inline="yes-display-inline">Of the covered claims listed under
				paragraph (1) that were approved, the number and percentage, listed by each
				sex, of claims assigned to each rating percentage.</text>
								</paragraph><paragraph id="H735BA4E2F91044C3B2E7219D28AC0E8A"><enum>(4)</enum><text>Of the covered
				claims listed under paragraph (1) that were denied—</text>
									<subparagraph id="HED0B879E9E6A4EB69008720B6676C218"><enum>(A)</enum><text>the three most
				common reasons given by the Secretary under section 5104(b)(1) of this title
				for such denials; and</text>
									</subparagraph><subparagraph id="HFFCEB99F5E9041D490FED9E6EC0F0801"><enum>(B)</enum><text>the number of
				denials that were based on the failure of a veteran to report for a medical
				examination.</text>
									</subparagraph></paragraph><paragraph id="H3D2DAE4180294548B9616D63591F91A1"><enum>(5)</enum><text>The number of
				covered claims that, as of the end of the fiscal year covered by the report,
				are pending and, separately, the number of such claims on appeal.</text>
								</paragraph><paragraph id="H1732C086327D4DB2B86F2139CA23846A"><enum>(6)</enum><text>For the fiscal
				year covered by the report, the average number of days that covered claims take
				to complete beginning on the date on which the claim is submitted.</text>
								</paragraph><paragraph id="H41FE1A0138C74520A838D253526ED3F9"><enum>(7)</enum><text>A description of
				the training that the Secretary provides to employees of the Veterans Benefits
				Administration specifically with respect to covered claims, including the
				frequency, length, and content of such training.</text>
								</paragraph></subsection><subsection id="H5CB6C016708C45C8806B6C9F0F98FA68"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
								<paragraph display-inline="no-display-inline" id="H2F941B2B162841F19D63AD3C221FA0E5"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>covered claims</term> means
				claims for disability compensation submitted to the Secretary based on a
				covered mental health condition alleged to have been incurred or aggravated by
				military sexual trauma.</text>
								</paragraph><paragraph id="HF896DB37B0FB4CB2BBCA9887C822E12F"><enum>(2)</enum><text>The term
				<term>covered mental health condition</term> has the meaning given that term in
				subparagraph (A) of section 1154(c)(3) of this title.</text>
								</paragraph><paragraph id="H34D8F7E958DB4DC5B1427EC4B8A3FD33"><enum>(3)</enum><text>The term
				<term>military sexual trauma</term> has the meaning given that term in
				subparagraph (B) of such
				section.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HBE215298409148E29405929E6D018A9B"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by adding at the end the following new item:</text>
					<quoted-block display-inline="no-display-inline" id="HB197001E269245F7945FA9CBD189418A" style="USC">
						<toc regeneration="no-regeneration">
							<toc-entry level="section">1164. Annual reports on claims for
				disabilities incurred or aggravated by military sexual
				trauma.</toc-entry>
						</toc>
						<after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HE01522AD7ADD4A45B268AD3ABDBBB9EA"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">Subsection (c) of
			 <external-xref legal-doc="usc" parsable-cite="usc/38/1154">section 1154</external-xref> of title 38, United States Code, as added by subsection (a), shall
			 apply with respect to any claim for disability compensation under laws
			 administered by the Secretary of Veterans Affairs for which no final decision
			 has been made before the date of the enactment of this Act.</text>
