		<section id="H953C20E73E0C459286324C85766DD2D0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fort Sumner Project Title Conveyance
			 Act</short-title></quote>.</text>
		</section><section id="H8C70FD22D7A341948EBB9B124DF9E3C8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H4CA90AEBDED043D9A36F4402A3E76BEA"><enum>(1)</enum><header>District</header><text>The
			 term <term>District</term> means the Fort Sumner Irrigation District, located
			 in De Baca County, New Mexico.</text>
			</paragraph><paragraph id="H65C0500CCA764C4984E8DBA13ADAE24F"><enum>(2)</enum><header>Forbearance
			 agreement</header><text>The term <term>Forbearance Agreement</term> means the
			 contract between the United States and the District for the forbearance of
			 exercising priority water rights numbered 08–WC–40–292 and dated August 21,
			 2009 (including any amendments to that contract).</text>
			</paragraph><paragraph id="H7D514AF146D245C6AE2E8388173AA0F8"><enum>(3)</enum><header>Project</header><text>The
			 term <term>Project</term> means the Fort Sumner reclamation project.</text>
			</paragraph><paragraph id="HC408BCF90F68451391052717AAE173A0"><enum>(4)</enum><header>Repayment
			 contract</header><text>The term <term>Repayment Contract</term> means the
			 contract between the United States and the District numbered Ilr–1524 and dated
			 November 5, 1948 (including any supplements and amendments to that
			 contract).</text>
			</paragraph><paragraph id="H8D4EB4CA817747B6AED14BD054825222"><enum>(5)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="HCBB442143E0A4AF8BA6CF48F84C6DBBE"><enum>(6)</enum><header>Memorandum of
			 agreement</header><text>The term <term>Memorandum of Agreement </term> means
			 the agreement entitled <quote>Memorandum of Agreement between the United States
			 and the Fort Sumner Irrigation District Concerning Principles and Elements of
			 Proposed Transfer of Title to Fort Sumner Irrigation District
			 Facilities</quote> and numbered 11–WC–40–406 (including any amendments to that
			 agreement).</text>
			</paragraph><paragraph id="H51EA5E514D4642C9A6B98304EBF1AF63"><enum>(7)</enum><header>Transfer
			 agreement</header><text>The term <term>Transfer Agreement</term> means the
			 agreement between the United States and the Fort Sumner Irrigation District
			 that identifies the specific terms and conditions of the title transfer. This
			 document will be completed after the requirements described in section 3(d) are
			 satisfied.</text>
			</paragraph></section><section id="H9A2FBF6E199D40D791B6A6F63E5E6FBA"><enum>3.</enum><header>Conveyance</header>
			<subsection id="HB7745D7E15444A2089401AABD42A042E"><enum>(a)</enum><header>In
			 general</header><text>The Secretary is authorized to convey to the District all
			 right and title of the United States in and to all works, land, and facilities
			 of the Project, in accordance with the terms and conditions established in the
			 Transfer Agreement.</text>
			</subsection><subsection id="H32D40DF2520549C5AB662F53ED7DEA84"><enum>(b)</enum><header>Valid existing
			 rights</header><text>The conveyance under this section shall be subject to all
			 valid existing leases, permits, rights-of-way, easements, and other rights
			 appurtenant to the property conveyed.</text>
			</subsection><subsection id="H612569038D694A41A9FB1AEF9EF6DD8A"><enum>(c)</enum><header>Costs of
			 conveyance</header><text>The costs of the conveyance under this section,
			 including the costs of environmental compliance, may be shared between the
			 United States and the District, in accordance with the Memorandum of
			 Agreement.</text>
			</subsection><subsection id="HE2C392DCD0C047F582C874194FE0217E"><enum>(d)</enum><header>Compliance with
			 environmental laws</header>
				<paragraph id="H961F20774B784CB4B4B4A4F8486DF0B4"><enum>(1)</enum><header>In
			 general</header><text>Before carrying out the conveyance under subsection (a),
			 the Secretary shall assure compliance with all applicable requirements
			 under—</text>
					<subparagraph id="HE6ADE9570DDF4D509AC159E5E03489E1"><enum>(A)</enum><text>the National
			 Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text>
					</subparagraph><subparagraph id="H7C8A734D9AE04CD4B2612DA7C5C40A23"><enum>(B)</enum><text>the Endangered
			 Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and</text>
					</subparagraph><subparagraph id="H38791CA4679D4845B33683CCE7FB5FEC"><enum>(C)</enum><text>any other law
			 applicable to the property conveyed.</text>
					</subparagraph></paragraph><paragraph id="H737766F31D49444AA7D8A5BEFAD1ED82"><enum>(2)</enum><header>Effect</header><text>Nothing
			 in this Act modifies or alters any obligation under—</text>
					<subparagraph id="H5040DF477F0A4AA186AEADBF421BB3EB"><enum>(A)</enum><text>the National
			 Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); or</text>
					</subparagraph><subparagraph id="HB40E52203C5A49E585E844441D402D36"><enum>(B)</enum><text>the Endangered
			 Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text>
					</subparagraph></paragraph></subsection><subsection id="H8119D2D9626F480485D21F1453D3D42B"><enum>(e)</enum><header>Failure To
			 convey</header><text>If the Secretary fails to complete the conveyance under
			 this section by the date that is 2 years after the date of completion of the
			 requirements described in subsection (d), the Secretary shall submit to
			 Congress a report that—</text>
				<paragraph id="H983825460D604B55B07B5B46974ECDB4"><enum>(1)</enum><text>explains the
			 reasons why the conveyance has not been completed; and</text>
				</paragraph><paragraph id="H68F81B395B38459DA44C18E1F9B5D758"><enum>(2)</enum><text>states the date by
			 which the conveyance will be completed.</text>
				</paragraph></subsection></section><section id="HD042D051640944969D7A4F9844496A4F"><enum>4.</enum><header>Liability</header>
			<subsection id="HF2891FC4C39F43B389BD76D8CA9CADAD"><enum>(a)</enum><header>In
			 general</header><text>Effective on the date of the conveyance under section 3,
			 the United States—</text>
				<paragraph id="H02DA0DD1E2974EFDBE5F5DA40AB2E3EF"><enum>(1)</enum><text>shall have no
			 further interest in, and shall have no responsibility for operating or
			 maintaining, the Project; and</text>
				</paragraph><paragraph id="H43392755B84B4D059836B0AB43A01E72"><enum>(2)</enum><text>shall not be
			 liable for damages of any kind arising out of any act, omission, or occurrence
			 relating to the conveyed property, except for damages caused by acts committed
			 by the United States or employees, agents, or contractors of the United States
			 before the date of the conveyance.</text>
				</paragraph></subsection><subsection id="H30BB74843CE94364A1D9D62C6F75342E"><enum>(b)</enum><header>Effect of
			 section</header><text>Nothing in this section increases the liability of the
			 United States beyond the liability provided under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28,
			 United States Code (commonly known as the <quote><act-name>Federal Tort Claims
			 Act</act-name></quote>).</text>
			</subsection></section><section id="HFE1D216E426A44618BD4C766FEBE4688"><enum>5.</enum><header>Termination of
			 repayment contract</header><text display-inline="no-display-inline">Effective
			 beginning on the date of the conveyance under section 3—</text>
			<paragraph id="HA3F3C156A5F744AA9498FCF690D5F10B"><enum>(1)</enum><text>the Repayment
			 Contract shall terminate; and</text>
			</paragraph><paragraph id="HFD6BA359E1C4447F9EB54D5E8B8644B6"><enum>(2)</enum><text>the United States
			 and the District shall have no obligations under the Repayment Contract.</text>
			</paragraph></section><section id="HB6CEC6CC64FA438F909B2292549741FE"><enum>6.</enum><header>Forbearance
			 agreement</header>
			<subsection id="HA97E0F512C9D4A32979610D4084E63E9"><enum>(a)</enum><header>Payment
			 obligation</header><text>In accordance with paragraph 4(a) of the Forbearance
			 Agreement, effective beginning on the date of termination of the Repayment
			 Contract under section 5, the United States shall have no payment obligation
			 under paragraph 4(a) of the Forbearance Agreement.</text>
			</subsection><subsection id="H59E712DD8B384AD7B489D04DB48DF4AB"><enum>(b)</enum><header>Other terms and
			 conditions</header><text>All other terms and conditions of the Forbearance
			 Agreement shall remain in full force and effect on termination of the Repayment
			 Contract under section 5.</text>
			</subsection><subsection id="HB3879A34950E46F69D76122BBFA1EFD1"><enum>(c)</enum><header>Term</header><text>The
			 term of the Forbearance Agreement shall be not less than 10 years after the
			 date of enactment of this Act, as set forth in the Memorandum of
			 Agreement.</text>
			</subsection></section><section id="H46D2D13824E348B4A458AA314A815A9A"><enum>7.</enum><header>Future
			 benefits</header><text display-inline="no-display-inline">After conveyance of
			 title under this Act—</text>
			<paragraph id="HB6768A7DA6114B3EB86BB95690272FA5"><enum>(1)</enum><text>the conveyed
			 property shall not be considered to be a part of a Federal reclamation project;
			 and</text>
			</paragraph><paragraph id="H59CB9FADC57C481CA2150B72D9E591A4"><enum>(2)</enum><text>the entity to
			 which the property is conveyed shall not be eligible to receive any benefits,
			 including Federal project power, with respect to the conveyed property, except
			 for benefits that would be available to a similarly situated entity with
			 respect to property that is not part of a Federal reclamation project.</text>
			</paragraph></section></legis-body>
