		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Investing in Innovation for
			 Education Act of 2013</short-title></quote>.</text>
		</section><section id="IDfae9d7c358d444f79ccfef74fc2e6363"><enum>2.</enum><header>Investing in
			 innovation</header>
			<subsection id="ID2b5ce116873445ea9c891aa37cb51c86"><enum>(a)</enum><header>In
			 General</header><text>Title IV of the Elementary and Secondary Education Act of
			 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7101">20 U.S.C. 7101 et seq.</external-xref>) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id0B7C5D9FAB234D32A40880346BB5D6C6" style="OLC">
					<part id="id3CFE6C86E11A4E498AAEA35D89173857"><enum>D</enum><header>Investing in
				innovation</header>
						<section id="ID1b28460cd2184c7a9dc537996ff012fe"><enum>4401.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this part are to—</text>
							<paragraph id="ID50fdd172ac744fda8a7ce88f94746a17"><enum>(1)</enum><text>fund the
				identification, development, evaluation, and expansion of innovative,
				evidence-based practices, programs, and strategies in order to
				significantly—</text>
								<subparagraph id="IDc95235572a404ca58e6b822abd83b78c"><enum>(A)</enum><text>increase student
				academic achievement and decrease achievement gaps;</text>
								</subparagraph><subparagraph id="IDf02157442f48475c8391ddb220d616f0"><enum>(B)</enum><text>increase high
				school graduation rates;</text>
								</subparagraph><subparagraph id="IDf2dcfe29c0aa47d7a6d732c1d57abbd5"><enum>(C)</enum><text>increase college
				enrollment rates and rates of college persistence;</text>
								</subparagraph><subparagraph id="IDca3709ca70274dc1b20331ef536444d2"><enum>(D)</enum><text>improve teacher
				and school leader effectiveness; and</text>
								</subparagraph><subparagraph id="IDaa4511cbfbb441559342c2830931fe54"><enum>(E)</enum><text>increase the
				identification of innovative educational strategies in rural areas; and</text>
								</subparagraph></paragraph><paragraph id="ID00f4dee5d96f47d1ba80f6066e92d31c"><enum>(2)</enum><text>support the rapid
				development, expansion, and adoption of tools and resources that improve the
				efficiency, effectiveness, or pace of adoption of such educational practices,
				programs, and strategies.</text>
							</paragraph></section><section id="ID614d721f1b644776b56fb9a28213ff26"><enum>4402.</enum><header>National
				activities</header><text display-inline="no-display-inline">The Secretary may
				reserve not more than 10 percent of the funds appropriated under section 4408
				for each fiscal year to carry out activities of national significance, which
				activities may include—</text>
							<paragraph id="idD1FB11C597D0462A995872E0E62213FD"><enum>(1)</enum><text display-inline="yes-display-inline">capacity building;</text>
							</paragraph><paragraph id="idFD6DDF25BA6B49A190BC2D71CFF97682"><enum>(2)</enum><text display-inline="yes-display-inline">technical assistance, including to
				applicants from rural areas;</text>
							</paragraph><paragraph id="id06D5554CE9D74A95873974F423AF0A90"><enum>(3)</enum><text display-inline="yes-display-inline">pre-application workshops and web-based
				seminars for potential applicants, including applicants from rural
				areas;</text>
							</paragraph><paragraph id="id3DC6383D2F5B4A48873E7042573049E1"><enum>(4)</enum><text display-inline="yes-display-inline">the recruitment of peer-reviewers,
				including individuals with a background in rural education, to participate in
				the review of applications submitted under section 4404;</text>
							</paragraph><paragraph id="idB7FF601D73454E1CA1D242EF02424001"><enum>(5)</enum><text display-inline="yes-display-inline">dissemination of best practices developed
				with grant funds provided under this part, including best practices developed
				with grant funds in rural areas;</text>
							</paragraph><paragraph id="id07412C5356464626ADEE8B6282C4E6FB"><enum>(6)</enum><text display-inline="yes-display-inline">carrying out prize awards consistent with
				section 24 of the Stevenson-Wydler Technology Innovation Act of 1980 (15 U.S.C.
				3719); and</text>
							</paragraph><paragraph id="id69DB9D46BA024782BA4951492C846F71"><enum>(7)</enum><text>entering into
				partnerships with other agencies, nonprofits, and the private sector to carry
				out advanced research and development activities, including research and
				activities in rural areas.</text>
							</paragraph></section><section id="ID0c638043c3c64c0c82ce38d3fb6c283e"><enum>4403.</enum><header>Program
				authorized; length of grants; priorities</header>
							<subsection id="ID6bc8fe607e654334a8903f4a9ce88ffe"><enum>(a)</enum><header>Program
				Authorization</header><text>The Secretary shall use funds made available to
				carry out this part to award grants, on a competitive basis, to local
				educational agencies, educational service agencies, and nonprofit organizations
				that propose to provide support to 1 or more public schools or local
				educational agencies, or both, consistent with section 4405.</text>
							</subsection><subsection id="ID8d8dac4e81f346dea00a9360b136f81b"><enum>(b)</enum><header>Duration of
				Grants</header><text>The Secretary shall award grants under this part for a
				period of not more than 3 years, and may extend such grants for an additional
				2-year period if the grantee demonstrates to the Secretary that it is making
				significant progress on the program performance measures identified in section
				4406.</text>
							</subsection><subsection id="ID3d4b686f0a154750ade7db500bd119cb"><enum>(c)</enum><header>Rural
				areas</header><text>The Secretary shall ensure that not less than 25 percent of
				the funds awarded under subsection (a) for any fiscal year are for projects
				that meet both of the following requirements:</text>
								<paragraph id="ID0611e4b7446f44de9a1eea5830c190f9"><enum>(1)</enum><text>The grantee
				is—</text>
									<subparagraph id="id6A06D92D71F64C8783DF8F1FE2ACA27C"><enum>(A)</enum><text>a local
				educational agency with an urban-centric district locale code of 32, 33, 41,
				42, or 43, as determined by the Secretary;</text>
									</subparagraph><subparagraph id="id715C94A6EE7D4FB38B3FE389E7ADB903"><enum>(B)</enum><text>a consortium of
				such local educational agencies; or</text>
									</subparagraph><subparagraph id="id0519FA71C70B4E059CBD626BDEC7B2AD"><enum>(C)</enum><text>an educational
				service agency or a nonprofit organization with demonstrated expertise in
				serving students from rural areas.</text>
									</subparagraph></paragraph><paragraph id="ID67bab14b68944e0386d5df1b36af0ef0"><enum>(2)</enum><text>A majority of the
				schools to be served by the project are designated with a school locale code of
				41, 42, or 43, or a combination of such codes, as determined by the
				Secretary.</text>
								</paragraph></subsection><subsection id="ID6d5d5b5bab214ac88f080ad00989db5e"><enum>(d)</enum><header>Priorities</header><text>In
				awarding grants under this part, the Secretary may give priority to an eligible
				entity that includes, in its application under section 4404, a plan to—</text>
								<paragraph id="IDf07e399248434c5b96832f3056190d80"><enum>(1)</enum><text>improve early
				learning outcomes;</text>
								</paragraph><paragraph id="IDd07f5a4ce9f04ba3a4f4a427daa9c87a"><enum>(2)</enum><text>support college
				access and success;</text>
								</paragraph><paragraph id="IDbdff669bc7c542da8a03ee18de1079f2"><enum>(3)</enum><text>support family
				and community engagement;</text>
								</paragraph><paragraph id="ID65b25ad7e022475787d52fb3fefc4236"><enum>(4)</enum><text>address the
				unique learning needs of students with disabilities or English language
				learners;</text>
								</paragraph><paragraph id="IDa7b67a56cbff433caf98e43e58565ab9"><enum>(5)</enum><text>support the
				effective use of education technology to improve teaching and learning;</text>
								</paragraph><paragraph id="IDeb3ce4cd68b5474c945b4641f573f729"><enum>(6)</enum><text>improve the
				teaching and learning of science, technology, engineering, or mathematics;
				or</text>
								</paragraph><paragraph id="idC586A030F8014D01897C52074A3E9EF5"><enum>(7)</enum><text>serve schools in
				rural local educational agencies.</text>
								</paragraph></subsection><subsection id="IDd8719010e6764060ac672e472e9d89df"><enum>(e)</enum><header>Standards of
				Evidence</header><text>The Secretary shall set standards for the quality of
				evidence that an applicant shall provide in order to demonstrate that the
				activities the applicant proposes to carry out with funds under this part are
				likely to succeed in improving student outcomes or outcomes on other
				performance measures. These standards may include any of the following:</text>
								<paragraph id="ID8d590b6a0daa40d4b8e0d43a8ef24429"><enum>(1)</enum><text>Strong evidence
				that the activities proposed by the applicant will have a statistically
				significant effect on student academic achievement, student growth, or outcomes
				on other performance measures.</text>
								</paragraph><paragraph id="ID73a4b1378ab64e4b9da872b7586a6e4d"><enum>(2)</enum><text>Moderate evidence
				that the activities proposed by the applicant will improve student academic
				achievement, student growth, or outcomes on other performance measures.</text>
								</paragraph><paragraph id="ID368def13c71a4d86b86ae00f3c585d95"><enum>(3)</enum><text>A rationale based
				on research findings or a reasonable hypothesis that the activities proposed by
				the applicant will improve student academic achievement, student growth, or
				outcomes on other performance measures.</text>
								</paragraph></subsection></section><section id="IDc670b77864c7478d8f8f6276daddfe18"><enum>4404.</enum><header>Applications</header>
							<subsection id="IDe5f22882594449beb7b9dfaecf83f495"><enum>(a)</enum><header>Applications</header>
								<paragraph id="id4E6F017CF8884CC5B1C80879A4C42DFE"><enum>(1)</enum><header>In
				general</header><text>Each local educational agency, educational service
				agency, or nonprofit organization that desires to receive a grant under this
				part shall submit an application to the Secretary at such time, in such manner,
				and containing such information as the Secretary may reasonably require.</text>
								</paragraph><paragraph id="idC181A9B7DD9F401496B49068B911C49C"><enum>(2)</enum><header>Reasonable
				period of time</header><text>The Secretary shall ensure that prospective
				applicants are provided a reasonable period of time in which to prepare and
				submit their applications.</text>
								</paragraph></subsection><subsection id="IDb5193ff615d14c95a416aede1a383484"><enum>(b)</enum><header>Contents</header><text>At
				a minimum, each application shall—</text>
								<paragraph id="ID5abda73b138745a7a1982f97c5ef9f04"><enum>(1)</enum><text>describe the
				project for which the applicant is seeking a grant and how the evidence
				supporting that project meets the standards of evidence established by the
				Secretary under section 4403(e);</text>
								</paragraph><paragraph id="ID4b7ea64e82a34c359be6d4304a7c0731"><enum>(2)</enum><text>describe how the
				applicant will address at least 1 of the areas described in section
				4405(a)(1);</text>
								</paragraph><paragraph id="IDffc6897f50bd42cdbd7ca4a28627d08e"><enum>(3)</enum><text>provide an
				estimate of the number of students that the applicant plans to serve under the
				proposed project, including the percentage of those students who are from
				low-income families, and the number of students to be served through additional
				expansion after the grant ends;</text>
								</paragraph><paragraph id="IDd577fe65cb3641fabd2683ee6157c8d6"><enum>(4)</enum><text>demonstrate that
				the applicant has established 1 or more partnerships with private
				organizations, nonprofit organizations, or community-based organizations, and
				that the partner or partners will provide matching funds, except that the
				Secretary may waive the matching funds requirement, on a case-by-case, upon a
				showing of exceptional circumstances, such as the difficulty of raising
				matching funds for a project to serve a rural area;</text>
								</paragraph><paragraph id="ID7f37e696eb2c4ea786d2766acee6ccd5"><enum>(5)</enum><text>describe the
				applicant's plan for continuing the proposed project after funding under this
				part ends;</text>
								</paragraph><paragraph id="idC6837BA3F7534D2D91996216F7C9AA21"><enum>(6)</enum><text>if the applicant
				is a local educational agency—</text>
									<subparagraph id="id363C9F2641E8431284283147034D8EFA"><enum>(A)</enum><text>document the
				local educational agency's record during the previous 3 years in—</text>
										<clause id="id0C0D207048AF4F6D8E42406B43A4E904"><enum>(i)</enum><text>increasing
				student achievement, including achievement for each subgroup described in
				section 1111(b)(2)(C)(v); and</text>
										</clause><clause id="id9BA0262E152E48279812D30D4EA7E3A7"><enum>(ii)</enum><text>decreasing
				achievement gaps; and</text>
										</clause></subparagraph><subparagraph id="idE8CC18E3EC584AB49B32D1FA5ACF2E02"><enum>(B)</enum><text>demonstrate how
				the local educational agency has made significant improvements in other
				outcomes, as applicable, on the performance measures described in section
				4406;</text>
									</subparagraph></paragraph><paragraph id="ID3a5f3454dfed42259db477776898a1e9"><enum>(7)</enum><text>if the applicant
				is a nonprofit organization—</text>
									<subparagraph id="IDf897e2999f174285a41a52a3356b05e0"><enum>(A)</enum><text>provide evidence
				that the nonprofit organization has helped at least 1 school or local
				educational agency, during the previous 3 years, significantly—</text>
										<clause id="IDc94a5098cfc74642a197ba9cd75274b3"><enum>(i)</enum><text>increase student
				achievement, including achievement for each subgroup described in section
				1111(b)(2)(C)(v); and</text>
										</clause><clause id="ID8fa2159a5260459398012c639b7f3c3e"><enum>(ii)</enum><text>reduce
				achievement gaps; and</text>
										</clause></subparagraph><subparagraph id="IDa3c02ef764324d02ac4affb97c5c1508"><enum>(B)</enum><text>describe how the
				nonprofit organization has helped at least 1 school or local educational agency
				make a significant improvement, as applicable, in other outcomes on the
				performance measures described in section 4406;</text>
									</subparagraph></paragraph><paragraph id="id28D43E9B64874317ABCBA4A62B2FB6D8"><enum>(8)</enum><text>if the applicant
				is an educational service agency—</text>
									<subparagraph id="idF7042CE1186941C3B34CCBFA19055CC1"><enum>(A)</enum><text>provide evidence
				that the agency has helped at least 1 school or local educational agency,
				during the previous 3 years, significantly—</text>
										<clause id="idB87264BB139C410BB543AF3AF7C7230E"><enum>(i)</enum><text>increase student
				achievement, including achievement for each subgroup described in section
				1111(b)(2)(C)(v); and</text>
										</clause><clause id="id48796126302848F198FE740DEF01F15D"><enum>(ii)</enum><text>reduce
				achievement gaps; and</text>
										</clause></subparagraph><subparagraph id="id1047308B9F0B4869840D1FB18235A5D2"><enum>(B)</enum><text>describe how the
				agency has helped at least 1 school or local educational agency make a
				significant improvement, as applicable, in other outcomes on the performance
				measures described in section 4406;</text>
									</subparagraph></paragraph><paragraph id="IDc4e4dfc94da345aba8f076551d753dc7"><enum>(9)</enum><text>provide a
				description of the applicant's plan for independently evaluating the
				effectiveness of activities carried out with funds under this part;</text>
								</paragraph><paragraph id="ID277ade6f29464524b9db3548a1eed118"><enum>(10)</enum><text>provide an
				assurance that the applicant will—</text>
									<subparagraph id="ID1de33009bc8c4364a7c6a453561bed5e"><enum>(A)</enum><text>cooperate with
				cross-cutting evaluations;</text>
									</subparagraph><subparagraph id="IDc2d2c23b85ed4c26acd5bc81158424e7"><enum>(B)</enum><text>make evaluation
				data available to third parties for validation and further study; and</text>
									</subparagraph><subparagraph id="ID0c51c2c68e6347c1986a3b37a0ae9abe"><enum>(C)</enum><text>participate in
				communities of practice; and</text>
									</subparagraph></paragraph><paragraph id="ID79c219bcf4b1488bb1e629075804de04"><enum>(11)</enum><text>if the applicant
				is a nonprofit organization that intends to make subgrants, consistent with
				section 4405(b), provide an assurance that the applicant will apply paragraphs
				(1) through (10), as appropriate, in the applicant's selection of subgrantees
				and in its oversight of those subgrants.</text>
								</paragraph></subsection><subsection id="ID2c7e2ea76d9c45a194f97215535f555f"><enum>(c)</enum><header>Criteria for
				evaluating applications</header><text>The Secretary shall award grants under
				this part on a competitive basis, based on the quality of the applications
				submitted and, consistent with the standards established under section 4403(e),
				each applicant's likelihood of achieving success in improving student outcomes
				or outcomes on other performance measures.</text>
							</subsection></section><section id="ID0e896969bdb34a42a3164d760d8da5a3"><enum>4405.</enum><header>Uses of
				funds</header>
							<subsection id="IDea0c9339041a4a998635d72e792d9042"><enum>(a)</enum><header>Uses of
				funds</header><text>Each local educational agency, educational service agency,
				or nonprofit organization that receives a grant under this part—</text>
								<paragraph commented="no" id="IDe6a78005dbf24e97958f331e0f059eb9"><enum>(1)</enum><text>shall use the
				grant funds to address, at a minimum, 1 of the following areas of school
				innovations:</text>
									<subparagraph commented="no" id="ID34d8640942c4442a81bbdd93a7c7b414"><enum>(A)</enum><text>Improving the
				effectiveness of teachers and school leaders and promoting equity in the
				distribution of effective teachers and school leaders.</text>
									</subparagraph><subparagraph commented="no" id="ID6b785513d8f64e08a89545705cd28cea"><enum>(B)</enum><text>Strengthening the
				use of data to improve teaching and learning.</text>
									</subparagraph><subparagraph commented="no" id="ID1e00b7075af345fb82cab8f7fb1f86b5"><enum>(C)</enum><text>Providing
				high-quality instruction based on rigorous standards that build toward college
				and career readiness and measuring students' mastery using high-quality
				assessments aligned to those standards.</text>
									</subparagraph><subparagraph commented="no" id="ID99ee8543b52c48839d47c217ebe2b877"><enum>(D)</enum><text>Turning around
				the lowest-performing schools.</text>
									</subparagraph><subparagraph commented="no" id="ID699eeb319dec468bb9cc96c1cb011be0"><enum>(E)</enum><text>Any other area of
				school innovation, as determined by the Secretary;</text>
									</subparagraph></paragraph><paragraph commented="no" id="IDa51043e90afe4d96b282c76ee3372d40"><enum>(2)</enum><text>shall use those
				funds to develop or expand strategies to improve the performance of high-need
				students on the performance measures described in section 4406; and</text>
								</paragraph><paragraph commented="no" id="id765B9DA625FC4EBABDEC1ADC63D3E3BA"><enum>(3)</enum><text>may use the grant
				funds for an independent evaluation, as required by section 4404(b)(9), of the
				innovative practices carried out with the grant.</text>
								</paragraph></subsection><subsection id="IDd9b48c20fb224054814fffbfa69c7a15"><enum>(b)</enum><header>Authority to
				subgrant</header><text>A nonprofit organization that receives a grant under
				this part may use the grant funds to make subgrants to other entities to
				provide support to 1 or more schools or local educational agencies. Any such
				entity shall comply with the requirements of this part relating to grantees, as
				appropriate.</text>
							</subsection></section><section id="ID1607fe0a787c452ebf60f9b591003e53"><enum>4406.</enum><header>Performance
				measures</header><text display-inline="no-display-inline">The Secretary shall
				establish performance measures for the programs and activities carried out
				under this part. These measures, at a minimum, shall track the grantee's
				progress in—</text>
							<paragraph id="IDd0429a5feff946e1bf6464c0d3a5e615"><enum>(1)</enum><text>improving
				outcomes for each subgroup described in section 1111(b)(2)(C)(v) that is served
				by the grantee on measures, including, as applicable, by—</text>
								<subparagraph id="ID56f11b8301ae4978a216615ae3c5fd43"><enum>(A)</enum><text>increasing
				student achievement and decreasing achievement gaps;</text>
								</subparagraph><subparagraph id="ID51028c04521b4823b49fc925d02d1b70"><enum>(B)</enum><text>increasing high
				school graduation rates;</text>
								</subparagraph><subparagraph id="ID50c1376a45fb4d91aaa874a9ea73047a"><enum>(C)</enum><text>increasing
				college enrollment rates and rates of college persistence;</text>
								</subparagraph><subparagraph id="IDda38a7fb06ff43c68c5d7187f871f1ce"><enum>(D)</enum><text>improving teacher
				and school leader effectiveness;</text>
								</subparagraph><subparagraph id="ID7d24b7e6af794e5980fc5571adabfb65"><enum>(E)</enum><text>improving school
				readiness; and</text>
								</subparagraph><subparagraph id="IDeb979368866f4700809e28f1cb46c69f"><enum>(F)</enum><text>any other
				indicator as the Secretary or grantee may determine; and</text>
								</subparagraph></paragraph><paragraph id="IDbc6a0c4395e24cedbc52cd80b5cae65c"><enum>(2)</enum><text>implementing its
				project in rural schools, as applicable.</text>
							</paragraph></section><section id="IDcfe7a4c793f74d61992014c1a416db2d"><enum>4407.</enum><header>Reporting;
				annual report</header><text display-inline="no-display-inline">A local
				educational agency, educational service agency, or nonprofit organization that
				receives a grant under this part shall submit to the Secretary, at such time
				and in such manner as the Secretary may require, an annual report that
				includes, among other things, information on the applicant's progress on the
				performance measures established under section 4406, and the data supporting
				that progress.</text>
						</section><section id="ID4739481f2d4e4fa4b3d545cc09f5ddd9"><enum>4408.</enum><header>Authorization
				of appropriations</header><text display-inline="no-display-inline">There are
				authorized to be appropriated to carry out this part $500,000,000 for fiscal
				year 2014 and such sums as may be necessary for each of the 5 succeeding fiscal
				years.</text>
						</section></part><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDffbb51f218db40b1b475dc7468049acd"><enum>(b)</enum><header>Table of
			 contents</header><text>The table of contents in section 2 of the Elementary and
			 Secondary Education Act of 1965 is amended by inserting after the item relating
			 to section 4304 the following:</text>

						<toc-entry idref="ID1b28460cd2184c7a9dc537996ff012fe" level="section">Sec. 4401. Purposes.</toc-entry>
