			 the Secretary of Commerce to enforce statutes</header><subsection id="IDF5DEADA456684196ABE11F3F37BA0739"><enum>(a)</enum><header>In
			 general</header><paragraph id="ID091AC634A3FE4C0CAADC9B20E202E460"><enum>(1)</enum><header>Enforcement</header><text>The
			 Secretary of Commerce and the Secretary of the department in which the Coast
			 Guard is operating shall enforce the Acts to which this section applies in
			 accordance with the provisions of this section.</text></paragraph><paragraph id="IDEA9BDDAFC7714C42A2D69F189BB2A103"><enum>(2)</enum><header>Nondepartmental
			 resources</header><text>The Secretary of Commerce may, by agreement, on a
			 reimbursable basis or otherwise, utilize the personnel services, equipment
			 (including aircraft and vessels), and facilities of any other Federal agency,
			 including all elements of the Department of Defense, and of any State agency,
			 in carrying out this section.</text></paragraph><paragraph id="ID64F3998B690D410C80F69CD8472A7480"><enum>(3)</enum><header>Application</header><text>This
			 section applies to—</text><subparagraph id="IDF947913C2BF34A659B05EC5C6ADE88B7"><enum>(A)</enum><text>the High Seas
			 Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826d">16 U.S.C. 1826d et seq.</external-xref>);</text></subparagraph><subparagraph id="ID8D79FC1F193D48B4AAECA3CD55D0AF02"><enum>(B)</enum><text>the Pacific Salmon
			 Treaty Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3631">16 U.S.C. 3631 et seq.</external-xref>);</text></subparagraph><subparagraph id="IDB469ECE3B1594ED1AEB7AFFFB45778EC"><enum>(C)</enum><text>the Dolphin

			 Convention Act of 1975 (<external-xref legal-doc="usc" parsable-cite="usc/16/971">16 U.S.C. 971 et seq.</external-xref>);</text></subparagraph><subparagraph id="ID8DB717E3976C46A8ADB7103BB0D3A8B8"><enum>(I)</enum><text>the Northwest
			 Atlantic Fisheries Convention Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/16/5601">16 U.S.C. 5601 et seq.</external-xref>);</text></subparagraph><subparagraph id="ID001275CCBE704D9492BE47C62592E8D8"><enum>(J)</enum><text>the Western and
			 Central Pacific Fisheries Convention Implementation Act (16 U.S.C. 6901 et
			 seq.);</text></subparagraph><subparagraph id="IDCE67D30872EB4941A3823B1FDC5E2886"><enum>(K)</enum><text>the Northern
			 Pacific Halibut Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/16/773">16 U.S.C. 773 et seq.</external-xref>);</text></subparagraph><subparagraph id="ID4823ACD0A39949DEB2C8CE973CA44DFB"><enum>(L)</enum><text>the
			 <short-title>Antigua Convention Implementing Act of
			 2013</short-title>; and</text></subparagraph><subparagraph id="id409E7F767E1545148416C02FFCB84A85"><enum>(M)</enum><text>any other Act in
			 pari materia, so designated by the Secretary after notice and an opportunity
			 for a hearing.</text></subparagraph></paragraph></subsection><subsection id="IDBC2BE10379204A55AD9149C0188986D4"><enum>(b)</enum><header>Administration
			 and enforcement</header><text>The Secretary of Commerce shall prevent any
			 person from violating any Act to which this section applies in the same manner,
			 by the same means, and with the same jurisdiction, powers, and duties as though
			 sections 308 through 311 of the Magnuson-Stevens Fishery Conservation and
			 Management Act (16 U.S.C. 1858 through 1861) were incorporated into and made a
			 part of each such Act. Except as provided in subsection (c), any person that
			 violates any Act to which this section applies shall be subject to the
			 penalties, and entitled to the privileges and immunities, provided in the
			 Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1801 et
			 seq.) in the same manner and by the same means as though
			 sections 308 through 311 of that Act (16 U.S.C. 1858 through 1861) were
			 incorporated into and made a part of each such Act.</text></subsection><subsection id="IDBF62AA799AD44E94A0EC577DF963E836"><enum>(c)</enum><header>Special
			 rules</header><paragraph id="ID06B187504D4242D28314C4F7A0A59D2F"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding the incorporation by reference of certain
			 sections of the Magnuson-Stevens Fishery Conservation and Management Act under
			 subsection (b), if there is a conflict between a provision of this subsection
			 and the corresponding provision of any section of the Magnuson-Stevens Fishery
			 Conservation and Management Act so incorporated, the provision of this
			 subsection shall apply.</text></paragraph><paragraph id="ID678705B74236412CBF645B248D860EDB"><enum>(2)</enum><header>Additional
			 enforcement authority</header><text>In addition to the powers of officers
			 authorized pursuant to subsection (b), any officer who is authorized by the
			 Secretary, or the head of any Federal or State agency that has entered into an
			 agreement with the Secretary under subsection (a) to enforce the provisions of
			 any Act to which this section applies may, with the same jurisdiction, powers,
			 and duties as though section 311 of the Magnuson-Stevens Fishery Conservation
			 and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1861">16 U.S.C. 1861</external-xref>) were incorporated
			 into and made a part of each such Act—</text><subparagraph id="ID353ABD68962E46419AA02170DB330EE4"><enum>(A)</enum><text>search or inspect
			 any facility or conveyance used or employed in, or which reasonably appears to
			 be used or employed in, the storage, processing, transport, or trade of fish or
			 fish products;</text></subparagraph><subparagraph id="IDF8472B480AEA4B2C9710546CA9AB107E"><enum>(B)</enum><text>inspect records
			 pertaining to the storage, processing, transport, or trade of fish or fish
			 products;</text></subparagraph><subparagraph id="ID09D6AA2DB36F48B2B05228537193E77E"><enum>(C)</enum><text>detain, for a
			 period of up to 14 days, any shipment of fish or fish product imported into,
			 landed on, introduced into, exported from, or transported within the
			 jurisdiction of the United States, or, if such fish or fish product is deemed
			 to be perishable, sell and retain the proceeds therefrom for a period of up to
			 14 days;</text></subparagraph><subparagraph commented="no" id="IDADD27460C9DE4453A5790FA5B96BDFB1"><enum>(D)</enum><text>make an arrest, in
			 accordance with any guidelines which may be issued by the Attorney General, for
			 any offense under the laws of the United States committed in the person's
			 presence, or for the commission of any felony under the laws of the United
			 States, if the person has reasonable grounds to believe that the person to be
			 arrested has committed or is committing a felony;</text></subparagraph><subparagraph commented="no" id="idD7ED7B3310ED4C14BB7D2093468389B0"><enum>(E)</enum><text>search and seize,
			 in accordance with any guidelines which may be issued by the Attorney General;
			 and</text></subparagraph><subparagraph commented="no" id="id7D16FFC097334F898AA4FBA97247E2A9"><enum>(F)</enum><text>execute and serve
			 any subpoena, arrest warrant, search warrant issued in accordance with rule 41
			 of the Federal Rules of Criminal Procedure, or other warrant or civil or
			 criminal process issued by any officer or court of competent
			 jurisdiction.</text></subparagraph></paragraph><paragraph id="ID02E8CA358203483DA6CBE008C1035E0B"><enum>(3)</enum><header>Information
			 collection, maintenance and use</header><subparagraph id="IDCDC10EE71E114983AD435737C7FBFFC0"><enum>(A)</enum><header>In
			 general</header><text>The Secretary of Commerce and the head of each department
			 and agency providing personnel for the task force under section 201, to the
			 maximum extent permissible under law, shall share all applicable information,
			 intelligence, and data, related to the harvest, transportation, or trade of
			 fish and fish product for the purposes under section 201(a)(2).</text></subparagraph><subparagraph id="ID4790FD49343D4C0D8A4D3D215B1574BF"><enum>(B)</enum><header>Coordination of
			 data</header><text>The Secretary of Commerce, through the task force under
			 section 201, shall coordinate the collection, storage, analysis, and
			 dissemination of all applicable information, intelligence, and data related to
			 the harvest, transportation, or trade of fish and fish product collected or
			 maintained by a member agency of the task force.</text></subparagraph><subparagraph id="IDC07CEE9628734587B958C3BA55F9B2C9"><enum>(C)</enum><header>Confidentiality</header><text>The
			 Secretary of Commerce, through the task force under section 201, shall ensure
			 the protection and confidentiality required by law for information,
			 intelligence, and data related to the harvest, transportation, or trade of fish
			 and fish product obtained by the task force.</text></subparagraph><subparagraph id="ID8BA7C563A9F7410B837636C5E137501B"><enum>(D)</enum><header>Data
			 standardization</header><text>The Secretary of Commerce and the head of each
			 department and agency providing personnel for the task force, to the maximum
			 extent practicable, shall develop data standardization for fisheries related
			 data for each member agency of the task force under section 201 and with
			 international fisheries enforcement databases as appropriate.</text></subparagraph><subparagraph id="ID40EE91E8D04746E098AA2DC4993AB1C0"><enum>(E)</enum><header>Assistance from
			 intelligence community</header><text>Upon request of the Secretary of Commerce,
			 elements of the intelligence community (as defined in section 3(4) of the
			 National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>)) shall collect
			 information related to illegal, unreported, or unregulated fishing activity
			 outside the United States about individuals who are not United States persons
			 (as defined in section 105A(c)(2) of such Act (50 U.S.C. 403–5a(c)(2))). Such
			 elements of the intelligence community shall collect and share such information
			 with the Secretary through the task force under section 201 of this Act for law
			 enforcement purposes in order to detect and investigate illegal, unreported, or
			 unregulated fishing activities and to carry out the provisions of this Act. All
			 collection and sharing of information shall be in accordance with the National
			 Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401">50 U.S.C. 401 et seq.</external-xref>).</text></subparagraph><subparagraph id="IDEFA105DAF33F4E869191D4834DD4C162"><enum>(F)</enum><header>Information
			 sharing</header><clause id="idB08297F698174F048251B1FBAC019D4F"><enum>(i)</enum><header>In
			 general</header><text>Subject to clause (ii), the Secretary of Commerce,
			 through the task force under section 201, shall have authority to share
			 fisheries-related data with—</text><subclause id="id75E2CD6B466F444DB51C59342C5679C0"><enum>(I)</enum><text>other Federal or
			 State government agencies;</text></subclause><subclause id="id1DA8EC71FC9F476E9EEF9ACAF963E8C6"><enum>(II)</enum><text>foreign
			 governments;</text></subclause><subclause id="id5BB4825A7CA0450EA4DFE938AF3A2770"><enum>(III)</enum><text>the Food and
			 Agriculture Organization formed at Quebec, Canada, on October 16, 1945;
			 or</text></subclause><subclause id="id4BF4537F7EBA4A00B18FF53D3E12CB5D"><enum>(IV)</enum><text>the secretariat
			 or equivalent of an international fisheries management organization or
			 arrangement made pursuant to an international fishery agreement.</text></subclause></clause><clause id="IDE066B28E87DB49F082691509B699852A"><enum>(ii)</enum><header>Limitations</header><text>An
			 entity listed under clause (i) may receive data under this subparagraph
			 if—</text><subclause id="id1C048EC21E81437D98A0F81F2B38E689"><enum>(I)</enum><text>the entity has
			 policies and procedures to safeguard such data from unintended or unauthorized
			 disclosure; and</text></subclause><subclause id="IDE649C5DB0BBB4E3D851D3CE62F19FACE"><enum>(II)</enum><text>the exchange of
			 information is necessary—</text><item id="ID0E3D0CDB0D7247E9AD49714D1C2A6327"><enum>(aa)</enum><text>to ensure
			 compliance with any law (including regulations) enforced or administered by the
			 Secretary of Commerce;</text></item><item id="ID36DEB47881644E8FAB6CE5B0D500B10D"><enum>(bb)</enum><text>to administer or
			 enforce treaties to which the United States is a party;</text></item><item id="IDD2EB3168404A4D3CBCD34DDB1C29A4BD"><enum>(cc)</enum><text>to administer or
			 enforce binding conservation measures adopted by any international organization
			 or arrangement to which the United States is a party;</text></item><item id="IDABA4E2A2841C4340AC5045533DA6624B"><enum>(dd)</enum><text>to assist in
			 investigative, judicial, or administrative enforcement proceedings in the
			 United States; or</text></item><item id="IDA81812B10F4C4759AFEFA28A6FB3DBFD"><enum>(ee)</enum><text>to assist in any
			 fisheries or living marine resource related law enforcement action undertaken
			 by a law enforcement agency of a foreign government, or in relation to a legal
			 proceeding undertaken by a foreign government.</text></item></subclause></clause></subparagraph></paragraph></subsection><subsection id="ID186ED4BB492D4AC0B7B57F81701D167F"><enum>(d)</enum><header>District court
			 jurisdiction</header><text>The several district courts of the United States
			 shall have jurisdiction over any actions arising under this section. For the
			 purpose of this section, American Samoa shall be included within the judicial
			 district of the District Court of the United States for the District of Hawaii.
			 Each violation shall be a separate offense and the offense shall be deemed to
			 have been committed not only in the district where the violation first
			 occurred, but also in any other district as authorized by law. Any offenses not
			 committed in any district are subject to the venue provisions of section 3238
			 of title 18, United States Code.</text></subsection><subsection id="ID2DE9AC7ED2594455B1E4C5C9CB4853F4"><enum>(e)</enum><header>Prohibited
			 acts</header><text>For purposes of this section and each Act to which this
			 section applies, it is unlawful for any person—</text><paragraph id="ID638B0469AE534BCC84BB3C5C6E00B3F6"><enum>(1)</enum><text>to violate any
			 provision of this section or any Act to which this section applies or any
			 regulation promulgated thereunder;</text></paragraph><paragraph id="IDB9A572EB075E4F0C87CCA5951A6AA78D"><enum>(2)</enum><text>to refuse to
			 permit any authorized enforcement officer to board, search, or inspect a
			 vessel, conveyance, or shoreside facility that is subject to the person's
			 control for purposes of conducting any search, investigation, or inspection in
			 connection with the enforcement of this section or any Act to which this
			 section applies or any regulation promulgated thereunder;</text></paragraph><paragraph id="IDAFBC50EDB7674E189AB30DC946E915D5"><enum>(3)</enum><text>to forcibly
			 assault, resist, oppose, impede, intimidate, or interfere with any such
			 authorized officer in the conduct of any search, investigation, or inspection
			 described in paragraph (2);</text></paragraph><paragraph id="IDAD31EC264A4A4D0391AA7527CAE855B2"><enum>(4)</enum><text>to resist a lawful
			 arrest for any act prohibited by this section or any Act to which this section
			 applies;</text></paragraph><paragraph id="ID400340AE29404CFDA507B7943155ECAA"><enum>(5)</enum><text>to interfere with,
			 delay, or prevent, by any means, the apprehension, arrest, or detection of
			 another person, knowing that such person has committed any act prohibited by
			 this section or any Act to which this section applies;</text></paragraph><paragraph id="ID2520D4AB611240A2BB65924DE3D70DD3"><enum>(6)</enum><text>to forcibly
			 assault, resist, oppose, impede, intimidate, sexually harass, bribe, or
			 interfere with any observer on a vessel under this section or any Act to which
			 this section applies, or any data collector employed by or under contract to
			 the National Marine Fisheries Service to carry out responsibilities under this
			 section or any Act to which this section applies;</text></paragraph><paragraph id="IDB2E100699A014C4E906155FCFA935460"><enum>(7)</enum><text>to import, export,
			 transport, sell, receive, acquire, or purchase in interstate or foreign
			 commerce any fish or fish product taken, possessed, transported, or sold in
			 violation of any treaty or binding conservation measure adopted pursuant to an
			 international agreement or organization to which the United States is a party;
			 or</text></paragraph><paragraph id="IDD4F42066552848B69CF25FD66A604798"><enum>(8)</enum><text>to make or submit
			 any false record, account, or label for, or any false identification of, any
			 fish or fish product (including false identification of the species, harvesting
			 vessel or nation, or the location where harvested) which has been, or is
			 intended to be imported, exported, transported, sold, offered for sale,
			 purchased, or received in interstate or foreign commerce.</text></paragraph></subsection><subsection id="ID261EEB670A52411F9142137BB2EEC737"><enum>(f)</enum><header>Regulations</header><text>The
			 Secretary of Commerce may promulgate such regulations, in accordance with
			 <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code, as may be necessary to carry out
			 this section or any Act to which this section applies.</text></subsection></section><section id="ID5932A996F97148DA8C7034833E6E1B8A"><enum>102.</enum><header>Conforming,
			 minor, and technical amendments</header><subsection id="IDA7D5C555101B40E0BA3DD88A8588ED26"><enum>(a)</enum><header>High Seas
			 Driftnet Fishing Moratorium Protection Act</header><paragraph id="IDB714084744CE4DFDB384B7A409F817E2"><enum>(1)</enum><text>Section 606 of the
			 High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826g">16 U.S.C. 1826g</external-xref>)

				any time during the preceding 3 years, in illegal, unreported, or unregulated
				fishing and—</text><subparagraph id="IDC3090F2CE5314197B379EAAA80559C87"><enum>(A)</enum><text>such fishing
				undermines the effectiveness of measures required under the relevant
				international fishery management organization;</text></subparagraph><subparagraph id="ID096A2CEFCBE54ECCAE97A8572EC2C9FD"><enum>(B)</enum><text>the relevant
				international fishery management organization has failed to implement effective
				measures to end the illegal, unreported, or unregulated fishing activity by
				vessels of that nation, or the nation is not a party to, or does not maintain
				cooperating status with, such organization; or</text></subparagraph><subparagraph id="ID9B6F6A73E1694D5DA82550C1FB5376B8"><enum>(C)</enum><text>there is no
				international fishery management organization with a mandate to regulate the
				fishing activity in question.</text></subparagraph></paragraph><paragraph id="ID6386E56BA2064987B988408A4E8F94E6"><enum>(2)</enum><header>Other
				identifying activities</header><text>The Secretary shall also identify, and
				list in the report under section 607, a nation if—</text><subparagraph id="ID59F8B58303094D72AECB3322800B2DC0"><enum>(A)</enum><text>it is violating,
				or has violated at any time during the preceding 3 years, conservation and
				management measures required under an international fishery management
				agreement to which the United States is a party and the violations undermine
				the effectiveness of such measures, taking into account the factors described
				in paragraph (1); or</text></subparagraph><subparagraph id="IDD8F838327C7240D0BFF8B3700DA9EFAC"><enum>(B)</enum><text>it is failing, or
				has failed at any time during the preceding 3 years, to effectively address or
				regulate illegal, unreported, or unregulated fishing.</text></subparagraph></paragraph><paragraph id="ID89CD3CEC9F6B48398CF617D53ABF4A79"><enum>(3)</enum><header>Treatment of
				certain entities as if they were nations</header><text>Where the provisions of
				this Act apply to the act, or failure to act, of a nation, they shall also be
				applicable, as appropriate, to any other entity that is competent to enter into
				an international fishery management
				agreement.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="ID50BFB7E6A0144502AB92DA64AE057297"><enum>(4)</enum><text>Section 609(d)(1)
			 of the High Seas Driftnet Fishing Moratorium Protection Act (16 U.S.C.
			 1826j(d)(1)) is amended by striking <quote>of its fishing vessels</quote> each
			 place it appears.</text></paragraph><paragraph id="ID891582AF52DE49B8BED6AC259CF3FFE4"><enum>(5)</enum><text>Section 609(d)(2)
			 of the High Seas Driftnet Fishing Moratorium Protection Act (16 U.S.C.

			 unreported, or unregulated fishing</header><subsection id="ID9BF4EF78F94C4ED7A2FFD861B574B907"><enum>(a)</enum><header>Amendment of the
			 High Seas Driftnet Fishing Moratorium Protection Act</header><paragraph id="id6598391632E64C86B4F95C64BC7D8492"><enum>(1)</enum><text>Section 608 of the
			 High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826i">16 U.S.C. 1826i</external-xref>),
			 as amended by section 302(a) of this Act, is further amended by adding at the
			 end the following:</text><quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="ID01A0312FDC87493A91C7569D9CB393CD" reported-display-style="strikethrough" style="OLC"><subsection id="IDC64B66733F7949CCB9EE72BA665D116A"><enum>(c)</enum><header>Vessels and
				vessel owners engaged in illegal, unreported, or unregulated
				fishing</header><text>The Secretary may—</text><paragraph id="IDEBB2F7FE585A42A7AED2A899A195F485"><enum>(1)</enum><text>develop, maintain,
				and make public a list of vessels and vessel owners engaged in illegal,
				unreported, or unregulated fishing, including vessels or vessel owners
				identified by an international fishery management organization or arrangement
				made pursuant to an international fishery agreement, whether or not the United
				States is a party to such organization or arrangement;</text></paragraph><paragraph id="ID71DAE05C8BF6491AAF5286562E7C3A08"><enum>(2)</enum><text>take appropriate
				action against listed vessels and vessel owners, including action against fish,
				fish parts, or fish products from such vessels, in accordance with applicable
				United States law and consistent with applicable international law, including
				principles, rights, and obligations established in applicable international
				fishery management and trade agreements; and</text></paragraph><paragraph id="IDB5C2D50BC67D4E5CA80A1022B45DEC7E"><enum>(3)</enum><text>provide
				notification to the public of vessels and vessel owners identified by
				international fishery management organizations or arrangements made pursuant to
				an international fishery agreement as having been engaged in illegal,
				unreported, or unregulated fishing, as well as any measures adopted by such
				organizations or arrangements to address illegal, unreported, or unregulated
				fishing.</text></paragraph></subsection><subsection id="IDF2A7A5FBDF9D46F7AB86E79632794B74"><enum>(d)</enum><header>Restrictions on
				port access or use</header><text>Action taken by the Secretary under subsection
				(c)(2) that includes measures to restrict use of or access to ports or port
				services shall apply to all ports of the United States and its
				territories.</text></subsection><subsection id="IDC486E702F840400496C96BC2E2D3B4FE"><enum>(e)</enum><header>Regulations</header><text>The
				Secretary may promulgate regulations to implement subsections (c) and
				(d).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idCDA3FFBD4B42499DA67DDB17B496C942"><enum>(2)</enum><text>Section 609 of the
			 High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826j">16 U.S.C. 1826j</external-xref>) is
			 amended—</text><subparagraph id="id34E86FAEF51F4694B754D3E9241BE519"><enum>(A)</enum><text>in subsection
			 (d)(3)(A)(i), by striking <quote>that has not been certified by the Secretary
			 under this subsection, or</quote>; and</text></subparagraph><subparagraph id="id48127FAF4AAC4099A38C5ACC74BE151D"><enum>(B)</enum><text>in subsection
			 (e)(3)—</text><clause id="idB1EBE17622BE4120AC91F1BDAD3B6AB1"><enum>(i)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (B);</text></clause><clause id="idCECFC3108FF743AF8764D879E904D9F4"><enum>(ii)</enum><text>by striking
			 <quote>agreement.</quote> and inserting <quote>agreement; and</quote>;

				conducted in waters under the jurisdiction of a nation without permission of
				that nation; and</text></clause><clause id="id0D0C949E9B30406FB4224BE9B9CED271"><enum>(ii)</enum><text>fishing
				activities conducted in contravention of a nation's laws (including
				regulations), including fishing activity that has not been reported or that has
				been misreported to the relevant national authority of a nation in
				contravention of that nation's laws (including
				regulations).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="IDF7EB18509D734E8C9ACA1B9FC778E4BB"><enum>(3)</enum><text>Section 610(c)(5)
			 of the High Seas Driftnet Fishing Moratorium Protection Act (16 U.S.C.
			 1826k(c)(5)) is amended by striking <quote>that has not been certified by the
			 Secretary under this subsection, or</quote>.</text></paragraph></subsection><subsection id="ID4696BD5F04844D9B918E53C3F8559886"><enum>(b)</enum><header>Amendment of the
			 High Seas Driftnet Fisheries Enforcement Act</header><paragraph id="ID6BE827122B9C4B79BC4BCA5763F27B08"><enum>(1)</enum><text>Section 101 of the
			 High Seas Driftnet Fisheries Enforcement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826a">16 U.S.C. 1826a</external-xref>) is
			 amended—</text><subparagraph id="IDDDCF90A1801947BBB8DB72C5FD1FAC66"><enum>(A)</enum><text>in subsection (a),
			 by striking paragraph (2) and inserting the following:</text><quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="IDDDEB38E9DFB04C998CB58EF05A41A8B8" reported-display-style="strikethrough" style="OLC"><paragraph id="IDF44D0519DF6446A096A9C17EE3CF8E1B"><enum>(2)</enum><header>Denial of port
				privileges</header><text>The Secretary of the Treasury shall, in accordance
				with recognized principles of international law—</text><subparagraph id="IDB8D629A00D7241EDB0C337860CEC745F"><enum>(A)</enum><text>withhold or revoke
				the clearance required by
				section
				60105 of title 46, United States Code, for—</text><clause id="IDFB2B675111524812A5F3DEBC6E56653B"><enum>(i)</enum><text>any large-scale
				driftnet fishing vessel that is documented under the law of the United States
				or of a nation included on a list published under paragraph (1); or</text></clause><clause id="ID9BE944D732734A4398F1F19D3108F258"><enum>(ii)</enum><text>any fishing
				vessel of a nation that receives a negative certification under section 609(d)
				or 610(c) of the High Seas Driftnet Fishing Moratorium Protection Act (16
				U.S.C. 1826j(d) or 1826k(c)); and</text></clause></subparagraph><subparagraph id="ID54E3B7BC36E448FF9644C58065E789D7"><enum>(B)</enum><text>deny entry of that
				vessel to any place in the United States and to the navigable waters of the
				United States, except for the purpose of inspecting the vessel, conducting an
				investigation, or taking other appropriate enforcement
				action.</text></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block></subparagraph><subparagraph id="ID9DFFD4AF128E443ABD2566ED24F3F36F"><enum>(B)</enum><text>in subsection
			 (b)—</text><clause id="idF6B55A3296BA4619BC60F2D2BE4E7349"><enum>(i)</enum><text>by striking
			 <quote>or illegal, unreported, or unregulated fishing</quote> each place it
			 appears in paragraphs (1) and (2);</text></clause><clause id="idC16060A858774E8EAD277FB7994147F8"><enum>(ii)</enum><text>by striking
			 paragraph (3)(A) and inserting the following:</text><quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id1AB2E59C52814889800A5F4BDFB32B62" reported-display-style="strikethrough" style="OLC"><subparagraph id="idB86341F2C1D74A0CBACAA98167147C9A"><enum>(A)</enum><header>Prohibition</header><text>The
				President shall direct the Secretary of the Treasury to prohibit the
				importation into the United States of fish and fish products and sport fishing
				equipment (as that term is defined in section 4162 of the Internal Revenue Code
				of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/4162">26 U.S.C. 4162</external-xref>)) from a nation—</text><clause id="idF0CFBC06BDEE4D16B2135710ED3CE6A2"><enum>(i)</enum><text>upon receipt of
				notification of the identification of the nation under paragraph (1)(A);</text></clause><clause id="idFFE192C532D348BB916B5631F7C99954"><enum>(ii)</enum><text>if the
				consultations with the government of the nation under paragraph (2) are not
				satisfactorily concluded within ninety days; or</text></clause><clause id="id6707CF66B11146A9AA4E30F9D971E085"><enum>(iii)</enum><text>upon receipt of
				notification of a negative certification under section 609(d)(1) or 610(c)(1)
				of the High Seas Driftnet Fishing Moratorium Protection Act (16 U.S.C.
				1826j(d)(1) and
				1826k(c)(1)).</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="ID46A8F41A9A634B33B5F01B3091B31609"><enum>(iii)</enum><text>by inserting
			 <quote>or after issuing a negative certification under section 609(d)(1) or
			 610(c)(1) of the High Seas Driftnet Fishing Moratorium Protection Act
			 (16 U.S.C.
			 1826j(d)(1) and 1826k(c)(1)),</quote> after <quote>paragraph
			 (1),</quote> in paragraph (4)(A); and</text></clause><clause id="ID8CBD8B5CECF240F0B5B882DE24DCE9F3"><enum>(iv)</enum><text>by striking
			 paragraph (4)(A)(i) and inserting the following:</text><quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id16BC473F2507414896EF0A4476292D81" reported-display-style="strikethrough" style="OLC"><clause id="id17FEE99FDBBB4220BB648B94A66AD818"><enum>(i)</enum><text>any prohibition
				established under paragraph (3) is insufficient to cause that nation—</text><subclause id="id74C85019F9114FB6848EDBBDBD537C57"><enum>(I)</enum><text>to terminate
				large-scale driftnet fishing conducted by its nationals and vessels beyond the
				exclusive economic zone of any nation;</text></subclause><subclause id="idA67E944F38B042289B24CC966AB4E781"><enum>(II)</enum><text>to address
				illegal, unreported, or unregulated fishing activities for which a nation has
				been identified under section 609 of the High Seas Driftnet Fishing Moratorium
				Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826j">16 U.S.C. 1826j</external-xref>); or</text></subclause><subclause id="id932ED1CBD89141D7B732E81F1DE211E1"><enum>(III)</enum><text>to address
				bycatch of a protected living marine resource for which a nation has been
				identified under section 610 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826k">16 U.S.C. 1826k</external-xref>);
				or</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="ID484C2430AC814AC18C54FBBB35EF230C"><enum>(2)</enum><text>Section 102 of the
			 High Seas Driftnet Fisheries Enforcement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826b">16 U.S.C. 1826b</external-xref>) is amended by
			 striking <quote>such nation has terminated large-scale driftnet fishing or
			 illegal, unreported, or unregulated fishing by its nationals and vessels beyond
			 the exclusive economic zone of any nation.</quote> and
			 inserting</text><quoted-block changed="deleted" committee-id="SSCM00" display-inline="yes-display-inline" id="ID29F9ABD7D014434B812051548D1A5A7C" reported-display-style="strikethrough" style="OLC"><text>such
			 nation—</text><paragraph id="ID7656F3B55E584F7FA040D82C61F9A986"><enum>(1)</enum><text>has terminated
				large-scale driftnet fishing by its nationals and vessels beyond the exclusive
				economic zone of any nation;</text></paragraph><paragraph id="ID826ADCEC777F41FB9A7D2FDB985C8748"><enum>(2)</enum><text>has addressed
				illegal, unreported, or unregulated fishing activities for which a nation has
				been identified under section 609 of the High Seas Driftnet Fishing Moratorium
				Protection Act (16
				U.S.C. 1826j); or</text></paragraph><paragraph id="IDFD60F7CB88124CDE9BECF52AE9EE7137"><enum>(3)</enum><text>has addressed
				bycatch of a protected living marine resource for which a nation has been
				identified under section 610 of the High Seas Driftnet Fishing Moratorium
				Protection Act (16 U.S.C.
				1826k).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="ID1007D1B7F72642CA83A694CEEFA7AE12"><enum>104.</enum><header>Liability</header><text display-inline="no-display-inline">Any claims arising from the actions of any
			 officer, authorized by the Secretary of Commerce or the Secretary of the
			 department in which the Coast Guard is operating to enforce the provisions of
			 this Act or any Act to which this Act applies, taken pursuant to any scheme for
			 at-sea boarding and inspection authorized under any international agreement to
			 which the United States is a party may be pursued under
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28,
			 United States Code, or such other legal authority as may be pertinent.</text></section></title><title changed="deleted" committee-id="SSCM00" id="IDD14C562C39484FE0A7266245A1FCEABE" reported-display-style="strikethrough"><enum>II</enum><header>Law enforcement
			 and international operations</header><section id="ID419441C89B064E57BB985D1D6E20D972"><enum>201.</enum><header>International
			 fisheries enforcement</header><subsection id="IDE8E22371FAC84BA8ABEE8DAEDA27EA69"><enum>(a)</enum><header>Establishment of
			 international fisheries enforcement task force</header><paragraph id="idB9B373B3038F472B98FA7E19D840DFFC"><enum>(1)</enum><header>In
			 general</header><text>Not later than 12 months after the date of enactment of
			 this Act, the Secretary of Commerce shall establish, through the National
			 Marine Fisheries Service's international enforcement program, an interagency
			 International Fisheries Enforcement Task Force.</text></paragraph><paragraph id="id7D36DB51DD1344019BE619F45481E8E7"><enum>(2)</enum><header>Purposes</header><text>The
			 purposes of the task force shall be—</text><subparagraph id="idDF60A6CD9EAD4BE296D6086E8350C359"><enum>(A)</enum><text>to detect and
			 investigate illegal, unreported, or unregulated fishing activity and
			 trafficking in the resulting fish or fish product; and</text></subparagraph><subparagraph id="idAB1B990028E04F53889611B7ACE10098"><enum>(B)</enum><text>to enforce the
			 provisions of this Act or any Act to which section 101 applies.</text></subparagraph></paragraph><paragraph id="idC8D1AFEE335B40A48DA7B8CC1D7A9C48"><enum>(3)</enum><header>Membership</header><text>The
			 task force shall include permanent representation from—</text><subparagraph id="idC6281A698E334F8CB2EC8C3920B3410A"><enum>(A)</enum><text>the National
			 Marine Fisheries Service's international enforcement program;</text></subparagraph><subparagraph id="id556A29F43C6E4336AC4B3B421D58618D"><enum>(B)</enum><text>the U.S. Coast
			 Guard;</text></subparagraph><subparagraph id="idBD95A2F6D9484BFB887E9B9A9B41B7C4"><enum>(C)</enum><text>U.S. Customs and
			 Border Protection;</text></subparagraph><subparagraph id="id97086EA6CFD7423DA69552097FFF2E89"><enum>(D)</enum><text>the U.S. Food and
			 Drug Administration; and</text></subparagraph><subparagraph id="idC80FBD9B9D38415AA8A834CED15609C2"><enum>(E)</enum><text>such other Federal
			 agencies as the Secretary considers appropriate and necessary to carry out the
			 purposes under paragraph (2).</text></subparagraph></paragraph></subsection><subsection id="IDD6E07D45FFFE4D10A25487097298B3C0"><enum>(b)</enum><header>Task force
			 organization</header><paragraph id="ID10DB500855764CD0BA1BA7807E8322A3"><enum>(1)</enum><header>Staffing and
			 other resources</header><text>The Secretary of Commerce and the head of each
			 department and agency identified under subsection (a)(3) shall—</text><subparagraph id="idA7EFB06DE33449F897E8D6D289AB492C"><enum>(A)</enum><text>by agreement, on a
			 reimbursable basis or otherwise, provide permanent representation to the task
			 force;</text></subparagraph><subparagraph id="idCA852BF6A3DD4A73A1AED4D0E2FAF26D"><enum>(B)</enum><text>by agreement, on a
			 reimbursable basis or otherwise, share personnel, services, equipment
			 (including aircraft and vessels), and facilities with the task force for the
			 purposes under subsection (a)(2); and</text></subparagraph><subparagraph id="id9964A7A0F2F94502816F623C4CA40B6B"><enum>(C)</enum><text>to the extent
			 possible, and consistent with other applicable law, extend the authorities
			 provided under their enabling legislation to the other departments and agencies
			 participating in the task force.</text></subparagraph></paragraph><paragraph id="ID1FD4233BD70340908A80A71D37067F8F"><enum>(2)</enum><header>Budget</header><text>The
			 Secretary of Commerce and the head of each department and agency providing
			 personnel for the task force, at their discretion, may develop interagency
			 plans and budgets and engage in interagency financing for such purposes.</text></paragraph><paragraph id="ID565B68590E3947B6853AD7C7520A6EA1"><enum>(3)</enum><header>5-year strategic
			 plan</header><text>Not later than 180 days after the date on which the task
			 force is established under subsection (a), the Secretary of Commerce shall
			 develop a 5-year strategic plan for guiding interagency and intergovernmental
			 international fisheries enforcement efforts to carry out the provisions of this
			 Act. The Secretary shall update the plan periodically as necessary, but at
			 least once every 5 years.</text></paragraph><paragraph id="ID9D52F0252563449894F272484860BD5C"><enum>(4)</enum><header>Cooperative
			 activities</header><text>The Secretary, in coordination with the head of each
			 department and agency providing personnel for the task force—</text><subparagraph id="id1BADFFF0CC724F3DBCC27489843CAF15"><enum>(A)</enum><text>may conduct one or
			 more joint operations for the purposes under subsection (a)(2);</text></subparagraph><subparagraph id="id27F2B647F2014DA295CE0ED8D25EFB91"><enum>(B)</enum><text>shall, to the
			 maximum extent permissible under law, create and participate in committees or
			 other working groups with other Federal, State, or local governments, and with
			 the governments of other nations for the purposes under subsection
			 (a)(2);</text></subparagraph><subparagraph id="idDA48F4E58E054742B99A68695DAEBB82"><enum>(C)</enum><text>may enter into
			 agreements with other Federal, State, or local governments, and with the
			 governments of other nations, on a reimbursable basis or otherwise, for the
			 purposes under subsection (a)(2).</text></subparagraph></paragraph></subsection><subsection id="ID44B53C45D2E44DE3B0787A5D9AB8CB65"><enum>(c)</enum><header>Powers of
			 authorized officers</header><text>Notwithstanding any other provision of law,
			 while operating under an agreement with the Secretary of Commerce entered into
			 under section 101, or while conducting a joint operation under subsection
			 (b)(4) of this section, each authorized officer shall have the powers and
			 authority provided in section 101.</text></subsection></section><section id="IDB1D9516757364D81A1F665A372108EA2"><enum>202.</enum><header>International
			 cooperation and assistance</header><subsection id="ID7B997309C1B244C997365D5D50818AE3"><enum>(a)</enum><header>International
			 cooperation and assistance</header><text>The Secretary of Commerce may provide
			 international cooperation and assistance for international capacity building
			 efforts.</text></subsection><subsection id="IDC06EA4752826465E9943A42E2648D78B"><enum>(b)</enum><header>Authorized
			 activities</header><text>In carrying out this section, the Secretary
			 may—</text><paragraph id="ID2AC708C6035948238EA2C196CA921456"><enum>(1)</enum><text>provide technical
			 expertise to other nations to assist them in addressing illegal, unreported, or
			 unregulated fishing activities;</text></paragraph><paragraph id="ID809FEBA35E5A47BFAFD2A5CF83EE09CE"><enum>(2)</enum><text>provide technical
			 expertise to other nations to assist them in reducing the loss and
			 environmental impacts of derelict fishing gears, reducing the bycatch of living
			 marine resources, and promoting international marine resource
			 conservation;</text></paragraph><paragraph id="ID6020D0F6D32546DD84C818DFEEF4976D"><enum>(3)</enum><text>provide technical
			 expertise, and training, in cooperation with the International Fisheries
			 Enforcement Task Force under section 201 of this Act, to other nations to aid
			 them in building capacity for enhanced fisheries management, fisheries
			 monitoring, catch and trade tracking activities, enforcement, and international
			 marine resource conservation;</text></paragraph><paragraph id="ID19E754F7F08343CDBB1A2E054EC65193"><enum>(4)</enum><text>establish
			 partnerships with other Federal agencies, as appropriate, to ensure that
			 fisheries development assistance to other nations is directed toward efforts
			 that promote sustainable fisheries; and</text></paragraph><paragraph id="IDA4573D23A8514F708249B66D2A2B00A4"><enum>(5)</enum><text>conduct outreach
			 and education efforts in order to promote public and private sector awareness
			 of international fisheries sustainability issues, including the need to combat
			 illegal, unreported, or unregulated fishing activity and to promote
			 international marine resource conservation.</text></paragraph></subsection><subsection id="ID38D284D514C6428A9CAC14736E27AF60"><enum>(c)</enum><header>Guidelines</header><text>The
			 Secretary may establish guidelines as necessary to implement this

				Commissioners may be appointed who reside in a State other than a State whose
				vessels maintain a substantial fishery in the area of the Convention.</text></subsection><subsection id="ID638D22DD929F4771840D878095BDB81D"><enum>(b)</enum><header>Alternate United
				States commissioners</header><text>The Secretary of State, in consultation with
				the Secretary, may designate from time to time and for periods of time deemed
				appropriate Alternate United States Commissioners to the Commission. Any
				Alternate United States Commissioner may exercise, at any meeting of the
				Commission or of the General Advisory Committee or Scientific Advisory
				Subcommittee established pursuant to section 4(b), all powers and duties of a
				United States Commissioner in the absence of any Commissioner appointed
				pursuant to subsection (a) of this section for whatever reason. The number of
				such Alternate United States Commissioners that may be designated for any such
				meeting shall be limited to the number of United States Commissioners appointed
				pursuant to subsection (a) of this section who will not be present at such
				meeting.</text></subsection><subsection id="IDA214248628ED4496848AF15C9CDCBE4F"><enum>(c)</enum><header>Administrative
				matters</header><paragraph id="IDDB93DEE80AB34DDEAF94C696A730C0AB"><enum>(1)</enum><header>Employment
				status</header><text>Individuals serving as such Commissioners, other than
				officers or employees of the United States Government, shall not be considered
				Federal employees except for the purposes of injury compensation or tort claims
				liability as provided in
				chapter
				81 of title 5, United States Code, and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28,
				United States Code.</text></paragraph><paragraph id="IDF0C548180CE54D1DA8047532BFCD54F8"><enum>(2)</enum><header>Compensation</header><text>The
				United States Commissioners or Alternate United States Commissioners, although
				officers of the United States while so serving, shall receive no compensation
				for their services as such United States Commissioners or Alternate United

				through 5708, and 5731 of title 5, United States Code.</text></subparagraph><subparagraph id="IDAFBCBE28E91743F499A5250636CC9A75"><enum>(B)</enum><text>The Secretary may
				reimburse the Secretary of State for amounts expended by the Secretary of State
				under this

				members</header><text>The chair of the Pacific Fishery Management Council's
				Advisory Subpanel for Highly Migratory Fisheries and the chair of the Western
				Pacific Fishery Management Council's Advisory Committee shall be members of the
				General Advisory Committee by virtue of their positions in those
				Councils.</text></subparagraph><subparagraph id="ID31F19242D74E4C8EB415AD9C88E3FEE6"><enum>(C)</enum><header>Terms</header><text>Each
				member of the General Advisory Committee appointed under subparagraph (A) shall
				serve for a term of 3 years and shall be eligible for reappointment.</text></subparagraph><subparagraph id="IDC683F48791454EB09F1B9AB4BCF397F8"><enum>(D)</enum><header>Non-executive
				meetings of the United States Section</header><text>The General Advisory
				Committee shall be invited to attend all non-executive meetings of the United
				States Section and at such meetings shall be given opportunity to examine and
				to be heard on all proposed programs of investigation, reports,
				recommendations, and regulations of the Commission.</text></subparagraph><subparagraph id="ID5D2374352B3646B6B60465E591FD5BA2"><enum>(E)</enum><header>Public
				participation</header><text>The General Advisory Committee shall determine its
				organization, and prescribe its practices and procedures for carrying out its
				functions under this chapter, the Magnuson-Stevens Fishery Conservation and
				Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801 et seq.</external-xref>), and the Convention. The General
				Advisory Committee shall publish and make available to the public a statement
				of its organization, practices and procedures. Meetings of the General Advisory
				Committee, except when in executive session, shall be open to the public, and
				prior notice of meetings shall be made public in timely fashion. The General
				Advisory Committee shall not be subject to the <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C.
				App.).</text></subparagraph></paragraph><paragraph id="IDF4CD9DCD5FCA489CB5CDB84DB7CAAF16"><enum>(2)</enum><header>Information
				sharing</header><text>The Secretary and the Secretary of State shall furnish
				the General Advisory Committee with relevant information concerning fisheries
				and international fishery agreements.</text></paragraph><paragraph id="ID4EAE1F28F42D4A80B92D3B43BC26E332"><enum>(3)</enum><header>Administrative
				matters</header><subparagraph id="IDBD318CFD5D0A408C958C82ED0D00C415"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall provide to the General Advisory
				Committee in a timely manner such administrative and technical support services
				as are necessary for its effective functioning.</text></subparagraph><subparagraph id="ID9BA25BF26B204147B2738C05E062073C"><enum>(B)</enum><header>Compensation</header><text>An
				individual appointed to serve as a member of the General Advisory
				Committee—</text><clause id="ID1FEBAB4ACA9C4C9EA7D07A5C25C56547"><enum>(i)</enum><text>shall serve
				without pay, but while away from home or regular place of business to attend
				meetings of the General Advisory Committee shall be allowed travel expenses,
				including per diem in lieu of subsistence, in the same manner as a person
				employed intermittently in the Government service is allowed expenses under
				section
				5703 of title 5, United States Code; and</text></clause><clause id="ID845909B37123478DBCD70E36AFE33DBF"><enum>(ii)</enum><text>shall not be
				considered a Federal employee except for the purposes of injury compensation or
				tort claims liability as provided in
				chapter
				81 of title 5, United States Code, and
				<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28,
				United States Code.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>;

				permit any officer authorized to enforce the provisions of this Act (as
				provided for in section 10) to board a fishing vessel subject to such person's

				in connection with the enforcement of this Act or any regulation, permit, or
				the Convention;</text></paragraph><paragraph id="ID9232980F4251454388CA38DF99EBE227"><enum>(4)</enum><text>to forcibly
				assault, resist, oppose, impede, intimidate, sexually harass, bribe, or
				interfere with any such authorized officer in the conduct of any search,
				investigations or inspection in connection with the enforcement of this Act or
				any regulation, permit, or the Convention;</text></paragraph><paragraph id="IDA40824952CFD4A1B863033A1F1B04523"><enum>(5)</enum><text>to resist a lawful
				arrest for any act prohibited by this Act;</text></paragraph><paragraph id="IDF86BBAAD568D43E6ADD6643ED8212F2C"><enum>(6)</enum><text>to ship,
				transport, offer for sale, sell, purchase, import, export, or have custody,
				control, or possession of, any fish taken or retained in violation of this Act
				or any regulation, permit, or agreement referred to in paragraph (1) or
				(2);</text></paragraph><paragraph id="ID5B38B35E732C4B34BF5BF63FF2DFB7F1"><enum>(7)</enum><text>to interfere with,
				delay, or prevent, by any means, the apprehension or arrest of another person,
				knowing that such other person has committed any act prohibited by this
				section;</text></paragraph><paragraph id="ID3B09972531CA44C7975096E89810DE58"><enum>(8)</enum><text>to knowingly and
				willfully submit to the Secretary false information regarding any matter that
				the Secretary is considering in the course of carrying out this Act;</text></paragraph><paragraph id="ID81261ECBEAF24C51A80ACF03F6F2A024"><enum>(9)</enum><text>to forcibly
				assault, resist, oppose, impede, intimidate, sexually harass, bribe, or
				interfere with any observer on a vessel under this Act, or any data collector
				employed by the National Marine Fisheries Service or under contract to any
				person to carry out responsibilities under this Act;</text></paragraph><paragraph id="ID3B7E8321376E41B196D2F9EB10F17419"><enum>(10)</enum><text>to engage in
				fishing in violation of any regulation adopted pursuant to section 6 of this
				Act;</text></paragraph><paragraph id="ID6CF02544B2A94983AFB598F49D0B2B95"><enum>(11)</enum><text>to ship,
				transport, purchase, sell, offer for sale, import, export, or have in custody,
				possession, or control any fish taken or retained in violation of such
				regulations;</text></paragraph><paragraph id="IDCC28708F0D294E7AA376F34C8AB7DEB0"><enum>(12)</enum><text>to fail to make,
				keep, or furnish any catch returns, statistical records, or other reports as
				are required by regulations adopted pursuant to this Act to be made, kept, or
				furnished;</text></paragraph><paragraph id="IDE5E8E2144DBB4F6CB0CD7317E350FD93"><enum>(13)</enum><text>to fail to stop a
				vessel upon being hailed and instructed to stop by a duly authorized official
				of the United States; or</text></paragraph><paragraph id="IDF10281618DF74CC89907B91E992CB370"><enum>(14)</enum><text>to import, in
				violation of any regulation adopted pursuant to section 6 of this Act, any fish
				in any form of those species subject to regulation pursuant to a
				recommendation, resolution, or decision of the Commission, or any tuna in any
				form not under regulation but under investigation by the Commission, during the
				period such fish have been denied entry in accordance with the provisions of
				section 6 of this Act, unless such person provides such proof as the Secretary
				of Commerce may require that a fish described in this paragraph offered for
				entry into the United States is not ineligible for such entry under the terms
				of section 6 of this

			 sections of the Magnuson-Stevens Fishery Conservation and Management Act under
			 subsection (b), if there is a conflict between a provision of this subsection
			 and the corresponding provision of any section of the Magnuson-Stevens Fishery
			 Conservation and Management Act so incorporated, the provision of this
			 subsection shall apply.</text></paragraph><paragraph id="idca1bde35-75cd-49ee-b7cb-874569346376"><enum>(2)</enum><header>Additional enforcement
			 authority</header><text>In addition to the powers of officers authorized
			 pursuant to subsection (b), any officer who is authorized by the Secretary, or
			 the head of any Federal or State agency that has entered into an agreement with
			 the Secretary under subsection (a) to enforce the provisions of any Act to
			 which this section applies may, with the same jurisdiction, powers, and duties
			 as though section 311 of the Magnuson-Stevens Fishery Conservation and
			 Management Act (16
			 U.S.C. 1861) were incorporated into and made a part of each
			 such Act—</text><subparagraph id="id9e3ed316-43da-4b69-9a82-765a526b521b"><enum>(A)</enum><text>search or inspect any
			 facility or conveyance used or employed in, or which reasonably appears to be
			 used or employed in, the storage, processing, transport, or trade of fish or
			 fish products;</text></subparagraph><subparagraph id="id67f9a9b1-5d2f-490f-af18-1ebb0c88a66e"><enum>(B)</enum><text>inspect records
			 pertaining to the storage, processing, transport, or trade of fish or fish
			 products;</text></subparagraph><subparagraph id="idfb46703f-8964-4df8-a14d-26fde5cf4f8e"><enum>(C)</enum><text>detain, for a period of
			 up to 14 days, any shipment of fish or fish product imported into, landed on,
			 introduced into, exported from, or transported within the jurisdiction of the
			 United States, or, if such fish or fish product is deemed to be perishable,
			 sell and retain the proceeds therefrom for a period of up to 14 days;</text></subparagraph><subparagraph commented="no" id="idacf21a22-5dec-4cbf-b6ad-9f6981a9b1d1"><enum>(D)</enum><text>carry firearms and make
			 an arrest, in accordance with any guidelines which may be issued by the
			 Attorney General, for any offense under the laws of the United States committed
			 in the officer's presence, or for the commission of any felony under the laws
			 of the United States, if the officer has reasonable grounds to believe that the
			 person to be arrested has committed or is committing a felony;</text></subparagraph><subparagraph commented="no" id="ided2762cf-210a-4ee9-956f-416c1098ffe3"><enum>(E)</enum><text>search and seize, in
			 accordance with any guidelines which may be issued by the Attorney General;
			 and</text></subparagraph><subparagraph commented="no" id="idea53781f-17c1-4154-bb5d-e16d12cdb733"><enum>(F)</enum><text>execute and serve any
			 subpoena, arrest warrant, search warrant issued in accordance with rule 41 of
			 the Federal Rules of Criminal Procedure, or other warrant or civil or criminal
			 process issued by any officer or court of competent jurisdiction.</text></subparagraph></paragraph><paragraph commented="no" id="idCBBA99552F2B42ABB35A7C5C09C8CF10"><enum>(3)</enum><header>Northern Pacific
			 Halibut Act of 1982</header><text>Notwithstanding the provisions of subsection
			 (b)—</text><subparagraph commented="no" id="id100C61C140C44BF3A341AC6D066D8AF6"><enum>(A)</enum><text>any person who is found
			 by the Secretary, after notice and opportunity for a hearing in accordance with
			 <external-xref legal-doc="usc" parsable-cite="usc/5/554">section 554</external-xref> of title 5, United States Code, to have committed an act prohibited
			 under section 7 of the Northern Pacific Halibut Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/16/773e">16 U.S.C. 773e</external-xref>)
			 shall be liable to the United States for a civil penalty under section 8 of
			 that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/773f">16 U.S.C. 773f</external-xref>);</text></subparagraph><subparagraph commented="no" id="id95D12FD388DB4901ADC6D017A2E2C3F4"><enum>(B)</enum><text>any act prohibited under
			 subparagraphs (B), (C), (D), or (F) of section 7(1) or section 7(2) of the
			 Northern Pacific Halibut Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/16/773e">16 U.S.C. 773e</external-xref>) is punishable under
			 section 9 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/773g">16 U.S.C. 773g</external-xref>); and</text></subparagraph><subparagraph commented="no" id="id21E092D67A09400E9644FBC7C7826A79"><enum>(C)</enum><text>the Secretary, in
			 cooperation with such other agencies as may be appropriate, may conduct or
			 cause to be conducted investigations in accordance with section 11(d) of the
			 Northern Pacific Halibut Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/16/773i">16 U.S.C. 773i(d)</external-xref>) as are deemed
			 necessary to carry out the purposes of the Northern Pacific Halibut Act of 1982
			 (<external-xref legal-doc="usc" parsable-cite="usc/16/773">16 U.S.C. 773 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="ida9d329dd-5afc-43af-a095-f1384b29e063"><enum>(4)</enum><header>Information collection,
			 maintenance and use</header><subparagraph id="id1558edac-aabd-4e6e-8cc8-20a05eb05c26"><enum>(A)</enum><header>In
			 general</header><text>The Secretary of Commerce and the head of each department
			 and agency providing personnel for the task force under section 201, to the
			 maximum extent permissible under law, shall share all applicable information,
			 intelligence, and data, related to the harvest, transportation, or trade of
			 fish and fish product for the purposes under section 201(a)(2).</text></subparagraph><subparagraph id="idfc6f6788-1f09-4b10-926a-03a3cf88f3da"><enum>(B)</enum><header>Coordination of
			 data</header><text>The Secretary of Commerce, through the task force under
			 section 201, shall coordinate the collection, storage, analysis, and
			 dissemination of all applicable information, intelligence, and data related to
			 the harvest, transportation, or trade of fish and fish product collected or
			 maintained by a member agency of the task force.</text></subparagraph><subparagraph id="idefd3f757-9ab7-417d-a46f-aef2ee43018e"><enum>(C)</enum><header>Confidentiality</header><text>The
			 Secretary of Commerce, through the task force under section 201, shall ensure
			 the protection and confidentiality required by law for information,
			 intelligence, and data related to the harvest, transportation, or trade of fish
			 and fish product obtained by the task force.</text></subparagraph><subparagraph id="id73d26a2b-dac0-4e91-8ef2-60ac0a052ada"><enum>(D)</enum><header>Data
			 standardization</header><text>The Secretary of Commerce and the head of each
			 department and agency providing personnel for the task force, to the maximum
			 extent practicable, shall develop data standardization for fisheries related
			 data for each member agency of the task force under section 201 and with
			 international fisheries enforcement databases as appropriate.</text></subparagraph><subparagraph id="ida505f947-d74a-44dd-ad29-5ccb4e04b40f"><enum>(E)</enum><header>Assistance from
			 intelligence community</header><text>Upon request of the Secretary of Commerce,
			 elements of the intelligence community (as defined in section 3(4) of the
			 National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>)) shall collect
			 information related to illegal, unreported, or unregulated fishing activity
			 outside the United States about individuals who are not United States persons
			 (as defined in section 105A(c)(2) of such Act (50 U.S.C. 403–5a(c)(2))). Such
			 elements of the intelligence community shall collect and share such information
			 with the Secretary through the task force under section 201 of this Act for law
			 enforcement purposes in order to detect and investigate illegal, unreported, or
			 unregulated fishing activities and to carry out the provisions of this Act. All
			 collection and sharing of information shall be in accordance with the National
			 Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401">50 U.S.C. 401 et seq.</external-xref>).</text></subparagraph><subparagraph id="id5de63563-39c8-4cb4-8785-378186d22ee5"><enum>(F)</enum><header>Information
			 sharing</header><clause id="id65e0718a-30d8-4bf0-a1cf-8d14d9f92f45"><enum>(i)</enum><header>In
			 general</header><text>Subject to clause (ii), the Secretary of Commerce,
			 through the task force under section 201, shall have authority to share
			 fisheries-related data with—</text><subclause id="id7b33accd-bcfb-474c-9a98-3f9f6c5cd6aa"><enum>(I)</enum><text>other Federal or State
			 government agencies;</text></subclause><subclause id="idff108300-468f-444c-b2f0-b997915d762f"><enum>(II)</enum><text>foreign
			 governments;</text></subclause><subclause id="id30131007-2754-475a-9eaa-c7f42ce4739b"><enum>(III)</enum><text>the Food and
			 Agriculture Organization formed at Quebec, Canada, on October 16, 1945;
			 or</text></subclause><subclause id="idfcbde565-64d2-4400-b3b1-7b14112600cb"><enum>(IV)</enum><text>the secretariat or
			 equivalent of an international fisheries management organization or arrangement
			 made pursuant to an international fishery agreement.</text></subclause></clause><clause id="id87f0f849-8ecb-4ef7-bfc8-a6aa49a975a3"><enum>(ii)</enum><header>Limitations</header><text>An
			 entity listed under clause (i) may receive data under this subparagraph
			 if—</text><subclause id="id8a3e1726-658d-4362-8eb0-aa1cbace3950"><enum>(I)</enum><text>the entity has policies
			 and procedures to safeguard such data from unintended or unauthorized
			 disclosure; and</text></subclause><subclause id="id40dfddc1-12e8-4dd2-8f9d-b0dcfe1c31ac"><enum>(II)</enum><text>the exchange of
			 information is necessary—</text><item id="id8b8b91ec-4cfc-4107-ae7b-95e41db6f12c"><enum>(aa)</enum><text>to ensure compliance
			 with any law (including regulations) enforced or administered by the Secretary
			 of Commerce;</text></item><item id="iddf289dd9-6e6a-43aa-a2b2-cdafbb8b0d93"><enum>(bb)</enum><text>to administer or enforce
			 treaties to which the United States is a party;</text></item><item id="id874b93d4-768b-4b58-bdc0-f8240bfa668d"><enum>(cc)</enum><text>to administer or enforce
			 binding conservation measures adopted by any international organization or
			 arrangement to which the United States is a party;</text></item><item id="id802f3cab-0523-4dab-863e-3f345d854330"><enum>(dd)</enum><text>to assist in
			 investigative, judicial, or administrative enforcement proceedings in the
			 United States; or</text></item><item id="id1e4e3093-1e13-4c21-9868-1aeee72e8506"><enum>(ee)</enum><text>to assist in any
			 fisheries or living marine resource related law enforcement action undertaken
			 by a law enforcement agency of a foreign government, or in relation to a legal
			 proceeding undertaken by a foreign government.</text></item></subclause></clause></subparagraph></paragraph></subsection><subsection id="id4c00a540-6aad-48e5-9303-16207e14e6b2"><enum>(d)</enum><header>District court
			 jurisdiction</header><text>The several district courts of the United States
			 shall have jurisdiction over any actions arising under this section. For the
			 purpose of this section, American Samoa shall be included within the judicial
			 district of the District Court of the United States for the District of Hawaii.
			 Each violation shall be a separate offense and the offense shall be deemed to
			 have been committed not only in the district where the violation first
			 occurred, but also in any other district as authorized by law. Any offenses not
			 committed in any district are subject to the venue provisions of section 3238
			 of title 18, United States Code.</text></subsection><subsection id="idf4788675-55ca-4c1a-954e-cbf7eb39d1b2"><enum>(e)</enum><header>Prohibited
			 acts</header><text>For purposes of this section and each Act to which this
			 section applies, it is unlawful for any person—</text><paragraph id="id1ca23a2c-4e66-4087-9208-13d24804bc01"><enum>(1)</enum><text>to violate any provision
			 of this section or any Act to which this section applies or any regulation
			 promulgated thereunder;</text></paragraph><paragraph id="id1b0ca971-652b-4884-934d-ce6b68f7081a"><enum>(2)</enum><text>to refuse to permit any
			 authorized enforcement officer to board, search, or inspect a vessel,
			 conveyance, or shoreside facility that is subject to the person's control for
			 purposes of conducting any search, investigation, or inspection in connection
			 with the enforcement of this section or any Act to which this section applies
			 or any regulation promulgated thereunder;</text></paragraph><paragraph id="idd0082d22-0e93-4dd1-901f-e434280acaf6"><enum>(3)</enum><text>to forcibly assault,
			 resist, oppose, impede, intimidate, or interfere with any such authorized
			 officer in the conduct of any search, investigation, or inspection described in
			 paragraph (2);</text></paragraph><paragraph id="id49e9f23c-3feb-4714-bd2c-189442fa31f7"><enum>(4)</enum><text>to resist a lawful arrest
			 for any act prohibited by this section or any Act to which this section
			 applies;</text></paragraph><paragraph id="ida9e22cf5-940a-484d-bd37-ee44b6989a56"><enum>(5)</enum><text>to interfere with, delay,
			 or prevent, by any means, the apprehension, arrest, or detection of another
			 person, knowing that such person has committed any act prohibited by this
			 section or any Act to which this section applies;</text></paragraph><paragraph id="idd81c60d8-154a-44a1-9bbb-19d3f33e2f2f"><enum>(6)</enum><text>to forcibly assault,
			 resist, oppose, impede, intimidate, sexually harass, bribe, or interfere with
			 any observer on a vessel under this section or any Act to which this section
			 applies, or any data collector employed by or under contract to the National
			 Marine Fisheries Service to carry out responsibilities under this section or
			 any Act to which this section applies;</text></paragraph><paragraph id="id690f9233-5b19-4ffd-ad28-bca0a40b03c0"><enum>(7)</enum><text>to import, export,
			 transport, sell, receive, acquire, or purchase in interstate or foreign
			 commerce any fish or fish product taken, possessed, transported, or sold in
			 violation of any treaty or binding conservation measure adopted pursuant to an
			 international agreement or organization to which the United States is a party;
			 or</text></paragraph><paragraph id="idcb6de7b1-583c-420f-9c06-ce348c156d6a"><enum>(8)</enum><text>to make or submit any
			 false record, account, or label for, or any false identification of, any fish
			 or fish product (including false identification of the species, harvesting
			 vessel or nation, or the location where harvested) which has been, or is
			 intended to be imported, exported, transported, sold, offered for sale,
			 purchased, or received in interstate or foreign commerce.</text></paragraph></subsection><subsection id="id1da1ac1a-6a92-473f-9167-bda5b16bb05d"><enum>(f)</enum><header>Regulations</header><text>The
			 Secretary of Commerce may promulgate such regulations, in accordance with
			 <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code, as may be necessary to carry out
			 this section or any Act to which this section applies.</text></subsection></section><section id="id2c16e9c1-d9ab-4986-b3e1-18e1cff519c9"><enum>102.</enum><header>Conforming, minor, and
			 technical amendments</header><subsection id="idac080e8c-831f-4b33-9e3e-420cce8c5da6"><enum>(a)</enum><header>High Seas Driftnet
			 Fishing Moratorium Protection Act</header><paragraph id="id71db0407-0d8e-46a2-9b31-9ecc99a5a2ef"><enum>(1)</enum><text>Section 606 of the High
			 Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826g">16 U.S.C. 1826g</external-xref>) is
			 amended—</text><subparagraph id="id8e4fa7dc-0d10-47fa-8680-015fe4676bea"><enum>(A)</enum><text>by inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">Detecting, Monitoring, and
			 Preventing Violations</header-in-text>.—</quote> before <quote>The
			 President</quote>; and</text></subparagraph><subparagraph id="idc4d6fa1a-bbde-4b02-85cf-e26c7b1bb91e"><enum>(B)</enum><text>by adding at the end the

				Enforcement
				Act</short-title>.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="id75C6919587534362A0CB18C0A75C7717"><enum>(2)</enum><text>Section 607 of the High
			 Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826h">16 U.S.C. 1826h</external-xref>) is amended by
			 inserting <quote>not later than June 1</quote> after <quote>2006,
			 and</quote>.</text></paragraph><paragraph id="id0ec681ea-73c8-4b30-8927-b4e19d2b5436"><enum>(3)</enum><text>Section 607(2) of the
			 High Seas Driftnet Fishing Moratorium Protection Act (16 U.S.C.
			 1826h(2)) is amended by striking <quote>whose vessels</quote>
			 and inserting <quote>that</quote>.</text></paragraph><paragraph id="idfecc6225-b63a-4e74-a57f-783a9b275947"><enum>(4)</enum><text>Section 609(a) of the
			 High Seas Driftnet Fishing Moratorium Protection Act (16 U.S.C.
			 1826j(a)) is amended to read as follows:</text><quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id3124346e-9ea5-41bf-9fb7-8d99ccf2c4b3" reported-display-style="italic" style="OLC"><subsection id="idf94083b4-8052-416e-86a9-4b1a035e1334"><enum>(a)</enum><header>Identification</header><paragraph id="id6ca5a5b5-209b-4062-a887-aaf75989ab74"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall identify, and list in the report
				under section 607, a nation if that nation is engaged, or has been engaged at
				any time during the preceding 3 years, in illegal, unreported, or unregulated
				fishing and—</text><subparagraph id="id842d3999-01f0-4b26-8bf0-bf75809d49bf"><enum>(A)</enum><text>such fishing undermines
				the effectiveness of measures required under the relevant international fishery
				management organization;</text></subparagraph><subparagraph id="id129c3171-15e0-473d-966b-db92f8de526b"><enum>(B)</enum><text>the relevant
				international fishery management organization has failed to implement effective
				measures to end the illegal, unreported, or unregulated fishing activity by
				vessels of that nation, or the nation is not a party to, or does not maintain
				cooperating status with, such organization; or</text></subparagraph><subparagraph id="id00b72477-6717-4299-99c0-58f0a41b3270"><enum>(C)</enum><text>there is no international
				fishery management organization with a mandate to regulate the fishing activity
				in question.</text></subparagraph></paragraph><paragraph id="id70bf73d0-5ccd-4aa2-b58f-d3d7f3fa38f6"><enum>(2)</enum><header>Other identifying
				activities</header><text>The Secretary shall also identify, and list in the
				report under section 607, a nation if—</text><subparagraph id="id1937f91a-2d1e-462e-96bf-3e5bfc93de64"><enum>(A)</enum><text>it is violating, or has
				violated at any time during the preceding 3 years, conservation and management
				measures required under an international fishery management agreement to which
				the United States is a party and the violations undermine the effectiveness of
				such measures, taking into account the factors described in paragraph (1);
				or</text></subparagraph><subparagraph id="id05d50fdc-cbe1-4264-bce1-410294ff0f64"><enum>(B)</enum><text>it is failing, or has
				failed at any time during the preceding 3 years, to effectively address or
				regulate illegal, unreported, or unregulated fishing.</text></subparagraph></paragraph><paragraph id="id62452c1c-39c5-49eb-bda5-3a1b06d24723"><enum>(3)</enum><header>Treatment of certain
				entities as if they were nations</header><text>Where the provisions of this Act
				apply to the act, or failure to act, of a nation, they shall also be
				applicable, as appropriate, to any other entity that is competent to enter into
				an international fishery management
				agreement.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idf23555ff-bb39-4f35-84b0-a2ef8cc32e77"><enum>(5)</enum><text>Section 609(d)(1) of the
			 High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826j">16 U.S.C. 1826j(d)(1)</external-xref>) is
			 amended by striking <quote>of its fishing vessels</quote> each place it
			 appears.</text></paragraph><paragraph id="idf903dcfe-5307-4f9b-8a4b-3f908003f35d"><enum>(6)</enum><text>Section 609(d)(2) of the
			 High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826j">16 U.S.C. 1826j(d)(2)</external-xref>) is
			 amended—</text><subparagraph id="id4283ca45-c045-4fbd-b261-5fd788fb9e1c"><enum>(A)</enum><text>by striking
			 <quote>procedure for certification,</quote> and inserting
			 <quote>procedure,</quote>;</text></subparagraph><subparagraph id="id8cacf5be-a514-415b-b461-c5214e084630"><enum>(B)</enum><text>by striking <quote>basis
			 of fish</quote> and inserting <quote>basis, for allowing importation of
			 fish</quote>;</text></subparagraph><subparagraph id="id94c42d51-9d7b-4c1f-bf27-34685359be5f"><enum>(C)</enum><text>by striking
			 <quote>harvesting nation not certified under paragraph (1)</quote> and
			 inserting <quote>nation issued a negative certification under paragraph
			 (1)</quote>; and</text></subparagraph><subparagraph id="idB7E7E956F580462EAE081CB9EC440405"><enum>(D)</enum><text>in subparagraph (A), by
			 striking <quote>under an international fishery management agreement to which
			 the United States is a party; or</quote> and inserting <quote>;
			 and</quote>.</text></subparagraph></paragraph><paragraph id="id635a8b02-6c45-4e6f-859b-3630c712f92c"><enum>(7)</enum><text>Section 610(a) of the
			 High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826k">16 U.S.C. 1826k(a)</external-xref>) is
			 amended—</text><subparagraph id="id632c0709-19b4-40fe-b949-a8a53bde12cb"><enum>(A)</enum><text>by striking
			 <quote>calendar year</quote> each place it appears and inserting <quote>3
			 years</quote>; and</text></subparagraph><subparagraph id="ide13d9684-91c0-4644-b0bd-0af2b8a6235d"><enum>(B)</enum><text>in paragraph (1), by
			 striking <quote>practices;</quote> and inserting
			 <quote>practices—</quote>.</text></subparagraph></paragraph><paragraph id="idC8CE85013A114C5B9A396D3628E7836A"><enum>(8)</enum><text>Section 610(c)(5) of the
			 High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826k">16 U.S.C. 1826k(c)(5)</external-xref>) is
			 amended by striking <quote>or fish or fish products not caught by the vessels
			 engaged in illegal, unreported, or unregulated fishing</quote>.</text></paragraph></subsection><subsection id="idf6647a2a-2120-4869-b260-d6432dd24f8c"><enum>(b)</enum><header>Dolphin Protection
			 Consumer Information Act</header><text>Section 901 of the Dolphin Protection
			 Consumer Information Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1385">16 U.S.C. 1385</external-xref>) is amended—</text><paragraph id="id38e57e7c-bb36-4ca4-9d27-b8fd872e7383"><enum>(1)</enum><text>by adding at the end of
			 subsection (d) the following:</text><quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id492ff85b-d427-4e29-8c11-a8005cdb3760" reported-display-style="italic" style="OLC"><paragraph id="id58a2cf8c-e677-4fbf-8e99-bddd8df27f28"><enum>(4)</enum><text>It is a violation of

			 Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826i">16 U.S.C. 1826i</external-xref>), as amended by
			 section 302(a) of this Act, is further amended by adding at the end the

				make public a list of vessels and vessel owners that are engaged, or have been
				engaged at any point during the preceding 2 years, in illegal, unreported, or
				unregulated fishing, including vessels or vessel owners identified by an
				international fishery management organization or arrangement made pursuant to
				an international fishery agreement, whether or not the United States is a party
				to such organization or arrangement;</text></paragraph><paragraph id="id32325217-3bad-4800-a889-f17824354aa4"><enum>(2)</enum><text>take appropriate action
				against listed vessels and vessel owners, including action against fish, fish
				parts, or fish products from such vessels, in accordance with applicable United
				States law and consistent with applicable international law, including
				principles, rights, and obligations established in applicable international
				fishery management and trade agreements; and</text></paragraph><paragraph id="id1fd4d724-a21b-405d-9bfe-1fc3d48e6efc"><enum>(3)</enum><text>provide notification to
				the public of vessels and vessel owners identified by international fishery
				management organizations or arrangements made pursuant to an international
				fishery agreement as having been engaged in illegal, unreported, or unregulated
				fishing, as well as any measures adopted by such organizations or arrangements
				to address illegal, unreported, or unregulated fishing.</text></paragraph></subsection><subsection id="id10fce1a6-4ccf-4031-bbdc-b73cb1502b84"><enum>(d)</enum><header>Restrictions on port
				access or use</header><text>Action taken by the Secretary under subsection
				(c)(2) that includes measures to restrict use of or access to ports or port
				services shall apply to all ports of the United States and its

				Secretary may promulgate regulations to implement subsections (c) and
				(d).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idf4e26d07-ae0b-4408-9118-5a94509e3ad1"><enum>(2)</enum><text>Section 609 of the High
			 Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826j">16 U.S.C. 1826j</external-xref>) is
			 amended—</text><subparagraph id="id9b8bc300-1348-4f73-a329-3bf7109fb814"><enum>(A)</enum><text>in subsection
			 (d)(3)(A)(i), by striking <quote>that has not been certified by the Secretary
			 under this subsection, or</quote>;</text></subparagraph><subparagraph id="id79E0A66E71F74163BC440820B492C938"><enum>(B)</enum><text>in subsection (e)(2), by
			 striking <quote>Within 3 months after the date of enactment of the
			 Magnuson-Stevens Fishery Conservation and Management Reauthorization Act of
			 2006</quote> and inserting <quote>Not later than 180 days after the date of
			 enactment of the <short-title>International Fisheries

				conducted by foreign vessels in contravention of a nation's laws (including
				regulations), including fishing activity that has not been reported or that has
				been misreported to the relevant national authority of a nation in
				contravention of that nation's laws (including
				regulations).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id82f771d7-fc35-4d80-82de-93cce1797001"><enum>(3)</enum><text>Section 610(c)(5) of the
			 High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826k">16 U.S.C. 1826k(c)(5)</external-xref>) is
			 amended by striking <quote>that has not been certified by the Secretary under
			 this subsection, or</quote>.</text></paragraph></subsection><subsection id="id4af3974a-64f7-4e8c-9fd9-bffdecdc1fd6"><enum>(b)</enum><header>Amendment of the High
			 Seas Driftnet Fisheries Enforcement Act</header><paragraph id="id25a7fd72-1378-4488-81d2-ce089b4480a6"><enum>(1)</enum><text>Section 101 of the High
			 Seas Driftnet Fisheries Enforcement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826a">16 U.S.C. 1826a</external-xref>) is
			 amended—</text><subparagraph id="id83323ec2-10d6-4b83-89ba-b5922412804d"><enum>(A)</enum><text>in subsection (a), by
			 striking paragraph (2) and inserting the following:</text><quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id9d86112c-f88a-4e6c-8016-55a3d02327ff" reported-display-style="italic" style="OLC"><paragraph id="id6437d8ef-9667-433e-a88f-82f86b6a2d5f"><enum>(2)</enum><header>Denial of port
				privileges</header><text>The Secretary of the Treasury shall, to the extent
				consistent with international law—</text><subparagraph id="id2c0d6b20-5a73-4297-b1c6-6b006d7c8a0f"><enum>(A)</enum><text>withhold or revoke the
				clearance required by
				section
				60105 of title 46, United States Code, for—</text><clause id="id5af06fd0-ed45-4843-8a88-1657dfde995d"><enum>(i)</enum><text>any large-scale driftnet
				fishing vessel that is documented under the law of the United States or of a
				nation included on a list published under paragraph (1); or</text></clause><clause id="id05e10cc0-9715-47ed-91ca-b4059521abe7"><enum>(ii)</enum><text>any fishing vessel of a
				nation that receives a negative certification under section 609(d) or 610(c) of
				the High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826j">16 U.S.C. 1826j(d)</external-xref> or
				1826k(c)); and</text></clause></subparagraph><subparagraph id="ida6b048e9-6cd5-4f06-8f90-62fe560317cc"><enum>(B)</enum><text>deny entry of that vessel
				to any place in the United States and to the navigable waters of the United
				States, except for the purpose of inspecting the vessel, conducting an
				investigation, or taking other appropriate enforcement
				action.</text></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idbe4eb290-66b3-4c13-bf6c-8a2c8e1d1982"><enum>(B)</enum><text>in subsection (b)—</text><clause id="id67477278-ba57-4726-907d-c10a5a5d22cb"><enum>(i)</enum><text>by striking <quote>or
			 illegal, unreported, or unregulated fishing</quote> each place it appears in
			 paragraphs (1) and (2);</text></clause><clause id="id632a673f-01f9-4f52-9e10-f48f25aceb7e"><enum>(ii)</enum><text>by striking paragraph
			 (3)(A) and inserting the following:</text><quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id2271cadd-3e6f-43f8-961c-c059f2e00eea" reported-display-style="italic" style="OLC"><subparagraph id="id7efd8341-0952-49bb-9083-ed4022fd4c05"><enum>(A)</enum><header>Prohibition</header><text>The
				President shall direct the Secretary of the Treasury to prohibit the
				importation into the United States of fish and fish products and sport fishing
				equipment (as that term is defined in section 4162 of the Internal Revenue Code
				of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/4162">26 U.S.C. 4162</external-xref>)) from a nation—</text><clause id="id5520fbb2-708a-4920-be55-993f83857862"><enum>(i)</enum><text>upon receipt of
				notification of the identification of the nation under paragraph (1)(A);</text></clause><clause id="idefdf5e7b-d9c3-4898-8d6e-c591d0bdde2b"><enum>(ii)</enum><text>if the consultations
				with the government of the nation under paragraph (2) are not satisfactorily
				concluded within ninety days; or</text></clause><clause id="id0ca1956a-a322-44fc-a1e6-e6118dfcf833"><enum>(iii)</enum><text>upon receipt of
				notification of a negative certification under section 609(d)(1) or 610(c)(1)
				of the High Seas Driftnet Fishing Moratorium Protection Act (16 U.S.C.
				1826j(d)(1) and
				1826k(c)(1)).</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="idbd96553a-7940-40c0-a1f2-5b8470a35b9c"><enum>(iii)</enum><text>by inserting <quote>or
			 after issuing a negative certification under section 609(d)(1) or 610(c)(1) of
			 the High Seas Driftnet Fishing Moratorium Protection Act (16 U.S.C.
			 1826j(d)(1) and 1826k(c)(1)),</quote> after <quote>paragraph
			 (1),</quote> in paragraph (4)(A); and</text></clause><clause id="id721710eb-1525-4769-9697-6ae778ebf338"><enum>(iv)</enum><text>by striking paragraph
			 (4)(A)(i) and inserting the following:</text><quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="idb8c0dcf8-c023-4335-91fe-56c6a84c126c" reported-display-style="italic" style="OLC"><clause id="idf4becf1b-23bd-42f9-b1e4-a515ff932e67"><enum>(i)</enum><text>any prohibition
				established under paragraph (3) is insufficient to cause that nation—</text><subclause id="id38903ca9-3c49-46ee-bdde-423bc3b7b029"><enum>(I)</enum><text>to terminate large-scale
				driftnet fishing conducted by its nationals and vessels beyond the exclusive
				economic zone of any nation;</text></subclause><subclause id="id6d47adad-7d9b-484b-a195-c12961f7781f"><enum>(II)</enum><text>to address illegal,
				unreported, or unregulated fishing activities for which a nation has been
				identified under section 609 of the High Seas Driftnet Fishing Moratorium
				Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826j">16 U.S.C. 1826j</external-xref>); or</text></subclause><subclause id="idd4b8b695-accb-4ff1-80f2-2fbb6ce06434"><enum>(III)</enum><text>to address bycatch of a
				protected living marine resource or shark catch on the high seas for which a
				nation has been identified under section 610 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826k">16 U.S.C. 1826k</external-xref>);
				or</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id54fbae4f-6f75-48a4-be30-c49e31ad30c0"><enum>(2)</enum><text>Section 102 of the High
			 Seas Driftnet Fisheries Enforcement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826b">16 U.S.C. 1826b</external-xref>) is amended by
			 striking <quote>such nation has terminated large-scale driftnet fishing or
			 illegal, unreported, or unregulated fishing by its nationals and vessels beyond
			 the exclusive economic zone of any nation.</quote> and
			 inserting</text><quoted-block changed="added" committee-id="SSCM00" display-inline="yes-display-inline" id="idc2bc86bc-6fa4-418d-9a22-8afaa260422f" reported-display-style="italic" style="OLC"><text>such
			 nation—</text><paragraph id="id3efaf183-ee8e-49d2-9f77-d75b437ea8f8"><enum>(1)</enum><text>has terminated
				large-scale driftnet fishing by its nationals and vessels beyond the exclusive
				economic zone of any nation;</text></paragraph><paragraph id="id03adfbd6-26b6-4077-a56f-324a9abb0058"><enum>(2)</enum><text>has addressed illegal,
				unreported, or unregulated fishing activities for which a nation has been
				identified under section 609 of the High Seas Driftnet Fishing Moratorium
				Protection Act (16
				U.S.C. 1826j); or</text></paragraph><paragraph id="id0cf9f8d2-e8e0-4336-9628-b82dbd4c2527"><enum>(3)</enum><text>has addressed bycatch of
				a protected living marine resource or shark catch on the high seas for which a
				nation has been identified under section 610 of the High Seas Driftnet Fishing
				Moratorium Protection Act (16 U.S.C.
				1826k).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id1fe50b1f-5e73-4ee3-8b5a-0a949c0e9f1b"><enum>104.</enum><header>Liability</header><text display-inline="no-display-inline">Any claims arising from the actions of any
			 officer, authorized by the Secretary of Commerce or the Secretary of the
			 department in which the Coast Guard is operating to enforce the provisions of
			 this Act or any Act to which this Act applies, taken pursuant to any scheme for
			 at-sea boarding and inspection authorized under any international agreement to
			 which the United States is a party may be pursued under
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28,
			 United States Code, or such other legal authority as may be pertinent.</text></section></title><title changed="added" committee-id="SSCM00" id="id7f7792e6-ce29-4588-a2bc-e640b06a3c16" reported-display-style="italic"><enum>II</enum><header>Law enforcement and
			 international operations</header><section id="id8d1d7463-739e-445d-883e-c2e7df68263f"><enum>201.</enum><header>International
			 fisheries enforcement</header><subsection id="id873f0873-f71a-4e78-acc1-688956f4152a"><enum>(a)</enum><header>Establishment of
			 international fisheries enforcement task force</header><paragraph id="id67281e07-15d6-43fd-8d37-87f3cde0388c"><enum>(1)</enum><header>In
			 general</header><text>Not later than 12 months after the date of enactment of
			 this Act, the Secretary of Commerce shall establish, through the National
			 Marine Fisheries Service's international enforcement program, an interagency
			 International Fisheries Enforcement Task Force.</text></paragraph><paragraph id="id760b690e-7c19-4cb2-8a5d-0b267a30d2d6"><enum>(2)</enum><header>Purposes</header><text>The
			 purposes of the task force shall be—</text><subparagraph id="idf9e1af07-16ab-4773-9564-d1a7d4c3aa28"><enum>(A)</enum><text>to detect and investigate
			 illegal, unreported, or unregulated fishing activity and trafficking in the
			 resulting fish or fish product; and</text></subparagraph><subparagraph id="id931e624b-8d6b-44dc-b511-c1ee79e9c50b"><enum>(B)</enum><text>to enforce the provisions
			 of this Act or any Act to which section 101 applies.</text></subparagraph></paragraph><paragraph id="ide4c62bc0-1479-407e-a189-686ab627cd7d"><enum>(3)</enum><header>Membership</header><text>The
			 task force shall include permanent representation from—</text><subparagraph id="id8c0f85cd-3821-459b-be7e-5cdad8ac0b61"><enum>(A)</enum><text>the National Marine
			 Fisheries Service's international enforcement program;</text></subparagraph><subparagraph id="id3a71de64-4bda-4acd-a99b-df99b4c6be11"><enum>(B)</enum><text>the U.S. Coast
			 Guard;</text></subparagraph><subparagraph id="idcde3d73a-a8e8-4767-8221-64fbc4480029"><enum>(C)</enum><text>U.S. Customs and Border
			 Protection;</text></subparagraph><subparagraph id="id753a54b7-198d-4ce1-8cfb-0a5d44016279"><enum>(D)</enum><text>the U.S. Food and Drug
			 Administration; and</text></subparagraph><subparagraph id="id593e938c-d6fd-402c-9664-d06de5cb16bb"><enum>(E)</enum><text>such other Federal
			 agencies as the Secretary considers appropriate and necessary to carry out the
			 purposes under paragraph (2).</text></subparagraph></paragraph></subsection><subsection id="idb384c7f5-175b-402e-962a-a8dff266db5f"><enum>(b)</enum><header>Task force
			 organization</header><paragraph id="id1ce5543a-4479-4867-8212-98c22521e89c"><enum>(1)</enum><header>Staffing and other
			 resources</header><text>The Secretary of Commerce and the head of each
			 department and agency identified under subsection (a)(3) shall—</text><subparagraph id="id4ee5a2ac-d0b8-4719-b214-a79e5f20f5cb"><enum>(A)</enum><text>by agreement, on a
			 reimbursable basis or otherwise, provide permanent representation to the task
			 force;</text></subparagraph><subparagraph id="id4457e338-73a6-4e14-b644-a71b7da648ed"><enum>(B)</enum><text>by agreement, on a
			 reimbursable basis or otherwise, share personnel, services, equipment
			 (including aircraft and vessels), and facilities with the task force for the
			 purposes under subsection (a)(2); and</text></subparagraph><subparagraph id="id32e87ed1-8189-4c6e-85f7-a24a6c8dde1b"><enum>(C)</enum><text>to the extent possible,
			 and consistent with other applicable law, extend the authorities provided under
			 their enabling legislation to the other departments and agencies participating
			 in the task force.</text></subparagraph></paragraph><paragraph id="idf50cf7ff-833c-48f6-af40-a6aaa50d7626"><enum>(2)</enum><header>Budget</header><text>The
			 Secretary of Commerce and the head of each department and agency providing
			 personnel for the task force, at their discretion, may develop interagency
			 plans and budgets and engage in interagency financing for such purposes.</text></paragraph><paragraph id="idb3cd2df5-c043-4160-9942-5b89e9f15a6a"><enum>(3)</enum><header>5-year strategic
			 plan</header><text>Not later than 180 days after the date on which the task
			 force is established under subsection (a), the Secretary of Commerce shall
			 develop a 5-year strategic plan for guiding interagency and intergovernmental
			 international fisheries enforcement efforts to carry out the provisions of this
			 Act. The Secretary shall update the plan periodically as necessary, but at
			 least once every 5 years.</text></paragraph><paragraph id="id97b4de02-687e-4b25-9865-cb6aa2410c2f"><enum>(4)</enum><header>Cooperative
			 activities</header><text>The Secretary, in coordination with the head of each
			 department and agency providing personnel for the task force—</text><subparagraph id="id79ee9f9d-6176-466e-8b94-6876dc31d0e1"><enum>(A)</enum><text>may conduct one or more
			 joint operations for the purposes under subsection (a)(2);</text></subparagraph><subparagraph id="id98f6f806-c69a-44db-9b0b-42a02ddb2312"><enum>(B)</enum><text>shall, to the maximum
			 extent permissible under law, create and participate in committees or other
			 working groups with other Federal, State, or local governments, and with the
			 governments of other nations for the purposes under subsection (a)(2);</text></subparagraph><subparagraph id="idf8193440-9f82-4389-8d34-85c8c9b8fe83"><enum>(C)</enum><text>may enter into agreements
			 with other Federal, State, or local governments, and with the governments of
			 other nations, on a reimbursable basis or otherwise, for the purposes under
			 subsection (a)(2).</text></subparagraph></paragraph></subsection><subsection id="id43296dec-d467-4b16-a643-12c7971ada49"><enum>(c)</enum><header>Powers of authorized
			 officers</header><text>Notwithstanding any other provision of law, while
			 operating under an agreement with the Secretary of Commerce entered into under
			 section 101, or while conducting a joint operation under subsection (b)(4) of
			 this section, each authorized officer shall have the powers and authority
			 provided in section 101.</text></subsection></section><section id="ide852ea26-5543-4997-9118-83e8e9d69579"><enum>202.</enum><header>International
			 cooperation and assistance</header><subsection id="id3bf982c2-1df3-4894-8ed1-1b2da7dc0731"><enum>(a)</enum><header>International
			 cooperation and assistance</header><text>The Secretary of Commerce may provide
			 international cooperation and assistance for international capacity building
			 efforts.</text></subsection><subsection id="idb706b515-a3d8-43b4-85cf-6e237570f0ad"><enum>(b)</enum><header>Authorized
			 activities</header><text>In carrying out this section, the Secretary
			 may—</text><paragraph id="idd161390a-fae4-4bec-928e-036b3dfe468d"><enum>(1)</enum><text>provide technical
			 expertise to other nations to assist them in addressing illegal, unreported, or
			 unregulated fishing activities;</text></paragraph><paragraph id="idebd8e357-205d-429a-a547-4de6e031e0f2"><enum>(2)</enum><text>provide technical
			 expertise to other nations to assist them in reducing the loss and
			 environmental impacts of derelict fishing gear, reducing the bycatch of living
			 marine resources, and promoting international marine resource
			 conservation;</text></paragraph><paragraph id="id4d0e0b9a-e47a-4d57-85ed-2063ff2eecbc"><enum>(3)</enum><text>provide technical
			 expertise, and training, in cooperation with the International Fisheries
			 Enforcement Task Force under section 201 of this Act, to other nations to aid
			 them in building capacity for enhanced fisheries management, fisheries
			 monitoring, catch and trade tracking activities, enforcement, and international
			 marine resource conservation;</text></paragraph><paragraph id="ide745f5af-9e6d-4d29-8b54-ae6f2238d5e5"><enum>(4)</enum><text>establish partnerships
			 with other Federal agencies, as appropriate, to ensure that fisheries
			 development assistance to other nations is directed toward efforts that promote
			 sustainable fisheries;</text></paragraph><paragraph id="id309888b6-1d84-44c0-9552-74d74cdd153b"><enum>(5)</enum><text>conduct outreach and
			 education efforts in order to promote public and private sector awareness of
			 international fisheries sustainability issues, including the need to combat
			 illegal, unreported, or unregulated fishing activity and to promote
			 international marine resource conservation; and</text></paragraph><paragraph id="idB5D2FB8FF7064FE389B82800207721B1"><enum>(6)</enum><text>use, with their consent,
			 with reimbursement and subject to the limits of available appropriations, the
			 land, services, equipment, personnel, and facilities of any department, agency,
			 or instrumentality of the United States, or of any State, local government,
			 Indian tribal government, Territory, or possession, or of any political
			 subdivision thereof, or of any foreign government or international
			 organization, for purposes related to carrying out the responsibilities of any
			 statute administered by the National Oceanic and Atmospheric Administration;
			 and</text></paragraph><paragraph id="id23485DA04ED149F8B505CF81C0D9EC57"><enum>(7)</enum><text>accept and expend funds
			 from other Federal agencies or foreign governments to carry out the purposes of
			 this section.</text></paragraph></subsection><subsection id="ida90337c7-c9a8-4485-9599-654ee2399b4a"><enum>(c)</enum><header>Guidelines</header><text>The
			 Secretary may establish guidelines as necessary to implement this
			 section.</text></subsection></section></title><title changed="added" committee-id="SSCM00" id="ide48ba679-679f-4b53-9380-cb9e535af9a7" reported-display-style="italic"><enum>III</enum><header>Miscellaneous
			 amendments</header><section id="id4720e7fc-cbdf-49f8-a7d8-dc6fa1bf4cb2"><enum>301.</enum><header>Atlantic Tunas
			 Convention Act of 1975</header><text display-inline="no-display-inline">Section
			 6 of the Atlantic Tunas Convention Act of 1975 (<external-xref legal-doc="usc" parsable-cite="usc/16/971d">16 U.S.C. 971d(c)(2)</external-xref>) is

				international fishery agreement, if such organizations or arrangements have
				policies and procedures to safeguard such information from unintended or
				unauthorized

				Republic of Costa Rica, signed at Washington, November 14, 2003.</text></paragraph><paragraph id="id6b26280b-d74b-4e3b-bba6-35c55a779c87"><enum>(2)</enum><header>Commission</header><text>The
				term <term>Commission</term> means the Inter-American Tropical Tuna Commission
				provided for by the Convention.</text></paragraph><paragraph id="id6ffbc1ab-62ed-4d2c-ae34-6ec4c3a0ca85"><enum>(3)</enum><header>Convention</header><text>The
				term <term>Convention</term> means—</text><subparagraph id="id1af960b1-12b8-41b1-9d4e-b0860daa9578"><enum>(A)</enum><text>the Convention for the
				Establishment of an Inter-American Tropical Tuna Commission, signed at
				Washington, May 31, 1949, by the United States of America and the Republic of
				Costa Rica;</text></subparagraph><subparagraph id="idf522baaa-f766-4860-ae69-2ede0e8b70ef"><enum>(B)</enum><text>the Antigua Convention,
				upon its entry into force for the United States, and any amendments thereto
				that are in force for the United States; or</text></subparagraph><subparagraph id="id891ad46f-3985-4173-8dcf-e2cb81e96651"><enum>(C)</enum><text>both subparagraphs (A)
				and (B), as the context requires.</text></subparagraph></paragraph><paragraph id="id51d77711-e8a7-4950-90c6-8b092e0e2426"><enum>(4)</enum><header>Import</header><text>The
				term <term>import</term> means to land on, bring into, or introduce into, or
				attempt to land on, bring into, or introduce into, any place subject to the
				jurisdiction of the United States, whether or not such landing, bringing, or
				introduction constitutes an importation within the meaning of the customs laws
				of the United States.</text></paragraph><paragraph id="idaf3c2fc0-59ac-4f88-88af-df2136fae0b0"><enum>(5)</enum><header>Person</header><text>The
				term <term>person</term> means an individual, partnership, corporation, or
				association subject to the jurisdiction of the United States.</text></paragraph><paragraph id="idbb1e8f86-770b-427a-ad61-837dde87bfcc"><enum>(6)</enum><header>United
				States</header><text>The term <term>United States</term> includes all areas
				under the sovereignty of the United States.</text></paragraph><paragraph id="id708f68a2-aedd-4c73-ad03-98cdcac76470"><enum>(7)</enum><header>United States
				Commissioners</header><text>The term <term>United States Commissioners</term>

				Section</header><text>The term <term>United States Section</term> means the
				United States Commissioners to the Commission and a designee of the Secretary

			 appointment, and qualifications</header><text display-inline="no-display-inline">Section 3 (<external-xref legal-doc="usc" parsable-cite="usc/16/952">16 U.S.C. 952</external-xref>) is amended to read as
			 follows:</text><quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="ide2f0d547-63af-4b69-a927-7dd56c719de1" reported-display-style="italic" style="OLC"><section id="idd1fd752a-785d-4a66-b72a-294fae2145ea"><enum>3.</enum><header>Commissioners</header><subsection id="id418fbb9f-e138-48c8-a20a-8b72053ee1e7"><enum>(a)</enum><header>Commissioners</header><text>The
				United States shall be represented on the Commission by 5 United States
				Commissioners. The President shall appoint individuals to serve on the
				Commission at the pleasure of the President. In making the appointments, the
				President shall select Commissioners from among individuals who are
				knowledgeable or experienced concerning highly migratory fish stocks in the
				eastern tropical Pacific Ocean, 1 of which shall be an officer or employee of
				the Department of Commerce, 1 of which shall be the chairman or a member of the
				Western Pacific Fishery Management Council, and 1 of which shall be the
				chairman or a member of the Pacific Fishery Management Council. Not more than 2
				Commissioners may be appointed who reside in a State other than a State whose
				vessels maintain a substantial fishery in the area of the Convention.</text></subsection><subsection id="id6f938659-2f60-4898-aae8-c6c2eb1465d4"><enum>(b)</enum><header>Alternate United States
				commissioners</header><text>The Secretary of State, in consultation with the
				Secretary, may designate from time to time and for periods of time deemed
				appropriate Alternate United States Commissioners to the Commission. Any
				Alternate United States Commissioner may exercise, at any meeting of the
				Commission or of the General Advisory Committee or Scientific Advisory
				Subcommittee established pursuant to section 4(b), all powers and duties of a
				United States Commissioner in the absence of any Commissioner appointed
				pursuant to subsection (a) of this section for whatever reason. The number of
				such Alternate United States Commissioners that may be designated for any such
				meeting shall be limited to the number of United States Commissioners appointed
				pursuant to subsection (a) of this section who will not be present at such
				meeting.</text></subsection><subsection id="id37d67aa4-7a85-400a-9aa4-06ff01b87617"><enum>(c)</enum><header>Administrative
				matters</header><paragraph id="idfbc7b2ca-b0f5-42a1-a66e-d2d70f0de2d4"><enum>(1)</enum><header>Employment
				status</header><text>Individuals serving as such Commissioners, other than
				officers or employees of the United States Government, shall not be considered
				Federal employees except for the purposes of injury compensation or tort claims
				liability as provided in
				chapter
				81 of title 5, United States Code, and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28,
				United States Code.</text></paragraph><paragraph id="id8d33b270-f99c-4619-bf3a-d513c7c26dc8"><enum>(2)</enum><header>Compensation</header><text>The
				United States Commissioners or Alternate United States Commissioners, although
				officers of the United States while so serving, shall receive no compensation
				for their services as such United States Commissioners or Alternate United
				States Commissioners.</text></paragraph><paragraph id="idef63f430-aba7-4b8d-9349-36d2dfaa3035"><enum>(3)</enum><header>Travel
				expenses</header><subparagraph id="id73d02514-082c-4e02-85d3-3545e721c631"><enum>(A)</enum><text>The Secretary of State
				shall pay the necessary travel expenses of United States Commissioners and
				Alternate United States Commissioners to meetings of the Commission and other
				meetings the Secretary deems necessary to fulfill their duties, in accordance
				with the Federal Travel Regulations and sections 5701, 5702, 5704 through 5708,
				and 5731 of title 5, United States Code.</text></subparagraph><subparagraph id="id085e8788-8bae-434d-92e1-d51d7c0e44cc"><enum>(B)</enum><text>The Secretary may
				reimburse the Secretary of State for amounts expended by the Secretary of State
				under this
				subsection.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id18735b24-9c2b-4d1d-9d8d-44e0ce7cbdca"><enum>404.</enum><header>General advisory
			 committee and scientific advisory subcommittee</header><text display-inline="no-display-inline">Section 4 (<external-xref legal-doc="usc" parsable-cite="usc/16/953">16 U.S.C. 953</external-xref>) is amended—</text><paragraph id="id99842f7d-36c4-417d-a370-901ac6e69daa"><enum>(1)</enum><text>by striking subsection

				participation</header><subparagraph id="idc9d956bf-8f2f-441d-aa70-2128e7dd006e"><enum>(A)</enum><header>Appointments</header><text>The
				Secretary, in consultation with the Secretary of State, shall appoint a General
				Advisory Committee which shall consist of not more than 25 individuals who
				shall be representative of the various groups concerned with the fisheries
				covered by the Convention, including nongovernmental conservation
				organizations, providing to the maximum extent practicable an equitable balance
				among such groups. Members of the General Advisory Committee will be eligible
				to participate as members of the U.S. delegation to the Commission and its
				working groups to the extent the Commission rules and space for delegations
				allow.</text></subparagraph><subparagraph id="id063a98ff-10c9-44b7-84de-c601208da544"><enum>(B)</enum><header>Additional
				members</header><text>The chair of the Pacific Fishery Management Council's
				Advisory Subpanel for Highly Migratory Fisheries and the chair of the Western
				Pacific Fishery Management Council's Advisory Committee shall be members of the
				General Advisory Committee by virtue of their positions in those
				Councils.</text></subparagraph><subparagraph id="id8f8fb164-ec35-4167-9c59-b29722bd0d99"><enum>(C)</enum><header>Terms</header><text>Each
				member of the General Advisory Committee appointed under subparagraph (A) shall
				serve for a term of 3 years and shall be eligible for reappointment.</text></subparagraph><subparagraph id="id9b3f86b7-035e-4d62-bec0-eac8d7df6537"><enum>(D)</enum><header>Non-executive meetings
				of the United States Section</header><text>The General Advisory Committee shall
				be invited to attend all non-executive meetings of the United States Section
				and at such meetings shall be given opportunity to examine and to be heard on
				all proposed programs of investigation, reports, recommendations, and
				regulations of the Commission.</text></subparagraph><subparagraph id="id09994807-677d-4805-8783-868781ab49f0"><enum>(E)</enum><header>Public
				participation</header><text>The General Advisory Committee shall determine its
				organization, and prescribe its practices and procedures for carrying out its
				functions under this chapter, the Magnuson-Stevens Fishery Conservation and
				Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801 et seq.</external-xref>), and the Convention. The General
				Advisory Committee shall publish and make available to the public a statement
				of its organization, practices and procedures. Meetings of the General Advisory
				Committee, except when in executive session, shall be open to the public, and
				prior notice of meetings shall be made public in timely fashion.</text></subparagraph></paragraph><paragraph id="id4f518b3b-d962-4dc6-97c1-a466c55c9562"><enum>(2)</enum><header>Information
				sharing</header><text>The Secretary and the Secretary of State shall furnish
				the General Advisory Committee with relevant information concerning fisheries
				and international fishery agreements.</text></paragraph><paragraph id="id1f5dbd42-adb7-4a2d-aee9-39834234e816"><enum>(3)</enum><header>Administrative
				matters</header><subparagraph id="id655762d0-83c6-4756-8612-7fa50f0ae4d0"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall provide to the General Advisory
				Committee in a timely manner such administrative and technical support services
				as are necessary for its effective functioning.</text></subparagraph><subparagraph id="id8a801f4b-42d2-4431-a1eb-74a9ad0b2aa6"><enum>(B)</enum><header>Compensation</header><text>An
				individual appointed to serve as a member of the General Advisory
				Committee—</text><clause id="idb34d849b-2034-42ff-a9df-69486dca1e45"><enum>(i)</enum><text>shall serve without pay,
				but while away from home or regular place of business to attend meetings of the
				General Advisory Committee shall be allowed travel expenses, including per diem
				in lieu of subsistence, in the same manner as a person employed intermittently
				in the Government service is allowed expenses under
				section
				5703 of title 5, United States Code; and</text></clause><clause id="idf84ff392-ae06-41b1-85c1-1a413f0ed4d2"><enum>(ii)</enum><text>shall not be considered
				a Federal employee except for the purposes of injury compensation or tort
				claims liability as provided in
				chapter
				81 of title 5, United States Code, and
				<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28,
				United States

				organizations.</text><subparagraph id="id5470D5730CE1416391CDF6553548E53E"><enum>(A)</enum><header>Public
				participation</header><text>The Scientific Advisory Subcommittee shall
				determine its organization, and prescribe its practices and procedures for
				carrying out its functions under this chapter, the Magnuson-Stevens Fishery
				Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801 et seq.</external-xref>), and the Convention.
				The Scientific Advisory Subcommittee shall publish and make available to the
				public a statement of its organization, practices, and procedures. Meetings of
				the Scientific Advisory Subcommittee, except when in executive session, shall
				be open to the public, and prior notice of meetings shall be made public in a
				timely fashion.</text></subparagraph><subparagraph id="idC79AC9D3428648059944AD9AA8608567"><enum>(B)</enum><header>Information
				sharing</header><text>The Secretary and the Secretary of State shall furnish
				the Scientific Advisory Subcommittee with relevant information concerning
				fisheries and international fishery agreements.</text></subparagraph><subparagraph id="id215817D7B5CD42639084802391293FF7"><enum>(C)</enum><header>Administrative
				matters</header><clause id="id2F09269537144E35A020BC31494C3B0E"><enum>(i)</enum><header>In
				general</header><text>The Secretary shall provide to the Scientific Advisory
				Subcommittee in a timely manner such administrative and technical support
				services as are necessary for its effective functioning.</text></clause><clause id="id79624C98E67C4CFA90D94CFB8D280A47"><enum>(ii)</enum><header>Compensation</header><text>An
				individual appointed to serve as a member of the Scientific Advisory
				Subcommittee—</text><subclause id="id46819B11FC574751AC6FA44F7712F053"><enum>(I)</enum><text>shall serve without pay,
				but while away from home or regular place of business to attend meetings of the
				Scientific Advisory Subcommittee shall be allowed travel expenses, including
				per diem in lieu of subsistence, in the same manner as a person employed
				intermittently in the Government service is allowed expenses under section 5703
				of title 5, United States Code; and</text></subclause><subclause id="id05A67948D29F47E58E8E81F945977BFD"><enum>(II)</enum><text>shall not be considered
				a Federal employee, except for the purposes of injury compensation or tort
				claims liability as provided in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code, and
				<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/171">chapter 171</external-xref> of title 18, United States
				Code.</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id8564BF4DE6674EF3927CB23C06B5E6F3"><enum>(3)</enum><text>in subsection (b)(2), by

				recommendations and decisions adopted by the Commission, promulgate such
				regulations in accordance with the procedures established by the
				Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1801 et
				seq.).</text></subsection><subsection id="id413d38c1-2d6f-4c0f-a378-e4ee77a9873d"><enum>(b)</enum><header>Jurisdiction</header><text>The
				Secretary may promulgate regulations applicable to all vessels and persons
				subject to the jurisdiction of the United States, including United States flag
				vessels wherever they may be operating, on such date as the Secretary shall
				prescribe.</text></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block></paragraph><paragraph id="idAD68481471294EDFB19B859266537665"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="idD08CA9010C9D4D3DBDB47D15A6A6AFC2"><enum>(A)</enum><text>by striking the

			 acts</header><text display-inline="no-display-inline">Section 8 (<external-xref legal-doc="usc" parsable-cite="usc/16/957">16 U.S.C. 957</external-xref>) is

				to engage in fishing after the revocation, or during the period of suspension,
				of an applicable permit issued pursuant to this Act;</text></paragraph><paragraph id="id1e9c5042-bc22-4281-ab99-af15262cda88"><enum>(3)</enum><text>to refuse to permit any
				officer authorized to enforce the provisions of this Act (as provided for in
				section 10) to board a fishing vessel subject to such person's control for the
				purposes of conducting any search, investigation or inspection in connection
				with the enforcement of this Act or any regulation, permit, or the
				Convention;</text></paragraph><paragraph id="id25aba9d2-03bf-4fe0-8afc-4d9258d36ae7"><enum>(4)</enum><text>to forcibly assault,
				resist, oppose, impede, intimidate, sexually harass, bribe, or interfere with
				any such authorized officer in the conduct of any search, investigations or
				inspection in connection with the enforcement of this Act or any regulation,
				permit, or the Convention;</text></paragraph><paragraph id="id18d35f0b-68fd-4c0e-9114-9a40d78e2a96"><enum>(5)</enum><text>to resist a lawful arrest
				for any act prohibited by this Act;</text></paragraph><paragraph id="id0938fc2d-889e-4e06-8dcb-539a6bb2feaa"><enum>(6)</enum><text>to ship, transport, offer
				for sale, sell, purchase, import, export, or have custody, control, or
				possession of, any fish taken or retained in violation of this Act or any
				regulation, permit, or agreement referred to in paragraph (1) or (2);</text></paragraph><paragraph id="id2d037fa8-123c-4866-8c42-1fb58192ce70"><enum>(7)</enum><text>to interfere with, delay,
				or prevent, by any means, the apprehension or arrest of another person, knowing
				that such other person has committed any act prohibited by this section;</text></paragraph><paragraph id="id8fd87946-b954-4a16-933f-17d5bc831f7b"><enum>(8)</enum><text>to knowingly and
				willfully submit to the Secretary false information regarding any matter that
				the Secretary is considering in the course of carrying out this Act;</text></paragraph><paragraph id="id52f5b6fe-fb1a-441c-8166-8df05bf4f8aa"><enum>(9)</enum><text>to forcibly assault,
				resist, oppose, impede, intimidate, sexually harass, bribe, attempt to bribe,
				or interfere with any observer on a vessel under the Convention, or any data
				collector employed by the National Marine Fisheries Service or under contract
				to any person to carry out responsibilities under this Act;</text></paragraph><paragraph id="id0eca783c-4984-408e-add6-d393a36ed7ef"><enum>(10)</enum><text>to engage in fishing in
				violation of any regulation adopted pursuant to section 6 of this Act;</text></paragraph><paragraph id="id85a95f2b-d702-4a74-9d2b-dd987e13bcaa"><enum>(11)</enum><text>to ship, transport,
				purchase, sell, offer for sale, import, export, or have in custody, possession,
				or control any fish taken or retained in violation of such regulations;</text></paragraph><paragraph id="id0171e04b-cf36-4b13-b4a3-c07926d1935b"><enum>(12)</enum><text>to fail to make, keep,
				or furnish any catch returns, statistical records, or other reports as are
				required by regulations adopted pursuant to this Act to be made, kept, or
				furnished;</text></paragraph><paragraph id="id05022fc5-1976-4889-82b5-48a3109879ca"><enum>(13)</enum><text>to fail to stop a vessel
				upon being hailed and instructed to stop by a duly authorized official of the
				United States; or</text></paragraph><paragraph id="id6e36eb94-040e-4018-a420-8730beb42de0"><enum>(14)</enum><text>to import any fish in
				any form in violation of any regulation adopted pursuant to section 6 of this
				Act.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id2635c344-e847-492d-bdeb-f36e8e6886bf"><enum>407.</enum><header>Enforcement</header><text display-inline="no-display-inline">Section 10 (<external-xref legal-doc="usc" parsable-cite="usc/16/959">16 U.S.C. 959</external-xref>) is amended to read as
