which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require a study and report by the Comptroller General regarding the restart provision of the Hours of Service Rules for Commercial Truck Drivers, and for other purposes.</official-title></form><legis-body id="H588E92FE29F443D5AAFAC847AEF6050A" style="OLC"><section id="H8D95D4DD0B884A05978B1A63236D46AC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>True Understanding of the Economy and Safety Act</short-title></quote> or the <quote><short-title>TRUE Safety Act</short-title></quote>.</text></section><section id="H4222A3FDB6A04388B070BE6B87AA9171"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="HFF82018E9CCD405A8CCE26BA4828C126"><enum>(1)</enum><text>the trucking industry is the backbone of the Nation’s economy, with nearly 7,000,000 Americans working in trucking-related jobs, including more than 3,000,000 commercial truck drivers;</text></paragraph><paragraph id="H5A9270268EF0456197D7E1C290C19703"><enum>(2)</enum><text>80 percent of all communities in the United States depend solely on trucks to deliver and supply their essential everyday commodities;</text></paragraph><paragraph id="H6EFD186C089146F68A0188A78DAB2E8D"><enum>(3)</enum><text>Federal regulations governing the hours of service for commercial truck drivers must be based on full and fair scientific research, analysis, and operational testing;</text></paragraph><paragraph id="H3416EEE3C8894BBB944AAA9AC3B510E4"><enum>(4)</enum><text>the restart rule that became effective on July 1, 2013, was based mainly on a one-month sleep study conducted in a laboratory setting;</text></paragraph><paragraph id="H7A38A8DB59414247A48A12156593B386"><enum>(5)</enum><text>the new restart rule will cost the trucking industry up to $376,000,000 annually, reducing productivity, impacting driver pay, and increasing the cost to deliver goods; and</text></paragraph><paragraph id="H06280148713F4CBFAE602BD420D54438"><enum>(6)</enum><text>the restart rule should not have become effective prior to completion of the thorough operational study required under section 32301(a) of the Moving Ahead for Progress in the 21st Century Act or MAP–21 (<external-xref legal-doc="public-law" parsable-cite="pl/112/141">Public Law 112–141</external-xref>; 126 Stat. 786).</text></paragraph></section><section id="H019DBF7D699C4BF69FA1D5779950571D"><enum>3.</enum><header>GAO assessments</header><subsection id="H82DB22A31AE3494D96E22FC368095593"><enum>(a)</enum><header>Assessment of methodology for MAP–21 restart study</header><paragraph id="HC84565CF209248D5861DFE7959F506D9"><enum>(1)</enum><header>In general</header><text>After the report regarding the field study on the efficacy of the restart rule, published on December 27, 2011, is submitted to Congress pursuant to section 32301(a) of MAP–21, the Comptroller General of the United States shall conduct an assessment of the methodology followed by the Secretary of Transportation in carrying out the efficacy of such restart rule.</text></paragraph><paragraph id="H10107B0D59BC42908DB5DA3E642B8F88"><enum>(2)</enum><header>Scope</header><text>The assessment required under paragraph (1) shall determine the extent to which the methodology followed by the Secretary meets the requirement under MAP–21 that—</text><subparagraph id="H45EFFA23FEAF47C7ABD1A68A4C27DAE8"><enum>(A)</enum><text>the data collected is representative of the drivers subject to the restart rule;</text></subparagraph><subparagraph id="H35B57DBEB69944C99B631E3ED5D27E9A"><enum>(B)</enum><text>the methodology is statistically valid; and</text></subparagraph><subparagraph id="HDBB3AF1CA27142D0B628D1631A64FB28"><enum>(C)</enum><text>the study followed the plan for the <term>Scheduling and Fatigue Recovery Project</term> developed by the Federal Motor Carrier Safety Administration.</text></subparagraph></paragraph></subsection><subsection id="H4B91A552EB1B4D5381C136795FD2EF41"><enum>(b)</enum><header>Assessment of regulatory impact analysis</header><paragraph id="HFB0AF91A744541FA9134FA140D9BE9BA"><enum>(1)</enum><header>In general</header><text>The Comptroller General shall conduct an assessment of the regulatory impact analysis that accompanied the final rule published by the Department of Transportation in the Federal Register on December 27, 2011, entitled <term>Hours of Service of Drivers</term> (76 Fed. Reg. 81134).</text></paragraph><paragraph id="H5398EB1C3B484344BB2A9C197FA28296"><enum>(2)</enum><header>Scope</header><text>The assessment required under paragraph (1) shall include—</text><subparagraph id="H1235B5DD242F4692A8602F3A8E05077D"><enum>(A)</enum><text>an analysis of the methodology and data used by the Federal Motor Carrier Safety Administration in its Regulatory Impact Analysis;</text></subparagraph><subparagraph id="H1DE171CE557D44669FB0D5570C0CC122"><enum>(B)</enum><text>an evaluation of the validity and representativeness of the driver data used to evaluate the operational and economic impacts of the new 34-hour restart rule applicable to operators of commercial motor vehicles;</text></subparagraph><subparagraph id="HE9C7E90B2D024F66B100284C98E890B2"><enum>(C)</enum><text>an analysis of the data and methodology used to develop the proposed safety and health benefits of the new 34-hour restart rule applicable to operators of commercial motor vehicles;</text></subparagraph><subparagraph id="H87CF62BBABE2424AB783ED29FD43FF95"><enum>(D)</enum><text>a review of the safety, health, cost, and operational implications of the restart rule, and the potential impact of a greater number of commercial motor vehicles on major roads during <term>morning commutes</term> as a result of the restart rule; and</text></subparagraph><subparagraph id="HD73C0DCA87844D799984D16DE08DF887"><enum>(E)</enum><text>a review of the research used in developing and justifying the new restart rule, particularly as the rule relates to the use of a laboratory test to justify the rule rather than an operational test in the field.</text></subparagraph></paragraph></subsection><subsection id="H9DE3563087AE4B3691443A9B16DFDAD9"><enum>(c)</enum><header>Reports</header><text>Not later than 1 year after the date of the enactment of this Act, the Comptroller General shall submit a final report to the appropriate committees of Congress on the assessments required under subsections (a) and (b), including any recommendations.</text></subsection></section><section id="H5A25713F8ABC44CDBAF51437C6F0E5DB"><enum>4.</enum><header>Delay in application of rule</header><subsection id="HEA683EB6777B464D825AA81EBF32E334"><enum>(a)</enum><header>In general</header><text>The restart rule published by the Department of Transportation in the Federal Register on December 27, 2011, shall have no force or effect during the period beginning on the date of the enactment of this Act and ending 6 months after the Comptroller General submits the report required under section 3(c).</text></subsection><subsection id="H1A6880CDB5AF43979B358FF2FC798A1A"><enum>(b)</enum><header>Application of previous rule provision</header><text>The 34-hour restart rule issued on April 28, 2003 (68 Fed. Reg. 22456), shall be in effect during the period described in subsection (a).</text></subsection><subsection id="H01A62513E20147649785899518128E45"><enum>(c)</enum><header>December 2011 rule</header><text display-inline="yes-display-inline">The Secretary of Transportation shall not apply the rule described in subsection (a) if the conclusions of the field study completed pursuant to section 32301(a) of MAP–21 do not support or concur with the conclusions of the laboratory study on which such rule was based.</text></subsection></section></legis-body></bill>
