<distribution-code display="yes">II</distribution-code><congress>113th CONGRESS</congress><session>1st Session</session><legis-num>S. 1888</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20131220">December 20, 2013</action-date><action-desc><sponsor name-id="S221">Mrs. Feinstein</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To facilitate a land exchange involving certain National Forest System land in the Inyo National Forest, and for other purposes.</official-title></form><legis-body id="H894AF54D86554C5880339FFFA94549EE" style="OLC"><section id="id27773CF1FFF940FEB492AE36C00A92D2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Inyo National Forest Land Exchange Act</short-title></quote>.</text></section><section id="id17C5561E499B474DADD930F60B5F7F8A" section-type="subsequent-section"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to modify the use of land exchange authorities available to the Secretary of Agriculture as of the date of enactment of this Act with respect to certain land in the Inyo National Forest, California.</text></section><section id="id5F6D47088097453690491AB3FEE1D261"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this section:</text><paragraph id="idDF734BAFCA3C445499F709D518EBA46E"><enum>(1)</enum><header>Federal land</header><text>The term <term>Federal land</term> means certain National Forest System land located within the boundaries
			 of the Inyo National Forest, California, as depicted on the map entitled
			 <term>Federal Parcel</term> and dated June 2011.</text></paragraph><paragraph id="id8D9BB67B1C534422BF592A4B96B00A87"><enum>(2)</enum><header>Non-Federal land</header><text>The term <term>non-Federal land</term> means certain non-Federal land in
			 California located outside the boundaries of the Inyo National Forest, California, as depicted on
			 the maps entitled <term>DWP Parcel–Interagency Visitor Center Parcel</term>
			 and <term>DWP Parcel–Town of Bishop Parcel</term> and dated June 2011.</text></paragraph><paragraph id="id58E364A55A1F40F991B151FD27EE30DC"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></section><section id="id70AF424D404E42E99DBDB9FD1CF3760E"><enum>4.</enum><header>Special rules for Inyo National Forest Land Exchange</header><subsection id="H69CE744D1D084048B29593A978760359"><enum>(a)</enum><header>Authority To
			 accept land outside boundaries of Inyo National Forest</header><text display-inline="yes-display-inline">In any land exchange involving the
			 conveyance of the Federal land, the Secretary may accept the conveyance of the non-Federal land in exchange for the conveyance of the Federal land, if
			 the Secretary determines that acquisition of the non-Federal land is desirable
			 for National Forest System purposes.</text></subsection><subsection id="H60E0768994E74A0CAF3462ACF6D0E229"><enum>(b)</enum><header>Cash
			 equalization payment; use</header><paragraph id="idAB4D319B16CE4ABCB219EAF959BFA17D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In
			 an exchange of land under subsection (a), the Secretary may
			 accept a cash equalization payment in excess of 25 percent of the value of the Federal land.</text></paragraph><paragraph id="id1C1EFEA05DCF4A8BBE6FAEEDB648A1D0"><enum>(2)</enum><header>Disposition and use of funds</header><text display-inline="yes-display-inline">Any cash equalization payment received by the Secretary under this subsection shall be—</text><subparagraph id="id0515E7ECB49E4F708589C08FCB224DDC"><enum>(A)</enum><text display-inline="yes-display-inline">deposited into the fund established under <external-xref legal-doc="public-law" parsable-cite="pl/90/171">Public Law 90–171</external-xref> (commonly known as the <quote>Sisk Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/484a">16 U.S.C. 484a</external-xref>); and</text></subparagraph><subparagraph id="id9EB9E9AD86FA44838ADCB5625DB9D620"><enum>(B)</enum><text display-inline="yes-display-inline">available to the Secretary for the acquisition of land or interests in land for addition to the National Forest System.</text></subparagraph></paragraph></subsection><subsection id="H2D26640C8EE5403CA2D465671A6E8AA4"><enum>(c)</enum><header>No new land exchange authority</header><text>Nothing in this section grants
			 the Secretary new land exchange authority.</text></subsection></section></legis-body></bill>
