			 (b)(5), by striking <quote>2008 through 2012</quote> and inserting <quote>2013
			 through 2015</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9FDCAD1C69E14798B57A4343C1CE888E"><enum>(2)</enum><text>in each of paragraphs (1)(D) and (2) of subsection
			 (h), by striking <quote>2013</quote> and inserting
			 <quote>2016</quote>.</text></paragraph></section><section id="HE6CA5BF447B24911A756B0AFE6E2D532"><enum>112.</enum><header>Improvements to
			 award structure</header><subsection id="H9B424893D32742CEB1F87390E9883F92"><enum>(a)</enum><header>Eligibility for
			 award</header><text display-inline="yes-display-inline">Section 473A(b) of
			 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b(b)</external-xref>) is amended by striking paragraph (2) and redesignating paragraphs (3) through (5) as paragraphs (2) through (4), respectively.</text></subsection><subsection id="HC64EB54F1E94418FA2FF897381ABF2DD"><enum>(b)</enum><header>Data
			 requirements</header><text>Section 473A(c)(2) of such Act (42 U.S.C.
			 673b(c)(2)) is amended—</text><paragraph id="H33053D5E3ECE40D9B5486026F362EFAA"><enum>(1)</enum><text>in the paragraph
			 heading, by striking <quote><header-in-text level="paragraph" style="OLC">numbers of adoptions</header-in-text></quote> and inserting
			 <quote><header-in-text level="paragraph" style="OLC">rates of adoptions and
			 guardianships</header-in-text></quote>;</text></paragraph><paragraph id="HFD427100BBAC41BFBE75D6CDFDAF17F8"><enum>(2)</enum><text>by striking
			 <quote>the numbers</quote> and all that follows through <quote>section,</quote> and
			 inserting <quote>each of the rates required to be determined under this section with respect to a State and a fiscal year,</quote>; and</text></paragraph><paragraph id="id70DE8829919B4ECE96485704915ED8F8"><enum>(3)</enum><text>by inserting before the period the following: <quote>, and, with respect to the determination of  the rates related to foster child guardianships, on the basis of information reported to the Secretary under paragraph (12) of  subsection (g)</quote>.</text></paragraph></subsection><subsection id="H58AC449D036E4D03B746D1A8133086E2"><enum>(c)</enum><header>Award
			 amount</header><text>Section 473A(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b(d)</external-xref>) is
			 amended—</text><paragraph id="id55D96850F3F04B8BA54FBF5A544D735A"><enum>(1)</enum><text>in paragraph (1), by striking
			 subparagraphs (A) through (C) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H939D33810D7A45F5AC8741360CDFA52B" style="OLC"><subparagraph display-inline="no-display-inline" id="H3FE43CACADA04515995CD48E10656041"><enum>(A)</enum><text>$4,000, multiplied

				foster child adoptions in the State during the fiscal year; exceeds</text></clause><clause id="HE28EAB6CC0C94CECB1C6F2582E133692"><enum>(ii)</enum><text display-inline="yes-display-inline">the product (rounded to the nearest whole
				number) of—</text><subclause id="H38DE960F0B8F4E7AAA506E7AD317C12D"><enum>(I)</enum><text>the base rate of
				foster child adoptions for the State for the fiscal year; and</text></subclause><subclause display-inline="no-display-inline" id="HFAE58987CFB14E458B9546C81E88A946"><enum>(II)</enum><text display-inline="yes-display-inline">the number of children in foster care under
				the supervision of the State on the last day of the preceding fiscal
				year;</text></subclause></clause></subparagraph><subparagraph display-inline="no-display-inline" id="H0FCCD7C67BBB4B759355B4847014C927"><enum>(B)</enum><text>$8,000, multiplied
				by the amount (if any) by which—</text><clause id="H5F345F697BF545B1B10ED677B4A390CB"><enum>(i)</enum><text>the number of
				older child adoptions and older foster child guardianships in the State during the fiscal year; exceeds</text></clause><clause id="H3D3B1F7469C641C286BEECC0566E7852"><enum>(ii)</enum><text display-inline="yes-display-inline">the product (rounded to the nearest whole
				number) of—</text><subclause id="H6D60DD93D5494211B53B6B051359DDE4"><enum>(I)</enum><text>the base rate of
				older child adoptions and older foster child guardianships  for the State for the fiscal year; and</text></subclause><subclause display-inline="no-display-inline" id="HAC95A6E30CAE456FB40147B8935F054D"><enum>(II)</enum><text display-inline="yes-display-inline">the number of children in foster care under
				the supervision of the State on the last day of the preceding fiscal
				year who have attained age 9;</text></subclause></clause></subparagraph><subparagraph display-inline="no-display-inline" id="idF5A562F8D39D4C8DB9C1D0659553895F"><enum>(C)</enum><text>$4,500,
				multiplied by the amount (if any) by which—</text><clause id="idD7A2A73A393B4A9AA36CBF3684E014BA"><enum>(i)</enum><text>the number of
				special needs adoptions that are not older child adoptions in the State during
				the fiscal year; exceeds</text></clause><clause id="idD8BF94E2B6674EFCA92A990E5EF6010A"><enum>(ii)</enum><text display-inline="yes-display-inline">the product (rounded to the nearest whole
				number) of—</text><subclause id="id0CB7147E33344A50A581E2D94F414507"><enum>(I)</enum><text>the base rate of
				special needs adoptions that are not older child adoptions for the State for
				the fiscal year; and</text></subclause><subclause display-inline="no-display-inline" id="id949AC24BB7904CB29F7CA43924947393"><enum>(II)</enum><text display-inline="yes-display-inline">the number of children in foster care under
				the supervision of the State on the last day of the preceding fiscal
				year who have not attained age 9;  and</text></subclause></clause></subparagraph><subparagraph display-inline="no-display-inline" id="H4D54664C38C0440EB6234FAC4F791798"><enum>(D)</enum><text>$4,000, multiplied
				by the amount (if any) by which—</text><clause id="H1A4EC5F94DA2487AAABF0F39E50CCC70"><enum>(i)</enum><text>the number of
				foster child guardianships in the State during the fiscal year; exceeds</text></clause><clause id="HDB6DBA222B1D49CBA12348B0C3D41A27"><enum>(ii)</enum><text display-inline="yes-display-inline">the product (rounded to the nearest whole
				number) of—</text><subclause id="HF9BA3B31E8A44B95A42A5E6132F05E5B"><enum>(I)</enum><text>the base rate of
				foster child guardianships for the State for the fiscal year; and</text></subclause><subclause display-inline="no-display-inline" id="HFE8D7E7567D54F45A335EE3D1E7FD4AD"><enum>(II)</enum><text display-inline="yes-display-inline">the number of children in foster care under
				the supervision of the State on the last day of the preceding fiscal year.</text></subclause></clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block></paragraph><paragraph id="id579B164350954321A8C6E72737CAB0DE"><enum>(2)</enum><text>by striking
			 paragraph (3) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id3D130F19ED5A4E9FBF200BC827F63DE6" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="ID71D2BC0B984846FD9A0CD5D30CAFD4EA"><enum>(3)</enum><header display-inline="yes-display-inline">Increased adoption and legal guardianship incentive payment for timely adoptions</header><subparagraph commented="no" display-inline="no-display-inline" id="IDF5361E351DB44FE2B5AF8469B93B7121"><enum>(A)</enum><header>In general</header><text>If for any of fiscal years 2013 through 2015, the total amount of adoption and legal guardianship incentive payments payable under paragraph (1) of this subsection are less than the amount appropriated under subsection (h) for the fiscal year, then, from  the remainder of the amount appropriated for the fiscal year that is not required for such payments (in this paragraph referred to as the <term>timely adoption award pool</term>), the Secretary shall increase the adoption incentive payment determined under paragraph (1) for each State that the Secretary determines is a timely adoption award State for the fiscal year by the award amount determined for the fiscal year under subparagraph (C) .</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC00A1F1494D34F1A98D8F0126DF542B3"><enum>(B)</enum><header>Timely adoption award State defined</header><text>A State is a timely adoption award State for a fiscal year if the State is one of the 50 States or the District of Columbia and the Secretary determines that more than 50 percent of  the foster child adoptions that were finalized in the State  during the fiscal year were for children for whom an adoption was finalized not more than 12 months after the date on which the child becomes legally free for adoption.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0BF1CFD97E614C8B9E737B6DB340DA5C"><enum>(C)</enum><header>Award amount</header><text>For purposes of subparagraph (A), the award amount determined under this subparagraph with respect to a fiscal year is the amount equal to the product of—</text><clause id="IDB3E06B94291443A3955A48C95D82BFD2"><enum>(i)</enum><text>the timely adoption award pool for the fiscal year; and</text></clause><clause id="ID68421A9651614607BB4AAD7B33C3FBF3"><enum>(ii)</enum><text>the number of timely adoption award States for the fiscal year.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H34E4A955CC074D2D83D4483AEE621E6B"><enum>(d)</enum><header>Definitions</header><text>Section
			 473A(g) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b(g)</external-xref>) is amended by striking paragraphs (1)
			 through (8) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id460C1109487F4445AB9762A48B9F6B37" style="OLC"><paragraph id="HE7D00AD47E104F258996A8DB24FA910D"><enum>(1)</enum><header>Foster child
				adoption rate</header><text display-inline="yes-display-inline">The term
				<term>foster child adoption rate</term> means, with respect to a State and a
				fiscal year, the percentage determined by dividing—</text><subparagraph id="H920330493A994C6B9B90241F75BAABA3"><enum>(A)</enum><text>the number of
				foster child adoptions finalized in the State during the fiscal year; by</text></subparagraph><subparagraph id="H0C90991AC8EF4222B87CA2E9F7D8F104"><enum>(B)</enum><text>the number of
				children in foster care under the supervision of the State on the last day of
				the preceding fiscal year.</text></subparagraph></paragraph><paragraph commented="no" id="H148465D9C7E243F6938FA24436ADAEB9"><enum>(2)</enum><header>Base rate of
				foster child adoptions</header><text display-inline="yes-display-inline">The term <term>base rate of foster child
				adoptions</term> means, with respect to a State and a fiscal year, the average of the foster child
				adoption rate for the State for the immediately preceding 3 fiscal years.</text></paragraph><paragraph id="H6AF13321AEE340BDAAF0497507D43733"><enum>(3)</enum><header>Foster child
				adoption</header><text display-inline="yes-display-inline">The term
				<term>foster child adoption</term> means the final adoption of a child who, at
				the time of adoptive placement, was in foster care under the supervision of the
				State.</text></paragraph><paragraph id="id7DC5E33EE8AC4F5FA251363A151DE94F"><enum>(4)</enum><header>Special needs
				adoptions that are not older child adoptions rate</header><text display-inline="yes-display-inline">The term <term>special needs adoptions that
				are not older child adoptions rate</term> means, with respect to a State and a
				fiscal year, the percentage determined by dividing—</text><subparagraph id="id4AC92DDC4C0443C78985AA0BE5FCD3BC"><enum>(A)</enum><text>the number of
				special needs adoptions that are not older child adoptions finalized in the
				State during the fiscal year; by</text></subparagraph><subparagraph id="id648771C3C71D419CBFD463F09C74064E"><enum>(B)</enum><text>the number of
				children in foster care under the supervision of the State on the last day of
				the preceding fiscal year who have not attained age 9.</text></subparagraph></paragraph><paragraph commented="no" id="idEFA0DC04D422403AA7A859791DE0A347"><enum>(5)</enum><header>Base rate of
				special needs adoptions that are not older child adoptions</header><text display-inline="yes-display-inline">The term <term>base rate of special needs
				adoptions that are not older child adoptions</term> means, with respect to a
				State and a fiscal year, the average of the special needs
				adoptions that are not older child adoptions rate for the State for the immediately preceding 3 fiscal years.</text></paragraph><paragraph id="idABD689F968C64FF78AF1EA78B8BB4EB6"><enum>(6)</enum><header>Special needs
				adoptions that are not older child adoptions</header><text>The term <term>special needs adoptions that are not older child adoptions</term> means the
				final adoptions of all children who have not attained age 9 and for whom an adoption assistance agreement is in
				effect under section 473.</text></paragraph><paragraph display-inline="no-display-inline" id="HE9EC30CB034B4F838D771C7B67DA0A8B"><enum>(7)</enum><header>Older child
				adoptions  and older foster child guardianships rate</header><text display-inline="yes-display-inline">The term
				<term>older child adoptions and older foster child guardianships rate</term> means, with respect to a State and a
				fiscal year, the percentage determined by dividing—</text><subparagraph id="H7BF3FAD4FDEB487A8C4CA42C8BCAFA72"><enum>(A)</enum><text>the number of
				older child adoptions and older foster child guardianships  finalized in the State during the fiscal year; by</text></subparagraph><subparagraph id="H2005DFEEB9D24F93B3B0585BCB29DDC0"><enum>(B)</enum><text display-inline="yes-display-inline">the number of children in foster care under
				the supervision of the State on the last day of the preceding fiscal year, who
				have attained 9 years of age.</text></subparagraph></paragraph><paragraph commented="no" id="H2F0F081208F74CF584793FD2F6215E45"><enum>(8)</enum><header>Base rate of
				older child adoptions and older foster child guardianships</header><text display-inline="yes-display-inline">The term <term>base rate of older child
				adoptions and older foster child guardianships</term> means, with respect to a State and a fiscal year, the average of the older child
				adoptions and older foster child guardianships rate for the State for the immediately preceding 3 fiscal years.</text></paragraph><paragraph id="HEABFC7B956E84EB1AC35739A19A9AA9A"><enum>(9)</enum><header>Older child
				adoptions and older foster child guardianships</header><text display-inline="yes-display-inline">The term
				<term>older child adoptions and older foster child guardianships</term> means the final adoption, or the placement into legal guardianship, of all children who have
				attained 9 years of age and—</text><subparagraph id="HACA3D76D11D34B8C95298E34C878F614"><enum>(A)</enum><text>at the time of the
				adoptive or legal guardianship placement, were in foster care under the supervision of the
				State; or</text></subparagraph><subparagraph id="HC2BEF6E587DA4E7BB526D0C306BB4181"><enum>(B)</enum><text>for whom an adoption
				assistance agreement was in effect under section 473.</text></subparagraph></paragraph><paragraph id="HDBDB0361DFDA4C4CA70D5C144ECB6F05"><enum>(10)</enum><header>Foster child
				guardianship rate</header><text>The term <term>foster child guardianship
				rate</term> means, with respect to a State and a fiscal year, the percentage
				determined by dividing—</text><subparagraph id="H295981DDC11A497D8C12B3D2899B6EE6"><enum>(A)</enum><text>the number of
				foster child guardianships that occurred in the State during the fiscal year;
				by</text></subparagraph><subparagraph id="H6DD10933095444F6B539A10D4E8E680D"><enum>(B)</enum><text>the number of
				children in foster care under the supervision of the State on the last day of
				the preceding fiscal year.</text></subparagraph></paragraph><paragraph commented="no" id="H31A0976BD30E49589825EE1543183FC9"><enum>(11)</enum><header>Base rate of
				foster child guardianships</header><text>The term <term>base rate of foster
				child guardianships</term> means, with respect to a State and a fiscal year,
				the average of the foster child
				guardianship rate for the State for the immediately preceding 3 fiscal years.</text></paragraph><paragraph id="HBD3ED2B107D44918BE51A2DC2933247C"><enum>(12)</enum><header>Foster child guardianship</header><text display-inline="yes-display-inline">The term <term>foster child guardianship</term> means, with respect to a State, the exit of a child from foster care under the responsibility of the State to live with a legal guardian, if the State has reported to the Secretary—</text><subparagraph id="H03C4E6FF0D4F47E0A0A4F99F19FE875C"><enum>(A)</enum><text display-inline="yes-display-inline">that the State agency has determined that—</text><clause id="HF42C282F04AA4ACC92DDCB87DA403DAB"><enum>(i)</enum><text>the child has been removed from his or her home pursuant to a voluntary placement agreement or as a result of a judicial determination to the effect that continuation in the home would be contrary to the welfare of the child;</text></clause><clause id="H6E88D246F8D440BE824017AEC6929DB4"><enum>(ii)</enum><text>being returned home is not an appropriate option for the child;</text></clause><clause id="H3BD632B983374A29AC26FDB958D1A704"><enum>(iii)</enum><text>the child demonstrates a strong attachment to the prospective legal guardian, and the prospective legal guardian has a strong commitment to caring permanently for the child; and</text></clause><clause id="H462292BD7DCC49FD94046DE63BC62CBA"><enum>(iv)</enum><text>if the child has attained 14 years of age, the child has been consulted regarding the legal guardianship arrangement; or</text></clause></subparagraph><subparagraph id="HAA37B2F594B04FDE86CEB76A5127059C"><enum>(B)</enum><text>the alternative procedures used by the State to determine that legal guardianship is the appropriate option for the child.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HF14313F3AF094CF8948AA5FC0C1179CD"><enum>113.</enum><header>Renaming of program</header><subsection id="HAA9F4C52977E4FA58C2AD141033BE192"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The section heading of section 473A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HAC44909EDD0C42A99E491B9205F760A9" style="OLC"><section id="HAF2B482F66DF4C7D80C814958858783E"><enum>473A.</enum><header>Adoption and legal guardianship incentive payments</header></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE76A838D1E154005B193DB678E5DC6BE"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="HAA9347B842744D8AA6E8F07D41763F89"><enum>(1)</enum><text display-inline="yes-display-inline">Section 473A of such Act is amended in each of subsections (a), (d)(1), (d)(2)(A), and (d)(2)(B) (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b(a)</external-xref>, (d)(1), (d)(2)(A), and (d)(2)(B)) by inserting <quote>and legal guardianship</quote> after <quote>adoption</quote> each place it appears.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6EBAA03C2A234C8D87BBB621F1E1B882"><enum>(2)</enum><text>The heading of section 473A(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b(d)</external-xref>) is amended by inserting <quote><header-in-text level="subsection" style="OLC">and legal guardianship</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">adoption</header-in-text></quote>.</text></paragraph></subsection></section><section id="HA55C44F86AD44A20ABF1C5FD51DD4582"><enum>114.</enum><header>Limitations on use of incentive payments</header><text display-inline="no-display-inline">Section 473A(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b(f)</external-xref>) is amended—</text><paragraph id="id6271F59FE1734399B86308621CA19E1F"><enum>(1)</enum><text display-inline="yes-display-inline">in the first sentence, by inserting <quote>, and shall use the amount to supplement, and not supplant, any Federal or non-Federal funds used to provide any service under part B or E</quote> before the period;</text></paragraph><paragraph id="idD8DF5DAFCF6245B692A307E19C6D2E9D"><enum>(2)</enum><text>by inserting after the first sentence, the following: <quote>In the case of any State that is paid an incentive payment under this section for a fiscal year that exceeds $100,000,   the State shall use at least 25 percent of the
				incentive payment made to the State for that fiscal year to provide services for children who have been reunified with their families, including services to youth who, after emancipating from foster care, return to their families, to support and sustain these reunifications.</quote>; and</text></paragraph><paragraph id="id6A2850A50EE942B6811C2C992BFA8165"><enum>(3)</enum><text>by striking <quote>the preceding sentence</quote> and inserting <quote>this subsection</quote>.</text></paragraph></section><section id="H1750B7D02ED847178E9CE2B99CC8560E"><enum>115.</enum><header>State report on calculation and use of savings resulting from the phase-out of eligibility requirements for adoption assistance; requirement to spend 40 percent of savings on certain services</header><text display-inline="no-display-inline">Section 473(a)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673(a)(8)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H577D51C232C34822B8D46FC7FB41A3AE" style="OLC"><paragraph id="H9C7E0030E970486496BAD3648B6CC278" indent="up1"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H1D51B50303A94D57A0516B1BC1E399EB"><enum>(A)</enum><text display-inline="yes-display-inline">A State shall calculate the savings (if any) resulting from the application of paragraph (2)(A)(ii) to all applicable children for a fiscal year, using a methodology specified by the Secretary or an alternate methodology proposed by the State and approved by the Secretary.</text></subparagraph><subparagraph id="HEBD88DB9804B46148AFA762D45FAF3F8" indent="up1"><enum>(B)</enum><text>A State shall annually report to the Secretary—</text><clause id="H34A12ECD270C4B1FBE9D333AB8293A45"><enum>(i)</enum><text>the methodology used to make the calculation described in subparagraph (A), without regard to whether any savings are found;</text></clause><clause id="HAEB110F2B2764FA785FF3E21C840434A"><enum>(ii)</enum><text>the amount of any savings referred to in subparagraph (A); and</text></clause><clause id="H038001827D2B48F0A2078CAC752442D7"><enum>(iii)</enum><text display-inline="yes-display-inline">how any such savings are spent, accounting for and reporting the spending separately from any other spending reported to the Secretary under part B or E.</text></clause></subparagraph><subparagraph id="H4010F209A97447ADB216BCDC73D36C0B" indent="up1"><enum>(C)</enum><text>The Secretary shall make all information reported pursuant to subparagraph (B) (including the information required under subparagraph (D)(iii)) available on the website of the Department of Health and Human Services in a location easily accessible to the public.</text></subparagraph><subparagraph id="H618F4FE60E2A42668C363C9C087D52BD" indent="up1"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="idCD3ECB620402462EB737C00129EF7B98"><enum>(i)</enum><text display-inline="yes-display-inline">A State shall spend an amount equal to the amount of the savings (if any) in State expenditures under this part resulting from the application of paragraph (2)(A)(ii) to all applicable children for a fiscal year, to provide to children of families any service that may be provided under this part or part B, and shall spend not less than 40 percent of any such savings on—</text><subclause id="idA2658D1C8DF1411989841402A43CEC27" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">post-adoption or post-guardianship services (as applicable)  for children placed in adoptive,
				kinship guardianship, or guardianship placements and their families; and</text></subclause><subclause id="id96C3EE4CB20D41D3B6A245D16B864257" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">services to support and sustain positive permanent outcomes for children who otherwise might enter into foster care under the responsibility of the State.</text></subclause></clause><clause id="id68F9E4AF0DC348CAA25A5CEBF0A77EA6" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">Any spending by a State in accordance with this subparagraph shall be used to supplement, and not supplant, any Federal or non-Federal funds used to provide any service under part B or E.</text></clause><clause id="idCFC821C5E1D5485BA4F875F45B874BCE" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">A State shall include in the annual report submitted to the Secretary under subparagraph (B) a detailed account, in such form and manner as the Secretary shall require, of the services funded by the State to satisfy the requirements of   clause (i) of this subparagraph.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HC2D28544D49B4D82ABEE616E28E33759"><enum>116.</enum><header>Preservation of eligibility for kinship guardianship assistance payments with a successor guardian</header><text display-inline="no-display-inline">Section 473(d)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673(d)(3)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H8F7F5D342AA241E2A85934EDC32273AE" style="OLC"><subparagraph id="H60131208A88F48F89E74A81774D68D7F"><enum>(C)</enum><header>Eligibility not affected by replacement of guardian with a successor guardian</header><text display-inline="yes-display-inline">In the event of the death or incapacity of the relative guardian, the eligibility of a child for a kinship guardianship assistance payment under this subsection shall not be affected by reason of the replacement of the relative guardian with a successor legal guardian named in the kinship guardianship assistance agreement referred to in paragraph (1) (including in any amendment to the agreement), notwithstanding subparagraph (A) of this paragraph and section 471(a)(28).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id8C8043D3FAAD4E53ADF2CA4BB9A133FE"><enum>117.</enum><header>Data collection
			 on adoption and foster child guardianship  disruption and dissolution</header><subsection id="id218380C33CFD49A6B1FD9893804270C4"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 479 of the
			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/679">42 U.S.C. 679</external-xref>) is amended by adding at the end the
			 following new subsection:</text><quoted-block display-inline="no-display-inline" id="id32468A1205BC4AFA83B18F70A583CDAC" style="OLC"><subsection id="idFD26712001F74BCDA7722970BCA68C45"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id4BCCD626D54C46B3ABDB36A1E4E29355"><enum>(1)</enum><text>Not later than 12
				months after the date of enactment of the <short-title>Strengthening And Finding Families for Children Act</short-title> the
				Secretary shall, as part of the data collection system established under this
				section, promulgate final regulations providing for the collection and analysis
				of information regarding children who enter into foster care under the supervision of a State as a result of
				the disruption of a placement for adoption or foster child guardianship or the dissolution of an adoption or foster child guardianship. The regulations
				shall require each State with a State plan approved under this part and part B to collect and report as part of such data collection system and, as appropriate, to report supplementary, descriptive, or spending information required separate from such system and, as appropriate, as part of other reports required under this part or part B, the information specified in paragraph (2).</text></paragraph><paragraph id="id1D3B5241FECF40A19DF95E9504A4BDC1" indent="up1"><enum>(2)</enum><text>The regulations promulgated under paragraph (1) shall require a State to collect and report the following information:</text><subparagraph id="id08B6A792CB3D4811B98202930793C01C"><enum>(A)</enum><text>Information on children born in  the United States who are
				adopted or placed in a foster child guardianship and who enter into foster care under the supervision of the State as a result of the disruption of a placement for adoption or foster child guardianship or the
				dissolution of an adoption or foster child guardianship, including—</text><clause id="id111B48B1B49F42F7BC92E23358FEE749"><enum>(i)</enum><text>the number of such children who enter
				into foster care under the supervision of the State as a result of—</text><subclause id="idA34EC59345174879AB17E6D5CE5A37B9"><enum>(I)</enum><text>the disruption of placement for adoption;</text></subclause><subclause id="idB523D587C3EE4A1A867113C6955D49C2"><enum>(II)</enum><text>the disruption of placement for foster child guardianship;</text></subclause><subclause id="idF5D81F36BF774B89B3244A6766A17B42"><enum>(III)</enum><text>the dissolution of an adoption; or</text></subclause><subclause id="id2D72FDDDEFA9484980C0652759E6EAE8"><enum>(IV)</enum><text>the dissolution of a foster child guardianship; and</text></subclause></clause><clause id="id048C11DFDC5C42E5B295D1810DF3B878"><enum>(ii)</enum><text>for each child identified under
				clause (i)—</text><subclause id="id74DAF3C5921B47F9AFD96162FDB9D5B1"><enum>(I)</enum><text>the length of the adoption or foster child guardianship placement
				prior to disruption or dissolution;</text></subclause><subclause id="id2671501C90BA4CB0A59AC04EB3E4070B"><enum>(II)</enum><text>the age of the child at the time of the
				disruption or dissolution;</text></subclause><subclause id="id1893E2A2824E40EC9905B6155FC824B4"><enum>(III)</enum><text>the reason for the disruption or
				dissolution, as well as illustrative or supplementary materials that provide elaboration for the reason; and</text></subclause><subclause id="id9D4CAFC513DA457D9C590B5C9FDEB442"><enum>(IV)</enum><text>the agencies who handled the placement
				for adoption or foster child guardianship.</text></subclause></clause></subparagraph><subparagraph id="id4B68DC2BA051437F92BAA8E7F86B7CE9"><enum>(B)</enum><text>Information on children born in a country other than the United States who enter into foster care under the supervision of the State as a result of the disruption of a placement for adoption or the dissolution of an adoption, including—</text><clause id="id52EA3796439D4E01856014309FBF338F"><enum>(i)</enum><text>the number of such children who enter
				into foster care under the supervision of the State as a result of—</text><subclause id="idD342367AB0E94C48B11B17D1768AC348"><enum>(I)</enum><text>the disruption of placement for adoption; or</text></subclause><subclause id="idD38877C835F74120A03E5C63878F697F"><enum>(II)</enum><text>the dissolution of an adoption;</text></subclause></clause><clause id="id14B29674A70A480890B573F4F1F63D6D"><enum>(ii)</enum><text>for each child identified under
				clause (i)—</text><subclause id="id2CBC01D2BFD4479BAB6F98DFC25DD3FF"><enum>(I)</enum><text>the child's country of birth and, if different, the country from which the child originally was placed for adoption;</text></subclause><subclause id="id12D5D2ECF00140A68E352F473BE12549"><enum>(II)</enum><text>the length of the adoption placement
				prior to disruption or dissolution;</text></subclause><subclause id="id2AE74811EBA54A4A8E9CCCD6ED0C10F0"><enum>(III)</enum><text>the age of the child at the time of the
				disruption or dissolution;</text></subclause><subclause id="idCAD0D07CC64F4E0D9865753501F1994B"><enum>(IV)</enum><text>the reason for the disruption or
				dissolution, as well as illustrative or supplementary materials that provide elaboration for the reason; and</text></subclause><subclause id="idFFC1AEAF35264CFC855BA680385E21E6"><enum>(V)</enum><text>the agencies who handled the placement
				for adoption; and</text></subclause></clause></subparagraph><subparagraph id="idAA71FFAFDB314668B011256A5043B973"><enum>(C)</enum><text>A description of the pre- and post-adoptive
				support services that
				the State has determined result in lower rates of disruption and dissolution of adoptions or foster child guardianships.</text></subparagraph><subparagraph commented="no" id="idE7C8424772F84D999A1BEB80D881FC09"><enum>(D)</enum><text>Information on how the State spends funds paid to the State from an allotment for the State under section 433 to promote adoption, and, separately, to provide pre and post-adoptive support services.</text></subparagraph><subparagraph id="idAE7BE972C4224BB8B7635849A232E149"><enum>(E)</enum><text>Such other information as determined
				appropriate by the Secretary.</text></subparagraph></paragraph><paragraph id="id82AF191EBAB24A9080A9B4D9C03CCD5A" indent="up1"><enum>(3)</enum><text>For purposes of  this subsection, the term <term>foster child guardianship</term> has the meaning given that term in section 473A(g)(12).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id0B133C1AD6CE4F528F80B48C583C2EBF"><enum>(b)</enum><header>Annual
			 report</header><text>Section 479A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/679b">42 U.S.C. 679b</external-xref>)
			 is amended—</text><paragraph id="idB8B90144B2BB4BB08521B6633EA94F34"><enum>(1)</enum><text>in paragraph (5),
			 by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="idD9AAF78E162B453791F25A8C6E4C88FB"><enum>(2)</enum><text>in paragraph (6),
			 by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id7E454B6643F84384A3B7CA2856DA2B97"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="id71AE80B7824A43D7840E940CBC7ADA75" style="OLC"><paragraph id="idF849AD40783A4BAC8AFB4ACDBC9F010D"><enum>(7)</enum><text>include in the
				report submitted pursuant to paragraph (5) for fiscal year 2016 or any
				succeeding fiscal year, national and State-by-State data on the numbers and
				rates of disruptions and dissolutions of adoptions, as collected pursuant to
				section
				479(d).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idA95FCE9D58FA451C99D01652847C827A"><enum>118.</enum><header>Encouraging the placement of children in foster care with siblings</header><subsection id="idAD9671BC406A4DE6ABC7D0B27AAF387D"><enum>(a)</enum><header>State plan amendment</header><paragraph id="idC8796CA30E044B80AAABC0EFD167A7B5"><enum>(1)</enum><header>Notification of parents of siblings</header><text>Section 471(a)(29) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)(29)</external-xref>) is amended by striking <quote>all adult grandparents</quote> and inserting <quote>the following relatives: all adult grandparents, all parents of a sibling of the child, where such parent has legal custody of such sibling,</quote>.</text></paragraph><paragraph id="id943DAA73579643ED9CE239AD584B77D4"><enum>(2)</enum><header>Sibling defined</header><text>Section 475 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id5A4F3071E26D4E18A66624EA8BB93E89" style="OLC"><paragraph id="idC5ECD10FD7B449FEA2BDD0D4390EFA03"><enum>(9)</enum><text>The term <term>sibling</term> means an individual who satisfies at least one of the following conditions with respect to a child:</text><subparagraph id="idD9F79719099C4EE4A6A5E389F291D8C9"><enum>(A)</enum><text>The individual is considered by State law to be a sibling of the child.</text></subparagraph><subparagraph id="id4BCDD0E521AE4CCAA3FB85EB5BC05D89"><enum>(B)</enum><text>The individual would have been considered a sibling of the child under State law but for a termination or other disruption of parental rights, such as the death of a parent.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id75D50075F12F4E04BCB71660B58A939A"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed as subordinating the rights of foster or adoptive parents of a child to the rights of the parents of a sibling of that child.</text></subsection></section><section id="H91207B5521B3472EBFEF6F1DB59FD4F7"><enum>119.</enum><header>Effective dates</header><subsection id="H52B12638CCD641A7A86DB91C9A8AD34E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this section, the amendments made by this subtitle shall take effect as if enacted on October 1, 2013.</text></subsection><subsection id="H3189439920714755BF631F8E7273E0B9"><enum>(b)</enum><header>Restructuring and renaming of program</header><paragraph id="H71A8001F99D24616AA5C007ED11BA9B0"><enum>(1)</enum><header>In general</header><text>The amendments made by sections 112 and 113 shall take effect on October 1, 2014, subject to paragraph (2).</text></paragraph><paragraph id="HE1C3D80DCA9249A3B444047F8701413E"><enum>(2)</enum><header>Transition rule</header><subparagraph id="idF9E769177D834BBDAF7C79D1E5F6CC49"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, the total amount payable to a State under section 473A of the Social Security Act for fiscal year 2014 shall be an amount equal to <fraction>1/2</fraction> of the sum of—</text><clause id="HC4B45CFD358D4B44A98F97239AB3344D"><enum>(i)</enum><text>the total amount that would be payable to the State under such section for fiscal year 2014 if the amendments made by section 112 of this Act had not taken effect; and</text></clause><clause id="H81B3B769D34F4303AE65B9723C6AFC9A"><enum>(ii)</enum><text display-inline="yes-display-inline">the total amount that would be payable to the State under such section for fiscal year 2014 in the absence of this paragraph.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDB5CBD2E4F0646BFBAAA33B272A4EB2D"><enum>(B)</enum><header display-inline="yes-display-inline">Pro rata adjustment if insufficient funds available</header><text display-inline="yes-display-inline">If the total amount otherwise payable under subparagraph (A) for fiscal year 2014 exceeds the amount appropriated pursuant to section 473A(h) of the Social Security Act  (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b(h)</external-xref>) for that fiscal year, the amount payable to each State under subparagraph (A) for fiscal year 2014 shall be—</text><clause commented="no" display-inline="no-display-inline" id="IDF4B53B5831994895AA8EFE37C8E6E88D"><enum>(i)</enum><text>the amount that would otherwise be payable to the State under subparagraph (A) for fiscal year 2014; multiplied by</text></clause><clause commented="no" display-inline="no-display-inline" id="IDAC58470D08D44BC3BA128372C79E167D"><enum>(ii)</enum><text>the percentage represented by the amount so appropriated for fiscal year 2014, divided by the total amount otherwise payable under subparagraph (A) to  all States for that fiscal year.</text></clause></subparagraph></paragraph></subsection><subsection id="id02D7AC68EEA34342B64DD3CFEC1F92D8"><enum>(c)</enum><header>Promoting sibling connections</header><paragraph id="id4D34297EA83C48CDA0BA341689FF3BD4"><enum>(1)</enum><header>In general</header><text>The amendments made by section 118  shall take effect on the date of enactment of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id13F470206FA54E20A8E70A1AF3F13DB3"><enum>(2)</enum><header>Delay permitted if State legislation required</header><text>In the case of a State plan approved under part E of title IV of the Social Security Act which the Secretary of Health and Human Services determines requires State legislation (other than legislation appropriating funds) in order for the plan to meet the additional requirements imposed by section 118, the State plan shall not be regarded as failing to comply with the requirements of such part solely on the basis of the failure of the plan to meet such additional requirements before the 1st day of the 1st calendar quarter beginning after the close of the 1st regular session of the State legislature that ends after the 1-year period beginning with the date of enactment of this Act. 				screening, and to determine appropriate State action and services, any child
				who the State has reasonable cause to believe is a victim of sex trafficking
				(as defined in section 103(10) of the Trafficking Victims Protection Act of
				2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102(10)</external-xref>)) or a severe form of trafficking in persons described
				in paragraph (9)(A) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102(9)(A)</external-xref>) or is at risk of being a
				victim of either kind of trafficking (including at the option of the State, any
				individual who has not attained age 26 without regard to whether that
				individual is or was in foster care under the responsibility of the State);
				and</text></clause><clause commented="no" display-inline="no-display-inline" id="idBEFB37474DD24BBAAA855B5872835253"><enum>(ii)</enum><text display-inline="yes-display-inline">2 years after the date of enactment of the <short-title>Protecting Youth At-Risk for Sex Trafficking Act</short-title>, demonstrate to the
				Secretary that it is implementing, in consultation with the child protective
				services agency or unit for the State, the policies and procedures developed under
				clause
				(i).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id9F8C21381E864273968C86AF9A88F038"><enum>212.</enum><header>Improvements
			 to another planned permanent living arrangement as a permanency option</header><subsection id="id8D0834137604457887BB21C7CF130F50"><enum>(a)</enum><header>Elimination of
			 the option for children under age 16</header><paragraph id="id221ADEEB88984E3F9A51DC90C446CB5E"><enum>(1)</enum><header>In
			 general</header><text>Section 475(5)(C) of the Social Security Act (42 U.S.C.
			 675(5)(C)) is amended by inserting <quote>only in the case of a child who has
			 attained age 16</quote> before <quote>(in cases where the State agency has
			 documented</quote>.</text></paragraph><paragraph id="id94370F399E404763A9F301ECDC576B78"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 422(b)(8)(A)(iii)(II) of such Act (42 U.S.C.
			 622(b)(8)(A)(iii)(II)) is amended by inserting <quote>, subject to the
			 requirements of paragraphs (5)(C) and (10) of section 475</quote> after
			 <quote>arrangement</quote>.</text></paragraph></subsection><subsection id="id7B6D0888017149BCB7E963DDC7EF12B2"><enum>(b)</enum><header>Additional
			 requirements</header><paragraph id="idD85AAF54FBF947F6AD515A5C2892C29E"><enum>(1)</enum><header>In
			 general</header><text>Part E of title IV of the Social Security Act (42 U.S.C.
			 670 et seq.) is amended by inserting after section 475 the following new
			 section:</text><quoted-block display-inline="no-display-inline" id="idA441AAC2DDEC4176B64A1E61DEE6CBBA" style="traditional"><section id="id497CE398241444F7A540458E9A22BBEE"><enum>475A.</enum><header>Additional case plan and case review system
		  requirements</header><subsection commented="no" display-inline="yes-display-inline" id="id9B9D063A6F4C4B0F8F0730DE3D6D4EB2"><enum>(a)</enum><header>Requirements for
				another planned permanent living arrangement</header><text>In the case of any
				child for whom another planned permanent living arrangement is the permanency
				plan for the child, the following requirements shall apply for purposes of
				approving the case plan for the child and the case system review procedure for
				the child:</text><paragraph id="id4311631432E7493CB86205BAAD15FE25"><enum>(1)</enum><header>Documentation
				of intensive, ongoing, unsuccessful efforts for family
				placement</header><text>At each permanency hearing held with respect to the
				child, the State agency documents the intensive, ongoing, and, as of the date
				of the hearing, unsuccessful efforts made by the State agency to return the
				child home, place the child with a fit and willing relative, place the child with a legal guardian, or place the child for adoption,  including through efforts that utilize
				search technology to find biological family members for children in the child
				welfare system.</text></paragraph><paragraph id="id01573A1ECF2643A7A4CB9DD0A40CCB35"><enum>(2)</enum><header>Redetermination
				of appropriateness of placement at each permanency hearing</header><text>At
				each permanency hearing held with respect to the child, the court or
				administrative body appointed or approved by the court conducting the hearing
				on the permanency plan for the child shall do the following:</text><subparagraph id="id1D7110959A92455FA47A0D0AA51958DE"><enum>(A)</enum><text>Ask the child if
				the child wants to be adopted.</text></subparagraph><subparagraph id="idF93892101A6B441FB9C26B4AD39431A9"><enum>(B)</enum><text>Make a judicial
				determination of a compelling reason with respect to each of the following
				options for why it continues to be not in the best interests of the child
				to—</text><clause id="id510CE916B294431C9D2334D8CD9B253E"><enum>(i)</enum><text>return
				home;</text></clause><clause id="idC60FD5445FFE4766B2F2A2597EADD4B8"><enum>(ii)</enum><text>be placed with a
				fit and willing relative;</text></clause><clause id="id99D073A49A774BD79F19B4BB3AF9A912"><enum>(iii)</enum><text>be placed with
				a legal guardian; or</text></clause><clause id="idE4808FE35F2746CFAE70BCE4C0E8B802"><enum>(iv)</enum><text>be placed for
				adoption.</text></clause></subparagraph><subparagraph id="idF8AFA93BCD994724904627E5F5259E51"><enum>(C)</enum><text>Identify the
				barriers to permanency plans other than another planned permanent living
				arrangement for the child.</text></subparagraph><subparagraph id="idB0CE60C493D2401DA92813DCD0A35081"><enum>(D)</enum><text>Make a new
				determination that another planned permanent living arrangement is the
				appropriate permanency plan for this child and submit findings as to why, as of
				the date of the hearing, another planned permanent living arrangement is the
				best permanency plan for the child.</text></subparagraph><subparagraph id="id621B50400A564AED97062428B686FA4E"><enum>(E)</enum><text>Require the State
				agency to document at the next permanency hearing held with respect to the
				child the intensive, ongoing, efforts made by the State agency to address such
				barriers and allow a different permanency plan for the child.</text></subparagraph></paragraph><paragraph id="id935FB0B8268E49CF82F32CF671ED4667"><enum>(3)</enum><header>Demonstration
				of support for engaging in age or developmentally appropriate activities and
				social events</header><text>The State agency shall appear before the court or
				administrative body appointed or approved by the court and demonstrate, not
				less frequently than every 6 months while the child is placed in another
				planned permanent living arrangement—</text><subparagraph id="id2DBB7ACA8C8A4052A76FFE014539560A"><enum>(A)</enum><text>the steps the
				State agency is taking, including with respect to reducing barriers such as
				paper work or other documentation, to ensure the child has regular, ongoing
				opportunities to engage in age or developmentally appropriate activities,
				including social events; and</text></subparagraph><subparagraph id="idB6C70CAA5D6F4B1FBDC102EC49794C87"><enum>(B)</enum><text>that an
				individual, other than a caseworker, is the caregiver for the child for
				purposes of the reasonable and prudent parent standard (as defined in section 475(9)), including with respect
				to authority for signing permission slips and giving informal permission for
				the child to participate in age or developmentally appropriate activities,
				including social
				events.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idF6DB73174430441C87E6B4CBBB2A2074"><enum>(2)</enum><header>Conforming
			 amendments</header><subparagraph id="id578DBF75443D428D9A6D69469E3C28BD"><enum>(A)</enum><header>State plan
			 requirements</header><clause id="idB152BD4171A34A07AF860A26B4520FD3"><enum>(i)</enum><header>Part

				<term>reasonable and prudent parent standard</term> means the standard
				characterized by careful and sensible parental decisions that maintain a
				child's health, safety, and best interests while at the same time encouraging
				the child's emotional and developmental growth, that a caregiver shall use when
				determining whether to allow a child in foster care under the responsibility of
				the State to participate in extracurricular, enrichment, and social
				activities.</text></subparagraph><subparagraph id="idAFA379211283461DB3E05B8F139BD498" indent="up1"><enum>(B)</enum><text>For purposes of subparagraph (A), the
				term <term>caregiver</term> means a foster parent with whom a child in foster
				care has been placed or a designated official for a child care institution in
				which a child in foster care has been placed.</text></subparagraph></paragraph><paragraph id="id34DB2EA404D547788BBF3367B2C05964"><enum>(10)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idA0D6A42ACECF41CE95B8D789BDAB26E0"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id0EFB14B1BDDF4A57B1DA2F455606B082"><enum>(i)</enum><text>The term <term>age or
				developmentally appropriate</term> means activities or items that are generally
				accepted as suitable for children of the same chronological age or level of
				maturity or that are determined to be developmentally appropriate for a child,
				based on the development of cognitive, emotional, physical, and behavioral
				capacities that are typical for an age or age group.</text></clause><clause id="id646432D75587431FA324B0994FBEA38B" indent="up2"><enum>(ii)</enum><text>In the event that any age related activities have implications relative to a child or youth’s academic curriculum, nothing in this part or part B shall be construed to authorize an officer or employee of the Federal Government to mandate, direct, or control a State, local educational agency, or school’s specific instructional content, academic achievement standards and assessments, curriculum, or program of instruction</text></clause></subparagraph><subparagraph id="id1E5528C1D7E04EAA993195662E77A085" indent="up1"><enum>(B)</enum><text>In the case of a specific child, the
				term means activities or items that are suitable for that child based on the
				developmental stages attained by the child with respect to the child's
				cognitive, emotional, physical, and behavioral
				capacities.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id92BD310B4BA2485DAB992FE6FCF967A8"><enum>(c)</enum><header>Collected child
			 support directed to the youth</header><paragraph commented="no" display-inline="no-display-inline" id="idC3F47C17FCBE48B79C2070C494DAA071"><enum>(1)</enum><header>Foster youth in
			 another planned permanent living arrangement</header><text display-inline="yes-display-inline">Section 457(e)(1) of the Social Security
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/657">42 U.S.C. 657(e)(1)</external-xref>) is amended by inserting <quote>unless the permanency
			 plan for the child is another planned permanent living arrangement, in which
			 case the amounts collected (without any reimbursement to the Federal
			 Government) shall be deposited by the State agency responsible for supervising the child's placement in an account established for the benefit of the child and only used for payment of fees or other costs attributable to
			 the child's participation in age or developmentally appropriate
			 activities (until the child attains 18 years of age or such higher age as the State has elected under section 475(8)(B)(iii) at which time any funds in the account shall be paid to the child)</quote> before the semicolon.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCD975F6E7DC040F5A030CD5E0A7C32FA"><enum>(2)</enum><header>Former foster
			 youth who have aged out of foster care</header><text>Section 457 of the Social
			 Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/657">42 U.S.C. 657</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id413AB7450AEC440EA1B6F558D526269C"><enum>(A)</enum><text>in subsection
			 (a), in the matter preceding paragraph (1), by striking <quote>(d) and
			 (e)</quote> and inserting <quote>(d), (e), and (f)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFDC539C28EF04FAD9B8084580CF8D3B2"><enum>(B)</enum><text>by adding at the
			 end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="id43509F0456A54C4AABBEA13F697CB543" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="id60A8BE3502A74DF79157BC2738E77F96"><enum>(f)</enum><header>Youth age 18 or
				older in foster care</header><text>Notwithstanding the preceding provisions of
				this section, amounts collected by a State as child support for months in any
				period on behalf of a child who is in foster care under the responsibility of
				the State on the date the child attains 18 years of age or such higher age as
				the State has elected under section 475(8)(B)(iii) shall be paid to the child
				(without any reimbursement to the Federal

			 dates</header><paragraph commented="no" display-inline="no-display-inline" id="id619FD2BB154A46D6AF84EBA49BFAF04E"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the amendments made
			 by this section shall take effect on the date that is 1 year after the date of
			 enactment of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4FDBB8BC895B4B7586D208545337406E"><enum>(2)</enum><header>Delay of child
			 support amendment permitted if state legislation required</header><text>In the
			 case of a State plan approved under section 454 of the Social Security Act
			 which requires State legislation (other than legislation appropriating funds)
			 in order for the plan to meet the additional requirements imposed by the
			 amendments made by subsection (c), the State plan shall not be regarded as
			 failing to comply with the additional requirements solely on the basis of the
			 failure of the plan to meet the additional requirements before the first day of
			 the first calendar quarter beginning after the close of the first regular
			 session of the State legislature that begins after the date of enactment of
			 this Act. For purposes of the previous sentence, in the case of a State that
			 has a 2-year legislative session, each year of such session shall be deemed to
			 be a separate regular session of the State legislature.</text></paragraph></subsection></section></subtitle><subtitle id="id924E79148CC84962BDA378DFF1920875"><enum>B</enum><header>Empowering older
			 youth vulnerable to domestic sex trafficking and other negative
			 outcomes</header><section id="id25F3BA87B51544E7BAABAD409E9B1783"><enum>221.</enum><header>Empowering
			 foster youth age 14 and older in the development of their own case plan and
			 transition planning for a successful adulthood</header><subsection id="id4DFC61237AE04FEDBC2DE3442A0F0459"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 475(1)(B) of
			 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675(1)(B)</external-xref>) is amended by adding at the end
			 the following: <quote>With respect to a child who has attained age 14, the plan
			 developed under this paragraph for the child, the permanency plan required for
			 the child under paragraph (5)(C), and any revisions or additions to such plans,
			 shall be developed in consultation with the child and, at the option of the
			 child, with up to 2 members of the case planning team who are chosen by the
			 child and who are not the child's foster parent or caseworker. A State may
			 reject an individual selected by a child to be a member of the case planning
			 team at any time if the State has good cause to believe that the individual
			 would not act in the best interests of the child. One individual selected by a
			 child to be a member of the child's case planning team may be designated to be
			 the child's advisor and, as necessary, advocate, with respect to the
			 application of the reasonable and prudent parent standard to the
			 child.</quote>.</text></subsection><subsection id="id62B51AA848564DA78B4474A0D0D0B89A"><enum>(b)</enum><header>Conforming
			 amendments To include youth 14 and older in transition planning</header><text display-inline="yes-display-inline">Section 475 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675</external-xref>) is
			 amended—</text><paragraph id="id157C4EB379064C6CA03124E4F3D758CD"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(D), by striking
			 <quote>Where appropriate, for a child age 16</quote> and inserting <quote>For a
			 child age 14</quote>; and</text></paragraph><paragraph id="id9864D77A541A4E69B59B10665F5642B5"><enum>(2)</enum><text>in paragraph
			 (5)—</text><subparagraph id="id42C261699E4248238D808E241AB0DEC0"><enum>(A)</enum><text>in subparagraph
			 (C)—</text><clause id="idAF4F866716504F2D8A15882C1790B170"><enum>(i)</enum><text>by striking <quote>16</quote> and inserting <quote>14</quote>; and</text></clause><clause id="id6ACE561F7E3E48FC82360A8CC3A9F090"><enum>(ii)</enum><text>by striking <quote>independent living</quote> and inserting <quote>a successful adulthood and that the permanency plan for the child is developed in accordance with the requirements specified in paragraph(1)(B)</quote>; and</text></clause></subparagraph><subparagraph id="idF143F8C1E6AB4632A20883E441A98BF8"><enum>(B)</enum><text>in subparagraph
			 (I), by striking <quote>16</quote> and inserting <quote>14</quote>.</text></subparagraph></paragraph></subsection><subsection id="idE6FA587072644330880ED57A67D17DA4"><enum>(c)</enum><header>Transition
			 planning for a successful adulthood</header><text>Paragraphs (1)(D) and (5)(C)(iii) of section 475 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675</external-xref>) are each amended by
			 striking <quote>independent living</quote> and inserting <quote>a successful
			 adulthood</quote>.</text></subsection><subsection id="id446A710A129C42699FB192B77F876B67"><enum>(d)</enum><header>List of
			 rights</header><text>Section 475A of the Social Security Act, as added by
			 section 212(b)(1), is amended by adding at the end the following new
			 subsection:</text><quoted-block display-inline="no-display-inline" id="idC4037ECE450B4982919A0CCD7107D575" style="OLC"><subsection id="id1F97D4E09BDB43EFAA9D17E089E42C29"><enum>(b)</enum><header>List of
				rights</header><text>The case plan for any child in foster care under the
				responsibility of the State or with respect to whom adoption or kinship
				guardianship, assistance is made available under this part, who has attained
				age 14 shall include an age or developmentally appropriate written document that describes the child's rights with
				respect to education, health, visitation, and court participation, and to
				staying safe and avoiding exploitation and a signed acknowledgment by the child
				that the child has been provided them with a written copy of such
				document.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id5C26D72185F54B4FA30C09C5455CB499"><enum>(e)</enum><header>Report</header><text>Not
			 later than 2 years after the date of enactment of this Act, the Secretary of
			 Health and Human Services shall submit a report to Congress regarding the
			 implementation of the amendments made by this section. The report shall
			 include—</text><paragraph id="id8298AF85F38E42ED80F508BBE0FD916C"><enum>(1)</enum><text>an analysis of
			 how States are administering the requirement of section 475(1)(B) of the Social
			 Security Act, as amended by subsection (a) of this Act, to permit a child in
			 foster care who has attained age 14 to select up to 2 members of the child's
			 case planning team from individuals who are not the child's foster parent or
			 caseworker for the development of the  plan
			 for the child under paragraph (1)(B) of section 475 of such Act, the permanency plan required for
			 the child under paragraph (5)(C) of section 475 of such Act, and for any revisions or additions to such plans; and</text></paragraph><paragraph id="id9625BC90EF47438985E98110C2A22F51"><enum>(2)</enum><text>a description of
			 best practices of States with respect to the administration of the
			 requirement.</text></paragraph></subsection></section><section id="id323416A4480044A9B193D8197160231B"><enum>222.</enum><header>Ensuring
			 foster youth have a birth certificate, Social Security card, driver's license or equivalent State-issued identification card, and a bank
			 account</header><subsection id="id44E943C9B75147D6B95315276B16174A"><enum>(a)</enum><header>Case review
			 system requirement</header><text display-inline="yes-display-inline">Section
			 475(5)(I) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675(5)(I)</external-xref>) is amended—</text><paragraph id="id72F17FA15A1945A5A41F4FBAFEE34ECD"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>and receives
			 assistance</quote> and inserting <quote>receives assistance</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1411A6505AA640EF8CBF7F090DAD8ADC"><enum>(2)</enum><text>by inserting
			 before the period, the following: <quote>and is not discharged from care
			 without being provided with an official birth certificate, a social security
			 card issued by the Commissioner of Social Security, a driver's license or identification card issued by a State in accordance with the requirements of section 202 of the REAL ID Act of 2005, and a fee-free (or low-fee)
			 transaction account (as defined in section 19(b)(1)(C) of the Federal Reserve
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/12/461">12 U.S.C. 461(b)(1)(C)</external-xref>)) established in the child's name at an insured
			 depository institution (as defined in section 3 of the Federal Deposit
			 Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>)) or an insured credit union (as defined in
			 section 101 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1752">12 U.S.C. 1752</external-xref>)), unless the
			 child, after consultation with the child's selected members of the child's case
			 planning team (if any), elects not to have such an account
			 established</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD975360CD487487999CD798AA7E657A7"><enum>(b)</enum><header>Penalty for
			 noncompliance</header><text>Section 474 of the Social Security Act (42 U.S.C.
			 674)) is amended by adding at the end
			 the following:</text><quoted-block display-inline="no-display-inline" id="idDFB2868806CA4BAC8A382F422D943C3B" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="ID3A7F93DC2DDE4BBAB95B381E70F19657"><enum>(h)</enum><header>Reduced federal
				matching percentage for administration for failure To ensure foster youth have
				a birth certificate, social security card, picture ID, and a bank account</header><text>If
				the Secretary finds with respect to a fiscal year quarter that a State has
				failed to comply with the requirement under section 475(5)(I) to provide each
				child in foster care under the responsibility of the State with an official
				birth certificate, a social security card issued by the Commissioner of Social
				Security,  a driver's license or identification card issued by a State in accordance with the requirements of section 202 of the REAL ID Act of 2005, and a fee-free (or low-fee) transaction account (as defined in
				section 19(b)(1)(C) of the Federal Reserve Act (<external-xref legal-doc="usc" parsable-cite="usc/12/461">12 U.S.C. 461(b)(1)(C)</external-xref>))
				established in the child's name at an insured depository institution (as
				defined in section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>)) or
				an insured credit union (as defined in section 101 of the Federal Credit Union
				Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1752">12 U.S.C. 1752</external-xref>)) before the child is discharged from such care, (unless
				the child elects, after consultation with the child's selected members of the
				child's case planning team (if any), not to have such an account established)
				then, notwithstanding subsection (a) of this section and any regulations
				promulgated under section 1123A(b)(3), the Secretary shall reduce the Federal
				matching percentage for expenditures described in subsection (a)(3)(E) for the
				succeeding fiscal year quarter by 1 percentage point for every multiple of 10
				children for whom the Secretary determines the State failed to comply with such
				requirements (but not to exceed 25 percentage
				points).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idB74735CAC37B472987BCB9FDAAE89975"><enum>(c)</enum><header>Effective
			 date</header><paragraph commented="no" display-inline="no-display-inline" id="id79A06AF6225548079C53BC546007D1D3"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the amendments made by this section take effect on October
			 1, 2015.</text></paragraph><paragraph id="id8F77F8819E4C4F27B0CEB9CD65CC173C"><enum>(2)</enum><header>Extension for State law amendment</header><text display-inline="yes-display-inline">In the case of a State plan approved under
			 part B or E of title IV of the Social Security Act which the Secretary of
			 Health and Human Services determines requires State legislation (other than
			 legislation appropriating funds) in order for the plan to meet the additional
			 requirements imposed by  the amendments made by this section, the State plan shall not be regarded as
			 failing to comply with the requirements of such part solely on the basis of the
			 failure of the plan to meet such additional requirements before the first day of
			 the first calendar quarter beginning after the close of the first regular session
			 of the State legislature that ends after the 1-year period beginning with the
			 date of enactment of this Act. For purposes of the preceding sentence, in the
			 case of a State that has a 2-year legislative session, each year of the session
			 is deemed to be a separate regular session of the State legislature.</text></paragraph></subsection></section></subtitle><subtitle id="idBFEAD3702F424AA5BD38FAA1BAA5B6D3" style="OLC"><enum>C</enum><header>Data and Reports</header><section id="id123FB47BDF9C49B8BA545ED4D3F3D66E"><enum>231.</enum><header>Streamline data
			 collection and reporting on sex trafficking</header><subsection id="idCA72264A6A60493E9972D9366F94E7D4"><enum>(a)</enum><header>State plan
			 requirements</header><paragraph id="id07677311612C477382084B0D777259F5"><enum>(1)</enum><header>In general</header><text>Section 471(a) of the Social Security Act (42 U.S.C.
			 671(a)) is amended—</text><subparagraph id="idDBB67DFC96B448A697E5BF4E123179F8"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (32);</text></subparagraph><subparagraph id="idD36CB72558324490AC89B1C58C5E80A1"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (33) and inserting a semicolon; and</text></subparagraph><subparagraph id="id474F657093EE4E68AD7900BFA9F82A8D"><enum>(C)</enum><text>by adding at the
			 end the following:</text><quoted-block display-inline="no-display-inline" id="id09984ED45BCA496B8E45043F8ADB857E" style="OLC"><paragraph id="id80B66060377D4AF2AC55FA5592CEA4C9"><enum>(34)</enum><text display-inline="yes-display-inline">provides that for each child over whom the
				State agency has responsibility for placement, care, or supervision (including a child who is in foster care, a child for whom a State child welfare agency has an open case file but who has not been removed from the home, and a youth who is not in foster care but is receiving services under section 477), the State
				agency shall—</text><subparagraph id="H8CB4F4B94D1F49B99624214A4B714BCB"><enum>(A)</enum><text display-inline="yes-display-inline">identify and document appropriately in
				agency records each child who is identified as being a victim of sex
				trafficking (as defined in section 103(10) of the Trafficking Victims
				Protection Act of 2000) or as a victim of severe forms of trafficking in
				persons described in section 103(9)(A) of the Trafficking Victims Protection
				Act of 2000 (relating to sex trafficking) as such a victim; and</text></subparagraph><subparagraph id="H9B41B95DFB4F4256B4FBA094E75493EA"><enum>(B)</enum><text display-inline="yes-display-inline">report immediately, and in no case later
				than 24 hours after receiving, information on missing or abducted children to
				the law enforcement authorities for entry into the National Crime Information
				Center (NCIC) database of the Federal Bureau of Investigation, established
				pursuant to <external-xref legal-doc="usc" parsable-cite="usc/28/534">section 534</external-xref> of title 28, United States Code, and to the National Center for Missing  and Exploited Children; and</text></subparagraph></paragraph><paragraph commented="no" id="id1EC1B7F7787940869C448639A27F197C"><enum>(35)</enum><text display-inline="yes-display-inline">contains a regularly updated description of
				the specific measures taken by the State agency to protect and provide services
				to children who are victims of sex trafficking (as defined in section 103(10)
				of the Trafficking Victims Protection Act of 2000) or as a victim of severe forms of trafficking in
				persons described in section 103(9)(A) of the Trafficking Victims Protection
				Act of 2000 (relating to sex trafficking), including efforts to
				coordinate with State law enforcement, juvenile justice, and social service
				agencies such as runaway and homeless youth shelters to serve that
				population.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H70A2B0A1DB694496AA9DA49FD54B3828"><enum>(2)</enum><header>Effective
			 date</header><subparagraph id="id4A9F7B5E3DC74B54A354B49604D28A05"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in subparagraph (B), the amendments made
			 by subsection (a) shall take effect on the date that is 1 year after the date of the
			 enactment of this Act, without regard to whether final regulations required under subsection
			 (b) have been promulgated.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id306B09FD36074EFDBC33D181F22DF4B9"><enum>(B)</enum><header>Delay permitted
			 if state legislation required</header><text>In the case of a State plan
			 approved under part E of title IV of the Social Security Act which the
			 Secretary of Health and Human Services determines requires State legislation
			 (other than legislation appropriating funds) in order for the plan to meet the
			 additional requirements imposed by subsection (a), the State plan shall not be
			 regarded as failing to comply with the requirements of such part solely on the
			 basis of the failure of the plan to meet such additional requirements before
			 the first day of the first calendar quarter beginning after the close of the first
			 regular session of the State legislature that ends after the 1-year period
			 beginning with the date of the enactment of this Act. For purposes of the
			 preceding sentence, in the case of a State that has a 2-year legislative
			 session, each year of the session is deemed to be a separate regular session of
			 the State legislature. Except as otherwise provided in this Act the amendments
			 made by this Act shall take effect on the date that is 1 year after the date of
			 the enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="idF19162AD8356497483A70221FA4C0980"><enum>(b)</enum><header>Inclusion of
			 data in AFCARS</header><paragraph id="idF3278C3A45014C2CA336FC9B65B007F5"><enum>(1)</enum><header>In
			 general</header><text>Section 479(c)(3) of the Social Security Act (42 U.S.C.
			 679(c)(3)) is amended—</text><subparagraph id="id9C6FCDBEDF1D462786CF86DD414DFB46"><enum>(A)</enum><text>in
			 subparagraph (C)(iii), by striking <quote>and</quote> after the semicolon;
			 and</text></subparagraph><subparagraph id="id6577CF39066A486F8F2EC2312EA54CE1"><enum>(B)</enum><text>by

				sex trafficking (as defined in section 103(10) of the Trafficking Victims
				Protection Act of 2000)  or as victims of severe forms of trafficking in
				persons described in section 103(9)(A) of the Trafficking Victims Protection
				Act of 2000 (relating to sex trafficking);
				and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idEF13E2713D484B2B86ED74EF65901653"><enum>(2)</enum><header>Reports to
			 congress</header><subparagraph id="idE0661DA2043E42E4A9DB42D4400F82A7"><enum>(A)</enum><header>Initial report</header><text>Not later than the date that is 2 years after the date of enactment of this Act, the Secretary of Health and Human Services shall—</text><clause id="id42B25980E5C24476A9BF297364155D4D"><enum>(i)</enum><text>survey each State with a State plan approved under part B or E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/621">42 U.S.C. 621 et seq.</external-xref>, 670 et seq.) to determine the estimated number of children in foster care and the estimated number of other children over whom the
				State agency has responsibility for placement, care, or supervision (including children for whom a State child welfare agency has an open case file but who have not been removed from the home and youth who are not in foster care but are receiving services under section 477 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/677">42 U.S.C. 677</external-xref>) who are identified as victims of
				sex trafficking (as defined in section 103(10) of the Trafficking Victims
				Protection Act of 2000)  or as victims of severe forms of trafficking in
				persons described in section 103(9)(A) of the Trafficking Victims Protection
				Act of 2000 (relating to sex trafficking); and</text></clause><clause id="id01BE48EB589E4326ABC7466EEF689351"><enum>(ii)</enum><text>submit a report to Congress that includes the results of such survey, including State-specific data, along with such recommendations for administrative or legislative action as the Secretary of Health and Human Services determines appropriate relating to the
			 identification of, and provision of services for, such children.</text></clause></subparagraph><subparagraph id="id63D9ECD2A415496D8EC4DE9E1340B709"><enum>(B)</enum><header>Annual reports</header><text>Section 479A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/679b">42 U.S.C. 679b</external-xref>), as amended by section 117(b),  is further amended—</text><clause id="idEAC7DF68E6604BC982842BDD3D744422"><enum>(i)</enum><text>in paragraph (6), by striking <quote>and</quote> after the semicolon;</text></clause><clause id="id33B25BAB30FB4F80960F359369153E36"><enum>(ii)</enum><text>in paragraph (7), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="idE2FE2A1461924BA08844C20A50150035"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idD792A0755B504F00B236D435425990A0" style="OLC"><paragraph id="idB2144F73486A4F4EBB0CA47E83B55319"><enum>(8)</enum><text>include in the

			 information as the Secretary determines appropriate relating to the
			 identification of, and provision of services for, the population of
			 children identified in such data.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection></section><section id="id89d7d493bf204b2d92941cdb1bc336bb"><enum>232.</enum><header>Recommendations to Congress for expanding housing for youth victims of trafficking</header><text display-inline="no-display-inline">Part A of title XI of the Social Security Act (42 U.S.C.  1301 et seq.) is amended by inserting after section 1123A, the following:</text><quoted-block display-inline="no-display-inline" id="idCBA0FC8F56EF469A98BC999E2CC27426" style="traditional"><section id="idF5CF1050463E41D1A7E1C5FF1A970B70"><enum>1123B.</enum><header>Recommendations to Congress for expanding housing for youth victims of trafficking</header><subsection commented="no" display-inline="yes-display-inline" id="idA4616D1EEBE947BF98F15A062998B2CC"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the enactment of this section, the head of each Federal agency specified in subsection (c) shall submit a report to Congress that contains recommendations for administrative or legislative changes necessary to use programs, properties, or  other resources owned, operated, or funded by the Federal Government to provide safe housing for youth who are victims of trafficking and to provide support to entities that provide housing or other assistance to such victims.</text></subsection><subsection id="id707a475f78194d608468471412eb03bf"><enum>(b)</enum><header>Content</header><text>The reports required by subsection (a) shall include with respect to programs, properties, or other resources owned, operated, or funded  by each Federal agency specified in subsection (c), information regarding—</text><paragraph id="id314C3690A2884677B5241E1629ECCED9"><enum>(1)</enum><text>the availability and suitability of existing Federal, State, and local housing resources that are appropriate for housing youth victims of trafficking or for providing support to entities that provide housing or other assistance to such victims, including in rural and isolated locations; and</text></paragraph><paragraph id="id02943F1CBFF140658FEB98B0D10B9161"><enum>(2)</enum><text>the feasibility of establishing or supporting public-private partnerships to provide housing for such victims or support to entities that provide housing or other assistance to such victims.</text></paragraph></subsection><subsection id="id5D633F945FE0497FB8004F9C8E20750B"><enum>(c)</enum><header>Agencies subject to reporting requirement</header><text>The Federal agencies specified in this subsection are the following:</text><paragraph id="idF283D218B8304849A48601F4F4CAF946"><enum>(1)</enum><text>The Department of Defense.</text></paragraph><paragraph id="id562797B39694476EB49F436AD1B92719"><enum>(2)</enum><text>The Department of Health and Human Services.</text></paragraph><paragraph id="idA81E454BC8F5463EA2E8701689BC2EA2"><enum>(3)</enum><text>The Department of Homeland Security.</text></paragraph><paragraph id="idD3EAA795380A42FDBAB2E6FECA3B420C"><enum>(4)</enum><text>The Department of Housing and Urban Development.</text></paragraph><paragraph id="idC88D366384AF4047A66443DFD188DA31"><enum>(5)</enum><text>The Department of Justice.</text></paragraph></subsection><subsection id="id66F7E1F21C544D2EB9BE7574745B4854"><enum>(d)</enum><header>Victims of trafficking defined</header><text>In this section, the term <term>victims of trafficking</term> has the meaning given that term in section 103(15) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102(15)</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></subtitle><subtitle id="id8AC0CCEDC32644D4BAC271A15B6FDBCB" style="OLC"><enum>D</enum><header>National Advisory Committee on Domestic Sex Trafficking</header><section id="id3211582F3A464F74B58431D989CC18D5"><enum>241.</enum><header>National Advisory Committee on Domestic Sex Trafficking</header><text display-inline="no-display-inline">Title XI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1301">42 U.S.C. 1301 et seq.</external-xref>) is amended by inserting after section 1114 the following new section:</text><quoted-block display-inline="no-display-inline" id="id22F36D0D334B4C77A4596906A658E7C2" style="traditional"><section id="id4DBA060EF70F423E817FB80A99FEAB2B"><enum>1114A.</enum><header>National Advisory Committee on Domestic Sex Trafficking</header><subsection commented="no" display-inline="yes-display-inline" id="idEA38F13286044443915984D9CBB5F3E2"><enum>(a)</enum><header>Official designation</header><text>This section relates to the National Advisory Committee on Domestic Sex Trafficking (in this section referred to as the <quote>Committee</quote>).</text></subsection><subsection commented="no" id="idDD0C5D231E3F4E79ADBABBDB0D4D7E4B"><enum>(b)</enum><header>Authority</header><text>Not later than  180 days after the date of enactment of this section, the Secretary shall establish and appoint all members of the Committee.</text></subsection><subsection id="id6B87C7465FB349D5B1724445010AFFCB"><enum>(c)</enum><header>Membership</header><paragraph id="id6818855EB02E4EF390E1CAA194082AFE"><enum>(1)</enum><header>Composition</header><text>The Committee shall be composed of not more than 21 members whose diverse experience and background enable them to provide balanced points of view with regard to carrying out the duties of the Committee. The Committee shall not be composed solely of Federal officers or employees.</text></paragraph><paragraph id="id76B823E8ED3B4B548B28C3D12A25E5CB"><enum>(2)</enum><header>Selection</header><text>The Secretary,  in consultation with the Attorney General, shall  appoint members to the Committee.</text></paragraph><paragraph id="idB11775E7366B4F0FB1B6CCC79467F131"><enum>(3)</enum><header>Period of
			 appointment; vacancies</header><text>Members shall be appointed for the life of the Committee. A vacancy in the Committee shall be filled in the manner in which the original appointment was made and shall not affect the powers or duties of the Committee.</text></paragraph><paragraph id="idA97F5DA68EB541878FF20A6AB5CAD044"><enum>(4)</enum><header>Compensation</header><text>Committee members, with the exception of reimbursement of official travel expenses and per diem for official travel, shall serve without compensation.</text></paragraph></subsection><subsection id="idA3DA5424F3B84DB483F8B232D22E6FB4"><enum>(d)</enum><header>Duties</header><paragraph id="id0166F6A041B4439E80E7F7F8C39B560D"><enum>(1)</enum><header>National response</header><text>The Committee shall advise the Secretary and the Attorney General on practical and general policies concerning improvements to the Nation's response to domestic sex trafficking of minors from the child welfare system and the commercial sexual exploitation of children.</text></paragraph><paragraph id="id51FB3549CFC64F0D8EC0059F411E97D1"><enum>(2)</enum><header>Cooperation policies</header><text>The Committee shall advise the  Secretary and the Attorney General on practical and general policies concerning the cooperation of Federal, State, local, and tribal governments, child welfare agencies, social service providers, physical health and mental health providers, victim service providers, State or local courts with responsibility for conducting or supervising proceedings relating to child welfare or social services for children and their families, Federal, State, and local police, juvenile detention centers and runaway and homeless youth programs, schools, and businesses and organizations that provide services to youth, on responding to domestic sex trafficking of minors and the commercial sexual exploitation of children, including the development and implementation of—</text><subparagraph id="idA6596FF953204DC3B1DBCCAD9052699C"><enum>(A)</enum><text>successful interventions with children and teens who are exposed to conditions that make them vulnerable to, or victims of, domestic sex trafficking and commercial sexual exploitation;</text></subparagraph><subparagraph id="id49C21F1BD91542FA9135001177099848"><enum>(B)</enum><text>policies that reflect an understanding that safety and well-being of children and teens can be compromised by the sexualization of children, the commodification of children, and a lack of normalcy characterized by isolation, disconnection from positive, appropriate, and healthy relationships with peers and adults, and an inability to engage in age appropriate activities; and</text></subparagraph><subparagraph id="id27792AB0E6424FCFAF1235655798FBBB"><enum>(C)</enum><text>the relationship between children and teens who are trafficked and the overall coarsening and desensitization of society to violence that puts the public safety of communities across the Nation at risk.</text></subparagraph></paragraph><paragraph id="idA96586EB02CE4AF98CD37137B04E8264"><enum>(3)</enum><header>Definition of  <term>commercial sexual exploitation of children</term></header><text>The Committee shall recommend a comprehensive definition of what constitutes the <term>commercial sexual exploitation of children</term>.</text></paragraph><paragraph id="idDC232CC6D7BD4841A00ABDD80DFC0E13"><enum>(4)</enum><header>Best practices for States</header><subparagraph id="id26F4C8FE013741F7BC027A9065D3D8EF"><enum>(A)</enum><header>In general</header><text>The Committee shall  develop 2 tiers (referred to in this subparagraph as <quote>Tier I</quote> and <quote>Tier II</quote>) of recommended best practices for States to follow in combating the domestic sex trafficking of minors and the commercial sexual exploitation of children. Tier I shall provide States that have not yet addressed domestic sex trafficking of minors and the commercial sexual exploitation of children with  an idea of where to begin and what steps to take. Tier II shall provide States that are already working to address domestic sex trafficking of minors and the commercial sexual exploitation of children with examples of policies that are already being used effectively by other States to address trafficking issues.</text></subparagraph><subparagraph id="id58050D9E496B44DC9B1D89B2A77EC5C7"><enum>(B)</enum><header>Development</header><text>The best practices shall be based on multidisciplinary research and promising, evidence-based models and programs.</text></subparagraph><subparagraph id="id3627C0B7F9A7402FA243D2130F28AE49"><enum>(C)</enum><header>Content</header><text>The best practices shall be user-friendly, incorporate the most up-to-date technology, and include the following:</text><clause id="idC4D3D52082BE44C5B9D42E4B254EDFAD"><enum>(i)</enum><text>Sample training materials, protocols, and screening tools to prepare child welfare personnel to identify and serve youth who are at-risk or  are victims of domestic sex trafficking or commercial sexual exploitation.</text></clause><clause id="id8153A9EEEBF54E1B8B83EB208DA28EB1"><enum>(ii)</enum><text>Multidisciplinary strategies to identify victims, manage cases, and improve services to meet the unique needs of this youth population.</text></clause><clause id="id57780DC963B34B5E852EE9BBF1441A41"><enum>(iii)</enum><text>Sample protocols and recommendations for effective, cross-system collaboration between Federal, State, local, and tribal governments, child welfare agencies, social service providers, physical health and mental health providers, victim service providers, State or local courts with responsibility for conducting or supervising proceedings relating to child welfare or social services for children and their families, Federal, State, and local police, juvenile detention centers and runaway and homeless youth programs, schools, and businesses and organizations that provide services to youth. These protocols and recommendations should include strategies to identify victims and collect, document, and share data across systems and agencies, and should be designed to help agencies better understand the type of trafficking or commercial sexual exploitation involved, the scope of the problem, the needs of the population to be served, ways to address the demand for trafficked children and youth and increase prosecutions of traffickers and purchasers of children and youth, and the degree of victim interaction with multiple systems.</text></clause><clause id="id914DF25BB8DB4B6FB0CBFA34CA185DEE"><enum>(iv)</enum><text>A list of recommendations to establish safe residential placements for foster youth who have been trafficked (as defined by the Committee) as well as training guidelines for caregivers that serve children and youth being cared for outside the home.</text></clause></subparagraph></paragraph></subsection><subsection id="id1FBA52B78AEC4359B1DD591E9183FD7A"><enum>(e)</enum><header>Reports</header><paragraph id="id0C63D9999B3A472B935103FE2227B591"><enum>(1)</enum><header>In general</header><text>The Committee shall  submit an interim and a final report  on the work of the Committee to—</text><subparagraph id="idB528DDF1921C4B87838652AEDCC6B062"><enum>(A)</enum><text>the Secretary;</text></subparagraph><subparagraph id="idC71386B5643E40C8933C9081535780BC"><enum>(B)</enum><text>the Attorney General;</text></subparagraph><subparagraph id="id1C17B3C4D11B47EEA98DF24F82B854A5"><enum>(C)</enum><text>the Committee on Finance of the Senate; and</text></subparagraph><subparagraph id="id2B12BAD21C7E4683BE275CCC629B1AB9"><enum>(D)</enum><text>the Committee on Ways and Means of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id77EA9AA7956540A1AC22CA1411D32B2A"><enum>(2)</enum><header>Reporting dates</header><text>The interim report shall be submitted not later than 1 year after the establishment of the Committee.  The final report shall be submitted not later than 2 years after the establishment of the Committee unless the Secretary establishes an extension period for the Committee,  in which case the final report shall be submitted not later than the last day of such period.</text></paragraph></subsection><subsection id="idF70B40125BBA433BBB7C24990B547CBF"><enum>(f)</enum><header>Administration</header><paragraph id="id5E2AB625AC3A4722831707119CE3459D"><enum>(1)</enum><header>Agency support</header><text>The Secretary shall direct the head of the  Administration on Children, Youth and Families of the Department of Health and Human Services to l provide all necessary support for the Committee.</text></paragraph><paragraph id="idBEDC6E5ED1C8415B841AF4B261AD5FF0"><enum>(2)</enum><header>Meetings</header><subparagraph id="idED07214A68854772AA2FA01A8B749837"><enum>(A)</enum><header>In general</header><text>The Committee will meet at the call of the Secretary at least twice a year to carry out the duties identified in this section, and more often as otherwise required.</text></subparagraph><subparagraph id="idE06B5FA8BC7245E99DDEFBB152CE28E8"><enum>(B)</enum><header>Procedures</header><text>The Secretary shall call all of the Committee meetings, prepare and approve all meeting agendas, attend all Committee meetings, adjourn any meeting when the Secretary  determines adjournment to be in the public interest, and shall chair meetings when directed to do so by an official or entity to whom the Committee reports.</text></subparagraph></paragraph><paragraph id="id3D1CA16FDC1A4B078C2F3B2AA4F928D8"><enum>(3)</enum><header>Subcommittees</header><text>The Committee shall be authorized to establish subcommittees or working groups, as necessary and consistent with the mission of the Committee, and any such  subcommittees or working groups shall operate under the provisions of the Federal Advisory Committee Act of 1972 (5 U.S.C. App.), the Sunshine in Government Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/5/552b">5 U.S.C. 552b</external-xref>), and other appropriate Federal regulations. Such subcommittees or working groups shall have no authority to make decisions on behalf of the Committee, nor shall  they report directly to any official or entity listed in subsection (d).</text></paragraph><paragraph id="idFD63F6EBC5B64C8BB5C685453ABB49AE"><enum>(4)</enum><header>Recordkeeping</header><text>The records of the Committee and any subcommittees and working groups shall be maintained in accordance with  appropriate Department of Health and Human Services policies and procedures and  shall be available for public inspection and copying, subject to the Freedom of Information Act (<external-xref legal-doc="usc" parsable-cite="usc/5/552">5 U.S.C. 552</external-xref>).</text></paragraph></subsection><subsection id="idD9B385B0B62348F7AD4F2053586F92D0"><enum>(g)</enum><header>Funding</header><paragraph id="id60E29D327F8C46A9BAF6E8483472797E"><enum>(1)</enum><header>In general</header><text>From the unobligated balance of funds made available to carry out section 414 of the Social Security Act (42 U.S.C.  614),  $400,000 of such funds are hereby transferred and made available to carry out this section.  Amounts transferred and made available to carry out this section shall remain available for expenditure until the date on which the Committee terminates and shall not be subject to reduction under a sequestration order issued under the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900 et seq.</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1FB5075B28334725AA621FF9CE265750"><enum>(2)</enum><header>Unobligated
			 amounts</header><text>Any amounts made available to carry out this section that are
			 unobligated on the date on which the Committee terminates shall be returned to the Treasury of the United States  .</text></paragraph></subsection><subsection id="idD574CDF093634C21A29C6E6A729BE2CA"><enum>(h)</enum><header>Termination</header><text>The Committee shall terminate 2 years after the date of establishment unless the Secretary determines that more time is necessary to allow the Committee to complete its duties, in which case the Committee shall terminate at the end of an extension period established by the Secretary (not to exceed 24 months).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></subtitle></title><title id="id5471B8C70D32404EA60ED6F2A0949C9B" style="OLC"><enum>III</enum><header>Child Support Enforcement</header><section id="id3ED1BB05F2BB43D9A913DCDE7A067D76"><enum>301.</enum><header>Short title of title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Child Support Improvement and Work Promotion Act</short-title></quote>.</text></section><subtitle id="id45FB98347877475EACDF874EA542C2CF" style="OLC"><enum>A</enum><header>Increased Reliability of Child Support</header><section id="idF54C1BB31599469D9B0EAFD51E654A72"><enum>311.</enum><header>Compliance with
			 multilateral child support conventions</header><subsection id="id6B95B8D55E9644D18C4970D397ED78D5"><enum>(a)</enum><header>Secretary's

				foreign country for which the 2007 Family Maintenance Convention is in

				maintenance convention</header><text>The term <term>2007 Family Maintenance

				Maintenance.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id729B0E30B88F4527A01E9E821042F46B"><enum>(e)</enum><header>Collection of
			 past-due support from federal tax refunds</header><text>Section 464(a)(2)(A) of
			 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/664">42 U.S.C. 664(a)(2)(A)</external-xref>) is amended by striking
			 <quote>under section 454(4)(A)(ii)</quote> and inserting <quote>under paragraph
			 (4)(A)(ii) or (32) of section 454</quote>.</text></subsection><subsection id="IDDB75C272A2D5419488D4D13F9B43F577"><enum>(f)</enum><header>State law
			 requirement concerning the uniform interstate family support act

				controlling order, as determined under subsection (g); and</text></paragraph><paragraph id="id823145b2ff2d475bbdf2895556a3abf4"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id1665221E11444D128DF1F91C2A38D5BE"><enum>(A)</enum><text>the State is the
				child's State or the residence of any individual contestant; or</text></subparagraph><subparagraph id="idc423cbcf35284d35924fe5c2f67692af" indent="up1"><enum>(B)</enum><text>the contestants provide consent (by
				providing consent in a record or in a hearing) for the tribunal to continue to
				exercise jurisdiction to modify the order.</text></subparagraph></paragraph></subsection><subsection id="id3f28112ff6234f70b4eaabe7e316b2e0"><enum>(e)</enum><header>Restrictions on
				exercising continuing, exclusive jurisdiction</header><text>A tribunal of a
				State that has made a child support order may not exercise continuing,
				exclusive jurisdiction to modify the order if—</text><paragraph id="id539cb936b76e484eac86885de201cdfd"><enum>(1)</enum><text>each individual
				contestant files a consent in a record with the issuing tribunal stating that a
				tribunal of another State (which has jurisdiction of at least 1 of the
				individual contestants or that is a tribunal of the State of the residence of
				the child) may modify the order and assume continuing, exclusive jurisdiction;
				or</text></paragraph><paragraph id="idf7ab31c2b03a48ff974fcaf4f48dec33"><enum>(2)</enum><text>the order is not
				the controlling order, as determined under subsection
				(g).</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idF46BB1D06A804578954EAACA67157119"><enum>(8)</enum><text>in subsection
			 (f), as redesignated by paragraph (6) of this section—</text><subparagraph id="id33A977219DB74727A5ACB3695ECEA737"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>subsection (i)</quote> and inserting <quote>subsection
			 (j)</quote>; and</text></subparagraph><subparagraph id="id233D72A4B437477A92412AB7534D03EB"><enum>(B)</enum><text>in paragraph
			 (2)—</text><clause id="id80450F4CBFD044789E2EA2D072698CA3"><enum>(i)</enum><text>in
			 subparagraph (A), by inserting <quote>and the contestants have not provided
			 consent (by providing consent in a record or in a hearing) for the tribunal of
			 the other State to continue to exercise jurisdiction to modify the
			 order</quote> before the semicolon; and</text></clause><clause id="id4BE382F849CD4A0FB4EC7C8E87110E79"><enum>(ii)</enum><text>in
			 subparagraph (B), by inserting <quote>with jurisdiction of at least 1 of the
			 individual contestants or that is a tribunal of the State of the residence of
			 the child</quote> after <quote>of another State</quote>;</text></clause></subparagraph></paragraph><paragraph id="id482D06249DF440B4A7CA5A64A37E2C81"><enum>(9)</enum><text>in subsection
			 (g), as redesignated by paragraph (6) of this section—</text><subparagraph id="idF4D45CF2927E45B89835166609D778AB"><enum>(A)</enum><text>in the subsection
			 heading, by striking <quote><header-in-text level="subsection" style="OLC">Recognition of child support orders</header-in-text></quote> and
			 inserting <quote><header-in-text level="subsection" style="OLC">Determination
			 of controlling child support order</header-in-text></quote>;</text></subparagraph><subparagraph id="id75D0BFF2B55E4F2F925F7DF791669D68"><enum>(B)</enum><text>in the matter
			 preceding paragraph (1), by striking <quote>to recognize for purposes of
			 continuing, exclusive jurisdiction and enforcement</quote> and inserting

			 the controlling order</quote>;</text></subparagraph></paragraph><paragraph id="idA9C72BD7D3FB4C63A874F0B90AE1ECCE"><enum>(10)</enum><text>in subsection
			 (h), as redesignated by paragraph (6) of this section, by striking
			 <quote>subsections (e) and (f)</quote> and inserting <quote>subsections (f) and
			 (g)</quote>;</text></paragraph><paragraph id="idE837D7CA4F3642BCA2B3F1677C1945FA"><enum>(11)</enum><text>in subsection

			 paragraph (2) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id99B8AE0E7BFF46EDBAD83E87E1F4A237" style="OLC"><paragraph id="id8A0864B8429949259BE3C2CB07A44851"><enum>(2)</enum><header>Law of State of
				issuance of order</header><text>A tribunal shall apply the law of the State of
				the tribunal that issued a child support order registered in the State of the
				tribunal with regard to—</text><subparagraph id="idaa2a205f9f344a5ab28890a814370f85"><enum>(A)</enum><text>the nature,
				extent, amount, and duration of current payments under the child support
				order;</text></subparagraph><subparagraph id="ide32b6d4902864dc99891aee03821a280"><enum>(B)</enum><text>the computation
				and payment of arrears and accrual of interest on arrears under the child
				support order; and</text></subparagraph><subparagraph id="id4e17762599eb41fda57b431dd95a3d7a"><enum>(C)</enum><text>the existence and
				satisfaction of other obligations under the child support
				order.</text></subparagraph></paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block></subparagraph><subparagraph id="idFAA1FAE7135446DE922E9E80E236E6FB"><enum>(C)</enum><text>in paragraph (3),
			 by striking <quote>child support order, a</quote> and inserting <quote>child
			 support order registered in the State of a tribunal, the</quote>; and</text></subparagraph><subparagraph id="idD82AA83F896848CF9A329C4A13D8B605"><enum>(D)</enum><text>by adding at the
			 end the following:</text><quoted-block display-inline="no-display-inline" id="id3DBF8B45193C47B9B712BA9C70946450" style="OLC"><paragraph id="ida05dfd8f42854e8eb736b274a16c2eee"><enum>(4)</enum><header>Prospective
				application of law</header><text>After a tribunal determines which is the
				controlling order and issues an order consolidating arrears, if any, a tribunal
				shall apply the law of the State of the tribunal that issued the controlling
				order (including the law of the State relating to interest on arrears)—</text><subparagraph id="id9EB82DC010234AE3B1073EC9B2380322"><enum>(A)</enum><text>for support paid
				after the date of the order consolidating arrears; and</text></subparagraph><subparagraph id="id627C1DD9DEEA4C05ADE91D7E14D58BF0"><enum>(B)</enum><text>relating to
				consolidated arrears.</text></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id631FE60D455946CE82374CEFCD2213D1"><enum>(12)</enum><text>by adding at the
			 end the following:</text><quoted-block display-inline="no-display-inline" id="id717FC784D46D46768042D18F56EA9B60" style="OLC"><subsection id="idf545ab0d8cff4d7bb0129a5e009f8a2a"><enum>(j)</enum><header>Registration
				for modification</header><paragraph id="id7ad217080b47405cbf167b51b3cf2fe9"><enum>(1)</enum><header>In
				general</header><text>A tribunal may modify a child support order issued in
				another State which has been registered in the State of the tribunal if, after
				notice and hearing, the tribunal finds—</text><subparagraph id="id1B0AF36BA8374201AB5BAA4702A510F0"><enum>(A)</enum><text>that—</text><clause id="idab25a681744c420f97fa2e8750ab3689"><enum>(i)</enum><text>no individual
				contestant or child resides in the State of the tribunal issuing the child
				support order;</text></clause><clause id="id8222b3f693c44ac7868fd2ba8ff28a77"><enum>(ii)</enum><text>the individual
				contestant seeking to modify, or to modify and enforce, a child support order
				issued in another State does not reside in the State in which the registering
				tribunal is located; and</text></clause><clause id="id427c643086134ea78583d110a766435f"><enum>(iii)</enum><text>the tribunal of
				the State in which the child support order has been registered has personal
				jurisdiction of the parties not seeking to modify, or modify and enforce, the
				child support order;</text></clause></subparagraph><subparagraph id="id006f592487be45b9a8fd278d35d0c365"><enum>(B)</enum><text>that the State in
				which the child support order has been registered—</text><clause id="idBAEE40EB0E3B4BFCB864D15E827E6E58"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="idECB5A8F99F4E42F486287BECC6BB8F46"><enum>(I)</enum><text>is the residence of the
				child; or</text></subclause><subclause id="id75D9314C58A9462CABB49DD194811B9B" indent="up1"><enum>(II)</enum><text>has personal jurisdiction of an
				individual contestant; and</text></subclause></clause><clause id="id0586EA02EDF64D68841E366CD32CACE8"><enum>(ii)</enum><text>each individual
				contestant has filed a consent in a record with the issuing tribunal for a
				tribunal in the registering State to modify the support order and assume
				continuing, exclusive jurisdiction; or</text></clause></subparagraph><subparagraph id="id9852c40b91974e9f9631b32c7715fbd5"><enum>(C)</enum><text>that all of
				the individual contestants reside in the State in which the registering
				tribunal is located and the child does not reside in the issuing State.</text></subparagraph></paragraph><paragraph id="idac5e789257324613b852ea6b7e5a2f4d"><enum>(2)</enum><header>Limitations</header><text>A
				tribunal may not modify any term of a child support order that may not be
				modified under the law of the issuing State, including the duration of the
				obligation of support. If 2 or more tribunals have issued child support orders
				for the same obligor and same child, the law of the State of the tribunal
				issuing the controlling order, as determined under subsection (g), establishes
				the terms of the child support order which are not modifiable.</text></paragraph><paragraph id="id354a0ca605404556ac4be467e626e903"><enum>(3)</enum><header>Proceeding to
				modify</header><text>In a proceeding to modify a child support order, the law
				of the State of the tribunal that issued the initial controlling order, as
				determined under subsection (g), governs the duration of the obligation of
				support. The obligor’s fulfillment of the duty of support established by that
				controlling order precludes a tribunal of another State from imposing a further
				obligation of child support on the obligor.</text></paragraph><paragraph id="id96dab4c7716047d8831c309db6a8f5f0"><enum>(4)</enum><header>Parties
				residing outside the United States</header><text>Notwithstanding paragraph (1),
				a tribunal in the issuing State retains jurisdiction to modify an order issued
				in that State if—</text><subparagraph id="id5f6e53a8ed5b4171bcf6076c77845181"><enum>(A)</enum><text>1 party resides
				in another State; and</text></subparagraph><subparagraph id="idac3a2f29c7074215a7d44ae391fc8691"><enum>(B)</enum><text>the other party
				resides outside of the United
				States.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id62F7AB322EDD478DB181FCA1DE0E054F"><enum>312.</enum><header>Relief from passport sanctions for certain individuals</header><text display-inline="no-display-inline">Section 452(k) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/652">42 U.S.C. 652(k)</external-xref>) is amended—</text><paragraph id="id0F496E0ACCA94650AD9180C913CDAF34"><enum>(1)</enum><text>in paragraph (2), by striking <quote>The Secretary of State</quote> and inserting <quote>Subject to paragraph (3), the Secretary of State</quote>;</text></paragraph><paragraph id="id28FFCA6F3F154EADB9E6732248104361"><enum>(2)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id58915479D7A44F18B85363D3F956AB4A"><enum>(3)</enum><text>by inserting after paragraph (2) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="idA869C17089694DAC802E93A00673EF17" style="OLC"><paragraph id="idAEE2ED770F94425AA7C171544FEB2F2D" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id831B74BF6E8E41DB8F3E6F683C0D2761"><enum>(A)</enum><text>Notwithstanding paragraph (2), the Secretary of State may issue a passport to an individual with respect to whom the Secretary has transmitted certification under paragraph (1) if—</text><clause id="idF12FACDC354E42729E30DB62018C61F4" indent="up1"><enum>(i)</enum><text>the individual submits an application for relief to the Secretary of State, in such form and manner as the Secretary of State shall require; and</text></clause><clause id="id57460B0BBC2D4D349CE26C2FBB495CE4" indent="up1"><enum>(ii)</enum><text>the Secretary of State certifies that the application includes evidence that the individual—</text><subclause id="idC64B781E3F3146EB9A64AC76068BE7C6"><enum>(I)</enum><text>has an annual income of less than $100,000;</text></subclause><subclause id="idA02B054AA9114DC6B0EB947A0EB02BE0"><enum>(II)</enum><text>is not incurring any new child support obligations, but only owes arrearages;</text></subclause><subclause id="idAC45257C8CF5428DA95715671DFD88BF"><enum>(III)</enum><text>does not owe arrearages of child support for a child who is less than 18 years old;</text></subclause><subclause id="id2CAE97918E37471D9434D76F46E14CC8"><enum>(IV)</enum><text>has been making child support payments consistently and in good faith for each of the most recently preceding 12 months; and</text></subclause><subclause id="idFF83B4A31D0B4653AA793C9898F4F4FF"><enum>(V)</enum><text>has a current offer to work outside of the United States, an offer to interview for work outside of the United States, a professional history of working outside of the United States, a job that requires travel outside of the United States, or is enrolled in a professional training program that requires travel outside of the United States.</text></subclause></clause></subparagraph><subparagraph id="idE99AE07E9E864B09832FB26BB6051F9E" indent="up1"><enum>(B)</enum><text>The Secretary of State shall revoke a passport issued to an individual under subparagraph (A) upon a determination that the individual has failed to make child support payments  consistently and in good faith for more than  6 months.</text></subparagraph><subparagraph id="id238F2A642B104E5284710E26DCEBB230" indent="up1"><enum>(C)</enum><text>The Secretary of State shall report the issuance of a passport under this paragraph to the Secretary.</text></subparagraph><subparagraph id="id9FE391BC7E9A4BA2A8F42D8D4C3DF081" indent="up1"><enum>(D)</enum><text>The Secretary shall report the issuance of a passport under this paragraph to the State agency that certified in accordance with section 454(31) that the individual to whom the passport is issued owed child support arrearages in an amount exceeding $2,500.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id8A616F87FD1B4CD886C4BD7DC7229266"><enum>313.</enum><header>Child support
			 enforcement programs for Indian tribes</header><subsection id="idEB87228FB22E424292CBAB5748ED4056"><enum>(a)</enum><header>Tribal access
			 to the Federal parent locator service</header><text>Section 453(c)(1) of the
			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/653">42 U.S.C. 653(c)(1)</external-xref>) is amended by inserting <quote>or
			 Indian tribe or tribal organization (as defined in subsections (e) and (l) of
			 section 4 of the Indian Self-Determination and Education Assistance Act (25
			 U.S.C. 450b)),</quote> after <quote>any State</quote>.</text></subsection><subsection id="id6F8C18D9BAF942EC95E850DD635FDA28"><enum>(b)</enum><header>Waiver
			 authority for Indian tribes or tribal organizations operating child support
			 enforcement programs</header><text>Section 1115(b) of the Social Security Act (42 U.S.C.
			 1315(b)) is amended—</text><paragraph id="idA204594EE02C404A87E1BD60CDD5EC9A"><enum>(1)</enum><text>by redesignating
			 paragraphs (1) through (3) as subparagraphs (A) through (C),
			 respectively, and realigning the left margin of subparagraph (C) so as to align with subparagraphs (A) and (B) (as so redesignated);</text></paragraph><paragraph id="id6F06FA20DFA74CE79957DCA8362F4A34"><enum>(2)</enum><text>by inserting
			 <quote>(1)</quote> after <quote>(b)</quote>; and</text></paragraph><paragraph id="id41276EC258954446B30C19C872ED0827"><enum>(3)</enum><text>by adding at the
			 end the following:</text><quoted-block display-inline="no-display-inline" id="idFFC1B7EA879D44BCA78819A79E5EF800" style="OLC"><paragraph id="id2BF8D86D40C5460585B00EBEA285C8BE" indent="up1"><enum>(2)</enum><text>An Indian tribe or tribal
				organization operating a program under section 455(f) shall be considered a
				State for purposes of authority to conduct an experimental, pilot, or
				demonstration project under subsection (a) to assist in promoting the
				objectives of part D of title IV and receiving payments under the second
				sentence of that subsection. The Secretary may waive compliance with any
				requirements of section 455(f) or regulations promulgated under that section to
				the extent and for the period the Secretary finds necessary for an Indian tribe
				or tribal organization to carry out such project. Costs of the project which
				would not otherwise be included as expenditures of a program operating under
				section 455(f) and which are not included as part of the costs of projects
				under section 1110, shall, to the extent and for the period prescribed by the
				Secretary, be regarded as expenditures under a tribal plan or plans approved
				under such section, or for the administration of such tribal plan or plans, as
				may be appropriate. An Indian tribe or tribal organization applying for or
				receiving start-up program development funding pursuant to section 309.16 of
				title 45, Code of Federal Regulations, shall not be considered to be an Indian
				tribe or tribal organization operating a program under section 455(f) for
				purposes of this
				paragraph.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" id="idA615A5E0E619455AB711EFF524F5E3F8"><enum>314.</enum><header>Parenting time arrangements</header><subsection commented="no" id="idAB68D960AFBE4160929F4F9E4DCB2369"><enum>(a)</enum><header>State plan amendments</header><text display-inline="yes-display-inline">Section 454 of the
			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/654">42 U.S.C. 654</external-xref>), as amended by section
			 311(c), is further amended—</text><paragraph commented="no" id="id3A33F15C53E64D00A861379E0280B324"><enum>(1)</enum><text>in paragraph
			 (4)(A), in the matter preceding clause (i), by inserting <quote>, establishment
			 of voluntary parenting time arrangements,</quote> after <quote>establishment of

			 (26)(A), by inserting <quote>to establish voluntary parenting time
			 arrangements,</quote> after <quote>to establish paternity,</quote>;</text></paragraph><paragraph commented="no" id="idF9B5D40D31AD4E97B74403A088645C39"><enum>(6)</enum><text>in paragraph

				arrangement at the time that a support order (as defined in section 453(p)) is
				initially issued under this part for parents who are not subject to a divorce or
				dissolution decree and for whom the voluntary parenting time
				arrangement is not
				contested, in
				accordance with such requirements and standards as the Secretary determines necessary and that include exceptions for family or domestic violence, dating violence, sexual assault, and stalking.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="idBAEE938DFA39497DA1ADAF68CFA27B0B"><enum>(b)</enum><header>Secretarial guidance</header><text>The Secretary shall issue guidance for States for the establishment of voluntary parenting time arrangements. The guidance shall provide that in establishing such arrangements, a State shall establish procedures to ensure—</text><paragraph commented="no" id="idD77CEF71614242C29596C739D616F002"><enum>(1)</enum><text>the informed and voluntary participation of both parents in the establishment of a voluntary parenting time arrangement that is free from coercion and threats of recrimination;</text></paragraph><paragraph commented="no" id="id1AFD6747F5854D6A88E47DDFEE3A67C8"><enum>(2)</enum><text>each parent's informed consent to the terms and legal implications of any parenting time plan established under a voluntary parenting time arrangement; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id44243B94440D4260936EFB2A17A90F1D"><enum>(3)</enum><text>that all voluntary parenting time arrangements comply with State law.</text></paragraph></subsection></section><section id="H5EC79578EDDF40439B87623408EA62AA"><enum>315.</enum><header>Efficient use of the national directory of new hires database for federally sponsored research assessing the effectiveness of federal policies and programs in achieving positive labor market outcomes</header><text display-inline="no-display-inline">Section 453 (<external-xref legal-doc="usc" parsable-cite="usc/42/653">42 U.S.C. 653</external-xref>) is amended—</text><paragraph id="H6C0C3F83FF9E4E039571B664185F9DCE"><enum>(1)</enum><text>in subsection (i)(2)(A), by striking <quote>24</quote> and inserting <quote>48</quote>; or</text></clause><clause id="H11ED7F13C126465CA14F6FE86351EC51"><enum>(ii)</enum><text>an evaluation or statistical analysis undertaken to assess the effectiveness of a Federal program in achieving positive labor market outcomes (including through grant or contract), by—</text><subclause id="HC58368221DA04F2EA0E7BABA4B148E8A"><enum>(I)</enum><text>the Department of Health and Human Services;</text></subclause><subclause id="H690C0620D17C4B79B767B58E9EE3B16B"><enum>(II)</enum><text>the Social Security Administration;</text></subclause><subclause id="HA079C22A4E10488DB9B30812373F2D93"><enum>(III)</enum><text>the Department of Labor;</text></subclause><subclause id="HA57DB050EEB34DA19F80F16860CC42A1"><enum>(IV)</enum><text>the Department of Education;</text></subclause><subclause id="HE51675EC7FAB46FDB60B746638A21CCD"><enum>(V)</enum><text>the Department of Housing and Urban Development;</text></subclause><subclause id="H02CE695D630D4A95A4F92590AE6E5C43"><enum>(VI)</enum><text>the Department of Justice;</text></subclause><subclause id="HFEB829CB4ED24022AB3E10B563E723F3"><enum>(VII)</enum><text>the Department of Veterans Affairs;</text></subclause><subclause id="HD11372F6213143AAB13D0674DF30107E"><enum>(VIII)</enum><text>the Bureau of the Census;</text></subclause><subclause id="H92EAC48EAFD245CBAD484E52265CF690"><enum>(IX)</enum><text>the Department of Agriculture; or</text></subclause><subclause id="H0BF3AC324BE144A1BDD4A16FDB8A2F2F"><enum>(X)</enum><text>the National Science Foundation.</text></subclause></clause></subparagraph><subparagraph id="HC2BBA6C4F93E4BBC8EB7DB03F0966CFF"><enum>(B)</enum><header>Personal identifiers</header><text>Data or information provided under this paragraph may include a personal identifier only if, in addition to meeting the requirements of subsections (l) and (m)—</text><clause id="H50CD87158AC649E68374AC9FA0D41F62"><enum>(i)</enum><text>the State or Federal agency conducting the research described in subparagraph (A)(i), or the Federal department or agency undertaking the evaluation or statistical analysis described in subparagraph (A)(ii), as applicable, enters into an agreement with the Secretary regarding the security and use of the data or information;</text></clause><clause id="HFCC12A3E736C4DB3AD347EBC0FACEEC7"><enum>(ii)</enum><text>the agreement includes such restrictions or conditions with respect to the use, safeguarding, disclosure, or redisclosure of the data or information (including by contractors or grantees) as the Secretary deems appropriate;</text></clause><clause id="H0F1995B268BB4CDE8786A98A6CCEC19D"><enum>(iii)</enum><text>the data or information is used exclusively for the purposes defined in the agreement; and</text></clause><clause id="HC5B0056EBD894857B194831C59530DB0"><enum>(iv)</enum><text>the Secretary determines that the provision of data or information under this paragraph is the minimum amount needed to conduct the research, evaluation, or statistical analysis, as applicable, and will not interfere with the effective operation of the program under this part.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H633DCFBA26EE42CDBDF48A9E24637D7D"><enum>(C)</enum><header>Penalties for unauthorized disclosure of data</header><text>Any individual who willfully discloses a personal identifier (such as a name or social security number) provided under this paragraph, in any manner to an entity not entitled to receive the data or information, shall be fined under title 18, United States Code, imprisoned not more than 5 years, or both.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></subtitle><subtitle id="idEA998B85A20A4DF99D15CC369A96DF6D" style="OLC"><enum>B</enum><header>Child Support Enforcement Task Force</header><section id="id1F41F1D3BCC54FF5B235EB761B82C2A9"><enum>321.</enum><header>Child Support Enforcement Task Force</header><subsection id="idC994F6B9DD5F47EDB8F3BCB504CE786F"><enum>(a)</enum><header>Establishment</header><text>There
			 is established in the executive branch a task force to be known as the Child Support Enforcement Task Force (referred to in this section as the <quote>Task Force</quote>).</text></subsection><subsection id="id30F474D3264D4967B7AB3487F2DA0BF4"><enum>(b)</enum><header>Membership</header><paragraph id="idB963EC328F22438AA4B4594349F930C4"><enum>(1)</enum><header>Composition</header><text>The
			 Task Force shall be composed of 15 members consisting of—</text><subparagraph id="id1B862A24FF734E0482D142EA74ED4BBF"><enum>(A)</enum><text>the Assistant Secretary of the Administration for Children and Families of the Department of Health and Human Services;</text></subparagraph><subparagraph id="idED64EF0EBA554E6AA3DA7353131C3CDF"><enum>(B)</enum><text>5 members appointed by the Senate, of which—</text><clause id="id085F3E16C1154A6C8444B15EFA0D9091"><enum>(i)</enum><text>1 shall be appointed by the Majority Leader of the Senate;</text></clause><clause id="idD14B9A732AD84140A3AAF027582A8FED"><enum>(ii)</enum><text>1 shall be appointed by the Minority Leader of the Senate;</text></clause><clause id="id49D8AEA18C654AA589212C7C85E25907"><enum>(iii)</enum><text>1 shall be appointed by the Chairman of the Committee on Finance of the Senate;</text></clause><clause id="idE51BF598DA7A417D8B82368F71C47B78"><enum>(iv)</enum><text>1 shall be appointed by the Ranking Member of the Committee on Finance of the Senate; and</text></clause><clause id="id3B98C7B34F6240CE983FA1B296357CDC"><enum>(v)</enum><text>1 shall be jointly appointed by the Chairman and Ranking Member of the Committee on Finance of the Senate;</text></clause></subparagraph><subparagraph id="id3BA5AAD1AB764A4BA204655C73B33C1E"><enum>(C)</enum><text>5 members appointed by the House of Representatives, of which—</text><clause id="id454D827207B14FFA92F0D640E9C78F65"><enum>(i)</enum><text>1 shall be appointed by the Speaker of the House of Representatives;</text></clause><clause id="idDD99222E1FE942F4AAD84E15BCFA970A"><enum>(ii)</enum><text>1 shall be appointed by the Minority Leader of the House of Representatives;</text></clause><clause id="idF8FBCED9BD7F49C99576AE66A7EBE36C"><enum>(iii)</enum><text>1 shall be appointed by the Chairman of the Committee on Ways and Means of the House of Representatives;</text></clause><clause id="id0BC1F6D0775F4140B9D52C261F1F14D7"><enum>(iv)</enum><text>1 shall be appointed by the Ranking Member of the Committee on Ways and Means of the House of Representatives; and</text></clause><clause id="idF383193BB4CD42EBBBFB31FCFA0D6A9D"><enum>(v)</enum><text>1 shall be jointly appointed by the Chairman and Ranking Member of the Committee on Ways and Means of the House of Representatives; and</text></clause></subparagraph><subparagraph id="idE598920245EF429C8B4686C215D387EC"><enum>(D)</enum><text>4 members appointed by the President.</text></subparagraph></paragraph><paragraph id="id96AE08866E9F4A6788217C1665141ED8"><enum>(2)</enum><header>Date</header><text>The appointments of the members of the Task Force shall be made not later than 6 months after the date of enactment of this Act.</text></paragraph><paragraph id="id961F718A0C23492FABA76FA1C309DC9D"><enum>(3)</enum><header>Expertise</header><text>The
			 membership of the Task Force shall consist of individuals who are knowledgeable
			 on issues regarding child support and related activities.</text></paragraph><paragraph id="id32A924DA2B944501BE847EE47D1CD2A4"><enum>(4)</enum><header>Period of
			 appointment; vacancies</header><text>Members shall be appointed for the life of the Task Force. A vacancy in the Task Force shall be filled in the manner in which the original appointment was made and shall not affect the powers or duties of the Task Force.</text></paragraph><paragraph id="id5B1D42F6C7454C428D7F68FF97189BAA"><enum>(5)</enum><header>Quorum</header><subparagraph id="idBECFA121AC0946D48BB6449C45B87EEF"><enum>(A)</enum><header>In general</header><text>A majority of the Task Force shall constitute a quorum, but a lesser number of members may hold hearings.</text></subparagraph><subparagraph id="idEB976BC9470B40AAA9B4FDEFB3E2F798"><enum>(B)</enum><header>Report</header><text>The Task Force may not submit the report  required under subsection (c) until all of the members have been appointed.</text></subparagraph></paragraph><paragraph id="id1CF87B0589A446BBAAD6D8B44F44A15A"><enum>(6)</enum><header>Meetings</header><subparagraph id="idC489D7D5821F48AA92986CA58D7179F6"><enum>(A)</enum><header>Initial
			 meeting</header><text>Not later than 30 days after the Task Force has a majority, the Task Force shall hold its first meeting.</text></subparagraph><subparagraph id="id9ED55FA66022459FB2659CC6DF73D843"><enum>(B)</enum><header>Chairperson and Vice Chairperson</header><text>During
			 the first meeting of the Task Force, the Task Force shall select a Chairperson and Vice Chairperson from
			 among the members appointed as of the date of the meeting.</text></subparagraph><subparagraph id="idE0C6CB0A9A8E4C1C85133A218CD1D4A5"><enum>(C)</enum><header>Other
			 meetings</header><text>Following the first meeting of the Task Force, any
			 subsequent meetings shall be at the call of the Chairperson or Vice Chairperson.</text></subparagraph><subparagraph id="idA80F6E330C614D7BBAADD715159B9527"><enum>(D)</enum><header>Public meetings</header><text>In addition to any other meetings held by the Task Force, the Task Force shall hold at least 3 meetings that are open to the public and preceded by timely public notice in the Federal Register of the time, place, and subject of the meeting. At least one public meeting of the Task Force shall focus on issues relevant to family courts or other State or local courts with responsibility for conducting or supervising proceedings relating to child support enforcement, child welfare, or social services for children and their families. At the public meetings of the Task Force, subject to such requirements and limitations as are determined appropriate by the Chairperson, appearances may be made and oral and written statements given by members of the public and the Task Force shall engage, at a minimum, with the following groups:</text><clause id="idDDE179774C004916ABAC80A4F0D6473E"><enum>(i)</enum><text>Administrators of State child support programs.</text></clause><clause id="id4ADFE3367A634A4090D45C97A31244D0"><enum>(ii)</enum><text>Judges who preside over family courts or other State or local courts with responsibility for conducting or supervising proceedings relating to child support enforcement, child welfare, or  social services for children and their families, and organizations that represent such judges.</text></clause><clause id="idF69C1A0C84B14C0381AD229238EA2E7D"><enum>(iii)</enum><text>Custodial parents and organizations that represent such parents.</text></clause><clause id="idCC52EF99437A4E649BB622B75FBFBB63"><enum>(iv)</enum><text>Noncustodial parents and organizations that represent such parents.</text></clause><clause id="idAB70BF74D79C4F79A0CC1D4FB7F44A98"><enum>(v)</enum><text>Organizations that represent fiduciary entities that are affected by child support enforcement policies.</text></clause></subparagraph></paragraph><paragraph id="id19B6CDA89E1A49E7A4BD84E0E2CB9DB3"><enum>(7)</enum><header>Compensation</header><text>Members
			 of the Task Force—</text><subparagraph id="id60E5D602780A4332AF4D46BF38E4B445"><enum>(A)</enum><text>shall not receive compensation for service on the Task Force; and</text></subparagraph><subparagraph id="idF8B5AEC312C946D78158B7353DB1D639"><enum>(B)</enum><text>shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of service for the Task Force.</text></subparagraph></paragraph></subsection><subsection id="id96AFC8AEEA5A4914B64A21AC8C6447A3"><enum>(c)</enum><header>Report to Congress</header><text>Not later than January 1, 2016, the Task Force shall
			 prepare and submit a report to Congress  that contains the Task Force's findings and recommendations for improvements in child support enforcement.   The report shall   include
			 the following:</text><paragraph id="id1C1C8C909E4D4E7285C0C49932330377"><enum>(1)</enum><text>An evaluation of the effectiveness of existing child support
			 enforcement programs and collection practices employed by State agencies
			 administering programs under part D of title IV of the Social Security Act (42
			 U.S.C. 651 et seq.) and an analysis of the extent to which such practices result in any unintended consequences or
			 performance issues associated with such programs and practices.</text></paragraph><paragraph id="id8420230070324162982D59A480D40438"><enum>(2)</enum><text>Recommendations for methods to
			 enhance the effectiveness of child support enforcement programs and collection
			 practices.</text></paragraph><paragraph commented="no" id="id60A3A68369AC4EB9A92F9DFD51343271"><enum>(3)</enum><text>An analysis of the feasibility of the establishment of a centralized lien registry by each State to contain all liens placed against real and personal property for overdue child support that would ensure access to and sharing of registry data among all necessary entities and individuals prior to any sale or distribution of property or funds.</text></paragraph><paragraph id="idA9CF8FE500944760B23D1ECA913C8FC1"><enum>(4)</enum><text>A compilation of State recovery and distribution policies.</text></paragraph><paragraph id="idCEFE56938AA54E7BA50D8540E4CDD47C"><enum>(5)</enum><text>Recommendations for methods to foster
			 engagement by fathers in their children's lives through consideration of parental
			 time and visitation with children.</text></paragraph><paragraph id="idFB710196F2484584881B4269E3B1A5DF"><enum>(6)</enum><text>An analysis of the role
			 for alternative dispute resolution in making child support determinations.</text></paragraph><paragraph id="id718BF720FD1949E4B2D2290789E250D3"><enum>(7)</enum><text>Identification of  best practices for—</text><subparagraph id="id2BFCEBC9043545A0AA0FC05F93DFC7BD"><enum>(A)</enum><text>determining which services and support programs available to custodial and noncustodial parents are non-duplicative, evidenced-based, and produce quality outcomes, and connecting custodial and noncustodial parents to those services and support programs;</text></subparagraph><subparagraph id="id9DDE8841EB5843189A6E97BC66B1FA7E"><enum>(B)</enum><text>providing employment support, job training, and job
			 placement for custodial and noncustodial parents; and</text></subparagraph><subparagraph id="id90945AC3BF34430BB0C77B53DA8D617F"><enum>(C)</enum><text>establishing
			 services, supports, and child support payment tracking for noncustodial
			 parents, including options for the prevention of, and intervention on, uncollectible
			 arrearages, such as retroactive obligations and Medicaid birthing costs.</text></subparagraph></paragraph><paragraph id="idC81BB2AB3A1A4C308B022E7192B4AD08"><enum>(8)</enum><text>Recommendations for methods for States to use to collect child support payments from individuals who owe excessive arrearages as determined under section 454(31) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/654">42 U.S.C. 654(31)</external-xref>).</text></paragraph><paragraph id="id26BD336C6FB847568708833818C30C09"><enum>(9)</enum><text>Recommendations for such
			 legislative and administrative actions as the Task Force
			 determines appropriate for improvement in child support enforcement.</text></paragraph></subsection><subsection id="idEEE5A68991294EB38B10F6D3C3327C28"><enum>(d)</enum><header>Powers of the Task Force</header><paragraph commented="no" id="id478E335B6F1344BCA50AE21B9C25F98B"><enum>(1)</enum><header>Hearings</header><subparagraph commented="no" id="id982BBE330F514A3CB03C9CB6E01B6EC4"><enum>(A)</enum><header>In general</header><text>The Task Force may hold such hearings, sit, and act at such times and places, take such testimony, and receive such evidence as the Task Force considers advisable to carry out this section.</text></subparagraph><subparagraph commented="no" id="id7CEF27BEFE4D461FA5CB05ACA2886580"><enum>(B)</enum><header>Information from Federal agencies</header><text>The Task Force may secure directly from any Federal agency such information as the Task Force considers necessary to carry out this section. Upon request of the Chairperson, the head of such agency shall furnish such information to the Task Force.</text></subparagraph></paragraph><paragraph id="idD367E37ADDA7455996CC850D97512292"><enum>(2)</enum><header>Rules</header><text>For the purposes of carrying out its duties in preparing the report required under subsection (c), the Task Force may adopt such rules for its organization and procedures as it determines appropriate.</text></paragraph><paragraph id="id12B442F80D934A64AD0F9FAD5D9CFD91"><enum>(3)</enum><header>Postal services</header><text>The Task Force may use the United States mails in the same manner and under the same conditions as other agencies of the Federal Government.</text></paragraph><paragraph id="id230238CE9910423892F69EB545CED1E4"><enum>(4)</enum><header>Donations and volunteers</header><text>The Task Force may accept, use, and dispose of donations of money and property and may accept such volunteer services of individuals as it determines appropriate.</text></paragraph><paragraph id="id4457DFFD1277471DB20CA07B0906C4E5"><enum>(5)</enum><header>Personnel matters</header><subparagraph id="idB53DE018B1D04C76B2032C7BDBE534B4"><enum>(A)</enum><header>Staff</header><text>The Chairperson may, without regard to the civil service laws and regulations, appoint and terminate an executive director and such other additional employees as may be necessary to enable the Task Force to perform its duties. The employment of an executive director shall be subject to confirmation by the Task Force.</text></subparagraph><subparagraph id="id98CD870149DA42218FDD2AA039771B8E"><enum>(B)</enum><header>Compensation</header><text>The Chairperson may fix the compensation of the executive director and other employees of the Task Force without regard to chapter 51 and subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, relating to classification of positions and General Schedule pay rates, except that the rate of pay for the executive director and other personnel may not exceed the rate payable for level V of the Executive Schedule under section 5316 of such title.</text></subparagraph><subparagraph id="id48CA62A508114C0DAF9B39584A078DBF"><enum>(C)</enum><header>Detail of Government employees</header><text>Any Federal Government employee may be detailed to the Task Force without reimbursement, and such detail shall be without interruption or loss of civil service status, benefits, or privilege.</text></subparagraph><subparagraph id="id5CB59C1F42AC471CBEC905E028BFB538"><enum>(D)</enum><header>Temporary and intermittent services</header><text>The Chairperson may procure temporary and intermittent services under <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109(b)</external-xref> of title 5, United States Code, at rates for individuals which do not exceed the daily equivalent of the annual rate of basic pay prescribed for level V of the Executive Schedule under section 5316  of such title.</text></subparagraph></paragraph></subsection><subsection id="id59EECE8A30E048A0AA2ADB8C82E2020C"><enum>(e)</enum><header>Termination</header><text>The
			 Task Force shall terminate 60 days after
			 submission of the report required under subsection (c).</text></subsection><subsection id="idEF07869F47AF4FF8808D326479321F5E"><enum>(f)</enum><header>Funding</header><paragraph id="id38B5CC3D07D94735A47A649E997718FF"><enum>(1)</enum><header>In general</header><text>From the unobligated balance of funds made available to carry out section 414 of the Social Security Act (42 U.S.C.  614),  $2,000,000 of such funds are hereby transferred and made available to carry out this section.  Amounts transferred and made available to carry out this section shall remain available through fiscal year 2016 and shall not be subject to reduction under a sequestration order issued under the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900 et seq.</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA612F3DBA8594102B61CB60505FCB3B1"><enum>(2)</enum><header>Unobligated
			 amounts</header><text>Any amounts made available to carry out this section that are
			 unobligated on the date of the termination of the Task Force under subsection
			 (e) shall be returned to the Treasury of the United States  .</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD9C8984F362D40A3863BD0BA0C8C0689"><enum>(g)</enum><header>Administration</header><paragraph commented="no" display-inline="no-display-inline" id="idCDB5D1428EE4457E834B56E04AF5CC2A"><enum>(1)</enum><header>In general</header><text>Upon the request of the Task Force, the Secretary of Health and Human Services  shall provide to the Task Force, on a reimbursable basis, the administrative support services necessary for the Task Force to carry out its responsibilities under this Act. These administrative services may include human resource management, budget, leasing, accounting, and payroll services.</text></paragraph><paragraph id="id22C0967CBF7D47398A92F62DA2D03B6C"><enum>(2)</enum><header>Travel expenses</header><text>The members of the Task Force shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Task Force.</text></paragraph></subsection></section></subtitle><subtitle id="idC681C1DF458D40B6A3AB5B30A1C624D5" style="OLC"><enum>C</enum><header>Effective Dates</header><section id="id945C4499CA0A451ABCFE5ED34B5B5993"><enum>331.</enum><header>Effective dates</header><subsection id="idD87759BA48C74DA3A18320F8C4BCD291"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), this title and the amendments made by this title take effect on the date of enactment of this Act.</text></subsection><subsection id="idAF4FC5CC30E54998A855C81CE83E68D0"><enum>(b)</enum><header>Exceptions</header><paragraph id="id26AD319A40BC4CEE830FCC75DD8FEA77"><enum>(1)</enum><header>UIFSA state law requirements; parenting time arrangements</header><subparagraph id="idA6D49EB6A6C54DCB8E483CDFCACC6FCD"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the amendments made by sections 311(f) and 314(a) take effect on October 1, 2014.</text></subparagraph><subparagraph id="id14605593A6164D49B32CB1D80E4CA4AD"><enum>(B)</enum><header>Delay</header><text>In the case of a State plan under part D of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/651">42 U.S.C. 651 et seq.</external-xref>) which the Secretary of Health and Human Services determines requires State legislation or State regulation in order for the plan to meet the additional requirements imposed by the amendments made by sections 311(f) and 314(a), the State plan shall not be regarded as failing to comply with the requirements of such sections solely on the basis of its failure to meet these additional requirements before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of enactment of this Act. For purposes of the previous sentence, in the case of a State that has a 2-year legislative session, each year of the session is considered to be a separate regular session of the State legislature.</text></subparagraph></paragraph><paragraph id="id91B00646B52B44E39A9ACD779AF8012C"><enum>(2)</enum><header>Relief from passport sanctions; child support enforcement programs for Indian tribes</header><text>The amendments made by sections 312 and 313 shall take effect on the date that is 1 year after the date of enactment of this Act.</text></paragraph></subsection></section></subtitle></title><title id="id191936885E2C4CDBB6C4F9573DE781EF" style="OLC"><enum>IV</enum><header>Budgetary Effects</header><section commented="no" display-inline="no-display-inline" id="id31a094939a34455fa08fb05a2051f4fe" section-type="subsequent-section"><enum>401.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the Senate Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section></title></legis-body><endorsement><action-date>December 19, 2013</action-date><action-desc>Read twice and placed on the calendar</action-desc></endorsement></bill>
