			 term <term>assets</term> includes contracts, facilities, property, records,
			 unobligated or unexpended balances of appropriations, and other funds or
			 resources (other than personnel).</text></paragraph><paragraph id="ID4D60C030E07E47238F5E526C3DADFEE3"><enum>(2)</enum><header>Department</header><text>The
			 term <term>Department</term> means the Department of Commerce and the
			 Workforce.</text></paragraph><paragraph id="IDEB2B88E287824B42B5AD51A2F31BE26F"><enum>(3)</enum><header>Function</header><text>The
			 term <term>function</term> includes any authority, power, right, privilege,
			 immunity, program, project, activity, duty, and responsibility.</text></paragraph><paragraph id="ID260798CE48DB473D9E63D48B6948FDD7"><enum>(4)</enum><header>Perform</header><text>The
			 term <term>perform</term>, with respect to a function, includes—</text><subparagraph id="id2CE7F3C48B3A4E328AEC66E122D5E187"><enum>(A)</enum><text>the undertaking,
			 fulfillment, or execution of any duty or obligation; and</text></subparagraph><subparagraph id="id937BABA485374D29A5F8AFE78E21D39B"><enum>(B)</enum><text>the exercise of
			 any power, authority, right, or privilege.</text></subparagraph></paragraph><paragraph id="ID7C42B63AC57543E48A6E67C1CF04228C"><enum>(5)</enum><header>Personnel</header><text>The
			 term <term>personnel</term> means officers and employees.</text></paragraph><paragraph id="ID34C159BB5C1F461E820BE7BBBDFB1CCB"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Commerce and the
			 Workforce.</text></paragraph></section><title id="ID62E4D18CCA8B47D091A49138E5BAAE50"><enum>I</enum><header>Establishment of
			 Department</header><section id="ID79F82FADADAE4571B1AB196A0B64AC52"><enum>101.</enum><header>Establishment</header><subsection id="ID69C7C61460534B34B03797E886AC3840"><enum>(a)</enum><header>Establishment</header><text>There
			 is established an executive department to be known as the Department of
			 Commerce and the Workforce.</text></subsection><subsection id="id67F720E95DF749E9978CBF2D8D6BC92A"><enum>(b)</enum><header>Mission</header><text>The
			 primary mission of the Department shall be to advance economic growth and jobs
			 and opportunities for the people of the United States by—</text><paragraph id="idE295C15DAB324304941314A6E0E15A34"><enum>(1)</enum><text>driving United
			 States competitiveness in the global marketplace;</text></paragraph><paragraph id="id421E7F3CF4834EC38CB0A3F3A0589F54"><enum>(2)</enum><text>ensuring a
			 competitive economic climate that is conducive to the development, growth, and
			 expansion of small businesses; and</text></paragraph><paragraph id="id3DD44BCDF9A04E5892BAE01746195715"><enum>(3)</enum><text>promoting and
			 developing the safety and welfare of the wage earners, job seekers, and
			 retirees of the United States.</text></paragraph></subsection><subsection id="id6DD55250447645FEB88DF5E1F2875285"><enum>(c)</enum><header>Secretary</header><text>The
			 head of the Department shall be the Secretary of Commerce and the Workforce,
			 who shall be appointed by the President, by and with the advice and consent of
			 the Senate.</text></subsection><subsection id="idDA0A48B4F0C141198B51D8F36741049B"><enum>(d)</enum><header>Administration</header><text>The
			 Department shall be administered, in accordance with this Act, under the
			 supervision and direction of the Secretary.</text></subsection></section><section id="id7FDE0BD064E048138EE4098B729E9F2F"><enum>102.</enum><header>Office of the
			 Secretary</header><subsection id="id31758B59B90A4122826C89FA586981BC"><enum>(a)</enum><header>Deputy
			 Secretary</header><paragraph id="id52ED4271F63C48429DF53DCD89A641C5"><enum>(1)</enum><header>Appointment</header><text>There
			 shall be in the Office of the Secretary a Deputy Secretary of Commerce and the
			 Workforce, who shall be appointed by the President, by and with the advice and
			 consent of the Senate.</text></paragraph><paragraph id="idB22B58FF3386423DADD73DBF25BA812F"><enum>(2)</enum><header>Temporary
			 assumption of duties of Secretary</header><text>The Deputy Secretary shall
			 perform the duties of the Secretary—</text><subparagraph id="id79A22ECEB2F8444EB403AF674D89555E"><enum>(A)</enum><text>in case of the
			 death, resignation, or removal from office of the Secretary, until a successor
			 is appointed; and</text></subparagraph><subparagraph id="id2B5681A173694DDDA9E6BEE3E4147A1D"><enum>(B)</enum><text>in case of the
			 absence or sickness of the Secretary, until the termination of such absence or
			 sickness.</text></subparagraph></paragraph></subsection><subsection id="id21C6A2B9ADAC489EA0925FE5E650D2B6"><enum>(b)</enum><header>Offices in the
			 Office of the Secretary</header><text display-inline="yes-display-inline">There
			 shall be in the Office of the Secretary—</text><paragraph commented="no" display-inline="no-display-inline" id="id8850C193FDA64B68B372E6553B92DF43"><enum>(1)</enum><text>the Office of
			 Public Liaison and Special Assistance;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id46EAC71907A84268975F6866C1263B33"><enum>(2)</enum><text>the Office of
			 Legislative and Intergovernmental Affairs;</text></paragraph><paragraph id="id30CC4D2724D74694B0EC40419FDD98E3"><enum>(3)</enum><text display-inline="yes-display-inline">the Office of the Executive Secretariat;
			 and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id949C8447B21F4173BB68B3A75EEB2C1E"><enum>(4)</enum><text>the Office of
			 Community and Public Affairs.</text></paragraph></subsection><subsection id="id966DFF3FC34449138305AB3140EB2576"><enum>(c)</enum><header>General
			 Counsel</header><paragraph id="idCAD9AAC88B2344BC89D89B6E67133BD5"><enum>(1)</enum><header>Appointment</header><text>There
			 shall be in the Department a General Counsel, who shall be appointed by the
			 President, by and with the advice and consent of the Senate.</text></paragraph><paragraph id="idB8948AC49FD1478C9311E96501EE88FF"><enum>(2)</enum><header>Solicitor</header><text>The
			 Secretary shall appoint, in the Office of the General Counsel, a Solicitor of
			 Commerce and the Workforce.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEA8CD6DCAC4F4DF8815049FE3D9B4906"><enum>(d)</enum><header>Assistant
			 Secretaries</header><text>The President shall appoint, by and with the advice
			 and consent of the Senate, in the Office of the Secretary—</text><paragraph commented="no" display-inline="no-display-inline" id="id383549C688D04F0EB458C558618CC865"><enum>(1)</enum><text>an Assistant
			 Secretary for Policy, who shall be the head of the Office of Policy; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8E927911E38F45218792AE68A6217899"><enum>(2)</enum><text>an Assistant
			 Secretary for Legislative and Intergovernmental Affairs, who shall be the head
			 of the Office of Legislative and Intergovernmental Affairs.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id201E33263C8A4ECC8B9232186348AC29"><enum>(e)</enum><header>Directors</header><text>The
			 Secretary shall appoint, in the Office of the Secretary—</text><paragraph commented="no" display-inline="no-display-inline" id="idF98905D2E7CD4E919EF196045F1E544D"><enum>(1)</enum><text>an Executive
			 Secretariat Director, who shall be the head of the Office of the Executive
			 Secretariat; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB64912EB517E48CF8491D634160FF527"><enum>(2)</enum><text>a Community and
			 Public Affairs Director, who shall be the head of the Office of Community and
			 Public Affairs.</text></paragraph></subsection><subsection id="IDEF307C1C6CDA4AD6A3147128473A4F0D"><enum>(f)</enum><header>Other
			 officers</header><text>To assist the Secretary in the performance of the
			 functions of the Department, the Secretary shall appoint, as officers of the
			 Department—</text><paragraph id="IDD18EC190388D470A986D8FEC10159165"><enum>(1)</enum><text>a Chief of
			 Staff;</text></paragraph><paragraph id="idC29A9D73436B4484BD064E2A021B9098"><enum>(2)</enum><text>a Chief Financial
			 Officer; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71BF4BC94D1F4E5082865BD5E7A18900"><enum>(3)</enum><text>a Chief
			 Information Officer.</text></paragraph></subsection></section><section id="id45FB7B471C7E48C6ADF93FCE3D2C695B"><enum>103.</enum><header>Office of the
			 Workforce</header><subsection id="id078793326D3C41F3BC7F70984395E916"><enum>(a)</enum><header>Establishment</header><text>There
			 shall be in the Department an Office of the Workforce.</text></subsection><subsection id="id4866949D815A4A60A989F820F10F9924"><enum>(b)</enum><header>Under
			 Secretary</header><text>The head of the Office of the Workforce shall be the
			 Under Secretary of the Workforce, who shall be appointed by the President, by
			 and with the advice and consent of the Senate.</text></subsection><subsection id="id42E9AD748A92484D9A53D2BD778C49E6"><enum>(c)</enum><header>Boards,
			 administrations, and offices</header><text>There shall be in the Office of the
			 Workforce—</text><paragraph id="id7BB84EF1CF6F432A9A0959767CACE3D1"><enum>(1)</enum><text>the
			 Administrative Review Board;</text></paragraph><paragraph id="idD87723E2F23741F696B3AB4603C50491"><enum>(2)</enum><text>the Benefits
			 Review Board;</text></paragraph><paragraph id="idF6B7EC26FADE4648AAE543F84A2E2558"><enum>(3)</enum><text>the Occupational
			 Safety and Health Administration;</text></paragraph><paragraph id="id7D13AAAA6DAD45FCB984A2CA732E9DE1"><enum>(4)</enum><text>the Office of
			 Workers Compensation Programs;</text></paragraph><paragraph id="idE0E4A416F3174FB0A3BF7C657B1062AB"><enum>(5)</enum><text>the Wage and Hour
			 Division;</text></paragraph><paragraph id="id28A56B59B8C1445485E7348BA7581006"><enum>(6)</enum><text>the Employee
			 Benefits and Security Administration;</text></paragraph><paragraph id="idC6C17313A5C2486C947905E52F99A53A"><enum>(7)</enum><text>the Mine Safety
			 and Health Administration;</text></paragraph><paragraph id="id11396590581447DDB0D4C8B26505B67B"><enum>(8)</enum><text>the Office of
			 Labor-Management Standards;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA06BF92241DF48CABDEDB00CFC53EB71"><enum>(9)</enum><text>the Veterans's
			 Employment and Training Service; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id07B45853721743EBA3112EDF87A2C341"><enum>(10)</enum><text>the Office of
			 Disability Employment Policy.</text></paragraph></subsection></section><section id="idF20F9E7894ED4332A87CEE4F2BAFABA0"><enum>104.</enum><header>Patent and
			 Trademark Office</header><subsection id="id10AD26C1F3104E98963AE9DC0F088423"><enum>(a)</enum><header>Establishment</header><text>There
			 shall be in the Department the Patent and Trademark Office.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idAD512276195D4EC6ADCAFEB8B041E30D"><enum>(b)</enum><header>Under
			 Secretary</header><text>The head of the Patent and Trademark Office shall be
			 the Under Secretary for Intellectual Property, who shall be appointed by the
			 President, by and with the advice and consent of the Senate.</text></subsection></section><section id="id9EB3B4F211A049F5BA07A0CD87BE2E48"><enum>105.</enum><header>Small Business
			 Administration</header><subsection id="id2A49E58D73784FE78F73F39B7A7D0B18"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There shall be in the Department the Small
			 Business Administration.</text></subsection><subsection id="id6B66A9B218224EC0889DB54975B0214E"><enum>(b)</enum><header>Under
			 Secretary</header><text display-inline="yes-display-inline">The head of the
			 Small Business Administration shall be the Under Secretary of Small Business,
			 who shall be appointed by the President, by and with the advice and consent of
			 the Senate.</text></subsection><subsection id="id01A041B0B00049CDAD94B759E266C989"><enum>(c)</enum><header>Deputy Under
			 Secretary</header><text>There shall be in the Small Business Administration a
			 Deputy Under Secretary of Small Business, who shall be appointed by the
			 President, by and with the advice and consent of the Senate.</text></subsection><subsection id="id6BEBC2F237154D50A5C8515E7604CD12"><enum>(d)</enum><header>Assistant
			 Secretaries</header><text>To assist the Under Secretary of Small Business in
			 the performance of the duties of the Small Business Administration, the Under
			 Secretary of Small Business shall appoint 4 Assistant Secretaries.</text></subsection></section><section id="idC81590B20861405B84CD3B6BF2F4707F"><enum>106.</enum><header>Office of
			 Economic Affairs and Statistics</header><subsection id="idB07DF9E98AF844E9843D2733FF3AFBC3"><enum>(a)</enum><header>Establishment</header><text>There
			 shall be in the Department an Office of Economic Affairs and Statistics.</text></subsection><subsection id="id58CFE19C91AB4FE49ABDD517040ADDF9"><enum>(b)</enum><header>Under
			 Secretary</header><text>The head of the Office of Economic Affairs and
			 Statistics shall be the Under Secretary for Economic Affairs and Statistics,
			 who shall be appointed by the President, by and with the advice and consent of

			 employed intermittently in Government service.</text></section><section id="id556B04D8B20E4F029664E75B27F37423"><enum>313.</enum><header>Advisory
			 committees</header><subsection id="idDB56626130554972B636C43FFA91147A"><enum>(a)</enum><header>In
			 general</header><text>The Secretary may establish in accordance with the
			 Federal Advisory Committee Act (5 U.S.C. App.) such advisory committees as the
			 Secretary determines necessary to assist in the performance of the duties of
			 the Secretary.</text></subsection><subsection id="id9C91B20F05CD4470AA2659C8A01C5CC1"><enum>(b)</enum><header>Travel
			 expenses</header><text>Members of an advisory committee established under
			 subsection (a), other than full-time employees of the Federal Government, may
			 be allowed travel expenses, including per diem in lieu of subsistence, as
			 authorized by <external-xref legal-doc="usc" parsable-cite="usc/5/5703">section 5703</external-xref> of title 5, United States Code, while attending
			 meetings of the advisory committee or otherwise serving at the request of the
			 Secretary away from the homes or places of business of the members.</text></subsection></section></subtitle><subtitle id="idCDA282AEA63442C5B9AE915A7FD68015" style="OLC"><enum>B</enum><header>General administrative provisions</header><section id="idF039B28AFDE8440494D6C69F143700B3"><enum>321.</enum><header>General
			 authority</header><text display-inline="no-display-inline">To the extent
			 appropriate to perform any function transferred by this Act, the Secretary or
			 any officer or employee of the Department may exercise, in carrying out the
			 function so transferred, any authority available by law (including
			 appropriations Acts) to the official or agency from which the function was
			 transferred.</text></section><section id="id7C73D1D8181B48028068DCBA4D2BB647"><enum>322.</enum><header>Delegation</header><text display-inline="no-display-inline">Except as otherwise expressly prohibited by
			 law, and except as otherwise provided in this Act, the Secretary may, as the
			 Secretary determines to be appropriate—</text><paragraph id="idDCEF3EE35FDE4A2A99B58978AE227479"><enum>(1)</enum><text display-inline="yes-display-inline">delegate any functions to officers or
			 employees of the Department; and</text></paragraph><paragraph id="id74E8DE25D7D34C97AB8820388E3A87FA"><enum>(2)</enum><text display-inline="yes-display-inline">authorize successive redelegations of
			 functions within the Department.</text></paragraph></section><section id="idDADAD173C8664B9FA0D7F3AD920CCCF8"><enum>323.</enum><header>Reorganization</header><subsection id="id09FAE43D8B154D8282BF77BD30898CEF"><enum>(a)</enum><header>In
			 general</header><text>Subject to subsection (b), the Secretary may establish,
			 alter, consolidate, or discontinue such organizational units or components
			 within the Department as the Secretary determines to be appropriate.</text></subsection><subsection id="id618D7C38CE0F465FB233A3A33FA3F660"><enum>(b)</enum><header>Limitations</header><text>The
			 authority of the Secretary under subsection (a) shall not extend to—</text><paragraph id="id8D277ECC850647C38E5B2BBAF9F77CF8"><enum>(1)</enum><text>the abolition of
			 any organizational unit or component established by this Act; or</text></paragraph><paragraph id="idABEA106DD6FD4EE6B196560245EAF8A8"><enum>(2)</enum><text>the transfer of
			 any function vested by this Act in any organizational unit or component.</text></paragraph></subsection></section><section id="idAAF81BC55546450787949569518137C7"><enum>324.</enum><header>Rules</header><text display-inline="no-display-inline">The Secretary may promulgate such procedural
			 and administrative regulations as the Secretary determines to be appropriate to
			 administer and manage the functions of the Secretary under this Act.</text></section><section id="id57842A4FCCC54994969A127166A93BEA"><enum>325.</enum><header>Subpoena</header><text display-inline="no-display-inline">For the purpose of carrying out this Act,
			 the Secretary (or a designee) shall have the same powers and authorities as the
			 Federal Trade Commission under section 9 of the Federal Trade Commission Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/49">15 U.S.C. 49</external-xref>) with respect to all functions vested in, or transferred or
			 delegated to, the Secretary by this Act.</text></section><section id="id2F99A936037F47139731D3478E19552B"><enum>326.</enum><header>Contracts</header><subsection id="id707BBC6E84E14E2BB4E64DABF261E801"><enum>(a)</enum><header>In
			 general</header><text>The Secretary may enter into and perform such contracts,
			 leases, cooperative agreements, or other similar transactions with public
			 agencies, private organizations, and individuals, and make such payments (in
			 lump sum or installments, and by way of advance or reimbursement), as the
			 Secretary determines to be appropriate to carry out the functions under this
			 Act.</text></subsection><subsection id="IDA9BE72362CB241E98041B715B8F3DE1B"><enum>(b)</enum><header>Limitation on
			 authority</header><text>Notwithstanding any other provision of this title, no
			 authority to enter into contracts or to make payments under this title shall be
			 effective except to such extent or in such amounts as are provided in advance
			 in appropriations Acts.</text></subsection><subsection id="IDB2D1678A26624AE1A6A98C0BD1B2898D"><enum>(c)</enum><header>Leasing of
			 excess Department property</header><text>The Secretary may lease, in accordance
			 with such terms and conditions the Secretary considers to be appropriate to
			 promote national security or the public interest, any acquired real property
			 and related personal property that—</text><paragraph id="IDF1D65D0D9DB849398A464FD455A05D98"><enum>(1)</enum><text>is located at a
			 facility of the Department to be closed or reconfigured;</text></paragraph><paragraph id="IDE2A0F78821EE46A38049B96D42B1477C"><enum>(2)</enum><text>at the time the
			 lease is entered into, is not needed by the Department; and</text></paragraph><paragraph id="ID9B6D253F405046CF91718CE309E47B1B"><enum>(3)</enum><text>is under the
			 control of the Department.</text></paragraph></subsection><subsection id="id36FFB93191064695B42B6CA946C80E35"><enum>(d)</enum><header>Terms of
			 lease</header><paragraph id="id6CA81344FA5C46FB9037E59040FD420B"><enum>(1)</enum><header>In
			 general</header><text>A lease entered into under subsection (c) shall be for a
			 term of not more than 10 years, except that the Secretary may enter into a
			 lease that includes an option to renew for a term of more than 10 years if the
			 Secretary determines that entering into such a lease will promote the national
			 security or be in the public interest.</text></paragraph><paragraph id="idEDE3754A2BED4B7E9CA5E710BCEC2647"><enum>(2)</enum><header>Consideration</header><subparagraph id="id6F27216C972A4175A294CBBF736DDBA2"><enum>(A)</enum><header>In
			 general</header><text>A lease entered into under subsection (c) may provide for
			 the payment (in cash or in-kind) by the lessee of consideration in an amount
			 that is less than the fair market rental value of the leasehold
			 interest.</text></subparagraph><subparagraph id="idF8465D235F954AAE9499E10E2338D8FD"><enum>(B)</enum><header>Services</header><text>Services
			 relating to the protection and maintenance of the leased property may
			 constitute all or part of the consideration under this paragraph.</text></subparagraph></paragraph></subsection><subsection id="idDB46D3C997384CB8B1B897E45DCAD3A9"><enum>(e)</enum><header>Environmental
			 concerns</header><paragraph id="id5F524B0CDA0246B795DD060FB9CB824C"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), before entering into a lease
			 under subsection (c), the Secretary shall consult with, and obtain the
			 concurrence of, the appropriate State official (with respect to property
			 located on a site that is not listed on the National Priorities List) to
			 determine whether the environmental conditions of the property are such that
			 leasing the property, and the terms and conditions of the lease agreement, are
			 consistent with safety and the protection of public health and the
			 environment.</text></paragraph><paragraph id="id2D82CCAEBE814D429C9AD216F374CD55"><enum>(2)</enum><header>Failure to
			 obtain concurrence</header><text>The Secretary may enter into a lease under
			 subsection (c) without obtaining the concurrence of the appropriate State
			 official under paragraph (1) if, by the date that 60 days after the date on
			 which the Secretary requests the concurrence, the appropriate State official
			 fails to submit to the Secretary a notice of concurrence with, or rejection of,
			 the determination.</text></paragraph></subsection><subsection id="id0B7A9512A95A4A79A3E2B10630808C98"><enum>(f)</enum><header>Rentals</header><paragraph id="idE91F4B42A21644E7A7CB6FCF7C624AE9"><enum>(1)</enum><header>Retention</header><subparagraph id="id72215240BDC14C00ADFBED90F05976BF"><enum>(A)</enum><header>In
			 general</header><text>To the extent provided in advance in appropriations Acts,
			 the Secretary may retain and use money received by the Secretary directly from
			 a lease entered into under subsection (c) in any amount the Secretary considers
			 to be necessary to cover the administrative expenses of the lease, the
			 maintenance and repair of the leased property, or environmental restoration
			 activities at the facility at which the leased property is located.</text></subparagraph><subparagraph id="id6260512808824B10803B9F8EF9BCB26F"><enum>(B)</enum><header>Treatment</header><text>Amounts
			 retained under this subsection shall be retained in a separate account
			 established in the Treasury for that purpose.</text></subparagraph></paragraph><paragraph id="id745635F9822E495185F7677B941E7C9C"><enum>(2)</enum><header>Report</header><text>The
			 Secretary shall submit to Congress annual reports on the amounts retained and
			 used under this subsection.</text></paragraph></subsection></section><section commented="no" id="IDFD10860A0F8340B18117BB05B98A6046"><enum>327.</enum><header>Facilities
			 construction</header><subsection commented="no" id="idE2F502670BA646CAA20B6A3F91039810"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">As necessary and when
			 not otherwise available, the Secretary may provide for, construct, or maintain
			 the following for employees and dependents stationed at remote
			 locations:</text><paragraph commented="no" id="IDEE3766EDB0404034867892CEEC853C24"><enum>(1)</enum><text>Emergency medical
			 services and supplies.</text></paragraph><paragraph commented="no" id="IDA661756CEFD3403DB784FDD82B9CA9FB"><enum>(2)</enum><text>Food and other
			 subsistence supplies.</text></paragraph><paragraph commented="no" id="ID929380894C234A38AF1A6FC96329C9CB"><enum>(3)</enum><text>Messing
			 facilities.</text></paragraph><paragraph commented="no" id="ID9DF25C05F3614B8CB2550A5033CFF4DB"><enum>(4)</enum><text>Audiovisual
			 equipment, accessories, and supplies for recreation and training.</text></paragraph><paragraph commented="no" id="ID9C7B4B8A3EC243C29047389108E868C7"><enum>(5)</enum><text>Reimbursement for
			 food, clothing, medicine, and other supplies furnished by those employees in
			 emergencies for the temporary relief of distressed individuals.</text></paragraph><paragraph commented="no" id="ID306FEB2CAF654545B20F606AC1D0AAE3"><enum>(6)</enum><text>Living and
			 working quarters and facilities.</text></paragraph><paragraph commented="no" id="ID1E62FAAC39EE4A8195D699E6AB8D0011"><enum>(7)</enum><text>Transportation of
			 school-aged dependents of employees to the nearest appropriate educational
			 facilities.</text></paragraph></subsection><subsection commented="no" id="IDA21DD92ACCF64CC8AE0EC8E1C062C7E5"><enum>(b)</enum><header>Pricing</header><text>The
			 furnishing of medical treatment under subsection (a)(1) and the furnishing of
			 services and supplies under paragraphs (2) and (3) of subsection (a) shall be
			 at prices reflecting reasonable value, as determined by the Secretary.</text></subsection><subsection commented="no" id="ID86A073F934C14ABF89704CAA86409A53"><enum>(c)</enum><header>Treatment</header><paragraph commented="no" id="id6F7DDAE721AE4F13B675056631579B28"><enum>(1)</enum><header>In
			 general</header><text>Proceeds from reimbursements under this section—</text><subparagraph commented="no" id="idFD9BFD9A7BF84F29AD6FB7C3029575A4"><enum>(A)</enum><text>shall be
			 deposited in the Treasury; and</text></subparagraph><subparagraph commented="no" id="id86CA95E868524727ABB873B337EAD4C9"><enum>(B)</enum><text>may be withdrawn
			 by the Secretary—</text><clause commented="no" id="id7CF9FD4E7F9B491FB4CC746905F41AB8"><enum>(i)</enum><text>to pay directly
			 the cost of work or services;</text></clause><clause commented="no" id="id2235B858FFE2458AA676077CB173706D"><enum>(ii)</enum><text>to repay or make
			 advances to appropriations of funds that will initially bear all or a part of
			 that cost; or</text></clause><clause commented="no" id="id6DB11381C48142F8A6727492B798DB87"><enum>(iii)</enum><text>to refund
			 excess sums when necessary.</text></clause></subparagraph></paragraph><paragraph commented="no" id="id8C4915B6E6344C83A23F86BF332A7AC8"><enum>(2)</enum><header>Crediting to
			 funds</header><text>A payment by the Secretary under paragraph (1)(B) may be
			 credited to a working capital fund otherwise established by law, including the
			 fund established pursuant to section 331, and used under the law governing the
			 fund, if the fund is available for use by the Department for performing the
			 work or services for which payment is received.</text></paragraph></subsection></section><section commented="no" id="ID2DB471F53DCB46129FB1D0441E704BB9"><enum>328.</enum><header>Use of
			 facilities</header><subsection commented="no" id="id29E7DBB4AAD84054B670E9A8635D5523"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">On the consent of the
			 Federal Government or the government of any foreign country, State, the
			 District of Columbia, the Commonwealth of Puerto Rico, or any territory or
			 possession of the United States, with or without reimbursement, the Secretary
			 may use the research, equipment, and facilities of such a government (or
			 political subdivision) in carrying out the functions under this Act.</text></subsection><subsection commented="no" id="IDF5168535F75C4756925FFF215FA05E56"><enum>(b)</enum><header>Use of
			 property</header><paragraph commented="no" id="id882F4C3D5A1F40AAA3249B0A9BEDB624"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), in carrying out this
			 Act, the Secretary may permit the use by public and private individuals and
			 entities of any real property, facility, structure, or improvement under the
			 jurisdiction of the Secretary for purposes of the Department, under such terms
			 and at such rates as the Secretary determines to be appropriate, for a period
			 of not more than 5 years.</text></paragraph><paragraph commented="no" id="idD25F508D0702401DAFD220161D0D2C78"><enum>(2)</enum><header>Reconditioning
			 and maintenance</header><text>The Secretary may require any individual or
			 entity to which a permit is provided under this subsection to recondition and
			 maintain, at the expense of the individual or entity, the real property,
			 facilities, structures, and improvements involved to a satisfactory
			 standard.</text></paragraph><paragraph commented="no" id="idD25B25020A074C5BBE742AD455646A18"><enum>(3)</enum><header>Exception</header><text>This
			 subsection shall not apply to excess property (as defined in section 102 of
			 title 40, United States Code).</text></paragraph></subsection><subsection commented="no" id="IDEB63DE20E8BB40BBA4BBAB72772D4106"><enum>(c)</enum><header>Proceeds</header><paragraph commented="no" id="id1069F8F0A4674DFAAB38C6079A718F6B"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the proceeds from
			 reimbursements under this section—</text><subparagraph commented="no" id="id4E61EA053CBC418D92F2BA2DF4225A78"><enum>(A)</enum><text>shall be
			 deposited in the Treasury; and</text></subparagraph><subparagraph commented="no" id="id0ACAD7B936004DABAD22B147E80CB924"><enum>(B)</enum><text>may be withdrawn
			 by the Secretary or the head of the another appropriate Federal department or
			 agency—</text><clause commented="no" id="id6A3D7343C0C94C3988ED1468EDB6D899"><enum>(i)</enum><text>to pay directly
			 the costs of the equipment and facilities provided;</text></clause><clause commented="no" id="id16D95AD9BBD045DFBA6645991921B2BF"><enum>(ii)</enum><text>to repay or make
			 advances to appropriations or funds that do or will initially bear all or a
			 part of those costs; or</text></clause><clause commented="no" id="id2EC1AA25FC6647E4A6FE3A656CEDEBD3"><enum>(iii)</enum><text>to refund
			 excess sums as necessary.</text></clause></subparagraph></paragraph><paragraph commented="no" id="idB8C68DBF19FB47619E84D06A5B31A922"><enum>(2)</enum><header>Exception</header><text>The
			 proceeds described in paragraph (1) may be credited to a working capital fund
			 otherwise established by law (including the fund established pursuant to
			 section 331) and used in accordance the laws governing that fund, if the fund
			 is available for use for providing the equipment or facilities involved.</text></paragraph></subsection></section><section commented="no" id="IDE80BD97A821D4F70A9FCC39FE6CE6CE9"><enum>329.</enum><header>Field
			 offices</header><text display-inline="no-display-inline">The Secretary may
			 establish, alter, consolidate, or discontinue to maintain such State, regional,
			 district, local, or other field offices as the Secretary determines to be
			 necessary to carry out this Act.</text></section><section commented="no" id="ID8E23135037C3465FA7F9775CAD027456"><enum>330.</enum><header>Copyrights</header><text display-inline="no-display-inline">The Secretary may acquire any of the
			 following described rights if the property so acquired is for use by or for, or
			 useful to, the Department:</text><paragraph commented="no" id="IDCBB1AC02D1EB4F339C98A80B81FDA905"><enum>(1)</enum><text>Copyrights,
			 patents, and applications for patents, designs, processes, and manufacturing
			 data.</text></paragraph><paragraph commented="no" id="IDFFDE0B724AC449ECB05E637D9E718E71"><enum>(2)</enum><text>Licenses under
			 copyrights, patents, and applications for patents.</text></paragraph><paragraph commented="no" id="IDC41A5D63EAE74A7BA36E5C36118BA66C"><enum>(3)</enum><text>Releases, before
			 suit is brought, for past infringement of patents or copyrights.</text></paragraph></section><section commented="no" id="ID9D283D662F9246788D43E1FF23B5F59C"><enum>331.</enum><header>Capital
			 fund</header><subsection commented="no" id="id59E1BEE5822F477BB36B0E7B7B463005"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary may establish a working
			 capital fund, to be available without fiscal year limitation, for expenses
			 necessary for the maintenance and operation of such common administrative
			 services as the Secretary determines to be appropriate in the interests of
			 economy and efficiency, including services such as—</text><paragraph commented="no" id="id8F62D14D842640D9888EB05450047C4C"><enum>(1)</enum><text display-inline="yes-display-inline">a central supply service for stationery and
			 other supplies and equipment for which adequate stocks may be maintained to
			 meet in whole or in part the requirements of the Department;</text></paragraph><paragraph commented="no" id="id538004B23AE445B395ED4AB4F4C3A41B"><enum>(2)</enum><text display-inline="yes-display-inline">central messenger, mail, telephone, and
			 other communications services;</text></paragraph><paragraph commented="no" id="id5F84C8CFA3FB4744850E4ACE24BE43DE"><enum>(3)</enum><text display-inline="yes-display-inline">office space and central services for
			 document reproduction, graphics, and visual aids; and</text></paragraph><paragraph commented="no" id="idF18562F32BC6432F9EAF817C36054535"><enum>(4)</enum><text display-inline="yes-display-inline">a central library service.</text></paragraph></subsection><subsection commented="no" id="id0C00ABF742BC4EDFB6ED71A5CB023700"><enum>(b)</enum><header>Transfers</header><text display-inline="yes-display-inline">The capital of the fund shall consist
			 of—</text><paragraph commented="no" id="id91866AF3F942427FB7C1EDCDCFEFBF4C"><enum>(1)</enum><text display-inline="yes-display-inline">any appropriations made for the purpose of
			 providing capital; and</text></paragraph><paragraph commented="no" id="id4AA2758F530049598B3FA113C8BC19D4"><enum>(2)</enum><text display-inline="yes-display-inline">the fair and reasonable value of such
			 stocks of supplies, equipment, and other assets and inventories on order as the
			 Secretary may transfer to the fund, less the related liabilities and unpaid
			 obligations.</text></paragraph></subsection><subsection commented="no" id="idE539809F468B427B8695468D0E23A9B7"><enum>(c)</enum><header>Reimbursement</header><text display-inline="yes-display-inline">Amounts in the fund shall be reimbursed in
			 advance from available funds of agencies and offices in the Department, or from
			 other sources, for supplies and services at rates that approximate the expense
			 of operation, including the accrual of annual leave and the depreciation of
			 equipment.</text></subsection><subsection commented="no" id="id712D6836FC0C4307A768657A545EB6CC"><enum>(d)</enum><header>Credits</header><text display-inline="yes-display-inline">The fund shall be credited with
			 receipts—</text><paragraph commented="no" id="idBA6B042B63E34E4F8955743DF7D1BDB4"><enum>(1)</enum><text display-inline="yes-display-inline">from sale or exchange of property;
			 and</text></paragraph><paragraph commented="no" id="idB2862E1D9C3C4CB4A4D162864E58DC4F"><enum>(2)</enum><text display-inline="yes-display-inline">in payment for loss or damage to property
			 owned by the fund.</text></paragraph></subsection><subsection commented="no" id="idC6D509B11A384B6B9E1DD6BA9DD2340D"><enum>(e)</enum><header>Surplus
			 amounts</header><text display-inline="yes-display-inline">There shall be
			 covered into the Treasury as miscellaneous receipts any surplus amounts in the
			 fund (all assets, liabilities, and prior losses considered), in excess of the
			 amounts transferred or appropriated to establish and maintain the fund.</text></subsection></section><section id="ID8EFDF0DE81194675B49361A8EE6BFE8D"><enum>332.</enum><header>Seal of
			 Department</header><subsection id="id3BE29421B044403590F2C2B82E3FE9DE"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 cause a seal of office to be made for the Department.</text></subsection><subsection id="idF1FDDC9BD2794674AFF201D4EF0531C9"><enum>(b)</enum><header>Judicial
			 notice</header><text display-inline="yes-display-inline">Judicial notice shall
			 be taken of the seal under this section.</text></subsection></section><section id="ID8E6644C6FA574C4CBD16E5E8116000CF"><enum>333.</enum><header>Annual
			 report</header><text display-inline="no-display-inline">As soon as practicable
			 after the end of each fiscal year commencing with the first complete fiscal
			 year following the date of enactment of this Act, the Secretary shall submit to
			 the President, for inclusion in a report to Congress, a report on the
			 activities of the Department during the preceding fiscal year.</text></section><section id="ID061E601B3029480984E26F22A0C8B817"><enum>334.</enum><header>Transfer of
			 funds</header><subsection id="id3C47E9F71A8A411582D1E92044DF8B1C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 subsection (b), the Secretary, as authorized in an appropriations Act, may
			 transfer for any fiscal year funds from 1 appropriation to another within the
			 Department.</text></subsection><subsection id="idDF05DDBD8EBA46269E3506E9B6E28671"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">No appropriation shall be increased or
			 decreased pursuant to this section by more than 5 percent of the appropriation
			 for the applicable fiscal year.</text></subsection></section></subtitle></title><title id="idF264519A8E2E4C36B37805D8AB06490B" style="OLC"><enum>IV</enum><header>Transitional, savings, and conforming
			 provisions</header><section id="id971D0BFAE0534B48A8947A2F58BBA7B3"><enum>401.</enum><header>Transfer and
			 allocations of appropriations and personnel</header><subsection id="idC7A57AD267D743A782A7292AF8B89F20"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as otherwise
			 provided in this Act, the personnel employed in connection with, and the
			 assets, liabilities, contracts, property, records, and unexpended balance of
			 appropriations authorizations, allocations, and other funds employed, held,
			 used, arising from, available to, or to be made available in connection with
			 the functions transferred by this Act, subject to <external-xref legal-doc="usc" parsable-cite="usc/31/1531">section 1531</external-xref> of title 31,
			 United States Code, are transferred to the Secretary for appropriate
			 allocation.</text></subsection><subsection id="idF4A94921A9E5403483DB6C709207C8ED"><enum>(b)</enum><header>Use of
			 unexpended funds</header><text display-inline="yes-display-inline">Unexpended
			 funds transferred pursuant to subsection (a) shall only be used for the
			 purposes for which the funds were originally authorized and
			 appropriated.</text></subsection><subsection commented="no" id="id9145E35E89904F8CAF0776FF961FE67A"><enum>(c)</enum><header>Specific
			 positions</header><text>Positions expressly specified by statute or
			 reorganization plan to carry out functions transferred by this Act, personnel
			 occupying those positions on the effective date of this Act, and personnel
			 authorized to receive compensation in those positions at the rate prescribed
			 for offices and positions at level I, II, III, IV, or V of the Executive
			 Schedule under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, on
			 the effective date of this Act, shall be subject to section 403.</text></subsection></section><section id="idCF1BEFBF98A14D55AAD4E86556458CB8"><enum>402.</enum><header>Effect on
			 personnel</header><subsection id="id35C386DFC9324D018CE7A2C584F8799D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as otherwise
			 provided in this Act or by the Secretary, the transfer pursuant to this title
			 of full-time personnel (except special Government employees) and part-time
			 personnel holding permanent positions pursuant to this title shall not cause
			 any such employee to be separated or reduced in grade or compensation for 1
			 year after the date of enactment of this Act.</text></subsection><subsection id="idE352C9739E80430086038509255B1247"><enum>(b)</enum><header>Compensation</header><text>Any
			 person who, on the effective date of this Act, holds a position compensated in
			 accordance with the Executive Schedule prescribed in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5,
			 United States Code, and who, without a break in service, is appointed in the
			 Department to a position having duties comparable to the duties performed
			 immediately preceding the appointment shall continue to be compensated in the
			 new position at not less than the rate provided for the previous position, for
			 the duration of service in the new position.</text></subsection><subsection id="id1B4B0B9EE97D4EDBBC1162F7B08A0321"><enum>(c)</enum><header>Reemployment
			 rights</header><paragraph id="id6E599EE61A7C4162A93566C74FC26651"><enum>(1)</enum><header>In
			 general</header><text>An employee transferred to the Department who holds
			 reemployment rights acquired under any provision of law or regulation may
			 exercise those rights only during the latter of—</text><subparagraph id="id11BD572EBD7D4A3D82B49D7D6631EFDB"><enum>(A)</enum><text>the 120-day
			 period beginning on the effective date of this Act; or</text></subparagraph><subparagraph id="id0CB9B93EFF404EE0A13B54A443390A56"><enum>(B)</enum><text>the 2-year period
			 beginning on the date on which the employee acquired the reemployment
			 rights.</text></subparagraph></paragraph><paragraph id="id3ABB1E70379A40FCB2331688070DB8A6"><enum>(2)</enum><header>Requirement</header><text>Reemployment
			 rights may only be exercised at the request of the employee.</text></paragraph></subsection></section><section id="id3B15D426938345B6AB7CB5BB61FC0689"><enum>403.</enum><header>Agency
			 terminations</header><subsection id="id9238757697C4443C961B2232455589A9"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as otherwise
			 provided in this Act, whenever all of the functions vested by law in any
			 agency, commission, or other body, or any component of an agency, commission,
			 or other body, have been terminated or transferred from that agency,
			 commission, or other body, or component by this Act, the agency, commission, or
			 other body, or component, shall terminate.</text></subsection><subsection id="idD075BAA09C684378A25A59D2841FF2F9"><enum>(b)</enum><header>Termination of
			 positions and offices</header><text display-inline="yes-display-inline">If an
			 agency, commission, or other body, or any component of an agency, commission,
			 or other body, terminates pursuant to subsection (a), each position and office
			 within the agency, commission, or other body, or component, that was expressly
			 authorized by law, or the incumbent of which was authorized to receive
			 compensation at the rates prescribed for an office or position at level II,
			 III, IV, or V of the Executive Schedule under subchapter II of chapter 53 of
			 title 5, United States Code, shall terminate.</text></subsection></section><section id="id03A0D66C539F4B8987BD3014AE1D6169"><enum>404.</enum><header>Incidental
			 transfers</header><text display-inline="no-display-inline">The Director of the
			 Office of Management and Budget, in consultation with the Secretary and the
			 Commission, shall make such determinations as may be necessary with regard to
			 the transfer of functions that relate to or are used by an agency, commission
			 or other body, or component of an agency, commission, or other body, affected
			 by this Act, to make such additional incidental dispositions of personnel,
			 assets, liabilities, contracts, property, records, and unexpended balances of
			 appropriations, authorizations, allocations, and other funds held, used,
			 arising from, available to, or to be made available in connection with the
			 functions transferred by this Act, as the Director considers necessary to
			 accomplish the purposes of this Act.</text></section><section id="idDF20458EB86D46F9A29B33309EB532FA"><enum>405.</enum><header>Savings
			 provisions</header><subsection id="id0D6E62214E994293815C0B06E11294C3"><enum>(a)</enum><header>Orders To
			 remain in effect</header><paragraph id="id6B9D51ABAF0E4300AD10E139CE594CA5"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">All orders,
			 determinations, rules, regulations, permits, contracts, certificates, licenses,
			 and privileges described in paragraph (2) shall continue in effect according to
			 their respective terms until modified, terminated, superseded, set aside, or
			 revoked in accordance with law by the President, the Secretary, or other
			 authorized officials, a court of competent jurisdiction, or by operation of
			 law.</text></paragraph><paragraph id="id31D47C49C45D4ED68F5CF12CFAC989FF"><enum>(2)</enum><header>Specification</header><text display-inline="yes-display-inline">Paragraph (1) applies to all orders,
			 determinations, rules, regulations, permits, contracts, certificates, licenses,
			 and privileges that—</text><subparagraph id="idD6D3618BFDF1433F9C7E84DD8E411266"><enum>(A)</enum><text>have been issued,
			 made, granted, or allowed to become effective by the President, any Federal
			 department or agency, official of a Federal department or agency, or by a court
			 of competent jurisdiction, in the performance of functions that are transferred
			 under this Act to the Department after the date of enactment of this Act;
			 and</text></subparagraph><subparagraph id="id8DA9D1C38B794FCDB7ACB151956B8B2A"><enum>(B)</enum><text>are in effect on
			 the date on which this Act takes effect.</text></subparagraph></paragraph></subsection><subsection id="id73F49D1600044FD1816C30726487942F"><enum>(b)</enum><header>Pending
			 proceedings</header><paragraph id="id00B9F55C43E14179BA99F82AD6B41414"><enum>(1)</enum><header>In
			 general</header><text>This Act shall not affect any proceedings or any
			 application for any license, permit, certificate, or financial assistance
			 pending before any department, agency, commission, or component of a
			 department, agency, or commission, functions of which are transferred by this
			 Act on the date on which this Act takes effect.</text></paragraph><paragraph id="id3C52283F51B040BE9E273CB917BD6C67"><enum>(2)</enum><header>Continuation</header><subparagraph id="id07E49734F7174B82A7B8780DD6EF4262"><enum>(A)</enum><header>In
			 general</header><text>To the extent that proceedings and applications described
			 in paragraph (1) relate to functions transferred by this Act—</text><clause id="idC7E1AC5AF31D42288944FE59F8AD4B44"><enum>(i)</enum><text>the
			 proceedings and applications shall be continued; and</text></clause><clause id="id63CBA0F6BB9847DFB590DF618596682C"><enum>(ii)</enum><text>orders shall be
			 issued, appeals shall be taken, and payments shall be made pursuant to the
			 orders, as if this Act had not been enacted.</text></clause></subparagraph><subparagraph id="id1D5B80D403BF4AAF8CE6590ACB30ECE8"><enum>(B)</enum><header>Effect</header><text>Orders
			 issued in any proceeding continued under this paragraph shall continue in
			 effect until modified, terminated, superseded, or revoked by—</text><clause id="id546916B83F9E4337864FE9EED691134D"><enum>(i)</enum><text>a
			 duly authorized official;</text></clause><clause id="id0F74AA4411544F649D46087AB39FF095"><enum>(ii)</enum><text>a
			 court of competent jurisdiction; or</text></clause><clause id="idD8D07A9CACF84B369C24C05314F7F9EA"><enum>(iii)</enum><text>operation of
			 law.</text></clause></subparagraph><subparagraph id="id6384E17053D3478185253ED73AE06BC4"><enum>(C)</enum><header>Discontinuance
			 or modification</header><text>Nothing in this subsection prohibits the
			 discontinuance or modification of any proceeding described in paragraph (1)
			 under the same terms and conditions and to the same extent that the proceeding
			 could have been discontinued or modified if this Act had not been
			 enacted.</text></subparagraph></paragraph><paragraph id="id6701FC18760A4F8085B572A6DED204DB"><enum>(3)</enum><header>Rulemaking</header><text>The
			 Secretary may promulgate regulations providing for the orderly transfer of
			 proceedings described in paragraph (1) to the Department.</text></paragraph></subsection><subsection id="idF4A83FB1E6EC437B98746C6BE7F94EED"><enum>(c)</enum><header>Pending
			 suits</header><paragraph id="id177D5F1CDF4348A3AEB66B8A05FCA350"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (3)—</text><subparagraph id="id4F36A5CF5AF74C8594B109E5E8439B4B"><enum>(A)</enum><text>this Act shall
			 not affect suits commenced prior to the effective date of this Act; and</text></subparagraph><subparagraph id="id0025914062AB43B58F862E99FC7E16E5"><enum>(B)</enum><text>in all suits
			 described in subparagraph (A), proceedings shall be had, appeals taken, and
			 judgments rendered in the same manner and effect as if this Act had not been
			 enacted.</text></subparagraph></paragraph><paragraph id="idA2BD18DE3AC1464F81A391FD0A1ED18C"><enum>(2)</enum><header>Suits by and
			 against officers in official capacity and departments and agencies</header><subparagraph id="idFD2822785EBA444B948BD41D92E17BDB"><enum>(A)</enum><header>Offices</header><text>No
			 suit, action, or other proceeding commenced by or against any officer in the
			 official capacity of the officer as an officer of any department or agency,
			 functions of which are transferred by this Act, shall abate by reason of the
			 enactment of this Act.</text></subparagraph><subparagraph id="id3D9F0E45BD524D9AA60A72847B8E388B"><enum>(B)</enum><header>Departments and
			 agencies</header><text>No cause of action by or against any department or
			 agency, functions of which are transferred by this Act, or by or against any
			 officer of a department or agency in the official capacity of the officer,
			 shall abate by reason of the enactment of this Act.</text></subparagraph></paragraph><paragraph id="id18304DB8172C470DBCC2AB7BAD8BABD0"><enum>(3)</enum><header>Transfer</header><text>If,
			 before the effective date of this Act, any department or agency, or officer of
			 a department or agency in the official capacity of the officer, is a party to a
			 suit, and under this Act any function of the department, agency, or officer is
			 transferred to the Secretary or any other official, then the suit shall be
			 continued with the Secretary or other official, as applicable,
			 substituted.</text></paragraph></subsection></section><section id="idE3C3AEBF16EB45EE9938AAD6A87189AA"><enum>406.</enum><header>Reference</header><text display-inline="no-display-inline">With respect to any functions transferred by
			 this Act and exercised after the effective date of this Act, reference in any
			 other Federal law to any department, commission, or agency or any officer or
			 office the functions of which are so transferred shall be deemed to refer to
			 the Secretary or other official or component of the Department in which this
			 Act vests those functions.</text></section><section id="id0AF542CCA50B469A9D2087A81DC0BEF3"><enum>407.</enum><header>Presidential
			 authority</header><text display-inline="no-display-inline">Except as provided
			 in title IV, nothing in this Act may be construed to limit, curtail, abolish,
			 or terminate—</text><paragraph id="idD25009E5B9D04915902471A589C09B4B"><enum>(1)</enum><text display-inline="yes-display-inline">any function of, or authority available to,
			 the President that the President had immediately before the effective date of
			 this Act; or</text></paragraph><paragraph id="id34A9C80DD52140A9B7F43CB1EF5082B8"><enum>(2)</enum><text display-inline="yes-display-inline">the authority of the President to delegate,
			 redelegate, or terminate any delegation of functions.</text></paragraph></section><section id="id2E2C456730064092A44964BE39ED4154"><enum>408.</enum><header>Transition</header><text display-inline="no-display-inline">With the consent of the appropriate
			 department or agency head concerned, the Secretary may use the services of the
			 officers, employees, and other personnel of the departments and agencies from
			 which functions have been transferred to the Secretary for such period of time
			 as may reasonably be needed to facilitate the orderly transfer of functions

			 the Director considers unnecessary due to consolidation of functions under this
			 Act;</text></paragraph><paragraph id="idC740C43CA00F41259BDB180879573345"><enum>(2)</enum><text>a statement of
			 the number of employees entitled to pay savings by reason of the reorganization
			 under this Act;</text></paragraph><paragraph id="id4A0D09E6E0EA4D95B25CFD7ED675AAAC"><enum>(3)</enum><text>a statement of
			 the number of employees who are voluntarily or involuntarily separated by
			 reason of the reorganization;</text></paragraph><paragraph id="id4C656E09F921479FBBC57D5E8A2D6C43"><enum>(4)</enum><text>an estimate of
			 the personnel costs associated with the reorganization;</text></paragraph><paragraph id="id66C2190EB4C546DFB8EDAEE1B447C9F5"><enum>(5)</enum><text>the effects of
			 the reorganization on labor management relations; and</text></paragraph><paragraph id="id1A4001FC6D4C4420A031EF3281B3046C"><enum>(6)</enum><text>such legislative
			 and administrative recommendations for improvements in personnel management
			 within the Department as the Director considers necessary.</text></paragraph></section><section id="ID89c275450b8c4a0f8c2b103350c8ec3c"><enum>411.</enum><header>Investigations
			 and reports on duplicative programs and activities</header><text display-inline="no-display-inline">The
			 Secretary shall—</text><paragraph id="idD500D56407C248C2827F5079CDE8F137"><enum>(1)</enum><text display-inline="yes-display-inline">conduct routine investigations to identify
			 programs, offices, and initiatives with duplicative goals and activities within
			 the Department; and</text></paragraph><paragraph id="idA47A89545EB94F5A88FC99A7173F515C"><enum>(2)</enum><text display-inline="yes-display-inline">report annually to Congress on the findings
			 from the investigations (including the cost of such duplication), including
			 recommendations for consolidation and elimination to reduce duplication and for
			 specific rescissions.</text></paragraph></section></title><title id="idBF8CAF9D0DCE4D18BAF402512B7DFA34" style="OLC"><enum>V</enum><header>Effective date and interim
			 appointments</header><section id="idB3BFA191DCF94BD384CEA79040D05AFD"><enum>501.</enum><header>Effective
			 date</header><subsection id="idBCE785CC06A5407DA376069B40D9CD36"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 subsections (b), this Act, and the amendments made by this Act shall take
			 effect on the earlier of—</text><paragraph id="id84C6EC6141F84F39889187A204577470"><enum>(1)</enum><text display-inline="yes-display-inline">120 days after the Secretary first takes
			 office; or</text></paragraph><paragraph id="idD72F401FF9ED43DC90C685BDB0147B7A"><enum>(2)</enum><text display-inline="yes-display-inline">such date as the President may prescribe
			 and publish in the Federal Register.</text></paragraph></subsection><subsection id="idE0BEDC9145B94D7BA0F3D8B2A02CE6F2"><enum>(b)</enum><header>Appointments
			 and regulations</header><text display-inline="yes-display-inline">At any time
			 after the date of enactment of this Act—</text><paragraph id="id746A73CBCD1F4A1597FE673473A1A676"><enum>(1)</enum><text display-inline="yes-display-inline">any of the officers provided for in titles
			 I and II may be nominated and appointed, as provided in such titles; and</text></paragraph><paragraph id="idC3658C08510749909D70A70A9B782D9C"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary may promulgate regulations
			 pursuant to section 405.</text></paragraph></subsection><subsection id="id14E933E8B9AC4D1DBD8BAF82E59A583B"><enum>(c)</enum><header>Use of
			 funds</header><text display-inline="yes-display-inline">Funds available to any
			 department or agency (or any official or component of a department of agency)
			 functions of which are transferred to the Secretary by this Act, may with the
			 approval of the Director of the Office of Management and Budget, be used to pay
			 the compensation and expenses of any officer appointed pursuant to subsection
			 (b) until such time as funds for that purpose are otherwise available.</text></subsection></section><section id="idD834D134DAAA46A080292B317E73B7EE"><enum>502.</enum><header>Interim
			 appointments</header><subsection id="id6684AA9F77E14A1A996EB6FB602BE31A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">If 1 or more officers
			 required by this Act to be appointed by and with the advice and consent of the
			 Senate shall not have entered upon office on the effective date of this Act,
			 the President may designate any officer, whose appointment was required to be
			 made by and with the advice and consent of the Senate, and who was such an
			 officer immediately prior to the effective date of the Act, to act in the
			 office until the office is filled as provided in this Act.</text></subsection><subsection id="idFFA01F6F7ACB408492384DF14F963838"><enum>(b)</enum><header>Compensation</header><text display-inline="yes-display-inline">Any person acting in an office in
			 accordance with subsection (a) shall receive compensation at the rates provided
			 by this Act for the respective office in which the person acts.</text></subsection></section></title><title id="idE3270B9B817C4435B2CA3198328331C0"><enum>VI</enum><header>Elimination and
			 reduction of programs</header><section id="id8576BA392C3D40E8A918B8EEFA5A4B9E"><enum>601.</enum><header>Elimination of
			 programs</header><subsection id="id7D37DD51F8BF4ED3B9AE768E09C6BA5A"><enum>(a)</enum><header>International
			 Labor Comparison Program</header><text>The International Labor Comparisons
			 program of the Bureau of Labor Statistics shall be terminated on the date of
			 enactment of this Act.</text></subsection><subsection id="idC0374F2488814C3FA6B20136AC939897"><enum>(b)</enum><header>Career Pathways
			 Innovation Fund</header><text>The career pathways innovation fund established
			 under the Workforce Investment Act of 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/220">Public Law 105–220</external-xref>) to develop and
			 implement career pathway programs in partnership with employers and other
			 relevant organizations in the community shall be terminated on the date of
			 enactment of this Act.</text></subsection><subsection id="idE420872A58D24FF3915A7742880E5E9F"><enum>(c)</enum><header>Transitional
			 Jobs Demonstration</header><text>The Enhanced Transitional Jobs Demonstration
			 program carried out under section 171 of the Workforce Investment Act of 1998

			 general</header><text>The Baldrige Performance Excellence Program shall
			 terminated on the date of the enactment of this Act.</text></paragraph><paragraph id="id51D8E50168AE431A9538C8D7F282E4C5"><enum>(2)</enum><header>Award</header><text>The
			 Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3701">15 U.S.C. 3701 et seq.</external-xref>) is
			 amended by striking section 17 (<external-xref legal-doc="usc" parsable-cite="usc/15/3711a">15 U.S.C. 3711a</external-xref>) (relating to the Malcolm
			 Baldridge National Quality Award).</text></paragraph></subsection><subsection id="idAECA88CDEF924AC9B10098D6A5C7CC20"><enum>(f)</enum><header>Emergency Steel
			 Guaranteed Loan Program</header><text>Section 101 of <external-xref legal-doc="public-law" parsable-cite="pl/106/51">Public Law 106–51</external-xref> (15
			 U.S.C. 1841 note) is repealed.</text></subsection><subsection id="id92B825753F8D4F0CA5AE6B4732276316"><enum>(g)</enum><header>Noncritical
			 functions of the Census Bureau</header><text>Beginning on the date of the
			 enactment of this Act, the Bureau of the Census shall discontinue—</text><paragraph id="id429F1E85CA594B2DBB312BE93720111A"><enum>(1)</enum><text>the Current
			 Industrial Reports function;</text></paragraph><paragraph id="idED6122CED10A4A34B7CD93EBC7157575"><enum>(2)</enum><text>the Federal
			 Financial Statistics Program;</text></paragraph><paragraph id="id09C1094C564847B787C1E438D68858BA"><enum>(3)</enum><text>the Foreign
			 Research and Analysis Program's international focus; and</text></paragraph><paragraph id="id1B49518D0C0D459D8F73ECD47CA6BBA1"><enum>(4)</enum><text>the production of
			 the Statistical Abstract.</text></paragraph></subsection></section></title></legis-body></bill>
