<distribution-code display="yes">VI</distribution-code><congress>113th CONGRESS</congress><session>1st Session</session><legis-num>S. 1832</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20131216">December 16, 2013</action-date><action-desc><sponsor name-id="S369">Mr. Markey</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>For the relief of Esther Karinge.</official-title></form><legis-body><section id="idC82366B167B0453BB4D065FBA089A7BD" section-type="section-one"><enum>1.</enum><header>Permanent resident status for Esther Karinge</header><subsection id="id41ea955a623841029d9be71a57734374"><enum>(a)</enum><header>In general</header><text>Notwithstanding subsections (a) and (b) of section 201 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref>), Esther Karinge shall be eligible for the issuance of an immigrant visa or for adjustment of status to that of an alien lawfully admitted for permanent residence upon filing an application for issuance of an immigrant visa under section 204 of such Act or for adjustment of status to lawful permanent resident.</text></subsection><subsection id="ide9443f00819a403e99e2a012f402e52a"><enum>(b)</enum><header>Adjustment of status</header><text>If Esther Karinge enters the United States before the filing deadline specified in subsection (c)—</text><paragraph id="idFFB77B6569DC4E90A38F6D58E32C4890"><enum>(1)</enum><text>she shall be considered to have entered and remained lawfully in the United States; and</text></paragraph><paragraph id="id12A8515C4F444C17BC42C2C9222B7F7D"><enum>(2)</enum><text>if otherwise eligible, she shall be eligible for adjustment of status under section 245 of the Immigration and Nationality Act as of the date of the enactment of this Act.</text></paragraph></subsection><subsection id="ida23868b55f384effad2176414b86855b"><enum>(c)</enum><header>Deadline for application and payment of fees</header><text>Subsections (a) and (b) shall not apply unless the application for issuance of an immigrant visa or the application for adjustment of status is filed with appropriate fees not later than 2 years after the date of the enactment of this Act.</text></subsection><subsection id="ida778bb1f404b424b9979ea5646faf524"><enum>(d)</enum><header>Reduction of immigrant visa number</header><text>Upon the granting of an immigrant visa or lawful permanent residence to Esther Karinge, the Secretary of State shall instruct the proper officer to reduce by 1, during the current or next following fiscal year—</text><paragraph id="id33EB98D81C494A60B660146026BBB952"><enum>(1)</enum><text>the total number of immigrant visas that are made available to natives of the country of Esther’s birth under section 203(a) of the Immigration and Nationality Act; or</text></paragraph><paragraph id="id11E20C01138643D2B2422F3C66481870"><enum>(2)</enum><text>the total number of immigrant visas that are made available to natives of the country of Esther’s birth under section 202(e) of such Act, if applicable.</text></paragraph></subsection><subsection id="id2e76eaeff611464b9c102f867cb921c4"><enum>(e)</enum><header>Denial of preferential immigration treatment for certain relatives</header><text>The natural parents, brothers, and sisters of Esther Karinge shall not, by virtue of such relationship, be accorded any right, privilege, or status under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></subsection></section></legis-body></bill>
