		  <quote><short-title>Emergency Port of Entry Personnel and Infrastructure Funding Act of 2013</short-title></quote>.</text></section><section id="idbd8e803ff1b246d8b26c477a96b5a1d6"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id1dfeb1dd7948442fa84f3ea2fd90009f"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the General Services Administration.</text></paragraph><paragraph id="id2A055F2566994C82B7E20D43A7C10BD4"><enum>(2)</enum><header>Commissioner</header><text>The term <term>Commissioner</term> means the Commissioner of U.S. Customs and Border Protection.</text></paragraph><paragraph id="id1F3F077C736F41C0B9B0C653D0CED44C"><enum>(3)</enum><header>Northern border</header><text>The term <term>Northern border</term> means the international border between the United States and Canada.</text></paragraph><paragraph id="idc3925c193bb24436a16a6b73ba351e3c"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph><paragraph id="idb8bb522691b847f2b4faf0c3ad43cb4e"><enum>(5)</enum><header>Southern border</header><text>The term <term>Southern border</term> means the international border between the United States and Mexico.</text></paragraph></section><section id="idb319d545711849a5943c2091e1402ccf"><enum>3.</enum><header>U.S. Customs and Border Protection personnel</header><subsection id="id606d951c924341e09520b0f2fecedb39"><enum>(a)</enum><header>Staff enhancements</header><paragraph id="id7655c518354144e69b851762328f1a27"><enum>(1)</enum><header>Authorization</header><text>In addition to positions authorized before the date of the enactment of this Act and any existing officer vacancies within U.S. Customs and Border Protection on such date, the Secretary, subject to the availability of appropriations for such purpose, shall hire, train, and assign to duty, by not later than September 30, 2019—</text><subparagraph id="id20e5e734fdb24ae3969df6ba8200ae59"><enum>(A)</enum><text>5,000 full-time U.S. Customs and Border Protection officers to serve on all inspection lanes (primary, secondary, incoming, and outgoing) and enforcement teams at United States land ports of entry on the Northern border and the Southern border; and</text></subparagraph><subparagraph id="idf2fc2e40c7f342688b53ae93852fd48f"><enum>(B)</enum><text>350 full-time support staff for all United States ports of entry.</text></subparagraph></paragraph><paragraph id="ida7d43235af7e462a9c8b3a15e584526e"><enum>(2)</enum><header>Waiver of fte limitation</header><text>The Secretary may waive any limitation on the number of full-time equivalent personnel assigned to the Department of Homeland Security in order to carry out paragraph (1).</text></paragraph></subsection><subsection id="id7208749880f14aa9aa4b453387996e8f"><enum>(b)</enum><header>Reports to Congress</header><paragraph id="id1ae9d54a312b4844b890bad9302762d2"><enum>(1)</enum><header>Outbound inspections</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary shall submit a report containing the Department of Homeland Security’s plans for ensuring the placement of sufficient U.S. Customs and Border Protection officers on outbound inspections, and adequate outbound infrastructure, at all Southern border land ports of entry to—</text><subparagraph id="id20e9c3317f484e34b7febffb51daa2e0"><enum>(A)</enum><text>the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>;</text></subparagraph><subparagraph id="idff6e68b6b2b24f4c9445e09ad85ebd42"><enum>(B)</enum><text>the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>;</text></subparagraph><subparagraph id="id7447560c5a5544c59a9b180394647548"><enum>(C)</enum><text>the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>; and</text></subparagraph><subparagraph id="id369dd375b7bd4dfe92b3c69892b36497"><enum>(D)</enum><text>the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>.</text></subparagraph></paragraph><paragraph id="iddecd43860e8c4e0a8aa858cb80bcf6a4"><enum>(2)</enum><header>Sufficient agricultural specialists and personnel</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary, in consultation with the Secretary of Agriculture and the Secretary of Health and Human Services, shall submit a report to the committees set forth in paragraph (1) that contains each department’s plans for ensuring the placement of sufficient U.S. Customs and Border Protection agriculture specialists, Animal and Plant Health Inspection Service entomologist identifier specialists, Food and Drug Administration consumer safety officers, and other relevant and related personnel at all Southern border land ports of entry.</text></paragraph><paragraph id="idf6431268780e4155ada28c9f8c5a0fda"><enum>(3)</enum><header>Annual implementation report</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Secretary shall submit a report to the committees set forth in paragraph (1) that—</text><subparagraph id="id08c7c6729d7844378e9fe731f5a1b6ec"><enum>(A)</enum><text>details the Department of Homeland Security’s implementation plan for the staff enhancements required under subsection (a)(1)(A);</text></subparagraph><subparagraph id="idadab277200594980b2b7978d6d4035c4"><enum>(B)</enum><text>includes the number of additional personnel assigned to duty at land ports of entry, classified by location;</text></subparagraph><subparagraph id="idf8e624bfda654d229875e77a7702e2a2"><enum>(C)</enum><text>describes the methodology used to determine the distribution of additional personnel to address northbound and southbound cross-border inspections; and</text></subparagraph><subparagraph id="id18dd666627b14408b930e766531a50af"><enum>(D)</enum><text>includes—</text><clause id="id6B4A6E7F1E1746C79826530DCAEB287D"><enum>(i)</enum><text>the strategic plan required under section 5(a)(1);</text></clause><clause id="idDA3F20423A264AB286C7559F770800E8"><enum>(ii)</enum><text>the model required under section 5(b), including the underlying assumptions, factors, and concerns that guide the decisionmaking and allocation process; and</text></clause><clause id="idD08E337423674402851BCC85F0528F4C"><enum>(iii)</enum><text>the new outcome-based performance measures adopted under section 5(c)(1).</text></clause></subparagraph></paragraph></subsection><subsection id="id714bdf9f2c144b4e84e3f44522c2040e"><enum>(c)</enum><header>Secure communication</header><text>The Secretary shall ensure that each U.S. Customs and Border Protection officer is equipped with a secure 2-way communication and satellite-enabled device, supported by system interoperability, that allows U.S. Customs and Border Protection officers to communicate—</text><paragraph id="ida34f8a59213a4b3897553b85771a9bd3"><enum>(1)</enum><text>between ports of entry and inspection stations; and</text></paragraph><paragraph id="id12adc300aee349a689564f6e43a490e4"><enum>(2)</enum><text>with other Federal, State, tribal, and local  law enforcement entities.</text></paragraph></subsection><subsection id="id6ed9b0bc3eba47e2a12f240ee79b691b"><enum>(d)</enum><header>Border area security initiative grant program</header><text>The Secretary shall establish a program for awarding grants for the purchase of—</text><paragraph id="idCF7945B2A5E5491890930D07844259E5"><enum>(1)</enum><text>identification and detection equipment; and</text></paragraph><paragraph id="id40A2015E7D2B437D9782539D43082D6F"><enum>(2)</enum><text>mobile, hand-held, 2-way communication devices for State and local law enforcement officers serving on the Southern border.</text></paragraph></subsection><subsection id="id8f55d871ae304ce2bd0cf683b0258092"><enum>(e)</enum><header>Port of entry infrastructure improvements</header><text>The Commissioner may aid in the enforcement of Federal customs, immigration, and agriculture laws by—</text><paragraph id="id41a88d5c75084a62b390e1e8b6acb3c7"><enum>(1)</enum><text>designing, constructing, and modifying—</text><subparagraph id="id279FED2358194E558379FEBFB687BC81"><enum>(A)</enum><text>United States ports of entry;</text></subparagraph><subparagraph id="id5A60DA47DE8B4877B8F5EE4C1C725AF7"><enum>(B)</enum><text>living quarters for officers, agents, and personnel;</text></subparagraph><subparagraph id="idEFF371D35A864C5C96C3482ECF1F74D4"><enum>(C)</enum><text>technology and equipment, including those deployed in support of standardized and automated collection of  vehicular travel time; and</text></subparagraph><subparagraph id="idEADFB010FF374923A7B7C9A50F85DC8A"><enum>(D)</enum><text>other structures and facilities, including those owned by municipalities, local governments, or private entities located at land ports of entry;</text></subparagraph></paragraph><paragraph id="id74c24ac5d4bd4558bfe3940d57558ffc"><enum>(2)</enum><text>acquiring, by purchase, donation, exchange, or otherwise, land or any interest in land determined to be necessary to carry out the Commissioner’s duties under this section; and</text></paragraph><paragraph id="ida693eea681b44ccebd41772b6294a274"><enum>(3)</enum><text>constructing additional ports of entry along the Southern border and the Northern border.</text></paragraph></subsection><subsection id="ide1de2e5455e04753b4f7cbbead6aee00"><enum>(f)</enum><header>Prioritization</header><text>In selecting improvements under subsection (e), the Commissioner, in coordination with the Administrator shall give priority consideration to projects that will substantially—</text><paragraph id="idfc9bee099f574479a35b5269ddfa0910"><enum>(1)</enum><text>reduce commercial and passenger vehicle and pedestrian crossing wait times at one or more ports of entry on the same border;</text></paragraph><paragraph id="id64701224c17744e1bb7231474e79f17a"><enum>(2)</enum><text>increase trade, travel efficiency, and the projected total annual volume at one or more ports of entry on the same border; and</text></paragraph><paragraph id="id22e1061e484042eaa222e7e092d2bcff"><enum>(3)</enum><text>enhance safety and  security at border facilities at one or more ports of entry on the same border.</text></paragraph></subsection><subsection id="id8d8ada8fedc148b28d8f370656b10136"><enum>(g)</enum><header>Consultation</header><paragraph id="idf5ac568f392745969dde071bc51e201d"><enum>(1)</enum><header>Locations for new ports of entry</header><text>The Secretary is encouraged to consult with the Secretary of the Interior, the Secretary of Agriculture, the Secretary of State, the International Boundary and Water Commission, the International Joint Commission, and appropriate representatives of States, Indian tribes, local governments,  and property owners—</text><subparagraph id="id424961e2f581454daaed1f2a23596ae9"><enum>(A)</enum><text>to determine locations for new ports of entry; and</text></subparagraph><subparagraph id="id26333d55fbbf4c1d8d7d66bed564b2c0"><enum>(B)</enum><text>to minimize adverse impacts from such ports on the environment, historic and cultural resources, commerce, and the quality of life of the communities and residents located near such ports.</text></subparagraph></paragraph><paragraph id="id3075d864a4a842a19cd09a8985f3f49d"><enum>(2)</enum><header>Savings provision</header><text>Nothing in this subsection may be construed—</text><subparagraph id="id8ce6c5a97ea04361936200f69754fe2d"><enum>(A)</enum><text>to create any right or liability of the parties described in paragraph (1);</text></subparagraph><subparagraph id="idae2e13979d9c450b9083b3894809f56d"><enum>(B)</enum><text>to affect the legality or validity of any determination by the Secretary under this Act; or</text></subparagraph><subparagraph id="idda1be965cd6b43d49306404d1b7c4de0"><enum>(C)</enum><text>to affect any consultation requirement under any other law.</text></subparagraph></paragraph></subsection><subsection id="idC0B4D0C3B8B340D7B00E8F2286059E26"><enum>(h)</enum><header>Authority To acquire leaseholds</header><text>Notwithstanding any other provision of law, if the Secretary determines that the acquisition of a leasehold interest in real property and the construction or modification of any facility on the leased property are necessary to facilitate the implementation of this Act, the Secretary may—</text><paragraph id="idAED91B0EA72E4551968BCEC8E5309066"><enum>(1)</enum><text>acquire such leasehold interest; and</text></paragraph><paragraph id="id0F9874108880421DB4FEB1CD699A6200"><enum>(2)</enum><text>construct or modify such facility.</text></paragraph></subsection><subsection id="id2715f8fa6b4d40c49b490698f3517e1d"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section, for each of the fiscal years 2014 through 2019, $1,000,000,000, of which $5,000,000 shall be used for grants authorized under subsection (d).</text></subsection><subsection id="id8fa0211f92784fae888a5f0278176294"><enum>(j)</enum><header>Offset, rescission of unobligated Federal funds</header><paragraph id="id93d2ad3a21f345ba975924b06ca9946d"><enum>(1)</enum><header>In general</header><text>There is hereby rescinded, from appropriated discretionary funds that remain available for obligation on the date of the enactment of this Act (other than the unobligated funds referred to in paragraph (4)), amounts determined by the Director of the Office of Management and Budget that are equal, in the aggregate, to the amount authorized to be appropriated under subsection (i).</text></paragraph><paragraph id="id406b1bbe78764e939533db2d83aec4b3"><enum>(2)</enum><header>Implementation</header><text>The Director of the Office of Management and Budget shall determine and identify—</text><subparagraph id="id8ae67c6a0ab546cd8bcfe89160672172"><enum>(A)</enum><text>the appropriation accounts from which the rescission under paragraph (1) shall apply; and</text></subparagraph><subparagraph id="id8b20424c928e4184bb8e795c8546d795"><enum>(B)</enum><text>the amount of the rescission that shall be applied to each such account.</text></subparagraph></paragraph><paragraph id="id09a52fae712344f484635dba58a10097"><enum>(3)</enum><header>Report</header><text>Not later than 60 days after the date of the enactment of this Act, the Director of the Office of Management and Budget shall submit a report to Congress and to the Secretary of the Treasury that describes the accounts and amounts determined and identified under paragraph (2) for rescission under paragraph (1).</text></paragraph><paragraph id="id842288ae8bf642629f7d0574a9ad2133"><enum>(4)</enum><header>Exceptions</header><text>This subsection shall not apply to unobligated funds of—</text><subparagraph id="id3bc6beed84894c859f688f6a3aef9b1b"><enum>(A)</enum><text>the Department of Defense;</text></subparagraph><subparagraph id="id89d08bcc376a40ec858c360fcc2c367b"><enum>(B)</enum><text>the Department of Veterans Affairs; or</text></subparagraph><subparagraph id="id2af663dc410b4c25af7ea3c2a71f9c50"><enum>(C)</enum><text>the Department of Homeland Security.</text></subparagraph></paragraph></subsection></section><section id="id5678b4a7fb45494f800a497305dccc13"><enum>4.</enum><header>Cross-border trade enhancement</header><subsection id="idba4cfe628f2445c38b03a04ba0a72a35"><enum>(a)</enum><header>Agreements authorized</header><text>For purposes of facilitating the construction, alteration, operation, or maintenance of a new or existing facility or other infrastructure at a port of entry, the Administrator  may—</text><paragraph id="idD99645CD8EA9449A8B209E1CA60DFC31"><enum>(1)</enum><text>enter into cost-sharing or reimbursement agreements; or</text></paragraph><paragraph id="idB044283EC8A34C96BFA4DF6C4673D3F4"><enum>(2)</enum><text>accept donations of—</text><subparagraph id="id14E13A687E504F099772C260F6B86770"><enum>(A)</enum><text>real or personal property (including monetary donations); or</text></subparagraph><subparagraph id="id8C6D48E55BBD407BACFA7CA27B3ECCCE"><enum>(B)</enum><text>nonpersonal services.</text></subparagraph></paragraph></subsection><subsection id="idd0693e9485484d86b2819e67d9c8b5c1"><enum>(b)</enum><header>Evaluation procedures</header><paragraph id="id440439e047e64cf1a63995a56b1ac58f"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Administrator, in consultation with the Secretary, shall establish procedures for evaluating a proposal submitted by any person under subsection (a)—</text><subparagraph id="id89ed68b0030446189d1bb8aa80d003cd"><enum>(A)</enum><text>to enter into a cost-sharing or reimbursement agreement with the General Services Administration to facilitate the construction, alteration, operation, or maintenance of a new or existing facility or other infrastructure at a land border port of entry; or</text></subparagraph><subparagraph id="id355c6d098c144836b8ad7a2da9d783cf"><enum>(B)</enum><text>to provide the Administration with a donation of real or personal property (including monetary donations) or nonpersonal services to be used in the construction, alteration, operation, or maintenance of a facility or other infrastructure at a land border port of entry under the control of the Administration.</text></subparagraph></paragraph><paragraph id="id2211d851b5fd4bc8a335d335c7d16ac2"><enum>(2)</enum><header>Specification</header><text>Donations made under paragraph (1)(B) may specify—</text><subparagraph id="id701afbceff1f493a971165b22132f279"><enum>(A)</enum><text>the land port of entry facility or facilities in support of which the donation is being made; and</text></subparagraph><subparagraph id="idbcab1c4a9999429b8e480cc4d6c86d32"><enum>(B)</enum><text>the time frame in which the donated property or services shall be used.</text></subparagraph></paragraph><paragraph id="id0248563cea834b269b75a88bdf32f233"><enum>(3)</enum><header>Return of donation</header><text>If the Administrator does not use the property or services donated pursuant to paragraph (1)(B) for the specific facility or facilities designated pursuant to paragraph (2)(A) or within the time frame specified pursuant to paragraph (2)(B), such donated property or services shall be returned to the person that made the donation.</text></paragraph><paragraph id="id3db9254f07464f9baa9fa383084a4b4e"><enum>(4)</enum><header>Determination and notification</header><subparagraph id="idb4ce0b56ecd6463db53d4e6aa74673e8"><enum>(A)</enum><header>In general</header><text>Not later than 90 days after receiving a proposal pursuant to subsection (a) with respect to the construction or maintenance of a facility or other infrastructure at a land border port of entry, the Administrator shall—</text><clause id="id3b0cdd87eefb4881ae1d330ee3e8ecf7"><enum>(i)</enum><text>make a determination with respect to whether or not to approve the proposal; and</text></clause><clause id="idfe64a3bf4fcf493f8eeb3823662100ac"><enum>(ii)</enum><text>notify the person that submitted the proposal of—</text><subclause id="id305f21413f9e4cd4868d05c8d0203e12"><enum>(I)</enum><text>the determination; and</text></subclause><subclause id="idc672381493fe498bb55f6a542601d2a3"><enum>(II)</enum><text>if the Administrator did not approve the proposal, the reasons for such disapproval.</text></subclause></clause></subparagraph><subparagraph id="iddfa535b0eb394df78debea77c0ba06c6"><enum>(B)</enum><header>Considerations</header><text>In determining whether or not to approve a proposal under this subsection, the Administrator shall consider—</text><clause id="id5d147f7bd71b4732ac1fd9832fbe3770"><enum>(i)</enum><text>the impact of the proposal on reducing wait times at that port of entry and other ports of entry on the same border;</text></clause><clause id="id3e0825e6cc714dfab0e6e446853f2e5f"><enum>(ii)</enum><text>the potential of the proposal to increase trade and travel efficiency through added capacity; and</text></clause><clause id="id3d2f5420cb654979815695d92b600be7"><enum>(iii)</enum><text>the potential of the proposal to enhance the security of the port of entry.</text></clause></subparagraph></paragraph></subsection><subsection id="idd7845ceb16bf463688c5e768cb55942b"><enum>(c)</enum><header>Delegation</header><text>For facilities at which the Administrator has delegated or transferred to the Secretary, operations, ownership, or other authorities over land border ports of entry, the authorities and requirements of the Administrator under this section shall be deemed to apply to the Secretary.</text></subsection></section><section id="ida5f7fb68ad3e474ba2428c66d3dd9405"><enum>5.</enum><header>Implementation of Government Accountability Office findings</header><subsection id="id698a29057ddb4f12948c835080ea829b"><enum>(a)</enum><header>Border wait time data collection</header><paragraph id="idA58A6C3FD67F493AA92597AD3E0F30D4"><enum>(1)</enum><header>Strategic plan</header><text>The Secretary, in consultation with the Commissioner, the Administrator of the Federal Highway Administration, State Departments of Transportation, and other public and private stakeholders, shall develop a strategic plan for standardized collection of vehicle wait times at land ports of entry.</text></paragraph><paragraph id="id0e2b16d723b149a290b0224da7da4859"><enum>(2)</enum><header>Elements</header><text>The strategic plan required under paragraph (1) shall include—</text><subparagraph id="id3b66506e6aba4617a11d8cc5e86fed83"><enum>(A)</enum><text>a description of how U.S. Customs and Border Protection will ensure standardized manual wait time collection practices at ports of entry;</text></subparagraph><subparagraph id="idB348BBAA8C6945DFABD5BAEC4085DEEF"><enum>(B)</enum><text>a timeline for incorporating standardized data into existing online platforms for public reporting;</text></subparagraph><subparagraph id="idbd91d340d2dd4bc1a05c6992ec9bc6a5"><enum>(C)</enum><text>the identification of a standardized measurement and validation wait time data tool for use at all land ports of entry; and</text></subparagraph><subparagraph id="idabff14d993254d1393580dc38937ea5c"><enum>(D)</enum><text>an assessment of the feasibility and cost for supplementing and replacing manual data collection with automation, which should utilize existing automation efforts and resources.</text></subparagraph></paragraph></subsection><subsection id="ideeb7b2c80e494e6daba754b6e60bb8d1"><enum>(b)</enum><header>Staff allocation</header><text>The Secretary, in consultation with the Commissioner and State, municipal, and private sector stakeholders at each port of entry, shall develop a standardized model for the allocation of U.S. Customs and Border Protection officers and support staff at land ports of entry, including allocations specific to field offices and the port level that utilizes—</text><paragraph id="id1377BCEEFB314FC8A05A5EE14081CFAB"><enum>(1)</enum><text>current and future operational priorities and threats;</text></paragraph><paragraph id="idB1ADA954C4FB45BDAC02ADC0204CE2BF"><enum>(2)</enum><text>historical staffing levels and patterns; and</text></paragraph><paragraph id="id15696C427A804B2EA8DAF8023F88085E"><enum>(3)</enum><text>anticipated traffic flows.</text></paragraph></subsection><subsection id="id6ae37f42b2624817a310317ab8bd7a84"><enum>(c)</enum><header>Outcome-Based performance measures</header><paragraph id="idA9475979F7884E619235ACFA020E9E80"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the Commissioner and relevant public and private sector stakeholders, shall identify and adopt new outcome-based performance measures that support the trade facilitation goals of U.S. Customs and Border Protection.</text></paragraph><paragraph id="id3690ceb5e5ec49a683df707047c88f01"><enum>(2)</enum><header>Effect of trusted traveler and shipper programs</header><text>Outcome-based performance measures identified under this subsection may include—</text><subparagraph id="idc2510347f86240558a061dfd200e03a2"><enum>(A)</enum><text>the extent to which trusted traveler and shipper program participants experience decreased annual percentage wait time compared to nonparticipants; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9de081a88e424c65b38e2e4aa7e93155"><enum>(B)</enum><text>the extent to which trusted traveler and shipper program participants experience an annual reduction in percentage of referrals to secondary inspection facilities compared to  nonparticipants.</text></subparagraph></paragraph><paragraph id="idd9623ebc432f4137b3ea7e788632d482"><enum>(3)</enum><header>Report</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary  shall submit a report to the committees set forth in section 3(b)(1) that identifies—</text><subparagraph id="id0B3DE538DA6D4C868FE52A28A957C0A2"><enum>(A)</enum><text>the new performance measures developed under this subsection; and</text></subparagraph><subparagraph id="idD4F999F1370544669AB58A019E77194A"><enum>(B)</enum><text>the process for the incorporation of such measures into existing performance measures.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
